PREFACE

This Construction Industry Standard (CIS) hereby referred as CIS 27: 2019 was developed asOccupational Safety and Health : Specification and Bill of Quantities (BQ) for Construction Worksby the Construction Industry Development Board (CIDB)Malaysia which acted as amoderator andfacilitator for the technical committee throughout the development process of this standard.

This CIS 27: 2019 Occupational Safety and Health : Specification and Bill of Quantities (BQ) forConstructionWorksadoptseveral componentswith reference toOccupationalSafetyandHealthActandRegulations(OSHA1994),FactoriesandMachineryActandRegulations(FMA1967),ConstructionIndustryDevelopmentBoardAct520,CIS15:2019GuidelinesofPreventionofFallatConstructionsSite, Guideline for Public Safety and Health at Construction Sites 2007 etc. The Specification andBillQuantities (BQ) proposed in thisCIS 27 : 2019may be adopted in total or in part and addition/omissionmay be effected to suit the project needs.

SECTION 1: GENERAL

1.1 Scope

TheConditionsofContractfortheWorkswhichisembodiedinanyFormofContractshallbereadinconjunctionwiththisSpecification.AcopyoftheFormofContractisavailableforinspectionontheTenderTableDocumentonanyworkingdaywithin the timestipulated for receiving tenders. If thetenderersconsiderthatanyoftheclausesofthecontractinvolvesexpenses,thetenderersshallallowforthemoneyvalueofsuchclausesinthetender.

TheWorkscoveredinthecontractcomprisetheprovisionbytheContractorathisownriskandcostofallmaterials,scaffolding,tools,plant,labour,transport,water,lightandeverythingelsenecessaryfortheconstructionandcompletionoftheproject.

AlltotheentireapprovaloftheSuperintendingOfficer/ProjectDirectorhereinafterreferredtoastheS.O/P.D.

SECTION 2: OCCUPATIONAL SAFETY AND HEALTH SPECIFICATION FOR CONSTRUCTION WORKS

2.1 Duty of Contractor

TheContractorisresponsibletoregisterabuildingconstructionworkswithcontractperiodofmorethanSix(6)weekstotheDepartmentofOccupationalSafetyandHealth.TheregistrationmustbecompletedwithinSeven(7)daysafterthecommencementofWorksincompliancewithSection35,FactoryAndMachineryAct1967(Revision1974).

Generaldutyofcontractorshallincludebutnotlimitedtothefollowing:

(i) TonotifyconstructionworkswithDOSHwithinseven(7)daysofsiteposessionforprojectwithcontractperiodofsix(6)weeksandmore.

(ii) Toprovideandmaintainasafeplantandsystemofwork.

(iii) Tomakearrangementsforhandling,usage,transporting,andstorageofsubstances.

(iv) Toprovidesafetyandhealthinformation,instruction,trainingandsupervision.

(v) Toprovideandmaintainsafeaccessandegressatworkplace.

(vi) To provide andmaintain a safe and healthyworking environment including adequatewellfarefacilities.

(vii) To establish aSafety andHealth committee at thework placewho is responsible toconductaminimumofone(1)meetingforaeverythree(3)months.SuchrequirementisapplicableforWorkswhichemploysmorethan40personnelon-sitefortheWorks.

(viii) ToensureallconstructionpersonnelatConstructionworksiteholdingavalidCIDBGreenCard.

(viiii) Toprovideandmaintainsafetyprovisionfortheiremployeesincludingthesubcontractorsandothers.

2.2 Safety And Health Plan (S&H Plan)

TheContractorshallpreparetheSafetyandHealthPlanasfollows:

(i) Fulfilment of all safety and health requirement during the construction works whichincludesplanning,managingandmonitoringplanthatenablestheWorkstobepracticallycommencewithoutanypotentialrisktosafetyandhealth;

(ii) Fulfilment all the requirement, pre-construction information and any other informationprovidedbytheOwner;

(iii) Scheduledplan forprojectupdate, review, reviseand refineof theSafetyandHealthPlaninconsistentwiththeprogressoftheWorksandminimizingthepotentialsafetyandhealthrisk;

(iv) ArrangementforS&HPlantobepracticallyimplementedacrossallpersonnelcarryingouttheconstructionworkandallpersonswhomaybeaffectedbytheWorks;

(v) Reasonablemeasures to identifyall potential safetyandhealth risksarising from theconstructionwork(includingtherisksspecifictotheparticulartypeofconstructionworkconcerned);

(vi) Suitable and sufficientmeasure for riskmitigation that includes provision of any siteSafetyandHealthrules.

