The HBA Works to Solve the Problems You Have as a Business PersonThe HBA is in the problem solving business. Your business benefits from strength in numbers. All of our efforts are focused on increasing your bottom line, keeping housing affordable and connecting businesses to other

businesses to improve your potential for years to come. Your local HBA and the National Association of Home Builders often survey our members to better define the problems that your business faces today and in the future. We constantly adjust in order to provide the best opportunities we can to help you solve your problems. Below are some of the top problems businesses face and the steps your local HBA is taking to address these issues. Overly restrictive regulations: The HBA’s advocacy efforts represent your company in the face of regulations. Our Land Development Council has six committees focused on Environmental Issues, Sanitary and Storm Water, Boone County Planning Commission, Campbell County Planning Commission, Kenton County Planning Commission, Powered Utilities, and Water Districts. The committees meet on an ad hoc basis to collaborate on new and existing regulations. They meet with the leaders in the agencies that affect your business regularly and are very effective at representing you in order to keep your cost of doing business as affordable as possible while helping to shape policy that streamlines the processes of land development. The Council is not only focused on residential development but also includes input from those involved in commercial development to help make the economy in Northern Kentucky a business friendly environment and that much better for your business. Our Housing and Building Codes committee works with local building inspectors and the state Board of Housing to ensure that building codes and the inspection process is a healthy and worth while application in our state. Kentucky is somewhat unique in that our building codes are vetted by committees at the Board of Housing before applied throughout the state. Members of the HBA and other HBA’s sit on these committees and help to make sure that the end result of code updates are as business friendly as possible. Our State and Local Government Committee maintains a constant relationship with elected officials locally and across the state. A dialogue is regularly kept with these individuals and allows our members a unique opportunity to provide feedback and encouragement with those that are elected to represent you locally and statewide.

Competition from other companies: HBA members have unique opportunities to position themselves head and shoulders above their competition. Our Registered Builder and Registered Remodeler programs allow our builders and remodelers to benefit from a level of achievement that simply cannot be bought off the street. Their reputation and mandated business practices are a hallmark of what a reputable builder or remodeler should aspire to reach. You will see a new approach to get the word out about these programs in 2013. Members can also benefit from participation in our consumer shows. Nowhere else in Northern Kentucky can business owners get in front of thousands of hot prospects so focused on newly built homes, remodeling projects and home and garden related products than here. You also have the chance to share peer to peer dialogue through our committees, social events and our education courses that help to grow your business. You can learn the latest in business practices, technical help, or simply have the critical conversation with those in your line of work to pick up those next three or four ideas that help take your business to the next level. We are constantly updating our education curriculum to provide courses that you need.

Ability to find skilled employees: Our Enzweiler Apprenticeship Program is growing by leaps and bounds. In the 2013-2014 school year we expect to double our size over the 2011-2012 school year. We have added courses in plumbing, welding, maintenance and remodeling and are looking at ways to expand our

carpentry program to help meet the needs of the recovering housing market here in Northern Kentucky. Our programs boasts over a 95% job placement rate; a rate unheard of in our area. We will host High School Seniors this fall in a new daytime education effort to create a true career pathway. High School to Trade School to work or college will be offered at the HBA building center.

Ability to reduce operating costs: Our AGC/SIF Workers Compensation Fund is one of the best opportunities businesses have at the HBA to save operating costs. The fund designs premium payments that adjust to your payroll. This plan is specifically designed for the construction industry. If you have a slow winter your premiums go down. If you experience a strong summer building season the premium adjusts accordingly. What’s more, if you have been in the program for four years, the fund pays dividends back to its participants. Dividend payments in 2013 will be just over $16 million statewide, up from $14.5 million the year prior.

Expanding market exposure: Our consumer shows and business to business events allow your company to experience valuable exposure at an affordable cost. In this type of environment you can create new business and consumer leads and steward and maintain existing business relationships. As a sponsor of our consumer shows you can step up your game and brand your business at a high level and with a rifled approach that gets your name out to a targeted group of consumers interested in homes and home products. As a sponsor of our business to business events you receive a high level of exposure through recognition and image placement that creates top of mind awareness with the outstanding decision makers that are the members of the HBA.

