Proceedings

We began with a short welcome by KHRP staff, setting forth the purpose of the meeting: o Come up with ways to increase the flow and reliability of information coming from the

Kurdish region in Syria o Discuss the possibility for collaboration between the KHRP and the organizations

represented by the attendees o Discuss how to strengthen the work of the KHRP in Syria through collaboration

Introductions by guests Introduction to the KHRP

o Our primary concern: How to help people working on the ground in Syria o Our method: Taking cases before international bodies, such as the UN, CoE etc., so that

human rights concerns may be brought to an international forum o By investing in individual cases/ incidents, violations of group rights are made public o Problem: The Syrian government seems disinterested in addressing the violations against

Kurdish people within their borders o Possible Solution: Concrete work; for example, through parliamentary and legal bodies o Specific Problem: How can the KHRP develop a relationship between Syria/ Kurdistan

and our 60 lawyers We need concrete information, so we may follow up on possible claims For example, addresses for following up and getting people to appear before the UN Syria’s Kurds are the “forgotten Kurds”

o Overview of the human rights violations in Syria: Suppression of the Kurdish language Torture Killings Rape as torture Violation of property rights

Kurdish History o The point was raised that in order to understand the current situation for Kurds in Syria,

it is essential to understand the history of the Kurds o Currently, Kurds in Syria have no rights o The Syrian government has encouraged factions among the Kurds, to further strip them

of collective power KHRP Response

o The KHRP utilizes Kurdish history, but differently o We link backwards from the present:

Present discrimination (case of human rights violation) Reason for discrimination (the person was Kurdish) Reason Kurds are singled out (history)

The Kurdish Situation o The point was raised that there is a general lack of awareness of the situation for Kurds

in Syria, in the international community o Suggestion: A campaign for Kurdish human rights; with support from non-political

sources, such as academics The 2004 incident

o The question was raised whether it is possible to bring the Syrian government to court for this incident

The point was raised that there are not concrete statistics; on the Kurds in Syria o We need concrete statistics and documentation regarding:

Denial of Syrian documentation to Kurds Denial of citizenship Torture Killings

o One way of collecting statistics is by submitting cases, which require detailed information reports, so we may know when incidents happen. In collating those reports, it is most helpful to get in contact with the families of victims; the eventual building of a body of casework can provide independent & verifiable data

International Campaign o Can we have violations against Kurdish Syrians tried at an international level?

Deprivation of Property o There is a problem of gathering information regarding deprivation of property o Kurds maintain mostly agricultural land in Syria o Syrian citizens are not allowed to sell their homes to Kurds

Denial of Access to Health Care o Kurds without citizenship rights are not allowed to receive medical care from public

hospitals in Syria KHRP Publicity of Human Rights Violations

o The KHRP uses courts as the forum for bringing up issues of human rights violations. o For example, rape being used as a form of torture o As a result the court is able to see a pattern of behaviour and can make a ruling with an

eye to broader social and public policy goals Personal Account

o One attendee shared his personal story of observing persecution and torture while confined in a Syrian prison. He traced the history of the specific conflict that lead to the burning of the prison, with prisoners still inside, by Syrian officials.

Arabization of Kurds in Syria Genocide of Kurdish culture

o Syrian government has instituted discriminatory laws with the intent to suppress Kurdish language, religion and art

o In this way, the government has targeted the very identity of the Kurds o Policy of assimilation

Page 7: Newsletter of WKA in English 3 - Western Kurdistan · 2014-10-16 · BINXET, Newsletter of Western Kurdistan Association-London, No: 40 2 by the Kurdish Artist Walid Siti, will be

KHRP and Campaigns o The KHRP is not involved in campaigning. However, organizations are welcome to use

results obtained by the KHRP in their campaign work. o To our knowledge, there are no cases which have been brought on behalf of a Kurdish

individual, though violations abound. o Need for mechanisms to be used professionally, to open the channels of communication

between organisations representing victims, and the government The Human Rights Framework

o The KHRP addresses violations against the Kurds from a human rights framework o The KHRP does not engage in advocacy of political causes; that is for organizations to

do o How can other organisations create change?

Continuing Issues o Why are Syrian problems not addressed within a human rights framework? What are the

main obstacles? o Where can cases be tried? What is the proper forum?

Conclusion o The KHRP would like to chart a long-term course in addressing the violations

perpetrated against Kurds in Syria o While the KHRP does not involve itself directly in campaigns, it does engage in efforts

toward “public awareness” o Our method is not to take a single issue and campaign against it. Rather, by bringing the

case of an individual before an international court, the message is spread that Syria is not upholding its obligations.

o By publishing the outcomes of KHRP cases, and conducting fact-finding mission on the ground, information is generated that can be used by campaigns.

o KHRP does not have enough contact on the ground. o Is this possible (question posed to the group)? Are we realistic?

We must remember that Syria is not governed by rule of law. It is difficult to get cooperation, as the secret service will attack informants and their families.

It is dangerous for families to report abuse/ torture/ killings If we look back at the situation the Kurds in Turkey faced during the 1980’s, and the

progress made in protecting their rights, we should see that there is hope for similar progress for the Kurds in Syria.

