Notice of Motion - Smoke Free Areas for Carparks of Kindergartens, Childcare Centres and Primary and Secondary Schools (Cr S Keane) D19/53852 I, Cr Sandy Keane, give notice of my intention to move the following motion at the next Ordinary Meeting of the Council Meeting of the City of Tea Tree Gully:
That a report be prepared no later than the end of September 2019 identifying all carparks at kindergartens, childcare centres and primary and secondary schools where Council is the owner of the land or has care and control of the land and outlining the process for making these areas smoke free.
Background
After a recent approach from a resident I was surprised to hear that a number of Council carparks surrounding leased kindergarten’s and schools are not necessarily smoke free. Consistent with recent Council reports detailing smoke free options for dog parks and Elmer’s (St Agnes Recreation Park) I am calling for a report to detail a process to make those Council controlled sites smoke free. This would align with other legislation that prohibit smoking in playgrounds, areas specifically used by our children. I have suggested that the report be prepared for no later than end of September to enable declaring a smoke free zone on these sites to be considered and implemented, if approved by Council, by the commencement of term 4 of this year. Notice of Motion - Smoke Free Areas for Carparks of Kindergartens, Childcare Centres and Primary and Secondary Schools (Cr S Keane) D19/53852 Policy
There are no policy implications related to this Notice of Motion. By-law No.3 Local Government Land provides the capacity at section 5.6.2 to prohibit smoking on any local government land to which Council specifically resolves to do so. Careful consideration would need to be given to describing the exact area that smoking restrictions will apply to and given this Notice of Motion only calls for a report, appropriate time and attention can be given to these considerations. On 16 August 2019, Council resolved to make dog parks in the City of Tea Tree Gully smoke free, a similar process can be applied to carparks of Kindergartens, Childcare Centres and Primary and Secondary Schools under Council owned or care and controlled land. Risk Staff attendance on site after receiving a complaint may be difficult given other demands on staff resources that may be present at the time. This may create a challenge with regard to reactive enforcement given the timing and nature of the activity. A comprehensive communications and engagement strategy with the relevant schools and other stakeholders of the carparks is recommended. As with other similar zones, often the signage is enough to discourage smoking and signage will assist in the general public being able to call out breaches so it becomes self-managed within the community. On receipt of the report, if Council decides to implement this proposed smoking restriction, Council’s By-law section on Council’s website would require a similar document for the car parks to those already in place for Waterworld and a portion of our St Agnes Recreation Area commonly known as Elmers.

All car parks would require appropriate signage to communicate that it is a no smoking area, and this along with legal advice, advertising etc the costs are likely to be in the range of $3,000 to $5,000 to implement.

Notice of Motion - Pizza Boxes Correct Disposal Waste Campaign (Cr Lintvelt) D19/54874 I, Cr Jessica Lintvelt, give notice of my intention to move the following motion at the next Ordinary Meeting of the Council Meeting of the City of Tea Tree Gully:
1. That the correct disposal of soiled pizza boxes be incorporated in the 2019-
2020 waste campaign as part of the drive to engage local businesses in waste education. That this campaign involve engaging with local businesses, including food retailers that use pizza boxes, to develop a mutually beneficial approach.
2. That an information report is provided to Council in March 2020 with the
outcomes of this campaign.
Background
Waste-eating monsters are leading an exciting behaviour-change initiative in the City of Tea Tree Gully designed to address the increasing cost of sending waste to landfill and kerbside bin contamination. In 2018-19, the City’s 40,000 households sent nearly 18,633 tonnes of waste to landfill through the kerbside bin system, costing the organisation approximately $2.2 million. This represents a 4.8% decrease in waste to landfill for the financial year and follows a 2% decrease in waste to landfill in 2017-2018. The need to reduce waste and bin contamination levels has become more important with the State Government’s Solid Waste Levy increasing to $140 per tonne by January 2020 and the imposition of higher standards by China on the quality of recycled materials it will accept. Understanding the financial, environmental and social gains from an investment in waste diversion programs, led Tea Tree Gully Council to develop a unique branded platform through which community-focused waste education messages could be delivered in a fun and engaging way. The aim was to reframe the way people think about waste disposal and take the complexity out of ‘which bin’ decisions. Since their introduction, the waste-eating monsters have gained significant recognition among residents and their impact is being seen. The marketing campaign outlined in the NOM will leverage off of the existing waste education message with a focus on diverting pizza boxes to the green organic waste stream. The messaging aligns with the objectives of the Waste Education Campaign, the specific message of pizza box disposal to organics will be incorporated. The Campaign has a range of key messages to educate our community in landfill diversion and increased recycling. The suggestion to engage with businesses as an audience will also be incorporated into the Campaign. An Information Report is already planned for Council’s consideration in September. This will share the successes and outcomes of the last 12 months, and share the key activities for the next 12 months. It is intended to provide an overview of the outcomes of Council’s Waste Education Campaign, and therefore the benefits of the proposed pizza box labelling initiative will be included in the overall reporting on outcomes. Financial implications are considered negligible and can be met within the general waste management budget areas.

