WEDNESDAY 8TH JUNE AFTERNOON SESSION

(SPEAKER IN THE CHAIR)

PRAYERS.

COMMUNICATION FROM THE CHAIR.

Speaker: Hon members I wish to welcome you back from the short recess… Today is almost

our last session. In the national assembly today they are reading the budget. We shall be

reading ours in due courses and I urge the committee concerned to be vigilant so that we meet

the deadline of 30th of this month. I shall be delivering two rulings: 1) one on the bills in

response to the concerns raised by Hon Milimo and 2) I shall also be writing a rulling on the

next session on a very comprehensive ruling on the statements. I am informed by the office of

the clerk that we have quite a number of statements and before we table them in this county

assembly I would like to give a ruling as per the procedure in handling them. I also wish to

request that the Hon Njoroge will be holding brief tomorrow as I will be attending to small

matters and then I shall be back.

MOTION.

Motion on purchase of fresh farm produce by supermarkets from Trans Nzoia farmers

by Hon Peter Osiako.

Hon Osiako: Mr. Speaker sir I beg to move the following motion.

Aware: that Trans Nzoia County is the bread basket of the country in production of cash

crops, food crops and horticultural products.

Further aware: that some of these products are sold in the supermarket for example

tomatoes, pepper, onions, vegetables etc.

Deeply concerned that our farmers produce these products yet the supermarkets in Kitale

town buy the said products from other counties and some are imported from other countries.

Further aware: that it is the mandate of our government to ensure excellence and economic

empowerment of our farmers and to motivate them which includes finding market for their

farm produce.

Mr. Speaker sir this house urges the county government to develop guidelines

/policies/regulations to ensure that the supermarkets in the county buy fresh produce from

local farmers.

Mr. Speaker may I move this motion briefly and then our Honorable members may also

debate on this issue which is affecting most of our farmers in this county. We are living in a



county that is arable and that the main work that our people from this county do is farming

and whatever they produce from their farms Mr. speaker they find it difficult to take it to the

market Mr. Speaker. Other counties are also avoiding farm produce to be transported to their

areas which brings a challenge to them. Mr. Speaker all this supermarkets in this county Mr.

Speaker you will find that they are personal supermarkets. Some farm produce are brought

from as far as Karatina and other areas in Kenya central places which denies our farmers a

ready market to sell their farm produce. I am wondering what’s happening why should such

farm produce be brought from that far? Mr. Speaker this has affected most of our farmers

denying them market for their produce Mr. Speaker. Mr. Speaker that is actually what I can

say and I beg all the members to contribute so that in the end of this Mr. Speaker we can

protect our hardworking people the farmers. Thank you.

Speaker: What is it the Hon Dorcas?

Hon Dorcas: I beg that you advise us on whether Hon Farid is properly dressed to be in this

house. I know he is in his religious regalia but it goes up to his feet.Mr Speaker I want you to

help us understand this.

Speaker: Yes can I be guided Hon Nyarango on whether it’s ok ?

Hon Nyarango: Thank you Mr. Speaker, I think that it’s a tradition that even in parliament

during Ramadhan members are allowed to dress like that in parliament he is properly dressed

he’s ok, its allowed Mr. Speaker.

Speaker: The Hon Kutitila I just want to know whether it’s in order for the member is

allowed to dress the way he is dressing.

Hon Kutitila: Mr. Speaker I want to concur with my colleague that this is their month of

fasting and when they fast Mr. Speaker they normally dress like this and I hope he will not

dress like this after Ramadhan .We can just allow him because they normally dress like that.

Speaker: I shall release the clerk temporarily to go and find out from the National parliament

regulation and come up with a report before I can make a decision. Our clerk should go and

call the clerk of the national assembly to find out whether that form of dressing is allowed.

Hon Nyarango: Thank you Mr. Speaker, I hereby first stand to wish our Muslim brothers

Saum Makbul and I also want to contribute to this motion Mr. Speaker. I just read this

motion. In my opinion this is like somebody who is trying to climb a tree from the middle.

Mr. Speaker if you wanted to climb a tree you start at the base. This is because Mr. Speaker

the produce that we have in this County, those people who produce fruits do not produce

enough. The production is not sufficient for a supply as it were in a supermarket. In a

supermarket Mr. Speaker they would like to have producers, they tender for the supply of

fruits and vegetables and they only give the tender to somebody who will supply each and



every day year in year out. Mr. Speaker, here in Trans Nzoia we have gone first to our

farmers and tried to show them what happens, what type of crops they are supposed to grow.

Mr. Speaker from my understanding is that the fruits and vegetables that we get from the

supermarket are fruits and vegetables that have a certain standards even some amounts of

pesticides are not allowed in the supermarket Mr. Speaker, there are crops we grow as

laymen nobody checks whether we have used a certain amount of insecticides Mr. Speaker

nobody checks whether we have used the right amount of insecticides and whether the

vegetables are safe. I said we are climbing the tree from the middle because we have to get

our farmers to know why those farmers in Karatina and Nyeri and whatever place they supply

to the supermarkets. You can see we have a farmer from the Suam Orchard but they don’t

supply to our supermarkets, they take their fruits outside this Country because their fruits

have attained the international standard of taking their fruits outside there. Mr. Speaker I

would urge the mover of this motion to may be think and rewrite and say that we want our

farmers to supply to supermarkets not only around here but even supermarkets outside Trans

Nzoia by knowing how the suppliers work, what amount of pesticides they use and how they

can irrigate their plants year in year out throughout the year Mr. Speaker. Thank you.

Hon Kutitila: Mr. Speaker I want to support the motion, I want to support the motion

because they say charity begins at home, you cannot tell us that we shall educate our farmers

that the fruits from this County are not worthy, the potatoes of this County do not qualify,

they don’t have the standards. Mr. Speaker the same potatoes which we normally buy outside

is the same potatoes we take to the supermarket. So when Hon Nyarango tells us that the

standard of the fruits and the potatoes of this County are not worth he is not saying the truth.

Mr. Speaker what the mover of the motion is saying is that we should have a policy, that we

make sure that the farmers of this county also benefit Mr. Speaker but if we don’t do that Mr.

Speaker that is the time the supermarkets and others will bring goods from outside this

county yet we have the same commodity from this county Mr. Speaker. That is why we say

we are the food basket of Kenya and at the same time, the same people are suffering Mr.

Speaker they don’t attain anything enough to sustain their families and even to grow Mr.

Speaker. What is lacking Mr. Speaker is policy that is why Anderson is looking for the

market outside Mr. Speaker and the same commodity is by passing ready market here Mr.

Speaker because we don’t have that policy in place. That is why these supermarkets are

getting food from outside and that is why they don’t want to employ our kids Mr. Speaker

from this County because they don’t bother. You will find out that Mr. Speaker on the side of

Tuskys when we wanted to demonstrate and then they convinced us that they will employ

people from this county but at the end of the day they lie to us just like that. So on the sides

of food and commodities and even on the side of employment Mr. Speaker so that this county

can also benefit from these people who are also collecting a lot of revenue and money from

our people Mr. Speaker. You will find out that we have potatoes and even cabbages from

farmers here but you will find some Lorries coming from outside this County bringing the

same commodity here. When you go outside there you will find Lorries bringing cabbages to

supermarkets around here. They are even bringing sugarcane Mr. Speaker yet we have the



sane sugarcane here. Is it that our sugarcane and cabbages don’t meet the standards? Mr.

Speaker we cannot allow that and as leaders of this County we need to protect our farmers

Mr. Speaker. Thank you, I want to support the motion.

Hon Terry: Thank you Mr. Speaker sir I stand to support this motion also in totality. Mr.

Speaker sir you realize that in Trans Nzoia is where we have the headquarters of Kenya Seed.

Trans Nzoia County has been planting and doing agriculture all along and from here we get

seeds like for carrots and cabbages and when you look at the small farmers Mr. Speaker sir

they are now planting small things like vegetables and they are using organic methods of

farming. When you use organic method in farming Mr. Speaker sir you get healthy

vegetables like cabbages which are heavy and healthy than what we are getting from out

there. When we talk about fruits our fruits are healthier t because we are not using GMO. Out

there what they want to bring to the supermarket in Trans Nzoia you realize that these are

GMO products which grow in a short period within two to three weeks. Mr. Speaker sir the

products are cancerous. Why can’t they take what we have from our small scale farmers?

Right now the farms have been demarcated we have points, let them take our carrots let them

take our cabbages let them take our sukuma wiki Mr. Speaker sir before they look for

markets outside because what we have here Mr. Speaker is healthy food, the rest that is

coming here is not healthy at all so i support this motion in totality.

Speaker: Thank you the Hon Terry Masibo. Just a small ruling having consulted the Hon

Hussein Farid is in order for him to put on like he is.

Hon Mutuli: Asante Sana Bw. spika kwa kunipa fursa.Kwanza kabisa kwa hii hoja mimi

nilikuwa naona kwamba ndugu yangu Farid angetoka nami ningeenda. Hoja hii mimi napinga

kwanini naipinga,kwa sababu kwa wakati huu tuko na kitu kinaitwa soko huru.Na soko huru

hatuwezi lazimisha mkulima apeleke kwa masoko ambayo yako hapa na hayo maduka

munayasema ni machache sana kwa sababu tunaangalia hapa Nakumatt na ingine inaitwa

Tuskys.Kwa hivyo iwapo tutalima mimea yetu na tuangalie ya kwamba mimea yetu inaenda

kwenye soko hizi ambayo tumetaja tutaona ya kwamba hizi soko zitakuwa chache sana

kulingana na ile mimea ambayo tunakuza kwenye kaunti ya Trans Nzoia. Kwa hivyo

ningesema ya kwamba hata ukiangalia kiwango ya mimea hii haitakuwa ya kiwango ya

kupeleka kwa yale masoko ambayo tumetaja hapa.Kwa hivyo tumesema ya kwamba tukiwa

na soko huru tungetaka sisi wakulima tuje na vyama vya ushirika ili ya kwamba tukichangia

katika vyama vya ushirika mimea yetu itapata soko hata nje kuliko kusema ya kwamba

ipelekwe kwenye haya maduka machache ambayo yako katika mji huu.

Speaker: What is it the Hon Kutitila and you inquire whether the Hon Mutuli would like to

be informed?

Hon Kutitila: Mr. Speaker the motion itself is not forcing the farmers to sell to the

supermarkets but we are putting condition to supermarkets that they should buy goods from



our people first before they get goods from outside but we are not forcing our farmers Mr.

Speaker. That is what I wanted to inform the member. Thank you.

Hon Mutuli: Asante sana Mheshimiwa Kutitila kwa uerevu na ukakamavu wake akiwa

Mheshimiwa anaelewa sana ndio umesema vizuri lakini mambo ya biashara lazima tutakuwa

na sera lazima utaona ya kwamba watu watatafuta pa kuuza mazao yao mahali

wanapenda.Isiwe jambo la lazima vile tunafanya mambo katika wilaya hii tuwalazimishe .Na

je nauliza iwapo soko hizi zinapendekeza kwa wakati huu ikuwe tuko na soko ingine hapa

Uasin Gishu na inalipa zaidi kuliko ya hapa mutalazimisha wakulima wapeleke hapa ama

pale wanapenda kuuza.Asante bwana spika.

Hon Njoroge: Thank you Mr. Speaker, first I would like to take this opportunity to salute

each and every one of you good afternoon. Secondly Mr. Speaker I would like to thank you

sincerely because you sent me to represent you in the national prayers and I really thought it

wiser to share what was talked about in the prayer meeting. The basic thing that was there

was us trusting in ourselves and actually trusting one another. We need to know that we need

to trust one another and we ask ourselves are we trust worthy so that we can have a very good

nation in moving forward together. I would like to say that I am opposed to this motion that

am so much in agreement with the spirit which is in the motion but if you go to the details

you will find that there are several areas you need to consider before we move to this

direction. First in agriculture we have a principle we ask ourselves what we produce and

when to produce how to produce .Those are the three basic things that guide us .When it

comes to marketing, marketing is a factor that we consider in production and when we are

talking about marketing there are several things that we also need to consider in agriculture.

First of them all is the quality of the product. Secondly is about the money, how much are we

selling and also like it’s been said we are in a free market economy whereby we cannot force

somebody to go there and there. This is a free market economy we cannot go contrary to that

we cannot really force our farmers to sell to the supermarkets that are around.

Speaker: If I may just seek a clarification the Hon Njoroge is there anything that can be

grown in Transport and somewhere else you are an agricultural person you can tell us

whether there are crops that can be grown in Trans Nzoia other than somewhere else.

Hon Njoroge: Yes I would like to say that when we come to the three principles of what to

grow and when to grow there is a product that can grow here very well in a particular season

and in a different season we cannot get it here we only source it from somewhere else. If we

limit our supermarkets that they have to get the products here and during a certain period and

we cannot produce the product during a certain period we shall be making a gravious mistake

and in fact putting the whole county in a big problem. There is a season that we are growing

fruits here there is a season we cannot get fruits here what are we going to do? Let us leave

things the way they are. What we can do and maybe what Hon Osiako could have said is

maybe let us guide our farmers to produce to the quality required by the supermarkets. I had

the same thing Osiako has today and I personally went to the supermarket because I was



wondering why our farmers cannot even supply sukuma wiki, when I went to this

supermarkets I learnt that they are soo keen on continuity. So when we do not have sukuma

wiki in this County what is going to happen? That is why am saying Mr Speaker we cannot

limit ourselves to the county but let us talk to our farmers to grow crops that are acceptable to

the standards set by the suoermarkets because it is not only supermarkets we can have other

markets that are even paying better than the supermarkets Mr Speaker..Let us even have the

policies from the agricultural department to the farmers so that they can grow as per the

requirement of the ready market that we have in this county. But restricting our farmers and

sellers that they have to buy and sell here will be a great mistake Mr. Speaker. Thank you.

Speaker: The Hon Likovele you are also a skilled person in agriculture maybe you can

contribute too.

Hon Likovele: Thank you Mr. Speaker on my side I oppose the motion with the following

reasons, There is freedom of choice on the type of food you want and whenever the food is

on the table you might be in a position to like eating ugali or beans. So the truth of the matter

is our policy states very well that there is freedom of marketing. We cannot squeeze our

supermarkets to get produce from our farmers from Trans Nzoia which are below the

standards of the consumers. Something we should do as the leaders of this county is we

should begin encouraging our farmers to produce quality food. You can look at our tomatoes

in the supermarkets and compare them to tomatoes in our farms, am very sure if you compare

that you cannot force someone who has gone to the supermarket to buy the tomatoes in our

own farms compared to those produce coming from Karatina.

Hon Kutitila: Mr. Speaker am surprised that the chairman of agriculture in this County and

for three years he has not educated our farmers Mr. Speaker then he is misplaced because it’s

the department of agriculture that should educate our farmers and at the end of the day we get

quality fruits from our farmers.

Speaker: Chairman of agriculture continue and defends yourself.

Hon Likovele: The truth of the matter is that we are working around the timetable and the

produce of farmers from Trans Nzoia will end up in the supermarkets without being forced

because when we shall yield to the expectation of the buyer ,the buyer will buy our food. So

what we are doing at the ministry is to educate our people to produce food which is

competitive. We shall want to take our food to Turkana and Turkana will not want food

which is substandard because if it’s sub-standard they will want to buy food from another

area where the consumer are satisfied of the quality of that food. So the truth of the matter is

that am opposing this motion and we should be in a position to ensure that our people can

produce food which is competitive in the whole country. Thank you.

