Custom homes come with a new home warranty, too GETTING INVOLVED IN THE CONSTRUCTION OF YOUR NEW HOME MAY AFFECT YOUR WARRANTY

For some people, building a custom home can be a dream come true – the opportunity to design the ideal place that exactly suits their taste and needs. A custom home, built by a builder, is usually considered a “contract home.” It’s a new house built on land already owned by the homeowner where a builder is hired to perform all the work and supply all the materials necessary to construct a completed home.

The builder must provide the mandatory one-year, two-year and seven-year warranties that the law requires for all new houses and condominiums in Ontario. The warranty also provides financial loss coverage of up to $40,000 if you and your builder have a falling out prior to substantial completion of the contract and the amount you paid your builder exceeds the value of the work and materials supplied by the builder.

However, there are always exceptions to the rule. Often with contract homes, homeowners get involved in some of the aspects of the construction, a move that may void part – or even all – of your new home warranty. This is where it is essential that homeowners make informed decisions. Many homeowners don’t realize that signing contracts with trades, and supplying or installing materials themselves may jeopardize their warranty rights.

A new home warranty is not an option. A contract home builder is required to provide the mandatory new home warranty if the builder performs all the work and supplies all the materials necessary to construct a completed home. If the homeowner takes responsibility or

any of the essential elements, the home may be considered “owner built,” and will not be covered by the Tarion warranties.

Essential elements include the footing/foundation, framing, exterior cladding, building envelope, and the electrical, plumbing and heating systems.

An owner-built home is one where the landowner owns the lot, and either exercises significant control over the construction of a new home, and/or is responsible for contributing one or more essential elements to it. This can even include entering into contracts directly with subtrades for those essential elements.

Owner-built homes are not covered under warranty because owners would be providing the warranty to themselves.

Before signing a contract with a builder, make sure he/she is a registered Tarion builder by checking the Ontario Builder Directory at tarion.com. It is a criminal offence in Ontario to build homes without being registered with Tarion. If a contract home builder gives you the option of signing essential element contracts yourself, don’t do it! Insist the builder signs these contracts so your warranty rights are protected.

Work supplied or installed by the homeowner can compromise your warranty. Design and work supplied or installed by the homeowner, as well as alterations, deletions or additions made by the homeowner, are not covered under warranty.

Although supplying some non-essential elements such as finishings will generally keep your warranty intact, it can have an impact on certain aspects of your warranty. For example, supplying and installing a kitchen sink will void your warranty on that sink since it was not supplied or installed by your builder. You can also experience a domino effect if anything you’ve supplied or installed damages something the builder has supplied. For example, a leak from an owner-supplied kitchen sink that damages the builder- supplied floor could void the warranty on the damaged flooring.

When purchasing a contract home, make sure you understand the warranty implications of becoming involved in your home’s construction. If the home is built from the foundation to the finished stage by a builder, it is likely eligible for statutory warranty coverage. However, there are a variety of reasons why a custom or contract home may not be covered under the statutory warranty. Visit tarion.com to find out what types of homes are and are not covered. A fi nancial reason to not overpay for your home

Bidding wars are sometimes a hot topic, with resale homes being priced low so potential buyers will come in with high o� ers. Some markets, such as Toronto, get a bad rap for bidding wars, but we know it’s not the only city in the country that experiences them. After conducting dozens of interviews with real estate agents across the country last year, we found out one Canada-wide truth: if supply is low, demand is high – and many buyers are willing to make o� ers above and beyond what sellers are asking.

Before you make an o� er on any home, even a new home, arm yourself with a mortgage pre-approval; this is the maximum amount of money a lender is willing to give you towards the purchase of a home. When we say maximum, we mean it. � e � rst reason not to overbid on a home is because you don’t want to go over your budget, or stretch yourself so thin that you’re house-poor. But the other reason not to overbid is because your lender’s home appraiser may deter-mine the property isn’t worth what you’ve o� ered; this leaves you in a tricky � nancial position.

“Let’s say you o� ered $400,000 for a home, your o� er was accepted and you have $40,000 to put down. If the bank’s appraiser believes it’s worth only $375,000, the bank will only give you a mortgage equal to their appraised value minus your down payment. In this case, that’s $335,000 ($375,000 - $40,000),” explains James Laird of CanWise Financial. “If you still wanted to purchase the home, you would need to come up with the extra cash to make up the shortfall. � e shortfall is your purchase price minus the mortgage amount your lender will give you. So, in this example, that’s $65,00 ($400,000 - $335,000).”