TheContractorshallsubmitfive(5)copiesofthepreparedSafetyandHealthPlantotheS.O.ortheclientrepresentative(eachcopyforS.O/P.D,HeadofProjectTeamandSiteOffice)beforetheprojectcommencesandupdateittotheS.O.ortheclientrepresentativethroughouttheconstructionworks.AcopyoftheupdatedSafetyandHealthPlanshallbekeptatsite.

SafetyandHealthPlanshallincludethefollowing:

(i) Project Introduction and Scope of Works (as in Works Programme or Critical PathMethod)associatedwithOccupationalSafetyandHealth(OSH).

(ii) Contractor’s Authorized and Updated OSH Policy, Drug and Alcohol Policy; OSHpromotional activities and campaign that carried out to meet Client’s Objective andTargets.

(iii) Contractor’sOrganizationChartandSafetyandHealthCommittee(SHC)Chartwhichshall describing the staff involved (example: Employer, Project Manager, SafetyAndHealth Practitioner, Foremen, Designated Person / Person In Charge / CompetencePerson,Sub-Contractor,Supplierinvolved,SecurityOfficer,Visitors,etc.)

(iv) Arrangementofcommunication,consultationand involvementofeachmemberof theContractor’s project team as shown in the Item 6.3 (iii), including their relationship,interfacingsandcooperationofworkmenforsuccessful implementationof theproject.TheplanningshalltakeintoaccountcontrolofanyOSHCommunications(ToolboxTalkandSafetyMeeting),OSHrelatedcomplaints,advice,OSHprogrammesandawareness,SHCmeetings’schedule,andsolvingOSHrelatedissues.

(v) Contractor’sAuthorisedUpdatedComplianceListonOSHLegislationandOtherRelatedRequirements.

(vi) ListofProhibitedfoodsanddrinksincludingdrugsandmedicine.

(vii) ListofSafetyandPersonalProtectiveEquipmentatrequiredatworkplace.

(viii) ScheduleofOSHTrainingsandProgrammestoallworkmenincludingsub-Contractor:Safety andHealth Induction,CIDBGreenCard, FirstAid,Housekeeping,Working atHeight, Manual Handling, Vector Control, Health & Hygiene Program Site SafetyInspectionandAudit,ProvisionofInformation(poster/pamphlet/noticeboard).

(ix) EmergencyResponsePlan:Emergencyroutesandassemblypoint,emergencycontactlist,evacuationdrill,emergencyrespondteam,facilitiesandwelfares,andemergencyevacuationplan.

(x) SafeWorkSystemonTemporaryElectricity InstallationWorks.Thespecificationmustincludeadesignatedpersonincharge,approvedlistofmaterialsused,referencesandadvisedbyTNBorotherauthoritiesasacasemaybe(ifnecessary)onprohibitionondangerorillegalinstallation.

(xi) SafeOperationalProceduresformethodofstatementsforthefollowingnatureofworks:

a. Stabilityofstructureswhilst carryingoutconstructionwork, including temporarystructuresandexistingunstablestructures,

b. Preventingfalls,

c. Workwithornearfragilematerials,

d. Controlofliftingoperations,

e. Themaintenanceofplantandequipment(asinterpretbyOSHA1994),

f. Workonexcavationsandworkwheretherearepoorgroundconditions,

g. Workonwells,undergroundearthworksandtunnels,

h. Workinvolvingexplosives,

i. Masonryworks,

j. Servicesworks.

(xii) Format of Incident investigation (nearmiss, dangerous occurrence, accident, fatality,occupationalpoisoningandoccupationaldisease).

(xiii) Format ofSafety andHealthPerformanceand IncidentStatistics.DailyReporting onIncidentStatistic.

(xiv) ChemicalSafetyDataSheetsorMaterialSafetyDataSheets.

(xv) HealthPrecautiononworkmen:MedicalReport(HealthSurveillance),noisemonitoring.

(xvi) ProvisionofWelfareFacilities(Sanitationforworkmen).

(xvii) ProvisionofSafetySignageandTrafficControl.

(xviii) ProvisionofProjectHazardIdentification,RiskAssessmentandRiskControl(HIRARC).

S&HPlanshallbepreparedandreviewedbyProjectManagerandapprovedbyProjectDirectorwiththedateandversiononthecoverpage.ItcanbepreparedinBahasaMalaysiaorEnglish

2.3 OSH Personnel

TheContractorshallemploysafetypersonnelsuchasSHO/SSS/CSS/DP(asthecasemaybe)asperrequirementoftherelevantAct/RegulationsunderthejurisdictionofDOSH.

a) SafetyandHealthOfficer

(i) ForaprojectvalueofmorethanRM20million,theContractorshallemployafulltimecompetentpersontoactasaSafetyandHealthOfficerattheplaceofworkthroughouttheentirecontractperiod.

