Turn to page 13 for her remarkable story. ‘Heart of her community’ RAMKISSON’S MURDER CHARGE: Ruling overturned ‘He cannot be convicted on suspicion alone’ — judge MERVYN KRISHNA T HE Supreme Court of Appeal (SCA) overturned the murder conviction of KwaDukuza resident Nishen Ramkisson, who is serving a 15-year- prison sentence for his role in the murder if his uncle Jairam Ramkisson in June 2006, on Tuesday. The SCA has set aside Nishen’s convic- tion for murder as the judge said he may have been embroiled in the rivalry be- tween the two families. “While there may be suspicion that he was in cahoots with his parents, he cannot be convicted on suspicion alone,” said the judge. Nishen was arrested with his parents Dewnath and Nirmalah Ramkisson, for the murder of Dewnath’s brother and rival businessman Jairam Ramkisson and the attempted murder of his wife Shashika Ramkisson. Jairam was shot and killed outside his takeaway in Hulett Street. Shashika, who survived, was shot in the neck. Evidence in the trial indicated that the two brothers hated each other and a key state witness, who pleaded guilty to com- mitting the crime andwho was sentenced to life imprisonment, claimed to have been hired by the Ramkissons. Minister takes actionTaxi violence: transportdepartment findsresolution

THE Maphumulo Taxi Associa-tion does not have authority tooperate on the Darnall to

Stanger route, transport MECWilliesMchunu said on Thursday at theKwaDukuza council chambers.

Speaking at the emergency meet-ing with KwaDukuza Municipalitycouncillors, Mchunu said the depart-menthadreachedthefinaldecisiononthematter and hoped that this wouldresult in an end to the taxi violence inthe area.

“After lookingatalldocumentationand following thorough process, wehave concluded that Maphumulo andits members have to stop operatingthe contested route of Darnall,” Mc-hunu said in a statement.

This decision was reached afterthoroughconsultationswithallaffect-ed parties including the legal repre-sentativesofmembersofMaphumulothat illegally operated the contestedroute.

His department had further planstorestorenormality in taxioperationsin the area.

Mchunu met the Maphumulo andKwaDukuza Taxi associations wherehe informed themof his final decisionover the contested route.

The Maphumulo Association wasnotpleasedwiththedecision,Mchunu

said.He advised them to approach the

court to pursue the matter in a legalmanner.

The Stanger Taxi Association ontheotherhandwasjubilantafterhear-ing the decision announced byMchunu.

There had been several shootingincidentsattheKwaDukuzataxirank,allegedly involving security compa-

nies contracted to the two associa-tions.

In one incident, a passenger wasinjured.

“I have engaged the police to pro-videmaximumsecuritytoensurepub-lic safety, mainly at the taxi rank andin Darnall,” he said.

Judge JanCombrink convicted allthree, sentencing Dewnath to lifeimprisonment,hiswifeto18yearsandhis son to15years inSeptem-ber, 2009.

The three appealed to the pro-vincial division sitting in Pieter-maritzburg, but were turneddown. Nishen then petitioned theSCA which granted him specialleave to appeal.

In the judgment,penned by actingJudge ConstanceMocumie (with fourjudges concurring),she said the mainevidence in the trialhad come from Wil-liamSitholewho tes-tified as an accom-plice witness.

He told how hehadbeenbrought in-to contact with thefamily through co-accused JabulaniMkhizewhohadbeenrecruitedbyDewnath to kill his brother.

Mkhize had taken him to thefamily business, a fish shop adja-cent to the deceased’s business.

Sithole wanted R35 000 tocarry out the killing, but Dewnathoffered only R15 000.

At some point, Dewnathbrought his wife (Nirmalah) andson into the roomtohelpmediate.

According to Sithole, Nishenasked himwhy hewas asking forsuch a high amount.

“[Nishen said] the personwhowe are asking you to kill is abso-lutely worthless,” said Sithole.

Sithole said Nishen thereaftersaid he would have “killed himhimself if he wasn’t involved withthe police”.

