WHEREAS by section 4 of the Firearms and Guns Act, 1531-1553, it is provided, inter aliaS, that sub- ject as therein mentioned, section 5 of that Act shall not apply, so far as regards firesrms other than pistols, in any portion of the State not par- ticularly specified in paragraph (3) of section 4 unless the Governor by Proclamation from time to time declares it to apply to any portion or por- tions not so specified; and whereas under and by virtue of a Proclamation published in the Govern- ment Gazette on the 20th November, 1053, section 5 of the Act was declared so to apply, inter aba, in all that area comprised svithin the boundaries of the Eucla Division of the State more particu- larly described in section 28 of the Land Act, 1933- 1950: Now, therefore, I, the Lieutenant-Governor, acting with the advice and consent of the Execu- tive Council, do hereby declare that, subject to the provisions of section 4 of the Firearms and Guns Act, 1931-1053, section 5 of that Act continues to apply in the Eucla Division of this State as described in the Proclamation published in the Government Gazette on the 20th November, 1953, except in that portion of the Division which to East of the 123rd meridian of East longitude. WHEREAS it is enacted, inter alia, by section 15 of the Wheat Products (Prices Fixation) Act, 1030-1939, that the Governor may from time to time, on the recommendation of the Wheat Products Prices Committee, constituted pursuant to the Act, by Proclamation fix the minimum and the maxi- nouns price at which substances included in the definition of wheat products may be sold in the State, or in any specified part of the State, by the manufacturer thereof or by any person, and that the Governor may from time to time revoke or vary any Proclamation under the section by a subsequent proclamation; said whereas the Gov- ernor by Proclamation dated the 0th day of August, 1056 and published in the Goveruncsexof Garmtte on the 10th day of August, 1958, fixed the prices at which bread, being a wheat product within thy meaning of the Act, may be ovid by any person in the various parts of the State specified In that Proclamation; and whereas it is now considered necessary and expedient to vary that Proclamation: Now, therefore, I, the Lieutenant-Governor and Administrator, acting with the advice and consent of the Executive Council and on the recommenda- tion of the Wheat Products Prices Committee, and in exercise of the posver in this behalf conferred upon one by the Act dcx hereby vary the Proclama- tion dated the 8th day of August, 1556, made pur- suant to that Act and published in the Government Gazette on the 10th day of August, 1956, by (1) substituting for paragraphs (a) and (b) of the First Schedule the following paragraphs- No. 74] PERTH: FRIDAY, 7th SEPTEMBER. Town Planning and Development Act, 1929-1955.ORDER IN COUNCIL.

T.P.B., R.P. 293/1/56.HIS Excellency the Lieutenant-Governor and Administrator, acting with theadvice and consent of the Executive Council, has been pleased to approve of theMetropolitan Region (Perth and Fremantle) Interim Development Order No. 1,made by the Minister for Town Planning pursuant to the provisions of section IAof the Town Planning and Development Act, 1926-195's, and set out in theSchedule hereunder.

SCHEDULE.

METROPOLITAN REGION (PERTH AND FREMANTLE) INTERIMDEVELOPMENT ORDER No. 1.

1.Interpretation.In this order, unless the context otherwise requires

"dwelling" means a building or part of a building which provides, oris designed for use as, self-contained living accommodation for asingle family;

"drive-in theatre" means a theatre which is specially designed toaccommodate in the open air a large proportion of the spectatorsor audience in motor vehicles;

"fiat building" means a building or part of a building containing twoor more separate flats or dwelling units each of which provides,or is intended, adapted or designed for use as, self-contained livingaccommodation for a single family;

"industry" means the carrying out of any process for or incidentaltothe making, altering, repairing, or ornamentation, paint-ing, finishing, cleaning, packing or canning, or adaptingfor sale, or breaking up or demolition of any article orpart of any article, andthe winning, processing and treatment of minerals, andthe generation of electricity or the production of gas, andthe manufacture of edible goods for human or animalconsumption

being a process carried on in the course of trade or business forgain, other than operations connected with-

the carrying out of agriculture;site works on buildings, works or land; andin the case of the manufacture of goods referred to insubparagraph (d) above, the preparation on the premisesof a shop of food for sale,

and includes, when carried out on land upon which the processis carried out, and in connection 'with that process, the storage ofgoods, any work of administration or accounting, the sale of goodsresulting from the process and the use of land for the amenity ofpersons engaged in the process;

