Recently, I attended a meeting at the US Fish & Wildlife Service (USFWS) Frankfort office to discuss Endangered Species Act issues arising from their rules about the Indiana Bat in Kentucky. With us were members from Louisville and our HBA of Kentucky Executive Vice President, Bob Weiss. As a result of their regulations you can only clear trees at particular times of the year between October 15th and March
31st. The USFWS is not enforcing or actively looking for violations unless a developer pulls a nationwide US Army Corps of Engineers (ACOE) permit. They have many options available to comply with the regulations but they are pushing you to simply pay them cash; up to $3,250 per acre to clear during summer months; half that much during the months just mentioned.On another front the USFWS is consider a “mega listing” of potentially new endangered species as a result of a threat of a lawsuit by two environmental groups. Dozens of these species live in Northern Kentucky. If these species become listed it will be more money out of your projects and more dates on a calendar when you can’t work.
Still another example of damaging regulations is a practical doubling of a list of plant species used to identify a wetland; where you can’t build. This list maintained by the ACOE used to be easy to identify the difference between an upland and a wetland; not the case today. They changed another step in the process as well. In many cases this leads to two years of testing; another two years you can’t develop or build.
What’s more, the US Environmental Protection Agency (EPA) has proposed a new rule which defines Waters of the US (WOTUS). At press time the proposed rule has been met by nearly 300,000 comments nationwide. Your HBA is submitting comments and is working with other organizations locally and statewide to help them do just the same. If the new rule were to go into effect there would be less land to develop as a result; more delays in construction and development.
Couple these things that are coming with all of the state local regulations, SD1’s consent decree with EPA, the whims of elected and appointed officials and a slow economy and it can get bad….really bad. You may ask why this is important to you. Maybe you don’t develop or build but you sell windows, mortgages, flooring or another product used in construction. Here is why it is important…you will sell less, make less and have less for future generations. How much? Consider this…nationwide 29% of the cost of a new home is from regulations. 60% of that is from land use and environmental regulations alone. For every $1,000 increase in the cost of a home in our metropolitan area 1,600 households are unable to purchase that home.
How long can the steady march of environmental regulation be sustained before the industry can no longer make a living building homes, stores, or industrial operations? Personally, I don’t know. I do know that the day of small developers is soon behind us already. A national builder or large commercial and industrial operator can comply easier than a smaller company. As an association that largely supports small business it definitely has us concerned.
Fortunately the National Association of Home Builders regulatory department is challenging the federal agencies, your state HBA is working in Frankfort and your local HBA is working to lessen the impacts of regulations upon your business. While you may not be directly involved or impacted by these rules you are definitely impacted. If affordability and the profit from building not only homes, but everything else dries up we will all be impacted. That is why it is important to vote. These agencies are watching the upcoming elections. It is also important to support the efforts of those in the HBA working on these issues. You may not have the engineering skills or knowledge about environmental regulations but many here do. They need your support and encouragement for our advocacy services at our Land Development Council, Building and Housing Codes Committee, State & Local Government Committee and our fledgling Commercial Council. They need your PAC donations for our political fundraising.
We all want a bright future for our environment and nobody wants dirty air or water but we also need to have a vibrant economy and thriving construction market to pass on to future generations. The Year of Living Boldly brought us three hours of pure inspiration, exposure to new ideas and tools to place ideas into action. Jeff Shore truly believes that the difference between average salespeople and
top salespeople is not a matter of experience, intelligence or personality. He says that top performers stand apart because they BOLDLY live outside their comfort zone. Top salespeople recognize that obstacles equal opportunities. Jeff went on to say that each sales person should ask his or her self, “am I doing this for myself or for the customer?” He suggests that we find those shiver moments. What does not challenge you does not change you. A moment of discomfort equals a moment of decision. Challenge yourself to not chase comfort, but to be BOLD.

Cincinnati has one of the most visually striking and impressive skylines in the Midwest. This asset has created
significant demand for skyline views from both sides of the Ohio River. The demand for skyline views has also created unique opportunities for homebuilders and buyers. But the demand and
desire for city views has also spawned a complicated regime of zoning regulations throughout the region.
Recently, local news outlets have been replete with stories about the impact that zoning regulations have on areas which enjoy exceptionally good vantage points of downtown Cincinnati. For instance, in Newport, Kentucky, it has been reported that residents are sparring with a developer over the construction of a new home. Current residents say that the new, 35-foot tall home will destroy their existing views of the downtown skyline. The homebuilder has pointed out, however, that the height of the planned construction complies with Newport’s zoning regulations. And absent zoning protections, a homeowner is simply not entitled to their view of Cincinnati. This leaves the existing residents with little recourse other than a protracted and uphill legal battle.
On the northern banks of the Ohio River, a similar fight is playing out in the Cincinnati neighborhood of Mt. Adams. That debate surrounds a proposed zoning change which would increase the building-height restrictions in the neighborhood from 35 feet to 85 feet. Current residents have mounted a campaign to prevent this change from taking
place, arguing that the construction of 85-foot tall buildings would negatively impact the dynamic of the community and destroy residents’ existing views of the Cincinnati skyline. Unlike the residents in Newport, however, the view-obstructing zoning change in Mt. Adams has not been finalized. So existing residents have the advantage of using the political process in order to prevent the height restrictions from being raised -- a less expensive and more effective way of addressing the issue.
What’s the lesson from all of this? Pay attention to the implications created by zoning regulations. In Northern Kentucky -- which contains a large collection of separately governed cities -- the zoning regulations can be drastically different throughout a relatively small geographical area. Homebuilders and buyers need to be aware of this fact, especially when considering a house with a view. For those looking to protect their views, consider placing additional zoning restrictions on building heights. For those looking to develop residences with great views of downtown, consider pursuing a change in the zoning requirements to allow for taller structures.
Regardless of your views on this matter, the demand for views of the downtown skyline is unlikely to subside. This makes it more important than ever to keep informed when it comes to zoning regulations in Greater Cincinnati.
