A lengthy discussion of Building Code issues featured an update of the existing code. Your fellow members are working to include more drawings into the code to better simplify the

interpretation process and to help builders follow the complex code. All code officials were encouraged to participate on the International Code Council (ICC) online voting process. We believe this process will allow for better, more representative, outcomes and should reduce the influence special interests have on adopting updates in the building code that result in the sale of their products. A voting guide was sent out to building officials as the vote was taken between February 8-21.

The Executive Officers from around the state met to discuss issues facing their respective associations and how what they do can benefit their members more. Topics ranged from an open discussion from NAHB Region C Field Representatives, workforce development and what your HBA and the HBA of Lexington are doing to solve the problem through our Building Institutes, association management issues, the upcoming MS4 Statewide Stormwater Permit, legislative visits with our Congresspersons and U.S. Senators, and planning future EOC meetings.

The Associates Committee met to discuss issues facing associates from across the state. The legislative and PAC meeting addressed specific bills that were working their way through the Capitol (see “Housing and Building Day at the Capitol p.10) During the PAC meeting specific statewide candidates were assigned contributions. As a matter of note, there are four PAC’s associated with HBA’s in the state. Our Political Housing Club of Northern Kentucky (PHC) is one of the PAC’s. Contributions from the PHC are matched in statewide races by the state PAC. In a recent PHC meeting it was decided to contribute to the following candidates who have opposition or occupy leadership positions in state Government. Senate Majority Floor Leader Damon Thayer, Chairman Senate Licensing and Occupations John Schickel, Representative Adam Koenig, Representative Dennis Keene, Candidate for Covington Mayor Jo Meyer.

A group of young members (40 and under) met to discuss doing business as a younger leader or business owner; something we may start

doing at this HBA…stay tuned. The next morning featured the actual Board of Directors meeting. Every local HBA with over 15 builder members is assigned 5 members to stand as Directors of the State HBA. Our Directors are Jason Yeager, Ashley Construction; Tom Spille, Spille Builders and Developers; Bill Cullen, Cullen Brothers; Mike Conklin, The Drees Company and Jim Frey, Pella. The meeting featured a presentation by Dwight Lovan, Commissioner of the Kentucky Department of Workers Claims and Corey Roblee, Field Director, International Code Council. After the meeting members were adjourned to return to their local associations.

There is currently no HBANKY representation on the State HBA’s Senior Officers ladder. We encourage members to step up and get involved in this fashion. Past Presidents, Past State Directors and others are especially well versed for this role. If you have interest in serving in this capacity, please contact us at your earliest convenience. We need volunteers to help us lead our efforts to represent you in Frankfort, not just with elected officials but at the agencies and offices as well.

The HBAK Winter Board meetings were held February 17 – 19 in Bowling Green, Kentucky. The full day of meetings on the 18th was capped off with a visit to the Corvette Museum that featured guest speaker, Senator Rand Paul, the association’s annual awards and installation of its 2016 Officers. A big congratulations go out to Watson Jones, C.K.

Ash Insurance, who won the association’s Gilbert Kittle Honored Associate Award, and Jim Cutter, Cutter Construction, who won the association’s Builder Achievement Award. We are very proud of our local members who go on to further serve our state association.

Charles G. Snavely was appointed by Gov. Matt Bevin as Secretary of the Kentucky Energy and Environment Cabinet in December 2015. Mr. Snavely is a graduate of Virginia Polytechnic Institute and State University with a B.S. in Mining Engineering and has recently completed the Executive MBA Program through a joint program of the University of Kentucky and the University of Louisville.

Mr. Snavely retired from the mining industry after more than 35 years, having served as a mine engineer and later president of several large coal companies in southeast Kentucky. He most recently was Executive Vice President of Operations for International Coal Group and President of Eastern Operations for Arch Coal, Inc. He is past chairman of the Board of Directors of the Kentucky Coal Association. He has received the Distinguished Alumnus Award from the Virginia Tech Department of Mining Engineering.

Housing and Building Day at the Capitol

Members from around our Commonwealth traveled to Frankfort on February 3rd to engage our Representatives and Senators on issues facing our industry. The day began at 8:30 with an

issues briefing featuring speakers Senator Chris McDaniel, a local member of the HBA and the Chairman of the Senate Appropriations and Revenue Committee and Representative Tommy Thompson, Owensboro, and Past NAHB President. Senator McDaniel focused on the Governor’s budget and the process he will undertake working with the Bevin administration as the budget works its way over from the House of Representative to the Senate. Representative Thompson highlighted the importance of staying engaged with state government and how the day’s visit will impact the outcomes in Frankfort. Issues were presented to those in attendance.

Following the briefing we visited with the following elected officials: Senator Chris McDaniel, Chairman Appropriations and Revenue; Senator John Schickel, Chairman Licensing and Occupations; Senator Damon Thayer, Majority Floor Leader; Representative Dennis Keene, Chairman Licensing and Occupations; Representative Arnold Simpson; Representative Sal Santoro; Representative Adam Koenig; Representative Diane St. Onge; Senator Wil Schroder; and Representative Addia Wuchner.

