Goods Sold for Export Only

(a) The Goods specified in the List are only for export to a destination other than Macau and the Mainland

China in full container load and direct export.

(b) The successful buyer shall export the Goods to a destined country (other than Macau and the Mainland

China) in one consignment within one month from the date of payment against the Demand Note or

Payment Instruction issued by the Government Representative.

(c) The successful buyer must seek prior consent from the Permit Office for loading or vanning of the Goods

into container.

(d) The loading or vanning of the Goods into container must be under the supervision of the Government

Representative(s). The successful buyer must make prior appointment with the Permit Office for

Customs attendance to supervise loading or vanning of the Goods.

(e) The Government Representative(s) shall be entitled to affix any seals to the container before the Goods

are exported. The successful buyer shall not break or interfere with the seals. The successful buyer shall

also take reasonable steps to prevent the seals from being broken or interfered with.

(f) The successful buyer must notify the Permit Office in writing, at least 7 working days before removing

the Goods for export, together with relevant supporting documents of the following information:

(i) name of the exporting carrier;

(ii) date, time and location of departure of the exporting carrier in Hong Kong;

(iii) port of entry at the destined country; and

(iv) scheduled date of arrival of the carrier at the destined port of entry.

(g) Verification of loading may be carried out by the Government Representative(s)* when the Goods are

loaded onto the exporting carrier.

(h) The successful buyer must produce to the Permit Office a landing certificate issued by the relevant

government authority of the destined country OR a document proving the landing of the Goods and

certified by a person who is the owner of the exporting carrier as defined in Section 2 of the Import and

Export Ordinance (Cap. 60)** within 14 working days after arrival of the Goods at the destined country.

(i) In accordance with Chapter 106 of the Telecommunications Ordinance, Radio Dealers Licence

(Unrestricted) is required by a company/firm in Hong Kong to possess and deal in the course of trade or

business in apparatus or material for radiocommunications or any component parts thereof (hereinafter

called "the Licensed Apparatus"). In addition, the licensee is authorised to import and export

radiocommunications transmitting apparatus.

(j) The successful buyer fails to comply with above clauses of Special Conditions shall constitute as a

material breach of the Contract, the Government will initiate the action in accordance with the Clause 5

of Terms and Conditions of Sale under Notice of Auction. * The successful buyer is required to notify either the Duty Office of the Containerized Cargo Support Unit of Ports and

Maritime Command if the Goods are to be exported by sea or the Duty Office of the Air Cargo Group of Airport

Command if the articles to be exported by air.

** In Section 2 of the Import and Export Ordinance, owner in respect of a vessel, aircraft or vehicle means – (i) the

registered owner and any person holding himself out to be owner thereof; (ii) any person acting as agent for the owner

in connexion with the handling of cargo carried in or on the vessel, aircraft or vehicle; (iii) any person to whom the

vessel, aircraft or vehicle has been chartered or hired; and (iv) any person having for the time being the control or

management of the vessel, aircraft or vehicle.

(b) 投得貨品人士在按政府代表發出的繳款通知書或付款指示付款當日起計一個月內，須將貨品全數

整批付運到出口的目的地國家（不包括澳門或中國內地）。

(c) 投得貨品人士必須事先獲得許可證辦事處同意，才可將貨品付載或裝箱到貨櫃內。

(d) 將貨品付載或裝箱到貨櫃內時，必須由政府代表在場監督。投得貨品人士須事先與許可證辦事處

預約時間，以便海關到場監督貨品的付載或裝箱工作。

(e) 在貨品出口前，政府代表有權在貨櫃上貼上任何封條。投得貨品人士不得破壞或干擾封條。投得

貨品人士亦應採取合理步驟防止封條遭破壞或干擾。

1. The successful bidder must first visit our Cheung Sha Wan Seized Goods Store at 5/F,Wang Cheong

Building, 783 Lai Chi Kok Road, Kowloon by contacting Ms. YIP at 2725 5703 for completion of

documentation before collection of vessel.

2. After completion of documentation, the successful bidder must give at least 24-hour advance notice to

Mr. LAI, Senior Inspector (C&ED) at 2307 0654 or 2745 3157 and the Duty Inspector (Marine

Department) at 2792 6245 for the arrangement to collect the vessel.

3. Vessels are sold as they are and with no warranty that they comply in any respects with the provisions of

any enactment relating to the construction and use of vessels. The successful bidder acknowledges that

all the vessels shown are confiscated vessels and these vessels sold by auction may not be registered or

licensed for use in Hong Kong.

4. All goods are confiscated under the laws of Hong Kong. These goods are sold with all faults and

imperfections and errors of description. Illustrations in the Auction List are for general identification

only. Bidders should satisfy themselves prior to the auction as to the condition of the goods. Any

statement by the Auctioneer as to the goods is a statement of opinion only and every bidder should rely on

his own judgement as to all matters affecting the goods. Neither the Government nor the Auctioneer,

3. 船隻是以其現有情況出售，政府不保證拍賣船隻在各方面俱符合每一項有關船隻構造及使用的法

例規定。承購人知道所有開列於拍賣物品清單內的船隻乃屬於充公船隻，該等以拍賣方式出售的

船隻將不獲登記或發牌在本港使用。

4. 所有貨品均為根據香港法例充公的物品。該等貨品出售時附有各種缺點、瑕疵及貨品說明的錯

誤。拍賣物品清單上的說明只作一般識別用途。在拍賣進行前，競投人須令其本人信納貨品的狀

況。拍賣行就貨品作出的任何陳述只屬意見陳述，一切涉及該等貨品的事宜，各競投人均須依靠