"Interim Development Map" means the set of maps referred to inparagraph 4 of this order;

"lot" means a portion of land depicted on a plan or diagram publiclyexhibited in the public office of the Department of Lands andSurveys, or deposited in the Office of Titles or Registry of Deeds,either before or after the coming into operation of this order, andfor which a separate Crown grant or Certificate of Title can beissued; and includes any portion of land depicted as a lot on asubdivisional plan or diagram approved, either before or after thecoming into operation of this order, by the Town Planning Boardor the Surveyor General, but not so exhibited or deposited;

"motel" means a building, group of buildings or place designed toaccommodate visitors on the same basis as a hotel or boardinghouse but in which special provision is made for the accommodationof visitors with motor vehicles;

"permitted development" means any class of development referred to inparagraph 9 of this order and which does not require approvalunder this order but is subject to local authority town planningschemes, by-laws and other provisions of law;

"Special Industry" means any trade listed in the Second Schedule tothe Health Act, 1911 (as amended) ; and includes any other tradedeclared by proclamation to be offensive in accordance with theprovisions of section 186 of that Act;

"the Act" means the Town Planning and Development Act, 1926-1955;"wholesale warehousing" or "retail warehousing" means any building

or enclosed land or part of a building or of an enclosed piece ofland used for the storage of goods and the carrying out of com-mercial transactions involving the sale of such goods by wholesaleor by retail respectively.

2.Application.This order applies to that part of the metropolitan region, within the

meaning of the Act, which Is bounded by the Indian Ocean and the heavy blackbroken line depicted on the Interim Development Map referred to in this order.

3.Administering Authority.The authority responsible for administering this order is the Town Planning

Board subject however to those provisions of this order delegating certainpowers of the Board to a local authority.

4.Interim Development Map.This order shall be read in conjunction with the set of eleven maps

numbered one to eleven comprised in ten sheets which shall be known jointlyas the Interim Development Map and which are more fully described in thisparagraph.

Each sheet is stamped with the words 'Metropolitan Region (Perth andFremantle) Interim Development Order No. 1" and countersigned by theChairman of the Town Planning Board.

A copy of the Interim Development Map is available for inspection bythe public free of charge together with copies of this order at the followingplaces

Town Planning Board Office, 31 Malcolm Street, Perth. The office ofeach local authority included within the scope of this order andas listed in Appendix V. of this order during the normal hours ofbusiness.

The Interim Development Map indicates by the different notationsshown on each sheet the various proposals in the proposed town planning schemefor the Metropolitan Region as follows

notations as amplified In this order.

5.Approval under this Order Required for Certain Development.The carrying out of any development (other than permitted development

as set out in paragraph 9 of this order) on land within the scope of this orderis prohibited unless approval is first obtained in accordance with the provisionsof paragraph 6 of this order in addition to any other permission or approvalwhich may otherwise be required by law.

6.Application For, and Grant of, Approval.No person shall carry out development (other than permitted develop-

ment as set out in paragraph 9 of this order) on land within the scope of thisorder until he has applied for approval from the local authority In whose areathe proposed development is to be situated and has received from the localauthority the written approval or conditional approval of the Town PlanningBoard or the local authority in accordance with the provisions of the Act andthis order.

Application shall be made by or on behalf of the owner of the land induplicate in Form 3 prescribed In Appendix I. to this order and shall beaccompanied by three copies of a plan or plans drawn to scale illustrating theproposed development and its location and indicating the type and constructionof any buildings or works proposed.