We voiced our support on restricting funds in the general budget to protect them from being swept (HB 30), Worker’s Compensation Subrogation which adds benefits to subrogation recovery (HB 200), Worker’s Compensation Temporary Total Disability which allows payments of benefits to be offset by wages paid by employers (HB 311), Economic Development Partnership adding a small business advocate (HB216), Exemption of radon certification requirements for new residential and commercial contractors (HB 272), expansion of the “costs of goods sold” to include those allowed by the IRS (HB292), Workforce Development taskforce which added an HBA member to the taskforce thanks to Representative Dennis Keene (HCR 97), establishment of Kentucky as a Right to Work State (SB3), exclusion of education buildings from the definition of “public works” (SB9) and special districts and special purpose government from having to pay prevailaing wage (SB94), and removal of a landlord from liability for injuries caused by a tenant’s dog (SB 68).

We opposed two bills; HB 144, allowing public access to private lands for cemeteries, and HB 159, mandating Master HVAC contractors to remain on site the entire time while work is performed, edging out property maintenance companies from the ability to make some repairs

to HVAC systems and mandates that a licensed HVAC technician to install range hoods over larger cooktops is certain CFU of airflow requires inflow of fresh air.

There was much talk of the budget and the $100MM bond release the Governor has assigned to workforce training programs as it relates to the Enzweiler Building Institute and the Building Institute of Central Kentucky. Additional dialogue encompassed the Stream Restoration Program at NKU and how the adjusted mitigation units have quadrupled in recent years; costing commercial builder/developers hundreds of thousands and in some cases halting projects altogether.

Building a Community and Bringing in JobsCommercial builders and developers are unique because the clients they attract are unique. Just as home builders rely on trusted industry professionals to provide products to build their homes, commercial builders rely on local people and services to outfit their buildings to meet their clients’ needs. However, each client has different needs. Some might require advanced technologies to build equipment or a workforce with unique skills or access to specific transportation mediums. Commercial developers in Northern Kentucky sell not only the buildings, but they help market the region that employs uniquely skilled workers and products that support new businesses.

“Everyone knows we have a huge manufacturing industry, but I think most people don’t realize the level of complex, high tech work that goes on in our community. That’s a true benefit to working in the region,” Shad Sletto, EGC Construction Corporation, emphasized. He explained the importance of having a dynamic manufacturing base to support other

industries coming in to Northern Kentucky. “As commercial builders, we build facilities for large companies and they’re all different. We have to work with each of those companies on creating space for their specific needs, so we interact with a variety of manufacturers that provide services our clients need to produce their own products or services. Our clients’ needs tie us into this vibrant manufacturing industry. Northern Kentucky has the benefit of not having to go outside our territory to find skilled labor, but what many people don’t realize is that we have robust, skilled manufacturing businesses that support the industries coming in,” he said, noting that a big selling point for commercial developers is the fact that potential businesses can find the products and people they need right here without having to ship equipment or supplies in.

Commercial Council Expands Voice of NKY’s Building Industry By Stacy Smith Rogers

With the recent addition of HBANKY’s Commercial Council, the association’s voice has expanded to include representation of commercial building interests, bringing together companies who help bring in jobs and businesses that will keep Northern Kentucky a vibrant place to live and work. The Commercial Council is a natural fit for the association to address complex issues affecting the development of commercial and industrial properties throughout Northern Kentucky. Many issues that home builders face are also road blocks for commercial developers, especially with regard to land development and smart growth. Working together will allow HBANKY to generate an increased awareness of those issues and to exert a collaborative effort to improve the building process and keep the community a competitive marketplace.

Sletto emphasized the fact that manufacturers play an important role in the commercial building industry, and when obstacles prevent the commercial building industry from moving forward, it doesn’t just make an impact on building, it has a trickle down effect that makes a difference for the whole community. Stream mitigation fees are a good example that Sletto used in an analogy. “Not only are the fees over the top, but the process is frustrating. It’s like going to the store and wanting to buy a pair of nice shoes, but before you can buy those shoes, you have to pay a tax. However, you’ll have to wait a year before they fit your foot and the cost is $470 per linear foot,” he explained. Sletto emphasized how that makes it hard to sell to clients who are comparing building a business in Northern Kentucky with other competing markets. top-of-mind when encountering future buyers. In the real world, he or she might connect with you on how to partner together to market your product and save you the headache of finding interested buyers and let you focus on what you do best

– building homes.

Partnership is a Benefit for All MembersJohn Curtin, Paul Hemmer Company, noted the value that partnering with HBANKY has for the commercial building community.

