INTRODUCTION

Development Ventures, Incorporated (DVI), an instrumentality of the Housing Authority of the

City of Durham, seeks proposals from interested firms to complete ALTA/ACSM Land Title

Survey and Boundary Surveys for up to fifteen housing developments located in Durham, North

Carolina. The firm shall complete the ALTA/ACSM Land Title Survey according to the 2011

Minimum Standard Detail Requirements for ALTA/ACSM Land Title Survey and the following

Optional Survey Responsibilities and Specifications:

Flood zone classification (with proper annotation based on federal Flood Insurance Rate

Maps or the state or local equivalent) depicted by scaled map location and graphic plotting

only.

Gross land area (and other areas if specified by the client).

Current zoning classification and building setback requirements, height and floor space area

restrictions as set forth in that classification, as provided by the insurer. If none, so state.

Observed evidence of site use as a solid waste dump, sump or sanitary landfill.

Location of wetland areas as delineated by appropriate authorities.

The work will be issued via task order. Task orders for each site will be issued separately. All

work is contingent upon funding.

Vendors must be willing to work/perform, services at all locations. Responses that do not

include prices for all locations and all services will be considered non-responsive.

Vendor will be selected based on the lowest total cost for all sites, services.

GENERAL PROPERTY DESCRIPTION

Brief descriptions of the sites are listed below:

Central Neighborhood

The site consists of four vacant parcels located in North East Central Durham at 1401, 1411 East

Main Street, 104 N. Blacknall (A & B), and 105 North Goley Street.

Club Boulevard

A multi-family development located at 2415 Glenbrook Drive comprised of 77 dwelling and one

non-dwelling building. The development consists of 77 units with bedroom distribution which

includes (54) three and (23) four bedroom units.

Cornwallis Road

A multi-family development located at 3000 Weaver Street comprised of 82 dwelling and one non-

dwelling building. The development consists of 200 units with bedroom distribution which

includes (20) one, (50) two, (76) three, (46) four, (6) five, and (2) six bedroom units.

Damar Court

A multi-family development located at 1002 Sherwood Drive comprised of 17 dwelling buildings.

The development consists of 102 units with bedroom distribution which includes (102) two

bedroom units.

Forest Hill Heights

An elderly development located at 700 South Mangum Street, comprised of eight dwelling and one

non-dwelling building. The development consists of 55 units with bedroom distribution which

includes (20) zero, and (35) one bedroom units.

Goley Phase

The site consists of nineteen vacant parcels located in North East Central Durham at 1402, 1404,

1408, 1504 East Main Street; 103, 105, 107, 109 South Blacknall; 1401, 1403, 1405, 1407, 1409,

1503, 1507, 1509 Angier Avenue; 107, 108 South Goley; and 106 North Goley.

Hoover Road

A multi-family development located at 1126 Hoover Road comprised of seven dwelling and one

non-dwelling building. The development consists of 54 units with bedroom distribution which

includes (21) two and (33) four bedroom units.

J. J. Henderson Housing Center

An elderly development located at 807 S. Duke Street, comprised of one nine story dwelling

building. The development consists of 178 units with bedroom distribution which includes (141)

zero and (37) one bedroom units.

Laurel Oaks

A multi-family development located at 600 Laurel Drive comprised of six dwelling and one non-

dwelling building. The development consists of 30 units with bedroom distribution which includes

(30) three bedroom units.

Liberty Street

A multi-family development located at 131 Commerce Street comprised of twenty-six dwelling and

one non-dwelling building. The development consists of 108 units with bedroom distribution

which includes (32) one, (47) two, and (29) three bedroom units.

Lincoln Apartments

The site consists of 16 vacant buildings located at 1102 Dayton Street, 1502, 1506, 1509 and 1512

Wabash Street; 1404, 1405, 1408, 1411, 1414, 1415, 1502, 1503, 1506, 1510 and 1515 Lakeland Street.

McDougald Terrace

A multi-family development located at 1101 Lawson Street comprised of 59 dwelling and one non-

dwelling building. The development consists of 360 units with bedroom distribution which

includes (59) one, (136) two, (100) three, (60) four, and (5) five bedroom units.

Oldham Towers

An elderly and disabled development located at 519 East Main Street comprised of one seven story

dwelling and one non-dwelling building. The development consists of 106 units with bedroom

distribution which includes (50) zero, (53) one, and (3) two bedroom units.

Oxford Manor

A multi-family development located at 3633 Keystone Place comprised of sixty-six dwelling and

one non-dwelling building. The development consists of 172 units with bedroom distribution

which includes (50) two, (34) three, (68) four, and (20) five bedroom units.