If you can’t borrow money from family or another outside party, you may be forced to walk away from the deal (and risk losing your deposit, in the process). Not having the resources in this situation is what is often referred to as “appraisal risk,” and it’s obviously something you want to avoid. How is that possible? First, don’t overpay, which is something an experienced real estate agent who knows your market should be able to stop you from doing. Second, saving a larger down payment can help reduce your risk, because it allows you to put less money down and use the extra to make up your shortfall.

Today’s Gen X Canadians overwhelmingly consider themselves “House-Plus” buyers who want enough fl exibility in the budget to aff ord things like travel after paying their monthly mortgage. Only one in seven (14 per cent) Gen X Canadians consider themselves “House-All” buyers who go to the higher end of what they can comfortably aff ord when it comes to their mortgage, leaving less room for discretionary spending. But, according to a recent TD survey, Gen Xers are fairly evenly split between those who see themselves living in their current home forever (42 per cent) and those who see it as a stepping stone to a diff erent property (45 per cent).

“More than two thirds of Gen X Canadians have told us they don’t want their entire budget allocated to mortgage payments,” says Nupi Zubair, associate vice-president, retail products at TD. “It’s possible to own a home and not feel handcuff ed to the mortgage, but it does require careful saving and planning before signing on the dotted line. Buyers need to purchase a home at a price they can aff ord, while still budgeting for the other things on their list of priorities.”

Zubair says that, in addition to the sale price of the home, Gen X Canadians need to factor in other costs of homeownership – such as taxes, maintenance, closing costs and insurance – and set a budget for all of the discretionary things they want to do.

“One way to have more disposable income every month is to make a larger down payment up front, which ultimately reduces the size of the mortgage and monthly payments,” Zubair says. “Keep in mind though, a shorter amortization period and making payments weekly, rather than monthly, can increase overall monthly payments but lower the overall costs of the mortgage. It really comes down to the buyer’s priorities.”

The TD survey found sale price is the most important factor for Gen X Canadians buying a home, followed closely by location and the future appreciation of the home. This was particularly true for those who consider themselves “House-Plus” homebuyers, but even “House-All” buyers put sale price at the top of their list, too. Access to public transit and proximity to schools were much lower on the priority list for all categories of Gen X Canadians, including those who planned to stay in their home forever.

ZUBAIR OFFERS THE FOLLOWING TIPS TO HELP YOUNGER HOMEBU YERS:1. Save for a down payment. The easiest way for buyers

to do this is to set up a regular automatic savings plan and add to it any special monetary gifts or bonuses received. First-time buyers can also take advantage of the RSP Home Buyers’ Plan to build a bigger down payment.

2. Set a budget. Start by listing all sources of income, including any potential help from family. Then list all non-discretionary expenses, such as food, utilities, insurance and car or student loan. What’s left will be the amount available for mortgage payments (replacing current living expenses), savings and any discretionary spending buyers may want to account for.

3. Buy the house that fits the budget. The mortgage should be realistic based on the available budget. If it’s not enough for the desired home, consider holding off and save for a larger down payment, or look for a less expensive property. The alternative to waiting is finding ways to cut back on allocated discretionary spending money each month.

4. Ask for advice. Buying a home is one of the most important investment decisions Canadians will make, so take the time to talk to an experienced professional. Work with a mortgage specialist and financial advisor in tandem to help develop a strategy to save for a down payment and, after closing, help maximize available funds for discretionary spending and future financial goals, such as retirement or a renovation down the road.

Keep in mind though, a shorter amortization period and making

payments weekly, rather than monthly, can increase overall

monthly payments but lower the overall costs of the mortgage.

It really comes down to the buyer’s priorities.

Flooring – it’s not just about decor, it’s also about function

Flooring often sets the tone and feel in a room, which is why choosing the right options for your new home or condo may seem like a daunting decision. The process combines your personal taste with careful thinking about practicality. After all, it is a surface you and your family will walk, stand and sit on.

Since each room in your home serves a different function, your floor covering should complement each room’s function and style. What’s the size of the family that will regularly use the room, and how much traffic will the floor receive? Children definitely make a difference, as do pets. Will the floor be regularly exposed to moisture? How often is it likely to need cleaning? How long do you hope and expect your new floor to last? COMMON LIVING AREASFlooring really comes down to a matter of personal choice. Some people like wood in their living areas, some tile, others carpet, perhaps all three.

