Ill. POLICIES AND PROCEDURES FOR WATER AND SEWER SERVICE

D.Additional Policies for Watar and Sewer SewIce

7. Water Wlthom Sewer -- In general, water and sewerage service should be eflendedSiMuffan~usly into areas rewmmendad for developmnl by the mmprehensive planning policies.However, limited expansion of water sewice wfihout sewer can be mnsiderd under the followingmndifions, provided that development with only mmmunity water is mnsistenf with the protection of sutiacsand ground wateffi:

a. The provision of water servim without sewer sewiw should bageneralh{ timitsd to areaszoned for “large lo~ residential and mral development such as those zoned RE-1, RE-2 andRE-2C/non+luster option, and Rural Cluster (RC)/cluster-option; areas withotherzones may bamnsideti

upon the remmmendafion of the Planning Board, For snes wittin the Rural Cluste (RC) zone, theprovision of public water servica shall generally require approval of a subdivision plan which uses theCluster+ption for the developwnt; water servi~ may also be approved in cases where zoning orsu~tvision regulations didate that agtiensite has insufficient acreage tousethe RCzonecluster opffon.The provision of waler service without sewer to areas zoned forfwo units-per-acre (R-200) or greaterdensities should be dismuragad wherever possible; in cases where such sewice is approval, thedevelopment plan must provide adequate protection forground andsurtace waters as discussed furtherinsubsetilon (e.) ofthis poticy. Asdi~ssad previously, unrestritied mmmunity water sewice shall not

be etiendad into areas zoned for Iowdensfiy rural development: the Rural (fwe-acre) and RDT(twenty-five-acre) zones.

b. Theprovision ofcommunify water sewim must confomto theland usepolicies of theapplicable master plan. fnoderto ensure insistency wnhtkmaster plans, all Hf~o~ change rquestsfor community water service to large lot areas will be submitted to M-NCPPC for reviaw and comment[reviewed] onacase-by+ase basis, Thepolicyof providing @mmunny waler sewimto la~elotamaswasfirst adopted in this funtional plan in June 1990 (under County Council Resolution IUO, 11-19W); theCouncil reviewed and adopted most of the local area master plans currently in use prior :0 the introdu~onOf this policy, Thedecision toetiend orrestricf water servica should fows onmnformanca with masterplan land-use and development remmmandafions, rather than on generalized water sewica areas iden~fiadin the master plans, Wha the provision of water sewica to large lot areas promotes the Iand-usa anddevelopment envisioned by the master plan and meets other ewnomic and environmental standards, the

aPProval of se~ica and/or ffming of service is appropriately handled by the adoption of water mtagorychanges as part of this Comprehensive Water Supply and Sewerage Systems Plan ~en-Year Plan),

Requests forwaterserviw to lame Iotaraas may beonsidered foradministrattie aoproval under the

“Consistent with Existing Plans'' Whcyinases where the Planning Bead Mncumthat theeflensionofservice ismnsistent with the land-use and development policies of the master plan,

D. Additional Policies for Watar and Sewer Semice

14. Community Sewlcato Properties Abutflrrg Existing Mains -Theadminislrafive delegation~ficies included in this chapter (Stilon III,D,9,) grant properties which abut an existing orauthorizsdsanfia~main asingle water and/or sewer hookup from that main under limited cirmmstanms: theabuftirtgproperty or a structure on the property must have bean established prior to the extension of the abuttingmain. That pohcy is sometimes used in sases where a propefly is not otherwise etigible tor such serviceunder the general policies of this plan. The County Council may act to grant less restrictive Mtegorychanges for properties abutting existing sanifa~ mains under the following two additional cirmmstances:

a. The single-hookup right may W assigned to a remainder or residual of an original pmpsrfy(which would have qualified for a single sewer hookup under administrative delegation poticy 111.D.9.b.“Propsties Abutting Existing Mains - Single Hookups Only”) provided that:

~) The site would qualty for a single sewer hookup under administrative delegation policy111.D.9,b. “Properties Abutting Existing Mains - Single Hookups Only”;

0) The site contains sensitive environmental features that would be preserved to a greateretient by the provision of pubtic sewer service rather than the construction of septic SyStemS;

W) The number of sewer hookups allowed shall not exsssd the number of lots which muldhave been approved for septic systems, based on a review of the site mndifions (soils, groundwatermndtions, local history, etc.) by MCDEP in mnsuhation with the Department of Heahh;

~v) WSSC Wnfinns that sewer mains abut the site and that all proposed development canbe served fmm the abutting mains: no on-sic main eflensions are required, no off-site main efiensionsor hookups are required, and no nghts+f-way are from other pro~rfies are required.

This poficy cannot ba apphsd in cases where the County Council has expressly restricted areasto the abutting main as specified under the Limited A~aa Mains policy (sss Section 111.D.12.).