Hon Njoroge: On a point of information Mr. Speaker I really wanted to make a point that we

are denying our farmers the opportunity to sell and if we want quality we might not even

have the quality to sell because we have prevalence of diseases and even pests that interfere



with our crops maybe in a region like this and you might find in another region that crop is

doing well that we cannot even compete it. So we cannot compel the supermarkets to buy

from us yet we have not even achieved that quality not because we cannot but because of the

natural factors.

Hon Kutitila: Mr. Speaker I just wanted to inform the members that they are saying about

Turkana but everyday there are many Lorries carrying food from Trans Nzoia taking them to

Turkana and Kisumu Mr. Speaker. So you want to tell us that we cannot consume food from

Trans Nzoia yet it is consumed in Turkana.I want to inform our honorable member that we

have quality food here and that is why it’s taken to Turkana. We are not compelling our

farmers but we need to make the ready market available first. If they can produce a lot of

food and we don’t have a ready market the small scale farmers cannot manage to transport

food to Kisumu and even Turkana Mr Speaker they need to have ready market here and as

leaders we need to protect our farmers .Middlemen buy food from our farmers and take them

to Turkana because we don’t have a ready market here Mr. Speaker while our own farmers

remain poor.

Hon Dorcas: Thank you Mr Speaker sir for giving me this opportunity to contribute to this

motion. I want to wish our Muslim brothers a happy Ramadhan…..I also want to say that I

was in the prayer breakfast and it was a wonderful one. I hope that next time they will invite

all of us.

Speaker: Can I say that we need to also organize our breakfast prayer here in Trans Nzoia.

Hon Dorcas: We tried to organize ours last year and it was not possible and I hope we will

organize one before the year ends .Thank you for encouraging us to organize ours here in

Trans Nzoia County because God still hears our prayers wherever He is and wherever we are.

I am standing because I wanted to contribute to the motion first of all, I want to say that i

visited few supermarkets in this county and wanted to find out why they don’t take our local

produce. A few of them told me that they had given the opportunity to our local suppliers and

unfortunately most of them were not able to supply. I want to give an example of chicken. I

went to Tuskys and asked them why their chicken is not from here and they said that they had

given a contract to a specific person but she was not able to meet the local market. So we do

have that challenge Mr. Speaker.

Speaker: Do you want to contravene that the Hon Waswa?

Hon Waswa: Thank you Mr. Speaker for giving me the opportunity to pass the point of

information. She is referring to Tuskys supermarket and it’s the same supermarket that

cheated honorable members.

Hon Dorcas: Thank you for the information, that is the supermarket that I visited Mr.

Speaker sir and the lady that had been given the contract happens to be my friend and

apparently I know her very well so I am not opposing the fact that they did not actually



honour their promise that they would hire people and I have no proof of whether they hired

people or not. I am only basing on what I heard. Mr. Speaker sir another point is that

supermarkets tend to offer very low prices. If I take my vegetables there they are very likely

to take a supply in low price and that could be the reason why most of the suppliers don’t

take their vegetables to the supermarkets because they believe most people will be in the

outside market where we call it Sokoni in Kiswahili and that is why Kenyans from Lodwar

and Kisumu would be able to take our vegetables at a better price and that is one of the

reasons why our locals will not take our produce to the supermarkets. I want to agree with my

colleagues that we have to empower our people so that they can produce high quality foods

that will be bought by the people who are willing to buy vegetables from the supermarket

because people who buy vegetables from the supermarkets are high class people, they want a

certain class of products and that is why we need to empower our people to produce products

that are of high standards to buyers in the supermarket. Finally I want to say that this is a free

market as our colleague have said and so the supermarkets also have the freedom to buy their

products from wherever they want and we cannot force them to buy our products if they feel

that we are not able to supply them consistently and if the quality is not of their standard.

That is all I have to contribute for today thank you.

Hon Waswa: Asante sana bwana speaker. Nasimama kwa miguu miwili kuunga hoja hii kwa

sababu aliyeleta hoja hii tunapopiga msasa ni mkaazi wa County hii na alikuwa na makusudi

ya kusaidia wakulima kwa vile pia sisi ni wakulima na mapato tunayoyapata inatufanya

tuchangie katika hoja hii ili kusaidia wakulima.La kwanza ningependa kuwaeleza

waheshimiwa wawili ambao ni wataalamu wa kilimo ya kwamba kusema kuwa mapato yetu

ni ya chini hiyo ni kupotosha nyumba hii kwa sababu unapoenda maeneo ya Chepchoina

kuna shamba moja ambalo linatoa matunda inaitwa Suam Orchard na pia unapoangalia

sehemu hiyo kuna shamba moja la maua na pia linatoa maharagwe inayotumika na wazungu

kule ng’ambo.Ningependa kwa hiyo hoja wabadilishe fikra ya kusema sisi wana Trans Nzoia

hatuwezi toa vitu ambavyo vinastahili.Ningependa kuunga hoja hii kwa sababu ya makusudi

Fulani. Ningependa kuunga Mheshimiwa Dorcas amepeana mfano mmoja wa duka la Tuskys

na ile lugha ambayo wametumia kusema ya kwamba upande huu wetu tunauza vitu kwa bei

ghali ilihali unapoangalia bei kutoka kwa duka na katika kijiji nitokako kwa duka inauzwa

kwa bei ya juu.Kwa hivyo ningependa tu kumweleza aliyeleta hoja hiyo hoja tuseme ya

kwamba tutapeana muda Fulani kwa mwana kandarasi aliyepewa kupeleka vitu kwenye

maduka tuseme asilimia Fulani kama 70 ipewe watu wa Trans Nzoia na 30 ipewe watu

wengine.Tuangalie wakulima wadogo ili wapeleke vyakula vyao katika masoko yetu.Hawa

tuliowapea tunafaa kuwapea,ugatuzi unatetea mwanachi anayetoka sehemu hiyo.Ningependa

kueleza kinara wa kilimo kuwa awasaidie wakulima wetu.

Hon Yator: Thank you Mr. Speaker sir. Mine was just a point of information. Am seeing

most of the members are on educating against the motion. The motion was about the product

and the market. The motion was not about the quality. Most of the members were debating

against the motion basing on quality but in reality the prayer of the motion was about the



product and the market. Mr. Speaker can you please guide the members who are against the

motion maybe they have not seen the prayer of the motion.

Hon Dorcas: Thank you Mr. Speaker it’s really information that there is no way you cannot

connect the quality and the market. Quality wise you must think about the market so you

cannot disconnect the quality as well as the market of a product.

Hon. Waswa: Thank you for giving me the opportunity to also inform honorable Dorcas. I

have already given an example of the qualities. So you cannot stand and say we don’t

produce qualities. So you cannot stand and say we don’t produce qualities yet I have already

given the example of Suam Orchard. Those are the quality food we produce and the

information that members are giving here is not true since we produce quality crops and even

people from Mombasa get fresh maize from Trans Nzoia. Those are the qualities when you

go to Turkana County they rely on us and those are the qualities.

Hon Farid: Thank you Mr. Speaker. I believe one thing is that this motion can lead this

County to a dangerous position. Why do I say so, it will limit our farmers to supply to five

supermarkets only.

Speaker: The Hon Farid the motion does not say we limit our farmers to supply to five

supermarkets but that those supermarkets take the produce of our farmers.

Hon Farid: Yes Mr. Speaker I was trying to say that the supermarkets in Trans Nzoia are

only five yet Trans Nzoia is the bread basket of this Country. If we stop by showing other

Counties that we can stop them from supplying here yet we need their markets because of the

five supermarkets we will lose the whole market. It’s a danger we are trying to do, we should

not make a policy that will block other counties from supplying here. What if Turkana today

says that their supply should not come from Trans Nzoia? The best thing is that lets improve

our markets. The agricultural skills are very important they will lead us somewhere. Thank

you.

Speaker: Our standing orders do not permit the speaker to debate but let me give some

directions. If you see the prayer of this motion it says that this house urges the county

government to provide guidelines. The first word is guideline the second policy and the third

one regulation to ensure that the supermarkets in the county buy fresh produce from local

farmers. Now having guided you on that please can you now argue properly. What I was

saying we all are right because one of the guidelines is that the county government should

provide guideline to our farmers to produce quality products.

Hon Omondi: Thank you Mr. Speaker sir am looking at the prayers of this motion. As a

county if we can only come up with guidelines ,policies and regulations .Another thing

honarble members am forgetting is that its Trans Nzoia that mothers the seeds that other

counties plant which is manufactured by Kenya seed. What we are forgetting is that don’t

abuse your mother even if she is as stupid as you. Am seeing danger of these honorable



members disowning their own County and trying to say that the produce from Karatina is

much better than those from Trans Nzoia. One thing you must realize is that if you go to

Endebess constituency all tomatoes as well as the potatoes come from there and Saboti. Now

you are telling the farmers in Trans Nzoia to throw away their farm produce and allow those

from Karatina to come in and dominate. This is an issue that we as the first legislators of this

County should not allow. As the prayer goes let us urges the County government of Trans

Nzoia to come up with guidelines .But then we cannot stand here to oppose the farm produce

from our own land. Whether its bad or good we are urging members to support this motion so

that the County government can come up with a policy which will be passed here and we can

also formulate an act and that can make our Trans Nzoia to come up with the best produce

Hon Nelima: Mr. Speaker I wanted to put something across. When you look at the 2nd

paragraph the honorable members have talked about is the mandate of the county government

to ensure excellence and the economic empowerment of our farmers and to motivate them

which includes finding market for their produce. The honorable member has stated clearly

that if the county government empowers farmers to come up with crops with more value than

we have been producing and in due course the county government will find market outside

and the product be allowed in our supermarkets so that all the members can get outside the

county. If we empower our farmers now to have that commodity of excellence it will be

marketed outside there.

Nafikiri vile nimesoma na nimeelewa kuwa tumeelimishwa tuwe na mapato mazuri katika

Trans Nzoia.Na tukipata hayo mapato pengine maduka ya jumla yatakuwa machache na

tutaweka wapi vyakula vyetu.Kwa mfano mambo ya Kenya seed sisi ndio wenye tunafanya

hiyo kazi tunajua inaenea Kenya mzima. Lori zinabeba mahindi yetu ambayo imeshagwa

ikipeleka Karatina na inaleta vyakula vingine huku kwetu.Napinga hiyo hoja bwana spika

tusifanye kosa kama hilo.

Hon Julia: Thank you Mr. Speaker sir. Mine is to oppose the motion our farmers like for

example we have heard from Hon Waswa that there is a farmer who exports his products. It’s

because of the price. Maybe he sees that the prices offered by the supermarkets are low. We

have very good products but we sale them outside the county because of the prices. Putting

these guidelines is like failing to support our farmers. Let our farmers be free to sell their

products whenever they want where they feel like they are going to get the best prices for

their products. Thank you.

Hon Kitiyo: Mr. Speaker I also stand to oppose this motion .First and foremost we have to

see both sides of the coin. We have to see the side of the interest of our farmers and the

interest of our business men. For example in Uganda one bag of maize is sold weighing 100

kilograms and may be they are selling at lower prices unlike in Kenya where they are selling

in 90 kilograms and the price is higher. Secondly there is the issue of availabity and



continuity. In most cases we depend on rains here in Trans Nzoia unlike in Karatina which is

mainly greenhouses and at least those things that can be produced throughout the year.

wale ambao wanaegeza mali yao hapa.Kwa hivo Bwana spika si jambo nzuri kuwafuguza

waegezaji bali tunaitaji waegezaji. Iwapo waegekezaji wakuu watataka kufungua biashara

kubwa kubwa hapa na iwapo serikali yetu itakuwa imepitisha sheria ambayo wanaona

kwamba inawatatiza hawatakuja.Jambo la soko huru ambalo lilianzishwa na serilali kuu ni

jambo ambalo sina imani nalo ya kwamba tuendelee na soko huru ili tusije tukatatizika

.Napinga hoja hii.

Hon Sakong: I stand to strongly oppose this motion. If only the prayers of the mover of the

motion was that the county provide guidelines policies and regulations to ensure that buyers

from this county or outside our county or buyers from outside this county buy our produce

from the locals I would have supported this motion because it will be forcing the county

government to ensure that fresh produce from our farmers is available and the market is there.

Mr. Speaker I have come late to this house because the roads from Matumbei to Kitale are in

a pathetic situation. You cannot drive at high speed Mr. speaker and when it starts raining

and a farmer from Salama who produces good quality tomatoes that can be exported and it

starts raining Mr. Speaker how will he trans port his produce? Its either the county

government comes up with policies to ensure that they will make the roads passable. Am not

supporting this motion Mr. Speaker.

Hon Kutitila: I think the mover is repeating the prayer of the motion. The guideline of the

motion is that the county government should .If he says the county government should put

guidelines .If there is a bad road like his place it’s the mandate of the county government to

make roads so that the farmers from his place should not suffer.

Hon Sakong: Am not aware whether the honorable member was informing me or making a

point of order but I don’t want to contradict myself Mr. Speaker. I have said if the prayer of

the mover was that the county government develops guidelines and policies to ensure that

buyers from within Trans Nzoia County including supermarkets or buyers from outside the

county and country buyers within the country or farmers outside this country I would have

supported it but the way it is Mr. Speaker as Birgen had put it we are putting our farmers in

trouble. What about the many fresh produce that we take to other counties. We don’t want to

get to a place where we shall have to get members from this house negotiating with members

from our neighboring counties to accept our produce. Am only against it because of the

prayer which is restricting us to the supermarkets in this county. If the prayer was that we sell

our produce to any person who is willing to buy our produce. I strongly oppose this motion.



Am saying we should not pass this motion because it’s going to put our county and farmers

into trouble

Hon Osiako: I once again stand Mr. Speaker to persuade these honorable members who have

their electorates at heart because they are farmers Mr. Speaker. Even when other members in

this house are complaining it’s just like any other products Mr. Speaker which has been

branded China yet it’s locally produced. I have a person who entered the business of supply

of farm produce. He pretends that he has gone to Karatina yet he has gone to Endebess and

picks the tomatoes and potatoes and then he stays here then he just comes in. Who has been

cheating our farmers i wonder with our learned friends from Jomo Kenyatta University I

think they went there by mistake. If they have this County at heart they will support this

motion.

INTER WARDS SPORT COMPETITION.

Speaker: Members I have an authority from the Hon Munene by order no 47 paragraph 2

who has authorized Hon. Dorcas Sikowo to move the motion on the inter wards sports

competition on his behalf.

Hon Dorcas: Thank you Mr. Speaker sir I stand here on behalf of Hon Munene to move the

motion on inter ward sports competition. Mr. Speaker Sir I beg to move the following

motion.

Aware that thousands of youths in Trans Nzoia have different sport talents and skills,

Further aware that unemployment rates continues to rise leading to many anti socials criminal

activities, idleness and frustrations that undermine the stability of the economy of the county,

Concerned talented youths in sports within the county have no well structured avenues where

they can exercise their sports talents and skills in order to earn a living,

Mr. Speaker sir noting that talent in sports is a source of income for the individual as well as

revenues to the county

This assembly urges the County Government to establish inter wards sports competitions for

youths in the county which can act as an avenue to scout for talented youths in sports.