Action Points

• Attendees to get in touch with Mr Osman Suoor, KHRP’s Iran/ Syria Desk Officer about whether they believe any of the following are possible/ desirable:

o When organisations learn of specific cases of human rights violations in Syria, can they either obtain contact information for the victim and/or his/her family or get the necessary info for a case to submit to the relevant international body with the KHRP (KHRP’s Legal Director, Ms Catriona Vine and Mr Osman Suoor, can provide the general types of questions that need to be asked, attached, pls see a sample)

o If organisations think this is possible, can it be agreed that they will contact the KHRP directly and work out an action plan

o Are there any organisations willing to organise a fact-finding mission to the region that would allow us to meet with those facing repression, whether they be in the Kurdish regions or elsewhere

o If the above possible, how practicably is this possible? What is proposed? Flying to Damascus? Going across the border? Etc? What concerns would there be for those interviewed and would it place them in further danger?

o If organisations are able to provide more concrete and verifiable cases, then would they be interested to do share ‘awareness-raising responsibilities’ meeting with European governments/bodies, the UN, etc

New Book (Collected Works 446pages) of Dr Jemal Nebez printed in the capital of Kurdistan Hawler, bellow its cover and the Introduction in English and Kurdish to

this book, which gives an idea about it, written by Dr Jawad Mella:

Introduction in English to this publication My teacher and comrade in the liberation struggle of the Kurdish people, Dr Jemal Nebez, has asked me to write an introduction to this book which I gladly do as it gives me the opportunity to thank him for his kindness and trust. This book is part of a series. The articles collected here all first appeared in the Kurdish newspaper, Media of Hawler between 1999 and 2007. Since this introduction is in English, I should like to mention that Jemal Nebez is known as the founder of the general lines of the Kurdish school of socialism, known as KAJYK-thought. He was born in the city of Sulaimani in Southern Kurdistan, known as the city of attack on tyranny and sacrifice for freedom. Nebez himself has always lived accordingly, applying all his might to the Kurdish liberation by way of critical thought, explaining his ideas in a great number of meetings and seminars - in Kurdistan as well as in many European cities, and in beautiful Kurdish easy to the ears of all Kurds. This, I must say, in addition to his numerous writings which also never stop getting the truth to the masses since they are always based on deep analyses of events and circumstance, beyond all personal, partisan, tribal and religious interests. Jemal Nebez, this great Kurdish thinker, has managed to predict so much, and is so infallible in his judgement, because it is the liberation of the Kurdish nation as a whole that he has in mind when dealing with so many different aspects of Kurdish politics, culture and life, as this collection of articles demonstrates well.

Page 14: Newsletter of WKA in English 3 - Western Kurdistan · 2014-10-16 · BINXET, Newsletter of Western Kurdistan Association-London, No: 40 2 by the Kurdish Artist Walid Siti, will be

BINXET, Newsletter of Western Kurdistan Association-London, No: 40 14

Still, the articles in this book contain an accurate picture of the events in Kurdistan. Nebez would not let any event pass without a thorough investigation of its historical background, including the positive as well as the negative sides, including the good as well as the bad, because Nebez is not hypocritical. The articles of Nebez are not only stories of realistic events but they are a written history of the Kurdish people for the times they cover. He is thus a neutral and just historian. That does not mean that he is impartial towards his homeland and people. On the contrary and moreover, in his thinking he is always inclusive, not taken in by any Kurdish partisan, tribal and regional disputes. There are a lot of other names besides Jemal Nebez in the Kurdish liberation movement, many of them empowered by billions of dollars or even armed forces. However, I regard Jemal Nebez’ intellectuality the more powerful, because his continuous liberation stance has become an indestructible force. Finally, I hope I have given this selfmade liberal thinker of truly national stance, Jemal Nebez, our teacher and comrade, his due, and I ask God to give him more power and old age to add more to what he has already achieved. Anyone who reads this part of his works or other parts will know what I have referred to in this brief introduction. The famous Kurdish poet: Seyde Cigerxwîn

Cigerxwîn ("The bleeding heart") is a pseudonym for Sheikmous Hasan. He came from northern Kurdistan, born in 1901 or 1903 in the village of Hesar close to the city of Mardin, at that time within the Ottoman Empire. In 1914, with the beginning of World War 1, his family became refugees and fled to Amude near the city of Qamishli in present-day north-eastern Syria. Seyde Cigerxwîn studied theology and became a cleric in 1921. In 1948 he joined the Communist Party of Syria and became a candidate for parliament in 1954. He left the party in 1957 to create the Azadî (Freedom) organization. Later, this new party was united with the Kurdish Democratic Party of Syria. He was arrested and jailed in Damascus in 1963 and exiled to the city of Siweyda. In 1969 he moved to Iraqi Kurdistan, where he took part in the uprising. In 1973 he fled to Lebanon where he published the collection Kîme Elishedz? (Who Am I?). And that is where this poem is from. There are many names here. Richard Lionheart and Saladin and Medes and Ardashir and the Shah of Persia, the blacksmith Kawa and Marx and Zoroaster and many, many more. A reader can go to a lexicon and find them all explained. But even without doing so the poem is deeply moving. It moves with the movement of history and of the people from the past to our own time and into a future that may or may not be. In 1976, Seyde Cigerxwîn returned to Syria, but three years later, at the age of 75 or 76, he had to flee again. To Sweden where many collections of his poems were

published. At 80 or 81, Seyde Cigerxwîn passed away. He was brought back to Kurdistan, to his home in Qamishli. And there, he still is with us.

