01 . RESOLUTION - - Confirmed minutes of the last meetings and approved the action taken thereon with the following further modifications and suggestions:-

Shri Suresh Kumar, Elected Member pointed out that the issue of unauthorized construction was considered by the Board vide CBR No.26 to 30 dated 17.10.2015 and subsequently the same was also entertained by the Board meeting dated 02.12.2015 to amend the action of the earlier resolution. Whereas, the CEO brought to the notice of the Board that the issue cannot be entertained in this regard until the expiry of three months as provided under rule 37 of the Business Regu lations.

He further suggested that the request for considering the unauthorized construction for compounding be rejected and unauthorized constructions be demolished.

that the requests of unauthorized constructions be considered and compounded by the Board, as has

been done in the case of Bungalow No.26, Mall Road, Jalandhar Cantt.

CEO informed the Board that the most of the buildings in civil area of Cantonment are of old

construction and any collapse of buildings may leads to complication and responsibility on the part of

Cantt Board. Hence, the public should submit the building plan for sanction that may be sanctioned under

the provisions of the Cantonments Act.

Shri Suresh Kumar, Elected Member further suggested that to sanction the building plan the

process should be made easy and admission deed should be obtained even if unregistered for

convenience of the general public. He further pointed out that the house tax of properties have been

enhanced which should be reviewed in the interest of the general public.

Shri Sanjeev Trehan, Elected Member also added that the documents pertaining to ownership

of property establishing pedigree should not be stressed, so that the general public may get the building

plan sanctioned easily.

The PCB concluded that the issue of unauthorized construction will be considered in the next

Board meeting for detailed discussion and issue of enhancement of taxes be reviewed under the

provisions of the Cantonments Act, if admissible on written request of the individual, and that this was to

be taken up as a separate agenda item at the next board meeting.

Action taken on Item No. 01 dated 23.12.2015 of Special Board Meeting

Proposal regarding Installation of Mobile Towers/Parking of Cell on Wheel to improve the quality

of Cellular Mobile Phone coverage in the area of Jalandhar Cantonment: Disposal of Rights under

License through Open tendering.

The Vice President and Elected Members raised the issue that despite forwarding the proposal

for installation of mobile towers/parking of cell on wheel to the competent authority for sanction yet no

result has been achieved and the public at large is suffering due to non-connectivity. They further

requested the PCB to personally liaise with the competent authority to ascertain the present status of the

proposal.

In reply to the request made by the Elected Members the PCB informed the Board that proposal

has already been sent to the Ministry of Defence by the GOC-in-C, Western Command to the Ministry

and the proposal is pending at the Ministry level. The PCB also advised the Cantt Board Members to use

their good offices to enable a decision favorable to the Cantt Board from the competent authority.

The CEO brought out that the matter is pending now in DGDE for approval of the Ministry and

that he would take up the matter with concerned officials of DG DE on his visit there.

Shri Rajinder Sharma, Elected Member suggested that the said issue is pending for the last one

year and the public is suffering at large and losing faith in members and further requested the PCB to

issue a Press Note for information of the general public in this regard.

The CEO stated that a Press note would be published for the requirement of the general public

and he would also personally discuss with the concerned officials in DG DE in this regard .

CONSIDERATION AND CONFIRMATION OF THE PROCEEDINGS OF THE COMMITTEES:-

(A) FINANCE & GENERAL PURPOSES COMMITTEE PROCEEDINGS DATED 08.01.2016

Minutes of the proceedings of Committees are put up on the table for consideration of the Board.

02. RESOLUTION - Confirmed minutes of the Finance & General Purposes Committee meeting and

minutes of Education Committee and approved the action taken thereon with the following further

modifications and suggestions:-

Shop No.6, Backside Mini Shopping Complex, Hardyal Road, Jalandhar Gantt.

Amplification:-

Shri Rajinder Kumar Sonkar, Elected Member raised the issue that the MRP of Rs. 1500/- per

month fixed thereof is very low compared to the adjacent Cantt fund properties and suggested that the

MRP should be comparable and there should be re-tender.

Shri Suresh Kumar and Shri Rajinder Sharma, Elected Members stated that the highest bid

should be considered as there is a reasonable enhancement by 25-30% and that he has been regularly

paying rent without default.

The Board further unanimously resolved to amend the Finance Committee resolution and that

the highest bid @ Rs'.1850/- per month by Sh. Lalit Kumar S/O Ram Parkash, resident of 316, VPO

Sirring, Jalandhar Cantt in respect of Shop No.6, Backside Mini Shopping complex, Hardyal Road,

Jalandhar Gantt be approved for a period of one year as the bidder has been regularly paying his dues.

