regulation 31, as follows:

Borrowing by the Board.31. (1) Where, in respect of any borrowing by the Board under section six A

of the Act, the principal money borrowed is repayable in one sum at the end of theterm for winch such principal money is borrowed, the debentures to be issued by theBoard as securit-y for the repayment of such principal money shall be in accordance

with the Form No. 7 in Appendix A to these regulations, and the interest couponsattached to, or to be issued with, such debentures shall be in accordance with thForm No. S in Appendix A aforesaid.

(2) Where, in respect of any borrowing by the Board under section six A of theAct, the principal money borrowed is repayable with interest thereon by half-yearlyor other periodical instalments, the debenture or debentures to be issued by the Boardas security for the repayment of such principal money and interest shall be in accord-alice with the Form No. 9 in Appendix A to these regulations.

(2) Appendix A to the said regulations is amended by adding thereto, after FormNo. 6, additional forms, to stand as Forms numbered 7, 8 and 9, respectively, asfollows:

(j ) to keep all books entered up to date in accord-nec with instructions issued by the Minis-

ter and other instructions of the Board;(k) to check all accounts sent in to the Board, and

to sec that all accounts for work have statedhi them the authority under which the workwas done;

(1) to pay into the bank wcekiy, or as macli moreoften as is required, to the credit of theBoard, all moneys received by him oa behalfof tile Board, when such moneys shall amountin the aggregate to tile sum of £5 or more;

(imi) to act, wimemi required, as inspector in connec-tion with tue administration of all Statutescoming within the jurisdiction of the Board;

(mm) to readily and clleerfull) obey all lawful ordersOr commands of the Board, and to attend tonih matters affecting the finances and wel-fare of time Board, not specified herein.

Duties of Supervisor.3. The duties of the supervisor shall be:

(a) The supervisor shall have the control of works,plant, and all property of the Board, andshall issue instructions to the foreman, andshall see that sammme are faithfully carriedout. Should (lie foreman be guilty of in-subordination or disobedience, or be foundiueapahle of performing tile duties allottedto himu, the supervisor shall report the mat-ter to (lie chairm,ui, who slmall inquire intotue c ircimiimsta,mccs, and, if necessary, shallsuspend the foremau and report the matterto the mmext mueeting of the Board;

(ii) to direct all works ammd improvements as re-gards roads, etc., under tile control of theBoard; examine all materials to bc employedin such works, and to see the sanio faith-fully executed and performed, and watchthe progress and formation thereof;

to see that the work of repairing and clean-hag of all public roads and footways is pro-perly carried out;

to see that no labourers are engaged but thosethat are able bodied;

to see that all servants under his control carryout their duties efficiently, and to report anydeparture therefrom

to examine all roads in the Board's districtas required;

to supply monthly, or, as required, returns ofall work, whether completed or in progress.

Appointment of Officers.No permanent appointment shall be made to any

office under the Board until after an advertisement hasbeen published in a paper circulating in the districtcalling for applications from persons competent to fillsuch an appointment. All appointments shall be madeby resolution of the Board.

The salary or allowance attached to the officeunder consideration shall be fixed in all cases priorto the appointment, and the salary of the officer, whenfixed, shall not at any time be considered with a viewto its increase or reduction unless specially authorisedby a meeting of the Board, at which at least a quorumis present.

All coniplaints against servants of the Board mustbe in writing, and must in every ense be signed by theperson or persons complaining, and no notice shall betaken whatsoever of any complaint not made in accord-alice with this by-law. All such complaints as are re-ceivable shall be addressed to the chairman, who, uponreceipt of such complaints, shall have power to investi-gate same, and he shall report thereon at the nextmeeting of the Board.

Meetings and Proceedings.Notice shall be given in writing to each member

of the Board by the chairman or secretary of ordinarymeetings, at least seven days before such meetings, andalso of every meeting adjourned for more than six days.The chairman, if present, shall preside at all meetingsof ratepayers and of the Board, and in his absence, or,if after being present lie shall retire, the vice-chair-man shall preside.

Meetings of the Board shall be of two kindsordinary and special. Ordinary meetings are thosecalled by the chairman or secretary as often as seemsproper for the transaction of the ordinary business ofthe Board. Special meetings are those called to con-sider special business the nature of which shall bestated on the notice seat to members, for which sevendays' notice shall be given.

No bushiess shall be trausacted at a specialmeeting other than that for which the special meetingwas called; provided that any matter of urgency canbe dealt with, with the rnling of the chairman and theconsent of those present.

Ordinary meetings of the Board shall be heldat the office of the Board at Marble Bar, on the secondSaturday in each month, unless otherwise arranged byresolution at the previous meeting of the Board.

A special meeting may, on the requisition ofthree members of the Board, be called at any time inthe manner prescribed by the Act, but the chairmanmay call a special meeting as often as lie thinks proper.

Any three members may require the Board Roomto be cleared of strangers, and the chairman or otherpresiding ehairmaa shall immediately give directions tohave the order executed.

At all meetings of the Board, when there is nota quorum present, or when time Board is counted out(which counting out shall take place whenever thereshall be less than a quorum present, or within 30 mm-m,tes after the time for which tIme meeting was called)such circumstances, together with the na,nes of themembers thea present, shall be recorded in the minutebook.

Voting.Each member, ineludin the chairman, shall

have one vote, and such chairman shall, in a ease ofequality of voting, have a casting vote in addition tohis ordinary vote, and all questions at such meetingsshall be decided by a majority of the votes of the mem-

hers present. All motions and amendments shall bedecided by show of hands, unless a division is de-maadcd, before the next bnshiess is proceeded with.

Order of Business.The order of business at all ordinary meetings

of the Board shall be as follows:(a) Reading and confirmation of minutes of last

ordinary and special meetings (if any).Consideration of business arising out of minutes.Questions of which due notice has been given

by members or officers of the Board.Reports of committees, sub comnuttees, and

officers.Reading of correspondence (inwards and out-

wards) and taking action as may be deemedexpedient thereto.

Deputations and presentation oU petitions or,acmor,als, and consideration thereof.

Consideration of tenders and ratification of con-tracts.

Presentation of monthly statenseat and passingof accounts for payment.

Motions, of wInch previous notice has been given.Motions without notice (by leave of tile Board

under by-law No. 16).General business.Notice of motions.

In the event of any member having urgent busi-ness t a place before the meeting, lie may move the sus-pension of Standing Orders, and, if agreed to by theBoard, such business shall take precedence of all other.

Any member wishing to rescind any motion car-ried at any previous meeting of the Board shall givethe secretary at least fourteen days' notice of his in-tention to move such rescission, particulars of whichshall immediately be sent to all members.

Petitions.Every petition or memorial shall be presented to

the Board by a member only. Such petitions shall betemperale and respectful in language, and any memberpresenting a petition or memorial shall affix his nameat the beginning thereof, with the number of signatures,and any member presenting a petition or memorial shallacquaiat hiaiself with tIme contents thereof, and ascertam that it does not contain language disrespectful t0the Board. The nature or prayer of every petition ormemnorial shall be stated to the Board by tIme memberpresenting same.

Tenders.Tenders for work shall be opened and dealt

with am-hen the subject-matter of the tenders comes onto be considered at the meeting of the Board, or by acommittee appointed for that purpose.

Order of DebateSpeakers aiust not digress.A member having audience shall not digress from

the subject of the debate.

Correspondence.21.. All correspommdeace with the Board slmall be ad-

dressed to the secretary oud submitted to thme Board. Noletter addressed to the Board shall be presented orread by a member.

