The State of Construction in Northern KentuckyHow the HBA helps you solve one

of your largest problems…steady supply of skilled tradespersons

Not but just seven years ago the building trades were growing, flush with skilled workers and ready to show up on

your job to help you build the dreams of Northern Kentucky. Today, while we are climbing out of a devastating economy those workers are not there as they once were. There are a multitude of studies and data that shows the skilled construction work force is experiencing serious shortages. As the recovery that our industry is experiencing continues the problem will only be that much dire. Recently, NAHB executive officers conducted a survey of young business people in our industry (those born after 1965). What they found is that the ability to find skilled tradespersons was one of their top three problems they face. The U.S. Department of Labor Statistics released data in 2012 stating that five million new jobs will be added in three areas. Not surprisingly one of the largest areas of job growth will be in construction. According to the Bureau nine of the thirty fasts growing jobs will be in construction. Depending on your specific trade jobs are expected to increase between forty to sixty percent between now and 2020. To see how serious the situation is perform a Google news search for “construction skilled labor shortage”. The amount of news out there is alarming. This problem has come to light in the face of good news.

In Northern Kentucky our single family home permits rose nine percent in 2012 over 2013. Other areas of the country that were harder hit during the downturn are experiencing a sharper increase. Many of them have seen increases around forty percent or greater. The good news for Northern Kentucky is that we see bright signs of optimism in the near future. Single family production is expected to increase twenty percent in 2013 over 2012, remodeling should reach normal levels by mid year, and multifamily production is practically back to where it was prerecession.

Over the last few years, and as the recession drug on, many traditional construction trades programs withered away. Many of the area technical colleges closed programs and in one case our largest County High School system in Northern Kentucky discontinued their traditional programming. Many programs have transitioned to robotics, technology, and other emerging trades. While that will help fill the voids in other sectors of our economy it does not help our industry. The housing industry is the only manufacturing industry that cannot be replaced outside of the boundaries of our country. A home in Northern Kentucky must be built in Northern Kentucky no matter whether that home comes as a single family or multifamily home. That home is here and must be supported by you, our industry, right here in Northern Kentucky.

The HBA is in the problem solving business and this is a problem that we are working to solve. Over the last two years we have been expanding our skilled trades programming. For years we have been concentrated on electric, carpentry and more recently HVAC. In the last couple of years we have added a remodeling and maintenance program, a plumbing program and an incumbent welding program. All of the programs are a certified two year program, with the exception of electric

which is a four year certified program, and welding which is a program that helps those in our other programs add valued skills to their abilities to help you. When a student leaves our program they receive a certificate from the Department of Labor, are accelerated towards earning their journeyman’s certificate and earn 24 hours of credit at Gateway Technical and Community College. Our programs are different. They are hands on. This means that your workers receive valuable experience both on the job and in our programs unlike any other program offered in our area. The graduates of our programs not only learn the basics and theories of their chosen skill but come to you ready to work with no other training necessary. As a result we enjoy the largest job placement rate of any trade school in our area and are seeing huge growth in enrollment. The placement rate is over ninety-five percent; a number unheard of in any such training program. Our first year enrollment in the program practically doubled. This means our graduation in April of 2014 will produce 100 skilled tradespersons ready to go to work.

So what does the future hold for our trades programs? This summer we will have training programs for at risk young adults. We will bridge the gap between high school and skilled trades training as we will open our first daytime high school program. High School seniors from all over Greater Cincinnati will attend construction programs in the afternoons in our building center. These individuals will come to us fully funded and ready to pursue construction as their chosen trade. We are looking for new programming to add to our curriculum in the coming years. Our goal is to supply the construction industry in Northern Kentucky with every skilled trade needed to build the American Dream.

If you ever get the chance to investigate our programs please take the time to do so. We are taking applications now for the 2013-2014 school year. As of today, we are almost half full with some programs already at maximum capacity. Members can send their employees through our programs at a discounted rate; another great member benefit of the HBA. The money spent as an investment in your workers is extremely low at the HBA compared to all other alternatives. It is one of the best things going for you at your HBA. 2013 HBANKY’s Table Top Night sponsored by Florida Tile at Horseshoes Casino in downtown Cincinnati promises to be one of the best attended TTN’s in years. Cheryl Stegman committee chairperson, along with her committee has prepared a plan to give the maximum exposer to our vendors. Each Registered Remodeler, Builder and Developer will be given two complimentary tickets to the event. During the evening door prizes will be drawn especially for them every fifteen minutes. In order to be included in the drawing it is necessary for a designated number of tables to be visited.

All attendees (even those who qualify for complimentary tickets) must contact the HBANKY office to reserve their ticket. Due to the venue, there will be no tickets sold at the door on the night of the event. Everyone who plans to attend must make their reservation prior to Tuesday, March 20th.