Thank you sir.

Let me first start by supporting this motion, knowing that we have so many talented young

people who are idle and who need something to occupy them. Further Mr Speaker we have

quite a number of youths who need to exercise their talent. Starting the inter ward

competition is a good idea because it will bring the talented people together closer to their

goals. They will be able to exercise and practice .Speaker sir this will cut on cost that would

otherwise have been incurred. The youth will be able to do something because the County

will be involved and therefore they will be occupied and doing something constructive. It will

enable the youths to nurture talent that would otherwise not been identified. Finally Mr.

Speaker they will spend their free time practicing in their villages and so they will not be

engaged in activities that are not accepted. People will be able to earn a living in those

activities that they will be doing. Thank you very much Mr. Speaker sir. I pray that this house

supports the motion.

very important motion which needs members when energetic. I also have missed members

Question to the County Assembly Service Board.

Mr. Speaker sir,

Could the Leader of Majority provide/furnish the House with the following.

1. The number of contractors and the names of companies who applied for the contract for

construction of the perimeter wall/parking shed.



2. Whether the same was advertised on the local dailies and provide a copy of the same.

3. Whether all the said contractors who had for the tender were notified of the date of opening

by the advertisement in the local dailies? And if they were notified, please provide prove of

the same and the attendance list signed by the contractors who attended the opening session.

4. The cost of the construction of the County Assembly perimeter wall/parking shed.

5. The contractors currently carrying out the work, name of the Company and the list of

Director of the said Company and.

6. Whether the opening of the tenders was done publicly.

Question to the County Secretary.

Mr. Speaker Sir,

Standing Order 18 (1) requires that the Governor shall address a Special sitting of the County

Assembly once every year and may address the County Assembly at any other time.

Could the County Secretary inform this House why the Governor has not addressed the house

for the last two years hence failed to comply with the said standing Order, the first limb of

which makes it mandatory for the Governor to address the Assembly at least once every year.

Thank you Mr. Speaker, Sir.

Speaker: Thank you for this question to the County Secretary and I therefore direct that the

office of the Clerk write to the County Secretary inquiring of the same and we need answers

within two weeks, the hon.Farid.



Hon.Farid: Thank you Mr. Speaker I think this question should first go to the committee of

Justice and Legal because this is a matter of law is the law being broken or followed we want

to further and find out its procedural.

Hon.Kisaka: Thank you Mr. Speaker I think you have already given the direction and

hon.Farid cannot stand to purport to direct the Chair.

Hon.Kutitila: Mr. Speaker am failing to understand because you know the county secretary

cannot come to this Assembly and answer, you should direct to a relevant committee so that

to carry investigation why governor has not been addressing the assembly and bring the

report to this House otherwise may learn today Mr. Speaker.

Hon.Nelima: Thank you Mr. Speaker if it’s something concerning petition to the County

Assembly its whereby its directed to the committee of Justice and Legal affairs, person who

is handling the issue of the County government is the Secretary, I think it will be in order

may be after statement has been answered its where it will be directed in the committee but I

think it’s in order for it to go straight to the executive then after the statement has come out

its where it should be directed to the committees for further investigation.

Hon.Teresia: Thank you Mr. Speaker Sir it has been a tradition to this house when a

question come in the house it go to the relevant committee, so I don’t see why this should be

different, let this question go to the relevant committee then from their it will proceed to the

committee its usually go to the concerned department where the question has been directed it

doesn’t go to the committee then departmental will be answered to the committee thank you

Hon.Kutitila: Mr. Speaker I have not denied that the question should go direct to the County

Assembly but who will do follow up that the question has been answered, you should direct

to the committee. Last time there was a question and the Speaker directed it to the committee

of planning,the CEC answered the committee then I came to answer the same question to this

house ,the county secretary will not come direct to this house and answer. If its directed to the

finance we normally direct it to the CEC of finance but we task the budget committee so that



the budget chairperson can answer for the same otherwise I will not accept that you direct to

county secretary then he will come here and answer in this house.

Hon.Kisaka.Thank you Mr. Speaker fast of all we don’t go by the Kutitila likes, whether

they like or not it’s a matter of discussion but we are following the law any communication

from this house is through the office of the clerk, county secretary will respond to the office

of the clerk and if it needs to be tabled in the house that’s the work of the majority leader.

Speaker: I think may be let me guide the house, that question is directed to the county

secretary like I have said the office of the clerk will communicate to the county secretary for

the answers and may be to be very specific and off course to give further direction to this,

chairperson of the legal and justice will table this so that if there is any discussion I think it

will go to the said committee.

INTER WARD SPORTS COMPETITION.

were about to start deliberating and the house was adjourned and therefore I take you to the

point that we are now going to debate for the said motion but for us to have more direction

and because the mover is in this house would like to give him the first opportunity y to open

up the discussion.

Hon.Munene: Asante sana Bwana Mwenye Spika ,nachukuwa fursa hii kusema ni asante

kwa kunitunukia nafasi hii nilijua ya kwamba mimi nikiwa Mwakilishi wa Wadi ya Sitatunga

ningependa kusema ya kwamba Bwana Spika ni vizuri tukiwa na michezo ambayo

itaunganisha Kaunti mzima na vijana wetu wanaweza kudumisha talanta zao na waweze

kuendelesha vizui. Bwana Spika ni vyema kukumbuka Kenya ni taifa ambalo linajivunia

michezo na sitakosa kumvulia Mheshimiwa Wesily Korir ni mmoja wa Kijana ambaye

ametoka Kaunti ya Trans Nzoia, kwa upande wa Kaunti nitasema katika Kaunti yetu ya Trans

Nzoia Bwana Spika ninasema kwamba ni vyema katika Kaunti yetu ingetenezwa viwanja

mbalimbali kila Wadi ili vijana na watu wengine waweza kushiriki michezo hii na baadaye

wataweza kupata mapato.

Bwana Spika pia ningepanda kusema hivi katika hii Kaunti yetu kuna wachezaji bora wa

mpira, valeboli, Bwana Spika tunapowakuza wale vijana tunajua ya kwamba wataenda mbali

na sitakosa pia kumushukuru Bwana Kichuki ambaye anatoka kwa Wadi ya Mheshimiwa

Osiako pia ametengeneza uwanja kwa hivo Bwana Spika in vyema tukuze talanta yao kila

siku.Kwa hayo machache nasema asante Bwana Spika naomba wenzangu kuunga mkono ili

tuweze kukuza talanta ya vijana,asante na Mungu awabariki.

Hon.Kutitila: Thank you Mr. Speaker I want to support the motion of inter wards sports

competition, Mr. Speaker you will realize that if we can exposed them this County will

benefit, Mr. Speaker if we can exposed youths from different Wards that’s 25 Wards and this

one will also help to get the best players in different Wards so that we can make a very strong

team of this county, Mr. Speaker we have youths who plays well in different Wards and

because they are not exposed Mr. Speaker they land nowhere and Mr. Speaker you know

very well football and even any sports it makes different people to benefits and achieve their

goals like Mariga,Wanyama and others who are getting billions of money because of their

talents. Mr. Speaker the way the Chair has said hon. Korir last time achieved a lot of money

after marathon we want to nature the talents of different youths this county. Mr. Speaker I

want also to urge hon. Members that we need also to allocate money for this inter-wards

competition, Mr. Speaker this buses will be fueled and transport footballers from one Ward to

another because this buses they are just lying here, last time we travelled to Mombasa we

were very tired I want to urge that they be rectified otherwise we shall be using them to carry

students and people from one Ward to another because they cannot match the standard of

hon. members of this house thank you very much Mr. Speaker.

Hon.Kitiyo: Thank you Mr. Speaker I want also to support this very important motion

brought by hon.Munene, Mr. Speaker the issue of sports its actually one way of promoting

diversity and consistence Mr. Speaker we also want to tap youths talents and youths will be

able to walk around their county I supports the motion.

Speaker: The Okul

Hon.Okul: Thank you Mr. Speaker I rise to support this motion it’s a very good motion it

will bring people together especially on young people, noting that we have very good youths

in Trans Nzoia County and that’s why you can get anybody and all characters are here and if

can get somebody like Chepkemoi of Kapsabet and I can get Cheptoo from Wareng we can

also get them from here, am sure we can get our people from here Nafula’s are here, the

Omondi’s are here the Nyaboke’s are here Mr. Speaker this is the very food basket so people

eat our maize when it’s still fresh before it goes to other areas so we have children with

strength and we need that strength to be used properly. Secondly we shall be knowing who is

working because with this we shall be going to Wards and see the best people, the best ward

and we shall give trophies so I support the motion.

Hon.Nangekhe: I also arise to support this motion its has come on the right time to the right

place now that Trans Nzoia we are cosmopolitan’s as hon.Okul has just said this inter Ward

completion one Mr. Speaker it will bring about peace when youths interact that exposure,



number two Mr. Speaker inter Ward sports we will end up getting the best because if you are

paying in one Ward a lone you will not get the really best, then they can be forwarded to

higher teams, that relationship between them we can get the best of this team so that I just

wanted to support the motion, we have youths who have never gone to Kitale town. We had a

case Mr. Speaker from Kwanza wards there was a boy who was brought to town who had

never seen a lorry and a car so we want them exposed and occupy them and we can count less

crime in our county, Mr. Speaker I want to thank God through Mt. Kenya University I was

privileged Mr. Speaker I was taken as one of the research teams in Eastern Central to Arusha

and I got exposed somehow so if you go out you will learnt a lot we were doing research Mr.

Speaker on gender how many girls have gone to school and that’s my area of interest and

ones you go out you will interact so I want to advocate inter Ward competition.

Hon.Masika: Thank you Mr. Speaker for giving me this opportunity surely inter Ward

competition will bring the unity of youths in our county Mr. Speaker Trans Nzoia is a county

of many tribes and when we will be having this, it will bring unity of all tribes in our county.

Also Mr. Speaker it will bring up the good relationship, the winning team will make others to

have friendship I think it will expose our youths in the county as other fellow members have

said many youths have never visited other Wards and also bench marking for development in

our County thank you Mr. Speaker for giving me this opportunity.

Hon. Nelima: I rise up to support this motion as we do Inter Wards Sports competition we

will be able to intensifying our Children who are at home we have talents that have not been

indentified it will enable them to go far. If I can give an example we had our young girl by

the name Veronica we went with her to Eldoret we played with her valley ball, right now she

has been taken by Malaika Strikers recently she went to Brasil. If we had not gone for that

competition she could have not been known so if we do so we will be able to identify the

talents of our youths from the grassroots which will help them go far and earn a living more

so when we were playing with Senate and Bunge team we learnt that some of them in the

team were youths and when we interrogated them they told us they were identified from the

county level during the inter wards competition in their Sub counties, now we have to

indentify our youths so that may be they can be employed by the Senate in the name of

playing Sports or running or foot ball it can help them to transform the community, we had

hon. Members who went to Nairobi at Nyayo Stadium I was among them and we were

trained to be coachers but we right now we are just here idling, we are supposed to go on the

ground and nature our people using the talents that we were trained at Nyayo Stadium, hon.

George was among the honorable members who went there. We want to encourage our

people on the ground that we have people who can nature them and earn a living, more so it

will bring people together because most of the people know that if you marry in a certain

community it’s not good but if now we encourage them to mingle they will inter marry and it



will bring unity and there will be no war in our County, thank you Mr. Speaker I support this

motion fully.

Hon. Laban: Asante Bwana Spika naunga hoja hii mkono pia nachangia kwamba itakuwa

vyema Bwana Spika ikiwa kweli michezo itakuwa katika kila Wadi katika Kaunti hii vipawa

tofauti tofauti vitatambulika. Pia Bwana Spika kuna wandugu na Dada wenzetu ambao wana

ulemavu ambao pia wana talanta Bwana Spika jambo ambalo ningependa kusema iwapo

kuna kamati ambayo itaangalia mambo haya ya michezo itakuwa vyema ili ionyeshe sura

kamili ya Trans Nzoia ili watu ambao ni Walemalvu wote na vijana,wamama kwa sababu

wote ni watu wa Trans Nzoia na wana michezo. Jambo lingine Bwana Spika itakuwa vyema

tusaidie wana michezo kuenda sehemu mbali mbali kuweza kujifunza pamoja na watu katika

Kaunti zingine, Bwana Spika nakumbuka vizuri kuna kijana mmoja ambaye alichezea hii

Kaunti kule Eldoret lakini ni huzuni nimesikia kwamba ni mmoja wa wale waliopigwa

risasi,ni mwendezaji Boda Boda kwa hivyo Bwana Spika itakuwa ni vyema kama tutakuwa

na vijana ambao wataendesha vipwa vyao katika hali ya kucheza hawatakumbana na mambo

kama hayo watakuwa na talanta za kuwapeleka mbali kama vile tumepata kusikia wachezaji

wetu kama Wanyama na wegine kwa hiyo naunga hoja hii mkono.

Speaker: Honorable Members, I have a ruling on responses of questions to confirm to you

this evening. These are the procedures under Standing Order No 40 & 41. Allow me to read

to you.

PROCEDURE ON STATEMENTS

UNDER STANDING ORDER NUMBER 40 & 41.

HONOURABLE MEMBERS,

This is the communication from the chair regarding procedure on statements under Standing

Order No. 40 and 41.

HONOURABLE MEMBERS,

You may recall that on several occasions, the Honourable member for Nabiswa Ward and

also other Honourable members have arisen on a point of order to seek the Speakers’



guidance on the status of Statements that were being sought in the House by Honourable

members.

HONOURABLE MEMBERS,

Before I give my Guidance on this matter, allow me to make a distinction between the New

and Old Constitutional dispensation on procedure with regard to this matter.

HONOURABLE MEMBERS,

In the Old Constitutional dispensation, the Executive were in the House. Under section 17(3)

of the Old Constitution, the Ministers in addition to being members of the National

Assembly, were responsible in answering Questions in the house. The Ministers were being

held to account on the floor of the House.

HONOURABLE MEMBERS,

This gave rise to the famous Question time. At that time, Honourable members would rise

on a Point of Order to request for Statements. During Statements time, the Minister would

respond to Statements requested by members in the Plenary.

HONOURABLE MEMBERS,

It is also worth to note that the Old Constitutional dispensation provided for Parliamentary

system of Government where there were a clear fusion of powers between the Executive and

the Legislative branches. However, in the New Constitutional dispensation which provides

for a Presidential form of Government, the Executive arm is distinct and separate from the

Legislative arm of Government.

HONOURABLE MEMBERS,

This separation of Powers serves to check and balance certain actions of either branch of

Government.

HONOURABLE MEMBERS,

In our case, the following shall apply:-



1. The Speaker shall interrupt the business of the County Assembly every Tuesday at

6:00 pm to facilitate members to make general Statements of topical concern. In this

regard, the provisions of Standing Order No. 40 (1), (2), (3), have to be complied

with.

2. During Statements hour on every Thursday, commencing not later than 3:00 pm as

provided for under Standing Order No.41:-

a) A designated member of the House Business Committee shall for not more

than ten minutes, present and lay on the Table, a Statement informing the County

Assembly of the business coming before the County Assembly in the following

week. The Statement must be strictly restricted to informing the house of the

business coming to the house in the following week.

b) The Leader of the Majority party, or the Leader of the Minority party as the

case may be, or their designated, may make strictly a Statement relating to their

responsibilities in the County Assembly or the activities of a Committee.