Who am I?

is a Poem of Seyde Cigerxwîn Who am I, you ask?

The Kurd of Kurdistan, a lively volcano, fire and dynamite

in the face of enemy. When furious,

I shake the mountains, the sparks of my anger are death to my foes.

Who am I?

I am in the east, forts and castles

towns and hamlets, rocks and boulders,

What irony, what a shameful day ! A slave I am now for blood suckers

yet I saved the Middle East from the Romans and the crusaders.

Who am I?

Ask the Near East Ask the Middle East, villages and towns, plains and deserts.

They were once all mine, when by war and knowledge

I defeated rivals to become crowned over an empire stretching to the borders of India.

Who am I?

I am the proud Kurd, the enemies' enemy,

the friend of peace-loving ones. I am of noble race,

not wild as they claim. My mighty ancestors

were free people. Like them I want to be free

and that is why I fight for the enemy won't leave in peace

and I don't want to be forever oppressed. Who am I?

I shall free my land

from the tyrants from the corrupt Shakh and Mollas,

from the Turkish juntas so we may live free like other nations,

so my gardens and meadows are mine again;

So I can join the struggle for the good of mankind.

Who am I?

It was I who defeated Richard Lionheart

My own blood I shed to defend these regions.

A thorn I was in my enemies' side in my shadow lived the Arabs, Turks and

Persians many a king held my horse's head.

Yes I am the warrior I am Saladin

the King of Egypt, Syria and Israel. Who am I?

I am Ardashir,

I am Noshi Rawan. In the ancient days

rivals feared my Caesars regretted my animosity.

I knew no fright; in love with adventure from India to Greece they paid me tribute.

Who am I?

Yes, I am the Kurd the Kurd of Kurdistan

who is poor and oppressed today. My castles and forts are now demolished;

my name and my fame swindled by my assailants,

those who set germs into my body to paralyze my existence

making a nameless soul of me; a nation with no friends.

Who am I?

I am the one who despite it all remains the unyielding Kurd still formidable to the enemy.

The smell of dynamite is again in my nostrils

and in my heart the strong desire to erupt. I am the fighting valiant of mountains

who is not in love with death but for the sake of life and freedom

he sacrifices himself so that the land of his ancestors,

the invincible Medes, his beloved Kurdistan, may become

unchained. Who am I?

One of my ancestors was the Blacksmith

Kawa who slayed Dahak, the notorious tyrant

to break off chains from Kurdish shoulders and save many heads from the sword and

Page 16: Newsletter of WKA in English 3 - Western Kurdistan · 2014-10-16 · BINXET, Newsletter of Western Kurdistan Association-London, No: 40 2 by the Kurdish Artist Walid Siti, will be

death. The day his vicious reign ended

was called Newroz, the New Day. When Newroz comes winter departs taking with it the dark harsh times

to make place for light and warmth. This is the time, as Zoroaster says the evil spirit Ahriman is defeated

at the hand of Ormazd, the god of wisdom and light.

Who am I?

I am the maker of Newroz; again I shall become my own master,

the ruler of my land so I may enjoy the fruits of my orchards, relish the sacred wines of my vineyards

and put an end to a dark era by seeking salvation in knowledge and

science; I shall make another new day

and breathe the pure air of the liberty. Who am I?

I am Kordokh, the good old Khaldew;

I am Mitan; Nayri and Sobar; the son of Lo Lo; Kardok and Kodi;

I am the Mede, the Gosh, Hori and Gudi; I am the Kurmanc, Kelhor; Lor and Gor; yes, I have always been and remain the

Kurd. Despite centuries of suppression

in a country by force divided. Who am I?

I am the son of Lor, Kelhor and Kurmanc

who have lost crown and reign to become powerless,

betrayed in the name of religion

to carry rosaries in their hands duped by the rulers,

deprived of might and wealth, fighting each other, divided and torn

while my oppressed Kurdistan, my wretched Kurdistan

remains repressed. Who am I?

The son of the Kurdish nation

awaken from deep sleep, marching forward,

proud as a lion wanting the whole world to know;

I shall struggle and continue the path to freedom;

I shall learn from great men Like Marx and Lenin.

I make a vow to my ancestors, to Salar, Shergo and Deysem,

that this of mine will remain vigorous, unyielding, stronger than death.

Let it be known I announce with no fear;

Liberty is my goal; I shall advance in this path.

Who am I?

I am not blood thirsty, no, I adore peace.

Noble were my ancestors, sincere are my leaders.

We don't ask for war but demand equality but our enemies are the ones who betray

and lie. Friendship I seek and offer my hands

to all friendly nations. Long live Kurdistan;

death to the oppressor!