(ii) TheSafetyandHealthofficershallbeemployedexclusively for thepurposeofensuringthedueobservanceoftheprovisionsoftheActattheplaceofworkandanyother regulationmade therein including thepromotionof a safeworkplaceconduct.

(iii) The Contractor shall comply with Occupational Safety and Health (Safety andHealthOfficer)Order 1997,Order I and II on any contract value that exceedsRM20millionorwithhighrisk.AsstipulatedinthisOrder,theMainContractor(s)shallensuretheirsub-Contractor(s)employaSafetyandHealthOfficer(SHO).

b) Site Safety Supervisor

SiteSafetySupervisor(SSS)tobestationedminimum15hoursaweekthroughouttheentireperiodoftheconstructionworks.

c) Contractor Safety Supervisor

EverySubcontractor inchargeofworksitewhoemploysmorethan20personsshallappointContractorSafetySupervisor(CSS)tobestationedminimum5hoursaweek.

d) Designated person

ContractorshallappointdesignatedpersoninaccordancetotherequirementofFactoriesandMachinery(BOWEC)(S)1986Regulations.

2.4 Safety And Health Committee

TheContractorshallestablishasafetyandhealthcommitteeattheplaceofworkif-

(i) Therearefortyormorepersonsemployedattheplaceofwork;or

(ii) TheDirectorGeneraloftheDepartmentofOccupationalSafetyandHealthdirectstheestablishmentofsuchacommitteeattheplaceofwork.

Thecompositionofasafetyandhealthcommitteeestablished,theelectionorappointmentofpersonstothecommittee,thefunctionofthecommittee,thepowersofthemembersofthecommitteeandanyothermatterrelatingtotheestablishmentorprocedureofthecommitteeshallbeasprescribedinPARTIIoftheOccupationalSafetyandHealth(SafetyAndHealthCommittee)Regulations1996.

2.5 Safety And Health Training

Programsfortheeducationandtrainingofemployeesintherecognition,avoidanceandpreventionofunsafeconditionsinemploymentscoveredbytheOccupationalSafetyandHealthAct1994(Act514)andFactoriesandMachineryAct1967(Act139)andotherrelevantregulationsshallbeestablishedandimplemented.

EveryconstructionpersonnelworkingatsitearerequiredtoobtainCIDBGreenCardbyattendingtheCIDBS&HInductionCourse.

Allconstructionpersonnel,Visitors,Vendors&Suppliersenteringworksiteare:

(i) Required to attend Site Safety Induction courses if required to enter an operationalconstructionzone;

(ii) Shallbeaccompaniedbycompanyappointedsitepersonnelwhileonthesite.

2.6 HazardsIdentificationRiskAssessmentAndRiskControl(HIRARC)

TheContractor shall identify potential hazards to employees or, assess their risk, or likelihood ofhappeningandtheeffectstheywouldhave,andthetakingofnecessarycontrolmeasuresforsuchhazards.

RecordsofHIRARCshallbekept,maintainedandsubmittedtotheS.O/PDpriortocommencementofthework.HIRARCmaybereviewedduringthecourseofworkasrequired

ThemethodologyproposedintheCIS25:2018GuidelinesforConstructionActivityRiskAsessment(CARA-HIRARC)publishedbyCIDBMalaysia.

2.7 Safety And Health Performance Report

Five(5)copiesmonthlysafetyandhealthperformancereportshallbepreparedandsubmitedtotheS.O.Thereportshallalsodescribethefollowings:

(i) Related OSH programme (toolbox meeting/ training/ drill/ inspection/ induction/housekeeping/audit/legislationcomplied/etc).

(ii) Incidentstatisticfromdailynotificationofanyaccidents,nearmisses,losttimeinjuries,death and ill-health with actions taken; in accordance with Occupational SafetyAndHealth (Notification ofAccident, DangerousOccurrence,Occupational Poisoning andOccupationalDisease)Regulations2004.

(iii) RelatedOSHissuesoncomplaints/Non-compliance/damagesandactionstaken.

(iv) StatusonS&HPlanandHIRARC.

(v) CIDBGreenCardrecords/Machineriesregisterandmaintainancerecords.

(vi) Trafficandotherrelatedsafetycontrol.