Health Care: One of the biggest concerns of business owners’ minds these days are the looming costs of healthcare due to the implementation of the Affordable Care Act. The law will go into affect on January 1st of 2014. The HBA’s Association Health Care Plan will benefit your business. If you are a builder, remodeler, developer, subcontractor, or a supplier who delivers your product to construction sites you will have the ability to participate in the Association Health Care Plan and avoid the ACA. Our plan will operate outside of the state run exchanges. While the exchanges will be mandated to “community rate” our plan will allow you to participate in a “risk rate” plan. What does that mean? Younger insured adults will be able to participate in a plan that allows them to benefit from the fact that younger people have less health concerns. The health care costs of younger professionals are far less than others. This brings the costs associated with health care plans under a “risk rate” system down well below those of a “community rate” system. You may enroll in the plan as a new participant anytime before January 1, 2014. If you are a current participant you must renew by July 2013. Companies with fifty employees or more are mandated under the ACA to provide insurance for their workforce. Make no mistake, the ACA mandates that every American must have health care whether it is provided by an employer or not. That means that if you actively work on the construction of a home you can participate as an individual in the HBA plan. The plan operates as if it were one large employer so the benefits of larger participation are a benefit to all in the plan.

Potterhill Homes Host Spring Member Mix & Mingle

Land Development Council Holds Annual Roundtable with Regional Infrastructure PartnersThe Land Development Council of the HBA held a roundtable meeting at the HBA’s building center on February 20th. The meeting was sponsored by Burlington Realty & Development.

The Council and its guests heard from Bob Yeager of the Kentucky Transportation Cabinet update the group on the currently funded road projects in Northern Kentucky as well as the two year and six year road plans. Road projects discussed included, KY 536 from Union to the AA Highway, roundabout design on the KY 536 project, and the new Mt. Zion Road interchange design. Bridge and road funding was discussed at length during Mr. Yeager’s presentation. After Mr. Yeager’s presentation the vast entities in attendance gave updates about what each were working on. Those in attendance included members of the Land Development Council, Boone County Planning Commission, Boone County Administration, Kenton County Planning Commission, Northern Kentucky Area Planning Commission, Campbell County Administration, Duke Energy, Owen County Electric Cooperative, Time Warner Cable, Cincinnati Bell, Sanitation District #1, Northern Kentucky Water District and the Boone County Water District. Make sure to attend the outstanding 2013 LDC meetings this year!

Spring was a no show for the Spring Member Mix & Mingle on March 7th. However, a large crowd of people did attend who were interested in

On February 21st a group of HBA leaders arrived in Frankfort to advocate on your behalf during the 2013 General Assembly. The group spent the day meeting with the Northern Kentucky

Caucus members one by one and attending the sessions in both the House of Representatives and Senate. The group carried messages on a handful of pieces of legislation. Two of the most important pieces of legislation were House Bill 365 and House Bill 378. House Bill 365 is a piece of legislation that would codify the HBA’s Group Employer Health Care program as a “bonafide” large employer group program. This bill would ensure that HBA members active in the construction of a home and those that deliver materials to the construction site can be covered under the HBA’s plan as an alternative to the Affordable Care Act. The insurance program would allow these members to “risk rate” instead of being mandated to participate in the state exchanges that would apply a “community rate”.

The plan would become far more attractive to younger members and would therefore bring the premiums of the health plan much lower than that of the state run exchange plans. House Bill 378 would create far more transparency for property owners directly and indirectly affected by the EPA’s listing of and measurement of “impaired waters”. The bill would

instruct the Kentucky Environmental Cabinet to list the impaired waters on its website and create an electronic notification system (emails) that citizens could sign up for in order to be notified when a water was considered for listing on the 303d list of impaired waters in the Commonwealth. At press time both bills had passed the house and had been assigned to committees in the Senate. The HBA send out regular notifications of bills and their progress during the General Assembly. Please be aware of any requests that come to members in order to participate so that we may help your business.

Beyond the specific pieces of legislation, it is extremely important that the HBA advocates on your behalf with state lawmakers. The HBA has had a long history of strong grassroots support with our elected officials. Your voice needs to be heard in Frankfort to make a difference. We are blessed with several members that are willing to take the time from their professional and personal lives to do just that for you at the state level. Efforts such as these make an impactful difference and ensure that your business is protected from harmful legislation and benefits from positive legislation at our state Capital. Visits such as these make an impact upon our elected officials. Please consider participating during our visits to the Capital during the 2014 General Assembly.

The Tommy Bright Scholarship Fund This scholarship was established to assist students achieve a more comprehensive understanding of how the United States Government operates. This will be accomplished by awarding financial aid to the scholarship recipient to attend an established governmental affairs program in Washington, DC.

The Betty Bell Scholarship Fund This scholarship fund was established to assist students in obtaining higher education in a building industry related field.

The Tommy Thompson Scholarship Fund The Tommy Thompson Scholarship is awarded to children of members of the Homebuilders Association of Kentucky to assist these children in their pursuit of a post secondary degree.

HBAK SCHOLARSHIPS

Federal law places an affirmative duty on employers to verify the identity and work authorization of all newly hired persons through completion of the Employment Eligibility Verification Form I-9 within three business days after the individual is hired.