However, the Leader of Majority party may also respond to matters of urgent

County scope, arising from the Statements sought.

c) A member may request for a Statement from the Committee Chairperson

relating to matters under the mandate of the Committee and the Speaker may

either appoint a day for the Statement or direct that the Statement be issued on the

same day.

What about Statements seeking answers from the Executive side?

HONOURABLE MEMBERS,

As stated above, it is clear that no member can give answers on behalf of the Executive in

this house. In any case, neither the Leader of Majority party nor Chairs of Committees can

hold brief for the Executive. However, they can seek replies from the Executive and deliver

such replies to the Executive.

HONOURABLE MEMBERS,



In this regard therefore, I give guidance to this House as follows:-

a) I shall be directing from time to time in some incidences that the Leader of

Majority responds to matters of urgent County scope arising from Statements sought,

if I shall be of the opinion that such matters would not be referred to a particular

Committee either due to their nature or due to their urgency.

Further, the Statements should not be more than two – at any one particular time on

Thursdays - in this case, the Leader of the Majority party will be expected to seek

an answer from the relevant arms of the Executive and read the Statement containing

answers to the house. The Leader of Majority shall be required to restrict himself to

the actual response given by the Executive as opposed to his own opinion.

b) Where a member requests a Statement from a Committee Chairperson relating to

matters under the mandate of the Committee, the Speaker may either appoint a day for

the Statements, or direct that the Statement be issued on the same day. However, the

Statement sought must be restricted to matters within the mandate of the Committee

or where the Chairperson is authorized by members of that Committee to issue

preliminary reports to the House.

HONOURABLE MEMBERS,

In this case, members will be allowed to seek Statements on Thursdays on the floor of the

House. Chairpersons will be required to take over the requests. Where necessary, seek

answers from the Executive either in written form through the office of the Clerk or summon

the particular Executive member to their Committee to provide answers.

HONOURABLE MEMBERS,

The member who requested the Statement will be expected to attend the meeting of the

Committee and also interrogate the matter requested or interrogate the said Executive

member. Thereafter, the Committee shall report back to the house in a form of a Statement by

the Chairperson of the Committee or in a form of a Statement.

HONOURABLE MEMBERS,



If the House adopts a report of a Committee arising from a Statement, it will form part of the

Resolution of the House for the Committee on implementation to follow up.

HONOURABLE MEMBERS,

In conclusion therefore, I direct that member’ Statements seeking answers shall be attended

to by the Majority Leader and the Chair persons of Committees using the procedure

stated above.

The Speaker shall have the sole discretion guided by the substance of each Statement either

to refer the Statements to be attended to by the Majority Leader or to a particular

Chairperson, to be attended to by the respective Committee.

MANDATE OF THE COMMITTEE

Mr. Speaker Sir,



The planning committee is one of the Sectoral Committees contemplated under Standing

Oder 191 and is provided for under Second Schedule to the Standing Orders of the County Assembly. This is the committee mandated to deal with, among other issues, All matters related to County planning and development, including statistics, land survey and mapping,

boundaries and fencing housing and electricity and gas reticulation and energy regulation; trade development and regulation, including markets, trade licenses (excluding regulation of

professions). Fair trading, practices, local tourism and cooperative societies. DEPARTMENTAL PROJECTS

Mr. Speaker Sir,

The following are proposed projects in their respective sectors which are being tabled before this honourable house for consideration and approval.

1. AGRICULTURE AND RURAL DEVELOPMENT SECTOR

Mr. Speaker Sir,

In the County Government of Trans Nzoia, the sector comprises of the departments of:

Agriculture, Livestock Development, Cooperatives and Marketing and Fisheries

Development. The sector is the major source of employment for over 80% of rural

population.

Agriculture sub sector

Mr. Speaker Sir,

The subsector is responsible for implementation of national agricultural policies at the county

level. The subsector mandate entail promoting crop development, supporting plant disease

control and management. It is specifically responsible for; implementation of Agricultural

policy and Services, Food Security policy, implementation of irrigation policy, crop

development, Agricultural machinery services, services management, Agricultural farmers

training and agricultural training colleges.

Livestock production sub sector

Mr. Speaker sir,

The sub sector mandates is to ensure sustainable development of the livestock industry in the

county. It is specifically responsible for; livestock policy management, livestock managing

and development, formulation and implementation of county veterinary services and disease

control policy, promotion of bee keeping industry, management and monitoring activities of

livestock sale yards and sale of other animal products, and the promotion of the tannery and

dairy industries.

Fisheries development sub sector



Mr. Speaker sir,

The sub sector is responsible for the implementation of national fisheries policies at the

county level. In specific, the sub sector is responsible for fish licensing, development of

fisheries, fisheries marketing, fish quality assurance and value addition.

Cooperatives and development sub sector

Mr. Speaker sir,

The sub sector is responsible for implementation of national co operative policy at the county

level. In specific, its major function includes; development and implementation of

cooperative policy, cooperative legislation and support services, cooperative governance,

education and training, cooperative production, marketing and value addition.

The Environment Water and Natural Resources Sector comprises of sub sectors of Water and

irrigation, environment, meteorological services and forestry.

They are responsible for matters relating to forest services, meteorological services, and

environment, water and wildlife services at county level.

transport and infrastructure.

The mandate of the sector includes; spatial planning and regulation, provision of adequate

housing facilities, implementation of national survey and mapping policies.

4. GENDER, YOUTH, SPORTS, CULTURE AND TOURISM

The sector is comprised of Gender and Social Development, Culture, Children, Youth, Sports

and Tourism subsectors in the County.

5. HEALTH SECTOR

Mr. Speaker Sir,

The health Sector comprises of county health services mainly public health and health care

services. They are responsible for matters relating to health at county level.

The projects proposed for this sector are;

Construction of one new health centre in each ward

Building of the County teaching and referral hospital

Equip and operationalize the County referral hospital

Upgrading of all sub-county hospitals.

Procurement of drugs,pharmaceuticals and health essentials supplies

Community health strategy

Vaccines and Immunizations cold chain equipment

Construction of 5 incinerators and disposal pits

Procure 50 Motor cycles and 5 utility vehicles.

Purchase of Generators for all hospitals.

6. COUNTY TREASURY

Mr. Speaker Sir,

The sector is comprises of departments of Finance, Audit and procurement. The sector is an

important player in the implementation of the county’s development programmes.

The department is responsible for revenue collection and management, cash disbursement

and control, generation of financial report, management of county bank accounts and co

ordination of the county budgeting process, ensuring that the county funds are used for the

intended purposes, undertaking project verification, undertaking payroll audit, county

procurement planning, making sourcing decisions, contract management and disposal of

county asset.

The committee recommends that this honourablehouse adopts and approves these proposed

projects and programmes to enable the county Government serve the people of Trans Nzoia

well.

Hon. Kitiyo: Thank you Mr. Speaker Sir. I stand to support the report. At least we will have

our Trans Nzoia residence to enjoy our fruits. But Mr. Speaker, we normally have good

things for our County but Implementation is the big problem.

Hon. Sikowo: Thank Mr. Speaker, at least you know that am aiming higher. I rise to say that

this is an excellent report because every sector has been broken down. I want to say that am

very happy to have it. If God help us to come next time, we will be better.

Hon. Nelima: Thank you Mr. Speaker Sir. I congratulate the Hon. Members who chaired the

report. But Mr. Speaker, I want to say that I raised something about irrigation during report

writing in Eldoret which has not been budgeted here. I request the Chair to meet with the

concerned minister to see how it can be fixed.

Hon. Kitur:(Point of Order) Mr. Speaker Sir, I think the Honorable member who is on the

without looking at the subsectors. Mr. Speaker am proud it has been captured. Thank you

Hon. Omondi: Thank you Mr. Speaker Sir. I rise to congratulate the Hon. Chairperson for

Planning and the entire House. This is the best report so far. At least 30% goes to the wards.

Therefore, I support it.

Hon. Kutitila: Thank you Mr. Speaker Sir. Mr. Speaker, I stand to thank the Honorable

members for their support. Mr. Speaker, it is not easy to table a report and have all 100%

members supporting it. And as Hon. Kitiyo has said, the implementation sector is what is

letting us down. We need to sit down as the whole House and now the Chair for Budget to

put in his effort so that people may enjoy their fruits.

of the 2013/2014, 2014/2015 and 2015/2016 County Government debts and their justification

thereof or an adhoc Committee be appointed and mandated for the said purpose.

AWARE of each ECDE class has been given two teachers per school



AND FURTHER AWARE that ECDE is divided into three classes (baby class, middle

class and pre- unit) making the two teachers not enough to handle this ECDE classes.

APPRECIATING the devolved Government act on ECDE and polytechnic and vocational

training is devolved under government counties.

I therefore move that by resolution of this House, the County Government of Trans Nzoia

County to employ one more ECDE Caregivers”

Mr. Speaker Sir, I want to appreciate the stand of Hon. Members to come up with the

resolution to employ care givers. I also want to appreciate the Trans- Nzoia County

Government for employing the 2 ECD care givers per school. We need more than 3 care

givers as the enrolment has gone higher as far 120 – 130 pupils per school. We need more

classrooms and in some areas, the classrooms are even complete. I would like you to

contribute to the motion. Thank you Mr. Speaker and welcome.

Hon. Kutitila: Thank you Mr. Speaker Sir, I support the motion. We not only need one care

giver but more because of the increased enrollment. In my Ward, the enrolment is about 150

pupils per school. For example, Kabuyefwe has 140 and Mucharage 150 and one or two

teachers cannot manage all these. Let us approve this motion so that the money that is

squandered is used to employ ECD care givers and the construction of classrooms. We can no

longer learn under trees like before and when we used to write on the grounds using sticks.

We are now digital and we have laptops. We should ensure we are updated. May God bless

you all.

Hon. Kisiero: Thank you Mr. Speaker, I support the motion. It is a good motion. It is our

mandate to ask the County Executive Committee and the Chief Officer concerned to employ

more teachers. Kokwo Pre- Primary School in my ward has180 pupils. I suggest the County

Executive Committee (CEC) should act on it.

Hon. Weswa: Thank you Mr. Speaker for giving me the opportunity to also contribute. I

support the motion. In my Ward, Misemwa pre-primary School has 180 pupils and has two

teachers and a standard class has 40 pupils, employing two teachers would not enable the

children get quality education. Now that we are doing the budget, let us allocate more funds

to employ ECD care givers for quality education to our children. Thank you.

Hon. Sikowo: Thank you Mr. Speaker Sir, I stand to support the motion fully. The key and

objective here is quality education. We will have not realized the mission if we do not

achieve quality education. The sharing of classrooms interferes with learning. We should add

more classrooms. ECD is a devolved function and we should get a policy where more money

allocated for motivation but not at the expense of our children. We don’t want to waste more

time on this. We should support this.



Hon. Kaboloman: Thank you Mr. Speaker Sir for giving me this opportunity to contribute. I

rise to support the motion and I congratulate the mover. ECD schools which contributed to

public schools have now increased. All the children have joined public schools and we need

more care givers. What would happen if one teacher fell sick? Will the children go without

learning? We need a good number of teachers in case of incapacitation and training. How can

one teacher mark assignment of a classroom with 100 pupils? It is our mandate to call for the

provision of quality education. Thank you,

Hon. Masibo: Thank you Mr. Speaker Sir. I congratulate the mover of the motion. First,

these children are young and sometimes it is hard to take care of them. It is good to add more

teachers because with less than one teacher, they can’t learn anything. There is an outcry that

when these children reach standard 8, they can’t read, or solve a simple arithmetic and write a

composition because the children did not have a good foundation which could enable them

get quality of education.

mkono kwamba tuongezee walimu wa chekechea Ili tuboreshe elimu ya watoto wetu.

Hon. Kitiyo: Thank you Mr. Speaker Sir, I rise to support the motion. This reflects that the

mover is a retired teacher but not tired.This is a devolved function. In my area, there are 152

pupils for two teachers. It is time we give it priority. The budget for Mavuno fertilizers can be

added to the ECD. I rest my case.



Hon. Kitur: Thank you Mr. Speaker Sir,indeed, international education requirements give

the ratio of 1:40 of teacher to students. The motion should have a policy of automatic

reflection to the increase of pupils done annually by Teachers Service Commission. In my

ward, Namanjalala has 120 pupils as well as Kobos and Kapomboi. This is a necessity. We

have passed important motions in this HOUSE but they have ended into dustbins. The Chair

of the implementations committee should do something. I support the motion.

Hon. Maling’a: Thank you Mr. Speaker Sir, at last you have recognize my presence .Once

teacher always a teacher (Loud consultation) Mr. speaker there is a lot of noise.

Hon. Speaker: Please consult in low tones.

Hon. Maling’a: As I was saying, we need quality education for our children, Thank God, we

have two teachers for a classroom. We still need more. The classes need more attention .It is

difficult for such young children to catch up easily, We need more teachers because

overcrowding in classrooms would not make them understand quickly.A standard classroom

should have 40 pupils, I am the vice Chair of implementation committee. Whenever we

decide to go for inspections, we have never been facilitated. We have wanted to do our best.

Hon. Sakong: Thank you Mr. Speaker Sir. I stand for my voice to be heard and my only wish

was the prayer to call employment of teachers in accordance to the population of the pupils.

In Matumbei there is a pre-primary school with 143 pupils, I want to believe as

representatives, we should wake up and do our mandate.I believe if the Governor does not act

on a motion within 14 days with an explanation it is assured to have been passed into law. It

is up to us to exercise our mandate .We should go out there and force them to act. That‘s why

we are being accused of not doing our work. We should defend our Assembly.I will table an

issue next week to show we are also in a mess in our assembly compared to the executive.

the mess?

Hon.Mutuli: Thank you Mr. Speaker Sir .I want to submit minutes to Honorable Too as the

deputy whip.

Hon. Too: Thank you Mr. Speaker sir for giving me this opportunity to contribute to this

motion. The first motion I moved went through. I am happy the chair man of the education

committee supported the motion. I also support this particular motion. In my ward, Kuriot

and Kiboswa, schools have only 2 teachers. A standard school should have 25 teachers.

These particular schools can’t work as kids are many.

Hon. Mutuli: Thank you Mr. Speaker Sir.Thank you my fellow members for supporting and

contributing positively. We call on the executive to act as Honorable Kitur and Honorable

Too have said; standard schools should have 25 enrolments of teachers.The County

Executive Officer failed for not having such policies. I was in Keiyo ward, and I saw many

people.The area is obeying the commandment of God. Honorable Waswa may not fail

because of the many people in his area. My motion involves preparing children mentally and

physiologically. My prayer could be given additions as it was only a starting point. This

should not only affect public institutions but involve churches also. My prayer is that it

should be given to the implementation committee .God bless you abundantly.

Motion on allocation of business Spaces for Persons with disabilities.

Hon. Laban: Thank you Mr. Speaker Sir, I beg to move the motion on allocation of

business spaces for persons with disabilities.