Action taken on F&GPC Item No. 03 dated 08.01.2016

Cattle Nuisance/Sale of Animals

No details of Self Finance Scheme for dairies has been put up for the Cantt Board's consideration

as on date but a suggestion has been made to examine the feasibility of shifting dairies in Gantt Board

land near Subhana Village.

Action taken on F&GPC Item No. 07 dated 08.01.2016

To dispose of the rights for occupation of Cantt Fund Property known as open space adjacent to

Oak Banglow, Mool Raj Road, Jalandhar Cantt.

Shri Suresh Kumar, Elected Member raised the issue that the issue has already been considered

by the Board vide CSR No.03 dated 09. 12.2015 wherein the Board resolved to terminate/cancel the

proceedings to dispose of rights for occupation of Gantt Fund properties known as Open Space (vacant

land) adjacent to Oak Bungalow, Mool Raj Road, Jalandhar Gantt for the purpose of

fairs/exhibitions/sales/marriage purpose etc. and to refund the earnest money of the highest bidder. The

Board further resolved to dispose of the rights for occupation of the said Gantt Fund property for Parking

purpose for convenience of the general public.

The Board further resolved that proposal for construction of Shopping Complex and multi

complex parking on the said land be prepared and put up for consideration of the Board .

. Whereas, the same issue has again been entertained by the Finance committee which is a

contradictory view which should be set aside as the recommendations of the Finance Committee are not

binding with the Board.

Shri Sanjeev Trehan, Elected Member stated that the said Gantt Fund property used for marriage

palace has been terminated by the Board in view of the nuisance caused by Noise Pollution and for being

adjacent to School and Hospital. Whereas, one Dharamshala on Southern side of the Cantt Board Girls

Sr. Sec. School is organizing marriage and other functions which caused littering of garbage and noise

pollution during the marriage function which may also be debarred for organizing such functions.

The Board considered and resolved to set aside the resolution made by the Finance Committee.

All other items of Finance Committee meeting were approved with the PCB recording his special

appreciation for the Mini Marathan successfully organized by Gantt Board Jalandhar.

Action taken on Education Committee Point No. (C)03 dated 19.10.2015

Cantt Board Elementary School, Mohalla No.20, Ganga Road, Jalandhar Cantt

All items of the Education Committee were approved unanimously in addition it was resolved that

meritorious school students would be annually awarded by instituting a FDR with a bank for school

purpose so that interest accrued annually could be disbursed as prize money to meritorious students

from such FD.

04. RESOLUTION - Considered and noted.

Shri Rajinder Sharma and Shri Suresh Kumar, Elected Members pointed out that the problem of

stray dogs and cattle are still persisting which needs to be improved. They further suggested that the

issue of shifting of dairies be expeditiously initiated and that required facilities such as water supply and

outer boundary wall as demanded by the dairy keepers be provided.

The problem of cow dung from dairies clogging sewerage in Sadar Bazar and the expense of

maintaining cattle catchers, cattle pound, provision of fodder was brought out by member Shri Rajinder

Sharma and the fact of free roaming of cattle on streets was commented upon by Sneh Gupta. The

Board asked the CEO to work out a solution for shifting of cantt dairies to the periphery to improve

sanitation problem.

MERGING OF CANTT BOARD ELEMENTRY SCHOOL, B.l.BAZAR, JALANDHAR CANTT WITH

SILVER OAK SCHOOL I CANTT BOARD PRIMARY SCHOOL, MOHALLA NO. 20, JALANDHAR

CANTT.

To consider the issue of merging of Cantt Board Elementary School, B.I. Bazar Jalandhar Gantt

with Silver Oak School/ C.B. Primary School, Moh.No. 20 Jalandhar Cantt.

It is brought to the notice of the Board that the Principal Cantt Board Boys Sr. Sec. School

Jalandhar Gantt vide its letter dated 07.01 .2016 informed that Gantt Board Elementary School, B.l.Bazar,

Jalandhar Gantt having average daily attendance of about 20-25 students and further recommended that

it may also converted into extension block of Silver Oak School with effect from the new session 2016-

2017. With the permission of the Education Committee Chairman, the issue was considered by the

Education Committee held on 14.01.2016 and after detail discussion on all aspects the committee

unanimously resolved that Gantt Board Elementary School, 8.1.Bazar be closed and the existing students

and regular teaching staff be shifted to Silver Oak School/Mohalla No.20 School. Chairperson suggested

that the views of parents should also be taken in the PTM regarding in which school they shift their child.

She also suggested that Principals should gave monthly report to the parents.

