In this month’s edition, we celebrate the future and entrepreneurial optimism, with a giant nod to the great innovators shaping the direction we will go as humans and business people. It’s our premiere edition of “Tanzania Real Estate Big Players and Rising Stars.”

In this issue, we have the address to Real Estate stakeholders from William Lukuvi, the Minister of Lands, Housing and Human Settlements Development. Also, a remarkable connection between the present, changing times and the future in real estate is made by the Director General of National Housing Corporation Nehemiah Kyando Mchechu. Thus, exhibiting the NHC’s ability to position itself as a strong brand as it has gained trust among the public as the place to go, when in search for quality housing.

It is my pleasure to thank you all for the support and immense contributions you have put in this rather nascent but very important industry which touches each and every individual’s life on a daily basis.

This is underpinned by the fact that without a decent home it would be unfulfilling for mankind and the overall objective of providing decent housing to all people. It is from this noble responsibility that the Government has been striving to ensure that the majority of the people own a house. Real Estate is an industry that is composed of multiple stakeholders that work together as a single entity.

These include but not limited to; Property developers, Banks, Contractors, Engineers, Architects, Property Managers, Real Estate Agents, Land and Quantity Surveyors, Consultants, the Tanzania Revenue Authority and the Tanzania Bureau of Standards. The shortage of decent housing for the entire country is one of the major concerns of the Ministry of Lands, Housing and Human Settlements Development. By the 2010, housing shortage was estimated to be 3 mil-lion units. While the bulk of the current stock in both urban and rural areas have been produced by individuals (about 90 percent), real estate, government agencies and other actors have been also contributing towards addressing this shortage.

The Ministry has tirelessly worked with various stakeholders towards achieving the industry’s objectives. On top of the agenda has been how to provide affordable housing units to the majority of the population.

For example, between 2010 and 2015, a total of 10,423 affordable housing units were constructed by the National Housing Corporation, Watumishi Housing, Mutual Developers , the National Social Security Fund, The Tanzania Building Agency and others. While the proportion of real estate developers remains low, when combined with initiatives from the private sector the true gap in housing shortage is decreasing. These initiatives have gone hand in hand with proper execution of the Unit-Titles Act (2007) which allows multiple ownership of a given property. The other equally important agenda is to make sure that our cities and towns are well planned

not only to suit the modern settlement standards but also facilitate the provision of ba-sic services such as roads, water, electricity, recreational places, worshiping and educa-tional places.

This has been achieved by closely working together with private companies to survey and deliver surveyed plots all over the country. Before 2003, there was no serious involve-ment of the Private Sector in surveying plots for different uses. By that time the surveyed land was estimated to be 10 per cent. From 2003, the Government started to engage the private

sector and several companies in land surveying.

This was marked by the involvement of private Sur-veying companies in the survey of 20,000 plots project which ultimately, culminated into production of 41,000 plots in Dar es Salaam City. This project was replicated to other cities and towns such as Mwanza, Mbeya, Arusha and Morogoro.

These efforts contributed to increase the proportion of the surveyed land to increase from 10 per cent in 2003 to 1 5 percent in 2015. Our objective is to achieve 25 percent by 2020. Therefore, our call to all Tan-zanians is to capitalize on this opportunity by building houses

on surveyed land and use the titles as collaterals for ac-cessing loans from financial institutions for other develop-ment projects.

We have also worked on various policies and acts including the review of the National Human Settlements Development Pol-icy of 2000, The National Land Policy of 1995 and the Urban Planning Act Number 8 of 2007. Some of the challenges that emerged in the course of coordinating these initiatives and that call for our attention have been manifest in the form of land disputes and invasion of open spaces. Our endless efforts is to continueensuring that laws and by-laws are

adhered to, resolve all dis-putes and recover all invaded open spaces to be used for the planned purposes. We look forward to continue working together with all stakeholders to collectively deliver on these government objectives. We understand that the road ahead might be one with very many hurdles and sometimes full of uncertainties. However, the past one year has shown that if we work together as a team we can realize these objectives.

Dear readers,Let’s take a moment to reflect on our achievements gained in Tanza-nia Real Estate Industry in the past year.

John Dewey once said, “We do not learn from experience … we learn from reflecting on experience.” As such, in order to access our accomplishments, we seek to ask open-ended queries and ponder as a collectively find answers to our successes and challenges.

