The State of Construction in Northern KentuckyOur industry is recovering from what can only be described as an economic nightmare. But the good news

is that we are indeed recovering. Several bright areas continue to grow as we go headlong into the recovery. Home price appreciation is on the rise, our HBA membership is at the verge of stabilizing and even growing, and demand continues to increase for homes and commercial buildings. But with recovery comes many challenges such as a healthy construction labor force, increased regulations, changing business models and consumer confidence. Our members face these challenges daily and the HBA is poised to help solve these problems.

In 2012 we saw a 10% growth of single family permits in Northern Kentucky. While that certainly does not put our industry back on pace with 2005 it is a welcomed improvement for the single family portion of our industry. Multifamily permits rose dramatically in 2012 doubling production over 2011. That portion of our industry is expected to regain full strength in the next year. Commercial construction posted impressive gains in our area, more than doubling activity, as companies are moving into Northern Kentucky and other businesses are picking up where they left off prerecession. The last few years has seen a rebound in residential and commercial remodeling as homeowners and businesses decided to stay put and make their current situation work for them. Both residential and commercial remodeling kept pace with 2011 which was a vast improvement over previous years.

Other fundamentals of a recovery are showing signs of life. Home price appreciation in Greater Cincinnati has improved for the last 90 days. This has not happened since 2006; the beginning of the recession. The NAHB Improving Market Index has more than doubled in the last few months. Of the 376 Metropolitan Statistical Areas (MSA) 242 of them were listed on the index of improving markets. The index tracks employment, building permits, and home price appreciation. It is a six month average. Our MSA has been listed on this index for several straight months. NAHB’s Housing Market Index at press time was holding steady at 47. This means out of every 100 builders 47 thought the market was currently better. This index includes current sales, future sales and sales traffic. In January current sales scored at 51, future sales scored at 49 and traffic scored at 37.

One of the most notable points of good signs is the investment in publicly traded homebuilders and specialty retail companies. Many of the publicly traded builders have posted stock earnings.

Of the nation’s three largest homebuilders there has been impressive advancement in their stock price. A year ago Pulte Homes’ stock price was $7.29. At press time the price for Pulte was $20.54. D.R Horton and Lennar, the nation’s 2nd and 3rd largest builders experienced increases as well. In the beginning of 2012 their stock was $13.49 and $21.33 respectively. At press time that stock was priced at $21.51 and $41.94. Given the fact that the market has been known to be an advanced indicator for homebuilding we may be on the verge of a stronger comeback in 2013.

Our HBA continues to boast one of the largest memberships in our national federation. Our show, HomeFest, is back again in 2013 in The Equestrian section of Triple Crown, Parade of Homes is in Saylor Woods near Independence, the Cavalcade of Homes will run again the first three weekends of May and the Tour of Remodeled Homes will feature beautiful projects across Northern Kentucky in October. We do these to continue to connect members with their customers. We have been in the top ten HBA’s during the economic downturn and are poised to help you solve the problems in the recovery as it continues. However, we are hearing stories locally and across the country of a labor shortage in construction. “There aren’t enough framers for the homes we are building…HVAC technicians…electricians…” is just one of many anecdotes we hear around the HBA. When we reach out to other HBA’s in our federation we are hearing the same thing. During the recession many traditional trades training opportunities vanished in Northern Kentucky and Greater Cincinnati. Your HBA took that opportunity to expand our programs and grow our trade school. The 2012-2013 Enzweiler Apprenticeship Program enjoyed its largest first year class during our school year in 16 years. We have expanded our curriculum as we now offer a two year plumbing certificate, two year maintenance & remodeling certificate as well as a one night per week incumbent welding training program. In the 2013-2014 school year we are going to take additional steps to make sure you have a qualified and skilled construction labor force to handle the recovery. We will open a second four year electrical program and double the size of our incumbent welding programs. The most transformational change we will create this year is a new High School Senior daytime program at our building center. This will keep the construction trades at the top of mind of tomorrow’s skilled tradespersons and your future managers and company owners. A direct pathway from High School to Certified Trades Training to work will all be happening right here at our own building center. If you ever have a chance to visit our traditional trades programming in

the evening you owe it to yourself to visit our center. If you are need of skilled workers you need to call us. Our job placement rate is well above 90%; the area’s largest rate; bar none.

As the recession drug on the pace of regulations increased. With the current administration in Washington DC we have seen new and severe regulations regarding stormwater, endangered species, wetland plant indicator species, and sustainable and livable communities initiatives. Locally we have seen the updates of comprehensive plans, subdivision regulations, and zoning regulations. The work of the volunteers and your staff at this HBA have saved you thousands of dollars in lessened regulations, fees and other costs as well as worked to streamline the processes you go through in doing business. These victories will be covered in more detail in an upcoming story in future months.

As we work to get back to what will be our “new normal” things have changed in the face of slowed production. New companies have entered the construction industry that are more technical savvy, younger, and able to do business differently. We provide group and one on one training for members to learn about new technologies or help them to hone their edge on their current business practices. For newer companies looking to make it we provide one on one and group educational opportunities to learn the basics of doing business; whether that mean estimating, accounting or other professional development services.

