. Notification of Registration of AmendmenttoCollective Bargaining Agreement.

IT is hereby notified that the Registrar of Labour Relations

has, in terms of section 84 (1) (a) of the Labour Relations Act,

1985, registered an amendment to the Collective Bargaining

Agreement for the Textile Industry notification of the registra-

tion of .which was previously published in Statutory Instrument

555 of 1983, to be binding with effect from ist April, 1988.

BMPLOYMENT COUNCIL FOR THE TEXTILEINDUSTRY

FURTHER AGREEMENT

This further agreement, made and entered into in accord-ance with the provisions of the Labour Relations Act, 1985,

between the Central African Textile Manufacturers’ Association |

(hereinafter referred to as “the employers” or the “Employers’

organization”), of the one part, and the Zimbabwe Textile

Workers’ Union of Zimbabwe (hereinafter referred to as “the

employees” or “the trade union”), of the other part, being

parties to the Employment Council for the Textile Industry,

shall be read as one with the agreement published in Statutory

Instrument 555 of 1983, as amended (hereinafter referred to

as “the principal agreement”), —.

1. Clause 8 of the principal agreement is amended—

(a) by the insertion of the words “discertification” after

the word “registration” before the word “of” in

the first line of subclause (5) (a).

2. Clause 9 of the principal agreement is amended—

(a) by the deletion of subclause (i) (i); |

(b) by the deletion of the words “unlicss exempted in

terms of paragraph (b)” in subclause (2) (a) and

‘the substitution of “Every employer shall pay to

each of his employees wages which, if calculated

on a weekly basis, are not less than the minimum

set forth in subclause (3) applicable to employee's

level and status as a learner or otherwise, or, if

calculated on an hourly, daily or monthly basis,

are no less than the amountarrived at by converting

the prescribed minimum weekly rate in the manner

laid down in Clause 12”; -

(c) by the deletion of subclause (2) (b);

(d) by the deletion of the word “normally” in sub--” clause (8) and the substitution of “an employer who.

requires an employee to perform work ascribed to

two or more levels shall pay to such employee the

wage applicable to thehighest of such levels.”; -

by the insertion. of the. words “in termsof section _68 of the Act” after the word “suspension” in -

- subclause (11). . - :

3, Clause 10 of the ‘principal agreement is amended—

(a) by the deletion in subclause (1) (f) of the word |“dismissed” and thesubstitution of the word

“suspended” in the last line;

by theaddition of a new subclause (1) (h) (iii) “in

thecase of a guard: that there are facilities that hereceives refreshments”; . _ oo

by the deletion of subclause (1) G@) and the sub-stitution of “an employee required: to travel on

duty shall be paid at his normal rate of pay up to

the maximum of 12 hours payable per. day”;

by the deletion of the proviso; _by the deletion of subclause (2) (g);

by. the insertion of the words “in consultation »with. the Workers’ Committee” after the word“may” before the word “cause” in subclause (5);

(g) by the deletion of subclause(c) and the substitution

of “Employees whose services are terminated or:

resign from employmentbefore commencing vaca-tion leave shall be entitled to wages and benefitsdue to them up to the timeof such termination .

4. Clause II of the principal agreement is amended—

by the deletion of subclause(1);by the deletion of subclause (3);by the deletion of subclause (4);

by the deletion of subclause (6); To

by the deletion of subclause (8) and the substitutionbya new subclause (1) “No employer shall place allor some of his employees on short-time working—without prior written approval of the Minister ofLabour, Manpower Planning and Social Welfare”.

5. Clause 15 of the principal agreement is amended—

(a) by the deletion of the words “three days” andsubstitution of the words “one day” in the provisoin subclause (1).

6. Clause 17 of the principal agreementis amended—

(a) by the deletion of subclause (1) (c) and the sub-stitution of “An employer who employs a motherwhose own child is under the age of thirteen yearsof age shall grant such mother time off for thepurpose of taking such a child for treatment,provided that she produces a medical certificate ora certificate from a registered traditional healerimmediately upon return to work. Such time offshall be deducted from the employee’s sick leaveentitlement in terms of clause 21 subclause (4) or(5) whichever is appropriate”;

(b) by the deletion of the whole of subclause (2);

(c) by the deletion of “2” and the substitution of “3”in subclause (3) (a).

7. Clause 18 of the principal agreement is amended—

(a) by the deletion of the words “but not less than aminimum amount equivalent to one day’s pay at

level 4 rates of pay’ in subclause (1) after the

word “expenses” and the substitution of the words

“appropriate to the area of work-location” afterthe word “expenses”.

8. Clause 19 of the principal agreemerteis amended—

(a) by the deletion of subclause’ (2) and the sub-stitution of “An employer shall permit an employeeto proceed on vacation leave one month of hisapplication therefor, and an ,employee who isentitled to vacation leave may be compelled totake such leave within one month of an instructionto do so from his employer.

9, Clause 21 of the principal agreement is. amended—

_ (a) by the deletion of subclause (1) and the substitutionof “If an employee becomes incapacitated andunfit for work owingto sickness or accident, heshall obtaina certificate from a medical practitioneror. a registered traditional healer, setting out thecause which renders him unfit for work, and shall.

4. Photographic copy or copy produced on a duplicating-machine may be accepted if it is abundantly clear.

5. (1) Should any copy—(a) exceed 10 pages of double-spaced typing on size A4

paper; or(b) contain tabular or other matter which involves

complicated setting; .| it will be classed as “lengthy” copy, and will be required to besubmitted not less than 21 days before the date of closing forthe Gazette in which it is to be published.

(2) Lengthy copy may be accepted at less than 21 days’

(a) the work involved is of a straight forward and non-tabular nature; and .

7, Copy must not be submitted as part of a letter or a‘requisition. It must appear on a separate sheet of paper, on‘which there is no instruction or other extraneous matter.8. (1) In cases where notices have to. be published intabular form, copy mustbe drafted exactly as it is to appear.If printed forms for any such notices are unavailable,advertisers must prepare their own forms. While it is notnecessary to include the preamble, the box-headings must bethere, and, where applicable, the number of the form; forexample, “Insolvency Regulations—~Form 3”.

(2) In the case of copy for tabular notices, the provision-of subsection (2) of section 3 does not apply. .

9, Copy for all advertisements, whether sent by post ordelivered by hand, must be accompanied by a requisitionora letter which clearly sets out—_

(a) the name and address of the advertiser; and(b) the debtor’s code-number, if any; and

(c) the required date or dates.of publication.-10.. (1) If a typographical error occurs in the Gazette, it is

rectified as soon aspossible by a correcting notice without' charge to the ministry or department concerned, subject tothefollowing conditions— _ .

(a) that such error is reportedto the editor within thremonths from the date of publication; and ==

(b) that the relevant copy, upon re-examination, is_ proved to beabundantly clear; and

(c) that the correction of such error is legally necessary;(2) Ifadrafting error is not detected before publication,