After our reflection section, we follow suit with setting our goals and consider the real needs that will allow us to plan accordingly.

Based on the above questions and deliberations, we would like to introduce our annual platform that will be featuring Tanzania Real Estate BIG PLAYERS and RISING STARS with each showcasing his roles and contributions. Special thanks to Hon. William Lukuvi, the Minister of Lands, Housing and Human Settle-ments Developments for embracing, supporting the idea and giving his fore words.

I would also like to thank all who have accepted the idea and gave your inputs because without this coop-eration then this wouldn’t have been realised.

It might be a surprise to some of us to realize that for the industry to operate completely smooth there is a long list of players with each playing a vital role.

The list include the government, property developers, Tanzania Revenue Authority, Tanzania Bureau of Standards, building material suppliers, architects, Quantity surveyors, contractors, consultants and land developers. Others are Banks, Real Estate Agents, PropertyManagers, Lawyers, Utilities suppliers, home decors, research companies, marketing firms, academic institutions, and the list goes on. In order to deliver the industry needs and targets all these have to work as a single entity.

Looking at the current housing gap of 3,000,000 with a rising annual demand of 200,000 houses, it is clear that we need special acceleration that will deliver the targets including the annual demand and closing on the gap on 3,000,000 houses deficit.

To achieve these goals we need to collaborate, work as a team and breakdown the requirements so that each player sets his plans based on the real needs and targets.

One of the key areas to focus on is the middle and low income segment which dominates about 70 percent of the to-tal industry’s needs. Special initiatives and focus are required to deliver affordable and low cost houses countrywide.

Without delving into further details, I hope this issue will provide you with a good read, one that will enhance opportunities and act as a basis for future collaborations. I am sure you will gain more insights and probably come up with constructive ideas on how to grow the industry.

If you have missed out on this first opportunity, worry not. Just start the preparations for the next one that will come at the end of the year.

National Housing Corporation through the years

The National Housing Corpo-ration (NHC) was established in 1962 by Act No. 45 with the

sole objective of providing and facili-tating the citizens with better hous-ing. This made NHC the first corpora-tion to be established by Mwalimu Julius Nyerere, just one year after Tanganyika’s independence.

The first task that the young corporation was tasked with was the slam clearance initiative; which was tagged as the ‘Ondoa Makuti’ campaign, an initiative that yielded 14,685 houses. This was made possible because there was commitment as the government side was funding 40 percent of the budget, whereas the government of the then Federal Republic of Germany (FRG) had committed itself to 17 percent grants to support NHC’s construction projects.

The Tanzania Housing Bank at that point funded 4 percent leaving the remaining 39 percent to be funded by NHC itself. The subsidies that the corporation received from the Government, financial assistance from the German Government and loans from the then Tanzania Housing Bank between 1962 and 1989 enabled the corporation to construct 16,356 houses countrywide.

Apart from the support and grants from FRG, the Corporation failed to deliver because of a number

of factors which included: unfavor-able legal framework, world economic crisis, lack of political support and inefficiency of the staff and management.

In 1990, the Government decided to merge NHC with the Registrar of Buildings which was established in 1971 by Act No. 13 to manage the nationalized buildings, to give the two organizations more financial power. This amalgamation formed a viable NHC with the cardinal obligation of spearheading housing agenda for better human habitation.

Despite the merger of these two corporations, there were no notable changes in performance as the Corporation only managed to build only 812 houses between 1990 and 2010.

Changing Times

In order for NHC to operate itself and cater for housing demand, the Government in 2005 made a miscellaneous amendment to enable the corporation to operate more commercially. Similarly, in 2008 the Government managed to enact the mortgage finance Act and the Unit Titles Act to facilitate the rapid growth of real estate sector. Moreover, in 2010 the Government made a tremendous overhaul by appointing a new Board of Directors and Management with the objective of

enhancing plans implementation and productivity so that the corporation could deliver on the housingshortage that now stands at about 3,000,000.

The first responsibility of the leadership was to prepare a medium term plan covering the period 2010/11 to 2014/15 that defined the new orientation and objectives of the Corporation.

