Philanthropy: Can We Just Talk About it?

This session will focus on the results of two studies conducted by the U.S. Trust. The 2014 U.S. Trust® Study of High Net Worth (HNW) Philanthropy delves into the motivations, behaviors and giving patterns of HNW families as they express their values through philanthropy, whereas the U.S. Trust Study of Philanthropic Conversations examines the dynamics between HNW donors and their Centers of Influence (attorneys, accountants and financial advisors). Both studies suggest that advisors and HNW donors value the discussion, though oftentimes encounter misunderstanding. An examination of the intersection of these two studies will give professionals in planned giving greater insight into how to have a meaningful conversation that successfully taps into the goals and objectives of their HNW clients.

In his role at National Philanthropic Solutions at U.S. Trust, David oversees a team of philanthropic specialists who provide expertise and comprehensive services to help nonprofit institutional and individual clients build and sustain their philanthropic missions and goals. His team supports Merrill Lynch US Wealth Management advisors, Private Wealth Advisors and Global Institutional Consultants as well as the U.S. Trust Private and Institutional Client Advisors.

David joined Merrill Lynch Trust Company in 1994 as the Regional Trust Manager in South Florida and was named National Executive of Philanthropic Solutions Sales in 2009 for Bank of America, Merrill Lynch and subsequently, U.S. Trust. Prior to working at Merrill Lynch, David was a Senior Vice President and Trust Sales Manager in the Trust and Investment Management Group for SunTrust Bank in South Florida.

David earned his BA from Wake Forest University. He is designated as a Certified Trust and Financial Advisor (American Banking Association) and Chartered Advisor in Philanthropy (American College). He conducted post-graduate work at the Wharton School of Business and Harvard Business School and received his Trust Certification from the Florida Trust School, University of South Florida.

David’s philanthropic involvement has included board and leadership positions with the Florida Grand Opera, the Florida Philharmonic, Broward County Library Foundation and the Community Foundation of Broward County. Currently, he is on the board of Fire Island Pines Arts Project, the Planned Giving Advisory Councils of Museum of Modern Art (MoMA) and the New York Public Library.

Lessons Learned from 35 Years of Charitable Planning

This lunchtime session will focus on the implications of tax rules in gift planning. Successful gift planning unites and maximizes donor desire, gift planner expertise, and yes, the Internal Revenue Code. Linda will offer insights on how to think creatively and plan effectively with donors in the current higher tax rate environment, including recognizing different donor personalities and matching them with suitable techniques. Most to the point, she will offer instruction on how to identify practical and technical (tax) pitfalls that may lead to a derailed gift or result in an unhappy donor and suggestions on how to avoid such issues and keep your donors satisfied while helping your institution to thrive philanthropically.

Gifts of real property can be complex, but they are often larger than gifts of other assets and worthwhile for charities to accept and manage. We will discuss how institutions can best prepare to capitalize on a real estate recovery, including building internal support for these gifts and marshaling the resources necessary to assess, close, and manage gifts of real estate. We also will address how to identify real estate gift opportunities, how to manage donor expectations, how to avoid surprises and whether or not to serve as the initial trustee of a real estate-funded trust.

Hit the Easy Button with Gifts of Complex AssetsJohni Hays, JD Thompson & AssociatesIt’s becoming more common for donors to propose to their favored charities donations of assets that are far more sophisticated than the typical gift of cash or securities. And increasingly donors may be looking to you for guidance. Uncover the mystery behind gifts of complex assets in this session. Johni Hays, JD will discuss an array of complex assets, outlining the various tax advantages--and disadvantages--for the donor and highlighting the issues associated with the various types of assets that may arise for your organization. You’ll learn a methodology for determining whether a gift of a specific asset type makes sense for the donor and for your organization.

Engaging Your Donors EthicallyDonald W. Kramer, Esq., Montgomery, McCracken, Walker & Rhoads, and Charles Sterne III, Curtis Institute of MusicWhen Mr. and Mrs. Legacy decide to create a $1 million charitable remainder trust for the benefit of their favorite charity, nothing seems to happen. What are the responsibilities of the charity’s development officer and those of the donors’ attorney and financial planner in closing this gift? Who should draft the documents? Who should pay the fee? Who should serve as trustee? What happens when, unbeknownst to the Legacies, but known to the professionals, their family’s financial circumstances change? Explore these and other ethical issues that planned giving officers and other professionals face in collaborating with potential donors.