Mr. Speaker Sir,

Aware that Article 27 of the Constitution of Kenya 2010 provides the citizens of this

Republic a comprehensive and equal freedom from discrimination.

Further theArticle 56(b) of the constitution of Kenya provides that the state shall put in place

affirmative action program designed and ensure that minorities and marginalized group are

provided with special opportunities in economic fields.

Am aware that people with Disabilities have not been given priority in allocation of business

opportunity within the Trans Nzoia County yet there are many disabled youths with potential

to do business effectively for the betterment of the county.



Mr. Speaker, Sir, this assembly urges the County Government to set aside at least five

percent of all business space within the Central Business District in Kitale, County markets

and Trading centers for people with Disabilities.

As I had said earlier, I am not feeling well and will not talk too much .I urge members to

contribute to the motion.

Hon. Sikowo: Thank you Mr. Speaker Sir (Point of order) When we look at this motion, it

should have come as a question. This is the property of the County Government department

which will come with a reply.

Hon. Sakong: Thank you Mr. Speaker Sir. The member should prove that those living with

disabilities were denied opportunities. I second Honorable Sikowo. It should be put as a

question and the task of County Executive Committee County Executive Committee to

answer.

Hon. Nelima: Thank you Mr. Speaker Sir (Point of Information) Going by the nature of the

motion, it is similar to the one brought by Honorable Masibo.

Hon. Masibo: Thank you Mr. Speaker Sir. Yesterday’s petition was a public one, it was not

my petition.

Hon. Nelima: Thank you Mr. Speaker Sir. Iam not talking about yesterday’s petition. I am

saying it was similar one that favored the disabled and we passed it. We don’t have evidence

the disabled were denied business space. It should come as a statement or a question.

Hon. Laban: Asante sana Bwana Spika. Kuna walemavu wamelalamika kwamba askari wa

kaunti wamewatoa pahali pao pa kazi haswa sehemu ya kuuzia maji. Hili jambo ni mbaya

asana.

Hon. Sakong: Thank you Mr. Speaker Sir. We should not appear to be denying the disabled

facilities they deserve; we are only giving him a direction so that we can pass it later. He got

an advice from you Mr. Speaker to withdraw. The prayer is only creating confusion. We shall

back it 100% if it comes as a question. He says he has two petitions. These are only hearsays.

Hon. Masibo:Thank you Mr. Speaker Sir. I don’t know where to start but I support the

motion. Yesterday, there was a petition and members wanted to shoot it down. Honorable

Nelima, said I brought a similar motion last year. I don’t know where we are. This is a

constitution affecting Kenyans just like women. This Assembly is going round and round

when it comes to the disabled. Hon. Laban was not born a disabled person. Let us respect

them Let us not underrate them. They are important.



Hon. Sakong:Thank you Mr. Speaker Sir. (Point of information)Nobody is disputing the

5%. What we are arguing is that it be put in the right way so that the disabled are supported.

Hon. Too:Thank you Mr. Speaker Sir. The marginalized and people living with disability

have always gotten bursaries just like other ordinary people. We have given them bursaries

and we are only asking that the motion be put in the right way as this House is guided by

rules and procedures. None has been denied help. Recently, I saw a disabled women in town

doing in business and I appreciate. The other day, we passed a motion for buildings to be

constructed with special facilities for the disabled.

Hon. Sikowo: Thank you Mr. Speaker Sir. We don’t have intent to kill the motion. We

want to save it. Even if it is debated, it would have been thrown out and we would not have

achieved the mission. That way they will not feel overlooked.

Hon. Masibo: (Point of Order) Thank you Mr. Speaker Sir. I wonder what is going on

members are only contributing and going after me. Was I through Mr. Speaker?

Hon. Speaker: You had concluded your remarks unless you request for an extension.

but we oppose the way the motion was constructed. The consideration of the constitution

versus people with disability has also been emphasized. I advise it be brought in form of a

petition I learnt that this motion can be included into the Gender Committee which it was

referred to. He should better withdraw. Thank you.

I beg to GIVE NOTICE ofthe following motion

AWARE that Article 27 of the Constitution of Kenya 2010 gives the citizens of this County and residence of Trans Nzoia County a right to life.

FURTHER AWARE that Health Services, including county Health facilities and primary Health care have been declared to the county government pursuant to paragraph 2 of part two

of the fourth schedule to the constitution.

CONCERNED that most county health facilities are in deteriorating state with inadequate

medical suppliers, lack of crucial medical equipments and human resource.

Mr. Speaker, Sir,



This Assembly urges the county government to equip all county Health Facilities with

requisite equipment and materials, sufficient medical suppliers and adequate well trained personnel to ensure that residents of Trans Nzoia County get the required services.

Hon. Were: Mr. Speaker, I would like to urge the Hon members to support the motion.Mr.

Speaker Sir, all our Health facilities’ are not equipped and were inherited from the National

Government. This motion is good and I like Hon members to contribute to this motion given

that all Hon members come from different areas.

Hon. Mutuli: Thank you Mr.Speaker Sir, first I would say thank you to Hon. Were for

bringing such a motion. As aperson, I do not see the green light at the end of the tunnel but I

prefer that it came as a question and it’s already budgeted for and as per facilities and a

surplus. They are already equipped with facilities and there is an advertisement of the staff in

all other hospitals or development funds which are long overdue, thank you. I do not support

Hon. Kitur: Mr.Speaker Sir, indeed the legal team of this Assembly and county Government

has failed us, because it doesn’t bring the legality of the motion. It’s a clear contradiction. It’s

like reminding you to take bread to your family and you know it’s your responsibility.Do you

need a motion to remind you your work? It’s the executive to implement the laws which are

be passed by the Assembly. The laws are very clear. The budgetary allocation of all the

financial years that Health department has been given money and this financial year alone, it

has a budget of close to 1.8 Billion shillings. We need to ask the County Executive

Committee for Health and the Chief Officer of Health over this, and with evidence, we can

surcharge and fire them if nothing has been done. The Chairman of Health Committee can go

and visit all the hospitals and Health facilities and make a report to the same. Am glad the

motion came from him as the Chair of Health. It’s upon us to provide the ideas and the

Executive to implement .Article 181 on the responsibility of the members of the County

Assembly, it is not to follow the day to day activity of the executive. I would like the legal

team to come up with motions and bills that conforms to the National Assembly norms; I do

not support this motion.

disease outbreak in Twiga near Chepchoina and the Health facility which was there was



Constructed by CDF and it had no furniture, there was only a table, we are all aware that the

Health sector was devolved and the National Government was not ready to let go. I saw it

prudent to come up with this motion so that other areas can be equipped and bring services

closer to mwananchi. I was expecting members to support the motion especially Hon. Kitur

owing to the fact that his area has only one hospital at Namanjalala Centre

Hon Kitur: (Point of Order) Mr. Speaker Sir, what parameters did he use to conclude that

my area has no hospitals?

Hon Were: Mr. Speaker Sir, I wanted to say that it is not really poor, but in his entire ward,

there is one hospital and one Health Centre, and it’s unequipped. I have no words to describe

this, am a very sad man. I beg members to re- consider their stands and support this motion so

that we equip our hospitals and we stop doing harambees for our people, thank you

PUBLIC WORKS, TRANSPORT AND INFRASTRUCTURE.

DATED 12th April

PROFILE OF COUNTY DEVELOPMENT PROJECTS FOR 2013/2014 TO 2015/16

FINANCIAL YEAR.

The Department of Transport and Infrastructure comprises of 5 sectors, namely; Public

Works, Road, Energy, Transport and Infrastructure.



1.0 PUBLIC WORKS SECTOR.

Under this sector the department routinely prepares Bills of Quantities (BQs), supervises

and gives certificates of completion works in the County.

1. ROADS SECTOR

During the financial year 2013/2014 the Department opened at least 1,500 km new roads

of the estimated total of 2, 95.5 km of County roads in all the 25 Wards in the County.

Most of the roads works carried out were on grading which was accompanied by

installation of culverts and drainage structure at strategic points, the latter exercise

continued during the 2014/2015 and 2015/16 financial years. Most of the roads works

was contracted. The road construction and maintenance work through contracting was

stopped due to the anomalies that were detected but in-house patchy grading of

impassable roads sections continued during 2014/15 and 2015/16 and 2015/16 financial

year. Each ward was allocated Ksh 1miilion for each culvert, hence at total of Kh 50 over

the two financial years.

2.0 ENERGY SECTOR.

In an Endeavour to turn the County into 24hours working economy and reduce insecurity,

the County Government embarked on a program of lighting up Kitale Town and other

Trading Centre’s. This programme is being implemented in collaboration with the Kenya

Power and Lighting Company. The Programme has progressed well and is planned to

continue as shown in Table 3.

3.0 TRANSPORT SECTOR

Being a major flagship project, the county government has design a modern bus park within

Kitale town and is currently under construction. The bus park is expected to be completed by

September 2016. When complete the bus park will host more than 300 Matatu’s, 50 buses

and a 1000 small traders at ago.

is a respond from the County Executive Committee in charge of Transport through the

question that was asked by the Implementation Committee. Therefore, members we have

heard from the Chairperson and may be I will wish to open the floor for members to react on

the same report before we adopt a comprehensive report we got from the County Executive

Committee, may be any observation, any spelling checking,?

Hon.Mutuli:Asante Bwana Spika. kwa kweli Bwana Yator ametoa riporti mwafaka na jinzi

alisema ya kwamba uenda lugha ya mama ikamuganganya na ni kweli. Lakini alipofika

katika eneo lake alisoma vizuri sana na nikajua kweli alikuwa anakompuleintu. Hivyo

kwangu ametoa ripoti kamili kabisa isipokuwa nilitaka kurekebisha tu herufi ‘’ Nyakinywa

Lorie’’ bali sio Lorig alafu ya mwisho Ngonyek Emkwenyi bali sio Emkwei hiyo tu asante

Bwana Spika.

Hon.Osiako: Thank you Mr.Speaker, mine is just the word the way it has been spelled in

Cherangany Subcounty Sinyerere Ward it should be Makindu and not Makundu.

Hon.Sikowo: Thank you Mr. Speaker it’s just in Endebess Sub County the right name should

be Kapkures they should remove the letter ‘’I’’

can clarify is it Limuli or Lumuli?

that was done in the ground or whether it was not captured. It’s not all about the spelling and

anything else so in respect Mr. Speaker can you guide us.

Hon.Weswa:Thank you very much Mr. Speaker, am a member for Sirende Ward, what the

Chairman has tabled before this honorable House according to my ward it is not true.

Mr.Speaker, the proposed culverts as per CEC and what I know as the area representatives it

is not true because we have captured almost seven culverts including for the money that have

been set aside for Ward specific for the same Mr. Speaker, so I don’t know whether this

report it’s a true report from the ground because according to me, could Sirende Ward

demand one culvert. Mr.Speaker and even the culvert the one has been mentioned John way

Ngokho Road is not even among the proposal. I captured Bishop Abwondi culvert ,Bishop

Omondi culvert, we have Machungwa B Culverts,Machungwa A culverts,we have Toro

Culverts and we have Toro B culverts so Mr. Speaker as the representative, I don’t agree with

the report that the Chair has read for Sirende because during the identifying of the said areas,

I personal accompanied an officer from the Roads departmentMr.Wanyonyi whom I went

with, so the areas Chairman is mentioning is not among the priority area.

Speaker: Chairman, do you know that some members have been omitted in this report ,are

you aware as claimed by the Hon.Weswa?

Hon.Yator:Mr.Speaker, may be you give me time so that I conduct whoever is concerned.

The CEC, maybe we shall have time with the CEC in the course of two weeks’ time and

present another report to this House.

Speaker:They have not captured the culverts mentioned by Hon.Weswa you can lias with the

CEC who gave you the report.

Hon.Nelima:Mr.Speaker, there is a place where Hon. Chairman read as Makona culvert

under Kwanza but when you look at the spelling they are not Makona but Makhon so I don’t

know how it reads, the neighbor of that area can help.

Speaker: Thank you for your concern its written Makhon culvert. I want to advise the

Hon.Yator the Chairman please inquire the right name for the culvert in Kwanza.

Hon.Osiako: Thank you Mr.Speaker something is missing here in Sinyerere Ward, I had

three culverts Makunga,St.Christopher,Makinndu Okelo and am not seeing Sitati foot bridge

and it has not been captured.

Speaker: Chairman there is foot bridge called Sitati foot bridge in Sinyerere Ward and the

area MCA is saying it has not been captured and it was there therefore it was to be captured

in this report, the

Hon.Mutuli: The only thing I wanted to say the Hon.Nelima comes from Matisi but if the

area MCA could be around she could have be in position to tell us the way Hon. member for



Hospital has done because she knows the name very well.Now to me, Mr. Speaker, there is

an issue of specific culvertsin fact for me I came up with ten of the latest so I don’t know

whether were captured or not because I have eight in number that I have not seen in my list,

we want also the Hon.Mheshimiwa to go back and say that in Kaplamai I have ten. Thank

you Mr. Speaker.

Hon.Nelima:Mr.Speaker, under Matisi WardSaboti Sub county it is supposed to be read

Sitabicha and not Sitabichi.

Speaker: I have seen it thank you for your concern, the Hon. members since this question

was asked by the chairperson for Implementation Committee I want to refer this same report

to the implementation Committee to confirm as weather it reflect the work done in Trans

Nzoia County or some other culvert have been skipped therefore any member of

implementation committee who is around here? Please I want to refer this report to the

Implementation committee to confirm on behave of this House as whether this report is fully

implemented as responded by the CEC so as they give us the comprehensive report as to

which culverts was there, which has been omitted in the Trans Nzoia county

REF: PROPOSED KITALE MAIN BUS PARK AND MARKET PROGRESS

UPDATE.

Reference is made to question no.016/2016 to the executive committee member in charge of

public works progress and health dated 28th April 2016.

Below is our response;

The progress of the contribution of the construction of the Kitale Main Bus Park.

The overall construction works progress at site is approximately 40%.

How much work has been done on the said Bus Park.

40% of the work has been done.Further, 90% of the subcontracts have been tendered,

awarded and fully mobilized on site.They include:

General electrical installations subcontractor.

General installations subcontractor.

Plumbing, drainage and fire protection installations subcontractor.

Kitchen extract and system subcontractor.

When is it likely to be finished?

With the overall progress of works at 40% and with current rate of progress, the practical

completion date is estimated to be September 2016.The same can be completed earlier with

availability of funds.

Mr. Speaker allow me to table the response, respondent by the CEC of Transport and Public

Works pertaining the question that was asked by Hon.Omondi who is the Vice chairlady in

Transport and Public works committee thank you.

Speaker:Thank you the Hon.Yator for your respond, I have a response with me which has

been tabled by the Chairperson as asked by Hon. Omondi. I want to hear from you, are you

satisfied with the response?

Hon.Omondi:Thank you Mr.Speaker you as the Chair will determine a lot thank you.



Speaker:The member who asked the question Hon.Bernadine Omondi and on behalf of this

House I want to open the floor for members to deliberate on the same issue before its adopted

in this House.

Hon.Weswa:Mr. Speaker am disappointed with this report because this is one of the flagship

project in the county ,we are talking of 300 million shillings Mr. Speaker you cannot expect

the Chair of this Committee to give usa summary of the report in A4 page. Mr. Speaker

without even outlining the cost of the project, how much has been paid so far,Mr.Speaker as

we are preparing for the budget this are the projects that are consuming a lot of money Mr.