This move was done because as trends in the economy continued to change, it called for a more dynamic approach in the industry hence, a need for a great restructuring to give it the face that it has today.

The new era ushered in new ways of doing business as the corporation’s sole funding was now through bank loans to build low cost housing.

It had to formulate a five year stra-tegic plan which acted as a road map towards major reforms of the housing firm.

The restructuring programme took two years to come into effect leaving us with barely three years on the first five-year plan but even then we have delivered on most of the projects.

According to the strategic plan NHC was supposed to construct 10,000 high and middle income houses and 5,000 affordable units.

The main reason that we decided to put more efforts on the high and middle income housing projects as opposed to low cost housing was to tap the resources from those with the financial muscles given the fact that, low cost housing are less profitable yet, the construction costs continue rising.

By July 2015, the Corporation had started implementing 142 housing projects of low, medium and high cost residential houses including commercial buildings.

These projects are located in various parts of the country with a total of 42,661 houses. Amongst them, 18 projects with a total of 6,494 houses have been completed, 35 projects with a total of 25,876 houses are under construction and 89 projects are in various stages of preparation. The Future

In 2008, the introduction of the mortgage finance Act that facilitat-ed the growth and investment of the housing sector, the Corporation has since entered into partnership agreement with 16 banks that are providing mortgage to house buyers on a long term basis.

The banks include Azania Bank, Bank of Africa, CRDB Bank, Exim Bank, KCB Bank, National Bank of Commerce, DCB Commercial Bank, Commercial

Bank of Africa, National Microfinance Bank, Banc ABC, NIC Bank, Stanbic Bank, First National Bank, Internation-al Commercial Bank, Diamond Trust Bank and Equity Bank.

By July 2015, 89 buyers managed to get loans to purchase NHC houses and others are in the process of getting them. The Corporation continues with its efforts to encourage members of the public to seize the house loans opportunity to buy houses of their own.

The total mortgage available to the 22 banks that are members of the Tan-zania Mortgage Refinancing Company (TMRC), has now reached 360 bittllion shillings.

Since its major changes, the corpora-tion has investments worth $400 million in ongoing and completed proj-ects and this is expected to double in the next five years.

NHC continues to position itself as a strong brand as it has gained trust among the public as the place to go, when in search for quality housing.

Even with such a bright future, the greatest challenge as mentioned earlier lies in lack of readiness from the municipal councils to provide land for the construction of low cost houses.

Affordable housing refers to housing units that are constructed for

Tanzanians whose income can purchase a house between the price

Tzs 20,000,000 and Tzs. 45,000,000.

Affordable housing in Tanzania has become a key issue especially in developing

our nation where a majority of the population cannot afford to buy houses at

the current market price. Disposable income of our people remains the primary

factor in determining the affordability of the buildings. As a result, it has become

our increased responsibility to cater for the rising demand for affordable

housing.

Our projects are designed and developed to offer various benefits to the

residents and their neighbors. The houses offer among other features are at

least 60 sqm size, 2 rooms, modern kitchen, sting and dining room. Facilities and

social amenities include roads, retail shops, kids play area, garbage collection

facilities, communal security etc.

The price range of NHC affordable houses ranges between Tzs. 30 million to 50

million. NHC has so far delivered 3,084 affordable housing units from 2010/11 to

2014/15.

DefinitionHome staging is the act of preparing a private residence for sale in the real estate industry. The goal of staging a home or property is to make it appealing to the highest number of potential buyers, thereby selling a property more quickly and for high prices. Staging techniques focus on improving a property's appeal bytransforming it into a welcoming, attractive product that anyone might want.

“Home staging” is not a new term, but for many homeowners and real estate agents, the concept of “professional home staging” is shedding new light on how to promote a home in the real estate marketplace. In past years, homeowners were left to their own discretion as far as preparing they were for their home showings. Though they could occasionally rely on an agent for instructions, more often real estate agents were at a loss when working out the details as the homeowner.

While agents are experts in the field of selling and closing, many of them do not have the design know how. They usually know exactly what factors may help them to sell a home. On the other hand, it’s just not always easy to get a home into selling condition in a timely manner without some sort of experi-enced assistance.

Who is a Home Stager?Professional home stagers are practiced in the art of preparing a home for resale. They work with the “flow” of a home, eliminate clutter, edit and arrange furniture as well as assist in enhancing curb-appeal.