Further the Committee recommended that the land of the school in question be utilized for some

other purpose. CEO further brought to the notice of the Committee that a joint inspection with the

Chairperson will be made to take further suitable action in this regard.

In this connection all relevant papers are placed on the table.

05. RESOLUTION - Shri Sanjeev Trehan, Elected Member intimated that the existing Primary Schools

of Gantt Board be privatized including B.I. Bazar and be given on lease/managed by private agencies ..

The same was strongly opposed by Shri Suresh Kumar who asserted that running schools is a primary

duty of the Gantt Board and cannot be neglected by the Gantt Board.

The CEO brought out that the experience of giving school leases in the bungalow area was

unsatisfactory and led to loss of control of school and land and unnecessary litigation. Hence the Gantt

Board resolved that schools be run by the Cantt Board only and no private parties be entertained. Hence

B.I. Bazar School be converted into an extension of Silver Oak with its principal managing its operations

and at least one permanent school staff be deputed to oversee its functions under the principal in addition

to such contractual teaching staff as required, having CBSE pattern syllabus.

The Vice President and Elected Members appreciated the door to door garbage collection

system and further stated that some of the residents do not cooperate with Cantt Board

Safaikaramcharies and in gross violation, litter the garbage at the street point instead of handing over the

same to the safaikaramchari and those should be penalized under the provisions of the Cantonments

Act.

Shri Rajinder Kumar Sankar, Elected Member pointed out that there are frequent instances of

slaughtering being done in Khatik Mandi, Jalandhar Cantt which should be checked by the SEMO himself.

Smt. Sneh Gupta, Vice President and Shri Suresh Kumar, Elected Member suggested that spray

and fogging be done regularly in the cantonment area.

ITEM N0.07

MAINTENANCE OF STREET LIGHT

Reference C.B.R. No.05 dated 02.12.2015.

In pursuance of above said resolution, tender were called through e-tender ID

2015_DGDE_58920_ 1 dated 04.12.2015 for inviting the tender from the · registered contractors of the

Cantonment Board, Jalandhar upto 24.12.2015 but not a single tender was received on due date. As per

the said resolution, intimation were given to M/S Atri Enterprises, Jalandhar Cantt to extend the contract

on the same old rates, terms and condition for one month vide this office letter No.JCB/E&M/1754/C

dated 15th Dec., 2015 but the same have been denied vide their letter No. Nil dated 21 .12.2015.

It is brought to the notice of Board that to maintain the essential services of security light,

quotation were invited to maintain the street light (without materials) including switching ON/OFF system

on 30.12.2015 and the work order given to Mis Maruti Enterprises Jalandhar Cantt, being the lowest

quoted rate i.e. 22,700/- per month for period of two months i.e. upto 29th Feb., 201 6.

In this regard all relevant papers are placed on the table for noting and to take further decision

to invite tenders waving the condition of pre-registration of registration with the Cantt Board and to allow

participation of the contractors registered with any other executing agencies or having experience in the

field to make it more participative.

07. RESOLUTION - Since the meeting could not be conducted in January, February, tender called for

March,yielded a lowest bid of Rs.25,000/- per month. Considered and approved the existing arrangement

for January, February@ Rs.22,700/- per month and March@ Rs.25,000/- per month.

Shri Sanjeev Trehan, Elected Member proposed the material be purchased by Cantt Board and

only labour be performed by the contractor, as is being done currently for January, February and March,

Shri Rajinder Sharma, Elected Member informed the Board that the performance of the

contractor is very poor as lights keep running for long with no switch off and electricity bills are rising

monthly. Also the cost of a permanent employee deputed to monitor the street light maintenance

schedule was an additional waste of resources and hence was financially more wasteful in the long run.

Material purchase should be handled by the contractor.

Hence the Board agreed to revert to the system of inviting· tender from registered and

unregistered bidders through e-tendering and with supply of materials calling for a contract of one year.

Terms and conditions of the agreement to also include that the contractor is to check and report

if all street lights are functioning or not.

ITEM N0.08

TENDERS DATED 11.01.2016 TO LICENSE OUT CANTI FUND PROPERTY KNOWN AS

CAFETERIA/SHOP NEAR CANTT BOARD OFFICE, HARDY AL ROAD, JALANDHAR CANTT.

To consider Tenders held on 11.01.2016 of the subject property in the office of the Cantonment

Board, Jalandhar Gantt to licensing out for a period of three years extendable by two years, as per tender

notice, under section 267 of the Cantonments Act, 2006.