Urgent Works.The chairman, with one member, or, in the ab-

sence of the chairman, any two members, may, in easeof urgency authorise the expenditure of a sum notexceeding ten pounds. Any one mnemher is authorisedfor the expenditure of a sum not exceeding five pounds,in cases of urgency, upon declared roads, but shall inevery ease report tIme same at the next meeting of tImeBoard.

Unauthorised Expenditure.Evc ry item of expenditure, and every liability

incurred by any connnittoc or member of the Boardothorwise titan under the authority of the Act or ofthese by-laws, shall be deemed unlawful expenditureamid a breach of this by-law.

Common Seal.24. The eonnnon seat of the Board shall be kept in

the safe. The common seal shall not be affixedto ally deed or other instrument, exeopt by order of theBoard.

Offences, Omissions, or Neglects.23. Any person guilty of the following offences shall,

on conviction thereof, pay a penalty not exceeding tenpounds

Damaging or destroying ally building, darn, well,tank, pump, windmill, windlass, bucket, rope,piping, troughing, fence, gate, vehicle, machin-ery, or an)' other property under the cohtrolof the Board;

placing any placard or other document, writing,or printing on or otherwise defacing any houseor building abutting or contiguous to a publicroad, or any wall, fence, or gate, without theconsent of the occupier or owner thereof;

blasting any rock, stone, timber, or other ma-terial in or near any road or street without thepermission of the Board, and not attending tosuch directions in regard thereto given b) suchBoard;

placing, stacking, or storing within the lhnitsof ally townsite in the open air any eases,paper, shavings, crates packed with sawdust,straw, or dangerous or inllainn,able sub-stances so as to be or likely to become a sourceof danger through fire.

Damaging Roads.20. No person shall, either wilfully, or negligently,

damage or destroy any road under construction or re-pair, by means of horse, team, vehicle, or other means,and any person found guilty of such damage or destruc-tion shall be liable to a penalty not exceeding £25.

Any person whocuts or removes, withont the consent in writ-

ing of the Board, any timber, earth, stone,or other material from a road Or reserve; or

erects, without the consent aforesaid, upon aroad so as to encroach thereon; or

draws, without the consent aforesaid, acrosstIme waterside of any road or across a drain,except over a properly constructed culvertor approach, any wheeled vehicle; or

draws upon any road, stone, timber, or othermaterial otherwise than on a wheeled ye-]ucle, or suffers such material, when carriedprincipally or hi ilmirt upon a wheeled '-c-hicle, to drag or trail upon a road, or drawsupon a road a whim or timber carriage anyportion of which, or any portion of chainsattached thereto, or any portion of otherattachment, trails or drags upon the road,

shall be deemed guilty of an offence against these by-laws, and shall be liable to a penalty not exceeding £5for every such offence.

Prevention of Trees falling across Roads.27. No persoit shall make or leave a fire near any

road or track or reserve without taking propel- precau-tions aguhist such fire spreading.

23. No person shill ringbark er set fire to an)' stand-ing tree upon or ncar any road or track.

Preservation of'l' rees, Shrubs, etc.29. Any person who shall carelessly, wilfully, or

wantonly injnre, destroy or carry away, or remove fromits place any tree, shrub or plant, standing ill any ofthe roads, enclosure, public places, or reserves, or whoshall carelessly, wilfully, or wantonly injure, destroy,carry away, or remove out of its place, or ride or drivcagainst any of the tree-guards, fences, or other pro-tection for such trees, shrubs, or plants aforesaid, shallbe liable to a penalty of not more than £10 and, inaddition thereto, shall pay the Board a sum equal tothe damage done.

Setting Traps or Poison on Roads.Any person who shall lay any poison baits or

set any traps upon any road or footway shall be liableto a. penalty not exceeding £2 far ever)' such offence.

Prescribing Removal of Vernndahs.Any verandah or balcony which obstructs the

footway or roadway, or is dangerous, suid all otherobstructions on the footways or roadways, or over thesame, shall be removed, when ordered, within such timeas shall be notified h)- time Board, and all expenses in-curred in removing the same shall lie borne by theowner or occupier of such veran,lah or balcony or otherol,struction, wbetl,cr removed by lIme Board or otherwise;aad an)- person whatsoever interfefing or obstructing o,iyoffice, or pen emplo)-cd by the Board in carrying outtIns by-law shall be liable to a penalty not exceeding£10.

Encroachments, ete.Rcnioval thereof.Oa l:he order of the Board, the seeretar) or other

appointed persun or officer, may direct the removal,within 14 dayi, of any l,uildng, fence, or other ob-struction or encroachment in or uon any street, lane,ur public place nuder the control of the Board. Inany ease u-here, after service of such notice of ren,oval,any such obsti m,ctioa or encroachment has not been re-moved within the specified time, it shall lie lawful forthe officer appointed by the Board to remove same attIme cost and charges of tIle pci-son so a heading, andto proceed against the offen,ler for time hi-each of thish)--laiv, the penalty for wInch breach shall not be snorethan £20 for every da)- or part of a day during wInchsuch offence shall be conimnitted or eonthn,ed after theexpiry of tIme ,iotice prescribed therein.

Lighting.Any unauthorised person who shall light, put

out when lighted, Or in any way interfere with any lampbelonging to the Board, or any person who shall damageor destroy such lamp shall pay, in addition to the valueof such damage, if ally, on conviction, a ,iuni not ex-ceeding £5.

Crossing Places.It shall lie lawful for the owner of a,my land

erontiug or adjoining any road or public way requiringaccess thereto with horse and velacles from such streetto such land across any existing made footpath, kerb-ing, channel, or gutter, having first hod and obtainedtIme consent of the Board to construct a Crossing of suchdimensions and n,aterials, and in such form and ,nanneras the regulations of the Board for the time being re-quire, or as may be directed by the secretary, and shallthereafter k':ep and maintain the same in good repair.Any person not complying with this by-law sl,nll beliable to a penalty not exceeding £5.

Straying Stock.No animal shall he allowed 10 stray on any road,

rcser'c, Or place, and iso animal suffering from infec-tions or contagious disease shall he ridden or driven onany road .Any diseased a,nmal found on any moad maybe slaughtered or destroyed. The owner of ally animalfound straying as aforesaid shall be liable to a pcsinityof not less than lOs. (temi shillings) and not ,nore than£5.

Water Supply.36 .Any person ivhto shall injure, destroy any well, bore,

pipe, tank or other place of storage for water, or anymachinery, appliances, or property used in connectiontherewith, shall be liable to a peaal- not exceeding £5,and also shah I pay to tIme B on rd the stint of such damage.

37 .Any person who shall waste, or allow water toescape, foul, pollute or taint lay water contained in an)-bore, pipe, tank, or other place of storage, shall baguilty of an offence under thus by-law, and shall beliable to a penalty not exceeding £20.

38. No person shall pollute, or cause to be polluted,tIll)' watercourse, pool, vel I, tank or reservoir, or otherwater within the district.

Any person may, with the consent of the Board,and upon payment of such reasonable fees as may bedemanded, remove any water from any bore, well, tankor other place of storage, under the control of theJ3oard.

For the purpose of tins by-law, the consent of theBoard shall be deemed to have been given and remainin force until notice to the contrary is specifically givento any such person, or is generally given by publica-tion in a local newspaper, or posted upon or in thevieitity of the well, bore, tank, or other place of storageto which such notice shall apply.