“When the association was working on zoning ordinances in Boone County, I attended a number of those meetings and realized that the HBA had a strong voice throughout the community and state and could get things done. Working with the association is an outstanding way for commercial builders to be heard.” Curtin said he’s been impressed by the association and it’s outreach. “The more I got involved, the more I realized they have an impact on getting things done. They asked me if I would be a member on the Board, representing the commercial building industry. I’ve been very impressed with how the HBA has come together and resolved important issues,” he explained.

Curtin said that commercial builders in Northern Kentucky are seeing increased activity.

“Coming out of the recession, there was a pent up demand for new spec distribution buildings to be built. Business is definitely picking up again,” he offered, reporting that Hemmer has been

involved recently in building a near 900,000 square foot facility that was immediately rented out when they broke ground. The company is working on another 650,000 square foot facility that’s rented as well and more prospects are in the pipeline.

Like Sletto, Curtin cited stream mitigation fees as one of the major challenges commercial builders are currently facing. “The mitigation costs are skyrocketing, adding layers of costs to each project and stunting growth,” he said, emphasizing the importance of the commercial building industry in partnering with the Council. “Our goal is to engage more commercial contractors to join the association. There’s strength in numbers and it’s a great voice for our industry. In Northern Kentucky, there are a lot of hills and streams, whereas in Indianapolis it’s mostly flat. If you have a company or homeowner who wants to build and realizes all the fees associated with it, they’re not going to come here.”

HBANKY Executive Vice President Brian Miller explained the association had been working with commercial building representatives for over a year before officially forming the Council. “We had actually been talking to them since 2009, but in 2014 we made a concerted effort to make it official. It’s a task-oriented structure, so we don’t hold regular meetings. When issues arise, we simply send an email or pick up the phone to pull together,” he explained. Miller said the association is currently representing the Commercial Council by working with NKU on addressing the stream restoration mitigation fees. In addition, the focus is on working with SD1 and growth and environmental issues that

affect both home building and the commercial building industry.

“We’ve taken a hard look at the incentives and disincentives to growth in each of the cities in Northern Kentucky and we’re now in the process of getting that data out. What we found, among many things, is that Kenton County’s growth is slowing in comparison to Boone and Campbell Counties’. We’ve identified areas for economic growth and the infrastructure required to support an industrial base and have proposed a set of recommendations. We’re determined to demonstrate the big picture of the economy and how development plays a role in improving the community.”

Miller emphasized that the Council is a great benefit not only for the commercial members but for the entire membership base. “Our Commercial Council is comprised of some of the major economic drivers in the community. So, when we walk into a meeting with their support, people notice. Our impact is stronger. We’re now basically advocating for everybody who moves dirt and puts stuff on it,” he explained. Miller emphasized that the Council also makes a difference within the association’s advocacy efforts. “We truly offer consolidated advocacy services from one entity that’s a warehouse of knowledge and can make real change happen. Nobody lobbies locally like a builder association. No one else is driving to Frankfort to get things done.”

New Homes Benefit More than Just Buyers and Builders

The only people who benefit when a house is built are the family members who get to live there, and the builder who constructed and sold the home, right?

Wrong. The positive impact of new residential construction is far-reaching, bringing benefits to families, businesses and services throughout a community immediately, as well as for years to come.

According to economists at the National Association of Home Builders, the one-year estimated local impacts of building 100 single-family homes in a typical metro area include $28.7 million in local income, $3.6 million in taxes and other local government revenue, and 394 local jobs.

But what does that economic impact mean in the real, day-to-day lives of community residents?

Just think about it. When a family moves to a community and buys a new house, they will likely shop at local stores to buy furniture and accessories to decorate the home. They will fill their car’s gas tank at local gas stations so they can get to the stores, have local mechanics work on the car when it breaks down or needs the oil changed, or buy a new car at a local dealer when it’s time to replace the old one.

The family may need to hire local companies for regular services to maintain their home, such as landscaping, house cleaning, pet sitters or pool upkeep.

The children will enroll in local schools. This increases enrollment, meaning more teachers, janitors, cafeteria workers and other school support staff will need to be hired. Those kids will also join sports leagues and other activities, buy equipment and pay registration fees that provide stipends for referees and coaches.

All of this economic activity puts income into the pockets of local business owners and their families, who can then afford to go out and spend money themselves, which recycles even more money into the community’s economy.

The new family also pays local and state taxes. These tax revenues help pay for a wide range of government services, including school teachers, police departments, refuse collection, parks maintenance and road repairs.

Over the long term, as the families who move into new homes become part of the community, their positive impact continues. NAHB estimates that those 100 new homes also provide the community with additional, annually-recurring impacts of $4.1 million in local income, $1 million in taxes and other revenue for local governments, and 69 local jobs.

Families who buy a newly built home enjoy benefits including safety, amenities, energy efficiency and floor plans to fit a modern lifestyle. But the advantages of new homes extend far beyond the buyers and the builders—residential construction has a positive, direct impact on the local community for years.