The subject Cantt fund property was licensed out to Sh. Govindan Kutty V.V. @ Rs.4, 112/- per

month for a period of three years i.e. 01.01 .2015 to 31 .1 2.2017, but on 08.10.2015 he left the shop by

violating condition no.13 of the license agreement dated 01.01.2015 which was executed with him. Thus

his security amounting to Rs.12,336/- deposited vide receipt no.2167 448 dated 15.01.2015 stands

forfeited .

Fresh tenders for the subject shop were also invited on 19-10-2015 fixing M.R.L. fee Rs.4, 112/­

per month. On such dated tender a sum of Rs.4,410/- per month received as a highest bid from Sh. Anil

Kumar Reddy Saen S/o Sane Obulareddy Clo Baljinder Singh New Defence Colony, Besides Park, Deep

Nagar, JRC. After acceptance of his bid by the Board, he failed to take over the charge on the intimation

of acceptance of his bid. So as per terms of the tender, the temporary earnest money deposited by him

forfeited by the Board.

Further fresh tenders for the subject shop were invited on 11.01.2016 fixing M.R.L. fee

Rs.4,1 121· per month. The Tender notices in this regards were published on 30.12.2015 in "Dainik

Bhaskar" and "Dainik Jag ran" newspapers vide this office letter No.JCB/T ax/Publication/201 5/1829

dated 28.12.2015. The tender notices were also affixed on the office notice Board. The tender notices

tenderers.

It is reported that for such dated tender 03 persons offered their bids out of them a sum of Rs.5,000/- per month received as a highest bid from Sh. Daljeet Mattu S/o Arr:iarjeet Singh, V.P.0.-Litran, Tehsil-Nakodar, Distt-Jalandhar-144040.

It is seen that the bid offered by Sh.Daljeet Mattu is good and favourable. It is recommended that the offered bid be accepted as the subject property is lying vacant since 08-10-2015. In this regards original tenders received from the different persons on 11 .01.201 6 with comparative statement and offers report are placed on the table for consideration.

08. RESOLUTION - The Board considered and approved the highest rate Rs.5,000/- received from Sh.Daljeet Mattu S/o Amarjeet Singh, V.P.0.-Litran, Tehsil-Nakodar, Distt-Jalandhar for a period of three years.

TO CANCEL THE LICENSES OF SALE OF FROZEN PRODUCTS OF CHICKEN/FISH/MUTTON ETC. IN THE PUBLIC MARKET, RUNNING UNDER THE MANAGEMENT Of CANTONMENT BOARD, JALANDHAR GANTT.

Reference C.B.R. No.23 dated 02.12.2015.

To consider the issue of cancellation of licenses for sale of frozen products i.e. Chicken/Mutton/Fish etc. in the public market ru nning under the management of the Cantonment Board, Jalandhar Gantt.

The Board considered the issue and after detai led deliberation and due to divergent views in the deliberation resolved to obtain the expert advice of SEMO for further consideration in the next Board meeting and till then to pend the issue for next Board meeting.

It is reported that so many complaints are received in this office regarding cancellation of licenses of sale of frozen chicken/fish/mutton products allowed vide CBR No.21 dated 17.10.2015 and to shift out of fish, chicken and mutton market which are situated near temple and vegetable market, which were terminated vide CBR No.01 dated 24.09.2015 in view of the instructions dated 17.09.2015 of the Punjab f Control Board, Jalandhar.

It is further reported that presently Chicken Shops/Mutton and fish market is situated just near a

religious temple, Vegetable market as well as near the residential area. In view of all these facts it is

recommended that Chicken/fish/mutton market be shifted to some suitable out area as well as new ETP

be constructed near that markets.

In this regards original tenders received from the different persons on 11 .01 .2016 with

comparative statement and offers report are placed on the table for consideration.

09. RESOLUTION - The matter was discussed in detail. Shri Sanjeev Trehan and Mrs. Puneet Kaur,

Elected Members expeditiously brought out that there was no slaughtering conducted in the premises,

and that only frozen meat was being sold.

The SEMO intimated that there was no ban on sale of frozen products as such and could not be

objected to. Col. Vijay Raj Rai, Adm Comdt was of the opinion that closing the meat market will involve

loss of an existing facility to the residents of the Cantt.

Shri Suresh Kumar, Elected Member brought out that slaughtering was indeed going on and that

if frozen products were being sold why was no octroi/V AT collected from the goods sold. The SEMO felt

that the issue of VAT /octroi are not related to the present case. However. Shri Suresh Kumar, Elected

Member questioned the definition of frozen meat products. According to Shri Suresh Kumar, Elected

Member only those frozen products as sold in Easy day. Reliance Mart and such food chains qualify for

the tag frozen meat. Merely storing products in a refrigerator do not qualify to be called frozen. He also

intimated that Food Safety Act has to be applied on these meat products and waste generated disposed

off by ETP. Present hygiene practices are a clear violation of the Act.

