Republic Act No. 10157 THE KINDERGARTEN EDUCATION ACTPursuanttotheprovisionofSection9ofRepublicActNo.10157,"AnAct InstitutionalizingTheKindergartenEducationIntoThe BasicEducationSystemAnd Appropriating Funds Therefor",otherwiseknownastheKindergartenEducationAct",approvedonJanuary20,2012,andwhichtookeffectonMarch14,2012,conformablytoSection12thereof,theDepartmentofEducation,inconsultationwiththeDepartmentof BudgetandManagement,herebyissuesthefollowingrulesandregulationstoimplementthe provisionsoftheAct.

Republic Act No. 10157 Rule I. GENERAL PROVISIONS

Section1.Title.Theserulesandregulationsshallbereferredtoasthe"'ImplementingRulesandRegulations ofRepublicAct10157,otherwiseknownastheKindergarten Education Act".

Section2.DeclarationofPolicy.-Theserulesshallbeinterpretedinthelightofthe Declaration of the Policy found intheSection2of theAct:

Section4.Institutionalizationof KindergartenEducation. PursuanttoSection4of the Act, kindergarten education is hereby institutionalizedaspartofbasiceducationandforS.Y. 2011 2012 shall be implemented partially and thereafter, itshallbemademandatoryandcompulsoryforentrancetoGrade1.

Section5.MediumofInstruction.-PursuanttoSection5oftheAct,theMotherTongue-BasedMultilingualEducation(MTB-MLE)methodisherebyadopted.Themothertongueof the learners shall be the primary mediumofinstructionforteachingandlearning inthe kindergarten level in public schools.

However,exceptionsshallbemadetothefollowing cases;5.1.Whenthepupilsinthekindergarten classroomhaveadifferentmothertongue orwhensomeofthemspeakanothermother tongue;5.2.Whentheteacherdoesnotspeakthe mothertongueofthelearners;5.3.Whenresources,inlinewiththeuseofthe mothertongue,arenotyet available;and5.4.Whenteachersarenotyettrainedonhow toimplementtheMTB-MLEprogram.

Section8.KindergartenCurriculum.-PursuanttoSection7.2ofthisIRR,the DepEd throughtheBEE,shallcontinuetodevelopaKindergartenEducationGeneralCurriculum(KEGC).Thecurriculumshallincludestandardsandcompetenciesexpectedoffive-yearold children along developmental domains. It shallfocusonthechild'stotaldevelopment according to his/her individual needs and socio-cultural backgroundThecurriculumshall likewise promote the delivery of complementary,integrativeservicesforcognitivedevelopment,healthandsafety,care,nutrition,sanitation,psycho-socio-emotional,culturalandvaluesformationactivities;

InfurtheranceofSection4.1.1ofthisIRR,thecurriculumshallbeinclusiveto addresstheuniqueneedsofdiverselearners,amongthem:8.1.HeadstartCurriculumfortheGifted 8.2.EarlyInterventionCurriculum8.3.KindergartenMadrasahCurriculum8.4.IndigenousPeoplesEducation Curriculum8.5.Catch-UpKindergartenCurriculum

Section9.InstructionalSupport.-PursuanttoSection6oftheAct,theDepEdshallprovide basic instructional support to kindergarten classesinpublicschools.Forthispurpose,theinstructionalsupportshallinclude,butshallnotbelimitedtothefollowing;9.1.BasicInstructionalMaterialsfor KindergartenEducation.

9.2.PhysicalFacilities.

Section10.HiringandDeployment.-PursuanttoSection7(e)oftheAct,inadditiontotheguidelinesforhiringissuedbytheSecretaryoftheDepEd,akindergartenteachershall have at least18unitsofEarlyChildhoodEducation(ECE)oritsequivalentunitsas determined by theappropriateagency.

Section11.ProfessionalDevelopment.- TheDepEdshallcontinuetodevelopasetofstandardsforKindergartenteachers.

Republic Act No. 10157 Rule VI. AUTHORITY OVER THE OPERATION OF PRIVATE KINDERGARTEN INSTITUTIONS

Section12.PursuanttoSection6andSection7(f)oftheAct,theSecretaryoftheDepEd shallhavetheauthoritytoregulatetheorganization,operationand/orimplementationofthe kindergarteneducationprogramofbothpublicandprivateschools.Section13.Privateinstitutionsmayofferkindergarten educationonlywhensoauthorized bytheDepEd.

Republic Act No. 10157 Rule VI. AUTHORITY OVER THE OPERATION OF PRIVATE KINDERGARTEN INSTITUTIONS

Section14. The Regional Director shall have the authority,responsibility and accountability in approving theestablishmentofprivatekindergarteninstitutionand ensuring compliance of the school to the national educationalpolicies,plansandstandards.Section15.TheDepEdshallprescribetheguidelinesonthe issuanceofpermittoand/or recognition of kindergarten schools, and revocation thereof through theRevisedManualof Regulations for PrivateSchoolsinBasicEducation.

Republic Act No. 10157 Rule VII. TRANSITORY PROVISIONS

Section16.ForSY2012-2013and2013-2014,thefollowingprovisionsareherebyadopted:

16.1.ThecompletionoftheKindergarten SummerProgramortheEarlyChildhood ExperiencesinGrade1Programshallbe deemedsufficientcompliancewith therequirementofkindergarten educationforentrancetoGrade1 asstipulated intheAct.

16.1.1.KindergartenSummerProgram. 16.1.2.EarlyChildhoodExperiencesinGrade1 Program16.2.HiringofVolunteerTeachers.- TheDepEdshallengagetheservicesof volunteerteacherstohandlekindergartenclasses.

Section17.Privateentitiesofferingfreekindergarten educationshallbeallowedtooperate for a periodoftwoyearsfromthedateofeffectivity oftheseRules.Thereafter,said institutions shall ceasetooperateunlessauthorizedbythe DepartmentofEducation.

Republic Act No. 10157 Rule VIII. MONITORING & EVALUATION

Section18.TheDepEdshallenhancetheexistingmonitoringandevaluation(M&E)system for the kindergarteneducationprogramforbothpublicandprivateschools.BEEshall collaborate with the OfficeofPlanningService(OPS)fortheidentificationofcommon indicators to be monitored.

Section19.RegionalDirectorsandSchoolsDivision Superintendentshallensurethat: 19.1.Allschoolsofferingkindergartencomplywith theDepEdpoliciesand guidelines in accordance withthisIRR,

19.2.Existingguidelinesonthedeploymentofkindergartenteachersarestrictlycompliedwith.Section20.Forpurposesoftrackingtheprogressofthelearners,theDepartmentof Education shall assignaLearnerReferenceNumber(LRN)toeachchildinkindergarten.

Section1.Title.TheserulesandregulationsshallbereferredtoastheImplementing Rules and Regulations(IRR)ofthe"EnhancedBasicEducationActof2013"(Republic Act No. 10533)Section2.ScopeandApplication.TheprovisionsofthisIRRshallprimarilyapplyto all public andprivatebasiceducationalinstitutionsandlearningcenters.ThisIRR shall apply to Higher EducationInstitutions(HEIs),Technical-Vocational Institutions(TVIs),dulyrecognized organizationsactingasTeacherEducation Institutions(TEIs),andfoundations.