He then left the room.Negotiations failed that day

and Sithole left without agree-ment being reached.

The judge said there was noevidence regarding further dis-cussions or negotiations or that

Dewnath was privy to anythingfurther.

A few days later, Sithole shotJairamashewas lockingupshop.

The judge said themain attackonconvictionwas that it hadbeenbased on common purpose whenthere was insufficient evidence,as the words he had utteredproved he had actively associatedhimself with his parents’ plan.

She agreed that apart from theevidence that hewalked in from thefront to the back ofthe shop and utteredthe “vengefulwords”, thestatehadnot proved any formof active participa-tion and “mere ap-proval” of the plandid not suffice.

“As morally rep-rehensible as it isthat he wished hisuncle dead or eventhoughtofkillinghimhimself,whathesaid

doesnotamount toactiveassocia-tion.

“His participation was re-moved from the active executionof the plan and, it can at best, beregarded as evidence that he hadsome knowledge of it,” saidMocumie.

Nishen’s attorney Anand Nep-aul who handled the appeal, saidthisjudgmentwasasanimportantreminder of the legal require-ments for common purpose con-victions.

One of the appeal judges point-ed out that thiswas introduced ata time of political violence whenidentification of individual perpe-trators was difficult in mob at-tacks.

“It isnotappropriate touse it inthese sorts of cases where thestate, on the evidence, cannotprove co-perpetration or conspir-acy,” he said.

Nishen told theWeekly hewashappy the SCA overturned hisconviction.

Murder charge overturnedPolice’sswiftworkresults inarrestsMERVYN KRISHNA

THE KwaDukuza Crime Intelligence, Tacti-cal Response team and the Umhlali taskteam embarked on an operation looking forwanted suspects after avictimwashijackedof his vehicle recently.

At about 9.50pm on 19 April the victimwas at a friend’s place at Shombela town-ship,KwaDukuzaoff-loadinggoodswhenhewas approached by three armed men.

It isallegedthatthemenoverpoweredthevictim and took his 9mm pistol.

The suspects shot towards the victim buthe was not injured.

They fled in his Toyota Hilux bakkie.Four days later, the members arrested

three suspects and recovered two unli-censed firearms in their possession.

One of the recovered firearms was takenduring the hijacking.

Acaseofhijackingandattemptedmurderwas opened at the KwaDukuza policestation.

All suspects - aged between 16 and 26yearsold-appearedintheKwaDukuzaMag-istrate’s Court on lastweek facinghijacking,attempted murder and possession of unli-censed firearm and ammunition.

Thecasewas remandeduntil 29April forfurther investigation.

KwaZulu-Natal Provincial Commission-er,LieutenantGeneralMmamonnyeNgobe-ni commended the speedily arrest of the hi-jackers by the members. “This shows thatour officers are dedicated in their duty tomake sure thatwanted criminals are appre-hended and brought before the law,” shesaid.

To be eligible for participation in the 2013/14 KwaDukuzaMayoral Awards, the following requirements must be

ness, or pass away. We see alltheEtetecommunity’s troubles- and joys,” says SummerhillHouse’s Esther Lynn.

Lynn,affectionatelyknownbymost as “Gogo”, is a much-loved Etete resident and anintegral member of theSummerhill House non-profit organisation team.

Many lives have beenmade brighter by herkindnessandgenerosi-ty, on her own accountand through the NPO.Shecooksforandfeedsthe people. She teach-essometosewandselltheir work. Shehelps them getbirth certificatesand ID documentsso they can work orobtain grants. Shealso takes time topraywith thosewhoare inconsolable.Lynn has brought

up 11 children in herhome - eight foster chil-

dren - and still helps care for

numerous others.“I have always loved children, and so

many of them in the community do nothave enough to eat and are sick and needhelp. Someof themhavebeenabandonedby their parents, or the parents are awayworkingmostof the time. Idon’thavea lotmyself, but I cannot turn them away.”

Lynn is able to feed 50 children once aweek with the help of Roberts and Chap-lin’s audit departmentwhich supplySum-merhill with sandwiches every Tuesday.