The SEMO and Shri Sanjeev Trehan ·opined that in applying Food Safety Act to all shops

vegetable & Meat, majority of the shops in Sadar Bazar would have to be closed down.

While accepting that ETP cannot be built overnight and that the necessity is to ensure compliance

by all, the PCB suggested that the overall quality of the market needs improvement. On questioning by

the PCB the concerned Sanitary Supdtt. intimated that he hasn't visited the meat market in recent weeks

but that he visited them earlier and didn't find slaughtering but member Shri Suresh Kumar questioned

the same saying these were inspected when the shops were closed. On a reference by the CEO to take

a decision by voting the PCB suggested the Board arrive at a consensus rather than decide on closure

of the market by voting. Hence matter was agreed to be kept pending till the next meeting for achieving

a consensus which could not be achieved despite an hour of discussion. Since Shri Rajinder Kumar

Sankar, Elected Member was an interested party he remained silent as a motion was passed by Shri

Suresh Kumar that as per Sec 32 of the Cantonments Act 2006, interested parties must not vote/discuss

on a matter.

The subject property was ·licensed out to Sh. Amit S/o Ashok Kumar, resident of House No.23, Guru Ravi Dass Colony, Dakoha road, Jalandhar-144023 (old address-202-A Bunga Colony, VPO­Birring, Jalandhar Cantt) for a period of three years i.e. from 15.02.2014 to 14.02.2016@ Rs.2,500/- per month.

Fresh tender of the subject shop were invited on 21-12-2015 for a period of three years extendable by two year fixing Minimum Reserved License fee Rs.2,500/- per month. For such dated tender five persons purchased tender forms but only four offered their bids, out of them a sum of Rs.3,550/- per month was received as highest bid from Sh. Shalinder Singh S/o Sohan Singh, resident of House No.7/22, Mahalia No.1, Jalandhar Cantt-144005, but the tenders rejected due to non fulfilment of technical bids by the bidders, which were required as per terms of the tender. Tenders were opened on 21 .12.2015 in the presence of the tenderers.

Further fresh tenders of the subject property were called on 11-01-2016 for a period of three years extendable by two year fixing M.R.L. fee Rs.2,500/- per month. For such dated tenders three persons purchased tender forms and offered their bids, out of them a sum of Rs.3,050/- per month was received as highest bid from Sh. Shalinder Singh S/o Sohan Singh, resident of House No.281 , Gali No.5, Shaheed Babu Labh Singh Nagar, Jalandhar, but the tender rejected due to low bid which was offered by the same person who offered Rs.3,550/- per month on 21 -12-2015. Tenders were opened on 11-01-2016 in the presence of the tenderers.

Again fresh tenders of the subject property were called today i.e. on 01-02-2015 for a period of three years extendable by two year fixing M.R.L. fee Rs.2,500/- per month. The tender notices in this regard were published on 23-01 -2016 "Dainik Bhasker" & "Dainik Jagran" newspapers vide this office letter No.JCB/T ax/Publication/2016/2040 dated 21 -01-2016. The tender notices were also affixed on the office notice Board. Tenders were opened on 01.02.2016 in the presence of the tenderers :-The M.R.L. It is recommended that the bid offered by Sh. Shalinder Singh be accepted as the existing license of the shop is going to expire on 14.02.2016.

REVISION OF PAY SCALE OF C&V TEACHER, CANTONMENT BOARD, JALANDHAR W.E.F.1.12.2011 AT PAR WITH THE STATE GOVERNMENT.

To consider the question of revision of pay scale of C&V Teachers of Cantonment Board at par with the State Govt. employees. The Board informed that the Govt. of Punjab vide their Notification No. 5/10/09-5FPl/665 dated 05.10.2011 have revised the pay scale of C& V Teachers w.e.f. 01.12.2011:-

designated as Multi-Purpose Supervisor (Male). The Govt. of Punjab Dept. of Finance vide notification

No. 5/10/09-5FP1/1546 dt. 23.12.2011 revised the Pay Scale of Multi-Purpose Health Supervisor (Male

& Female) w.e.f. 01 .12.2011, which is as under:-

Health & Family Planning Dept. , Punjab Memo No. E-7(1) Punjab 2015/2700 dated 05.10.2015 that the

post of sanitary inspector was merged along with other categories to the post of Multi-Purpose Health

Supervisor (Male).

The Present scale of pay including Grade Pay of Multipurpose Health Supervisor (Male) (being

presently equated post) is also applicable to the Sanitary Inspectors of Cantonment Board, Jalandhar.