As you can see, our HBA has been restructuring its business model. We are focusing more on education to meet the demand for tomorrow’s workers and managers and to help the company owners today and tomorrow to make sure they are as competitive as they can be. I became involved with my local HBA via my local Women’s Council. I was in my early 20’s and my mom talked me into going to a meeting with her. Most of the members were my mom’s age and involved in the business along with their husbands. Not the group I thought I would want

to hang out with. I couldn’t have been more wrong. These women became my mentors. Aside from the obvious person (my mom, who worked along my dad for years and years to build a business that anyone would be proud of, while raising a family and working elsewhere), Jean Miller stood out. Her passion for this industry became my passion. Aside from all the good that the Women’s Council did, it was here that I was taught a valuable lesson. A lesson that we all should remember and continue to practice every day. I can still hear Jean saying these words to us. “This industry puts food on my family’s table. It put my two sons through college. It puts a roof over my family’s head. We owe it to this industry to support it.” What other reason could you need?

Unfortunately our industry does need more reasons to have your support. Those reasons are the purpose of my article. “What does my membership do for me? Well as Jean taught me, everything. But for those who need more, let me tell you the monetary gains my family’s business has seen from our membership in this great organization we call the Home Builders Association.

My family’s business is Star Building Materials. We specialize in masonry products. Like everyone else in this industry, we have suffered from the downturn in the economy. Since we sell brick, we need the housing market to be strong. Lucky for us we are located in the great state of Kentucky. Your State Association has negotiated the best reason for us all to belong. The ACG of Kentucky where you get workers compensation at a hugely discounted rate. Along with that come the yearly dividends that we receive from them. Our last dividend was $2768.28. Since we are a supplier and not a builder, our rates are much lower. If you’re a builder your dividend would have been much higher. This dividend is more than 5 and ½ times our yearly dues of $495.00. I don’t need to go any further in telling you why you should belong but I feel the need to continue. Star uses the Speedway gas card also, another state program available for you and your business. We get $80.00 to $90.00 per month off our bill. Again, much more than our annual HBA dues. Then we use the FedEx discount offered to all HBA members. Not that we ship a lot but again what we do use would pay at least ½ of our yearly dues. Just with these very few examples, we save $3978.28. As I see it we are up $3483.28.

Hmmm. Is anyone catching on here? Dell, Hertz, FTD Florist, Office Depot, Omaha Steaks, Paychex, Verizon phones, Lowes (don’t tell my hubby about this one please), Budget, Wyndham hotels, HP, GM ( a new truck would be nice) , and so many more offer discounts for your membership in the HBA. This isn’t even touching on benefits like education, scholarships and advocacy for our industry, which I feel is more important and it is.

Bottom line is I think you should belong because of what my mentors taught me. But if that’s not enough , the extra discounts we discussed should be. Support your industry. It supports you!

Imagine this common scenario amongst neighboring homeowners – a married couple recently adopted a puppy and wants to build a fence around their backyard. The couple digs out an old land/

property survey to determine a location for the fence. During a walk-through of their property, the couple notices that their neighbor’s shed encroaches into their property line. Unfortunately, the ideal path for the fence is directly through the shed. The couple confronts the neighbor, and he refuses to remove the shed.

Common sense dictates that the law should require the neighbor to remove the shed from the couple’s property. However, in certain situations, the neighbor may have actually acquired actual title to the section of encroached upon property. This is known as the law of adverse possession.

In Kentucky, to acquire another’s land through adverse possession, the individual claiming possession must satisfy all of the following elements:

ACtuAL POSSeSSION- the claimant must actually possess the subject property. Kentucky case law has held that occasional entries onto property, marking a property line, cutting bushes and the occasional sowing of grass seed are not enough to establish actual possession. However, erecting a fence or a building may be sufficient.

HOStILe POSSeSSION- the claimant must possess the property without mistake as to the true location of his boundary line and without the permission of the legal owner. In other words, the claimant must know that the property he is trying to possess does not legally belong to him.

OPeN AND NOtORIOuS uSe- the claimant must use the property in an open and notorious manner sufficient to notify the legal owner that the claimant is possessing his property.

exCLuSIVe POSSeSSION- the claimant must possess the property without the concurrent use of the legal owner. For example, if a claimant builds a structure on a neighbor’s property, there is no adverse possession if the claimant and the neighbor share use of the structure.

CONtINuOuS POSSeSSION- All of the above elements must be satisfied for a continuous period of fifteen (15) years.

In the above example involving the married couple and the neighbor’s shed, much more information would be needed to make an accurate assessment as to whether the neighbor adversely possessed the land under the shed. The physical nature of the shed is likely sufficient to establish actual possession and open and notorious use. However, the remaining elements are inconclusive. For example, the neighbor does not have hostile possession if he believes that the shed was actually built on his own property; exclusivity fails if the neighbor and couple share the shed; continuous possession fails if the shed is less than fifteen years old.

An adverse possession claim can be tricky and a property owner may not understand the merits of their claim. However, the point of this article is to raise awareness so that property owners do not sleep on their rights. If a neighbor has built a structure in your yard or is otherwise encroaching on your property, the initial step should be to try to reach an amicable solution. If negotiations fails, consult an attorney. Do not lose your property!
