Item 11: Victims Services Program The court heard an update on the 33rd JUdicial District Victim Services program. Judge Kithil stated that San Saba county will not support the program. The payroll will be transferred to llano county on October 1, 2005. Judge Kithil stated that after today, Burnet County will know which counties will participate in this program. The court took no action at this time.

Item 12:AppellateCourt System ihe court disucssed the state mandated fee to support the appellate court system. Motion was made byComm. Oakley, seconded by Comm. Hibler and the vote was unanimous to approve agenda item 12.

Item 13:County PolicyPurchase of Fuel The court discussed adoption of county policy on purchase of fuel for county vehicles. Motion wasmade by Comm. Oakley, seconded by Comm. Neve and the vote was unanimous to approve agenda item i3.

Motion was made by Comm. Hibler, seocnded by Comm. Oakley and the vote was unanimous to monimateEd Dalke to the Appraisal District Board of Directors.

Item 17:ElectionJudges The court discussed election judges and alternates further appointments; withdrawal of one alternate.Motion was made by Comm. Oakley, seconded by Comm. Graeter to appoint Rex Barber and Sarah Webb. The vote passedunanimously. (See Attched Memo)

Item 18:Election ServicesContract The court discussed approval of the Contract for Election Services between the Burnet County Clerk and theTemporary Directors of the Central Texas Groundwater Conservation District. Motion was made by Comm. Oakley, seconded byComm. Neve and the vote was unanimous to approve the contract for election services between Burnet County Clerk andTemporary Directors of the Central Texas Groundwater District. (See Attached Contract)

Item 110:Burn Ban ihe court discussed the need for a burn ban in Burnet County. ihe court took no action at this time.

Item 113:Road ­KingslandHills The court discussed not accepting ownership by the county of a section of road in Kingsland Hills. Comm.Neve stated the county never agreed to accept ownership by the county of a section of road in Kingsland Hills. Motoin wasmade by Comm. Neve, seconded by Comm. Oakley and the vote was unanimous that Burnet C~unty not accept ownership of asection of road in Kingsland Hills.

Item 114:Exemption ihe court discussed approval of request for exemption from subvdivision regulations on sale of approximately10 acres by Aubrey fulton. Motion was made by Comm. Graeter, seconded by Comm. Oakley and the vote was unanimous toapprove the exemption from the subdivision regulations on sale of approximately 10 acres by Aubrey Fulton. (See AttachedExemption form)

Item t16:CARTPO The court discussed prioritzation of CARTPO transportation projects. Comm. Oakley gave an update on the CARTPOprojects. The court took no action at this time.

Item 118:Exemption The court discussed request for exemption from subdivsion regulation for a one-time split of property forDewey Hollingsworth. Motion was made by Comm. Oakley, seconded by Comm. Neve and the vote was unanimous to approve therequest for Exemption for Dewey Hollingsworth. (See Attached Exemption Form)

Item 119:DestructionDerby The court discussed assistant to Spicewood Volunteer Fire Department in preparation for annual derbyfundraiser. Motion was made by Comm. Oakley, seconded by Comm. Neve and the vote was unanimous to authorize Precinct 14 toassist in preparation for Speciewood Volunteer Fire Department fundraiser.

Item 130:Contracts Comm. Neve discussed the contract with the Travis County Medical Examiners office. Motion was made byComm. Neve, seconded by Comm. Hibler to request a refund on autopsy performed by th~ Travis County Medical Examinersoffice. Eddie Arredondo, County Attorney questioned if Burnet County has the authority to request a refund of an autopsy.Comm. Neve stated he will visit with the County Attorney about this issue.

Item ill:Replat ­Legends on LakeLBJ The court discussed approval of the amended plat of lot 1009-A, Plat 11.2, legends on lake lBJ, to be knownas lot 1009-AA, Plat 11.3. The court held the public hearing portion of this agenda item. The court took no action atthis time.

Item 14:Staffing -Jail The court discussed the recommendation of state Commission on Jail Standards on staffing levels at the countyjail. The jail added beds in 1998 which was a total of 96 beds at that time. Since 1998 an additonal two beds wereadded. With the addition of these two beds, State law requires the jail to add five (5) staff members. Comm. Neve stated a96 bed facility requires 16 jailers. Burnet County currently funds 19 positions. ihe Burnet County jail is locensed for96 beds. ihis item will be discussed at the next regular meeting of the commissioners court.

Item 121:Payroll Motion was made by Judge Kithil, seconded by Corom. Oakley and the vote was unanimous to approve payroll inthe amount of $269,118.86.

Item 122:Budget LineItem iransfers Motion was made by Comm. Oakley, seconded by Comm. Hibler and the vote was unanimous to approve budgetline item transfers. (See Attached line Item Transfers)

Item 126:Correspondence Judge Kithil reported that there is a special meeting scheduled for August 15, 2005 at 9:00 a.m. tohold a public hearing on the County Clerks Records Archive Plan and adopt a fee for the County Clerk Records ArchivePlan. The court will hold a workshop meeting for August 18, 2005 in conjunction with the Water District Meeting. Therewill be an open house August 9, 2005 at 7:30 P.M. at the new Burnet High School.

Item i27:Bids Motion was made by Comm. Oakley, seconded by Comm. Neve to call for bids for financing on the purchase of theBurnet County Supply Store. The vote passed unanimously.

Item 128:PropertyTransfers Motion was made by Comm. Neve, seconded by Comm. Oakley and the vote was unanimous to approve. SeeAttached Property Transfers)

Item 129:Budget Amendments Motion was made by Comm. Hibler, seconded by Comm. Oakley and the vote was unanimous to approvebudget amendments. (See Attached Budget Amendments)

Item 131:Grants The court took no action on this agenda item.