After service of suell notice, or publicationthereof, any person removing any water from any well,bore, tank, or other place of storage the subject of suchnotice, shall be guilty of an offence and be liable to apenalty not exceeding £5.

Barbed Wire.Barbed wire shall not he allowed on the outer

or road side of any fence along any road. Any per-son offending against this by-law shall be liable to apenalty not exceeding £5.

Pencing.The owner of any lamld abutting on any road

in any townsite shall fence all such boundaries abut-ting with snell description of femice as may be directedby tile Board, and shall nlallltuin every such boundaryfence erected, or to be erected, in good order. In theevent of such fence not being erected or repairedafter due notie has been given so to do, the Boardmay fence or repair such fences and recover the costof doiag so fromn the owner or owners of rue land.

Bathing.No O5011 shall bathe in any river, pool, or

open public water within the limits or abutting on theboundary of the road district within the jurisdictionof the Board, without suitable bathing costulae orclothing. Every person offending against this by-lawshall for every offence i,e liable to a penalty notexceeding £20.

Reserves and Recreation Grounds.The Board slmall have power to grant exciusive

right to use and occnpy ally recreation grounds orreserves placed under its control within the districtfor holding public sports or amnusemnents, to anyresponsible person or persons, or club, and ally person,persons or club obtaining such right shall be respell-sible for the proper care of all fences, buildings,roads, trees, shrubs, or other improvements upon oremlclosing such iec-reatio,m grounds or reserves, andshall pay to the Board a feo to be fmxecl for adulissionon such occasion, and comply with the provisions ofthese by-laws and any regulations passed by resolu-tion of time Board under which such exclusive rightsarc granted.

No horses, cattle, or vehicles shall be allowedon recreation grounds or reserves without tile writtenpermission of the Board.

The Board many at its discretion prohibit anygames or gymnastics from being played or carried onby ally person or persons upon any recreation groundor reserve on a Sunday, (Jhristnlas Day, or Good Fri.-day.

Aerodromae Reserve.No person shall drive, or cause to be driven,

any motor car, truck, cart, or otimer vellicle across theranways of the lammdimmg ground. No existing trackshall be continued to be used as a motor road. Nopersoml simail place or leave any ohstraetioml whateverwithin the area reserved for the above pnrpose norinterfere ill any way with time existimlg groulld marks.Ally C5O offending against tills by-law shall beliable to a pemmalty not exceeding £25.

Penalties.\Vlmere any person by these by-laws or any of

tllem,l is required to do or to perforiml any act, andsuch act is not done, or renmains undone or uaper-formed, it shall be lawful for the Board to performtile samne amid cimarge the costs aad expenses againstsuch persoml, and tile amount thereof may be recov-ered summarily.

Every person who does, permits, or suffers allyact, mmatter or thing contrary to any of these by-laws,or comnmits or permits any breach or neglect tlmereof,shall be deemned guilty of an offence against these by-laws, and, where mmot otherwise provided, simall beliable to a penalty not exceediimg £20 for every suchoff emmce.

For all work not specified as above, the rates of payshall be as prescribed by the current Mining Award forthe class of work performed: Provided that, where undersuch Award t:io rate per shift is calculated on the basisof six (0) full shifts per week, the rate per shift underthis Agreement on the basis of five and one-half (5½)shifts per week shall be so calculated that the aggregatepayment for five and one-half (5½) shifts under thisAgreement s-hall be equal to the aggregate payment forsix (6) shifts under the said Award.

The above rates are payable under a contract of dailyservice.

4Hours.For roasterinen, packermen, scrcwmca and rous-

abouts (h mreinatter called essential arsenic workers) thehours of employment shall not exceed seventy-eight (78)hours yer fortnight, to be worked in alternate weeks oftiurty-six (36) hours and forty-two (42) hours.

For all other workers the hours of employment shallnot exceed forty-four (44) hours per week.

'fIle hours to be worked per shift shall be as setout hereunder according to the classification of theworker:-

Fcr essential arsenic workerssix (6) hours,exclusive of crib time;

For change-room attendantsscven and one-third (7*) hours, exclusive of crib time;

For all other workerseight (8) hours, exclu-sive of crib time.

Provided th,t no worker shall during any one shiftwork for a longer period than six (6) hourswithin any section of the Arsenic Works inwhich essential arsenic workers are or wouldnormally be engaged.

(e) Crib time shall not exceed Three-quarters (%)of an hou,' in the case of Rousabouts or One-half (½)aa hour in the case of all other workers.

5.Overtime.No overtime shall be worked, excepting to effect

repairs (this clause not to apply to roaster-men, whenthe relief u,au fails to turn up at the change ofshift)

All work done beyond the ordinary hours ofduty on any ordinary working day (Monday to Satur-day, inclusive) shall be paid for at the rate of timeand one-jaIl for the first tn-u (2) hours and at doubletime thereafter.

All work done oa Sundays shall be paid for atthe rate of time and one-half up to six (6) hours andat double time thereafter.

6.Public Holidays.The following shall be holidays :Christmas Day,

Easter Monday, and Labour Day. If Christmas Dayfalls on a Sunday the following Monday shall ho kept.In the event of a worker not being required by theemployer to present himself for duty on any of thesedays, payment may be deducted, All work done onpublic holidays shall be paid for at the rate of doublethne.

7.Annual Holidays.A fortnight's holiday, including twelve (12) ordi-

nary working days on full pay, shall be granted oncein each year to every worker: Provided he has workedtwo hundred and ninety-eight (298) shifts at ordinaryrates of pay, and should he have worked less thantwo hundred and ninety-eight (295) shifts when suchholiday is taken, or at the termination of Ins employ-ment, he shall b5 paid for a proportionate number ofholidays.

TIus clause shall operate regardless of the circum-stances attending the termination of the worker ' em-ploymnent.

8.Resumption of Work After Holidays.Where a worker is not notified prior to taking his

holidays that no further work is avallable, lie shall bere-engaged upon his return.

9.Accident Pay.In the event of a worker meeting with an accident

during the course of Ius shift, or being required toattend to one who has met with an accident, he shallbe deemed to have rendered duty during the whole ofthe shift and shall be paid accordingly.

10.Full payment for Shift.After beginning a shift, workers shall not be

paid less than for a full shift, unless they leave oftheir own accord, or are dismissed for misconduct.

If before a worker leaves the works at the endof the shift and because lie is not so informed lieattends the next shift ready to work it, and there is nosuitable work which he is allowed to perform, he shallbe paid tile wages he would have been e,,titled to iflie had worked the shift lie was ready and willing towork.

11.First AidA suitable first-aid kit shall be supplied by the mm

ployor and shall be accessible at all tunes.

12.Drinking Wrater,Drinking water, cool and free from dust, shall be

provided by some approved method other than bywater-bags.

13.Showers.A suitable change-room with hot and cold showers

shall be provided.

14.Working Clothes and Equipment.The following articles shall be supplied by the

employer, when necessary to the n'elf are of the workers,and shall be laundered and kept in good repair by theomployer:Glovcs, goggles, masks, overalls, bloomers.

15.Quick Shifts.No worker shall be required to report for work unless

lie has had at least eight (5) hours off duty since hisprevious shift.

16.Retrenchments,Should the occasion arise to reduce the number of

nlea employed, the Company shall give full weight tothe consideration of length of service and shall retainthose n-ho have been longest in their employ, all thingsbeing equal.

17.Casual Labourers.Any worker employed for less than oae week shall

be considered casual and shall be paid two shillings persluft (2s.) above the rate specified for the work.