Wood flooring has a natural beauty and elegance, looks warm but is a rigid surface, so is less easy on your feet and back. However, it’s stain-resistant, easy-to-clean and offers long-term versatility. Your options range from boards with “character marks” to boards that are almost completely uniform. Oak is the most popular, while maple, birch and pine are also widely used.

Tile offers a nearly unlimited variety of patterns and styles, from the simple to the exotic. Because of its dense composition of clay, minerals and water – and a coating of liquid glass for colour and texture – most tiles are resistant to moisture, odour, fire, stains, scratches, allergens and bacteria, which makes this material ideal for kitchens, bathrooms and transition flooring from

outdoor space to indoor space, such as lobbies or inside patio doors. On the other hand, tiles can feel cold and hard underfoot, so they may not be the best choice if you’re looking for something cosier.

For warmth and intimacy, carpet is probably your best choice. It’s especially appropriate for bedrooms and anywhere you spend a lot of time barefoot. It also provides a certain amount of sound-proofing, as well as warmth and insulation. It is a child-safe surface compared to others, and causes much less damage when kids trip and fall or play at length on the floor itself. It’s inexpensive to install and comes in a variety of colours and textures. The quality and thickness of the underpad is just as important as the carpet itself. KITCHENSWhen selecting kitchen flooring, durability and ease of cleaning should be your top criteria. Good choices are ceramic tile and linoleum. Linoleum is inexpensive and provides an easy-to-clean surface and comes in countless designs. Ceramic tiles offer superior durability, resisting most dents, dings and scratches. Caution, especially if your family includes children: smooth tiles can be slippery when wet, so you may want to consider ones with a textured surface.

Then there is wood. Some feel it’s an unusual choice given that there are so many other flooring options, but hardwood is an excellent choice for the kitchen. Everyone ends up spending a lot of time there, and wood floors are durable, add a “homey” feel and offer great decorating options when contrasted with wood or other cabinet door surfaces. Make sure you apply a good protective finish, such as polyurethane, or use prefinished wood to guard against moisture. BATHROOMSWhile bathrooms tend to be among the smaller rooms in your house, with the proper flooring they can have a large visual impact. Linoleum, ceramic tile, limestone, marble and granite are all popular and functional choices. Ceramic tiles look great and provide superb durability. Should you elect to go with an even more striking and higher-end material such as marble, you’ll need to employ a team of skilled craftspeople. And like kitchens, bathrooms see a lot of moisture.

Choosing your flooring is certainly a big decision, but it doesn’t have to be overly stressful. Plan ahead, asking yourself all the important questions beforehand, including who will use the room, what atmosphere you hope to create, how much effort you yourself want to expend maintaining it, and of course, what you’re willing to spend. Having done that, you’ll be well on your way to picking your perfect floor.

T he fl oral and fragrant gateway to Niagara is St. Catharines, the Garden City. While it may

seem to take its nickname from thousands of acres of blossoming gardens, parkland, orchards, vineyards and farmland which surround it, it could easily be a result of the substantial greenhouse industry which thrives within the protective shelter of the Niagara Escarpment

Named after the wife of its fi rst mayor, William Hamilton Merritt, hence the uncommon spelling, St. Catharines lies between the shores of Lake Ontario and the Niagara Escarpment, 10 minutes from Niagara Falls, 45 minutes from Hamilton and about 110 kms from Toronto’s Pearson Airport.

With a population of 131,400, St. Catharines is home to almost a third of the residents of the Niagara region.

Th e city has maintained a diverse blend of industry and commerce which successfully co-exists with a rich agricultural heritage. Th e soil and climate conditions and the protective environment of the escarpment make this area ideal for growing vegetables and tender fruit which complement the related food processing industry. Th is is also Canada’s most celebrated and prolifi c wine-producing region. Th e region accounts for more than 40 per cent of Canada’s $300-million fl ower and ornamental plant industry. Almost 3,000 full-time workers are employed by area growers who supply national and international markets. Residents and visitors alike enjoy fresh fruits and vegetables right from the source at farms, farmers’ markets and roadside stands.

On the outskirts of the city is the Wine Route, a scenic trail that winds through Niagara to each of the local wineries. With the considerable growth in the wine industry, St. Catharines benefi ts from the creation of agricultural jobs that lead to manufacturing positions at wineries and processing plants, plus skilled specialists, marketing, sales and retail positions, and, of course, construction jobs to build the facilities multiplied by almost 100 wineries in the Niagara area. St. Catharines loves to celebrate both its culture and its agriculture through festivals throughout the year. Th e piece

Lifestyle is the growing focus of the city fathers. St. Catharines presents a number of new, state-of-the-art destinations for visitors and locals alike. Downtown is the new Meridian Centre where residents can watch the Niagara IceDogs of the Ontario Hockey League. In the north end, a new city library neighbours the Kiwanis Aquatic Centre. The city’s new performing arts centre is scheduled to open in 2015. Other cultural pursuits of theatre, music and dance can be uncovered at Rodman Hall Arts Centre and botanical garden, Brock Centre for the Arts, Niagara Artist Company or Montebello Park where the pavilion is alive with entertainment from spring until fall. The extensive waterways, trail systems and parklands of St. Catharines create a natural network of recreational opportunities that include fishing, sailing, boating, hiking, cycling and golfing.

St. Catharines has also prospered as a shopping mecca and features the region’s largest mall, the newly opened Niagara Outlet Mall, plus The Pen, Fairview

Mall that has morphed into a power centre, and Harvard Square. All have grown to address the needs of growing communities and new housing developments.

With the scenic and social attributes of the city, it comes as no surprise that home building is big business, especially when Niagara has become a retirement destination due to attractive resale and new home pricing that appeals to Toronto buyers. According to 2013 figures from Canadian Home Builders’ Association, the residential construction industry’s economic impact this area is substantial, with 1,223 new housing starts contributing to 7,740 construction-related jobs making this industry the largest employer in the region, rivaling health care, the casinos and the public sector. That translates into about $423 million in wages that manifest its influence in spending within the local economy. Formerly a motor city and home to two General Motors plants, GM was once one of the largest employers but now employs a fraction of its former work force, equal to the numbers employed at

the growing call centres located hereAmong those contributing to this

economic impact are the region’s largest home builder, Mountainview Homes with 13 communities underway, Bayview-Wellington Homes with two of its own long-term projects, and Silvergate Homes, renowned for luxury custom builds with five new home communities of its own in the works.

Preparing for the busy season

There are many time-consuming activities we do, despite the fact that we don’t enjoy doing them. Could our time possibly be better spent? Is it possible to unburden yourself by improving your methods or delegating some tasks? If it’s a choice between kids and cleaning or sleep versus cooking, why not call in a cleaner or a caterer if it fits into your budget? As the holiday season approaches, try these tips and see if you enjoy this time of year just a little more with a little less on the agenda.

AVOID MALL MADNESS Do you get stressed when shopping for gifts at the mall? Do those long line-ups and limited parking spots dampen your holiday spirit? There’s still lots of time to shop online and have your items delivered in time for the holidays. Many retailers offer free shipping or other incentives at this time of year. Another option is to hire a personal shopper. Some major department stores actually offer this service at no cost, so ask!

HELP FOR THE HOST Hosting a holiday soiree this year? Don’t be a superhero – accept help from others. Make it a potluck. People feel better when they can contribute, and it makes the meal more interesting. While you’re at it, put your kids to work during the event. They can take coats as guests arrive, freshen up the appetizer plates and load the dishwasher. They’ll be learning valuable skills and you’ll be a more relaxed and joyful host.

ASK AND YOU SHALL RECEIVE As the popular Rolling Stones song goes, “You can’t always get what you want, but if you try sometimes you might find you get what you need.” The part they left out of the lyrics is “...if you only ask.” Few people ask for what they need. We expect that those around us will just know, and that if they really care about us, we shouldn’t have to ask. However, most people aren’t mind readers. As an experiment, just for one week, find the courage to speak up and make a direct request – and don’t be surprised if you get both what you need and what you want!

FREE YOURSELF Challenge yourself to spend one weekend a month without doing chores. If you plan in advance, and use the time during the week effectively, it can be done. In fact, it may even motivate you to boost your productivity level during the week substantially. Use

the time to just relax, unwind and putter around the house. If you find you’re feeling bored, let the initial discomfort pass – on the other side of boredom you’ll find peace and tranquility. Remember, we are human beings not human doings, so we need and deserve to spend some time just “being” – guilt-free.

OVERSCHEDULED AGAIN? With fall in full swing, many of us begin to take on more and more responsibility and, before we know it, our plate is not only full, it’s overflowing. Before getting to the point of exhaustion and resentment that often comes from doing too much for too many, make a conscious choice to put your needs ahead of the needs of others. Give yourself just a little more breathing room than you think you need. When you make your needs a priority, you’ll not only feel happier, you’ll also be more fun to be around.