Scattered Sites

An elderly development located at 300 Gary Street comprised of 25 dwelling and one non-dwelling

building. The development consists of 50 units with bedroom distribution which includes (12) zero

and (38) one bedroom units.

Please utilize Exhibit 1 to provide pricing for each property.

TASK ORDER ISSUANCE PROCESS

1. DVI will issue a task order to the contractor. The task order will indicate the development,

the desired products to be delivered, and provide guidance on the anticipated period of

performance, including, any binding deadlines.

2. DVI and the contractor will execute the task order. Once the task order is executed by both

parties, the contractor may proceed with the requested work identified in the task order.

3. Upon execution of the task order, the contractor will have 30 days to complete the work, and

deliver the deliverables as indicated in the task order.

SCOPE OF WORK

1. After execution of the task order, the contractor has 30 calendar days to provide the services,

complete the work, and deliver the deliverables as indicated in the task order.

2. Complete the following:

a) An ALTA/ACSM Land Title Survey according to specifications consistent with the

Minimum Standard Detail Requirements for ALTA/ACSM Land Title Surveys.

b) A Boundary Survey.

3. The ALTA/ACSM Land Title Survey should include the following items :

Flood zone classification (with proper annotation based on federal Flood Insurance

Rate Maps or the state or local equivalent) depicted by scaled map location and

graphic plotting only.

Gross land area (and other areas if specified by the client).

Current zoning classification and building setback requirements, height and floor

space area restrictions as set forth in that classification, as provided by the insurer. If

none, so state.

Observed evidence of site use as a solid waste dump, sump or sanitary landfill.

Location of wetland areas as delineated by appropriate authorities.

4. The Boundary Survey should include, but not be limited to, the following items:

a) Property lines

b) Improvements with their current location and condition noted;

c) Legal Description;

d) Easements;

e) Setbacks;

f) Flood zone determination;

g) Comments and concerns that might affect the property; and

h) Physically permanently marking (staking) the property boundaries (monuments

placed at all major corners of the boundary of the property).

5. The Surveyor will provide DVI with three copies of preliminary plats for review of the

ALTA and boundary survey. If any discrepancies are uncovered, the surveyor will correct

any incomplete, inaccurate, or defective work, promptly without additional cost to DVI.

6. After approval by DVI, the Surveyor will file and record the ALTA/ACSM Land Title

Survey and the Boundary survey with the Durham County Register of Deeds office.

7. The response shall be inclusive of the cost to record and update the surveys, if requested.

DELIVERABLES

1. After final approval of the ALTA/ACSM Land Title Survey and Boundary Survey by DVI

and recordation, the surveyor will furnish the following for both the ALTA/ASCM Land

Title and Boundary Survey:

a) three (3) bound copies and two (2) CDs of the ALTA/ACSM Land Title Survey

according to the specifications outlined in the Minimum Standard Detail

Requirements for ALTA/ACSM Land Title Surveys and the additional items

specified;

b) three (3) hard copies (18” X 24”) and one (1) CD of the Boundary Survey

SCHEDULE AND REQUIRED INFORMATION

Interpretation: Questions about how to interpret this RFP may arise; and if so respondents should

submit questions by August 22nd, 5:00 p.m. via email to [email protected]. DVI shall respond

to all questions no later than August 26th, 5:00 p.m. via posting to the DHA website located at

www.durhamhousingauthority.org.

Request for Proposal Due Date: DVI requests sealed proposals by 2:00 p.m. EDT, on September

4, 2013 at 330 East Main Street, Durham, North Carolina. Late proposals will not be considered.

DVI’s Options: All submissions in response to this request shall become the property of DVI. The

attention of respondents is directed to the fact that the proposed work may be financed in whole or

in part with federal funds, therefore, all applicable federal statutes, rulings, and regulations,

including applicable prevailing wage rates will apply to such work. Final awards will be subject to

available funds. DVI will consider as NON-RESPONSIVE any Firm for which critical information

is lacking or whose submission represents a substantial deviation from the requirement of the RFP.

Withdrawal of Interest: Any Firm may withdraw his/her interest either personally or by written

request at any time prior to the scheduled closing time for receipt of proposals.

Contact with DVI Staff, Board and Residents: Any contact between respondents and DVI staff,

Board members, or residents during the selection process is disallowed, except as stated in the

Interpretation section above.

Personnel: The procured Firm will not be considered DVI personnel. DVI assumes the proposal

of certain personnel to be a statement of their availability to perform the work.

Miscellaneous: This RFP does not commit DVI to award a contract, pay any cost incurred in the

preparation of a response to this request, or to procure or contract for services. DVI reserves the

right to accept or reject any or all responses received as a result of this request, to waive any

informalities, to negotiate with qualified consultants, or to cancel in part or in its entirety the RFP if

it is in the best interest of the DVI.