15.Preference of Employment.Preference of employment shall be given to mem-

bers of the ''Australian Workers' Union.''

19.Time and Record Books.These books shall be kept by tile employer and shall

be open to inspection by the Union representative,when required.

20.Fluetuations of Basic Rate.Whatever the actual increase above the present

basic wage of four pounds sixteen shillings and 2 our-pence (E4 16s. 4d.) per week for male adults at Wilunais, shall be added to the agreed rates as set out in. thisAgreement.

In the event of the basic wage decreasing fromthe present figure of £4 lOs. 4d., the employer may pro-portionately lower the daily rate of the worker untilthe base basic rate of £4 7s. Od. per week at Wilunais reached, when no further reduction may take place.

It is hereby agreedbetween tile parties for the period of this Agreementthat, in the event of the basic wage being increased orreduced in accordance with section 124 of the Arbitra-tion Ant, such increase or reduction shall net affect therate of wages as set out in "1" ''Schedule'' of thisAgreeutemit: providing always, should the increase in thebasic wage exceed the minimnm wage set out herein,such increase being one shilling or shillings, such in-crease shall be paid.

Adult labourer:Adult labourers employed in orabout the Bottling Works or Brewery net covered by anyothcr industrial Agreement or industrial Award mustnot receive less than the minimum wage of £5 lSs. Gd.per week.

Storage tanks :Reconditioning storage tanks, whichshall include scraping and/or cleaning and/or painting,shall be paid for at the rate of 4s. per hour.

Oilers end aprons:Employers shall, for use in theirwork only, supply oilskin coats, cash and docket sat-chels, leather aprons, gaiters or leggings to motor lorrydrivers, free of cost.

Boots :The employer shall, for use during workinghours only, supply suitable boots to those employed atthe bottle washing, at the tanks, at the tubs, at the ffl-ters, at the cask washing shed, at the bottlers, and toany employees working in or about water, such boots tobe supplied free of cost.

2.Boys.The rate of wages for boys shall be:

3.Hours.Forty-four hours shall constitute a week's work for

all employees. Employees shall begin at 7.30 n.m. andconclude work at 4.20 p.m., from Monday to Friday in-elusive, with an allowance of one hour for meals andshall commence work at 7.30 am, and conclude at 12.20p.m. on Saturday.

Shift cellarmen :Porty-four hours shall constitutea week's work for shift ccllarmen, and the hours to beworked shall be:

Day sllift-8 a.m. to 4.20 p.m., with one hour offbetween 12 noon and 1 p.m. for lunch;

Aftcraoon shift-4.20 p.m. to 11.40 p.m. on weekdays and 3 p.m. to 11 p.m. on Sundays, inclusiveof thirty minutes each shift for crib.

Night shift-11.40 p.m. to 7 n.m. on week daysand 11 p.m. on Sundays to 7 a.m. on Mondaymorning, inclusive of thirty minutes each shiftfor crib time.

Tile luncheon hour on Saturday to be between 11.20a.m. and 12.20 p.m.

Provided always, that the quick shift man shall notwork en Sundays, and that the night shift man shallhave at least one week on day shift in every four weeks.

Topmen shall mean two or three sets of men working16 hours or 24 hours respectively, by shifts of 7 hoursiSO minutes straight out, on Mondays to Fridays, inclu-sive, and a shift of 4 hours 50 minutes on Saturday, onehour being allowed for luncheon, Monday to Friday, in-clusive. The hours of labour shall be 44 hours per week;hours of starting at the discretion of the brewer for oneman only, other men to start at 7.30 n.m.

4.Overtime.If ally employee works earlier than his starting time

or later than Ins ordinary quitting time, lie shall be paidovertime at tile rate of ti,no and a half, each day tostand alone.

SrCasual Hands.Casual hands shall be paid at the rate of 2s. lOs. pei

hour.6.Record Book.

Each Company shall keep a record of the time of eachemployee, of the time he starts and finishes each day,and of tile total amount of hours worked, and of thewages paid to each employee. Such record than be opento tile inspection of tile secretary of or any person ap-pointed by the employees' Union, during working hours.Each employee sIlall sign the record kept for nIl moneysreceived by him.

7.Sundays.All work performed on Sundays by employees ill ally

department (shiftmen excepted) shall receive paymentfor the same at double time i-ate. Shiftmen, when noton rotation Sunday shift, shall be paid at double timerate.

8.Holidays.All work perforned by elnployces in any depart-

ment on holidays shall be paid for at double tilne rates,and, as far as reasonably pernutted, employees shallbe employed on tile holiday shift in their turn as holi-days occur.

It is agreed between the employer and the Union thatin the event of any driver being called upon to workon holidays, such driver is to be paid at double timerate per hour worked (a part of an hour to be paidfor as a full hour) up to 10 n.m., and if such driverworks after 10 n.m. he shall be paid for the full shiftat double time rate. Any driver called upon to workOn Ilolidays after 10 n.m. shell be paid for the fullshift at double time rate.

Any employee (excepting drivers) working any partof a shift on a holiday sllall he paid for the full shiftat double tilne rates; all holiday shifts t0 rotate. Ifno work be done tile ordinary rate silall be paid forholidays. The days to be observed as holidays, ac-cording to the provisions of this Agreelllent are:Christmas Day, Boxing Day, Good Friday, Easter Mon-day, Union Fienie Day, Labour Day, Kalgoorlie CupDay, Boulder Cup Day, New Year's Day, Anzae Day,ICing's Birthday, and Foundation Day. In case anyof tile above holidays fall on a Sunday another day inlieu thereof shall be given, but such day silail be addedto the annual Ilolidays provided always, that whenFoundation Day alid/or ICing's Birthday fall on ordi-nary working days, work shall be performed on suchdays, and two days will ho granted in lleu thereofwhich shall be added to tile annual holidays. Frovidedalways, that when Baxiag Day fails on a Saturday allmen required shall work on tilat day alld another dayshall be given in lieu thereof.

9.Annual Holidays.Twelve days' annual leave on full pay shall become

due to workers with twelve months' service, such leaveto be taken at tunes mutually agreed upon between theemployer and the employees, between tile 30th Apriland tim 30th September in cad' year, in addition tothe Ilolidays ellamera ted in clause S of tills Agree-ment. Temporary hands with less than twelve months'service shall, 01' retirement, receive a proportion of tileannual holidays in ratio to their service.

10.Any employee, excepting those as herein provided,

at the request of the enlployor, starting work at atinle during the day later than 7.30 a.In., shall continueilis employment without a break, other than for mneals,until ho has completed on the first five days of eachweek a servico of sevea hours twenty minutes per day,and a term of five hours fifty minutes on the sixth day.

During each sllift so worked such employee, excepttilOse as herein provided, shall be paid overtime ratesafter 4.20 p.m.

Any employee, excepting those as herein provided, onday shift who is required to work before 7.30 am., shallnot be called upon by the employer to cease work until4.20 p.m. and shah be paid overtime rates for the timeworked previous to 7.30 n.m.

No coatract or piecework shall be permitted.All work of any employee in the capacity as men-

tioned hi ti is Agreement in or about a brewery orbottling woras, or in connection with the business ofbrewing or beer bottling, shall be carried out depart-mentally by bone fife breweries employees engaged andpaid direct by tile brewery proprietors and not byagents or contractors. This clause shall not apply tocontractors erecting, repairing, Or making alterationsto buildings or machinery, or to carriers being engagedfor the delivery of goods other than beer or empties, ashas been the practice or custom prior to this date. Theemployer agrees that such carriers employ only boaafife members of the Transport Workers' Union.