What does Home Stager Do?With the aid of a professional home stager, your house can make a notable first impression on potential homebuyers. As the real estate industry

Stagers use the homeowners own décor and advise the owners what to pack up and put away as storage. To show well, a home must be easy to navigate and free of personal mementos and pictures.

This is because, potential owners must be able to imagine themselves in the house and the personal items of the sellers can cloud that image. To that end, stagers take over, reorganize the furniture and eliminate any clutter that homeowners have trouble parting with in order to create a pleasant and appealing environment for prospective buyers.

FurnishMost of the times, stagers are called in after the homeowners have already moved, leaving a cold and empty home for sale. Prospective buyers have difficulty looking past the emptiness of the house to envision themselves living in that space. At the same time, flaws are more noticeable when rooms are empty.

DecorateA home stager may suggest more extensive work than mere shifting of furniture to make the house more attractive to prospects. They often recommend painting or adding shut-

ters or other window treatments to the rooms that are saturated with too much natural light. They either bring in employees to provide such services or give it out as a contract to local providers. In that case, home stagers usually keep a list of trusted contractors, including painters, carpenters, plumbers, landscapers and other home-service providers.

Complete PictureIt is a common practice that home stagers looks after the property until it’s sold. They tend to make regular visits to available homes in their care to clean or freshen the décor. The exterior also falls under the care of the home stager in many cases; which includes regular yard maintenance and cleaning.

Home stagers may be called on prior to an open house to make adjustments to the décor to accommodate larger groups of lookers. Home stagers also partici-pate in creating an online presence for sellers, taking pictures to place in online advertisements and creating virtual tours of the newly staged and decorated home.

Geared to Deliver 50,000 Affordable Houses in Five

PhasesWatumishi Housing Company (WHC) is a public entity which was established two years ago. WHC's major functions include the provision of affordable homes and more specifically; to implement the public servant housing scheme a fund manage-ment. As a fund manager, WHC manages the first ever Real Estate Investment Trust (WHC-REIT) in East Africa. WHC-REIT is a collective investment scheme specifically geared towards investment in real estate development. Initial subscribers to WHC-REIT include the PSPF Pension Fund, NSSF, PPF Pension Fund, GEPF Retirement Fund, National Health Insurance Fund and National Housing Corporation.

WHC, therefore, is a special purpose vehicle that operates as a Real Estate Investment Trust where we have a pool of investors and it is these resources that we allocate in the development of affordable homes.

We also took on the responsibility to increase public awareness by imparting the knowledge on how they can get mortgage financing.

As a REIT (Real Estate Investment Trust), unlike other investment schemes, we mobilise savings from many small investors which are specifically allocated for the funding of investment on land and housing.

The establishment of REIT in Tanzania makes it only the fourth country in Africa after South Africa, Egypt and Nigeria that have a well developed REIT markets on the continent.

FundingGiven the level of awareness on this type of investment was low, WHC started with a few investors such as NSSF, GEPF, PPF, LAPF, PPF, PSPF, NHC and NHIF.

These investors took the lead in mobilis-ing own resources an initiative that allowed us to kick off smoothly.

This kind of arrangement shall exist for the first three years and there af-ter these investors may exit from WHC-REIT by selling their units at the Dar es Salaam Stock Exchange to the general public.

WHC’s main objective is to provide affordable housing even in the absence of a concrete definition of what an affordable house means.

However, through our research in the market in the context of Tanzania we found that, these houses should be at the level of the income of the buyers.

The research revealed that 70 percent of Tanzanians cannot afford a house if it is above Tzs 20 million which means that these houses should not exceed this amount if developers are to serve 70% of the market.

Even with these challenges, we are trying to match the price of the houses and the income of the targeted group.

Our ProjectsWe are currently working on eight projects countrywide; our first project was at Mkundi - Morogoro Housing Proj-ect with 40 units which is in the finishing stage, the Bunju B Mabwepande Housing Project with 201 units with the initial stage taking off with 71 .

The Gezaulole Residence with 800 units with 369 in the phase one, Magomeni Housing Project with 104 units which is also in progress.

We have also contracted a contractor for the Kibaha Housing Project which is earmarked for 750 units apart from this we also have the Pongwe City and Dodoma Housing Estates.