The U.S. Citizenship and Immigration Services (USCIS) has issued a new Form I-9, Employment Eligibility Verification. The form is available for immediate use by employers, but employers may continue to use the previous version of the I-9 form (expiration date 8/31/12) until May 7, 2013. After May 7, 2013, all employers must use only the newly revised Form I-9 (expiration date 3/31/2016) for each new employee hired, or be subject to a civil penalty if audited.

The new form requires additional data, and expands the form from one page to two pages. Employers are encouraged to familiarize themselves with the new format and instructions. To download the new form and instructions, go to: uscis.gov/files/form/i-9.pdf.

FOLLOW TRAFFIC PATTERNS.Outdoor living spaces that are easily accessible from indoor rooms are the most likely to get used. When designing your patio, choose a spot that’s in your home’s traffic pattern, such as off the family room. Also, lay formal paver walkways, add walls, create shifts in hardscape materials, or plant trees & shrubs to establish borders.

PLAN AN OUTDOOR KITCHEN.Summer cookouts are always enjoyable events unless your time as host is spent running back and forth between the grill and your indoor kitchen. Keep all of the ingredients for outdoor dining close at hand. It can be as simple as a grill with storage cabinets for cooking gear or even a full kitchen with a grill, refrigerator, sink and eating area. Also, while a grill and counter for food prep are essential, a refrigerator and sink are not, but including these items can increase the value of your home by helping your outdoor kitchen qualify as a second kitchen.

PLANNING YOUR SPACE. Existing or new patios are great foundations for outdoor kitchens and fireplaces. You can add your kitchen or fireplace components without structural modifications. The side of or against the house may also be a great location for your outdoor living area. There’s no need to excavate for gas and electricity and the house will provide some shelter for the kitchen appliances and seating areas. Since yard space is usually at a premium, consider walls with seating (seat walls) or countertops with barstools to provide dining options.

ADD A FIRE SOURCE.A source of fire draws people - whether you are relaxing by the fire on a quiet evening or where larger groups can gather on a chilly night. If you have the space, consider a full size outdoor fireplace; or choose a fire pit, which provides flexibility and affordability.

Delays in residential construction projects are to be expected. Whether in the form of bad weather, material shortages, or scope changes, delays are inevitable. Contractors must expect and account for delays in their schedule. While it is impossible to foresee every possible delay that might occur, there are steps contractors can take to avoid or reduce delays.

Weather may very well be the most common reason for delays on a construction project. No one can predict the weather day-to-day, let alone for the entire length of the project. Nonetheless, the contractor should build some time into the schedule for poor weather. It may not be exact, but an estimation of “bad weather days” should take into account the time of year, historical weather data, and the geographical location.

Owner changes can often account for delays in the project as well. Effective communication with the owner may help to reduce these delays. Constructing a new home provides the owner with infinite choices and countless decisions. Often, this proves to be overwhelming. As a result, the owner may change his or her mind time and time again. However, he or she may not fully understand the implications of the changes – on the schedule or the budget. The contractor should work closely with the owner and fully explain the consequences of these changes. Communication may not eliminate owner-initiated changes, but it will help to ensure all parties fully understand the changes and agree with the implications of them.

Subcontractors may also cause delays in the project. Subcontractor delays can have a domino effect. If one trade is late in completing its work, it may delay another trade from starting or completing its work. That delay could cause another delay. Subcontractor delays may be addressed in the contract between the general contractor and the subcontractor. The general contractor may consider financial penalties for subcontractor delays. However, the subcontractor may not agree to such terms. Again, frequent communication with subcontractors can help. Developing good relationships with subcontractors can also be key. As with general contractors, subcontractors benefit immensely from referrals. In addition, subcontractors generally go into a job hoping it results in future work with the general contractor. Between effective communication, strong professional relationships, and the sub’s desire for additional work, the general contractor should minimize subcontractor delays.

Other potential project delays may include material shortages, delayed supply shipments, and inspections. The contractor should discuss with the owner the benefits of using in-stock materials and supplies. Further, the contractor should undertake careful planning strategies to ensure it orders materials and requests inspections at the appropriate times. Finally, strong relationships in the community can have a dramatic and positive effect as well. Delays can be drastically reduced if the contractor has a good partnership with its suppliers. Likewise, if the contractor knows and understands the inspection process and the individuals involved in the process, it can substantially cut down on such delays.

The best way to reduce delays is through relationships and communication thought it will not eliminate them. Contract provisions between the contractor and the owner, subcontractors, and suppliers can help to further minimize them. Where unforeseeable delays occur, contract terms can help to assign risk and responsibility. Ultimately, delays can result in financial burdens on all parties involved. It is best to assign the financial responsibility before the project starts.