Lynnalsocooksduringschoolholidayswhen the childrenget ahotmeal eachdayto make up for the meal they would nor-mally recieve at school.

Funds, raised by Summerhill, also gotowards getting documentation for peo-ple, school fees, taking Bibles to the com-munity, building the Summerhill facilityand more.

Lynn was born and grew up on theTweedie family’s sugar farm inlandon theNorth Coast, and worked for the them formany years. She eventually moved whenmost of the family had moved away ordied, and it no longer felt like home. Shethen got a job through her church with afamily that needed help to look after theirtwins, and she then moved with them toPretoria for a time.

“I will never forget, it wasmy first tripin an aeroplane and I was so excited andnervous, but had to be calm to look afterthe children,” she reminisced.

Shedidnotstay long inPretoria, saying

thereweretoomanypeopleandit“wasnother type of place”.

Shewas unemployed for threemonthsbefore getting a job, again through herchurch, with Summerhill founder PaulaOwen about 12 years ago.

Lynn has not had an easy life, havingnever been to school, losing her husbandin1990andthenhavingherhomeandfur-niture in Stanger repossessed as shecouldn’t pay the instalments without herhusband and she found herself homelesswith 11 children to take care of.

Lynn was desperate and even consid-ered prostitution as a solution to help paykeep her home. She decided though thatahouse,evenoneshebuiltwithherhands,wasnotworthherdignity. Luckily ChurchAlive helped her find a temporary placeto live in.

Lynneventually foundahouse inEtete,whichtheOwenfamilyhelpedherbuyandwhich is now the heart of many Summer-hill gatherings.

Tearfully she says she doesn’t knowwhereshewouldbeifitwasnotforherem-ployer and close friend, Paula. “Paula hasa wonderful, kind heart. She has done somuch for me and the community. She isvery special to all of us. Thanks to her myhouse will be ours forever.”

The Summerhill concept began 10years ago, andwas officially registered asan NPO in 2007.

Gilbert co-directed the production of“Thuurkaari” and participated as “MadamHalwa” for Stanger Manor Secondary.

She also directed many other produc-tions including Ronnie Govenders “At theEdge”andAtholFugards “PeopleareLivingThere” for Manor Secondary and DarnallSecondary.

She played the “Green Goddess” in theShoestring Company’s production of “Man-go Leaf Magic” directed by Themi Venturas(popularlyassociatedwiththeCatalinaThe-atre in Durban).

Gilbert has also participated in severalprofessionalplaysanddancedramasduringher threeyearsofstudyingdramaatUniver-

sity of Natal.She recorded two documentary voice-

overs for TV at UKZN Audio-Visual Centre -one of which was on Prison Rehabilitationanda copy of itwas requestedby and sent tothe then president Nelson Mandela.

She assisted Dr Eubulus Timothy duringthe shoot of an East Net Christmas Specialin Durban and appeared in this TV show aswell.

MERVYN KRISHNASEVEN karate fighters took part in one of Japan’smost prestigious karate events, the Kyokushin Iko2014 International friendship tournament, last week.

They arrived home at King Shaka InternationalAirport to much ceremony last Thursday.

They were the only team from Africa selected bythe International Karate Organisation (IKO) to com­pete abroad.

KwaDukuza deputy mayor Dolly Govender, hascommended KwaDukuza fighters for waving the na­

tional flag with pride abroad saying this is a cause forcelebration. She welcomed the fighters back homeat the airport following their two day clash in Tokyo.

“Given or taken, the blows are experience,” Goven­der told the team, just briefly after their final touch­down.

“Being selected to compete with the best of thebest is a quantum leap forward for the nation andthis is a cause for national pride and celebration. Weare proud and convinced that this tournament will re­sult to positive spin­offs back at home,” she said.

The fighters set out on a journey last week. Thetournament is held only every 10 years. The road tosuccess is never easy, Govender explained “nothingis done overnight, sports like Karate is masteredthrough trial and error”.
