the person authorized shall constitute a breach of the authorization.

5. The person authorized shall implement Emergency Response Procedure (ERP) for which this authorization is

being granted considering all specific possible scenarios such as spillages, leakages, fire etc and their possible

impacts and also carry out mock drill in this regard at regular interval of time.

6. The person authorized shall comply with the provisions outline in the Central Pollution Control Board

(CPCB) guidelines on implementing liabilities for environment damages due to handling and disposal of

hazardous waste and penalty.

7. It is the duty of the authorized person to take prior permission of the Pollution Control Board (PCB) to close

down the facility.

9. The record of consumption and fate of imported hazardous and other waste shall be maintained.10. The hazardous waste which gets generated during recycling or reuse or recovery or pre-processing or

utilization of imported hazardous or other waste shall be treated and disposed of as specific conditions ofauthorization.

11. The importer or exporter shall bear cost of import or export and mitigation of damages, if any.12. An application for renewal of an authorization shall be made as laid down under these rules.13. The person authorized shall also comply with other conditions as per guidelines issued by the Ministry of

Environment & Forest and Climate Change or Central Pollution Control Board from time to time.14. Annual return shall be filled by June 30th for the period ensuring 31 st March of the year.15. Annual return shall be filed by June, 30th for the period ensuring 31st March of the year.

Specific Conditions:-

1- The unit holder shall comply to the general terms and conditions of the Hazardous and Other Wastes(Management and Transboundary Movement) Rules 2016 , dt: 4-4-2016 otherwise an action as warrantedunder EP Act 1986 and amendment made thereof.

2- The Unit holder shall dispose Hazardous Waste strictly in accordance with Hazardous Waste Rules,2016 andshall dispose as per Hazardous waste Rules.

3- The unit holder shall fill Form - 4 [See rules 6(5), 13(8), 16(6) and 20(2)] before 30th June, every year forthe period from January to December of the preceding year and the same be submitted to the concernedDivisional Officer, PCB before 30th June failing which consent shall revoked/cancelled.

4- The unit holder has a display Board outside the unit for displaying Air I Water I Hazardous Waste data as perHon'ble Supreme Court ofIndia Directions.

5- This authorization is issued with condition that the used i.) oil being generated from the diesel generators atthe facility be disposed off to an authorised recycler of used oil only and transport manifests of the same besubmitted to JKPCB on form 10 . ii) the applicant needs to maintain details of used oil on form 3 and submitthe annual return on form 4 by 30th June every year as per HoWM rules 2016 n. Iii) The applicant needs toproperly lal el and maintain the used oil storage.