Speaker,we don’t expect the Chief Officer in charge of roads even if he has no respond to this

House Mr. Speaker just to give a sketch report for the purpose of trying to convince the Chair

Mr. Speaker this are my prayers that because we are not satisfied we propose that the

committee under my able Chair Hon.Yator physically to go to the same project with the

accompaniment of a technical person so that we can be able to get a full detailed report. We

want to know how much money for the contractors have been paid so far because we

understand that the same project Mr. Speaker they are proposing for additional funds, also

they are proposing for amendment without approval of this House this report Mr. Speaker is

abuse for the same office because even if he could take a month we wanted a comprehensive

report as we prepare to go for the budget so that we can be able to see whether to add more

money or reduce thank you Mr. Speaker.

Hon.Sikowo:Thank you Mr.Speaker,am surprised that the answer to Hon.Omondi question is

clearly stated 40% of the work done, that 60% of the work has not been done and yet we are

only imagining that we will be able to know,how that is possible, Chief Officer went

fartherand said 90% of the sub-contractor has already been tendered. I would like to get the

clarification again that does that mean that they have been paid because if it means tendering,

it probably be better if the Chief Officer will clarify whether this amount of money is seating

somewhere or they are stillasking for some money. Butit’s not realistic to say that this work

will be done by September because this is a flagship project I was hoping it should be

completed by September but if 40% work is done there is still a lot am disappointed thank

you Mr. Speaker.

Hon.Sikowo:Am giving my opinion about the report, I will be lying so am rejecting it will

not be finished by September.

Speaker:Any other member? The hon. House this is a response from the Chief Officer about

the progress of the c obstruction of the Kitale Main Bus Park, how much works has been

done so far and when is it likely to be finished what is your reactions are you rejecting the

report or accepting.



Hon.Nelima: Mr. Speaker, I want to buy the idea of leader of majority that we go to the

ground and evaluate how everything has been done, I want to agree with the report, this

people are genuine it could not be good for them to exaggerate and say 80% and yet they

have not done and when you look down here they are saying the same can be completed

earlier with availability of funds which means if they can be given funds then we will look

into the time frame, I just want to agree with the report the way it is.

Hon.Mutli: Thank you Mr. Speaker for me, according to what Hon. Omondi asked she has

been answered but my only problem is that the last part of Hon. Nelima’s, has said if they

will be availability of funds and already they are talking of 40% so we need to go deeper like

the leader of majority has just said so that we found out how much have they used so far

otherwise for me according what Hon. Omondi wanted has been answered right away.

Hon. Too: I also rise to agree with the report as table the question was asked how much work

has been done at the Bus Park. The Chairman could have seated with CEC or Chief Officer

so that they analysis the report today. We could be able to agree or disagree. But now

because you didn’t seat together, we don’t want to lie. As a member, we have been to the site

and we saw the work and I want to sayit’sjust around the percentage given because the

question was not written that we wanted to know the amount that has been paid and the

remaining one, we could be asking such questions Mr. Speaker but next time when the

question is being asked concerning any department, we are supposed to go and tour the

project so that when we come back and seat with the CEC or Chief Officer of the same

department, we are able to see facts before we table the report. For now I agree with the

report thank youMr. Speaker.

Speaker:Thank you any other member who has any issue or comment? If there is no any

member I want to say that this is a respond from the CEC as the question was raised to this

hon. House as per the contribution from you hon. Membersthis questionhas been fully

answered as per the question let me put a question.

Nzoia County Government Budget Estimates for the Financial Year 2016/2017.

Hon. Kisaka: Thank you Mr. Speaker Sir. Mr. Speaker, I rise to give the report on County

Budget for the coming Financial Year 2016/2017. Mr. Speaker, according to the PFM Act,

the Budget should be tabled on 30th day of June. The law also provides that we do Public

Participation and Mr. Speaker we did that from 10th June 2016 to 20th June 2016 and this

time we carried our Public Participation in every ward. In so doing, we involved all

1. INTRODUCTION:- Mr. Speaker Sir,

This is the report of the County Budget and appropriation Committee on the proposed Budget estimates for the County Executive and County Assembly of Trans Nzoia following its public

participation in 25 wards across the county, an exercise carried out between 10th to 20th June 2016.

2. THE MANDATE OF THE COMMITTEE

Mr. Speaker Sir

The County Budget and Appropriation Committee is a Creature of Standing Order 187.

The Committee is mandated to:-

a) investigate, inquire into and report on all matters related to coordination, control

and monitoring of the County budget;

b) Discuss and review the estimates and make recommendations to the County

Assembly;

c) Examine the County Budget policy Statement presented to the County Assembly;

d) Examine Bills related to national(sic)County budget, including Appropriation Bills;

and

e) Evaluate tax estimates, economic and budgetary policies and programmes with

direct budget outlays.

3. AGENDA

Mr. Speaker Sir,



Pursuant to the above mandate the Committee’s agenda was to involve and get the public

views on the Trans Nzoia County proposed Budget estimates for Financial Year

2016/2017 as required by the law.

4. PUBLIC PARTICIPATION PROPOSALS ON THE TRANS NZOIA COUNTY

PROPOSED BUDGET ESTIMATES FOR FY 2016-2017

1. Works, Transport And Infrastructure

a) Rehabilitation of the County Garage be reduced and be added to the Grading,

Murraming and leveling.

b) Bus park Construction be reduced and be added to the Electrification

c) Construction of Boda Boda shades be reduced.

d) Construction of Office at the Bus Park all amount be added to Road Maintenance.

2. Land Housing and Physical Planning.

There was no major objection.

3. Economic Planning, Commerce And Industry.

a) They Suggested that the amount allocated for JuaKali Boda boda shades be

removed and the amount be added to Construction of Boda Boda shades and be

transferred to Works, Transport and Infrastructure to avoid repetition.

4. Agriculture, Livestock And Fisheries

a) Tissue Culture Laboratory and Banana seedlings with allocation be reduced by and

the amount be added to Fruit Tree Nurseries.

b) Construction of grain stores be reduced and the amount be added to Improvement of

indigenous Chicken.

5. Environment Water And Natural Resource

a) Sanitation/Conservancy be increased.

b) The amount allocated for Drilling be moved to Drilling and Rehabilitation of

boreholes.

6. Gender, Youth, Sports, Culture And Tourism

a) Designs for Sports Facilities be reduced and the amount be added to Rescue

Centre(Bahati).

b) Mobilization of Youths and Women Skills be reduced and the amount be added to

Women and Youth development Fund.

7. Education.



a) ICT Equipment, Services and Infrastructure all amount be added to the construction

of ECDE classrooms.

b) They also proposed to do away with the amount Ksh2000,000 allocated for

Motivation of ECD caregivers, they did not specify where the amount should be

moved.

c) Proposed the amount allocated for CATs be removed and added to Tools/equipment for

polytechnics .

d) Amount allocated for ECD classes be removed and added to Latrines (Schools).

They proposed that the amount allocated for Equipment of Mt. Elgon Hospital be reduced

and be added to Dispensaries.

11. County Assembly

There was no objection.

CHALLENGES OF PUBLIC PARTICIPATION EXERCISE

Mr. Speaker Sir,

The following are the challenges that the committee encountered during public participation

exercise;

1. The budget allocated to the exercise was very small

2. Members of the public found it difficult to understand the abbreviations used like

TNZ, AMS and ATC

3. Some members of public failed to attend because of lack transportation.

4. Members of the public did not have enough time to go through the proposed budget .

RECOMMENDATION

Mr. Speaker Sir,

The following are the proposed solutions/recommendations to the said challenges;

Mr. Speaker Sir,



a) The assembly should allocate more funds to public participation process to make it

more successful

b) We recommend that in future when printing the budget estimates the use of

abbreviations should be accompanied by the explanation for members of the public to

understand it better.

c) We recommend that the county should allocate some money to help transport

Members of the public in their respective Wards who wish to participate but due to

lack of transport.

d) Copies of the proposed budget to be distributed in advance to allow members of the

public enough time.

Pursuant to the above mandate the Committee’s agenda was to examine the Trans Nzoia

County Assembly proposed Budget Estimate for the FY 2016-2017 and propose amendments thereof for subsequent consideration, debate and adoption by the plenary.

3. COUNTY ASSEMBLY BUDGET ESTIMATES FOR FY 2016-2017

The budget committee deliberated and made the following recommendations on the proposed

assembly budget.

A. Proposed assembly budget for FY 2016/2017

The committee adopted the proposed assembly budget for FY 2016/2017 both Recurrent

and Development Estimates totaling to ksh. 629,956,208 (say Six Hundred and twenty

nine million, nine hundred and fifty six thousand, and two hundred and eight only) as per

the summary in the table 1.1

a) RECURRENT BUDGET FY 2016/2017



The proposed total recurrent budget of the county assembly was increased from kshs.

498,398,759 to Ksh. 534,271,010.This include personnel emoluments for Honorable

members and county assembly staff of Ksh. 356,655,804 and operation and maintenance of

Ksh. 177,615,206 as per the table above.

Committee recommendation

The committee adopted the proposed recurrent budget with some amendments on operation

and maintenance as follows:

a) Allocation of Kshs 21,500,000 for administrative cost and speakers social

responsibilities was reduced by kshs. 16.5 million to Kshs 5 million

b) Allocation for water services was increased by Kshs 2 million to kshs2.55 million so

as to cater for the payment of water bills and the construction of water reservoir to

curb water shortage in the county assembly

c) Allocation for domestic travel and subsistence allowance was increased by kshs. 11

million from ksh. 39,053,616 to kshs 50,053,616

d) Allocation for publishing and printing services was increased by kshs.2 million from

kshs. 7,818,425 to kshs. 9,818,425

e) Allocation for training and capacity building was reduced by 10 million from 15

million to 5 million.

f) Allocation for public participation was increased by 10 million from kshs 5 million to

Kshs 15 million.

g) Allocation for catering services was increased by 1.5 million from kshs. 8million to

kshs. 9.5 million

h) The allocation for the purchase of staff uniforms and clothing was increased by kshs.

450,000 from kshs 550,000 to kshs. 1 million. This allocation will also include the

purchase of county assembly staff identification tags.

i) The allocation of sanitary and cleaning materials was increased by kshs. 280,000 from

kshs.220, 000 to kshs. 500,000 so as to cater for the purchase of hand driers,and

cleaning materials.

j) Allocation meant for contracted professional services of ksh. 1.1 million was

completely removed .

k) Allocation for KICOSCA & CASA games was increased by kshs 4 million from kshs.

6,050,000 to kshs. 10,050,000

l) Allocation for the purchase of office furniture and fittings was increased by kshs. 2

million from kshs. 880,000 to kshs. 2,880,000

b) DEVELOPMENT BUDGET ESTIMATES FY 2016/2017

The committee adopted the proposed development budget of the county assembly of Ksh.

95,685,198.

which I now put the question that this report be adopted.

Hon. Kitur:(Point of Order). Mr. Speaker, I do think that you should be calling for the

seconding and also give time for us to discuss before you put a question.

Hon. Maling’a: (Point of Concern). Mr. Speaker, when I go through this report, I don’t see

my name and I attend fully in Kisumu.

Speaker: Honorable Chair, can you clarify to the House if Hon. Maling’a was present?

Hon. Kisaka: Mr. Speaker, I think it is just typing error, but Hon. Malinga was present. In

fact she was active in the exercise.

Speaker: Hon. Maling’a, accept that it was a topographical error. Now Members, can we

have one member to second the report?

Hon. Farid: Thank you Mr. Speaker Sir. I second the report.

Speaker: Thank you, Honorable members; I will go with direction of Hon. Kitur. I will give

3 chances on each side. I will start with Hon. Kitur.

Hon. Kitur: Thank you Mr. Speaker, once again I want to thank the Honorable House for

the Budget. Mr. Speaker, this Budget as provided is a process and today we are at the apex in

the , I want to thank the Executive and Assembly for the effort made to come up with such a

budget. It has been a nerve cracker thing. Mr. Speaker, we got independence of politics but

not the economy to do our things as we want. Mr. Speaker, under road works; this is the only

County that doesn’t have a tarmac road. We have been rated down the line but I think this

Budget will place us somewhere. The constitution has equalized all 25 wards to have the

same development by introducing the Ward Specific Funds. My last prayer is that the

County Assembly has played its part. The remaining part is for the Executive to implement.

Hon. Terry: Thank you Mr. Speaker Sir. Mr. Speaker, I think the House has worked so much

for the Budget. It is a good Budget.



Hon. Mutuli: Thank you Mr. Speaker Sir. First and foremost, I thank the Chairperson and

the entire House without forgetting the Executive. Indeed, for the last 50 years, Kenyans have

not been experiencing the fruits of their country but now the Governance is in their hands. If

these things go well and what we have put here be implemented, we will be far ahead.

Hon. Sakong: (Point of Clarification). Mr. Speaker arise to get a clarification from the Chair.

The section A, I don’t know what is written because we reduced 20 million to 10 million in

our recommendation. But it is not here.

Speaker: Chairman, can clarify to the House?

Hon. Kisaka: Mr. Speaker Sir, I thank the Member for highlighting the error. We reduced to

10 million.

Speaker: Honorable Members, can somebody move an amendment on that.

Hon. Sakong: Thank you Mr. Speaker Sir. Mr. Speaker, because I am the only members who

realized, I stand to move an amendment that the figure be changed to read 10 million.

Hon. Kisaka: Mr. Speaker, in fact in the actual estimate, in the Actual document, it is 10

million.

Hon. Kaboloman: Thank you Mr. Speaker Sir. I think what I want to say is to add that the

final document is 10 million.

Speaker: Thank you Honorable Members. Before we continue, let me put the question on the

amendments raised by Hon. Sakong .

Hon. Farid: Thank you Mr. Speaker Sir. Mr. Speaker, I want to congratulate my colleagues

and my able Chairman for the good job they have done. This budget has been well balanced.

They have done it well. The Jubilee Government has done good thing to financing the

Budget.

Hon. Sikowo: Thank you Mr. Speaker Sir. I want to say that the committee has done a

recommendable job. But I want to inform Hon. Farid that Jubilee is not doing us any favor.

This is our tax money.

Hon. Sakong: (Point of Information). Mr. Speaker Sir, I want to inform the Honorable on the

floor that it is true it is not a favor, but it is managed by the Jubilee.

Hon. Sikowo: Thank you Mr. Speaker, I appreciate, I accept but it is our right to get the

money.



Hon. Masika: Thank you Mr. Speaker Sir. Mr. Speaker, I was also supporting that the

Jubilee Government has done a good Job for managing the money. I urge that this budget be

implemented.

Hon. Maling’a: Thank you Mr. Speaker Sir. I want also to say that we are doing a

recommendable job. Mr. Speaker, we are the pioneers of this assembly and we want when we

leave here, we leave a legacy. We have proposed for a restaurant to be put up. If you go to

other counties, you will enjoy the facilities that are there in the restaurants. We also want to

have a secured place so that when our visitors come, they fill safe. And for doing this, I have

seen we are constructing a perimeter wall. I finish by saying the budget is good. God bless

the Chair. Thank you.