Provisionandmaintenanceofsafetyandhealthstatisticscoreboardshallbeprovidedtoensurethatpersonsatsiteareatleastinformedaboutthesafetyandhealthactivities.Theboardsshallbelocatedattheentranceofsiteoffice/workplaceorpracticablelocations.

2.8 Safety And Protective Equipment

Employeesarerequiredtowearappropriatepersonalprotectiveequipment inalloperationswherethereisriskofexposuretohazardousconditionsasperapprovedHIRARC.

ProvisionandmaintenanceofPersonalProtectiveEquipmenttoemployeesandsitestaffatsiteofadequatequantityandshallmeettherequirementsandspecificationsasapprovedbyS.O/PD.Theequipmentshallincludebutnotbelimitedtothefollowing:

(i) FootProtection

(ii) Safetyhelmets

2.9 Health and Welfare Provision

To conduct Health Measurements (if necessary) by designated / competent person (example:OccupationalHealthDoctor/MedicalPractitioner).MedicalReport(MedicalSurveillance)ofworkmentoberecordedbytheContractor(employer/self-employedperson)fortheWorksexposedtochemicalsand hazardousworking area as listed inOccupational Safety andHealth (Use andStandards ofExposureofChemicalsHazardoustoHealth)Regulations2000.

Firstaidfacilities

(i) TheContractor shall require to provide and properlymaintained a completeFirst aidfacilitiesandprovisionsformedicalcareavailableforeveryemployeeperformingworkatthesitewhichincludeprovisionoffirstaidkitandfirstaiderthroughoutthecontractperiod.

(i) Regulations prescribing specific requirements for first aid inFactories andMachinery(Safety,HealthandWelfare)Regulations1970shallbefollowed.

TheContractormustrefrainfromdumpingor/anddepositing(thatcapableofcollectingwater)whichafford breeding places for mosquitoes (including houseflies, rats, insects and other dangerousanimals).Allexcavationandanyportionofthesitewherewaterstagnatesoraccumulatesshallbekeptdrybypumping,bailingorotheroperations(vectorcontrol).ThecontractorshallpayallchargesasmayberequiredbytheMOH/LocalAuthorityandemploywhateverdestructivemeasuresasarenecessaryentirelyathisowncostandexpense

All Work shall be carried out without unreasonable noise and dust suppression. The Contractorshall takingmeasures to ensure that all equipment,machinery and place ofWorks are in properworkingconditionsoastominimizetheamountofnoisegeneratedanddustsuppression.Wheneverhazardoussubstancessuchasdusts,fumes,mists,vapours,orgasesexistorareproducedinthecourseofconstructionwork,theirconcentrationsshallnotexceedthelimitsspecifiedintheAct.TheS.O/P.DmayrequiretheContractortoreplaceanymachineryandequipmentaswellasmethodofstatementsthattohisdiscretion,isemittingexcessivenoiseanddust.

Construction areas shall be lighted to not less than the minimum illumination intensities as perregulation29FactoriesandMachineryAct1967.Emphasisshallbegiventostairways,accessesandemergencyescaperoutes.

TheContractorshallprovideandmaintaintemporaryaccommodationinaccordancetoMS2593:2015-Temporaryconstructionsiteworkers’amenitiesandaccommodation–Codeofpractice.

TheContractorshallprovideandmaintaineddesignatedrestarea/areasforworkersandsitestaff.Theareasprovidedshallbesafe,ventilatedandlighted.

The Contractor shall provide adequate temporary toilet and bathing place with necessary water,septictankanddrainageinaccordancetoRegulation37SHWelfareRegulationsunderFMA1967,DepartmentofEnvironment(DOE)or/andLocalAuthorityrequirements. Itshallbemaintained inacleanandsanitaryconditionatalltimestothesatisfactionoftheS.O/P.D/MOH/LocalAuthority.Allwastewatermustbetreatedsuchthatitseffluentmeetstherequirements.

2.10 Safe Working Area

Allow for compliance with Guidelines for Public Safety in Construction published by DOSH. TheContractorshallstoreorstackatalltimes,allmaterials,tools,etcaslistedbelowinasafeandorderlymannersoasnotobstructanypassagewayorplaceofwork.

(i) Shedforstorageofcementwiththefloorraised300mmabovetheground.

(ii) Shedforbar-bendingandsimilarWorks

(iii) Storeforchemical/hazardoussubstance

(iv) Storeforotherbuildingmaterials

TheContractorshallsupply,erect,maintaintheperimeterhoardingtoensurepublicsafety.