Where any application is required by the provisions of paragraph 1 ofthis order to be referred for decision to the Town Planning Board the localauthority shall forthwith forward one copy of the application and two copiesof the plan or plans to the Town Planning Board for consideration, but whereapproval for the development could not in any case be granted by reason of anystatutory or other provisions (not being the provisions of this order) such astown planning schemes, by-laws, or other enactments, the application shall notbe forwarded to the Town Planning Board but shall be returned to the applicantby the local authority and the reason for return stated.

(ci) In the case of applications forwarded to the Town Planning Board forconsideration the Board shall return to the local authority in duplicate its

pproval, conditional approval, or refusal as the case may be in Form 4 asprescribed in Appendix II. to this order together with one copy of the plan orplans and the local authority shall issue one copy of Form 4 and the plan or plansto the apr licant as the decision of the Town Plannning Board.

(e) Where under the provisions of paragraph 7 of this order the localauthority Is not required to forward the application to the Town Planning Boardfor decision the application shall be dealt with by the local authority in accord-ance with the terms of this order and the approval, conditional approval, orrefusal of the local authority shall be issued to the applicant In Form 4 togetherwith one copy of the plan or plans.

7.General Provisions.(a) No building permit under its building by-laws shall be granted or

approved, by a local authority, which involves the erection, within the area towhich this order applies, of more than one dwelling or one fiat building andthe outbuildings appropriate thereto on a single lot, unless the written approvalof the Town Planning Board is first obtained.

(b) Every application for development of the following classes shall bereferred by the local authority to the Town Planning Board for decision

Race Courses, Trotting Tracks, Drive-in Theatres and Motels (withinthe area to which this order applies).

Industry or Special Industry (within the areas covered by notation 6).(c) The decisions of the Town Planning Board or any local authority made

under the provisions of subparagraph (e) of paragraph 6 or of paragraph 7 ofthis order or of the Minister on an appeal from any of those decisions of theBoard or the local authority over-ride and prevail over any provisions of a townplanning scheme or town planning by-law in force on or after the coming intooperation of this order and which is inconsistent with those decisions.

(d) Every application for development within an area oovered by eithernotation 1 or notation 2 or by both notations 1 and 2 on the interim Develop-ment Map shall be referred by the local authority to the Town Planning Boardfor decision, except in cases where it is provided in paragraph 6(c) of this orderthat approval for the development could not in any case be granted.

(e) Every application for development within an area covered by notation3 in the Interim Development Map (other than development referred to insubparagraph (b) of this paragraph) shall be dealt with by the local authorityand not referred to the Town Planning Board for decision, but no developmentshall be approved by the local authority for purposes other than those of anindustry (not being a Special Industry) and of wholesale warehousing or retailwarehousing, excepting the erection of a dwelling and the outbuildings appro-priate thereto on any lot which had been depicted on a plan or diagrampublicly exhibited in the public office of the Department of Lands and Surveysor deposited in the Office of Titles or Registry of Deeds, or approved as a lotprior to the coming into operation of this order, but not more than one suchdwelling shall be erected on each such lot and then only if its erection ispermissible under a town planning scheme or town planning by-laws in forcein that area.

(f) Every application for development within an area covered by notation4 on the Interim Development Map (other than development referred to insubparagraph (b) of this paragraph) shall be dealt with by the local authorityand not referred to the Town Planning Board for decision, but no such develop-ment shall be approved, unless it is for the purposes of a Special Industry,excepting the erection of a dwelling and the outbuildings appropriate theretowhere the local authority is satisfied that the dwelling is essential for theaccommodation of staff required in connection with the proper care andsupervision of that industry.

(g) No approval under this order is required for the carrying out ofdevelopment within an area covered by notations 5 and 6, excepting develop-ment referred to in subparagraph (b) of this paragraph, but the provisions ofthis subparagraph do not exempt a person from the requirement, if any, toobtain permission or approval for development under any other provision oflaw.

8.Development by Public or Local Authority.Any public luthority or local authority intending to carry out develop-

ment (other than permitted development) within the area covered by this orderis required to tonsult the Town Planning Board in writing and to supply suchinformation as may be necessary to explain the proposal.

