Whereas the purpose of the Petroleum Products Pricing Regulations is to ensure just and reasonable prices forspecified petroleum products taking into consideration the objectives of preserving the availability of suchproducts in rural areas, stabilizing prices of such products and minimizing the variances in prices of suchproducts across the Province;

And whereas the Nova Scotia Utility and Review Board (“Board”) considered the manner in which it wouldproceed to set petroleum product prices in its decision, 2006 NSUARB 108, issued on October 16, 2006;

And whereas the Board revised the retail margin and transportation allowance effective January 6, 2012, in itsdecision, 2011 NSUARB 181, issued on November 23, 2011;

And whereas the Board revised the wholesale margin effective January 4, 2013, in its decision, 2012 NSUARB213, issued on December 12, 2012;

And whereas the average of the average of the daily high and low reported product prices (in Canadian cents)for the week ended September 7, 2016, are:

Grade 1 Regular gasoline 48.1¢ per litreUltra-low-sulfur diesel oil 47.5¢ per litre

Now therefore the Board prescribes the benchmark prices for petroleum products to be:

Gasoline:Grade 1 48.1¢ per litreGrade 2 51.1¢ per litreGrade 3 54.1¢ per litre

Ultra-low-sulfur diesel oil 47.5¢ per litre

And now therefore the Board has determined, based on historical data regarding price changes and to achieverevenue neutrality, it is appropriate to apply, and the Board so orders, forward averaging corrections of:

Ultra-low-sulfur diesel oil: minus 0.2¢ per litre

And whereas a winter blending adjustment of plus 1.1¢ per litre is required for ultra-low-sulfur diesel oil;

And now therefore the Board prescribes the prices for petroleum products as set forth in Schedule “A”effective on and after 12:01 a.m., September 9, 2016.

Environmental Assessment Regulations;Solid Waste-Resource Management Regulations

Order dated September 13, 2016Amendment to regulations made by the Governor in Council

pursuant to Sections 49 and 102 of the Environment Act

The Governor in Council on the report and recommendation of the Minister of Environment dated June 22,2016, and pursuant to Chapter 1 of the Acts of 1994-1995, the Environment Act (the Act) , is pleased, effectiveon and after September 13, 2016, to

(a) pursuant to Section 49 of the Act, amend the Environmental Assessment Regulations, N.S. Reg. 26/95,made by the Governor in Council by Order in Council 95-220 dated March 21, 1995, to provide additionalregulatory clarity to the environmental assessment process for incinerators and thermal treatment facilitiesin the manner set forth in Schedule “A” attached to and forming part of the report and recommendation;and

(b) pursuant to Section 102 of the Act, amend the Solid Waste-Resource Management Regulations, N.S. Reg.25/96, made by the Governor in Council by Order in Council 96-79 dated February 6, 1996, to provide forthermal treatment facilities, in the manner set forth in Schedule “B” attached to and forming part of thereport and recommendation.

Schedule “A”

Amendment to the Environmental Assessment Regulations made by the Governor in Council under Section 49

of Chapter 1 of the Acts of 1994-95, the Environment Act

1 Schedule A to the Environmental Assessment Regulations, N.S. Reg. 26/95, made by the Governor inCouncil by Order in Council 95-220 dated March 21, 1995, is amended under the heading Class IUndertakings by adding the following item immediately following item E.2:

3. A thermal treatment facility as defined in the Solid Waste-Resource Management Regulations madeunder the Act.

2 Schedule A is further amended under the heading Class II Undertakings by repealing item C.1. andsubstituting the following item:

1. An incinerator as defined in the Solid Waste-Resource Management Regulations made under theAct.

Schedule “B”

Amendment to the Solid Waste-Resource Management Regulations made by the Governor in Council under Section 102

of Chapter 1 of the Acts of 1994-95, the Environment Act

1 Section 2 of the Solid Waste-Resource Management Regulations, N.S. Reg. 25/96, made by the Governorin Council by Order in Council 96-79 dated February 6, 1996, is amended by

(a) striking out the clause letter before each definition;

(b) amending the definition of “incinerator” by

(i) striking out “the primary purpose of”, and

(ii) adding “with or without energy recovery” immediately after “combustion”;

(c) adding the following definition where it belongs in alphabetical order:

“thermal treatment facility” means a facility for the thermal treatment of municipal solidwaste to produce liquid or gaseous fuels or energy, but does not include an incinerator;

2 Clause 12(1)(a) of the regulations is amended by

(a) striking out “and incinerators, covered in Schedule “B”, on or before the date the ban comes intoeffect” and substituting “, incinerators and thermal treatment facilities as listed in Schedule “B””.

[Note: there is no clause (b) in the document filed with the Office of the Registrar of Regulations.]

3 Section 30 of the regulations is amended by repealing subsections (1) and (2) and substituting thefollowing subsections:

(1) A person must not destroy or dispose of a designated material listed in Schedule “B” in alandfill, incinerator or thermal treatment facility.

(2) A person, including a municipality, must not accept a designated material listed in Schedule“B” for destruction or disposal in a landfill, incinerator or thermal treatment facility.

4 The regulations are further amended by repealing Schedule “B” and replacing it with the followingSchedule “B”:

Amended Order

Whereas on November 23, 2015, the Board issued an order to the Municipality of the District of St. Mary’s(“Municipality”) approving the polling district boundaries for seven polling districts;



And whereas on September 2, 2016, Marvin MacDonald, CAO of the Municipality, requested an amendedorder to correct boundary descriptions submitted to the Board on January 29, 2015, and forming part of theBoard’s order of November 23, 2015, and filed revised boundary descriptions;

It is hereby ordered that the boundaries of the seven polling districts are approved as set out in Schedule “A”,attached to and forming part of this order;

And it is further ordered that all provisions of the Municipal Government Act and the Municipal Elections Actand any other Acts of the Province of Nova Scotia applying to the preparation for and holding of the regularelection of councillors of the Municipality in the year 2016 will be complied with as if the above-noted changeshad been made on the first day of March, 2016, but for all other purposes, such changes shall take effect on thefirst day of the first meeting of the Council after the election of councillors for the year 2016.

4(c) Per current P5 policy for the 1c/4c Pricing Program for innovativeproducts, the price discounts for milk cream and manufactured dairyproducts are respectively 25% for the first 12 months, 15% for thesecond 12-month period and 10% for the third 12-month period. Thediscounts will be deducted off the appropriate P5 target classcomponent prices for approved products.
