• This committee seeks to improve PSU students’ ability to access affordable, nutritious, and culturally relevant food

Prohibited Discrimination & Harassment Policy

Discrimination means excluding from participation, denying the benefit of, or otherwise subjecting an individual or group of individuals to different treatment based on Protected classes, which includes disabilities and perceived disabilities.

Continued:Discriminatory harassment means verbal comments, graphic or

written statements, or physical conduct by a student, faculty, staff or other PSU community member based on Protected Class or Protected Classes that is so severe, persistent or pervasive that it interferes with or limits a student, faculty, staff, volunteer or PSU community member’s ability to participate in or benefit from the university’s educational and/or employment opportunities, programs or activities. Discriminatory harassment includes sexual harassment.

Protected Classes:• Age• Disability• National origin• Race• Color• Marital status• Veteran status• Religion• Sex• Sexual orientation• Gender identity and expression• Genetic information• Any other basis protected by federal, state or local law, or in the use of

Workers’ Compensation, the federal Family and Medical Leave Act or the Oregon Family Leave Act and any other category covered by law.

Non-Retaliation:

• No person shall retaliate against an individual for reporting discrimination or harassment, filing a complaint, participating in an investigation, participating in resolution of a complaint or any other activity protected under this policy, regardless of the outcome of the concern or complaint.

• Any act of retaliation or reprisal violates this policy and will be treated as a separate matter.

• Anyone found to have retaliated against someone making use of this policy will be subject to corrective actions, up to and including severance of any relationship with PSU.

Title IX:

“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.”

Discrimination on the basis of one’s sex includes gender, gender identity, sexual orientation and sexual harassment.

Sexual HarassmentSexual Harassment is a form of gender discrimination and

is defined as unwelcome sexual advances, request for sexual favors and other verbal comments, graphic or written statements, or physical conduct of a sexual nature.

Sexual misconduct and sexual assault are forms of sexual harassment.

This may be an incident of student to student, student to faculty/staff or employee to employee.

Required Reporting:• Report all discrimination or discriminatory harassment to the Office

of Equity and Compliance or the Office of the Dean of Student life

• Any supervisor, Manager, faculty member or other University Official (which includes all individuals with oversight responsibility for students . . .) who becomes aware of an incident that may constitute discrimination or discriminatory harassment is required to promptly notify the Office of Equity & Compliance or the Office of the Dean of Student Life.

Confidentiality v. Privacy

Because supervisors, managers, faculty or anyone with oversight over students has a reporting obligation, they cannot keep the information reported to them confidential, but can stress privacy.

Department of Education, Office of Civil Right

Student/employee wants confidentiality

If the person coming to you with a concern wants to keep the matter confidential and not have you report it, stop the person from telling you more and refer her/him to Student Health and Counseling Services (SHAC) or Employee Assistance program (EAP).

These services are strictly confidential and there are no reporting obligations.

Request for Confidentiality

Persons reporting they have experienced gender discrimination, sexual harassment, or sexual violence may request they remain anonymous and decline involvement in an investigation. Victims will be informed that PSU will not be able to conduct as effective investigation without their participation.

PSU’s Title IX Coordinator will determine the extent it is possible to keep the person’s identifying information confidential.

Your follow up after gaining knowledge

If individuals specifically discusses their concerns regarding discrimination, harassment and/or sexual violence with you should:

a. Inform them you of your reporting obligations and assist with completing an on-line complaint;

b. Contact the OEC or DOSL to report;

c. If appropriate, refer them to SHAC or Employee Assistance Program; and

d. If gender based, provide them with a print-out located on the EMSA website and refer them to the WRC or QRC.

If you overhear or learn of concerns third hand still contact the OEC or DOSL to report.

Scenario

A colleague in your department asks if he can get coffee with you to discuss concerns he has in your department. One of the first things he says to you is I think the Director is discriminating against me ….in how work is being allocated.

A student employee comes to you upset and starts to tell you what happened the night before when she was at a party. She informs you that a guy made her go into a room with her and she had told him that she did not want to be alone with him.