The development shall not be commenced until the Town PlanningBoard, after consultation where necessary with the local authority in whosearea the development is proposed, advise the authority either that the develop-ment is in conformity with the proposed town planning scheme for theMetropolitan Region or can be co-ordinated with it; but before so advising theBoard may require modification to the development.

In the event of the modification not being acceptable to the authority,the development shall not be commenced but the matter shall be referred tothe Minister by the Town Planning Board for determination by the Governoras provided by subsection (9) of section 7A of the Act.

9.Permitted Development.The following classes of development do not require approval under this

order and are subject only to local authority town planning schemes, by-lawsand other provisions of law:-

(i) Development by public authorities and local authorities for thepurpose of their undertaking or functions on land owned by them atthe time of coming Into operation of this order, other than landwithin the area covered by notation 2 on the Interim DevelopmentMap.

Construction, reconstruction, repair and maintenance of roads,railways, pipe lines, service mains, sewerage and drainage lines bypublic and local authorities on any public road way or reserve oron any reserve or easement established for the purpose.Within the areas covered by notations 5 and 6 on the InterimDevelopment Map all classes of development other than the classesreferred to in subparagraph (b) of paragraph 7 of this order.Within the areas covered by notations 1, 2, 3 and 4 on the InterimDevelopment Map extensions of or alterations, renovations ormaintenance to existing buildings within the curtilage of the landon which such buildings stand provided that the floor space of anysuch building or group of buildings is not increased thereby by morethan 50 per cent.

10.Existing Use.No provision in this Order shall prevent the continued use of any land or

building for the purposes for which the land or building was being lawfullyused at the time of the coming into operation of this order or shall preventthe carrying out of any development for which immediately prior to the cominginto operation of this order, a permit or permits if any, required under this orany other Act authorising the development to be carried out had been obtainedand was current.

11.Appeals.In the event of a person being aggrieved by the refusal of approval

or by the conditions subject to which approval is granted in respect of anapplication for permission to carry out development under this order, he mayappeal to the Minister against the decision. The appeal must be lodged inaccordance with the provisions of subparagraph (c) of this paragraph withinsixty days after the refusal or conditional approval is served on him.

Where the Town Planning Board or a local authority excercising thepowers of the Town Planning Board under this order fails to grant approvalto an application for permission to carry out development within a period ofsixty days after receipt of the application by the local authority, the failureshall be regarded as a refusal of approval and a person aggrieved by suchrefusal may appeal to the Minister against the refusal The appeal must belodged in accordance with the provisions of subparagraph (c) of this paragraphwithin thirty days after the expiration of the period of sixty days from thereceipt of the application by the local authority.

Every appeal shall be in the form 5 prescribed in Appendix III to thisorder and shall state the grounds on which the appeal is made. It must belodged within the prescribed time at the office of the Town Planning Boardor at the office of the local authority concerned who shall forward it immediatelyto the Town Planning Board, for submission to the Minister.

12.Compensation.Where an application for permission to carry out development on land

within an area covered by notation 1 or notation 2 or by both notations 1 and 2is refused unconditionally or granted subject to conditions, the application shall,for the purposes of paragraph (a) of subsection (12) of section IA of the Act,be deemed to have been so refused or so conditionally granted on the groundthat the proposed town planning scheme for the metropolitan region is toinclude that land within a reservation for public purposes.

Where, under the provisions of subsection (12) of section 7A of theAct, compensation is claimed by a claimant, the claim for compensation shallbe made in writing in the form 6 prescribed in Appendix IV to this order andlodged by the claimant at the office of the Board not later than six monthsafter the date of the decision of the Minister made under the provisions ofsubsection (6) of that section.

Where, under the provisions of subsection (12) of section IA of theAct, the Crown is requested by a claimant to purchase the land injuriouslyaffected, the request shall be made in writing in the form 7 prescribed inAppendix IV to this order and lodged by the claimant at the office of the Boardnot later than one month after the date of the determination of compensationmade in accordance with the provisions of that subsection.