13.Engagement.The engagement between tile employee and the em-

ployer, except casual hands, shall be weekly, a week'snotice from either party to terminate same, except intile ease of an employee absenting himself from duty,nat obeying lawful commands, or being guilty of misSconduct, or of the works of the employer being stoppedthrough fire or tempests, when such agreement shall betenninated imnmediately.

14.Discharging and Re-engaging Hands.Tile question of dismissals and reengagement of

Union members shall be administered in a just and fairspirit, according to tile seniority of service, but re-serving to tile employer the right to depart fromtile rne of seniority of service ill circumstances wheretile employee is teellniealiy unqualified for the work, isilleolllpetent or guilty of misconduct, or, in tile opinionof' the employer, inconvenience would he occasionedto the euployer owing to the inclusion in tile dismissalsof sonIc essential man, Or tile inability of the employerto re-engage an essential mall.

This clause to apply only to men of at least oneyear 's continuous service.

Tile following departments shall be considered, asseparate employament for the purpose of this clause:(a) Bottle department; (b) brewery; (e) delivery.

No euiployce who has previously been in receipt ofhigher wages tllan arranged for in this Schedule shallbe reduced ill wages under his present employment, andshall receive a similar iacrease to all other employees.

All employees on day shift in or about a Breweryor Bottling Works shall, if required to work more thanone hour overtime after 4.20 p.m., knock off between5 p.m. and 6 p.m. for refreshments.

The employers shall moire it a condition of employ-ment that all workers covered by this Agreement shaUbe members of the Eastern Goldfields Breweries Em-ployees' Industrial Union of Workers and/or becomesuch within twenty-eight days of their employmentunder its terms.

Where an employee is required to take a ''leadingposition'' he shall, during the time he occupies suchposition, receive the sum of ten shillings per week inaddition t0 his ordinary rate of pay.

HAVING read the report of the Industrial Board ap-pointed t0 inquire into and report on the amendmentsasked for by the abovenamed Union to Award No. 25of 1935, together with the oral evidence and the exhibits,and having heard Mr. 3. Foley, on behalf of the appli-cant Union, and Mr. L. L. Carter, on behalf of therespondents, other than the Minister for Trading Con-cerns and the Commissioner of Railways, and Mr. S. S.Fisher, on behalf of the Minister for Trading Concerns,and Mr. E. MeKcnna, on behalf of the Commissioner ofRailways, the Court hereby orders and directs that thesaid Award No. 25 of 1935 be and the same is herebyamended as follows:

(1) Clause 2Interpretations:''Main docker'' Add the following words to the defi-

nition:''Main docker'' shall also include the docker in

a mill where one docker only is used: Provided thatthe output of such mm is not less than ten (10)loads per day.

(2) Clause 4Piecework:Omit this clause and insert in lieu thereof the follow-

ing''(1) An employer may make a contract with a

worker or group of workers for payment by resultsby piecework.

All disputes between employers and workersor groups of workers, or between the employer andthe Unioa concerning any matter relating to pay-ment by results shall, in default of agreement be-tween, the employer and his workers or the em-ployer and the Union, be referred to a Board ofReference for determination.

The rates now being paid sholl be continueduntil altered or revised pursuant to the provisionsof this clause.

When entering into a contract for pieceworkthe rate of payment shall be fixed on the basisthat it shall be sufficient to yield to a worker ofaverage capacity over a period of three (3) months,if the contract were to be of that duration in theiocalty specified, for a full week's work of theordinary hours us prescribed herein for dayworkers ten per cent. (10%) or more above theminimum time rote of pay as prescribed hereinfor such week's work plus allowances for holidays,where same are commuted to a weekly payment,and such allowances, if any, pursuant to clausep19 and 31:

Any contract for piecework shall containin express terms a statement as to whether holidaypay is included in the price to be paid for thework.

(i) Contracts for piecework may be re-vised at the end of each three (3) monthly periodfrom their date.

(ii) If any increase or decrease in the basicwage as proclahned from time to time is not in-cluded in tile piecework rates, the earn-ings shall be increased or decreased, as the casemay be, in accordance with such increase or de-crease in the basic wage.

Where a worker works part of a week atpiecework rates and part at tinle rates, he shall bepaid so much as he is entitled t0 receive underpiocework rates for the omount of work done, and,in addition thereto, such proportionate amount attime rates of pay as prescribed in this Award forthe portion of the week worked at time rates. Inthe latter case, the rate of pay shall include suchamount, if ally, apportioned pro rafa if necessary,to which he weuld be entitled nuder Clauses 19and 3L

A worker working under any system of pay-ment by results shall receive or be credited withat least Ilie time rate of pay apportioned if neces-sary. Notwitlistauding anything elsewhere in thisAward eoatoincd, when any question arises as towhether any pieceworker lbs received his time rateof pay, the total payment received by him duringtile past three months, or during the duration oftiw. contract for piecework, whichever period is theshorter, shell be averaged.

Any time occupied by a piecework faller inthe performance of sue!' work as sharpening sawsand axes, end which is usually performed by a timeworker during working hours, shall be taken intoconsideration when fixing the piecework rates.

Time occupied by a pieceworker walkingto and from his working place, when such i5 situ-ated beyond one and a half (1½) miles from thecamp, shall be taken into consideration as timeworked ia fixing piecework rates on the basis oftweaty (20) minutes for each mile, both going toand returning from work, between the one-and-a

half (1%) mile point and the working place. Ifnot included when fixing rates for piecework, itshall be paid to the worker as part of his wages.

(II) Where holidays, or equivalent holiday pay,have not beeti commuted pursuant to subelause (4)hereof, ui employer shall gr:tiit to any piecoworkerin his service paid holidays equivalent to thosegranted to time workers in accordance with clause13. Such holidays, when taken out, shall be paidfor at the day work rates prevailing when theholidays are taken. Where the term of serviceis less than twelve (12) months, holidays for piece-workers shall he assessed and paid for pro rate.

(12) The foregoi]Ig subclauses, with the excep-tion of subelauses (1) and (2), shall not apply topiecework skeper hewing, the minimum rates andconditions of employment for which class of workshall be governed by the following provisions:(a) The minimum hewing rate for jarrah sleepers

duly passed hy the Government Inspectorshall, in default of agreement between theUnion and the employer, be two pounds tenshillings (fi2 105.) per load of fifty (50)cubic feet.

(h) The minimum hewing rate for wnndoo sleepersduly passed by the Government Inspectorshall, in default of agreement between theUnion and the employer, be two poundseighteen shillings (fi2 iSa.) per load of fifty(50) cubic feet.

(c Payment of wages shall be made within two(2) weeks of the official inspection. If theofficial inspection be delayed beyond onemonth, a worker shall be entitled to be paidninety per cent. (90%) of the work valueof the sleepers cut by him and carted tothe stacking site.

(d) After each official inspection of sleepers bythe Gevernment Inspector, the employershall supply to the sleeper hewer a state-ment containing the following particulars:-the date of inspectionthe number and sizes of the sleepers passed;the number and sizes of the sleepers re-jected.

(13) Subject as aforesaid, no clause ef thisAward ether than clause 29 (Beard of Reference)shall apply to piecework sleeper bowers.

