Subject: Notation, exceptions and additions to proposal.

Notation: Scope of work,

1. Replacement of (5) heating and cooling units with more energy efficient

models. RTU #4 & #9 model # as shown on bid documents are 6 ton units and not 7.5 ton

units and will be replaced with same capacity units or price difference of 57,720.00 addedto Base.

2. In addition to curb adapters, hail guards for above units, we will include

Manual Fresh air intake dampers.

3. Smoke Detectors on units @ 2000 CFM and above will be provide, wired

to de-energize units in the event of smoke or fire.

4. Tie ins on gas and condensate will be modify from existing to new at each

individual inlet and outlet with same material.

5. Existing Electrical disconnects will be used and configured to accept new.

6. Add $3,194.00for Efficiency of15 SEERfor the 4 & 5 ton units and 12.6

EER for the 6 ton, ifyou want the 7.5 ton @ 13 EER add $2,638.00.

Exception:

l.Work to begin within 30 days of award of contract; we propose

adding... .upon approval and release of equipment proposed from Manufacturer; that

work will be completed with 30 Days.

2. No Fire alarm testing or tie in other then what is presently existing on units

to be replaced.

3. No Certified test and balance on existing duct or air devices.

4. Other than individual thermostat control per unit will be wired and

configured to accept new, no EMS/BAS interfacing software or any type of

communication network is figured in our price.

AND AIR CONDITIONING UNITS

INTENT: It is the intent of this bid invitation to establish prices for the installation of 5

heating and air conditioning units at the Burnet County Courthouse Annex, 1701 E.

Polk, Burnet, TX, all in accordance with the Bid Conditions, Specifications, and/orSpecial Provisions attached hereto.

DUE DATE, TIME, AND LOCATION OF BID OPENING: Sealed bids will be accepted

until Wednesday, July 20, 10:00 AM, at which time the bids will be publicly opened and

read in the Burnet County Annex Conference Room, 133 E. Jackson St., Burnet, TX

78611. Bids will be accepted until the time of opening.

INSTRUCTIONS TO BIDDERS: Bids must be received in the office of the BurnetCounty Auditor/Purchasing Agent on or before the time and date specified. Bids

received after the time and date specified, whether delivered or mailed, will not be

considered and will be returned unopened.

In order to assure your bid is fairly considered, it must be submitted in a properly sealed

envelope, clearly marked on the outside lower left hand corner surface with the

numbers "11-510-05" (this includes overnight envelopes). Bids marked otherwisemay be opened prematurely.

A bid that is in the possession of the Purchasing Agent may be withdrawn by the firm inperson (with the proper identification) or by written request up to the time of the

opening. Bids may not be withdrawn after the opening time. Bids may be altered by e-mail, letter or fax transmission bearing the signature or name of authorized personnel,provided it is received prior to the time and date of opening.

Burnet County is a political subdivision of the State of Texas and is exempt from usualsales taxes.

The Commissioners1 Court of Burnet County reserves the right to reject any and all bids,to accept them in whole or part, to waive any informality in the bids received, to accept

bids separately or combine bids as it shall deem to be in the best interest of BurnetCounty.

No bid may be withdrawn within 45 days of bid opening date. Work must commencewithin 30 calendar days from bid award date.

The County reserves the right to negotiate a contract, in the best interest of BurnetCounty, in private with all responding parties.

SPECIFICATIONS

1) Scope of Work:

The scope of this project shall include the following:

Replace 5 heating and air conditioning units with more energy efficient models. The 4-

and 5-ton units will be at least 13 SEER. The 7.5-ton units will be rated no lower than 11

SEER. The size and number of the units are as follows: one 4-ton unit; two 5-ton units,

and two 7.5-ton units. NOTE: Include SEER rating in your bid. If you want to bid more

than one SEER rating, make copies of the bid response sheet and submit additional

bid(s). See Attachment A for a list of equipment that is to be replaced.

Include curb adapters and hail guards in your price.

2) Site of Work:

The Burnet County Courthouse Annex is located at 1701 E. Polk Street, Burnet, Texas.

3) Laws, Codes and Standards:

The Bidder is responsible for being familiar with all federal, state, and local laws,

ordinances, codes, rules and regulations that may in any way affect the work. All work

must be done in conformity with all applicable local, state and federal building safety

codes, ordinances and regulations.

4) Installation:

Only experienced professionals shall install equipment. All work must be performed

according to industry standards and specifications listed herein.

The Contractor must furnish all labor, materials, equipment, and incidentals required to

completely and properly install all equipment and make operational in accordance with

all specifications.

5) Insurance

The successful bidder agrees to provide liability insurance covering any damage orinjury to persons and property, including damage and/or injury to any of it employees, toall Burnet County employees or members of the public injured by the acts of thecontractor, its employees, or its owner.

The Contractor shall carry Workers1 Compensation and Employer's Liability as requiredby State Law.

To the fullest extent permitted by law, the Contractor and its owner(s) shall indemnify

and hold harmless Burnet County, its officials and employees from and against any andall causes of actions or demands resulting from any misconduct, negligent act, orbreach of obligation by the Contractor or any of its subcontractors it may use inperformance of this project.