Marketing Legacy Gifts: Strategies that WorkClaudine A. Discovering Spectacular Success with a Survey CampaignJonathan Gudema, JDAfter years of trying numerous marketing techniques and approaches in various professional roles and on behalf of a host of clients and not finding much success, I finally launched a campaign that worked in a big way: over 50 new Legacy Society members and over 400 self-identified prospects with whom to follow up! This session will feature several of my trials and tribulations marketing planned gifts, particularly the project for the client that led to the breakthrough, and then explain the specifics of the survey campaign that saw incredible results and offered many lessons for future consideration.

What makes a successful fundraiser? How can you adopt some of those techniques?Joseph B. Tumolo, CAP®, Planned Giving EssentialsSuccessful fundraisers are not born. They do not “wing it.” They do not sit in their office waiting for the phone to ring. Successful fundraisers have a system, a process which they follow to help them meet and exceed their goals. They visit with donors and talk with them every day. Joe combines proven techniques, real examples and light humor to provide practical content that you can implement immediately. Balancing in-depth knowledge of sales, communication and fundraising, Joe will share concrete ideas and tools that every fundraiser should know and utilize.

Of Course You’ve Got Style—But It’s Not About You. . .Bob Fogal, PhD, ACFRE, CAP®, Fogal AssociatesWe seldom take time to analyze how our natural ways of expressing ourselves affect others. Understanding and accommodating differences in communication style can enhance our ability to engage donors more effectively by interacting with them from their point of view. For example, are the results I’m describing the results in which she’s interested? Is the information I’m providing meaningful to him? If not, how should I express myself? Drawing on the Myers–Briggs Type Indicator (MBTI) assessment (MBTI®), this session will offer a guide to communication that will strengthen your ability to interact successfully with others.

When is a CGA Better Than a CRT?Alvin Blitz, JD, Masonic Charities, and Scott Meyer, JD, Montgomery, McCracken, Walker & Rhoads The session will examine issues in which a Charitable Gift Annuity (CGA) may trump a Charitable Retained Remainder Trust (CRT)--specifically, in cases when a CRT may be unavailable due to potential self-dealing or significant unrelated business income tax (UBIT) and taking into account the perspectives of both the donor and the charity. Some emphasis will be given to comparing the economics of a CGA to a CRT for very elderly donors (over age 77) and to discussion of a CGA as the only possible planned giving tool in sophisticated business planning with pass-through entities. Enhanced knowledge of the potential benefits and possible pitfalls of a CGA versus a CRT will enable planners to recognize and consider pursuing sophisticated charitable gift opportunities.

SESSION IV

Beyond Basic Demographics -- Attitudes and Behaviors Related to the Dimensions of Healthy AgingMichael Hutney, The Stelter CompanyThis presentation will relay findings from a new U.S. study on healthy aging and examine the significance of such findings for those professionals working in charitable gift planning. Health, finances and interpersonal relationships all play a role in how seniors and boomers perceive planned giving, and this session is intended to offer guidance to planned gift officers in creating appropriate communications, devising and managing strategies and cultivating and maintaining long-term relationships with donors.

Essential Gift Annuity Elements for the Master FundraiserScott Janney, Ed.D., CFRE, RFC, Rowan UniversityA master fundraiser offers donors and prospects a variety of options for achieving their philanthropic objectives. Being effective in this role requires an understanding of the essential elements of the charitable gift annuity (CGA). This presentation will help you understand the many benefits CGAs offer your donors and your charity by explaining the similarities and differences between CGAs and commercial annuities, knowing the pros and cons of funding a CGA with cash versus stock, and describing the CGA that pays immediately versus the ones that delay the first payment to the donor in exchange for a higher rate. We will also discuss state regulations and what is required to establish a CGA program.

Planning for Gifts of Qualified Plan Assets and Business InterestsPhilip Cubeta, CLU®, ChFC®, CAP®, The American CollegeIn this session we will explore best practices for serving our highest capacity donors whose major assets lie not in cash, but in complex assets such as qualified plan interests and/or closely held business interests. Assisting these donors and educating them regarding the merits of using such assets to establish a life-income arrangement with their favorite organization will become increasingly important as boomers transition into retirement and want an active retirement with increased nonprofit engagement. How can we, across our disciplines, help these clients and donors with their planning? How can we collaborate so that donors succeed in having maximum social impact while ensuring that their affairs are handled efficiently from a tax perspective?