(11) A ce,itract for piecework may be ter,ninatedat any tinie by either the employer or the worker,in which ease payment shall be made for the workdone up te date, subject to the previsions of sub-clause (8). In the ease of wages, payment shall bemade within two (2) hours of application, at theoffice of the employer, a,id, iu eases where pieceworkearnings have to be calculated, within two (2) days.''

(3) Clause 5Junior Labour:Omit this clause and insert in lien thereof the follow-big:

'' (a) The employer may employ juniors in anyposition which they are capable of filling, but ex-cluding the positions of carpenter, wheelwright orwagoabnllder in the towns of Northam, Bunbury,Geraldten, Albany, Varleep, Jarrandale, and Pem-berton, sawyer, dovetailing ,nachinist in box-making,and tnnehi,,ist to any machine other than these hero-inbefore allowed or those to be allowed by theCourt: Provided that the :n:mhcr of such boys em-ployed in any bush mill does not exceed the pro-portion of one i,j eight (8) of the total adultworkers euiploycd: Provided further, that where asection of the mill is devoted to fruit-case makingthe foregoing proportion may be increased to onejunior to every four (4) or fractien of four (4)adult workers employed, but in any case not en-ceediag one junior for each adult worker employedin suea section; and in mills whose work is solelythat of fruit-case making the proportion allowedshall he one junior for every four (4) er fractionof four (4) adult workers employed in such mill.

(b) The employer, within one week of the en-gagement of a junior under this clause, shall infermthe Union by registered letter of such employmentand the total number of junior and adult workersthen employed.

(e) Nothing in this clause shall prevent the in-struction and tuition in sawing or machining of anyjnnior employed under this clause, where such in-struction or tuition is supervised by an adult workeror foreman.

When any junior is engaged he shall furnisha certificate or statutory declaration as te his age,and the employer may rely on such certificate ordeclaration until he has had notice in writing ofits inaccuracy.

The minimnm weekly rates of wage to bepaid to juniors shall be ns prescribed in Schedule I.

In any ease in which it is claimed that byreason of any special eircumsta,,ccs it is desirablethat a greater or less number of juniors should heemployed, an application setting out such specialcircumstances may be made to the Court far a spe-cial order thereon, and the Court may thereuponmake such order as it thinks proper under suchcircumstances.'

Clause 8Measuring Logs:This clause is amended by the addition of the follow-

ing: -'' (b) All lags felled shall be paid for ia the next

fortnightly pay following that in which the logswere felled, subject to the provisions of clause 20.''

Clause 13Holidays:Omit this clause and insert in lieu thereof the follow-

ing :-''(a) All workers after twelve (12) months' ser-

vice, cther than piceeworkers who are provided forunder clause 4, shall be entitled to a fortnight'shuliday per annum on full pay, as prescribed herein.

(b) The holidays mentioned in subelause (a) maybe taken all nt one time or partly at Christmas timeand partly at Easter time, as may he mutually ar-ranged between the Union, or the local branch ofthe tinJon, and the employer.

(e) Where any day has been kept as a holidayoutside the holidays mentioned in subelanse (a)and paid for, such day or the pay theref or shall bedcduetel from the days herein specified as holidays,or, if included, shall not be paid for. Labour Dayshall be deemed to be included in the provisions ofthis subelause.

(d) Where the employment of a worker is ter-minated during the conrse of a calendar year, hisemployer shall pay to lnm a day's wages for eachcalendar month of his service, in lieu of the holi-days to which lie would have been entitled tinderthis clause and has not received. Such worker shallonly be entitled, when the holidays are taken tosuch holidays, on full pay as are proportionate tohis length of service with such employer, and, ifsuch holidays are not equal to the holidays given toother workers, lie will not be entitled to work orpay whilst the other workers of such employer areon holidays on full pay.

(e) An extra week's holiday may be taken atDu-istmnas time without pay, if desired by the localbranch of the Union and agreed to by the employer.

(f) Holiday pay shall not accrue during aworker 's absence from his work for any cause what-soevcr, except---

permitted absence through sickness;holidays in pursuance of this clause of the

Award;(ill) the extra week's holiday at Christmas time

mentioned in subclause (e)(iv) stoppage of work owing to breakdown of

machinery or shortage of logs, hut not an-eeeding twelve (12) days in twelve (12)months and pro vata where the service isless than twelve (12) months.

(g) A watchman, whose ordinary hours of dutyare fifty-six (56) per week, shall be entitled to three(3) weehs' annual holiday: Provided he shall havebeer in the employer's service as a watchman aperiod of twelve (12) calendar months prior to thedate of such holidays, and, if he shall have beenemployed as a watchman for a lesser period thantwelve (12) mouths prior to the date of such holi-days, then he shall be entitled to holidays as pro-vided in proportion to the period of his service din-ing such year. Each worker, who shall not actuallyhave received the holidays in any one year as herein

provided on full pay, shall be entitled t0 be paidwages in proportion to the length of service heshall have rendered.

The holidays for watchmen, feeders, andgrooms shall be taken at such time as may be mutu-ally agreed upon between the employer and theworker.

This clause does not apply t0 casual

(6) Clause 14Hours:Amend subelause (a) by adding thereto the fol-

lowing''to be worked ia five and a half (54) days.''Amend subelause (c) by adding thereto the fol-

towing:"In the event of a dispute between the employer

and the Union as to the reasonableness of the dailyspread of hours for these workers, such disputemay be referred to a Board of Reference for deci-sion.'

Amend subelause (e) by adding thereto the fol-lowing :-

''without loss of pay.''(7) Clause 19Travelling Time:(1) Amend subclause (a) by adding thereto the

following:''Provided that suck travelling time shall be

limited to eight (8) hours in any one day.''(2) Omit subclause (b) and insert in lieu thereof

the following:(b) Every worker in the bush, except a piece-

worker, who is provided for under the provisionsof clause 4 (10), shall have a starting place forwork, which shall be any point not more than oneand a half (1½) miles by the nearest practicableroute from the eamp.

(3) Omit subelause (e) and insert in lieu thereofthe following:

(c) When a worker is required to walk to hiswork at any place situated beyond the startingpoint, he shall be paid for all time occupied inwalking between the starting point and the work-place at the rate of twenty (20) minutes for eachmile or part thereof, both going and returning,that the workplace is beyond the starting point.''

(8) Clause 20Payment of Wages:Add the following subclause :-

''After the thirtieth (80th) day of June in eachyear, on the request of a worker, the employershall supply such worker with a statement show-ing the amount of wages earned by him whilst inthe employment of the employer during the pre-ceding twelve (12) mouths, together witk theamount deducted from the wages of such workerby statutory authority."

(9) Clause 26Contract of Service:Amend subalause (a) by the omission of the

words ''in tho case of towns.''Amen.d subelause (f) by the addition of the

following:''So as to obviate as far as possible loss of

time to the worker, all plant and machinery shallbe kept in a reasonable state of repair by the em-ployer, and every effort shall be made by him toensure a constant supply of logs at the mill ''

(10) Clause 30Absence Through Sickness:Amend tins clause by omitting subelause (b).

(11) Clause 31Allowances:(1) Omit subelause (i) and insert in lieu thereof

the following:-''(i) Where a wet-sawing process is operated

in a mill to the discomfort or to the detriment ofthe health of the workers, such allowance, if any,shall be paid t0 the henchman and assistants orother workers affected by the process, as may beagreed npon, or, in default of agreement, de-termined by a Board of Reference,''

(2) Add a new subclause as foiows:-''(j) Where a worker is called upon to work

in water or slush more than six (6) inches deep,he shall be paid an allowance of one shilling(is.) per day, or be provided by the employer withrubber boots whilst to employed."

