Corres. 684/61.WHEREAS by section 33 of the Land Act, 1933-1963,it is made lawful for the Governor to direct thatany reserve shall vest in and be held by any muni-cipality, body corporate, or other person or personsto be named in the order, in trust for any of thepurposes set forth in section 29 of the said Act, orfor the like or other public purposes to be specifiedin such order and with power of subleasing; andwhereas it is deemed expedient that Reserve No.27176 (Wongan Hills Lot 109) should vest in andbe held by the Shire of Wongan-Ballidu in trustfor the purpose of Aged People's Homesites: Now,therefore, His Excellency the Governor, by andwith the advice and consent of the ExecutiveCouncil, doth hereby direct that the before-mentioned reserve shall vest in and be held bythe Shire of Wongan-Ballidu in trust for AgedPeople's Homesites with power to the said Shireof Wongan-Ballidu, subject to the approval inwriting of the Minister for Lands being firstobtained, to lease the whole or any portion ofthe said reserve for any term not exceeding twenty-one (21) years from the date of the lease.

WHEREAS it is enacted, inter alia, by subsection(1) of section 433A of the Local Government Act,1960, that the Governor may make and publish inthe Gazette uniform general by-laws for all orany portion of the purposes for which by-laws maybe made by a council under Part XV of the Actand may, by order, declare that all or any suchuniformgeneral by-laws as are specified in theorder shall apply to the whole or any portion of

a district so specified; and whereas, by Orders inCouncil published in the Government Gazette onthe 23rd June, 1961, on the 13th June, 1962, onthe 4th October, 1962, on the 3rd July, 1963, andon the 30th December, 1963, the Governor didthereby make certain uniform general by-laws; andwhereas it is desired that the said by-laws shouldapply to the portion of the district set out here-under: Now, therefore, His Excellency the Gov-ernor, acting with the advice and consent of theExecutive Council, and in the exercise of the powerconferred by the Local Government Act, 1960, dothhereby declare that the whole of uniform generalby-laws made pursuant to the provisions of para-graph (a) of subsection (1) of section 433A ofthe Local Government Act, 1960, and published inthe Government Gazette on the 23rd day of June,1961, on the 13th day of June, 1962, on the 4thday of October, 1962, on the 3rd July, 1963, and onthe 30th December, 1963, shall apply to the wholeof the district with the exception of the pastoralleases of Yardie Creek and Exmouth Gulf Stationswithin the district of the Shire of Exmouth.

ORDER IN COUNCIL.L.G. 191/64.

WHEREAS the Council of the Shire of Kwinanais desirous, under the bylaw-making power con-ferred by section 193 of the Local Government Act,1960, of making by-laws for regulating public bath-ing and the costumes of bathers and the conductof bathers and others in the sea adjoining thoughoutside its district for a distance of two hundred(200) yards from low water mark at ordinaryspring tides; and whereas it is enacted by sub-paragraph (iv) of paragraph (a) of that section,that such by-laws may be made only pursuant toan order made under subsection (8) of section 190of the Act; and whereas it is enacted by the sub-section lastmentioned that, where in the opinionof the Governor a bylaw-making power conferredby the Act on a Council should be extended to anarea which is outside the district, the Governormay, by order, declare that for the purpose of theexercise of the power the area is to be regardedas being within the district and that the Councilmay exercise the power in respect of the area asif in fact it were within the district; and whereasthe Governor is of the opinion that the said bylaw-making power should be extended to the said areaoutside the district of the said Council: Now,therefore, His Excellency the Governor, pursuantto the powers conferred by subsection (8) of section190 of the Local Government Act, 1960, and actingby and with the advice and consent of the Execu-tive Council, doth hereby declare that, for thepurpose of the exercise of the said bylaw-makingpower, an area which is outside the district of theShire of Kwinana, namely the area which adjoinsthat district and extends for a distance of twohundred (200) yards seaward from low water markat ordinary spring tides is to be regarded as beingwithin the district of the Shire of Kwinana, andthat the Council of the Shire of Kwinana maymake by-laws for regulating public bathing andthe costumes of bathers and the conduct of bathersand others in respect of that area as if in fact itwere within the municipal district of the Shire ofKwinana.

Shire of Morawa.ORDER IN COUNCIL.

L.G. 2208/52.WHEREAS it is enacted by subsection (1) (b) ofsection 373 of the Local Government Act, 1960, thatthe Governor may, by order, apply all or any ofthe provisions of Part XV of the said Act to anydistrict or to portion of a district; and whereasby subsection (2) of the said section at the requestof a Council the Governor may, by order, fromtime to time suspend the operation of all or anyof the provisions of the said Part XV in its dis-trict or any portion thereof; and whereas, by anOrder in Council published in the GovernmentGazette of the 16th June, 1961, the Governor sus-pended the operation of Part XV of the Act to thewhole of the municipal district of the Shire ofMorawa with the exception of the Morawa Town-site; and whereas the Morawa Shire Council hasrequested that the provisions of Part XV shallapply to the towns of Morawa, Koolanooka, Pin-tharuka, Gutha and Canna: Now, therefore, HisExcellency the Governor, acting by and with theadvice and consent of the Executive Council andin exercise of the power conferred by subsection(1) (b) of the Local Government Act, 1960, dothhereby order that all of the provisions of PartXV of the Act shall apply to the towns of Morawa,Koolanooka, Pintharuka, Gutha and Canna withinthe municipal district of the Shire of Morawa, anddoth further order that the suspension of Part XVcontained in the reference to the Shire of Morawain the schedule to the Order in Council publishedin the Government Gazette of the 16th June, 1961,be revoked.