Notice of Motion - No Standing Zone Parking Control - 1316 North East Road Tea Tree Gully (St Agnes Estate) (Cr Jones) D19/55336 I, Cr Lucas Jones, give notice of my intention to move the following motion at the next Ordinary Meeting of the Council Meeting of the City of Tea Tree Gully:
That Council resolves to have the existing no standing zone parking outside properties at 1316 North East Road, Tea Tree Gully (St Agnes estate housing) extended by an additional length of approximately 15 metres in a westerly direction with the option for the Chief Executive Officer to change it to approximately 2 hour timed parking on weekdays between 9.00am and 5.00pm after engaging with adjoining residents.
Background
I have decided to move this motion after ongoing discussions with residents of the St Agnes estate situated at 1316 North East Road, Tea Tree Gully. Residents originally requested a yellow no parking or timed parking line to be installed outside the houses at 1316 North East Road and council agreed to do this for a certain length which did not satisfy what the residents asked for, this was a year ago and at the time I advised the residents to wait and see if it achieved what was desired. The reason residents want the no parking/timed parking installed are for a number of reasons, one of the main reasons is because on bin day cars will park outside residents houses despite bins being put to be emptied which makes it difficult for their bins to be emptied and when pulling out of the St Agnes estate it can be difficult to view both sides of the road because cars are parked all the way along creating a difficult line of sight. Residents are also open to having timed parking installed at the sight to allow for cars to still park there but to avoid cars being able to park there for 12 hours a day which some currently are. If timed parking is installed, it would allow residents visiting the Tea Tree Gully Township precinct or guests visiting the St Agnes Estate to still park there. Notice of Motion - No Standing Zone Parking Control - 1316 North East Road Tea Tree Gully (St Agnes Estate) (Cr Jones) D19/55336 Policy
This Notice of Motion does not impact on any Council policy. Parking management improves road safety and provides amenity for residents, visitors and other road users. Risk Permissible parking in this location is likely to provide amenity for residents, visitors, public transport users and patrons accessing businesses and facilities on the northern side of North East Road. Parking would be displaced further west along North East Road. Any concerns will likely be raised and addressed through consultation with nearby residents and businesses. A Traffic Impact Statement would be prepared in accordance with the requirements for installing Traffic Control Devices in South Australia. It is not envisaged that a ‘No Stopping’ or ‘Timed Parking’ zone will have any adverse impact on road safety. Financial Implications The cost of installing line marking and signage to effect parking controls, can be accommodated with Council’s existing budget allocation for this type of work.

Notice of Motion - Traffic Management Feasibility - 1316 North East Road Tea Tree Gully (St Agnes Estate) (Cr Jones) D19/55337 I, Cr Lucas Jones, give notice of my intention to move the following motion at the next Ordinary Meeting of the Council Meeting of the City of Tea Tree Gully:
1. That Council requests for a report to be brought back to a Council meeting
with recommendations on how the following matter can be implemented in
stages, detailing ways of how a right turn traffic holding bay can be
installed outside 1316 North East Road, Tea Tree Gully (St Agnes housing
estate) to assist for the safe right turn for motorists into the Housing Estate
from North East Road for vehicles travelling in an easterly direction.
2. That the report should include:
Cost estimates and feasibility study for the installation of a right turn traffic holding bay into the St Agnes estate, situated at North East Road, Tea Tree Gully including a possible cost sharing arrangement with the Department Planning, Transport & Infrastructure (DPTI)
Any recent previous correspondence between the City of Tea Tree Gully and DPTI regarding the potential right turn traffic bay at this site
Potential funding options of stage 2 (below) within the 2019-20 Council budget
The option of staging to include:
a. Stage 1 - High level concept approval from DPTI regardless of who
pays for the construction
b. Stage 2 - Design cost estimates if Council is required to design
c. Stage 3 - Construction cost estimates if Council was to fully pay
for construction or otherwise as agreed with DPTI

Background
I am calling for a report into this matter to allow council to potentially consider taking further action based on a detailed report. Residents of the St Agnes estate have been speaking with me for over a year now about council or the Department of Transport dealing with the issue of a right hand turn bay to be installed at St Agnes Estate, 1316 north east road, Tea Tree Gully. Residents who turn into the estate report regularly the difficulty of turning into the estate without having vehicles tailgate them because there is limited room to turn. Around 18 months ago, council asked DPTI to look into addressing this traffic issue however they advised that it is not a priority for them to address. Residents of the estate view it as a constant and ongoing issue that they would like looked into. The feasibility report I am asking for would allow me and other councillors to understand how it can be fixed and what the total cost of the project would be. This would also assist me in future budget considerations. I am not seeking council to commit to spending any budget expenditure by moving this motion and any future move to do so would be based on the advice given to councillors through the report. Risk There is a risk that a right-turn lane cannot be accommodated due to the proximity of the right-turn lane into Church Street, or the right-hand turn lane into Church Street would be shortened subject to approval from the Department of Planning Transport and Infrastructure. Council has previously enquired with DPTI as to what options may be available for this location, their response is provided in Attachment 2. There is a risk that effort or funds committed to a further investigation will be wasted, Financial Implications
The cost of preparing a detailed report with options and cost estimates will require a budget of approximately $10,000 - $15,000. Council staff would need to engage a consultant to undertake an engineering survey and concept designs and liaise with the Department of Planning Transport and Infrastructure (DPTI). Funding for this work can be accommodated within the existing traffic management operation budget provisions for the 2019-20 financial year.

