S.O.735(E): '--- Whereas it appears to the Ccnt;:ai G~"/(?xnment that it is llecessa.ry so to do for securing equitable distribution and availability at fair price of two wheeln' vehicles, namely, scooters, motor-cycles and mopeds:
Now, therefore, in exercise of the pm.vu·s confened by section 18G of the Industries (Development and Regulation) Act, 1951 (65 of 1951), the Central Government hereby mal;:es l-he following Order, namely: -.
1. Sh(rd title, extent nl1d C(1)1/rli6JWE:ii( .'It. - (-l) This (J).'Q,--)
may be called the two VVheeJer Vehicles (Restrietiol] on nR~salc) Order, 1981.
(2) It extends to the whole of India,
(3) It 8hall come into force on the 6th day of Odobel', 1983.
2, Definitions, - In this Order, unless I he context otJ-lelwis(-' requires, -
(1) "two wheeler vehicle" means n motor v,chicle of any description specified in column (1) of the schedule, mam;_factured or <>_-ssembled in India, or manufactured. in Jndi:' or from components imported into India. or part13r imported and partly manufactured in India, and includes every such description of motor vehicles, whether called a. scooter. motor cycle, mini-motor cycle, moped or by any other name:
(2) "Controller" means a. person appointed as such by tile state Government or the Central Government as the (~ase may be for the purposes of this Order;
(3) "state Government", in relation to a Union Territory_ means the Administrator of the Union Territory:

(4) "Schedule" means the Schedulf armexed to this Order.
3. Restricti0n8 on Re-sale. -(1) On and from. the commencement of this o ['del', no
person shall, before the expil-y of two years f::'om the dnto when a two wheeler vehicle is first put'chased a., a n._~\/ two wheeler v.ehicle, whether purchased by him or by any person on his behalf and whether purcha.sed bf!fore or aftel' the commencement of this Order, sell or off'~r to sell 0)' enter into any transaction involving the transfer of posse·· ssion- of the two wheeler vehkJe to any other person excqJc under and in accordance with i_he tcnns and conditions of t" permit, in writmg, from the Controller who S iall, when' " permit is not granted, communi:c.ate to the per8<m concerned, the reasons for such refusal.
(2) In granting or refusing a penuit under sub-clmuJC (1), the Controller shall have regard to the (Ircumstances relating to the proposed sale or transaction, as the case may be, and to the purpose of this Order.
(3) Any person aggrieved by the refusal of tlle Controllm' to grant a pennit under sub-·clause (1) may, wifujn thirty days from the date on which such r.efusal is commW1icated to him, prefer an appeal to the State Government:
Provided that the State Goverrunent may entertain the appeal after the expiry of the said period of thirty days if it IS satisfied that the appellant had sufficient '::aus€' for 110L preferring the appeal within the period aforesaid.
4. Power to obtain ilnjcrrmat'ion. -- If the C)ntroller has reason to believe that a new two wheeler vehicle has been sold or its possession has been transferred befo::-e the expiry of the period of two years referred to in sub-elause (1) of clause 3, he may require the person, who has so sold or transferred its possession, to furniHp. the particular;s relating to such sale of transaction involving such transfer or possession as the Controller may deem fit, including the name of the person to whom the vehiclc; 'N(1S so sold or its p!)sseSS'o"l transferred.

In virtue of the powers vested in me under !Section 17 A (1) of the Maharashtra COOp. Societies Act. I96\) "H applied to the Union Territory of Goa, Daman and Diu, read with Rule 14 A of tlle COOp. SocietIes Rules 1962. Shri Rawalnatll V. K. S. S. Society Ltd., Adpoi and Janata V. K. S. 8. Society Ltd., Wad),·. -Talaulim were issued a draft amalgamation c,rder under the letter dated 1-7-1981 and eirenmstances leading to the ama1·· gamation have been explained and hence in ter:ns of aforesaid section I h~reby direct the ama.lgama.tion of tJj.e said societie.<:: on the following lines.
1) The existing bye-law~) of Shri RawoJnatll. V. K. S. S. So·· ciety Ltd., Adpoi shall be the bye-laws of thi~ amalgamate!"I, unit with the following modifications.
a) The first sentence of the Bye-law No. :l shaH be subs· tituted as the name of the society is Shli Ra:wa.1na.th Janat:l, Group V. K. S. S. Whereas it appears that the provisions of "Devasthan Regulations" (Regulamento das Mazanias) as approv.ed hy Diploma Legislative No. 645 dated 30-3-1933 as arnend8:d t>y Diploma Legislative No. 1898 dated 2!j-5.:L959, are Dot adequilte to meet the present context of changed circ~1...<)tanc(!S.
And Wherea.s it has been decided by the Government to constitute a Committee to go lIJ.to the various aspects of the existing legislation and propose suitable appropriate amendments wherever necessary, to the said LegislH-tive Diplom8!': dated 30-3-1933 and 29-5-1959.