ChallengesAs mentioned earlier we have to match the prices with the earnings of the target customers yet the reality is that, the cost of construction cost and materials have kept on rising. In addition, although WHC has negotiated better mortgage finance terms with banks for public servants, the interest rates charged are still on the higher side when you take into account issues of affordability. A lasting solution to this obstacle lies in establishing a fund that will raise cheap financial resources and lend to mortgage borrowers at interest rates preferably lower than 10%.

Infrastructural challenges in the areas that we seek to develop such as electric-ity, water, roads which on ordinary terms should be catered for b y the utility companies.

This, unfortunately, reflects on the cost of the houses as we have to absorb these costs.

Housing ShortageTanzania is believed to have a shortage of about 2.5 million homes. According to the 2012 census, Tanzania has 9.3 million homes with each home accommodating 5.5 persons on average. Unfortunately, 3 million of these are made of mud and thatched by grass.

With two years of success, it is our belief that we shall in the coming five phases commencing from FY 2015/2016 we shall deliver by supplying houses to the market that matched the income level of an average Tanzanian.

In the meantime, we have to look at how to increase on our collaboration with stake-holders who have influence on what is pulling us down to manage the prices.

This means local authorities will be key in areas such as roads, and the prices of land, this in the process which will enable us to push the prices down and therefore attracting more buyers.

PSPF Plaza

One of the few beautiful and conveniently located buildings along Nyerere road in Dar es Salaam.

Boasting as a three storey high bulding, the plaza offers approximately 12,000 square meters for commercial uses including show rooms and corporate offices.

It was procured in 2005 and has been one of the Fund revenue sources.

Challenges The challenges which the Fund face in the construction industry is escalation of the materials purchase cost due to the change of the value of local currency. Selling of the properties/houses is also affected by inclusion of the tax in the selling price. This affects the Fund due to the fact that the materials are purchased with VAT and also the product/house sold with VAT (Double taxation).

Near future projectionsThe Fund is continuously carrying out studies and research to determine projects which will best fit the public. The public should

expect more real estate and infrastructure investments which will benefit the public through employment and use of the facilities at affordable cost.

Long term plan

The Fund plans to extend its investments in real estate and infrastruc-ture to the peripherals (Rural areas). This will increase social security awareness to the public and not only improve the wellbeing of the public but also enable them to build habit of saving for their old age benefits.

Tanzania Mortgage Refinancing Company

Acquisition of a descent home remains as one of the main challenges for most Tanzanians with myriad of obstacles ranging from rapid urbanization, infra-structure shortcomings, provision of long term finance, supply of affordable housing to title registration.

As these challenges rare their ugly heads, there seems to be a light at the end of the tunnel as the government actively stepped in to tackle the housing shortfall by creating an enabling environment.In March 2010, the Government signed a Credit Agreement with the International Development Association (IDA) for the Housing Finance Project (HFP) and man-dated Bank of Tanzania as the project’s implementing entity.

The HFP initially received $ 40 million for a 5-year-project with the objective of expanding access to affordable housing finance under market-based conditions for the purchase, construction or improvement of housing.

And with such the Tanzania Mortgage Refinance Company Limited (TMRC) was born to provide long term liquidity to mortgage lenders to finance purchase, construction and renovation of homes.

When the project’s initial tenure ended in 31st March 2015 it was further extend-ed for an additional three years to 31st March2018 with an additional credit of $60 million provided to fill a financing gap of mortgages in Tanzania. The mortgagemarket in Tanzania has grown rapidly in recent years both in the number of loans and balances outstanding making it one of the fastest growing in the region.

Growth

Though the market started at a low base, a consistent growth at an annual rate of over 40 percent has been recorded of recent years. Data collected by Bank of Tanzania indicates that total mortgage lending by the banking sector has increased from Sh69.6 billion as at 30th September 2011 to Sh356.6 billion by 30th September 2015 recording a growth of 413 per cent over the four year period with the total number of loans growing from 590 as at 30th September 2011 to 5,289 as at 30th September 2015.

The ratio of outstanding mortgage debt to Gross Domestic Product (GDP) has also grown from 0.20 percent to 0.45 percent during the period between September 2011 and September 2015.

