THE Eastei Vacation of tlle High Court shall commence onSaturday, the 6th April, 1974, and shall terminate on Tuesday,the 23rd April, 1974, b0th days inclusive.

During this period the trial of criminal cases and the hearingof criminal appeals will take place as usual.

A Judge will hear urgent civil matters if admitted to hearingon application made in accordance with the Rules of Court.

During the vacation the ofùces of the Hj h Court, elsewherethan at M ombasa, shall be open to the pubhc from 8.45 a.m. to12 noon al1 week-days other than public holidays.

During the vacatipn the omces of 'the High Court at M ombasashall be open to the public from 8 a.m. to 11.45 a.m. on a11weebdays other than public holidays.All courts shall be closed on public holidays.

The Courts and olces of the Senior Resident M agistrates,Resident Magistrates, Kadhis and District Magistrates will beopen during the usual hours for Government Departments ineach province.

The Claimants took up the matter on his behalf and havechallenged the validity of the Respondents' action in terminatingthe services of their member M r. Awidha on the grounds ofredundancy without the prior approval of the lndustrial Courtas required under the provisions of the Trade Disputes Act.They reported a dispute with the Respondents on this groundto the Minister for Labour.

During the hearing the Claimants submitted that the wordd'reorganlzation'' which the Respondents had used in the letterof termination implied that there was redundancy. They sub-mitted that the Respondents had earlier issued a clrcular statingthat redundancy was contemplated and that Mr. Awidha wasin fact declared redundant.

The Claimants strongly refuted allegations of incompetencyand carelessness on the qart of Mr. Awidha and said that theRespondents were detennlned to get rid of bim at any cost.

The Respondents contended that they had been more thanfair with M r. Awidha and had given him more than enoughopportunities to improve on b0th his pefsonal conduct and onhis work but he had turned out to be a total disappointment tothose who had entrusted him with responsibility.

3, On 24th September, 1973, the Court received the Notilka-tfon of V spute Form <'A'' dated 1st August, 1973, duly signedby the part-les' representatives along wfth statutory certfscatesunder sections 9 (9) (e) and (/) signed by the Labour Commis-sioner and the M inister for Labour.Wilson Awidha starttd work with the Respondents on 13th

January, 1963, as a packing clerk at a salary of Sh. 210 p.m.plus free housing and on 28th October, 1970, he was promotedto the position of supervisor at a salary scale of f 600 by f40 tof I ,160 p.a. During the fntervening period he was promoted toother positions although a couple of warnings were given to himbut he was also commended for his good work and once wona prize of Sh. 100 for a sales development suggestion. In July,1969, when he was in sales department he narrowly escapedsummary dismissal whert a shortage of Sh. 829 was discoveredin his sales fgures. He pleaded for forgiveness and promisedto make good tlle shortage. Because of this fncfdent he wasretransferred from sales to production department.

There wtre a few other incidents also in which he wasadversely involved but the fact remains that he received as muchrecognition for his elorts as he was disciplined for his weak-nCSSCS.

On 11th September 1972, he was suspended from duty:ponding further investlgations on the allegation that he lladwrongfully consigned goods to Dar es Salaam and Kampala.He was, however, reinstated after the goods had been returned

' from tlleir respective wrong destinations unspoiled. The Res-ndents, zowever, suiered a tbtal loss of Sh. 11,87.8/30 inpo

freight charges. The Court has taken note of the fact that tlleCla'unants state that Mr. Awidlza was not responsible for thîsmixup and the subsequent loss.Oa 13th M arch, 1973, Mr. Awidha received another letter of

warning. regarding an incident when it was alleged he interferedwith an Inspector/checker bn his oëdal duties and man-handled him. lt was alleged that he was also very discourteousto the Production Manager who inquired into the incldent.

Ol1 23rd March 1973, he was again susqended from dutybecause serious dlscrepancies and irregularitles hâd come tolight when a physical check of goods against packing slipNo. 117022 dated X nd M arc:, 1973, was carried out. He wassuspended pending the General Manaler's return from Mombasaand was told to make himself readlly available should he berequired to answere any queries.

On 30th March, 1973, he received the following letter : -ieAs a result of reorganization, which is very much overdue

within the productioa department, it has been decided thatthe company will no longer require your services from 31stMarch, 1973. '

The Respondents strongly denied that Mr. Awidha had beendeclared redundant and emphasized that they had used theword fTreorqanizatioa'' in his letter of tenninatlon so as not toprejudice ius chances of securing othèr employment. Theyointed out that Mr. Awidha's job has not been abolished and?ls to be filled in the near future.

For the aforesaid reasons they asked the Court to uphold thejustisable dismissal of Mr. Awidha.The Court notes that the Claimants' action is based on the

argument that M r. Awidha was declared redundant and sinceIndustrial Court's permission was not sought the redundancy isunlawful.

The Court, however, is satissed on the submissions and theevidence tendered during the hearing that Mr. Awidha was notdeclared redundant. The' Claimants' argument, that because M r.Awidha's services were tenninated due to reorganization there-fore this must be a case of redundancy, is not sound. If re-organization ls accompanied by or results in the reduction ofstac tllen it would be redundancy, but reorganization can alsobe carrled out whhout reducing staF.

The Court finds that the Respondents were motivated in usingthe word reorganization in order not to spoil M r. Awidha'schances of getting other employment.

As far as the reasons for the termination of Mr. Awidha areconcerned, they are not very relevant in view of the line ofaction that the Claimants have pursued. Further the issue indispute is clear in that it is wrongful redundancy of M r. W ilsonAwidha (Foreman).