AGREEMENT FOR COMPENSATING CANTONMENT BOARD, JALANDHAR OUT OF PUNJAB MUNICIPAL FUND (11% OF VAT) IN LIEU OF SUSPENSION OF COLLECTION OF OCTROI BY CANTONMENT BOARD, JALANDHAR.

Reference Spl C.B.R. No.02 dated 09.12.2015.

The Board is informed that the fresh draft agreement has been prepared and duly vetted by the Cantonment Board Legal Advisor. The fresh draft agreement has been forwarded vide office letter No.JCB/Octroi/Oct Suspension/2015/02/41 dated 08.01.2016 to the State Govt. for approval of competent authority and requested to retu rn the same at the earliest for onward submission to the Ministry of Defence for approval and notification of Suspension of collection of Octroi tax as required under the provisions of the Cantonments Act, 2006. The approval of the same is still awaited. In this regard a reminder has been sent to State Govt. vide this office letter No.JCB/Octroi/ Oct Suspension / 2015/02/43 dated 01.02.2016.

In this connection all relevant papers are placed on the table.

16. RESOLUTION - CEO informed the Board that in response to the letter dated 08.01.2016 forwarded to the State Govt. for approval of the draft agreement by the competent authority in regards to suspension of collection of octroi tax , the Local Govt. Department vide their memo No.2/8/2014-5SS3/684718/1 dated 09.02.2016 has suggested few amendments/corrections in the draft agreement. In this regard a letter No.JCB/Octroi/Oct Suspension/2015/02/48 dated 25.02.2016 was issued to Sh. Mandeep Singh Sachdev, CBLA for opinion on the subject matter and legal opinion has been received on 01.03.2016. As per his opinion the necessary amendments are made in the draft agreement.

Considered and approved. Col. Vijay Raj Rai, Nominated Member suggested that the applicability of octroi on CSD items be exempt.

The CEO replied that since the issue would financially affect the Board's interest the same is not considerable.

The PCB suggested that a full agenda item on the topic be put up for the board consideration at the next meeting.

ENHANCED OF DEARNESS RELIEF FROM 113% TO 119% W.E.F. 01.07.2015 TO CANTT BOARD PENSIONER'S

Reference C.B.R. No.08 dated 22. 10.2014.

The State Govt. of Punjab had granted 119% enhanced DA w.e.f. 01.07.2015 to its pensioners vide Pb. Govt. Notification No.7/44/2015-IFP1 /56 dated 25.01 .2016. According to the instructions received vide DG DE Delhi Gantt letter No.2351/C/l&C/72(PC-Vol-ll l) dated 02.08.1990, the same has beeri implemented with the pension to the Gantt Board pensioners on the said terms and conditions as specified in the State Govt. of Punjab letters ibid.

The DA on pension is payable to Gantt Board pensioners at par with the State Govt. of Punjab under the provision of para 14 of Memorandum of Settlement.

It is recommended that payment of arrear of DA w.e.f. 01.07.2015 be made to the pensioners of the Cantt Board subject to the availability of funds with the Board. The amount of arrears included Rs.11,21,667.00 approximately. Budget provision exists.

In this connection all relevant papers alongwith case file No.1/51 is placed on the table for consideration.

17. RESOLUTION -Considered and approved.

Shri Sanjeev Trehan, Elected Member suggested that central pension be applied for Gantt Board pensioners. The same was rejected by the CEO, since pay scales of Gantt Board employees are equated to State Govt. scales and hence pension fixed on State Govt. scales cannot be converted into Central Govt. scales post retirement.

Hence resolved to grant DA revision at par with the State Govt. notification subject to the availability of funds with the Board.

CURRENT POSITION OF COURT CASES

To consider the position of Cantonment Board's Court cases pending before different courts. At the beginning of January 2016 there were 88 cases pending in different courts and as on date list of pending cases is as under :-

18. RESOLUTION - Considered and noted. The Board resolved that the cases be vigorously pursued and in case of delay expeditors be filed for early hearing and monthly details of cases filed by /and against the Board and cases decided be put before the Board for perusal.

GRANT OF ENHANCED DA @ 6% FROM 113% TO 119% TO THE CANTONMENT BOARD EMPLOYEES W.E.F. 01.07.2015

The Board is informed that the State Govt. of Punjab has enhanced Dearness Allowance @ 6% w.e.f. 01 .07.2015 to its employees from 113% to 119% vide their notification No.7/44/2015-1FP1/56 dated 25.01 .2016 (copy enclosed), the same is also admissible to the Cantt Board employees under the provision of para 14 of the Memorandum of Settlement on the said terms and conditions as specified in the State Govt. of Punjab letter ibid.

