76. Regular Meeting - October 5, 2009 Closed Session - Personnel Item Chairman adjourned the meeting to a closed session at 5:07 p.m. to discuss complaints against a public employee (Gov. Code sections 54957(b)): one case (Article VII of the collective bargaining agreement between Covina-Valley Chapter 49, California School Employees Association (CSEA), and the Covina-Valley Unified School District-consideration of grievance filed by classified employee). Chairman reconvened the meeting in open session at 5:31 p.m. Report of Action in Closed Session - Personnel Item Chairman asked for a report of the action taken in closed session. Motion by Mr. Myrick, and seconded by Mr. Kemp, that the grievance filed by a classified employee be denied. Motion was unanimously carried by Dr. Hanes, Mr. Kemp, Mr. Knoll, Mrs. Meister, and Mr. Myrick all voting Aye. Closed Session - Employer-Employee Relations Chairman adjourned the meeting to closed session at 5:32 p.m. to discuss negotiations with members of the District’s negotiating teams regarding contracts with the Covina-Valley Chapter 49, California School Employees Association (CSEA), and the Covina Unified Education Association (CUEA), with no action and reconvened the meeting in open session at 5:58 p.m. District Academic Progress Report Dr. Wanda Pyle, Director of Curriculum and Instruction, and Dr. Stella Port, Director of Assessment, Evaluation, and Instructional Technology, provided a presentation to the Board regarding the District’s Adequate Yearly Progress (AYP), Academic Performance Index (API) results, and the Program Improvement (PI) process. Gifts Accepted Motion by Mr. Knoll, seconded by Dr. Hanes, and unanimously carried, that the following gifts donated to the District be accepted with thanks: • $30 from Child Related Research to Vincent Children’s Center • $75 from Lasr-Ink Corporation to Merwin Elementary School • $269.25 from Carlos Lugo to Lark Ellen Elementary School • $24 from Macy’s West G.I.F.T. to Vincent Children’s Center • $35 from Liliana Martinez to Lark Ellen Elementary School

Memorandum of Understanding - Community Day School Services Motion by Mr. Knoll, seconded by Dr. Hanes, and unanimously carried, that Covina-Valley Unified School District’s Memorandum of Understanding with the East San Gabriel Valley Regional Occupational Program be approved for Community Day School Services. District Membership and Participation Motion by Mr. Knoll, seconded by Dr. Hanes, and unanimously carried, that membership and participation in the following association be approved for designated staff for the 2009-10 school year: • Advancement Via Individual Determination Las Palmas Middle School (AVID)

Student Exemptions from Physical Education Motion by Mr. Knoll, seconded by Dr. Hanes, and unanimously carried, that the following requests for student exemption from physical education requirements be approved:

• Student Case No. 09-10-01, a senior at South Hills High School, be granted exemption from all physical education class participation and the 20-credit physical education requirement for graduation.

• Student Case No. 09-10-02, a junior at South Hills High School, be granted exemption

from physical education class participation for the 2009-10 school year. • Student Case No. 09-10-03, a junior at South Hills High School, be granted exemption

• Covina-Valley music teachers, Sharon Cathey and Richard Jadrich, will be paid a stipend

of $2,500 each to prepare and coordinate the choral and instrumental music festivals April 19-20, 2010 and May 24-26, 2010.

• Heidi Headcock, Patti Shawn, and Julie Starrett, will be paid the District’s consultant rate

of $34.24 per hour, not to exceed 100 hours total, October 1, 2009 to June 30, 2010, to conduct sign language classes for parents and relatives of DHH students.

• As part of the collective bargaining agreement, middle schools are provided $2,500 in

stipends to provide leadership in the core content areas: A $500 stipend for teachers coordinating core content areas in language arts, social science, science, and mathematics; and one $500 stipend will be used at the discretion of the principal and site leadership team.

• As part of the collective bargaining agreement, elementary schools are provided $1,000

each to be used as teacher stipends. These stipends will recognize staff for services provided above and beyond their normal duties. Each principal, with input from their leadership team, will decide how the funds will be distributed.

Teacher Assignments Motion by Mr. Knoll, seconded by Mr. Myrick, and unanimously carried, that the following teachers be authorized to teach under Education Code Section 44256(b) respectively as set forth below: Under Education Code Section 44258.3, local school districts may assign teachers who hold teaching credentials to teach in departmentalized classes, with their consent in K-12, irrespective of the designations on their teaching credentials, as long as the teacher's competence is verified according to policies and procedures established by the governing board consistent with the language of the statute.
