12.1 There is a high pressure oil pipeline that crosses the southern part of the site

12.2 This section of the ES will identify the location of the high pressure oil

pipeline, it will set out the requirements of the guidelines on work near

Location of the Oil Pipeline

12.3 The High Pressure Oil Pipeline is an Esso Pipeline that runs from Alton in the

west to Purfleet in the west, and operates at a pressure of 1100psi and is a

10” pipeline.

Appendix 12.0/A. It can be seen from the plans that the pipeline is located to

various companies who own or operate pipeline. The guidelines identify the

pipelines and sets out guidelines for work near pipelines. A full copy of the

Guidelines can be found at Appendix 12.0/B.

Infrastructure 12 12.6 In summary, the restrictions as they relate to physical development are as

follows:

• Operators are required to provide notification of their intension to carry

out underground works when within 50 metres of the pipe and in the

same parcel of land,

• No lowering or raising of the ground level throughout the easement

without prior consent,

• Concrete slab protection will be required over the pipeline at

permanent road crossings and parking areas, including temporary

construction areas,

• No buildings, structures or caravans to be within the easement,

• The pipeline easement should always be in an open area, as access

to the easement and / or the pipeline is required at all times,

• Tree planting is restricted,

• No pile driving within 30 metres of the pipelines without prior

agreement, and

• High voltage electric cable crossing may require special consideration.

12.7 Furthermore, the guidelines advise that no works shall take place within 3

metres on either side of a pipeline without prior approval of the pipeline

operator in accordance with the provision of the Deeds of Grant and the Acts

of Parliament.

Potential Impacts

12.8 The potential impacts from the development upon the pipeline will be

assessed in terms of the 50 metre and 6 metre zones as identified in the

aforementioned guidelines.

12.9 The proposed development is set out in detail at Section 2 of this

Environmental Statement. The nearest development is the conversion and

change of use of the barn to a sports shed located within the farm buildings

complex. The sports shed is located some 80 metres north of the oil pipe line.

The only other development on the site is the redevelopment of the main

house on the site. The house is located some 950 metres north of the oil

pipeline. The nearest proposed new trees are located 15 metres from the

pipeline, however a shallow rooted hedgerow is proposed to cross the

pipeline. This is shown on the drawing at Appendix 12.0/C.

Assessment of Impacts

12.10 Table 12.1 below assesses the proposed developments as set out above

against the 50 metres and 6 metre restriction zones as required by the

guidelines

12.11 As set out above there are no underground works proposed within 50 metres

of the pipeline and as such no safe systems have to be put in place or

notification of the intention to carry out underground works is required.

12.12. Furthermore, there is no physical development proposed within 3 metres

either side of the pipeline and as such prior approval for development is not

required.

12.13 There are no trees proposed to be planted within 3 metres of the pipeline,

however a shallow rooted hedge is proposed that crosses the pipeline. Esso’s

agents, Fisher German have confirmed that the proposed hedgerows are

acceptable.

impact on the high pressure oil pipeline or any impact on the environment in

relation to that pipeline.

The purpose of this booklet is to provideguidance on the basic requirements forsafe working in close proximity to buriedpipelines owned and/or operated by BP,BPA, ConocoPhillips, E-On, EssoPetroleum Co. Ltd, The GovernmentPipelines and Storage System (GPSS),Huntsman, Mainline Pipelines Ltd,Manchester Jetline Limited, Shell and Total.They are not exhaustive and a safe systemof work, including any specificrequirements of the operator, should beagreed prior to work commencing.

To fulfil their duty to specify safe systemsof work near the pipelines, the operatorsrequire notification of the intention to carryout underground works (as more fullydefined in pp18-21) when within 50metresof the pipe and in the same parcel of land,i.e. not separated by a fence or otheridentifiable division. The operator is thenresponsible for clearly marking the detailedroute of the pipe (a free service) and thespecification of any constraints on theproposed method of working.

All works require prior approval exceptroutine agricultural operations; however,drainage operations and mole ploughingmust be approved.

When planning works which could involvecrossing or working close to a high-pressure pipeline then the land owner,occupier, utility company or contractorshould supply details of the proposedworks to the Pipeline Operator or hisAgent. These should include:

1 A brief description of the proposed works.

2 A plan with a National Grid reference.

3 A proposed time scale for the works.

No works shall take place within 3m (10ft)on either side of a pipeline without priorapproval of the pipeline operator inaccordance with the provisions of theDeeds of Grant and the following Acts ofParliament: -

• Requisitioned Land and War WorksAct 1948.

• The Land Powers (Defence) Act1958.