Annual growth rates of 46 per cent and 59 percent on mortgage lending by the banking sector were recorded in 2013 and

2014 whereas a 76 per cent growth rate was recorded in the 12 month period between 30th September 2014 and 30th September 2015.

Having kicked off with only three banks in 2010, by the end of 2015, 22 banks were offering mortgage loans with 12 having signed a partnership agreement with TMRC. More banks are set to join in 2016. Apart from the banks other non-banking mortgage institutions such as Mortgage which is supported by IFC investment in partnership with Bank M Tanzania Limited, HFDC India are set to enter the market.

The mortgage market is currently dominated by three large lenders who among them command over half of the mortgage business in the market. With new entrants launching products plus growing competition it is likely that other Tanza-nian financial institutions will consider making their presence felt in this sector.

The continuing projects by National Housing Corporation (NHC) through its 2010-2015 strategic plan focusing on high, medium and low income earners have continued to have a positive impact on the mortgage market.

Likewise, implementation of the Civil Ser-vants Housing Scheme by Watumishi Hous-ing Company (WHC) is in progress with the

first phase being focused on construction of houses in the administrative regions of Dar es Salaam, Coast, Tanga, Arusha, Mwanza, Shinyanga, Mtwara, Lindi, Tabora, Dodoma, Morogoro, Kilimanjaro, Ruvuma and Mbeya.

ChallengesDemand for housing and housing loans re-mains extremely high but is constrained by inadequate supply of affordable housing and high interest rates charged by banks.

The current housing deficit in Tanzania is estimated at three million housing units with 200,000 units annual demand. Most lenders offer loans for home purchase and equity release while a few offer loans for self-construction which for the most part continue to be expensive beyond the reach of the average Tanzanian.

The good news

Currently TMRC has 14 shareholders and member banks which include NMB, CRDB, NBC, TIB, Azania Bank, Exim Bank, BOA, DCB, BancABC, NIC Bank, PBZ, I&M Bank, NHC and Shelter Afrique.

These shareholders have contributed a to-tal paid up capital of Sh17.37 billion; these banks received a total of sum of Sh43.9 billion towards the end of 2015. Even with the challenges of a nascent industry TMRC broke even in its 3rd year of operations by making a marginal profit and continued to operate profitably in 2015.

TMRC successfully advocated for the change of Risk Weighted Capital from 100 percent to 50 percent, the company has also been a key promoter of the revised

Banking and Financial Institutions (Mort-gage Finance) regulations of 2015.

TMRC lobbied to ensure that funds bor-rowed from TMRC are excluded from the calculation of loan to deposit ratio by BOT.

TMRC has secured additional $40 million in funding from the World Bank as the in-stitution is getting close to exhausting the initial funding of $30 million.

These efforts have left a great impact on the industry as the mortgage market has continued to steadily grow, recording an annual growth rate of 59 per cent in 2014 compared to 46 per cent in 2013.

By 30th September 2015 TMRC lending to its member banks constituted 12 per cent of the total outstanding mortgage debt.

anzania’s population is one of the fastest growing on the continent, only rivaled by that of DR Congo and Nigeria which stand at annual growth of 3.7 and 6.7 million respectively.

With an annual population growth which is estimated at 2.9 million, the challenges of housing posses as a potential threat to urban and rural development in Tanzania.

Tanzania currently has a total of 9.3 million houses according to the 2012 census which brings current housing shortage in Tanzania is at 3,000,000 units with an annual increment of about 200,000 new demands. Tanzania’s housing backlog is the fourth on the continent where Nigeria ranks highest with 18 million followed by DR Congo with 4 million, then Egypt at 3.5 million in that descending order.

According to experts in real estate, the number of available houses includes the over 3 million substandard houses that are mud-walled and grass thatched.

For Tanzania to meet the current demands, something drastic has to be done to clear the grass thatched houses in the countryside; which at the moment stands at about one third of the total existing houses in the country. The situation is worsened by the fact that, the rate of construction does not meet the annual rising demand of homes in Tanzania and Africa in general.

According to a research conducted by Betoniq, without replacing existing houses that are

sub-standard, 10.6 Million houses have to be built in Africa annually to keep up with housing demands of the continent.