Hon. Kaboloman: Mr. Speaker Sir, on point of view,I want to go to the allocation of 43

million for the library and Research Office. Mr. Speaker Sir, so many motions have been

passed without having a plan to retrieve them. We want to set a place for the reference. For

the allocation of this 43 million, I hope the Honorable Members will enjoy.

Hon. Too: Thank you Mr. Speaker Sir, I thank you and the entire Board. Since we came

here, we have seen some development like constructing the Parameter wall. The former local

authorities used to receive little amount but they did a good job but I think now, it is a

challenge to us, we are receiving huge amounts and we need to do more than this.

Hon. Weswa: Thank you Mr. Speaker Sir. I have also realized the input we have made. I

think everybody will want to say that we are also in the records. As we approach the 2017

elections, we need to change the environment better than we found it. Let us make sure that

members get equal services.

Hon. Kitiyo: Thank you Mr. Speaker Sir, I support my able Chair for the good work. But Mr.

Speaker, one challenge that members faced during the public participation is that, the public

did not know that this budget should be prepared with them through the Executive. So I urge

that when Executive are preparing, they should go to the ground.

The budget committee deliberated and made the following recommendations on the proposed

budget estimates for the county.

A. RECURRENT BUDGET FY 2016/2017



Mr. Speaker Sir,

Proposed Recurrent Budget estimates for FY 2016/2017 for the county was Kshs.

3,482,223,755 for both executive and county assembly broken down as per the table 1.1

below:

county assembly ceiling by CRA.

Proposed Development Budget estimates for FY 2016/2017 was Kshs. 2,707,036,964

consisting of Kshs.95, 685,198 for county assembly and Kshs. 2,611,351,766 for

county executive.

The committee recommends the following amendments to be adopted by this honorable

a) The allocation for Construction of offices at the Bus Park be reduced by Kshs.15,

b) County Roads to be increased by Kshs. 15m from proposed amount of

Kshs.35,000,000 to Kshs.50,000,000 (Kshs.2,000,000 per Ward)

d) Pending Bills (payments for contractors) to be given allocation of Kshs.56,000,000

The Proposed development budget estimates for FY 2016/2017 under this sector was Ksh.

The committee recommends an increase in allocation in this sector from Kshs. 164,020,000

to Kshs. 175,020,000 to accommodate ward specific projects.

c) The allocation for Expansion /construction of Health facilities in wards to be

has read. I want to congratulate the committee and the Office of the Clerk for facilitation. I

want to say that members who went to Kisumu discharged their Mandate. One of our

mandates here is to pass the Budget and we are fully discharging our duty. Mr. Speaker,

while the Executive carries their budget, they should reach the grassroot, because this is not

what they have been doing. I want also to say that for the last three years, we have been

passing budgets but little has been implemented. But this time we are praying that let Lord

will convict them to implement this budget.

Hon. Mutuli: Asante sana Bwana Spika kwa kunipa fursa hii nami nijangie Bajeti. Nataka

kwanza kumshukuru mwenye kiti bila kusahau waheshimiwa wiliofanya kazi bora . Bajeti

hii imeenda mpaka mashinani na haya ndiyo matakwa yao. Bwana Spika, ningependa

kukusia Wizara ya Afya. Bwana Spika tunataka kwa kila Zahanati tuwe na madawa ya

kutosha ili wagonjwa wasije wakaumia. Pia ningependa kukusia Bwana Spika kwamba, kuna

watu ambao husembea kazini na hawatekelezi waajibu wao. Naomba wakati huu tukienda

nyumbani, mungu ashushe roho mtakatifu watekeleze maombi ya hii bajeti. Asante.

Hon.Omondi: Thank you Mr. Speaker for giving me this chance. I want to thank you Mr.

Speaker, the Office of Clerk including the able Chairman. I want to comment on the Budget

of the County Executive. I want to urge the Chief Officer of Roads and Transport works and

his County Executive that up to now, I don’t know if most of us will go to our homes in

Endebess. Now money has been allocated for roads, I want to believe that they will do

something. These roads are impassable. As the Honorable House, we have done our part and

the crucial part remains for the executive. This is the last budget that we have made with our

hearts. We urge the County Executive to implement.

Hon. Kisiero: Asante Bwana Spika kwa kunipa fursa hii. Nashukuru bunge hili kwani yale

yaliyo kwenye bajeti hii ni yale mwananchi alipitisha .Pili, nataka kusema kwamba kuna

watu walifanya kazi kwa barabara na mpaka sasa hawajalipwa. Nashukuru tume watengea

shilingi million 56 ili waweze kulipwa.

Hon. Makhanu: Thank you Mr. Speaker Sir. Mr. Speaker, I congratulate the Chair and the

entire House for the good job. I would like to contribute on this budget. First, Mr. Speaker

Sir, our major problem is roads. But this time we have allocated enough funds. We have also

allocated 2 million for fueling Graders. We want to make sure that our roads are in good

conditions. Second, we are also going to do marraming to our roads. We have also budgeted

for our contractors who did the job for the last 3 years and they have not been paid. We have

set a side 56 million to pay them. In the side of economic and physical planning, our

committee felt to promote the local business. We have set aside the money for model and



standard Kiosks which are going to the grassroots to help the local Mwananchi. On the side

of Gender and Youths Sports, Mr. Speaker, we know most of our youths love sports. The

committee has allocated 20 million. We have also 8 million allocated for every ward to

prepare for the fields. With that, our youths will be comfortable. We have also budgeted for

the uniforms for sports. Mr. Speaker Sir, as you know, a uniform brings a sense of belonging.

We have also budgeted for items for capacity building. In the past, we have been giving our

youths money but not capacity building them. I hope these funds will help our youths. On the

Health sector, at time, this House has been blamed of not allocating the money, but this time

we have allocated enough. On the referral Hospital, members said that indeed we feel and

wanted to support the referral, and that is why we put aside the money at a safe place and

when everything will be in order, we will allocate this money in the supplementary budget.

The same committee felt that we needed to promote Health centers so that minor illness can

be treated there. If we allow all to be handled at the referral, we will be just creating

congestion. We want to bring services close to our people. The other thing Mr. Speaker, the

committee allocated some money for this Community Health Worker (CHW). I want to belief

that the money was meant to facilitate them. In the previous budgets, we have not been

facilitating them and they play a big role. But this time, we have captured them at least they

will be happy.

Hon. Sakong: Thank you Mr. Speaker Sir. I also rise to give my sentiments to this budget. I

want to say that Hon. Mutuli who has saying that the lord may fill the Executive with the

Holy Spirit to implement the budget but before the lord fill them with the sprit, the Assembly

will fill them with the spirit of impeachment if they don’t implement what we have passed.

Mr. Speaker, I want to say that as we went out, the public did not have knowledge that the

Budget was supposed to be prepared by them. So I urge the Executive to involve the public in

budget making. Hon. Kisiero said that there are contractors who have worked for the last

three years and up to now, they have not been paid. Last time Mr. Speaker, we passed a

supplementary budget of 200 million and up to now they have not paid them but I heard that

they are in the process. We called the Chief Officer and asked him how much money does he

require to be added and he said that he needs 56 million and I am proud because we have

given him. Mr. Speaker, on the side of Health, in our public participation, the public were

complaining of 300 million for the referral and 150 million for constructing first and second

floor of the facility. And that we remove 150 million. Today, everybody knows that a case on

the referral hospital is in court. Let the case end, we will give them 300 million in the

supplementary budget. Mr. Speaker, this is the only county that automation has not been put

in the system. Now we have done this today so that the finance office be doing well with their

job. I don’t want to park my car aside and somebody comes telling me to give him something

so that he can release my car. On the issue of Nawiri Fund, the only thing I urge is the County

Executive should not put a lot of restriction for a local business woman in Matumbei to fear.

The issue of environment should be balanced. The issue of drugs in Hospitals, I think we

have solved. Today we have put a lot of money in drugs. We don’t want to hear that anyone

is suffering. Let them know that we have given them enough money.



Hon. Osiako: Thank you Mr. Speaker Sir. I like to thank the Chair and all Honorable House.

I will say something on environment. Really when we went on public participation, I noticed

most areas that because of bare land, there is a lot of soil erosions. People have not planted

trees. Cascades were all drawn by wind. Our people should plant trees. We need to emphasize

on this. On gravity, I stand here to say that we have done a lot but the problem in on the

procurement. We expect our Chief Officers will work hard on this. We should not be blamed.

We are passing this and I hope it will be implemented. On the issue of agriculture, fertilizer

should be procured at right time now that we have budgeted for that.

Hon. Terry: Thank you Mr. Speaker. First, I want to thank my able Chairman for the

wonderful job. I want also to thank the Honorable members who burnt midnight oil for the

betterment of the county. Mr. Speaker, I was not sure that today I will stand here to contribute

to the budget. I want to say thank you the Chair. My prayer is that since we have given the

Transaction of title deeds 50 Million; let the process begin so that our people get the title

deeds. Mr. Speaker, one day, we went to meet our President who comes from Jubilee and he

told us that he would come to give us the title deed. On the side of Agriculture, on the issue

of rabbit project, we removed and replaced with what favored the public. We sat down and

came up with this nice budget and my prayer Mr. Speaker is that you come up with a plan

through the Chair of Public Participation Hon. Wambalaba so that we go out and see what

has been implemented. Mr. Speaker, I want to say that as much as we say, there are good

things. There are nice streetlights in Sikendu and Kiminini as you head to town. And we do

say that let us have enough lights especially for Hon. Too who was complaining. Let her be

supplied with street light so that Chepsiro people can do business at night. When we passed

through Kiminini and Sikhendu it was very nice.Mr. Speaker, I finish by saying that it is our

duty to do oversight according to chapter 184 of the constitution Act.

Hon. Kemei: Thank you Mr. Speaker, I also raise to join my colleagues on congratulating the

whole House for the good job. I want to raise some few issues that are a great milestone to

our County. Mr. Speaker, this time we have Hospitals running, this will help us a great deal

in health sector. Also we have allocated for the drugs in our dispensaries. Next, this is the

second year we are going to benefit from Ward Development Funds. Mr. Speaker, we are

confident that today we are going to see more fruits coming.

Hon. Kutitila: Thank you Mr. Speaker Sir. First I want to apologize for coming late but I

want to appreciate you and all members for supporting me when I told you that I had lost my

brother through a road accident. Today I told my wife that we will be passing the budget and

it is my mandate for me as the member of the Assembly to go and contribute in the passing.

Mr. Speaker Sir, I want to begin that the problem is on the implementation. Every budget we

pass in this House, the Executive don’t implement even 60% of it. Mr. Speaker on the issues

of Title deeds, I want to call upon the National Government being led by the President from

the Jubilee that they have given us hard time on issues of title deeds. Last time, the president

told us that we reach 100,000 people for him to come and issue the title deeds. But this time



we have budgeted for it so that we reach that number. Last time we budgeted for 60 million

and now we have budgeted for 50 million which I am sure we will reach. Mr. Speaker, last

time we were 80,000 people and I think this time we will reach 100,000. But Speaker, I want

to tell Jubilee that they should not wait until it is campaign time to use the titles as an item.

Hon. Kisiero: (Point Information). Mr. Speaker, I want to inform Hon. Kutitila that the

President will be coming in the month of July.

Hon. Kutitila: Mr. Speaker, it is okay but let the Jubilee people tell him that when he comes,

let him release the title deeds. Everywhere people have received the title deeds. Second Mr.

Speaker, we have 22 million for at least the acquisition of land for expansion of the Airstrip

so that we will not be traveling to Eldoret to take flights. On the side of Agriculture, as Hon.

Osiako said, we have budgeted for the fertilizer but you will find the Fertilizer delaying. And

more so these people go ahead and collect money from farmers. On the site of County

Assembly, I appreciate that we will be dealing with our property. We can make our

construction now without difficulties. And as for the Speaker, who is the Chair of the Board,

make sure that people who get jobs here for construction are qualified and capable. I am

saying this because many people will come with papers but they are not capable. In my ward,

I cancelled the LSO of one contractor who was allocated the job of water project by the

Executive but was not capable. Mr. Speaker, let me rest my case.

Speaker: Honorable members, I know most of your hands are up but I am sorry. Due to time,

we do come to the end and we also have another item on Appropriation Bill which will also

MOTION

Implementation of the 2013/2014, 2014/2015 and 2015/2016 County Budget and

outstanding debts.

Hon. Milimo: Thank you Mr. Speaker Sir for giving me this opportunity that i may be able to

move the following motion.

Mr. Speaker Sir,

I beg to MOVE the following motion

AWARE that we are now just about to finalize the 2016/2017 County Budget Process;

AND FURTHER AWARE that this is the last Budget to be implemented during the life of

the first Assembly.



Mr. Speaker Sir, it is imperative that this House carries out a comprehensive Audit of the

extent to which the previous three budgets have been implemented and the outstanding

amount of County Government debts and their justification thereof.

Accordingly, I may move that by the resolution of this Assembly, the relevant committees of

the County Assembly do carry out a comprehensive assessment of the extent of

implementation of 2013/2014, 2014/2015 and 2015/2016 County Government Budgets, the

amount of County Government debts and their justification thereof or an ADHOC Committee

be appointed and mandated for the said purpose.

Thank you Mr. Speaker Sir.

Mr. Speaker, we as the Assembly more often than not, we have been just blamed harshly with

the public on the expenditure of the budget. We cannot have County Assembly and County

Government not working together. Our role as County Assembly is to approve the Budget

and provide oversight, but the implementation is part of County Government, to manage and

exercise their duties. Mr. Speaker, during the Budgets, this House can tell us how much we

have been allocating which I will have to read to you . In 2014/2015, the budget was Kshs.

15,166,144, 103/= of which 3.22 billion was set a site for development.

Hon. Kutitila: (Point of Order) Thank you Mr. Speaker, while the mover is moving the

motion, I would also like him to explain to us what it is about, because Mr. Speaker, when

you pass a budget and you don’t carry out oversight, you will be telling us that you don’t

know your job. Mr. Speaker, if somebody goes to court that we have not been carrying out

our role to oversight for the three Budgets that we have passed, what will we say? How can

ADHOC committee give a report when we are here? That means, we have not been over

sighting.

Speaker: Hon. Kutitila, the mover is elaborating on the motion and you wait him to finish

before you start objecting. So give him time to finish first.

Hon. Milimo: Thank you Mr. Speaker for your noble direction. Mr. Speaker Sir, there is a

saying that one time, there was a fire and an Ostrich buried its head in the sand thinking that

it was save. But Mr. Speaker, it was consumed. Mr. Speaker, when you look at this motion, it

is to carry out oversight. We know we have been complaining over County Executive and the

same County Executives have been called by the Senate to explain over the budgets. We are

alive to the fact that the public have been demonstrating on the street. It is us Mr. Speaker Sir

to carry out our mandate either to defend the County Executives or not. We have been

passing the budget and if you go down to the villages, there is nothing constructive that we

can be proud of. That is why I came up with this motion so that we have a comprehensive

report on the entire projects we have put in place using the past budgets and which ones are

remaining.



Speaker: Thank you Hon. Milimo for your elaborate insight. Honorable members, now this

is a motion brought by Hon. Milimo and the motion is sensitive. So I call upon you to

contribute.

Hon. Okul: Thank you Mr. Speaker Sir, first I congratulate the mover of the motion. Mr.