Quarter 4 Financial Year 2018-2019 Strategic Plan and Organisation Plan KPI Status Report (D19/54589) Our vision and aspirations for our community are contained in our Strategic Plan 2020. The Strategic Plan contains three themes that focus on community wellbeing. A summary of these is shown in the graph below as well as in Attachment 1. Our Organisation Plan 2020 details the aspirations and objectives that we strive for as an organisation that will enable us to deliver outcomes that are focused on our community. The Organisation Plan 2020 contains five key result areas focusing on business excellence and relevant objectives. A summary of the five key result areas is shown in the second graph below as well as in Attachment 2. Key Performance Indicators (KPIs) have been developed to enable us to track how we are progressing in achieving the objectives detailed in the Strategic Plan and the Organisation Plan. These KPIs are contained in the Annual Business Plan, which is endorsed by Council each year. Reporting against these KPIs is at quarterly, six monthly or yearly intervals. Most KPIs are measured as a percentage of progress and are reported as “on track” (shaded green), “requires attention” (shaded orange) or “below target” (shaded red). Our annual performance against these KPIs is also reported to the community via the Annual Report.

This Quarter 4 report represents the fourth and final reporting period for the financial year 2018-2019. Attachment 1 contains detailed information on the progress of each “quarterly” Strategic Plan KPI as at the fourth quarter (April - June 2019) of the financial year 2018-2019.
The report for Quarter 4 indicates KPIs were 95.8% achieved. Areas requiring attention
Some targets that were not met:

87% of procedures have been reviewed and are up to date Trends The Quarter 4 result of 97.4% KPIs achieved is a slight increase when compared to the Quarter 3 result of 93.3% achieved.
1.3 Yearly Progress As we have now completed our third year of reporting against both the Strategic Plan 2020 and the Organisation Plan 2020, it is possible to benchmark our yearly progress in implementing strategic and organisation objectives. The achievement of Strategic Plan KPIs has been relatively consistent with previous years with between 95.8% and 97.4% of KPIs achieved each year. The achievement of Organisation Plan KPIs has improved on previous years with 97.4% of 2018-2019 financial year KPIs achieved compared with 93.9% in 2016-2017 financial year.

COUNCIL MEETING

Confidential Subject: Sale of Land for Non Payment of Council Rates (D19/51894) It is the recommendation of the Chief Executive Officer that the Sale of Land for Non Payment of Council Rates be received, discussed and considered in confidence. The Council should determine whether it is necessary and appropriate for the matter to be discussed in confidence as provided for by the provisions of Sections 90 and 91 of the Local Government Act 1999 (with a recommendation provided as follows):
Recommendation for Moving into Camera 1. That pursuant to Section 90(2) of the Local Government Act, 1999 the Council orders
that the public (except staff on duty) be excluded from the meeting to enable discussion on the Sale of Land for Non Payment of Council Rates.
2. That the Council is satisfied that pursuant to section 90(3) aa of the Act, the information be received, discussed or considered in relation to this item is:
it relates to information the disclosure of which would involve the unreasonable disclosure of information concerning the personal affairs of any person (living or dead)
o on the basis that it relates to personal financial affairs of rate payers and is
inappropriate to put pending private financial in the public domain prior to it being finalised, and
3. In addition, the disclosure of this information would, on balance, be contrary to the public interest. The public interest in the public access to the meeting has been balanced against the public interest in the continued non-disclosure of the information. The benefit to the public at large resulting from withholding the information outweighs the benefit to it of disclosure of the information. The Council is satisfied that the principle that the meeting be conducted in a place open to the public has been outweighed in the circumstances on the basis that it could impact the financial position of the relevant ratepayer.
4. That the Council is satisfied that the principle that the meeting should be conducted in a place open to the public has been outweighed in relation to this matter by the need to keep the discussion of this matter confidential because on the basis that it could impact the financial position of the relevant ratepayer.
Note: The meeting should pause to allow members of the public to leave the meeting room and the doors should be closed behind as the last person leaves. Discussion on the matter can then proceed. The meeting automatically moves out of confidentiality at the end of consideration of the matter, and the public should then be invited to attend the meeting.