• Shell-Mex and BP (London AirportPipeline) Act 1959.

• Esso Petroleum Company Act 1961.

• Pipelines Act 1962.

• Pipeline Safety Regulations 1996.

Section 16 of The Land Powers (Defence)Act 1958 prohibits most works within the easement without the prior consent of the Secretary of State. (See guidance note 15).

For the purposes of this document theterm “easement”, as used, includesproperty rights arising under Deeds ofGrant, Wayleaves and other rights in landgranted under the above Acts.

Details of the relevant operators or theiragents are listed in this booklet.

1 All work shall be in accordance with theGuidance Notes. (Contained in thisbooklet). Prior to commencement of allworks a written task risk assessment andmethod statement will be required. Ingeneral a legal consent will be requiredprior to any works within the wayleave.Adequate time should be allowed for thecompletion of these consents.

2 No raising or lowering of ground levelthroughout the easement without writtenconsent from the pipeline operator.

3 Concrete slab protection will be requiredover the pipeline at permanent roadcrossings and parking areas, includingtemporary construction areas, typically, asper example (Appendix I). Prior toinstallation the developer shall expose thepipeline under the supervision of arepresentative of the Pipeline Operator andarrange for the existing protective pipewrapping to be inspected, repaired andthen double wrapped at the Promoter'sexpense by a contractor approved by thePipeline Operator or his Agent.

4 The easement shall be pegged out andfenced off prior to works commencing.Agreed crossing points across theeasement for construction machines shallbe protected by tied timber mat, “Bog Mat”or a temporary concrete slab or hardcore,as per example (Appendix II).

5 To prevent indiscriminate crossingsalong the pipeline, service crossings (i.e. drains, cables, pipes, etc.), should be grouped together at a common point.These should be ducted if possible.

6 Pipeline marker posts shall be installedat the Promoter's expense each side of allroad crossings and elsewhere asnecessary, to mark the pipeline route. The Pipeline Operator to supply markers (2 weeks notice required).

7 No buildings, structures or caravans tobe within the pipeline easement.

8 The pipeline easement should always bein an open area, as access to theeasement and/or the pipeline is required atall times.

9 Attention is drawn to the fact that thepipeline is cathodically protected. This cancorrode metal structures in the vicinity andit is the Promoter's responsibility to protecttheir constructions against this.

10 Tree planting is restricted.

11 No explosives to be used within 400metres (1300 ft) of the pipeline withoutprior agreement with the Pipeline Operatoror his Agent.

12 No pile driving within 30 metres (100 ft) of the pipelines without prioragreement with the Pipeline Operator or his Agent.

13 No 3D seismic survey using theVibrosis method within 30 metres (100ft)of the pipeline without prior agreement.

14 Directional drilling, thrust boring orother trenchless techniques will beconsidered as an alternative method ofcrossing the pipelines subject to certainconditions being fully adhered to.

15 High voltage electric cable crossingmay require special consideration.

General Information

• All the pipelines mentioned are highpressure, steel pipelines containingpetroleum products.

• Sizes vary from 150mm, (6�) to 750mm(30�) diameter.

• Nominal depth of cover is 0.9m, (3ft)although in some locations this covermay be less. e.g. Canal towpaths.

• The employing authority (or hiscontractor) shall be responsible for all or any liability under the Health andSafety at Work Act, 1974, etc.

1 Pursuant to the provision of theapplicable Acts, a Consent is requiredbefore commencing any work within 3m(10 ft) of a point on the surface of the landvertically above the position of the pipeline.Such works shall include, but not belimited to:-

(a) the erection or construction of abuilding, structure, road or path

(b) excavation or the deposit of earth,refuse, spoil or other material on theground.

or,

(c) the crossing by a utility or other service.

Full details of the proposed work shouldbe submitted to the appropriate PipelineOperator or his Agent.

Applicants are normally requested to enterinto a form of indemnity before Consent isgiven. The employing authority should notethat any one incident involving damage tothe pipelines could result in claims inexcess of £5,000,000 and they shouldensure that they have adequate insurancecover. The Pipeline Operator or theirAgent shall have the right to inspect allrelevant policies and premium receipts.

2 The conditions mentioned herein arecommon to most works but are notexhaustive. Other conditions may beimposed depending on the nature of thework.

3 Prior to any work commencingthe following applies:

(a) The location of the pipe must beverified and pegged on site by the PipelineOperator's representative and witnessedby a representative of the employingauthority or contractor.

(b) On receipt of written approval of theproposed works, and subject to theapproval, if required, of the Secretary ofState and the landowner, the employingauthority or contractor shall give not lessthan 3 working days notice to the respectivePipeline Operator or his Agent of intentionto commence the works and access forthem will be afforded at all times.