The tickets whether complimentary or paid in advance include drink tickets, appetizers, parking and a chance to win door prizes. The HBANKY will not be mailing actual tickets. All attendees upon arrival will visit the registration table to obtain a badge, parking validation and drink tickets.

At the end of the night all members who attend will come out winners. Some will take away door prizes from the 30 vendors, Builders, Remodelers & Developers will leave with cash, and all will have benefited from the networking.

Table Top Night will be held in the Horseshoe Pavilion Ballroom on the third floor of the Casino. HBANKY members will enjoy on-site parking with direct access. It has been suggested that our members park on the fourth floor of the parking garage. The garage is easily accessible from Reading Road or Gilbert Avenue. Once you are in the Casino look for the “Pavilion” signage.

Something unique to the 2013 Table Top Night will be the lay-out of the tables/booths. The committee during planning was committed to creating equality for all vendors. With this in mind the tables will be arranged in the shape of a horseshoe. Food and beverages will be located in the middle. This should eliminate a table being in a “bad spot”. This also allows good access for our members to visit all tables/booths.

A few other things HBANKY members will notice about the 2013 Table Top Night is there will be no live racing – of mice or men! There will also be no themes. Builders will not be auctioned off to the highest bidder. Pipe and drape has been eliminated as well. Our 30 booths will be the feature of the night. They will be there to showcase their products

and to talk to you about the advantages of member to member discounts. There will be fun, networking and chances to win door prizes. You will not want to miss one of the biggest networking opportunities of 2013.

Last, this event would not be possible without the dedication of the TTN committee and the sponsors. The HBAK has 3 scholarships to give away! The deadline is April 15.  There are 2 - $1000 scholarships and 1 - $500 one. The applicant’s parent or grandparent must be an HBAK member and their major is not limited to construction related fields. The scholarship can be awarded to any college student – does not have to be an incoming Freshman!

The Tommy Bright Scholarship FundThis scholarship was established to assist students achieve a more comprehensive understanding of how the United States Government operates. This will be accomplished by awarding financial aid to the scholarship recipient to attend an established governmental affairs program in Washington, DC.

The Betty Bell Scholarship FundThis scholarship fund was established to assist students in obtaining higher education in a building industry related field.

The Tommy Thompson Scholarship FundThe Tommy Thompson Scholarship is awarded to children of members of the Homebuilders Association of Kentucky to assist these children in their pursuit of a post secondary degree.

1. TRUE OR FALSE: Kentucky’s Fairness in Construction Act applies to residential construction contracts.

ANSWER: FALSE. Kentucky’s Fairness in Construction Act includes provisions such as prompt payment to subcontractors and retainage. While these provisions apply to both public and private construction contracts in Kentucky, residential and utility construction contracts are excluded.

2. TRUE OR FALSE: Kentucky statutes include a “Pay when Paid” requirement.ANSWER: TRUE. Kentucky statute requires that all contractors pay all subcontractors

and suppliers in full out of sums received from the owner. If the contractor does not receive enough to pay all amounts owed subcontractors and suppliers, it must be pay them on a pro rata basis. If there is a good faith dispute as to the amount owed, such disputed amount may be withheld by the contractor until the dispute is resolved.

3. TRUE OR FALSE: A buyer can terminate its agreement to buy a home before closing.ANSWER: IT DEPENDS. There are often contingencies included in the contract

that allow the buyer to terminate its contract. This may be especially true of already-built spec homes. For example, there may be a financing contingency in the contract. If so, as long as the buyer used reasonable and good faith efforts to obtain financing but was unable to do so, the buyer could terminate the contract. A contingency may also be included regarding the buyer’s sale of his current home. If this contingency exists, the buyer has a valid reason to terminate if his home does not sale before closing.

The buyer may also have grounds to terminate if there are defects found in the home upon inspection. There will likely be language in the contract as to when the buyer must find and notify the builder of the defects. Further, the builder would likely have an opportunity to correct any defects.

4. TRUE OR FALSE: The builder can force the buyer to purchase a home if the buyer does not have a valid reason to terminate the contract.

ANSWER: FALSE. The builder can bring suit against the buyer for damages; however, it cannot force specific performance and force the buyer to purchase the home. The builder can seek all damages resulting from the buyer’s breach, including costs incurred by the builder to maintain the home until it sells, advertising costs to market the home, the difference in the contract price and the eventual sales price (if less), and potentially attorney fees, if included in the contract. It should also be noted that the builder may need to mitigate its damages. For example, it should actively market the sale of the home. Failing to do so could result in a reduction in the builder’s damages by the court.