Speaker, Istand to contribute to this motion which is very noble. Mr. Speaker, we cried for

devolution and it came. Now the devolution is here, it stands and it will remain. We are aware

that implementation is very slow. We shall continue following to find out where the problem

is and why the implementation has not been done. Mr. Speaker, it is true we have not seen

one project finished and with this, if we have the ADHOC Committee to find out why, it will

help us. And this over sighting, i propose that we have an Audit Committee and Finance

committee to come up and help us. I support this motion Mr. Speaker. Thank you.

Hon. Kutitila: Thank you Mr. Speaker, I will stand by my words that this House has

Implementation committee which should carry out oversight role and bring to this House the

report. Why then ADHOC? Mr. Speaker, we are to oversight and we have been doing so. We

have been meeting with the concerned Executives. Mr. Speaker, it is not our mandate to go

out after passing three budgets and we wait for three years that we want to tell the public that

we are doing the oversight. Let’s say the truths Mr. Speaker, if we have failed, we have

failed. I can say like on the issue of the referral hospital, we said the Executive never

followed the right procedure. In fact I was with the late Hon. Matongolo and we emphasized

that the Executive have not followed the right procedure and now you see the referral has

been stopped. So who do we blame? We did our part. Everybody will carry his or her cross.

And we told the public the issue of referral hospital and now they are aware that the issue is

in the hands of anti Corruption.

Speaker: Hon. Milimo, we gave you time to explain and I thought you elaborated and

finished. It is now time for the members to discuss, or either you want to tell us something

new.

Hon. Milimo :( Point of Order). Thank you Mr. Speaker, the role of the mover is to convince

the members to understand the motion. Therefore I will not be comfortable when the Hon

member who has deficiency in reading mislead the House. Mr. Speaker, the motion clearly

want thatAccordingly, by the resolution of this Assembly, the relevant committees of the

done our oversight role and we are still doing it. Passing this motion will show the public

that we have not been doing our work and now we want to pretend that we want to work. Mr.



Speaker, like in my committee and you will bear me witness, we have been scrutinizing every

department and the County Executives have been complaining that the problem is with the

finance office and procurement. We have the Chairperson of Implementation and this House

gave him this work. What is his work? In my ward Sikhendu Mr. Speaker, I have been doing

oversight. Everything allocated to Sikhendu, I always make sure that it is implemented. Mr.

Speaker, like the Bus Park, We did our oversight, we went on the ground with the

Chairperson for Transport and we saw the work. We did our work Mr. Speaker. Therefore I

am saying that this motion could have come as a question so that we question the County

Executives on this. I don’t support this motion Mr. Speaker Sir.

Hon. Mutuli: Thank you Mr. Speaker Sir. First I should say that the emotion is not

necessary. Am saying this because now after the issue on referral hospital, People are coming

up with motions from nowhere just to impress others. If the members are properly saying that

the Implementation has not been done, then it is in his ward. Let him say no implementation

has been done in his ward. But for me in Kaplamai ward, there are many projects that have

been implemented.

Speaker :( Point of Order) Hon. Mutuli, when the motion comes to the House, it becomes the

property of the House but not the motion of a particular ward.

Hon. Mutuli: Thank you Mr. Speaker. I want the mover to come up clearly and tell us which

part has failed. The other way, may be to help him is to advise him to go and change the

motion to be a question. But passing this motion let it pass and all of us will be home. Thank

Hon. Kemei: Thank you Mr. Speaker Sir. I rise to congratulate the mover Hon. Milimo for

this motion. Sometimes back this House through the committee of Public Accounts and

Investment committee did Auditing of the money on the municipal council. I don’t why this

House is rejecting to carry out the over sighting of 2013/2014, 2014/2015 and 2015/2016

budget. The motion is valid because one, there is a part where the mover said we need to have

a comprehensive Audit of the extent to which the previous three budgets have been

implemented and the outstanding amount of County Government debts and their justification

thereof.Mr. Speaker Sir, we know that there is a lot of mess in implementation. Through the

sectorial committee, these committees will carry the inputs to implementation committee and

ADHOC Committee will make the final report. I support the motion because this motion if it

will be passed, it will give us a summary of want is implemented and what not implemented.

Hon. Likovele: Thank you Mr. Speaker Sir. I don’t know why Hon. Mutuli is laughing. Mr.

Speaker, I stand to support this motion. We have been having a problem in our hearts on over

sighting where by the committees wants to go out to oversight but is not facilitated. And this

gives room to the Executive to do their own things. So I am happy with the motion so that

the Office of the Clerk will not refuse to facilitate us. Mr. Speaker, there is a project in my

ward. It was allocated Government money worth 15 million and up to now nothing has

happened. So we want to go and find out if somebody pocketed the money.

Hon. Kutitila: (Point of Information) Mr. Speaker Sir, I stand to inform Hon. Likovele that

by tasking the Clerk to facilitate the committees it is wrong. That is the work of the Board but

not Clerks Office. So let him say that the Board has failed the Assembly but not the Office of

Clerk.

Hon. Kemei: (Point of Order) Mr. Speaker, I stand to tell Hon. Kutitila that Hon. Likovele

said that the Clerk to support the committees to go and do oversight, but he did not say that

the Board has failed the Assembly.

Hon. Sakong: Thank you Mr. Speaker Sir. First I want to apologize for coming late. Mr.

Speaker, if you look at me, you will realize that am not okay. Mr. Speaker, our Senator lost

his son and you can confirm from my moods that I am mourning. Mr. Speaker, I want to

begin by congratulating my Brother here for this motion. Somebody told me that the

Governor will be ranking the MCAs and funny enough Hon. Kisiero told me that I should not

be worried because I came late. Meaning I am number last. Mr. Speaker, if you start ranking

MCAs using the development project that are implemented in their specific wards, then you

are wrong. The MCAs must rank according to what he contributes in the House.

Hon. Masika :( Point of Order) Thank you Mr. Speaker, I want to tell Hon. Sakong that he is

just purporting the ranking. He doesn’t have any evidence to show. Therefore he should stick

to the motion.

Hon. Sakong: Thank you Mr. Speaker Sir. I just want the ranking to start so that you can

understand the importance of this motion. Mr. Speaker, in my ward Matumbei, 2014/2015

FY, a project in Kaisagat was allocated money and up to now, nothing has been done. I agree

that we go out to carry out oversight and bring back the report in this House. If in Matumbei,

there is a project implemented, let’s go and find out and we bring back the report. And if not



done, let us speak the truth. We don’t need to hide things because I am a straight forward

person. I want to finally say that in 2010, we had just the same story with my colleagues and

we ignored it. Mr. Speaker that sends us home. Thank you Mr. Speaker, and remember the

issue of our Senator who has lost his son.

Speaker: Thank you Hon. Sakong. But before you came in, I had made a communication.

Hon. Weswa: Thank you Mr. Speaker, it is very clear that after having had time to make sure

everything is okay with the budget, nothing goes on the ground. We have been crying out

oversight but nothing has been done. Mr. Speaker, I want to say that I met with some youths

in my ward that challenged me on the implementation and were asking me why Bikike

Hospital for the last 6 months has been lacking drugs. Mr. Speaker, outside there, we are

ashamed. The Public are misjudging us. If I buy a pair of shoes, they say that am using their

money. If I change the tires of my vehicle, they say that I am consuming their money. Public

knows that we get billions of money and no project has been implemented in previous

Financial years. Mr. Speaker Sir, we have to go and see how poorly we have performed.

There is no way we can pretend that we are okay. This county was very beautifully, a very

nice place that everyone admired. But if you go around now and see what has happened and

compare with our neighboring counties like Bungoma, Uasin Gishu West Pokot and Elgeyo

Marakwet Mr. Speaker, we are very far. I sometimes feel that we are number last if ranked

countrywide. Hon. Mutuli is my neighbor and I feel I shamed when there is a lot of

development in his ward compared to my ward. Is it that he is in the Government or what.

Hon. Kutitila (Point of Order) Mr. Speaker, I want to say that if you oppose a motion you

don’t mean that you belong to the Government and Mr. Speaker, Hon. Mutuli said that this

motion should come as a question which i also agree with.

Hon. Weswa: Thank you Mr. Speaker, I want to say that it is humiliation. As the

representative of Sirende ward, I don’t want to struggle to explain to my people to what has

happened. Mr. Speaker Sir, when the Health Service are run down even if I am not the Chief

Officer or County Executive member of Health, I have to give the answers to my people.

When it comes to roads, I also have to give the answers. I also need to explain to them why

we did not have a water project when money was allocated. We want to go on records that we



did not spend our money well. We want to do our oversight and see what we budgeted for is

in place. I want if I go to Nabiswa, I see with my naked eyes what has been implemented. I

support the motion.

kinaendelea kukua na maneno mapya yanaibuka. Lakini hapo Bwana Spika mheshiwa laban

Kidogo ameenda msitu. Si Kipengele bali ni Kibala.

Hon. Laban: Asante Bwana Spika, katika kipala cha nne.

BwanaSpika, bila kusahau, juzi tulipitisha bajeti na tulikuwa na pesa ambazo tuliweka kwa

kununua uwanja wa ndege na hatujafahamishwa pesa tulizotenga kwa bujeti ya awali zilifika

wapi ?. Pili kuna makadirio ya pesa kwa walemavu ambazo tulitenga kando na hatuna ripoti

kusihusu. La mwisho Bwana Spika, kuna kamati kama ADHOC ambayo iliundwa kwa

Jumba hili kushukulikia malilio ya wana kandarasi ambao mimi ni mmoja wao. Bwana

Spika tumefanya kazi na imepaki kuenda kuandika ripoti lakini wamekataa kutupatia pesa.

Bwana Spika sijui kuna kaamati kubwa kushinda zingine ama nini.

Speaker: Hon. Mutuli what is it. You are supposed to contribute once and I will limit points

of orders.

(Hon. Mutuli insists)

Hon. Mutuli:(Point of correction) Mr. Speaker, this is a very light debate. And I was saying

that the motion should be brought as a question. I want to correct Hon. Laban who said that

Kipara instead of Kibala kwa lugha mfuti, because I was once a teacher and I know how

students take time to catch things.

Speaker: Hon. Mutuli, you should take this House with seriousness. This is the House of law

and you should handle it with respect.

Hon. Masika: Thank you Mr. Speaker Sir, I stand to support the motion strongly. Surely, we

need to have a comprehensive report. We have been allocating some money but so many

projects are not finished. We want to know why they have not been implemented. With this

motion, we should be able to know why projects have not been implemented, how many have

been implemented and by how much was supplied. Thank you.

Hon. Omondi: Thank you very much Mr. Speaker Sir. As I have been sitting here Mr.

Speaker and looking at how my fellow Honorable members contribute to the motion, surely

they don’t appear like they are in Trans Nzoia County. It is like they are staying in

neighboring counties. Mr. Speaker, I stand strongly to support the motion. We have been

struggling with the County Executive since the Budget 2013/2014 and sometimes we have

been delaying the budget because of implementation of earlier budgets. Then just as the

mover has said, we shall move to all the projects and see which ones have been implemented.

Money was allocated for markets from budget of 2013/2014 and up to now, if you go to

Endebess, the market is bare. I don’t know which markets have been completed. I get

annoyed when one of us says that lets us speak the truth when he knows that there was no

truth in the sentiments. Let us do our job of over sighting. Thank you.

Hon. Talam: Thank you Mr. Speaker Sir for giving me this opportunity to air out my views.

I start by thanking Hon. Milimo for the motion. We passed a supplementary budget to pay the

contractors and debts of the county and up to now we still have debts and they have not told

us where the money went to. If we go out, the contractors are still complaining.

Hon. Birgen: Asante sana Bwana Spika kwa kunipa fursa hii ili nami nichangie. Kwanza

kabisa naunga mkono mheshimiwa Milimo. Kwa kweli, mali ya wananchi haitumiwi vizuri.

Nimesikia mheshimiwa Mutuli anesema kwamba kuna maendeleo sana Kaplamai. Nataka

kusema hivi, kwamba mimi natoka Kaplamai na hakuna chochote kimefanyika, hakuna

barabara, hakuna madarasa. Kuna darasa moja tu hapo Nyasiland ambayo nimeona

wamejaribu kujenga wakafikisha Kwa katikati. Kwa hivyo naunga mkono hawa mawaziri

watupatie nafasi tuende tuangalie na tuleta ripoti kwa hili Jumba.

Hon. Yator: Thank you Mr. Speaker Sir. I stand to support the motion fully. Our work is to

oversight, approving the budgets and legislation. If we say that we don’t do Audit, we will be

denying ourselves an opportunity to work. In FY 2013/2014, we did not have any Audit

report. Mr. Speaker, better late than never.

Hon. Kitiyo: Thank you Mr. Speaker Sir. At long last, you have seen me. Hon. Yator has

said that our work is to oversight and you oversight what you see with your eyes and what

you have allocated money. In my ward, we have 10 fields that we had budgeted to buy since



2013/14 FY and we have been allocating money for that. But Mr. Speaker, we have never

done anything and the people on the ground are doing propaganda that we pocketed the

money. Lastly Mr. Speaker, this House received a petition and formed ADHOC Committee

to go and write a report. Mr. Speaker Sir, being the Chair, we have been frustrated. And the

contractors who presented the petition are calling us now and then to present the report to the

Governor.

Hon. Nelima: Thank you Mr. Speaker Sir, I support the Motion brought in this House by

Honorable Milimo. Mr. Speaker, if we carry the Audit report, it will help us in ranking. It will

also help us to know which ward is better and we will be able to challenge the County

Executive why they favor other wards. Mr. Speaker, the Hon. Members have complained of

the ADHOC Committee which am the Vice Chair. Mr. Speaker, the contractors are coming

even to our homes complaining that we have failed them. So Hon. Members, when we came

up with this motion, through the relevant sectorial committee and the ADHOC Committee, to

investigate the issues. Let the blame go to the Governor and his team so that if the other

Governor comes, he will not retain the same team or if the Governor will be re elected he will

appoint another team.

Speaker: Honorable Members, before I put the question, I call upon the mover to thank the

members.

Hon. Milimo: Thank you Mr. Speaker Sir. There is no more clarification when the motion

has been fully understood by the House. But Mr. Speaker, I want to point out one thing which

I have seen even in this House. Mr. Speaker, during the time of Moi, we had two MPs who

were even if they are collapsing, they will stand to support Moi. That is Matiba and J.J

Kamotho and I have seen them here. Mr. Speaker, when a motion comes to this House, it is

the property of this House and we should debate soberly. First if the report comes before

supplementary budget, it will help us so that we will be giving more money to the active

department. Mr. Speaker, we allocated funds to clear the debts and up to now the contractors

are still complaining. Mr. Speaker Sir, I want to finish by saying that my ward is even not

better than those wards which there is no any project completed. Hon. Mutuli was saying that

this motion was for my ward but I want to tell him that I was in his ward during the public

participation and he could not even stand and mobilize the crowd to listen to him. He was

defeated and now he is saying that there are many project implemented in his ward. I want

tell him that let us see, between him and me, who will come back. Thank you.

I now give my directions that all Chairpersons, can you engage your County Executives

Committees and do the oversight and hand over the report to implementation committee . If

this fails, let the ADHOC committee be formed to carry out the exercise.