(12) Schedule 1:A,uend this portion of the Award as follows:

MEMORANDUM OF AGREEMENT.(Note.Wherever the word occurs herein

it shall he taken to mean and include ''Agreement'').

1.Area.This Award shall have effect over the area comprised

within a radius of twenty-five (25) miles from the PostOffice, ICalgoorlie.

2.Hours.Portyeight (48) hours shall constitute a week's work.

3.Spread of Shift.Spread of silift shall mean the time which elapses

from tile worker's starting time to the worker's finishingtime for tile shift.

Weekly spread of shift shall mean the aggregateIlumber of hours contained in the spread of shifts fora week.

Subject to clause 4 (Overtime), a spread of shiftshall not exceed twelve (12) hours.

Weekly spread of shifts shall not exceed seventy-two (72) hours.

Nothing contained ill (c) and (d) hereof shallentitle an employer to increase the spread of shift nowworked by his workers, unless it can be shown that thegeneral alterations contained in this Award have madethe continuance of such a spread of silift difficult. Insucil a ease the matter shall he settled by agreementbetween tile employer and an accredited representativeof tile Union, or, failing any such agreenlent, by theBoard of Reference provided by this Award.

In addition to breaks for meal intervals, theremay be a break of not less than three (3) hours duringany shift.

4.Overtime.All work done ill excess of the spread of shift

provided in clause 3, or beyond forty-eight (48) hoursill any olle week, or outside the rostcred hours in anyshift, shall be deeuied to be overti,ne and shall be paidfor at the rate of tinle and a half.

No employer shall work any worker, and noworker shall n ork for any employer for a longer periodof overtilne than five (5) hours in any one week, exceptduring-

the period from 23rd December to 6th January,inclusive;

the racing carnival week in whicil the Kalgoorlieand Boulder Cups are contested.

Provided, however, that ill 110 ease shall more than ten(10) hours' overtime be worked in any one week.

6.Board and Lodging.For all workers where board is provided, the enlployer

shall be elltitled to deduct one pound two shillings andtwopenee (flu 2s. 2d.) per week, and where lodging isprovided, eleven shillings alld sevenpenee (us. 7d.) perweek.

7.- Aceonuno dation.An elnployer requiring a worker to sleep in silail pro-

vide suitable accommodation. If tile worker shall con-sider the aceonlmOdation unsuitable, tileR the Union mayrequest the Healtil Inspector to inspect and report upontile salne, and his decision shall be filIal on the point.

Workers sleeping-in shall be provided with a comnlonsitting room apart from their bedrooms, and they shallhave access to a bathroom.

8.Change 1100,1,.The employer silall provide a suitable and properly

oquipped change room for tile workers of each sex,where such workers do not reside on the preulises. Tileroom shall i,e provided with nmirror, washbasin, soap,towels, and seating accommodation. Any complaintsas to tile inadequacy of any change room in any par-ticular way shall be referred to tile Board of Reference.

9.Meal Hours.At least one clear hour in every six (6) silail be

allowed off for each worker for meal time.

10.Meals.Where board is provided meals silali ho supplied as

11.Weekly 1-Iohdays.All workers silall he entitled to and shall receive one

full day off duty in each week, excepting in hotelswhere one cook is employed, in which ease two (2)half-days in lieu of one full day may be given, and,in addition, tile wages paid by such hotels to suchworkers shall be increased by one-twelfth (1/12th)above the rates provided by this Award. 12.Annual Holiday.After the completion of twelve (12) months' service

annual holidays shall be granted as follows:Three(3) weeks' holiday on full pay shall be granted withinthree (3) months of becoming due, and all workersshall be required to take such holidays: Provided that,any worker who shall have served one month or overand whose services shall have been terminated by eitherparty before the annual holiday has become due underthis clause, shall be eatitled to and shall receive a pro-portionote allowance for the time actually served.Should the employer require the worker to continuework after the time appointed under this clause forthe takiag of such holidays, then he shall pay theworker at the rate of double time for all work doneafter that date, unless after consultation with the Unionrepresentative lie can show that it is not possible forhim to find a substitute during that time: Providedalso, that a roster containing the names of workers andthe dates on which their holidays become due may bearranged between the employer and the Union. Byconsent of the employer, workers may exchange theirrostered holidays with each other.

13.Payment for Public Holidays.All work done on Good Priday, CinJatmas Day,

Labour Day, and Aniac Day shall be paid for atdouble time rates in all establishments.

14.Roster.A roster of the working hours of all workers shall

be exhibited in each establishment in such a place asit may he conveniently and readily seen by each worker,such roster to be compiled weekly, and shall denotethe hours to be worked by such workers for the weekahead and shall be open for inspection by Union of-ficials during all working hours. A copy of thus Awardshall be available at all times in a place where allmay perusa it.

15.Record Book.The employer shall keep or cause to be kept at his

business premises, or at each of them if more than one,a time and wages book, wherein shall be entered thename, occupation and, in the ease of juniors, the age onhis or her last birthday, the time he or she eommeaeesand finishes work each day, and the wages paid to eachworker each week. Such book shall he entered up eachday and shall be signed weekly, if correct, by eachworker. The employer and each worker shall he sever-ally responsible for the proper posting of this book.The book shall be open for inspection on the employer 'spremises during working hours by a duly authorisedrepresentative of the Union, who shall be permitted totake extracts therefrom.

16.Weekly Wages.Wages shall be paid weekly. When no agreement in

writing is made determining the period of notice, theaa notice of not less than twenty-four (24) hours shallbe given by either party of intention to terminate theservice.

17.liestrietion of Work.No female shall he permitted or compelled to climb

ladders for the purpose of cleaning fanlights, electricfans, walls, or windows.

18.Uniforms.Employers shall provide, maintain, and pay for the

cleaning and the laundering of all stiff white cuffs,collars, white aprons, white coats or other workingapparel in the nature of uniform, where same are de-manded to be worn.

19.Higher Duties.Any worker who for more than two (2) hours in any

day performs work carrying a higher prescribed rateof wages than that in which he or she is engaged shallreceive such higher wage for the time so employed.

20.Absence Through Sickness.(a) A worker shall be entitled to payment for non-

attendance, on the ground of personal ill-health, forone half (%) day for each completed month of service:Provided that payment for absence through such ill-health shall be limited to six (6) days in each calendaryear. Payment hereunder may be adjusted at the endof each calendar year, or at the time the worker leaves

the service of the employer, in. the event of the workerbeing entitled by service subsequent to the sickness toa greater allowance than that made at the time thesickness occurred. This clause shall not apply wherethe worker is entitled to compensation under the\Vorkers' Compensatioa Act.

A worker shall not be entitled to receive any wagesfrooi las employer for any time lost through the resultof an accident not arising out of or in the course oflas empicymeni or for any accident, wherever sus-tained, amising out of his own wilful default or forsickness arising out of Ins own wilful default.

No wo' ker shall be entitled to the benefits of thisclause u,iless lie produces proof satisfactory to hisomployer of sickness, but the employer shall not beentitled to a medical certificate unless the absence isfor three (3) days or more.

(b) Any time in respect of which a worker is absentfrom work except tune for which he is entitled t0 claimsick pay under the preceding provision shall not conntfor the purpose of determining his right to holidays.