The decision of payment of arrear of DA of enhanced rate for the period 01 .07.2015 to 31 .12.2015 shall be taken later on and payment of enhanced DA due from 01.01.2016 under these order shall be paid in cash. The Board may consider approval of payment of DA@ 119% to the Cantonment Fund Servants after approval of the Directorate Defence Estates.

The total monthly expenditure will be Rs.378157.00 approx. Provision for the same have been made in the Budget estimates.

In this connection all relevant papers alongwith case File No.1/51 is placed on the table for consideration.

19. RESOLUTION - Considered and resolved to approve the enhanced DA i.e. @ 6% FROM 113% to 11 9% to the Cantonment Board employees w.e.f. 01 .07.2015 at par with the State Govt. Proposal may be forwarded to GOC-in-C, WC, Chandigarh for necessary sanction.

VACATION OF QUARTER N0.94, KASTURBA NAGAR JALANDHAR CANTT.

That the Board informed that the Kasturba Nagar Low Income group Housing Scheme, quarters were constructed by the Cantonment Board in the year 1960-61 as per the revised scheme 1957 as a centrally sponsor scheme of Ministry of work & Housing & Supply for this purpose a loan was taken by the Cantonment Board, Jalandhar from the State Govt., and the same was paid back by Cantonment Board, Jalandhar alongwith interest in 30 years.

In the year 1967, the Principal of Kendriya Vidyalaya, Jalandhar Gantt requested for the allotment of Kasturba Nagar quarters for the staff employed at Central School, Jalandhar Cantt, in the name of the Principal and he also took the responsibility of paying rent and water charges etc., of such quarters. Six 2-roomed quarters and two 3-roomed quarters in the Kasturba Nagar Colony were placed under the disposal of the Principal, Central School for allotment to his staff. Principal, Kendriya Vidyalaya, Jalandhar Gantt executed necessary mnt agreement for different quarters with the Cantonment board, Jalandhar Cantt, which were subsequently allotted by him to various teachers at h_is own level on vacation by its staff from time to time and the rent was being paid by"him vide Cantt Board Resolution No. 18 dated 21.05.1980. Accordingly quarter No. 94, was allotted to Sh. Salish Kumar, WET in Feb., 1968 in the name of Principal Central School and later on he took pre-mature retirement in the year Sept., 2000 and went to Canada, before leaving to Canada he 'handed over keys of this quarter to Sh. Rajinder Kumar Raju as a caretakertill the actual authority i.e. Principal Central School, ask for return of quarter.

The Cantonment Board, Jalandhar Cantt issued numbers of letters to Principal, Kendriya Vidayala No. 1, Jalandhar Cant! to explain in which capacity quarter No. 94 is occupied by Sh. Rajinder Kumar Raju. Now the Principal of the said school written a letter bearing No. L&B/2, Staff Qrs., KVJ-1/2015-16/1518/PB-304 dated 17.10.2 015 to Sh. Rajinder Kumar Raju, copy to same the Chief Executive Officer, Cantonment Board, Jalandhar Cantt in which the Principal stated that a letter dated 12.10.201 5 is received from Sh. Salish Kumar, Ex-WET that Quarter No. 94, Kasturba Nagar, Jalandhar Cantt was given to you as a caretaker and requested you to hand over the quarter to the Chief Executive Officer, Cantonment Board, Jalandhar Cantt immediately.

The quarter is allegedly under occupation of a sitting member. The Principal of the school has submitted a letter dated 01.12.2015 enclosing a copy of affidavit submitted by Sh. Satish Kumar, Ex WET, K.V. No. 1, Jalandhar Cantt. The letter is addressed to Sh. Rajinder Kumar occupant of quarter No. 94, requiring him to vacate the quarter.

It is intimated that Sh. Ramandeep has make many complaints for the higher authorities and they are asking for action taken report. There are many other quarters also occupied by unauthorized persons hence the issue is required to be put up before the Board for consideration.

20. RESOLUTION - Shri Rajinder Kumar Sonkar, Elected Member didn't participate as he is an interested party as per Section 32 of the Cantonments Act, 2006.

The matter was discussed in detail. Shri Sanjeev Trehan, Elected Member pointed out that there is a court case and matter is subjudice. Col. Vijay Raj Rai, Nominated Member brought out that the matter had been pending with ADJ, Jalandhar for final orders and deferred by a month.