(c) Work includes any structure, erection,plant or equipment being placed on orwithin the easement. The pipeline ownersconsent to the variation of property rights,necessary for the purpose, must beobtained and completed.

4 Any plant crossing the easement can behazardous to the pipeline especially if theground is soft or wet. The PipelineOperator or his Agent will require thecontractors to mark out the easement witha paling fence or similar if this isconsidered to be in the best interest of asafe operation. Where access over theeasement is required, a tied timber mat,“bog mat” or temporary concrete slab isnecessary to prevent a reduction in earthcover. This protection will be requiredunless authority in writing to the contrary isgiven by the Pipeline Operator or hisAgent. (See Appendix II).

5 Where road construction schemes orsimilar are to encroach over the pipeline,the employing authority or their contractorwill be required to place a protectiveconcrete pad over the pipeline unlesswritten permission to the contrary is givenby the Pipeline Operator or his Agent. The protective pad should be similar to the example in Appendix I.

6 All excavations above, below or within3m (10 feet) on either side of the pipelinemust always be supervised by arepresentative of the Pipeline Operator.Manual digging will be employed unlessanother method is specifically authorisedby the representative.

7 Where a new service passes under orover the existing pipeline, there should beideally a 600mm (24�) clearance betweenthem and cross at an angle of not less than60°. A lesser clearance or angle ofcrossing will not be permitted withoutauthority in writing from the PipelineOperator or his Agent. A concreteseparation slab, marker tiles or warningtape may be required. If the new service orworks includes a high pressure gas pipe orother pipe containing material whoseescape might endanger the pipeline(s),sleeving and/or construction in pre-testedpipe across the width of the easement maybe required.

8 If it is proposed to use explosives within400m (1300 ft) or drive piles within 30m(100 ft) of a pipeline then agreement mustbe reached with the Pipeline Operator orhis Agent.

9 Suitable fire extinguishers must beprovided if contractor's plant or equipmentis working near the exposed pipeline. Any

work involving a naked flame or likely tocause a spark within 3m (10 ft) of anexposed section of a pipeline will only bepermitted subject to approval of themethods by, and presence of, therepresentative of the Pipeline Operator.The Pipeline Operator reserves the right ofhis representative to check the availabilityof fire extinguishers on site to reduce therisk to the pipeline should the plant orequipment catch fire, and to prohibit anywork until they are reasonably satisfied.

10 Backfilling shall be in layers ofmaximum depth of 300mm (12�) andconsolidated before any further backfillingtakes place. Backfill must be free of flintsor any other material, which may damagethe anti-corrosion wrapping. If the backfillmaterial is not suitable in the opinion of therepresentative of the Pipeline Operator,imported sand, stone dust or otherapproved fine material shall be provided togive a minimum 150mm (6�) surround tothe pipeline.

11 The pipeline is wrapped to preventcorrosion and any damage to the pipe orits wrapping must be notified immediatelyto the Pipeline Operator or his Agent whowill arrange for repairs to be carried out.The Pipeline Operator reserves the right torecover the cost of repairs.

12 Cathodic protection of the pipelines isprovided by an impressed current systemand sacrificial anodes which couldadversely affect any ferrous structure orservice that crosses or runs parallel to thepipeline for any distance. It isrecommended that test leads be installedat the point of intersection of the two tofacilitate interference testing, according toBritish Standard BS 7361 Part 1 1991.

The fitting of the test lead to the pipelinewill be carried out by a representative ofthe Pipeline Operator and the two leadstaken to a Cathodic Protection Test Postsupplied by them and installed at thenearest convenient point. Any workrequired will be at the expense of thePromoter. The Pipeline Operator does notaccept responsibility for any damage to thenew service by virtue of electric corrosionprotection systems applied to thepipeline(s). It would be in the Promoter'sinterest for him to make provision forprecautionary measures during planningand construction stages of the new serviceor works.

13 Ideally no trees or shrubs should beplanted within the easement and beforeany shrub or tree planting is carried outwithin the easement area, written approvalmust be obtained from the PipelineOperator or his Agent. Any approvalgranted will be subject to the PipelineOperator retaining the right to remove, at any time in the future, all trees andshrubs which, in his opinion, might becomea danger to the pipeline and, inconsequence, a potential hazard topersonal safety, or prevent access formaintenance purposes.

Where permission is granted for plantingwithin the easement only species, such ashazel, oak, ash, sweet chestnut and manyothers which are tolerant to coppicing, willbe acceptable (i.e. they will sprout from thestump if it is necessary to cut them downto ground level in order to provide access).Many garden shrubs are acceptable, butconifers are not acceptable.

14 Where permission is granted for a newpipe, cable, etc., to cross a pipeline, thatpermission will only be granted subject tothe following condition:

“If at any time during the course of thenew construction it is discovered thatthe Pipeline Operator requires to carryout emergency works on their pipelinethen work on the new constructionmust cease until the pipeline repairwork has been completed. This repairwork will be carried out with theshortest possible delay. In thesecircumstances the Pipeline Operatorwill not be responsible for any delay orassociated costs on the newconstruction.”

15 Supervision of Works

The Pipeline Operators require strictcontrols to be applied on all third partyworks that could affect the pipeline, whichare administered by the Pipeline Operator orAgent. The minimum controls are:

• A minimum of three working days priornotice shall be given by the third party tothe Pipeline Operator or Agent beforecommencement of any works within 3m(10ft) ft of the pipeline.

• All works within the pipeline wayleaveshall be supervised by the PipelineOperator or Agent and shall notcommence without the written authority ofthe Pipeline Operator or Agent.

• There will be no charge for suchsupervision for the first three working days,(of 8 hours), but, thereafter, the costs willbe recovered by the pipeline operator fromthe third party. Current contract rates forsupervision charges will be provided by thePipeline Operator to the third party onrequest.

16 Trenchless techniques

Directional drilling, thrust boring or othertrenchless techniques will be consideredas an alternative method of crossingpipelines subject to the followingconditions being fully adhered to.

Method statement complete with drawingsfor the completion of pipeline crossingsusing trenchless methods shall beapproved by the pipeline operator.Approval shall be requested at leastthirteen weeks prior to commencement ofthe works. Approval by the pipelineoperator shall in no way reduce theresponsibilities and liabilities of the thirdparty for the safe and successfulcompletion of the crossing works.Clearance between the pipeline and thedrilling auger (or similar) should bemaximised. The minimum clearance shallbe 1.5 metres.

17 Special requirements specific toGPSS and Fina Line pipelines:

Any works within a GPSS wayleave(easement) are subject to the provisions of The Land Powers (Defence) Act 1958.

Section 16 of this act prohibits most workswithin the pipeline wayleave without theconsent of the Secretary of State, i.e.within 3m (10ft) either side of the pipeline.Any works within the Fina-Line DemisedStrip will require a legal wayleaveagreement to be completed with Totalbefore any works can commence.

• Planning of Works

When planning any works which couldinvolve crossing or working within thewayleave of an oil pipeline, the PipelineOperator or his Agent must be contactedwho will then

• locate and mark the pipeline and

• obtain a Section 16 Consent (GPSS)

• Instruct solicitors (Fina-Line).

This can be achieved by providing thePipeline Operator or his Agent with thefollowing: -

• A detailed description of the proposedworks including a method statement.

• Six copies of an OS 1:2500 scale planshowing the proposed works and with aneight figure OS Map Reference.

• A proposed time scale for the works.

It should be noted that a Section 16Consent can take up to four weeks toprocess from the date the requiredinformation is received by the PipelineOperator or his Agent. The Fina-Line LegalAgreement is dependant on both party’ssolicitors. Normally it takes between twoand four months.

In addition, works outside the wayleave butwhich may jeopardise the integrity of an oilpipeline, such as blasting or piling, must bediscussed with, and agreed by, thePipeline Operator.

Action to be taken by the Owners of thenew service or works in the event of a leakin the pipeline:

a) Dial 999 and call the Fire Brigade andPolice.

b) Contact the Pipeline Operations ControlRooms (24 hours)

c) Remove all personnel from immediatevicinity.

d) Remove all sources of ignition for atleast 200 metres upwind and 500 metresdownwind from the area of leak, e.g. stopengines, stop smoking, extinguish all nakedflames, and do not use any electricalapparatus.

e) Prevent approach of traffic and generalpublic.

f) Assist in safeguarding persons andproperty as necessary or as requested by the Police, Fire Service or PipelineOperator.

g) Do not attempt to seal any leak of gasor oil at source, but if oil is leaking frompipeline(s) construct [with regard to limitsapplied by c) or d) above] dams or bundswith earth or boards to prevent it flowinginto ditches, streams, drains, manholes orother such water courses or ducts.

19 Action to be taken if damage has notcaused leakage:

a) Contact the Pipeline Operator or hisAgent.

b) Do not backfill and await therepresentative of the Pipeline Operator toinspect the damage and decide on theaction required.