Section 3 Requirements: All work under this RFP and any subsequent Agreement must comply

with Section 3 of the Housing and Urban Development Act of 1968 which applies to all contracts.

The selected contractor must comply with Section 3 regulations and requirements, regardless of the

dollar amount of the Agreement. To the greatest extent feasible, the successful vendor must provide

opportunities for training and employment to low income residents and business concerns in all

Section 3 covered projects. The U.S. Department of Housing and Urban Development (HUD)

regulations require that all Section 3 covered contracts include the entire Section 3 clause.

Contract Requirements

DVI will enter into a contract with the successful firm for the provision of environmental services.

All work products must be delivered in the appropriate form and number of copies. The requested

services are to be performed in support of DVI’s mission and in compliance with the requirements

of the designated housing program. All tasks will be executed in a manner consistent with relevant

federal, state, and local laws, the Code of Federal Regulations, and various HUD Handbooks and

Notices, as appropriate. Interested parties should submit a proposal to DVI which must be received

by the submission deadline stated in this Request for Quotes (RFQ). The selected firm shall agree

to comply and submit the following, as attachments, with the proposal:

Certification A: Certification Regarding Debarment, Suspension, andOther Responsibility Matters - Primary Covered Transactions

1. The prospective primary participant certifies to the best of its knowl-edge and belief that its principals;

a. Are not presently debarred, suspended, proposed for debarment,declared ineligible, or voluntarily excluded from covered transactionsby any Federal debarment or agency;

b. Have not within a three-year period preceding this proposal,been convicted of or had a civil judgment rendered against them forcommission of fraud or a criminal offense in connection with obtain-ing, attempting to obtain, or performing a public (Federal, State, orlocal) transaction or contract under a public transaction; violation ofFederal or State antitrust statutes or commission of embezzlement, theft,forgery, bribery, falsification, or destruction of records, making falsestatements, or receiving stolen property;

Instructions for Certification (A)

1. By signing and submitting this proposal, the prospective primaryparticipant is providing the certification set out below.

2. The inability of a person to provide the certification required belowwill not necessarily result in denial of participation in this coveredtransaction. The prospective participant shall submit an explanationof why it cannot provide the certification set out below. The certifi-cation or explanation will be considered in connection with thedepartment or agency’s determination whether to enter into thistransaction. However, failure of the prospective primary participant tofurnish a certification or an explanation shall disqualify such personfrom participation in this transaction.

3. The certification in this clause is a material representation of factupon which reliance was place when the department or agency deter-mined to enter into this transaction. If it is later determined that theprospective primary participant knowingly rendered an erroneouscertification, in addition to other remedies available to the FederalGovernment, the department or agency may terminate this transactionfor cause of default.

4. The prospective primary participant shall provide immediate writ-ten notice to the department or agency to whom this proposal issubmitted if at any time the prospective primary participant learns thatits certification was erroneous when submitted or has become errone-ous by reason of changed circumstances.

I certify that the above named Applicant will or will continueto provide a drug-free workplace by:

a. Publishing a statement notifying employees that the un-lawful manufacture, distribution, dispensing, possession, or useof a controlled substance is prohibited in the Applicant's work-place and specifying the actions that will be taken againstemployees for violation of such prohibition.

b. Establishing an on-going drug-free awareness program toinform employees ---

(1) The dangers of drug abuse in the workplace;

(2) The Applicant's policy of maintaining a drug-freeworkplace;

(3) Any available drug counseling, rehabilitation, andemployee assistance programs; and

(4) The penalties that may be imposed upon employeesfor drug abuse violations occurring in the workplace.

c. Making it a requirement that each employee to be engagedin the performance of the grant be given a copy of the statementrequired by paragraph a.;

d. Notifying the employee in the statement required by para-graph a. that, as a condition of employment under the grant, theemployee will ---

Acting on behalf of the above named Applicant as its Authorized Official, I make the following certifications and agreements tothe Department of Housing and Urban Development (HUD) regarding the sites listed below:

(1) Abide by the terms of the statement; and

(2) Notify the employer in writing of his or her convic-tion for a violation of a criminal drug statute occurring in theworkplace no later than five calendar days after such conviction;

Notifying the agency in writing, within ten calendar daysafter receiving notice under subparagraph d.(2) from an em-ployee or otherwise receiving actual notice of such conviction.Employers of convicted employees must provide notice, includ-ing position title, to every grant officer or other designee onwhose grant activity the convicted employee was working,unless the Federalagency has designated a central point for thereceipt of such notices. Notice shall include the identificationnumber(s) of each affected grant;

f. Taking one of the following actions, within 30 calendardays of receiving notice under subparagraph d.(2), with respectto any employee who is so convicted ---