Item 130:Contracts Motion was made by Comm. Oakley, seconded by Comm. Neve and the vote was unanimous to approve contract withMike lucksinger.

Motion was made by Comm. Oakley, seconded by Comm. 6raeter and the vote was unanimous to approve contract with 1113Architects for proposed records archive building.

Motion was made by Comm. Greater, seconded by Comm. Hibler to transfer funds from within the bUdget to fund thecontract with Texas Dept. of Human Services. The motion and second was withdrawn.

Motion was made by Comm. Oakley, seconded by Comm. 6raeter and the vote was unanimous to approve the contract withTexas Department of Human Services.

Item 132:Old Business The court took no action on this agenda item.

Item 120:BriggsTowerProject ihe court received a review from Tom Burke, XPM Communications on the Briggs tower project and FCC trendsand regulations. (See Attached information)

Mr. Burke stated this tower should have the capacity to hold another antennae. Mr. Burke stated if the county goes toa county owned system, the county needs two to three times the amount of towers that you currently have, plus addtionalequipment for this type of system.

Item 129:Budget Sheriff Pollock came before the court to discuss the Sheriff and L.E.e. budget. Sheriff Policok would liketo purchase radios that will lock Burnet County into the 900 mgh radio communciations.

Motion was mde by Comm. 6raeter to replace the buffer at the lEC. The motion was seconded by Comm. Oakley. The motionand second was withdrawn.

Item 19:Tax Rate The court discussed taking a record vote on a proposed tax rate for the 2006 county budget. The county'sbudget is increasing 5.9% for FY 2006. Motion was made by Comm. Neve to move that the proposed property taxes be increaseto $0.4002. The motion was seconded by Comm. Oakley. Voting for - Judge Kithilj Comm. Nevej Comm. Graeterj Camm. HibIerjand Comm. Oakley. The motion passed unanimously.

"Rent" means base rent plus any other sums ofmoney due Landlord by Tenant.

"Landlord" means Landlord and its agents, employees, invitees, licensees, or visitors.

"Tenant" means Tenant and its agents, employees, invitees, licensees, or visitors.

"Essential' Services" means heating, ..ventilating, air conditioning, water, and utilityconnections reasonably necessary for occupancy of the premises for the use stated above.

"Common Areas" means all facilities and areas of the building that are intended anddesignated by Landlord from time to time for the common, general, and nonexclusive useofall tenants ofthe building, including restroom facilities and break room area for commonuse ofbuilding tenants. Landlord shall have the exclusive control over and right to managethe common areas.

LEASE CLAUSES AND COVENANTS

A. Tenant agrees to--

1. Lease the premises for the entire term beginning'on the commencement date andending on the termination date.

2. Accept the premises in their present condition with additional build-out atTenant's expense. Tenant acknowledges that the Premises are suitable for Tenant'sintended use.

3. Obey all laws, ordinances, orders, and rules and regulations applicable to the use,condition, and occupancy of the premises, including the rules and regulations ofthebuilding, and parking facility, if any, adopted by Landlord.

4. Pay monthly, in advance, on the first day of the month, the base rent to Landlordat Landlord's address.

5. Pay, as additional rent, all other sums due under this lease.

6. Pay a late charge of five (5%) percent ofany rent not received by Landlord withinten days after it is due.

7. Allow Landlord to enter the premises to perform Landlord's obligations, inspectthe premises, and show the premises to prospective purchasers or tenants.

8. Repair, replace, and maintain any part of the premises that Landlord is notobligated to repair, replace, or maintain, normal wear excepted.

9. Repair any damage to the premises or the parking facility caused by Tenant.

10. Submit in writing to Landlord any request for repairs, replacement, andmaintenance that are the o~ligationsofLandlord.

11. Maintain public liability insurance for the premises and the conduct ofTenant'sbusiness, naming Landlord as an additional insured, in the amounts stated in the basiclease terms and definitions.

12. Maintain insurance on Tenant's personal property.

13. Deliver certificates of insurance to Landlord before the Commencement Dateand thereafter when requested.

14. Indemnify, defend, and hold Landlord hannless from any loss, attorney's fees,expenses, or claims arising out ofuse of the premises.

15. Vacate the premises and return all keys to the premises on termination of thislease.

16. On request, execute an estoppel certificate that states the commencement andtermination dates ofthe lease, identifies any amendments to the lease, describes anyrights to extend the lease tetm or purchase rights, lists defaults by Landlord, andprovides any other information reasonably requested.

17. Arrange with Landlord in advance for any heating, air conditioning, or electricalneeds in excess of the services provided by Landlord and pay for such additionalfacilities or services as billed by Landlord.

Tenant agrees not to--

1. Use the premises for any purpose other than that stated in the basic lease terms anddefinitions.

2. (a) Create a nuisance, (b) interfere with any other tenant's nonnal businessoperations or Landlord's management ofthe building, (c) permit any waste, or (d) usethe premises in any way that is extra hazardous, would increase insurance premiums,or would void insurance on the building.

3. Change Landlord's lock system.

4. Alter the premises without consent of Landlord.

5. Allow a lien to be placed on the premises.

6. Assign this lease or sublease any portion of the premises without Landlord'swritten consent.

7. Place any exterior signage on or in the building or on or inside exterior glasswindows without Landlord's prior written consent.

Landlord agrees to--

1. Lease to Tenant the premises for the entire term beginning on thecommencement date and ending on the tennination date.

2. Obey all laws, ordinances, orders, and rules and regulations applicable to theuse, condition, and occupancy of the building, if any.

3. Provide normal utility-service connections to the building and the premisesand pay for the following utility services for the premises:

a) Gas (for heating);b) Electricity;c) Trash pick-up; andd) Janitorial services.

4. Repair, replace, and maintain the (a) roof, (b) foundation, (c) common areas,(d) structural soundness ofthe exterior walls and doors, (e) premises lighting fixturesand bulbs, and (f) other structures or equipment serving the premises.

5. Insure the building against all risks of direct physical loss. Tenant will haveno claim to any proceeds of Landlord's insurance policy.

6. Provide the following services: (a) air conditioning and heating to thepremises reasonable for Tenant's use (exclusive of air conditioning or heating forelectronic data processing or other specialized equipment); (b) regular janitorialservices; (c) trash pick-up; (d) electric current for nonnal office machines andbuilding's standard lighting reasonable for Tenant's use; and (e) internet servicethrough provider selected by Landlord.

7. Allow Tenant to place one exterior sign on the street front wall ofthe buildingadjacent to the building entry and signage on the interior building premises entrydoor and/or adjacent wall. Tenant shall remove any such signage prior to theTermination Date at Tenant's expense.

D. Landlord agrees not to--

1. Interfere with Tenant's possession of the premises as long as Tenant is not indefault.

E. Landlord and tenant agree to the following:

1. Alterations. Any physical additions or improvements to the premises made byTenant will become the property ofLandlord. Landlord may require that Tenant, attermination ofthis lease and at Tenant's expense, remove anyphysical additions madewithout Landlord's consent, exterior signage, repair any alterations made withoutLandlord's consent, and restore the premises to the condition existing at thecommencement date, nonnal wear excepted.

2. Abatement. Tenant's covenant to pay rent and Landlord's covenants areindependent ofeach other. Except as otherwise provided, Tenant shall not be entitledto abate rent for any reason.

3. Release of Claims/Subrogation. (a) Landlord and Tenant release each otherfrom any claim, by subrogation or otherwise, for any damage to the premises, thebuilding, or personal property within the building, by reason of fire or the elements,regardless ofcause, including negligence ofLandlord or Tenant. This release appliesonly to the extent that it is permitted by law, the damage is covered by insuranceproceeds, and the release does not adversely affect any insurance coverage. (b) Foran additional charge, Landlord is providing an internet connection to the premisesthrough Landlord's equipment and with a service provider selected by Landlord.Landlord retains the right to contract with any internet service provider. Tenantagrees not to install antennas, wiring or other hardware to the premises without

Landlord's prior written consent. While Landlord agrees to maintain an internetconnection to the premises, Landlord makes no guarantees as to the reliability oftheservice provider or any particular minimum bandwidth or line capacity. Tenantwaives all claims and agrees to hold Landlord harmless for abatement ofrent or anyexpense or damages incurred by Tenant by reason ofany interruption or impainnentofintemet services to the premises which are not the direct fault ofLandlord's grossnegligence.

4. Notice to Insurance Companies. Landlord and Tenant are advised to notify theissuing insurance companies ofthe release set forth in the preceding paragraph andto have the insurance policies endorsed, if necessary, to prevent invalidation of theinsurance coverage.

5. Casualty/Total or Partial Destruction. (a) If the premises are damaged bycasualty and can be restored within ninety days, Landlord will, at its expense, restorethe premises to substantially the same condition as they existed before the casualty.IfLandlord fails to complete restoration within ninety days from the date ofwrittennotification by Tenant to Landlord of the casualty, Tenant may terminate this leaseby written notice to Landlord. (b) If the premises cannot be restored within ninetydays, Landlord has an option to restore or not to restore the premises. If Landlordchooses not to restore, this lease will terminate. IfLandlord chooses to restore, it willnotify Tenant ofthe estimated time to restore and give Tenant an option to terminatethis lease by notifying Landlord within ten days. If Tenant does not tenninate thislease, it shall continue and Landlord shall restore the premises as provided in (a)above. (c) To the extent the premises are untenantable after the casualty and thedamage was not caused by Tenant, the rent will be adjusted as may be fair andreasonable.

6. Condemnation/Substantial or Partial Taking. (a) If the premises cannot beused for the purposes contemplated by this lease because of condemnation orpurchase in lieu of condemnation, this lease will tenninate. (b) If there is acondemnation or purchase in lieu of condemnation and this lease is not terminated,Landlord will, at Landlord's expense, restore the premises, and the rent payableduring the unexpired portion of the tenn will be adjusted as may be fair andreasonable. (c) Tenant will have no claim to the condemnation award or proceeds inlieu ofcondemnation. Tenant acknowledges being advised by Landlord that the Cityof Burnet is currently engaged in a project for renovation of the Burnet square onwhich the building fronts. Landlord has been advised by the City of Burnet of thepossibility of disruption of utility services from time to time during the renovationproject, and that Tenant's and the public's ability to access the building may be

impaired during the renovation. Landlord can give no guarantee as to when or howlong utility service interruptions may occur or of the extent to which access to thebuilding may be impaired. Tenant waives all claims and agrees to hold Landlordharmless for abatement of rent or any expense or damages incurred by Tenant byreason of the utility service interruptions or impairment of access to the premises.

7. Uniform Commercial Code. Tenant grants Landlord a security interest inTenant's personal property now or subsequently located on the premises. This leaseis a security agreement under the Uniform Commercial Code. Landlord may file acopy of this lease as a financing statement.

8. Default by LandlordlEvents. Defaults by Landlord are (a) failing to complywith any provision of this lease within thirty days after written notice or (b) failingto provide essential services to Tenant within ten days after written notice.

9. Default by Landlord/Tenant's Remedies. Tenant's remedies for Landlord'sdefault are to (a) sue for damages, and (b) ifLandlord does not provide an essentialservice for thirty days after default, terminate this lease.

10. Default by TenantlEvents. Defaults byTenant are (a) failing to pay timely rent,(b) abandoning or vacating a substantial portion of the premises, or (c) failing tocomplywithin ten days after written notice with any provision ofthis lease other thanthe defaults set forth in (a) and (b) above.

11. Default by TenantlLandlord's Remedies. Landlord's remedies for Tenant'sdefault are to (a) enter and take possession of the premises (Landlord may relet thepremises on behalfofTenant and receive the rent directly by reason of the relettingand Tenant agrees to reimburse Landlord for any expenditures made in order to relet);(b) enter the premises and perfonn Tenant's obligations; or (c) terminate this lease bywritten notice and sue for damages. Landlord may enter and take possession of thepremises by self -help, by picking or changing locks if necessary, and may lock outTenant or any other person who may be occupying the premises, until the default iscured, without being liable for damages.

12. DefaultlWaiverlMitigation. It is not a waiver of default if the nondefaultingparty fails to declare immediately a default or delays in taking any action. Pursuit ofany remedies set forth in this lease does not preclude pursuit ofother remedies in thislease or provided by law. Landlord and Tenant have a duty to mitigate damages.

14. Holdover. IfTenant does not vacate the premises following termination ofthislease, Tenant shall be a tenant at will and shall vacate the premises on receipt ofnotice from Landlord. No holding over by Tenant, whether with or without theconsent of Landlord, will extend the term.

15. Alternative Dispute Resolution. Landlord and Tenant shall submit in goodfaith to mediation before filing a suit for damages.

16. Attorney's Fees. If either party retains an attorney to enforce this lease, theprevailing party is entitled to recover reasonable attorney's fees.

17. Venue. Venue is in the county in which the premises are located.

18. Entire Agreement. This lease is the entire agreement of the parties, and thereare no oral representations, warranties, agreements, or promises pertaining to thislease.

19. Amendment of Lease. This lease may be amended only by an instrument inwriting signed by Landlord and Tenant.

20. Limitation ofWarranties. There are no implied warranties ofmerchantabilityor fitness for a particular purpose, or of any other kind arising out of this lease, andthere are no warranties that extend beyond those expressly stated in this lease.

21. Notices. Any notice required by this lease shall be deemed to be delivered(whether or not actually received) when deposited with the United States PostalService, postage prepaid, certified mail, return receipt requested, and addressed toLandlord or Tenant at their addresses.

22. Abandoned Property. Landl0t:d may retain, destroy, or dispose ofany propertyleft on the premises at the end of the term.

Attached is a consolidated list ofpresiding election judges and alternate judges, whichCommissioners Court approved on July 25, 2005, with three exceptions:

(1) Rex Barber has been nominated by Linda Rogers, the Republican Chair,as Presiding Election Judge for Precinct 4. (His name was submitted too late to besubmitted at the last meeting.) I respectfully request you to appoint him as such.

(2) Sarah Webb has been nominated by Shirley Schmidt, the Democraticchair, as Alternate Election Judge for Precinct 5. (Her name was submitted too late to besubmitted at the last meeting.) I respectfully request you to appoint her as ·such.

(3) Shirley and I miscommunicated concerning the appointment of Ira D.Wall as Alternate Election Judge for Precinct 10. In fact, Mr. Wall had previously toldShirley that the November election would be his last as an election worker. Therefore, Irespectfully request that you allow the withdrawal ofMr. Wall's appointment, leaving avacancy in the position of alternate judge.

Following the above two appointments and one withdrawal, Burnet County has a fullcomplement ofPresiding Election Judges and has Alternate Election judges for allprecincts, except precincts 3, 10, and 17. Shirley is still working on these precincts.

SEPTEMBER 24,2005 CONFIRMATION ELECTION

THIS CONTRACT is made and entered into by and between Janet Parker, theCounty Clerk of Burnet County, Texas, hereinafter referred to as "Contracting Officer,"and the Temporary Directors of the Central Texas Groundwater Conservation District("the District"), hereinafter referred to as "the Directors," pursuant to the authority underSection 31.092(a) of the Texas Election Code.

WHEREAS, Senate Bill 967, which became effective on June 17, 2005, createdthe District, the boundaries of which are coextensive with Burnet County, Texas, subjectto a confinnation election ("the election"); and

WHEREAS, in accordance with enacted Senate Bill 967, Commissioners Courtof Burnet County appointed the following as Directors of the District: Patrick Quinlan,Wayne Brown, Todd Fox, Jerry Bostick, and John Simmons; and

WHEREAS, the Directors intend to call the election for September 24, 2005 anddesire the Contracting Officer to conduct the election on their behalf, pursuant to theauthority under Section 31.092 of the Texas Election Code; and

WHEREAS, the Contracting Officer is willing to conduct the election on theirbehalf, pursuant to the authority under Section 31.092 ofthe Texas Election Code.

THEREFORE, In consideration of the mutual covenants and promiseshereinafter set forth, the parties to this contract agree as follows:

I. RESPONSIBILITIES OF THE DIRECTORS. The Directors shall have thefollowing responsibilities:

A. Notification to Contracting Officer of Confirmation Election Date. Toensure that the Contracting Officer is given sufficient time to prepare the submission forpreclearance to the U.S. Department of Justice, the order of election, and the notice ofelection, the Directors agree to give the Contracting Officer 90 days advance notice inwriting of the election date. If such 90 days' notice is not given, the Contracting Officerhas the unilateral right to tenninate this contract without further obligation.

32 of the Texas Election Code. Within five days after appointing the presiding judges.and alternate judges, the Director~ shall provide a list of the appointments to theContracting Officer.

G. Appointment ofPresiding Judge for Early Voting Ballot Board. Withinsuch time so as not to impede the orderly conduct of the election, under Section 87.002 ofthe Texas Election Code, the Directors shall appoint the presiding judge of the EarlyVoting Ballot Board either from the proposed list provided by the Contracting Officer orfrom other sources. If from other sources, the Directors shall ensure that the appointeesmeet the eligibility requirements in Section 87.003 of the Texas Election Code. Withinfive days after appointing the presiding judge of the Early Voting Ballot Board, theDirectors shall provide the name in writing to the Contracting Officer.

H. Designation ofNumber ofElection Clerks. Under Section 32.033(a) ofthe Texas Election Code, the Directors authorize each presiding judge to appoint twoelection clerks, one of whom shall be the alternate judge. Additionally, the Directorsauthorize each presiding judge, if it appears that as a result of voter turnout, it will not bepossible for the three election workers at a polling location to conduct both voting dutiesand counting duties, after conferring with the Contracting Officer, to appoint a third clerkfor a period not to exceed five hours for the purpose of assisting in the counting ofballots.

J. Contractingwitlt Tltird Parties. In accordance with Section 31.098 oftheTexas Election Code, the Directors authorize the Contracting Officer to contract withthird persons for election services and supplies. The cost of such third-person servicesand supplies will either be paid by the Contracting Officer and reimbursed to her by theDirectors or the Directors will pay such cost directly to the third persons, as agreed by theparties at the time the services and supplies are ordered.

K. Adopting a Voting System. Section 123.001 of the Texas Election Coderequires the authority conducting an election to adopt a voting system for use in anelection. The Directors hereby adopt a paper ballot system for the election.

posting, the Contracting Officer shall submit the notice to the Directors for approval andsignature within such time frame that will allow its timely publication and posting.

D. Nomination of Presiding Judges and Alternate Judges. No later thanAugust 1, 2005, the Contracting Officer shall submit to the Directors for their approval aproposed list of presiding election judges ("presiding judges") and alternate presidingjudges ("alternate judges") for each of the Election Day polling places designated by theDirectors. Such proposed presiding judges and alternate judges shall meet the eligibilityrequirements in Subchapter C of Chapter 32 ofthe Texas Election Code.

E. Nomination ofPresiding Judge ofEarly Voting Ballot Board. No laterthan August 1, 2005, the Contracting Officer shall submit to the Directors for theirapproval the name of a person to serve as the presiding judge of the Early Voting BallotBoard Such nominee shall meet the eligibility requirements in Section 87.003 of theTexas Election Code.

F. Notification to Presiding and Alternate Judges; Appointment ofClerks.

1. Promptly after being advised by the Directors of the names of thepresiding and alternate judges and the presiding judge of the Early Voting BallotBoard appointed, the Contracting Officer shall notify each presiding judge andalternate judge of his or her appointment. The notification will also include theassigned polling location, the date of the election school(s), the eligibilityrequirements for election workers, the date and time of the election, the rate ofcompensation, the number of election clerks the presiding judge may appoint, andthe name of the presiding or alternate judge, as appropriate.

2. The Contracting Officer will include with the notification to eachpresiding judge, or send them promptly thereafter, a list of registered voters inBurnet County who are willing to serve as election clerks from which each judgeshall make his or her clerk appointments. For those polling locations containingBurnet County voting precincts 2, 10, 12, 13, 18, 20, 22, and 23, the presidingjudge shall choose at least one election clerk who speaks both English andSpanish, if the presiding judge or the alternate judge does not speak both Spanishand English. The Contracting Officer shall ensure that the presiding judges makethe appropriate election clerk appointments and notify the clerks of theirappointments.

3. The Contracting Officer shall prepare writs of election to thepresiding judges in accordance with Section 4.007 of the Texas Election Code tobe signed by the Directors. The writs of election shall be delivered to thepresiding judges at the time specified in Section 4.007.

G. Contracting with Third Parties. In accordance with Section 31.098 of theTexas Election Code, the Contracting Officer may contract with third persons for electionservices and supplies. The cost of such third-person services and supplies will either be

B. Department of Justice Preclearance. The Directors authorize theContracting Officer on their behalf to prepare and submit to the United States Departmentof Justice under the Federal Voting Rights Act of 1965 all required submissions on theholding of an election to create a special district, the designating of election precincts andpolling locations, and the type ofvoting system to be used. The Directors understand thatsuch submissions should be made at least 65 days before the election date, and theDirectors agree to provide the Contracting Officer in a timely manner with anyresolutions or orders that may be required from them in support of such submissions.'

c. Designating Election Precincts and Polling Places. Because Section36.017 of the Texas Water Code requires the order of election to contain the designationof the election precincts and polling places, the Directors shall establish the electionprecincts and the polling places and, at the time they advise the Contracting Officer of theelection date, the Directors shall also advise the Contracting Officer in writing of theelection precincts and polling places they have designated. The Directors agree that anycost of services required to provide access, security, or custodial services for the pollinglocations will be reimbursed to the Contracting Officer.

D. Appointment ofAgent During Election Period. Because the District doesnot have a regular business office, Section 31.123(a) of the Texas Election Code requiresthe Directors to appoint an agent to perform the duties set forth in Section 31.123(b)-(e).The Directors hereby appoint the person named below as such agent and agree that she/hewill maintain the following office address and hours, on regular business days, betweenAugust 5, 2005 and November 3, 2005, when the agent wiUbe available for electionduties:

E. Approval and Signature oftlte Order ofElection and Notice ofElection.The Directors shall promptly approve and sign the order of election prepared by' theContracting Officer so that it is effective no later than the 62nd day before the electiondate and the notice of election prepared by the Contracting Officer, within such a timeframe that will allow the Contracting Officer to comply with the deadlines for publishingand posting such notice.

F. Appointment of Presiding Judges and Alternate Judges. Within suchtime so as not to impede the orderly conduct of the election, under Section 32.005 of theTexas Election Code, the Directors shall appoint the presiding judges and alternate judgesfor the polling places they have designated either from the proposed list provided by theContracting Officer or from other sources. If from other sources, the Directors shallensure that the appointees meet the eligibility requirements in Subchapter C of Chapter

L. Applications for Mail Ballots. The Directors or their agent shall datestamp and then immediately fax or deliver to the Contracting Officer all applications formail ballots that they receive. Promptly after faxing, the Directors or their agent shalldeliver or send by mail the original mail ballot applications to the Contracting Officer.

M. Central Location Bilingual Clerk. In compliance with section 272.009of the Texas Election Code, if the presiding judges advise the Contracting Officer thatthey are unable to find bilingual election clerks, the Directors authorize the ContractingOfficer to have available at a central location one election clerk who is fluent in bothEnglish and Spanish to provide assistance to Spanish-speaking voters. The Directorsagree that the cost of such bilingual clerk will be reimbursed to the Contracting Officer.

N. Promotion and Information About the Election. The Directors assumethe responsibility of providing information about the issues in the election and ofpromoting the schedules for Early Voting and Election Day. The Contracting Officershall have no responsibility for this other than to prepare and have published and postedthe notice of election.

O. Canvass. The Directors shall hold the canvass, in accordance withChapter 67 of the Texas Election Code and Section 36.017 of the Texas Water Code notearlier than the 8th day after the election or later than the 11th day after the election.

II. RESPONSIBILITIES OF CONTRACTING OFFICER. The ContractingOfficer shall be responsible for performing the following services and furnishing thefollowing materials and equipment in connection with the election:

A. Department of Justice Preclearance. The Contracting Officer shallprepare and submit on behalf of the Directors in a timely manner to the United StatesDepartment of Justice under the Federal Voting Rights Act of 1965 all requiredsubmissions on the holding of an election to create a special district, the designating ofelection precincts and polling locations, and the type of voting system to be used.

B. Order of Election. The Contracting Officer shall prepare the requiredorder of election under Section 3.006 of the Texas Election Code, S.B. 967, and Section36.017 of the Texas Water Code for signature by the Directors and submit such order tothe Directors for signature within such time frame that it will be effective on or before the62nd day before the election date.

C. Publication/Posting of Election Notice. The Contracting Officer shallprepare the required election notice under Section 4.003(a)(1) of the Texas Election Codeand Section 36.017 of the Texas Water Code for signature by the Directors, have thenotice translated into Spanish, have such notice published once in an appropriatenewspaper and at a competitive price, and have the notice posted at the Burnet CountyCourthouse and the Marble Falls Courthouse Annex. In advance of such publication and

posting, the Contracting Officer shall submit the notice to the Directors for approval andsignature within such time frame that will allow its timely publication and posting.

paid by the Contracting Officer and reimbursed to her by the Directors or the Directorswill pay such cost directly to the third persons, as agreed by the parties at the time theservices and supplies are ordered.

H. Election School(s). The Contracting Officer shall be responsible forconducting one or more, in her discretion, election schools to train the presiding judges,alternate judges, election clerks, and early voting deputy clerks in the conduct ofelections, .including qualifying voters, provisional voting, and the counting of ballots.The Contracting Officer shall determine the date, time, and place for such school(s) andnotify the presiding judges, alternate judges, and election clerks of such. The ContractingOfficer may hold the election school(s) on a Saturday in order to increase its availabilityto election workers who are employed during the regular work week.

I. Election Supplies; Sample Ballots. The Contracting Officer shall procureor prepare and distribute to the presiding judges or their designees for use at the pollinglocations on Election Day (and to the Early Voting Deputies during Early Voting) thefollowing consumable election supplies: election kits from third-party vendors or theequivalent (including the appropriate envelopes, lists, forms, name tags, posters, andsignage described in Chapters 51, 61, and 62, and Subchapter B of Chapter 66 of theTexas Election Code); pens; pencils; tape; markers; paper clips; ballot box seals; sampleballots; tacks, and all consumable-type office supplies necessary to hold an election. Inaddition, the Contracting Officer shall procure Early Voting mail ballot kits from third­party vendors or the equivalent. The Contracting Officer shall also make available foruse in the election, if necessary, at no cost to the Directors, from her stock of electionsupplies nonconsumable election supplies, such as magnifying glasses, clipboards,staplers, and scissors. Such nonconsumable election supplies shall be returned to theContracting Officer when the election is over. The Contracting Officer shall preparesample ballots on yellow paper for use at the polling locations. The Contracting Officershall also procure white copy paper, for the purpose of photocopying extra poll lists,signature rosters, compensation sheets, tally lists, and return lists.

J. Ballots. The Contracting Officer shall prepare or procure from third-partyprinters, at her discretion, sufficient paper ballots for use during Early Voting and at thepolling locations on Election Day in English with a Spanish translation. "Sufficient"means taking into account that ballots may be "spoiled" and recognizing that voterturnout is unpredictable. At the present time, there are approximately 24,500 registeredvoters in Burnet County. During the November 2004 General Election, approximately15,800 of those registered voters voted. During the November 2003 Special Election onconstitutional amendments, there were approximately 22,500 registered voters in BurnetCounty, of whom approximately 2,950 voted. The ballot will be worded as set forth inS.B. 967. The Contracting Officer shall distribute the ballots along with the electionsupplies to the presiding judge or his or her designee and to the Early Voting Deputies.