Shri Suresh Kumar, Elected Member brought out that matter of the subjudice case was not material to the unauthorized occupation of govt. accommodation by Sh. Rajinder Kumar Sonkar. The Kasturba Nagar Housing Colony has claimed ownership & possession of Cantt fund properties and that meagre rent of Rs.120 etc. is being paid while in actually sale transaction of Rs.20-25 lacs are being quoted for transfer of property. None of these are with registered sale deeds but merely to transfer occupation/unauthorized possession.

However, Shri Rajinder Kumar Sankar, Elected member is by default an occupant of one of the quarters rep by Kasturba Nagar and hence his interests are contrary to that of the Cantt Board in this matter.

Shri Sanjeev Trehan suggested that there were 9 allottees which were mutated in the tax records despite matter being subjudice in the past. Hence there was no bar on the Cantt Board to recognize existing occupants as allottees, to which other _members objected saying that past irregularity cannot be used to condone/legalise present irregularities. Shri Sanjeev Trehan quoted that the irregular allotment and mutation of allottes was being quoted by the Kasturba Nagar Housing quarters t~ weaken the Cantt Board's case. ··

The PCB suggested that the CEO study the matter in detail and again put up the matter for consideration at the next Board meeting, and also await the court verdict to decide the further course of action.

Reference C.B.R. No.11dated17.10:2015. To note and approve the engagement of persons/safaiwalas for cleaning of main drains of Sadar

Bazar and other civil area of Jalandhar Gantt. The Board vide above CBR resolved to hire 10 Safaiwalas for cleaning of main drains in Sadar Bazar and other civil area of Jalandhar Gantt through existing contractor/service provider on minimum wages rates for a period of three months only.

The services have been expired on 31.01.2016 and there is requirement to continue the above services for a further period of one month.

As per instructions of PD DE, WC vide letter referred above have accorded necessary sanction for engagement of 06 Data Entry Operators and 02 retired staff w.e.f. 22.09.2015 to 19.12.2015 and 15.09.2015 to 12.12.2015 respectively on narrick rate of Rs.398.65 per day for indexing, scanning & digitization of land records of defence lands pertaining to Jalandhar Cantonment.

It is intimated that the funds allotted by the PODE have already been exhausted and additional funds under appropriate head is awaited. Payment of six data entry operators and 02 retired staff are pending w.e.f. 18.11 .2015 in respect of the detail of employees as mentioned in the letter under reference.

Board Sr. Sec. School Boys Jalandhar Gantt be opened to general public beyond school timing and

entrance gate be provided on Hardyal Road and Church Road to facilitate entry exit to the general

public. The overall management should be with Principal Gantt Board Boys Sr.Sec. School. The CEO is

authorized to make necessary improvement and to incur expenditure. Specialized agencies like SAi or

any other agencies be roped in.

It is therefore, recommended that the board should amend the referred CBR ac~ordingly.

above, the Sports Meet (Josh 2016) was held on 5th & 6th November, 2015 at Ferozepur Gantt, in which

Jalandhar Cantonment was one of the participant of said Sports meet under the Western Command.

As per the letter dated 17.02.2016 referred above of Ferozepur Cantonment Board, the

contribution /share a sum of Rs,.4, 14,000/- towards the expenditure incurred on the subject meet is due

with the Jalandhar Cantonment and ·further requested to pay the same at the earliest.

Therefore, the Board is to approve the proportionate contribution/share a sum of Rs.4, 14,000/­

No.JCB/Engg./Conv./5753/C dated 04-03-2005.

A request dated 27-05-2014 from Sh. Malkiat Singh, Property No.94(P), outside Mohalla No.21 ,

Jalandhar Cantt was received in this bffice· regarding refund of the 25% of the conversion cost (Earnest

Money) i. e. Rs.3,06,300/- (Rupees three lac six thousand and three hundred only) which was deposited

by the occupier in this office vide receipt No.005502 dated 17-01-2005 of the above said property. Now

he has submitted that a period of over nine years has since lapsed and the land property has not been

converted into free hold yet. In the meantime the occupier had sold the property in question and is not

interested in converting the same to free ·hold anymore.

It is further submitted that the guidelines in this regard had already been sought from Principal

Director, Defence Estates Office, Western Command Chandigarh vide this office letter

No.JCB/Engg/Conv./23 dated 19-05-2015 and Directorate vide their letter under reference advised to this

office 25% of the conversion cost deposited by Sh. Malkiat Singh should be refunded and after refund of

amount he should inform in writing to this office that his application for processing the free hold case need

not be processed and confirm to the Directorate for closing the case.

In this connection all the relevant papers are placed on the table.

30. RESOLUTION - The matter could not be considered due to paucity of time and hence deferred to

next Board meeting.