HOW TO BE HAPPIER NOW Most of us have heard the saying, “don’t sweat the small stuff.” It’s great advice for keeping stress under control. I also invite you to “appreciate the small stuff.” We often think it’s the big things that will make us happy – the house, the fancy car, the great promotion – but those come few and far between. Why put off your happiness until then? Instead, you can find little pleasures to enjoy every single day: A freshly cut flower on your bedside table, a candle in your favorite scent, a visit from a cardinal in your backyard. It’s pretty simple – pay attention to the little things that make you happy, and you’ll see more of them.

Home-hunting tips FOR COUPLES

Many happy couples will admit they are an example of opposites attracting. When these couples decide to buy a home together, their differences can certainly pose a challenge.

Buying a home is exciting but the process can also be stressful. It is the biggest purchase most people will ever make and there will almost certainly be some conflict when two people need to make such an important decision together.

Once a couple understands the house-hunting process, however, they can have informed discussions, come to compromises and ease some of the stress.

Farhaneh Haque, director of mortgage advice at TD Canada Trust, outlines the topics that every couple needs to discuss before they start home-hunting:

When these couples decide to buy a home together, their differences can certainly pose a challenge.» The skeletons in the closet: When a couple takes out a mortgage together, both of their credit ratings, incomes, and other factors are taken into account. If one person’s credit rating is less than ideal, it can affect their joint mortgage application and even the interest rate or type of mortgage they’ll qualify for together. Couples should have an open and honest discussion about finances to decide on their best course of action.

» The expectations: Before they even look at a listing, couples should decide together on their price range based on what they can afford and what features they’re looking for in a home. The home-buying process may move quickly and both parties need to be ready to jump in with both feet when they start searching.

» The mortgage: The decisions don’t end with choosing the right neighbourhood and home features. Deciding on the right mortgage is just as important as choosing the right home. Since a mortgage becomes as much a part of a couple’s life as their new home, it’s important that both are comfortable with the mortgage term, interest rate, repayment schedule and other features. “Some sacrifices will have to be made to find the home and mortgage you will both be happy with,” says Haque. “Having the discussions and coming to these compromises before you’ve entered the pressure-cooker of the home-hunt will make a big difference and likely make the home-hunting journey a much more positive experience for you both.”

Hamilton’s housing market, already a star performer in Ontario especially when compared to high-priced Toronto, will experience steady demand in 2015. Homebuyers moving to the city and increasing job creation support strong existing homes sales, says Abdul Kargbo, senior market analyst for Hamilton and Brantford at Canada Mortgage and Housing Corp. (CMHC).

At the recent CMHC Annual Housing Outlook Seminar for this market, Kargbo said demographic trends will impact the housing industry in Hamilton in 2015.

“� e housing market will benefi t next year from more people moving into than out of Hamilton. � ese out-of-town buyers and a tight resale market will continue to support house prices,” says Kargbo. “Growing housing demand is leading to residential intensifi cation through infi ll and

redevelopment, with multi-unit housing rising to 56 per cent of starts in 2015 and 2016, up from 44 per cent in 2011.”» Existing home sales will remain strong on wider price gap

with Toronto.» More aff ordable areas will see higher existing home sales in

2015 and 2016.» More jobs will be created in 2015 and 2016, which will

support housing demand.» � e rental market will tighten as immigrants and echo

boomers support rental demand.

As for specifi c areas in Hamilton that represent the greatest opportunities for new home purchases, Kargbo says buyers might want to look at Stoney Creek, Glanbrook, Flamborough and Grimsby.

“Given the current land availability and positive net in-migration, (those) areas will see higher level of new residential construction for single-detached and townhouses,” he told New Home & Condo Guide.

� e City of Hamilton core and Burlington will see higher proportion of apartment construction (which includes condo ownership and rental) in the short and medium term, he added.

Land supply issues – including availability and rapidly rising acquisition costs – are having a notable impact in Toronto. � is is even occurring in multi-family housing such as townhomes, previously a popular choice for buyers not able to aff ord detached homes. Over time, this concern could spread to Hamilton.

“Land issues will become more prevalent in the next fi ve years as more people move into Hamilton,” he says. “� is helps explain why intensifi cation could be a solution to growing housing demand and housing aff ordability.”

For Ontario overall, growing economic momentum will support stronger activity in the housing market in 2015.

“However, as mortgage carrying costs continue to grow, due largely to rising home prices, demand will increasingly shift to more aff ordable housing by 2016,” says Ted Tsiakopoulos, CMHC’s Ontario regional economist. “Resale markets surrounding the Greater Toronto Area, higher density dwellings and rental over ownership tenure will benefi t most from the continued shift in buying patterns.”