Christopher S. Abbott, CFPChris serves as Director of Development and manages all fundraising efforts at the Masonic Charity Foundation of New Jersey. A member of the Foundation’s staff for 25 years, he has a unique perspective of the long-term processes inherent to gift planning programs. Chris has served on the Board of the Partnership for Philanthropic Planning of Greater Philadelphia for the past four years as Program Committee Chair and Secretary. Philip Cubeta, CLU®, ChFC®, CAP®As the Sallie B. and William B. Wallace Chair in Philanthropy at The American College, Phil Cubeta is responsible for the Chartered Advisor in Philanthropy® (CAP®) curriculum. Prior to joining The American College, Phil served as Chief of Staff for The Nautilus Group, a service of New York Life Insurance Company providing estate, business, and philanthropic strategies to affluent clients through 200 of the company’s top agents. Phil earned a BA at Williams College in English Literature; an MA at Oxford University in Philosophy and Psychology; and an MA and M.Phil. at Yale University in English Language and Literature. Anne DeVivo DeMesaAnne serves as Vice President for Gift Planning at Barnabus Health. A member of the Gift Planning Council of New Jersey and a non-profit development professional for 17 years, Anne has held numerous positions in the field: a grant writer and Director of Development at an art museum; a Donor Relations and Stewardship Officer in a university advancement office; an Associate Director of Major Gifts and Director of Planned Giving for the Catholic Church; a Director of Major Gifts for a performing arts organization and the New Jersey Symphony Orchestra (NJSO). Anne implemented the Centennial Legacy Challenge that helped NJSO identify nearly $10M in documented planned gifts committed to its endowment pipeline, as well as $1M in corresponding challenge cash donations from generous individuals and foundations committed to helping the NJSO leverage more legacy gifts. Anne holds a BA from Fairfield University and an MA from Rutgers University in Art History and Museum Studies.

Claudine A. Donikian, JD, MBAClaudine is the president, chief executive officer, and chief marketing officer of Pentera, Inc. A sought-after national speaker, she is regarded as one of the foremost experts in planned giving marketing and is editor-in-chief for Pentera’s corporate marketing content and client marketing content. Claudine’s professional area of interest is women in philanthropy, and she serves as a member of the Advisory Council for the prestigious Women’s Philanthropy Institute at the Indiana University Lilly Family School of Philanthropy and as a member of the board of directors of the Partnership for Philanthropic Planning.

Bob currently serves as a board member of the Partnership for Philanthropic Planning of Greater Philadelphia and chairs PPPGP’s annual Planned Giving Course. Before entering the field of philanthropic fundraising in 1979, Bob taught church music at the Protestant Institute for Advanced Theological Studies in Buenos Aires, Argentina. He is a certified MBTI® trainer and a licensed minister in the United Church of Christ.

Jonathan Gudema, JDJonathan has over 18 years of experience working with non-profit organizations on planned gift arrangements and tax-advantaged charitable estate planning options. An attorney by training, Jonathan advises charitable organizations on managing planned giving programs while working with staff, donors and advisors to cultivate and close significant planned gifts. Prior to founding Planned Giving Advisors in 2011, Jonathan was a Managing Director at Changing our World, the third largest U.S.-based fundraising consulting firm, where he led consulting projects and outsourced the planned giving staff for several major clients. He also has held senior management positions in planned giving with the Anti-Defamation League, United Jewish Communities and Continuum Health Partners. Jonathan authors The Planned Giving Blog that provides news and commentary on the field of planned giving with over 950 subscribers and over 50,000 visitors since its launch in 2010. Jonathan earned a BA in Political Science from Rutgers University and a JD from Western New England College School of Law.

Johni Hays, JD Johni is a Senior Vice President with Thompson & Associates, a charitable estate planning firm. She wrote the book, Essentials of Annuities, and co-wrote The Tools and Techniques of Charitable Planning. Johni is the president of the Charitable Estate Planning Institute and serves on the national board of the Partnership for Philanthropic Planning. With more than 20 years experience as a practicing attorney in charitable and estate planning, Johni Hays is a recognized expert on the subject of charitable gift planning.

Margaret HolmanMargaret M. Holman is president of Holman Consulting, a full-service fundraising consulting firm she founded in New York City in 1991. Until 1997, she was also a senior consultant in the Northeast region for The Sharpe Group, a planned giving company located in Tennessee. She has held senior fundraising management positions at a variety of arts, health and educational institutions throughout the country. Ms. Holman has published numerous articles on planned giving and non-profit management, lectures widely, and has served on the faculty of various institutes and conferences--including the Partnership for Philanthropic Planning Conference, the European Association for Planned Giving, the Association of Fundraising Professionals (AFP) and the International Conference for Fundraising Managers the United Kingdom. She is a president emeritus of the Philanthropic Planning Group of Greater New York.

Michael HutneyMichael is the Director of Product Strategy and Innovation for The Stelter Company and relies on his extensive background in sales, communications and marketing to spearhead Stelter’s efforts to help nonprofits connect and communicate with their donors. Beyond his work in product strategy, Michael continues to work directly with national organizations such as the U.S. Fund for UNICEF, Memorial Sloan Kettering Cancer Center, Girl Scouts of the USA, Hadassah, and the National Society Daughters of the American Revolution. Before joining Stelter, Michael worked for the Hewlett-Packard Company and the Vignette Corporation, serving numerous enterprise-level organizations, including American Express, AT&T and The Principal Financial Group. Michael is a proud graduate of Texas A&M University. He currently serves on the board of directors for the National Capital Gift Planning Council based in Washington, DC.

Scott Janney, EdD, CFRE, RFCScott serves as Assistant Vice President for Development at Rowan University. In his 20 plus years in the field, he has closed more than a dozen seven-figure gifts for organizations that include Villanova, Temple, Main Line Health, and St. Mary Medical Center. Scott has made ten presentations at the National Conference on Philanthropic Planning and published seventeen national gift planning articles. He is the President of PPPGP and served on the National Board of PPP. Scott earned his BA from Asbury University, MA from Princeton Theological Seminary, and Ed.D. from Temple University. He is a CFRE and a Registered Financial Consultant (RFC).

Donald W. Kramer, JD Don is chair of the Nonprofit Law Group at the Philadelphia law firm of Montgomery, McCracken, Walker & Rhoads, LLP. Don has more than 40 years of experience dealing with the concerns of nonprofit organizations, not only as a lawyer, but also as a teacher, writer, publisher, and board member. Don is editor and publisher of Don Kramer’s Nonprofit Issues®, a national electronic newsletter of “Nonprofit Law You Need to Know” (www.nonprofitissues.com), which he started at Montgomery, McCracken in 1989. He writes and lectures

frequently on nonprofit legal issues and has taught courses on nonprofit organization law at the University of Pennsylvania Law School, the School of Social Policy and Practice at the University of Pennsylvania, and Eastern University. He has worked with nonprofit organizations of all types and sizes, helping structure start-up situations and restructure multi-organizational social service, health and educational systems. He counsels on a wide range of corporate, governance, tax, real estate, charitable giving and other nonprofit issues. Don also serves on the Boards of the Pennsylvania Association of Nonprofit Organizations, the Philadelphia Council for Community Advancement and the Philadelphia Fire Department Historical Corporation. A graduate of Princeton University, he earned an LL.B. degree from Harvard Law School.

Bruce B. Makous, CFRE, CLU, ChFC, CAP®Bruce is Director of Development at the ACLU of Pennsylvania and also serves as a consultant with Barnes & Roche, Inc. He has been a professional fundraiser for 30 years. He was previously national Vice President for Development with the Multiple Sclerosis Association of America and is a published author and a frequent presenter. Bruce was named by The Nonprofit Times among the “Most Influential and Effective” fundraisers in the US in 2009, an honor awarded to only 14 individuals annually. He is a past president of PPPGP and AFP-GPC, a past national board member of both PPP and AFP, and currently serves on the board of PPPGP. He earned a BA from Oberlin College and an MA from New York University.

Scott Meyer, JDClifford Scott Meyer is a partner in the Business Department at Montgomery, McCracken, Walker & Rhoads, LLP and a member of the Trusts & Estates, Tax, and Nonprofit Organization practice groups. His diverse practice includes financial and tax Monte Carlo modeling of sophisticated transactions, domestic asset protection, tax reformation of instruments and transactions, closely held business succession planning, technical support for planned giving departments of major institutions and individual tax planning. Prior to joining Montgomery McCracken, he was a partner with the now dissolved law firm of Cohen, Shapiro, Polisher, Shiekman and Cohen. He is a frequent lecturer for the Pennsylvania Bar Institute. Admitted to practice in Pennsylvania, New Jersey and Tax Court, he graduated magna cum laude from Bucknell University in 1976. In 1981, he received his JD, cum laude, from the University of Pennsylvania. He earned an LLM in Taxation from Villanova University in 1985.

Vikan MikaelianViken Mikaelian was the first to bring planned giving to the Internet in 1999. Since then, his company PlannedGiving.com has helped over 1,200 non-profits get their planned giving programs online. Many people make a living by complicating planned giving. Viken makes his by keeping it simple. He shoots straight, keeps things practical, and adds a welcome splash of flavor to otherwise vanilla topics. Viken graduated from the University of Pennsylvania.

Delia Perez, CFREDelia is the Director of Planned Giving for Fairleigh Dickinson University and an accomplished entrepreneurial professional with 30 years leadership experience in all aspects of philanthropy. Her fundraising career includes senior management positions with nationally prominent organizations such as the American Kidney Fund, University of Delaware, Recording for the Blind & Dyslexic, Bucknell University, and the Hospitaller Brothers. She is the Immediate Past President for PPPGP and serves as the Faculty Committee Chair for the Planned Giving Day Conference. She served on the executive boards for New Jersey Community Health Charities and AFP-GPC, co-chairing the Youth in Philanthropy Project and the Awards Committee for National Philanthropy Day. She is a member of the Executive Committee for USMS Delaware Valley as the Open Water Swimming Representative.

Timothy Prosser, JDTim is a Relationship Manager/Senior Technical Consultant at Kaspick & Company. Tim has nearly 20 years of experience in legal practice and financial services, having worked at TIAA-CREF Trust Company for 15 years and practiced law in the areas of estate planning, estate and trust administration, charitable giving, and business succession planning with the firms of Sonnenschein Nath & Rosenthal and Armstrong Teasdale Schlafly & Davis in St. Louis, Missouri. Tim has served on the board of the Partnership for Philanthropic Planning and as Chair of its National Conference. He is a board member and past president of the Saint Louis Planned Giving Council and is a recipient of the Council’s “Founders Award.” Tim is a frequent speaker at national and regional conferences on charitable and tax planning. He received his BA in Russian Area Studies from Loyola University in New Orleans and his JD and MA in Public Administration from St. Louis University.

Charles Sterne IIIChuck is Director of Principal Gifts and Planned Giving at the Curtis Institute of Music in Philadelphia, Pennsylvania. Chuck started the school’s planned giving program in 1993 and subsequently helped Curtis complete three successful endowment/capital fund drives, including the $35 million Sound for the Century campaign, a $17 million campaign to secure challenge grants from the Lenfest and Annenberg Foundations, and a five-year, $158 million comprehensive campaign which concluded in May 2013. Chuck is a member of the Association of Fundraising Professionals, the Partnership for Philanthropic Planning and the Partnership for Philanthropic Planning of Greater Philadelphia. He has served as president of the local planned giving council, co-presented and moderated past sessions at Planned Giving Day and the Franklin Forum and has lectured on planned giving for Drexel University’s Arts Management Program.

Joseph B. Tumolo, CAP®In 2014 Joe joined Gift Planning Development to focus his attention on training. Joe coaches fundraisers and board members all over the country. He incorporates relational sales training with planned giving to develop well-rounded fundraisers who are less transactional and more relational in their engagement with donors that leads to valued relationships. Joe is a board member of the Planned Giving Council of Greater Philadelphia and planned giving advisory chair for Montgomery County Community College in Blue Bell, Pennsylvania, where he participates in the solicitation and stewardship of planned giving donors. He recently earned certification as a Chartered Advisor in Philanthropy at the American College in Bryn Mawr, Pennsylvania.

Andrew WheelerAndrew serves at Diversitfied Search, where he is Managing Director and Practice Leader of the Education and Not-for-Profit Practice, an active member of the Healthcare Practice, and also a member of the Executive Committee. Previously, he served at Diversity Search in the role of Chief Lean Officer and spearheaded initiatives to deliver more value to clients. Passionate about identifying the right individuals who can have a significant impact on mission-driven institutions and non-profit organizations, Andrew has spent his entire career discovering and recruiting leaders.