The Court would like to record that it is satissed on thematerial before it that the Respondents had suëciently soundreasons for terminating the services of M r. Awidha.

The Court, while conhrming that Mr. Awidha ' is entitled tobne month's notice and a11 other benefits due to him, rejectsthe Claimants' demands asking for his reinstatement.

the area of the land ff used for shop and/or oKce purposesonly or such lesser area of the land as may be laid down bythe local authority in its by-laws, and not' more than 50 percentum of the area of the land lf used for combined purposesof shops, oëces and flats or such lesser area ' as may be laiddown by the local authority in its by-hws.7. The land shall not be uscd for the purpose of any trade

or business which the Commissioner of Lands considers to bedangerous or ofensive.

8. The grantee shall not subdïvide the land.9. The grantee shall not sell, transfer, sublet, charge or part

with thc possession of the land or any part thereof or anybuildings thereon except with the prior consent in writing of tllePresident ; no application for such consont (except in respectof a loan required for building purposes) will be considereduntil Special Condition No. 2 has been performed. ' '10. The grantce shall pay to the Commissioner of Lands on

demand such sums as the Commissioner may estimate to be theproportionate cost of constructing al1 roads and drains andsewers serving or adjoining the land and shall on completion ofsuch construction and the ascertainment of the actual propor-tionate cost either pay (within seven days of demand) or berefunded the amount by whicll the actual proportionate costexceeds or falls short of the amount paid as aforesaid.

General Conditlons1. Tho ordinary conditions applicable to township grants of

this nature except as varied hereby slmll apply to this grant.2. The grant will be myde under the provlsions of the

Govermnent I-ands Act (Cap. 280 of the Laws of Kenya), andtitle will be issued under the Registration of Titles Act (Cap.281).3. The grant will be fssued fn the name of thc allottee as

stated in the letter of application.4. Tho term of the grant will be for 99 years from the ârst

day of the month following the notiflcation of the approval ' ofthe grant.5. Each allottee of a plot shall pay to the Commissioner of

Lands within 14 days of notifcation that lds application hashcen approved, the initial estimated amount for the constructionof roads and drains to servo the plot, the assessed stand premiumand the proportion of the annual rent together with the legalfees payable in respect of the preparation and registration ofthe grant (Sh. 225) and the stamp duty in respect of the grant(apgroximately 2 per cent of the stand premium and annualrent). In default of payment within the specified time, theCommissioner of Lands may cancel tho allocation and theapplicant shall have no further claim to the grant of the plot.

THE KEN YA GAZERVE

1. No buildings shall be erectcd on the land nor shall addi-tions or external alterations be made to any buildings otherwisethan in conformity with plans and spccmcations previouslyapproved in writing by the Commissioner of Lands and thelocal authority. The Commissioner shall not give his approvalunless he is satisfied that the proposals are such as to developtlle land adequately and satisfactorily.2. The grantee shall within six months of the commencement

of the term submit in triplicate to the local authority and theCommissioner of Lands plans (including block plans showingthe positions of the buildlngs and a system of drainage for thedisposal of sewage, surface and sullage water), drawings, eleva-tions and specilications of the buildings the grantee proposes toerect on the land and shall within 24 months of the commence-ment of the term complete the erection of such buildings andthe construction of the drainage system in confonnity with suchplans, drawings, elevations and specifications as amended (ifsuch be the case) by the Commissioner :Provided that notwithstanding anything to the contrary con-

tained in or implied by the Government Lands Act (Cap. 280),if default shall be made in the performance or observance ofany of tho requirements of this condition it shall be lawful forthe Conimissioner of Lands or any person authorized by himon behalf of the President to re-enter into and updn the landor any part thereof in the name of the whole and thereuponthe term hereby created shall cease but without prejudice to anyHght of action or remedy of the Presidcnt or the Commissionerin respect of any antecedent breacll of any conditions hereincontained.

3. The grantee shall maintaln in jood and substantial repafrand condition all 'buildings at any tune erected oil the land.4. Shotzld tlze grantee give notice ln writing to the Commis-

sipner of Lands that he/she/they is Jare unable to cqmplete thebuildings within the period aforesaid, the Commlssloner ofLands shall (at the grantee's expense) accept surrender of thehnd comprised herein )Provided further that if such notîce as aforesafd shall be

givolt (1) within 12 months of the commencement of the term,the Commissioner of Lands slmll refund to the grantûe 50 percentum of the stand premium paid in respect of the land, or(2) at any subsequent tlme qrlor to the expiratîon of the saïdbuilding period, the Commissloner of Lands shall refund to thegrantee 25 per centum of tlle said stand premium . In the eventof notice being given after ' the expiration of the said buildingperiod, no refund shall be made.

13. The grantee shall pay such rates, taxes, charges, dutfes,assessmcnts or outgoings of whatever description as may beimposed, charged or assessed by any Government or localauthority upon the land or the bulldings erected thereon, includ-ing any contributfon or other sum paîd by the President in lieuthereof.

14. The President or such person or autkority as may beappointed for the purpose shall have the rirht to enter upon tlleland and lay and have access to water mains, service pipes anddrains, teleplzone or telegraph wires and electric mains of alldescriptions whether overhead or underground, and the granteoshall not erect any buildings in such a way as to cover orinterfero with any existing alignments of main or service pipesor telephone or telegraph wires and electric mains.

15. The Commissioner of Lands reserves the right to revisethe annual ground rental payable hereunder after the expirationof the 33rd and 66th year of the term hereby granted. Suchrental will be at a rate of 4 per cent of the unlmproved freeholdvalue of land as assesaed by tlle Commissioner of I-antls.