K. Registered Voter List. The Contracting Officer shall obtain from theBurnet County Voter Registrar the list(s) of registered voters in Burnet County requiredfor use on Election Day and for the Early Voting period required by law.

L. Ballot Boxes and Transport Bags. The Contracting Officer shall makeavailable for use in the election, at no cost to the Directors, the appropriate number ofBurnet County-owned ballot cans (complete with locks) and transport bags to carryelection supplies and ballots. The ballot cans and transport bags will be returned to theContracting Officer at the conclusion of the election by the presiding judges or their.designees at the Burnet County Courthouse. The Contracting Officer shall have theballot cans and transport bags (containing the ballots, and election supplies) ready to bepicked up by each presiding judge, or the designee of the presiding judge, on theafternoon before the Election Day, at the "Old Jail," on the northeast comer of the Squareacross from the main Burnet County Courthouse, 220 S. Pierce, Burnet, TX 78611 andshall notify each presiding judge of the time such shall be ready.

M. Early Voting. In accordance with Sections 31.096 and 31.097(b) of theTexas Election Code, the Contracting Officer will serve as Early Voting Clerk for theelection.

1. The Contracting Officer shall supervise and conduct Early Votingby mail and personal appearance and shall secure personnel to serve as EarlyVoting Deputies.

2. Early Voting by personal appearance for the election shall beconducted during the hours and time period and at the locations listed in Exhibit"A," attached hereto and made a part of this contract. The Contracting Officershall ensure that the Early Voting polling location is set up for Early Voting andhas the necessary tables, chairs, voting booths, election supplies, and ballots.

3. The Contracting Officer may receive mail ballot applications onbehalf of the Directors. All applications for mail ballots shall be processed inaccordance with Title 7 of the Texas Election Code by the Contracting Officer orher deputies at 220 S. Pierce, Burnet, Texas 78611.

4. All Early Voting ballots (those cast by mail and those cast bypersonal appearance) shall be secured and maintained by the Contracting Officerand delivered by her or her deputy for counting in accordance with Chapter 87 ofthe Texas Election Code to the Early Voting Ballot Board at the main BurnetCounty Courthouse, 220 S. Pierce, Burnet, TX 78611 on Election Day.

N. Election Day Polling Locations. The Election Day polling locations arethose listed in Exhibit "B," attached hereto and made a part of this contract. If suchpolling locations have not been designated at the time this contract is executed, whenthey are designated by the Directors, the designation shall become part of this contract asExhibit "B." The Contracting Officer shall arrange for the use of all Election Day pollingplaces and shall arrange for the setting up of all polling locations for Election Day,including ensuring that each polling location has the necessary tables, chairs, and votingbooths. .

o. Election Reports. The Contracting Officer shall prepare the unofficialtabulation of precinct results under Section 66.056(a) of the Texas Election Code andshall provide a copy of the tabulation to the Directors as soon as reasonably possible afterthe Contracting Officer has received the precinct returns on Election Day night. TheContracting Officer shall also provide to the Directors the results of any provisional votesand any mail ballots received after Election Day, as well as any other documents neededby the Directors for their canvass, by the time the Directors are required to hold theircanvass.

P. Custodian of Voted Ballots. The Contracting Officer is hereby appointedthe custodian of voted ballots and shall preserve them in accordance with Chapter 66 ofthe Texas Election Code and other applicable law. The remaining election records shallbe returned by the Contracting Officer to the agent for the Directors after the ContractingOfficer has provided the Directors with all tabulation and documents described inparagraph 0 above.

Q. Canvass. The Contracting Officer shall provide to the Directors thetabulation information, documents, and the results of provisional votes and late mailballots within such a time frame as to allow the Directors to hold the canvass, inaccordance with Chapter 67 of the Texas Election Code and Section 36.017 of the TexasWater Code not earlier than the 8th day after the election or later than the 11th day afterthe election.

III. PAYMENT

A. Billing. As soon as reasonably possible after Election Day, theContracting Officer will submit an itemized invoice to the Directors for (1) actual costsand expenses directly attributable to the coordination, supervision, and conducting of theelection and incurred or promised on behalf of the Directors by the Contracting Officer,including expenses for Early Voting Deputy and election worker wages, supplies inconnection with the election school(s), publication and printing of the election notice,election supplies, ballots, wages paid to the Contracting Officer's employees for servicesunder this contract performed outside of normal business hours, and any other expensesreasonably and directly related to the election, and (2) the Contracting Officer's fee underSection 31.1 OO(d) of the Texas Election Code. Costs and expenses for whichreimbursement is sought shall be supported by appropriate documentation, except that theprice of items coming out of the Contracting Officer's stock of election supplies shall besupported by the Contracting Officer's certificate about the number of items used and theunit cost therefore according to the vendor's standard price list.

B. Pay/nellt. The Contracting Officer's invoice shall be due and payablewithin 30 days from the date of receipt by the Directors. If the Directors dispute anyportion of the invoice, the Directors shall notify the Contracting Officer within such 30­day period or the invoice will be deemed to be a true and accurate rendering of the

amount that is due. The parties recognize that the District may not immediately havefunds to pay the invoice. In such event, the Directors agree that when the District doeshave funds, the Contracting Officer's invoice shall take precedence over any other debt,except as expressly provided to the contrary under law.

c. Estimated Cost of Services. A cost estimate for election expenses isattached hereto and made a part of this contract as Exhibit "C." The parties agree thatthis is an estimate only and that the Directors are obligated to pay the actual expenses ofthe election as set forth herein.