Erection,dismantling,alterationandmaintenanceofscaffoldingshallcomply toBS1139MS1462,workingplatformandsafetynettingsshallbeunderthesupervisionofthecompetentperson.

Catchplatformshallbedesignedbyprofessionalengineerwithpractisingcertificate(PEPC)whereitinvolveddemolitionofstructureorotherrelatedexteriorworksatmorethan12mheight.

Contractorshallerectandmaintainoverheadprotection/fencing/guardrails/safetyscreen/wirenetting/toeboard/safetybarricadestoensuresafeworkingenvironment.

Contractor shall providepersonal fall arrest systemsasper requiredunder theGuidelines for thePreventionofFalls atworkplaces2007 issuedbyDOSH.Provision,maintenanceand removal ofguardrailsorboard fencesand temporary footwalkswithadequateoverheadprotection forpublicwalkwaysandthoroughfares(pleasedeletewherenotapplicable)duringtheworks.

Cordoningoffworkingareaandprovisionofpubliccontrolandsafetymeasureswhereliftingoperations,moving,shifting,transferringworksarecarriedoutoutsidethehoardedupareaoftheworksite.

2.11 TrafficManagement

Provisionof traficmanagementplan, trafficmanagement safety report andadequate safety trafficwarningsignages,warninglights,flagmenshallcomplytoNotaTeknikJalanJKRNo.23/2003,ArahanTeknikJalan2C/85tobeprovidedandmaintainedbydesignatedpersonatsuitablelocationsforworkplaceincloseproximityofpublicthroughouttheentireperiodofconstructionworks.

2.12 Special Working Conditions

Specialattentionshallbegiventothefollowingworkingconditionbythecontractor:

(i) Working in confined space shall comply with the requirements of Industry Code ofPracticesforSafeWorkinginaConfinedSpace,2010,OccupationalSafetyandHealthrequirementsstatedinlaws,regulationsincludinganyrevisionstothecurrentregulations.

(ii) ForworkingatheightContractorshallcomplytherequirementofCIS15:2019GuidelinesofPreventionofFallatConstructionsSite.

(iii) Allexcavationworksshallcomplywith theprovisionofPARTXIIof theFactoriesandMachinery (Building Operation and Works of Engineering Construction) (Safety)Regulations,1986.

(iv) All demolitionworks shall complywith theprovisionofPARTXI of theFactoriesandMachinery (Building Operation and Works of Engineering Construction)(Safety)Regulations,1986andtheMS2318:2010DemolitionofBuildings-Codeofpractice.

(v) All blasting works shall comply with the provision of PART XV of the Factories andMachinery (Building Operation and Works of Engineering Construction)(Safety)Regulations,1986,Act207ExplosiveAct1957andotherregulatoryrequirements

(vi) WorkingOverorNearWater

a) Employeesworkingoverornearwater,wherethedangerofdrowningexists,shallbeprovidedwithapprovedlifejacketorbuoyantworkvests.

b) Priortoandaftereachuse,thebuoyantworkvestsorlifepreserversshallbeinspectedfordefectswhichwouldaltertheirstrengthorbuoyancy.Defectiveunitsshallnotbeused

c) Ringbuoyswithat least27.5metreof lineshallbeprovidedandreadilyavailable foremergencyrescueoperations.Distancebetweenringbuoysshallnotexceed61metre.

d) Atleastonelifeboatshallbemadeavailableatlocationswhereemployeesareworkingoveroradjacenttowater.

2.13 Access and Egress

TheContractorshallprovideallnecessarypersonnelandlightingforthesecurityofthesiteatalltimesuntilcompletionofthewholeWorks.

Ineverybuildingorstructureentranceandexitsshallbesoarrangedandmaintainedastoprovidefreeandunobstructedaccessandegressfromallpartsofthebuildingorstructureatalltimeswhenit isoccupied.No lockor fastening toprevent freeescapefromthe insideofanybuildingshallbe

Exits shall be marked by a readily visible sign.Access and egress to entrances and exits shallbemarkedbyreadilyvisiblesigns inallcaseswheretheentranceorexitorwaytoreach it isnotimmediatelyvisibletotheoccupants.

Meansofaccessandegressshallbecontinuallymaintainedfreeofallobstructionsorimpedimentstofullinstantuseinthecaseoffireorotheremergency.

2.14 Plant and Machinery

TheContractorshallensurethefollowingplantsobtainavalidcertificationwhicharedeemedtobeincompliancewiththerequirementsbytheDepartmentofOccupationalSafetyandHealthMalaysiabeforetheyarebeingputintooperation:
