1. PREAMBLE
1.1 Site and Surrounding Locality A site visit was carried out in January 2015. The subject site been 40 Gardyne Street is located at the north-east corner of Gardyne Street and Pacific Street, Bronte. The site is known as Lot A (approximate area 863m²) and Lot B (approximate area 311m²) in DP 419744. The subject site contains a northern frontage to Pacific Street measuring 34.39m, eastern boundary with 40 Pacific Street measuring 33.53m, southern boundary with 42 Gardyne Street measuring 34.57m and a western frontage to Gardyne Street measuring 35.53m, providing a combined site area (Lots A and B) of 1155.9m². The site contains a significant slope from the south-western corner to the sites north-eastern frontage to Pacific Street frontage of approximately 12.7 metres. All buildings on site have been demolished in preparation for the construction of the approved dwelling and associated buildings. Surrounding the site are a variety of residential developments including semi-detached, detached dwellings and residential flat buildings. The surrounding buildings contain a variety of architectural styles, designs and age, which provides a varied streetscape with no consistent design theme or rhythm. Located south-east of the site is the Gardyne Street pedestrian stairs and Albert Lane, both of which provide significant public domain views over the site towards Bronte beach and coastal headlands. Located north of the site across Pacific Street is 23 Gardyne Street which contains three storey residential flat building. Located east of the site across the side boundary is 40 Pacific Street which contains a two storey residential flat building. Located south of the site is 42 Gardyne Street which is a three storey dwelling, while located west of the site across Gardyne Street are a number of detached dwellings.

1.2 Details of Approved Development
DA-130/2011/A – Approved by the NSW Land and Environment Court on 5 April 2013. Modifications to allow for an amended third level to the dwelling. The court approved the modification application allowing for an amended third level to the dwelling. DA-130/2011 – Approved by the NSW Land and Environment Court on 5 April 2013. Demolition of existing dwelling and garage with flat over, construction of a part two and part three storey dwelling with a single garage, detached cabana over a single vehicle garage, swimming pool and associated works. The court issued deferred commencement consent in Schedule A numbers 2, 6, 7 and 9. The deferred commencement matters retained by the Court are detailed below: 2. The third level and associated shade structure are deleted. 6. The cabana is to maintain a 7.0 metre setback to Pacific Street and a 1.2 metre setback to the
eastern boundary. Further, the southern alignment of the cabana is not to extend past the southern alignment of the existing structure in this location.
7. The overall height of the cabana is to be lower by 500mm. 9. An amended BASIX Certificate. Satisfaction of deferred commencement matters was issued by the Divisional Manager of Development assessment on 28 November 2012.
1.3 Proposal The application has been lodged as a section 96(AA) application and provides for the following modifications to the approved development:
Dwelling Lower ground level (level 0)
Additional excavation providing for basement store room, cellar and linen;
Floor level of lower ground level reduced from RL29.80 to RL 29.77 (reduction of 30mm);
Increase width of rumpus room from 5750mm to 6430mm (increase of 680mm);
Decrease eastern side of building footprint by 780mm;
Reconfiguration of staircase, laundry and bedrooms 2, 3, 4 and 5;
Modifications to windows at all elevations of the lower ground floor; and
Delete services room from the southern side of the floor. Upper ground level (level 1)
Increase north western wing of upper ground floor comprising of bedroom 1, WIR and bathroom from 6350mm to 7150mm (increase of 800mm);
Reduce the length of the eastern wing of the building comprising of the kitchen and family rooms from 16970mm to 16890mm (reduction of 80mm measured from the garage);
Adjust angle of open plan kitchen and family room, and steel plate awning over;
Relocation of gas fire place;
Increase the height of the concrete awning over the dwelling entry from RL35.45 to RL35.49 (minor increase of 40mm);
Increase the width of the garage door from 3450mm to 3500mm (minor increase of 50mm); and
Modifications to the location and size of windows and skylights to all elevations and enlarge the front door.
First level (level 2)
Minor internal reconfiguration of internal stair including new slot window to the east elevation;
Modification to internal configuration of bathroom and associated windows to the west elevation; and
Modify balcony material from timber decking to concrete. Roof plan
Minor adjustment to external building line and steel plate awning roof over upper ground floor;
Modifications to location to size and location of upper ground floor skylights; and
Relocate solar hot water unit (HWU) panels over the open plan kitchen and living areas of the building.
Cabana Garage and basement level
Lower garage level by 50mm from RL 22.20 to RL 22.15;
Extend the width of the garage driveway;
Increase excavation to garage level comprising of plant, OSD tank room and store; and
New frosted glass window to the rear of the garage level. Cabana level
Reconfigure internal of cabana including raise cabana floor level by 80mm to RL24.83;
Delete narrow vertical windows to the east elevation;
Modifications to north facing window and new south facing window;
Modifications to materials and finishes of cabana;
Modifications to west facing sliding doors, windows and skylight to cabana;
Increase the width of the cabana from 4930mm to 4950mm (increase of 20mm)
Garden and external modifications Garden levels
Relocate the outdoor shower adjoining the northern side boundary fence parallel to the graded garden path;
Reconfigure of pool terrace to enable retention of existing significant tree;
Increase the level of the pool terrace area from RL 24.75 to RL 24.83 and increase the ground level of the pool terrace seating level to RL 25.35;
Provide BBQ to pool terrace;
Relocate existing boulder to pool area; and
Reconfigure garden stairs including deletion of garden stairs located in the southeast corner of the site;
Minor adjustment to the garden wall profile at the eastern corner of the retaining wall;
Modification to substantially reduce the height of the retaining wall between 40 and 42 Gardyne Street;
Gardyne and Pacific Street boundary fence material changed from planted bagged block work to planted face block work.
2. ASSESSMENT
The following matters are to be considered in the assessment of this modification application under sections 79C and 96 of the Environmental Planning and Assessment Act 1979 (the Act).
2.1 Section 96 Considerations Section 96 (AA) applications - Modification by consent authorities of consents granted by the Court - the development to which the consent as modified relates is substantially the same development as the development for which the consent was originally granted and before that consent as originally granted was modified (if at all), and each person who made a submission in respect of the relevant development application has been notified of the proposed modification by sending written notice and submissions considered as discussed further in the report.
2.2 Section 79C (1)(a) Planning Instruments and Development Control Plans The following is an assessment against relevant legislation, environmental planning instruments, including State environmental planning polices (SEPPs), and development control plans.
2.2.1 SEPP (Building Sustainability Index – BASIX) 2004 A BASIX Certificate has been submitted with this Section 96 application. The BASIX Certificate lists measures to satisfy BASIX requirements which have been incorporated into the proposal. A standard condition is recommended ensuring the measures detailed in the BASIX Certificate are implemented.
2.2.2 SEPP 55 Remediation of Land The site will continue to be used for residential purposes. Accordingly, site land contamination is considered unlikely and no further investigation is necessary.
2.2.3 Waverley Local Environmental Plan 2012 (Waverley LEP 2012) The relevant matters to be considered under the Waverley LEP 2012 for the proposal are outlined below:

The subject site is not identified as a heritage item and is not located in a Heritage Conservation Area. However the site is located in proximity to the Gardyne Street Landscape Conservation Area, the proposed modifications are acceptable with regards to the provisions of clause 5.10 and supported in this instance.
Part 6 Additional local provisions
6.2 Earthworks

The objective of clause 6.2 is to ensure that earthworks for which development consent is required will not have a detrimental impact on environmental functions and processes, neighbouring uses, cultural or heritage items or features of the surrounding land. The modifications provides for additional excavation to the lower ground floor level of the dwelling and garage level of the cabana. The additional excavation is considered acceptable with regards to clause 6.2 subclause (3) as the excavation is not expected to impact on the natural environment and all relevant conditions of consent are imposed to ensure that the excavation does impact on neighbouring allotments. The modification for additional excavation is supported and recommended for approval.

Dwelling The additional excavation to the lower ground level of the dwelling is located towards the southwest corner of the site, setback more than the required 900mm from the sites side boundaries. The additional excavation comprises of a store room, cellar and linen storage. The additional excavation does not result in an increase to the ground levels and the excavation is contained within the building footprint and does not increase the bulk and scale of the building. Further all standard conditions of consent regarding geotechnical engineer’s reports are already imposed on the original court consent. Accordingly, the additional excavation proposed to the dwelling is considered reasonable and supported on merit in this instance. Garage and Cabana The additional excavation proposed to the garage level of the cabana provides for additional plant, OSD tank room and storage (at the rear of the garage). The majority of new excavation will occur within the building footprint of the cabana however the additional excavation beyond the building footprint is to the west of the cabana which is located away from the neighbouring building at 40 Pacific Street. Accordingly, the additional excavation proposed to the dwelling is considered reasonable and supported on merit in this instance.

The modification to the north wing of the dwelling is supported with regards to setbacks.

1.7 Visual and acoustic privacy

Dwelling The proposed new and modification to the windows, skylights and openings (doors) to the dwelling are not considered to generate additional or unreasonable visual or acoustic privacy impacts on neighbouring residential allotments. The modifications to windows, skylights and openings (doors) provide for domestic scale windows which do not provide for unreasonable opportunities to overlook surrounding buildings or private open spaces. The proposed relocation of the solar hot water system from the north wing of the dwelling to south-east wing of the dwelling (over the kitchen and family room) will be in close proximity to the neighbouring building at 42 Gardyne Street. It is understood that relocating the solar hot water system is purely for aesthetic reasons and it is noted that a number of side facing windows to the dwelling at 42 Gardyne Street are orientated over the south side boundary of 40 Gardyne Street. The neighbour at 42 Gardyne objects to the relocation of the solar panels concerned with

potential light glare/reflection and impacts on the window outlook. This issue raised by the neighbour is considered to have merit therefore without any real justified reason from the applicant, it is considered inappropriate for the solar hot water unit to be moved to the proposed location. The system is to remain where it was originally approved (away from 42 Gardyne St). This is addressed via condition. Garage/Cabana and Pool Terrace The modifications to the garage and cabana windows and openings are orientated away from the neighbouring allotment to the east and no visual or acoustic privacy impacts are envisaged. The modifications to the pool terrace provide for a reduction to the overall size allowing for the retention of a significant tree and increase the ground level of the terrace. The reduction in the pool terrace size will have no impact on the visual or acoustic privacy of neighbouring allotments. The proposed increase to the floor level of the pool terrace are supported as the substantial setbacks from the east side boundary of the site are retained which will prevent overlooking and acoustic privacy impacts on the neighbouring building. The modifications to the garden stair behind the pool terrace and deletion of the garden stair located in the southeast corner of the site are not considered to impact on the visual or acoustic privacy of neighbouring allotments. The modifications to the garage/cabana, pool terrace and other garden access are acceptable with regarding to the objective and controls in clause 1.7 visual and acoustic privacy in Part C1 of the WDCP 2012.

The modifications to the garage level of the cabana provides for additional excavation for plant, OSD tank room and storage which does not constitute GFA under the provisions of the WLEP 2012. The modifications to the garage level of the cabana do not increase the floor area of overall height of the ancillary building as approved by the NSW LEC consent. The modifications to the ancillary building are supported with regards to clause 1.14 Ancillary buildings in Part C1 of the WDCP 2012.
2.3 Section 79C(1)(b) – Other Impacts of the Development
The proposed development is capable of complying with the BCA. It is considered that the proposal will have no significant detrimental effect relating to environmental, social or economic impacts on the locality, subject to appropriate conditions being imposed.
2.4 Section 79C(1)(c) – Suitability of the Site for the Development The site is considered to be suitable for the proposed development.
2.5 Section 79C(1)(d) – Any Submissions The modification application was notified in accordance with Waverley Development Control Plan 2012, Part A – Advertised and Notified Development and three (3) submissions were received. The issues raised in the submissions are summarised and discussed below. Issue: Impacts from fire place and flue.
Response: No objection is raised regarding the relocation of the fire place as per the modified plans, as the fire place and flue is setback from the boundaries of the site. In addition the standard condition titled Domestic Heaters is included as a new condition and prohibits the installation of solid fuel fire places. Issue: Objection to the relocation of the solar panel (over the kitchen/dining area) due to potential reflectivity and glare impacts. Response: This matter has been discussed within the report and the relocation of the solar panel is not supported. Issue: Clarification of reduction in height proposed to retaining wall between 40 and 42 Gardyne Street. Response: The modification reducing the height of the retaining wall between 40 and 42 Gardyne Street is supported as the height of the approved retaining wall is excessive and unnecessary. The reduction in the height of the retaining wall will not impact on the visual or acoustic privacy of 40 and 42 Gardyne Street. Issue: Impacts from raising pool terrace level by 80mm. Response: The proposed modifications to the pool terrace ground levels are not considered to impact on the visual or acoustic privacy of 40 Pacific Street, as the modification seeks to reduce the overall size of the pool terrace which is setback 6.2 – 8 metres from the east side boundary of the site. The increased elevation of the pool terrace is supported given the substantial setbacks from the east side boundary and reduction in the size of the pool terrace which on balance will remain to have acceptable visual and acoustic privacy impacts on neighbouring allotments. Issue: Solar access impacts from retaining wall changes south of cabana. Response: The modifications do not seek consent to change the height of retaining walls located south of the cabana and the minor increase to the floor level of the pool terrace will not result in solar access impacts on neighbouring allotments. Issue: Impacts from change in floor level to cabana may increase height of cabana. Response: The modifications to the floor level of the cabana does not result in an increase to the overall height of the cabana. Issue: Bulk and scale impacts from extending the rumpus room by 800mm east. Response: The minor extension of the north wing of the dwelling by 800mm is not considered to contribute additional bulk and scale to the dwelling, as the opposite end of the dwelling (to the south east) has been reduced. On balance the building envelope that level remains relatively the same. Issue: Proposal will impact on streetscape, view and vistas from the public domain. Response: The modifications do not seek significant changes to the building form, style character, bulk or scale that would have an substantially different impact on the streetscape, views or vistas from the public domain.
2.6 Section 79C(1)(e) – Public Interest It is considered that the proposal will have no detrimental effect on the public interest, subject to appropriate conditions being imposed.
3. REFERRALS All referral bodies support the proposed modifications and have not recommended additional conditions.
4. SUMMARY The Section 96 application proposes modifications to a dwelling and cabana which has been approved through Land Environment Court proceedings. The modifications include additional excavation, internal and external reconfigurations, adjustments to the fenestration and modifications to landscaped and recreational areas throughout the site. The modification complies with the FSR development standard and does not seek to changes the maximum building height approved under the court consent. The modifications comply with the relevant provisions in Part C1 of the WDCP 2012 as the proposal will not result additional bulk and scale, adverse shadowing or visual or acoustic privacy impacts on surrounding residential allotments. The modifications are supported (apart from the modification to the solar hot water system on the roof) subject to additional conditions of consent. Three public submissions were received which raised objections to proposal on the basis of privacy, bulk and scale, streetscape and others. The issues raised by the objectors have been considered but do not warrant amendment or refusal of the application. Some of the objections are addressed by conditions of consent. The modifications to not significantly alter the bulk, scale, or streetscape presentation of the building and is substantially the same development as the development for which the consent was originally granted. Accordingly, the application is supported and recommended for approval.

B. New Conditions
63. DOMESTIC HEATERS (ADDED DA-103/2011/B) The provision of solid fuel heating is prohibited. The fire place identified on the plans to be amended to indicate an alternative fuel source, prior to the issue of the Construction Certificate.
64. SOLAR HOT WATER SYSTEM TO ROOF OF DWELLING (ADDED DA-103/2011/B) No approval is granted for the relocation of the solar hot water system over the southern wing of the dwelling comprising of the open plan kitchen and family rooms. Accordingly, the solar hot water system is to be maintained in the approved location on the roof of the northern wing of the dwelling above the comprising of bedroom 1, bathroom 3 and walk in robe.