The current housing deficit in Africa is estimated at 64 Million houses, combined with an explosive population growth of 3.2 Billion people in the next 85 years requires a massive housing effort. However, even as developers make an effort towards narrowing this gap there are some glaring challenges that seems to stall the progress in solving this crisis.

Funding of major housing projects have been left in the hands of mainly private developers who are also faced with a myriad of shortcomings including taxation which in return makes the houses out of reach for the common citizenry.

Even with the introduction of mortgage financing in Tanzania through Tanzania Mortgage Refinanc-ing Company (TMRC) most citizens are still ignorant of the availability of such funding to enable them acquire such funds.

Most lenders offer loans for home purchase and equity release while a few offer loans for self-con-struction which for the most part continue to be expensive beyond the reach of the average Tanzanian.

The poor infrastructure, the ever rising prices of construction materials and huge compensations for the land in the areas where developers seek to invest is another challenge which in the long run pushes up house prices.

In a fast growing economy at an average of 6.3% as of 2015, the Tanzanian real estate sector has been flourishing with a great

demand of affordable housing. This great demand is greatly driven by the fast growing population in Tanzania which is estimated at t53.43 million.

TENANT Eviction and Procedure in Tanzania

Tenant is a person who occupies land or property rented from a landlord, and on that basis of occupation, there must be an instrument which govern that relations. That instrument under the law it’s called a contract/ agreement, but as the matter of being specific we all know them as lease agreement.

Lease is a contractual agreement by which one party conveys an estate in property to another party for a limited period, subject to various condi-

tions, in exchange for something of value, but still retains ownership.

A lease contract can involve any property that is not illegal to own commonly includes agreements for leasing real estate and apart-ments, manufacturing and farming equipment, etc. Leases are governed by statutes and byCommon Law, or precedential cases. Most leases are subject to state laws.

Generally, a lease may be writ-ten or oral, but a lease for certain types of property must be in writ-

ing and signed by both parties. For example, if a lessee seeks to lease real property (land or buildings) for more than one year, the lease must be in writing and recorded in a registry of deeds.

And all lease agreement have express written covenants and implied written covenants, for example in Tanzania, the Land Act no. 4 of 1999 on Part nine, subpart two provides for all implied covenants under the lease agreement, that means whatever has been agreed between the landlord and the tenants still there are the terms which cannot go against those implied conditions, unless those terms aimed to improve and provide more favor than what has been provided by the law. Practically, under the common

law, a court may void an unconscio-nable lease term.

A lease is unconscionable if it unduly favors one party over the other. For example, assume that, a small - business owner leases property for 30 years in order to operate a gas station. The lease contains a clause stating that, the lessor may revoke the agreement without cause and without notice. If the lessee performs his obligations under the lease, but the lessor revokes the lease without notice, the clause allowing termination without notice may be found to be unconscionable.

A determination of unconsciona-bility must be made by the court based on the facts of the case. The fact finder may consider factors such as the relative bargaining power of the parties, other terms in the lease, the purpose of the lease, and the po-tential loss to either party as a result of the terms of that lease agreement.

As I have mentioned from the beginning the relationship between the landlord and the tenants is governed by the instrument called a contract/ agreement and specifi-cally lease agreement and, based on that, the relationship can’t be ended just on jealous, hate, anger etc., in short the land lord cannot evict a tenant simply because he/she doesn’t like tenant.

A landlord, can evict a tenant before the lease or rental agree-ment ends, but he must have legal cause to do so. Eviction procedures vary from state to state, but every state allows the land lord to evict a tenant who fails to pay rent, who has violated terms of the lease or who has committed an illegal act (such as dealing drugs) on the premises of the rental unit. The reason for the eviction will determine the steps need to be taken.

There is a procedure for eviction and every state has slightly different rules and procedures regarding evictions, but the overall idea is the same in each state but under the common laws.

The common principles requires the landlord to give notice to the tenant before filing the eviction lawsuit, although the length of notice required may vary depending on the reason for the eviction and the agreement which have been entered between the parties involved. Also, the notice period should be reasonable enough to enable the tenants decide if he/she intends to search, relocate to another property or stay in the same property.

For instance, in Tanzania, for those rent defaulters or for those who have violated the terms of the lease or rental agreement, landlord must give the tenant not less than thirty days’ notice to pay the rent, for them to move out of the apartment before taking another measures which includes filing the eviction lawsuit. But important thing here is the notice. The notice must be delivered reasonably by the landlord for the matter to stand valid in court, eviction can never be done without it.