2l.Junior Worker's Certificate.Junior workers, upon being engaged, shall, if re-

quired, furnish the employer with a certificate con-taining the following particulars:-

Naaie in full.Age and date of birth.Name of each previous employer, and length of

service with such employer.Class of work performed for each previous em-

ployer.Such of the foregoing particulars as are within the

kaowledge of an employer shall be indorsed on the cer-tificate and signed by the omployer, upon request ofthe worker.

No n-orker shall have any claim upon an employerfor additional pay, in the event of the age or lengthof service of the worker being wrongly stated on thecertificate. If any junior worker shall wilfully mis-state his age or length of service in the above eerti.fleate, he alone shall be guilty of a breach of thisaward.

22.l3oard of Reference.(a) The Court appoints, for the purpose of the

Award, a Board of Reference. This Board shall con-sist of a chairman and four (4) other representatives,two (2) t0 be aomi,iated by each of the parties. Thereare assigned to such Board, in the event of no agree-ment being arrived o t between the parties to the Award,the functions of:-

adjusting any niatters of difference which mayarise between the parties from time to time,except such as involve interpretations of theprovisions of the Award or any of them;

classifying and fixing wages, rates and conditionsfor any oceupalian or calling not specificallymeitioned in the Award;

deciding any other niatter that the Court mayrefe to such Board from time to time.

(b) An appeal shall lie from any decision of suchBoard hi the manner and subject to the conditions pre-scribed in the Industrial Arbitration Act, 1912-1935,which f or this purpose are embodied in this Award.

23No Reduction.Nothing herein contained shall entitle an employer to

reduce the wages of any worker n-lie at tIme date of thisAward was being paid a higher rate of wages than theininimunt prescribed for in Ins or her class of n-ark.

24.Preference.All things being equal, preference shall be given to

members of The Hotel, Club, Caterers, Tearooms andRestaurant mployees' Industrial Union of Workers,W.A. Goldfields Branch.

25.No Vietimisation.No employer shall disnuss any worker from his em-

ployment or injure him in his employment or alter hisposition to his prejudice by reason merely of the factthat the worker is a meaiber of The Hotel, Club,Caterers, Tearoonis, and Restaurant Employees' Unionof Workers, W.A. Goldfields Branch, or by reason of thefact that such worker is entitled to all the beneflt.s ofthis Award.

26.Term.The term of this Award shall be three (3) years from

6.Overtime.(a) All tima worked on any day after the regular

8.Termination of Employment.The coatcact of service shall be by the day and shall

9.Piece Work.A worker undertaking piece work shall be paid at

least the minimum rate prescribed by this Award plusten per cent. (10%).

10.Leading Hand.Any worker placed ill charge of three (3) adult

workers covered by tl,is Award shall be paid the rateof one shilling (is.) per day extra.

11.Higher Duties.A worker engaged for more tItan two (2) hours in

aay one day on duties carrying a higher rate than hisordinary classification shall be paid the higher rate forthat day.

12.Meal Money.One shilling and sixpence (is. ad.) shall be allowed

to any worker who is required to work more than two(2) hours' overtime after completing his day's work.This shall not apply where a worker has been notifiedon the previous day that overtime shall be worked.

13.Spray Painting.Spray painting operations shall be carried on under

the conditions and restrictions imposed by orders orregulations for the time being in force made by tileDepartment of Public I-Iealthi, hi pursuance of the Pae.tories and Shops Act and amendments thereof, and forsack purpose such orders and regulations are herebyembodied in and form part of this Award, with theintent tl,at a bronchi thereof may be enforceable as abreach of the Award.

14.Dipper.A worker while employed dipping shall be provided

with an apron or over-all to protect his clothing whileso employed.

(e) Workers shall be allowed five (5) minutes eachday before ceasing work for the purpose of washingand cleaning np.

6.Access to Jobs.The secretary or any authorised officer of the Union

shall be allowed free access te any job at any timedurhig the luncheon hour, and, with the consent of theemployer or foreman at any other time to interview any of the workers, if lie desires to do so.

17.Absence Through Sickness.(a) A worker shall be entitled to payment for non-

attendance, on tile ground of personal ill-health, for onehalf day for each completed month of service: Pro-vided that payment for absence through such ill-healthshall be limited to six (6) days in each calendar year.Payment hereunder may be adjusted at the end of eachcalendar year, or at the time the worker leaves the ser-vice of the employer, in the event of the worker beingentitled by service subsequent to the sickness to agreater allowance than that made at the time the - sick-

hess occurred. This clause shall not apply where theworker is entitled to eolnpensatioa under the Workers'Compensation Act.

(b) Holiday pay shall not accrue during a worker'sabsence from duty, except on. account of sickness inaccordance with suhelause (a) hereof.

18.Holidays.Twelve (12) paid holidays per annual shall be

granted each worker, after twelve (12) months' con-tinuous service: Provided always, that New Year'sDay, Good Friday, Easter Monday, Labour Day, Christ-mas Day, and Boxing Day, or the days observed assuch, shall be taken as they come as portion of theholidays. The balance of six (6) days shall be grantedas annual leave, at the convenience of the employer,but shall in any event be taken within six (6) monthsafter becoming due.

In the event ofaworker being employed by anemployer for poition only of a year, he shall only beentitled to such holidays on full pay as are proportion-ate to Ins length of service during that period withsuch employer, and, if such holidays are not equal tothe holidays given to the other workers, he shall notbe entitled t0 work or pay whilst the other workers ofsuch employer are on holidays on full pay.

(e) Except when employed subject to the conditionsof clause 6 (e) (Overtime) no worker shall be requiredto present himself for duty on any of the speciallyaamed holidays in subelause (a) hereof. On any otherpublic holiday an employer's establishment or placeof business may be closed, in which ense a worker neednot present himself for duty, hut, if kept open or workbe dune, ordinary rates shall apply.

Where a worker is dismissed for wilful miscon-duct, he will not be entitled to the benefit of the pro-visions of this clause.

The foregoing provisions shall not apply to casuniworkers.

19.Aged end Infirm Workers.Any worker who by reason of old age or in-

firmity is ivab)e to earn the miniinuni wage may bepaid such lesser wage as may from time to time beagreed upon in writing between the Union and the em-ployer.

In ti e event of no agreement being arrived at,the matter clay he referred to the Board of Referencefor determination.

(e) After application has been made to the Bonrd,and pending the Board's decision, the worker shall beentitled to work for or be employed at the proposedlesser rate.

20.Record Book.Each employer shall keep n time and wages hook,

showing the name of each worker, and the nature of hisvork, the hours worked each day, and the wages andallowances p Lid each week. Any system of antomatiorecording b means of machines shall be deemed acompliance with this provision to the extent of the in-for,nation recorded.

The time and wages record shall be open forinspection to a duly acer edited official of the Unionduring the usual office hours, at the employer's officeor other convenient place, and he shall be allowed totake extracts therefrom.

21.Junior Workers.Male junior workers shall be allowed in the pro-

portion of one junior to each adult worker. The pro-prietor and/or his manager shall be counted as a workerfor the purpose of this clause, if engaged in the actualworking in the shop or factory. Where no adult workeris employed one junior may be employed.

Female juniors shall not be employed.

22.Junior Worker's Certificate.Junior workers, upon being engaged, shall, if

required, furnish the employer with a certificate con-taining the following partieuiars:(i) Name in full;(ii) Age and date of birth.

No worker shill have any elai,a upon an em-ployer for additional pay, in the event of the age oftile worker being wrongly stated on the certificate. Ifany junior worker shall wilfully mis-state his age inthe above certificate, he shall be guilty of a breach ofthis Award.