IV. GENERAL PROVISIONS

A. Nontransferable Functions. In accordance with Section 31.096 of theTexas Election Code, nothing in this contract shall be construed as changing

1. the authority with whom applications of candidates for a place onthe ballot are filed;

2. the authority with whom documents relating to political funds andcampaigns under Title 15 of the Texas Election Code are filed;

3. the authority to serve as custodian ofvoted ballots or other electionrecords, except that the Contracting Officer, if requested in writing by theDirectors, will become the custodian of the voted ballots; or

4. any other nontransferable function specified under Section 31.096ofthe Texas Election Code.

B. Joint Election. The parties acknowledge that Burnet County or otherpolitical subdivisions within Burnet County may hold elections at the same timeas the Directors. The Directors agree that if their polling locations for earlyvoting or Election Day voting are the same as those used by Burnet County orsuch political subdivisions, they will share the polling location(s) and the servicesof the Early Voting Deputies and the Election Day workers. The Directors agreeto share equally with Burnet County and such political subdivisions thecompensation paid the Early Voting Deputies and Election Day worker and anyconsideration for the use of the polling locations under Section 43.033 of theTexas Election Code. In the event of such a joint election, the Directors agree toexecute a Joint Election Agreement with the appropriate political subdivision,which will be attached hereto and made a part of this contract as Exhibit "D."

C. Contract Copies to Treasurer and Auditor. In accordance with Section31.099 of the Texas Election Code, the Contracting Officer agrees to file copiesof this contract with the County Treasurer of Burnet County, Texas and theCounty Auditor of Burnet County, Texas.

Sir:

This letter confirms the emergency declared regarding unforeseen expenses arising out ofthe loss of funding for the Burnet Victim Assistance Program which exists within theDistrict Attorney's Office of the 33rd Judicial District. As you know, this program haspreviously been funded through State grants. The emergency has arisen because the Statehas decided that it will no longer fund the program. No previous warning was everannounced to the County regarding the loss of this vital funding. The decision by theState is not due to any blame on the part of any local governmental agency, including theDistrict Attorney's Office.

The result is alack of funding for this program for the remainder of the current budgetyear and the future. Failure to take immediate steps to continue the funding of thisprogram through this current budget year will result in the loss of service to the manycitizen of Burnet County who are the unfortunate victims of crime. Among theseinnocent victims are persons who are unable to cope with the effects of theirvictimization without the aid of the professionals under this program. Children and theelderly are especially vulnerable. Clearly, this would have an immediate detrimentaleffect upon the citizens. It is for this reason that I have declared an emergency and Iauthorize spending funds from the county fund balance as directed by the Burnet CountyCommissioners Court.

maintenance or repairs as may be necessary to provide protection of life or property on or adjacent to the highway. Changes in design will be

made only with approval of the State.

4. The Grantee shall hold harmless the State and its duly appointed agents and employees against any action for personal injury or propertydamage sustained by reason of the exercise of this permit. .

5. Except for regulatory and guide signs at county roads and city streets, the Grantee shall not erect any sign on or extending over any portion of

the highway right of way, and vehicle service fixtures such as service pumps, vendor stands, or tanks shall be located at least 3.6 meter

(12 feet) from the right of way line to ensure that any vehicle services from these fixtures will be off the highwa

RESOLUTIONCIVIL SUIT FEE

WHEREAS, Burnet County, Texas, is located within the Third Court of AppealsDistrict; and,

WHEREAS, the 79th Legislature enacted Senate Bill 241, which amendsSubchapter C, Chapter 22 of the Texas Government Code; by adding Section 22.2041.

WHEREAS, in order to fund the appellate judicial system, a fee of $5 is set foreach civil suit filed in a county court, county court at law, probate court, or district court inthis county, except that this fee does not apply to a suit filed by this County or to a suit fordelinquent taxes, this fee shall be taxed, collected, and paid as other court costs in a suit.

IT IS FURTHER ORDERED, that the Clerk of the Court who collects theaforementioned fee shall pay same to the County officer who performs the CountyTreasurer's functions, and said officer shall deposit said fee in a separate appellate judicialsystem fund. The balance of the fund shall be paid by the first of the month followingcollection of the fee to: Diane O'Neal, Clerk of the Court, Third Court of Appeals, P.O.Box 12547, Austin, Texas 78711.

IT IS FURTHER ORDERED that management of the appellate judicial systemfund is vested in the Chief Justice of the Third Court of Appeals.

This order shall take effect September 1,2005.

Re: Previous letter of July 22, 2005, concerning Senate Bill 241 and the imposition of a$5.00 fee on civil filings

Dear Honorable Dave Kithil:

It has been brought to my attention that in 2003, Section 51.607(c) of theGovernment Code was amended to provide that "Notwithstanding the effective date ofthe lawimposing ... a ... fee ... the imposition ... does not take effect until the next January 1 afterthe law takes effect." A copy of the pertinent part of the statute is attached for your review.

The other courts cited in my previous letter received approval of the fee prior to 2003,therefore were not subject to the requirement of Governmental Code amendment postponingthe effective date.

I sincerely hope that reliance upon my previous letter did not cause inconvenience, andif it did,please accept my apology. Perhaps, even though my previous letter contained anincorrect effective date, early notice of the existence of the law was helpful in preparation forthe eventual imposition ofthe fee, giving all of us more time to organize administrative plans.

Therefore, as a result of the 2003 amendment cited above, the imposition of the $5.00fee per civil filing will not be effective until January 1, 2006. As always, questions may bedirected to our clerk, Diane O'Neal, at 512-463-1709, or by email [email protected].

(a) Following each regular session of the legislature, the comptroller shallentify ,each law enacted by that legislature, other than a law disapproved bye governor, that imposes or changes the amount of a court cost or feelIected by the clerk of a district, county, statutory county, municipal, or