And according to our laws, notice aims to allow the tenant to come into compliance with the lease or rental agreement by either paying rent or stopping errant behavior. If the tenant complies, then eviction cannot be done. However, some-times depends with the kind of defaults made by the tenants, and it doesn’t matter if the tenant fixes the problem, landlord can still file the eviction lawsuit at the end of the notice period.

After the expiry of the notice period, then the landlord can file the initial paperwork to begin the eviction lawsuit, and still through the common law principle of right to be heard, the tenant will have an opportunity to respond to the claim raised by the landlord and the court will set a date for a hearing of the matter. At the hearing or trial, both landlord and the tenant will get an opportunity to talk to the court and present any evidence they may have. The tenant may have a defense against the eviction, in which case, the court could rule in the tenant’s favor. If that happens, then the landlord will just have to wait until the end of the lease or rental agreement to ask the tenant to move.

But if the landlord wins the eviction lawsuit, then the court will ask the tenant to move out of the rental unit by a certain date. If the tenant does not move, then the court will issue an order that gives the landlord the authority to use the

court brokers to remove the tenant by force on or after a certain date.

As it can be seen on this short article since the beginning where I talk about the legal relationship that exist between the landlord and the tenant, importance of giving notice, the court process, all of these aim to emphasize one point i.e. illegal evictions is not allowed nor entertained in the today world we are living in,landlords must follow the laws and rules set forth by the state when evicting a tenant. The eviction shall only occur after landlord have won an eviction lawsuit against the tenant, and the only person autho-rized to actually remove the tenant from the rental unit at that point by force will be the court broker.

Most if not all common law countries have made it illegal for landlord to force the tenant to move out through any other means, such as changing the locks on the doors or shutting off the utilities to the rental unit and, if the landlord try that illegal procedure, the ten-ant can sue the landlord and, the landlord could end up owing the tenant enough money for damages which includes but not limited to loss of earnings, privacy disruption, financial losses, family instabilities injury of reputations, loss of goods and items etc.

GALAXY ESTATE MANAGEMENT (GEM) was established 10 years ago in 2006.

The idea of starting a Property Management Company was float-ed to the owner by a friend seeing the boom of construction and the emergence of a lot of new buildings in Tanzania.

Property Management at that time (as it is even now) was an unknown business as the buildings in Dar es Salaam were mostly managed by the owners themselves and the pace of life was such that the owners could spare time in doing so.

With the boom of construction of new buildings and specially high rises, Property Management became a specialized and full time occupation.

But still the owners thought by appointing a manager they could manage their newly constructed properties.

It was at this right moment, we decided to venture into profes-sional services of Property Management.

When GEM was established, there were 3 or 4 major companies in this field and they were mostly concentrating on the Government Sector.

We decided to start with concen-trating on the private sector where these services were lacking.

We also decided that, we would start with smaller buildings so that

we could create a name for the Company as well as deliver quality and personalized service.

And this has been our motto since then. We have grown from a small company which was managing 10 apartments in a building in Upanga and now are managing some prestigious and big sized projects.

When we take over a Project, we take away all the headache of the Owners. Hence our services include

Collection of Rent and delivering to Landlords

Collection of Service Charges and using the same for Maintaining the Building and Managing the Services

Preparation of Lease Agree-ments Tenants and completing all the formalities with TRA including following up on Withholding Tax and Stamp Duty on Rents and Lease Agreements.

Following up on renewals to ensure that the Owners and Tenants are in a valid state of agreement

Preparing Fiscalised Invoices and issuing proper receipts when collecting the dues.

Collection of Generator, Elec-tricity Charges, Water Charges wherever applicable

We also manage all the Service Providers like Lifts, Bore-well, Generators, Utilities bills, Garbage Collection Companies, Cleaning Companies etc.

Besides this we also take care of the Property Tax, Land Rent and Fire regulations and payments of the Properties.

Besides this we also provide Main-tenance Services for the building.

Building is easy, but maintaining it is a mammoth task. We are seeing a lot of deterioration in buildings in Dar es Salaam, mainly due to poor maintenance.
