Acts/legislative frameworks/policies/strategies

The Disaster Management Act 57 of 2002 (as amended) is the primarylegislation dealing with DM in South Africa.

❑The Act provides for an integrated & coordinated disaster managementpolicy that focuses on:

▪ Preventing or reducing the risk of disasters (Prevention);

▪ Mitigating the severity of disasters (Mitigation);

▪ Emergency preparedness;

▪ Rapid & effective response to disasters, &

▪ Post-disaster recovery and rehabilitation

❑The Act also makes provision for the establishment and functioning ofDM Centres across all spheres of government, disaster managementvolunteers; and matters incidental thereto.

Management Framework (NDMF)

is the legal instrument specified by

the Act to address the need for

consistency in avoiding, reducing,

responding to and reconstructing

following a disaster through the

concerted energies and efforts of

all spheres of government, civil

society and the private sector, by

providing ‘a coherent, transparent

and inclusive policy on disaster

management appropriate for the

Republic as a whole’(section 7(1)).5

❑ The ICDM is a Political forum inwhich national, provincial and localgovernment office bearers consultgive effect to the principles ofcooperative governance set out inChapter 3 of the Constitution onissues related to disastermanagement. The Structure isreplicated at provincial andMunicipal level in some provinces.

❑ The ICDM is accountable to, advisesand reports to Cabinet.

The National Disaster Management Advisory Forum (NDMAF)

❑ The NDMAF is a technical forum in

which national, provincial and local

government and other disaster

management role players consult one

another and co-ordinate their actions on

matters relating to disaster

management. The Structure is also

replicated at provincial (PDMAF) and

Municipal level (MDMAF)

❑ Technical Task Teams are established

to deal with specific cross-sectoral

disaster management issues

▪ National Joint Drought and Flood coordination Committees

Facilitate and coordinate the development and implementation of a national integrated and inclusive drought and Flood contingency plan, which covers the preparedness, response and recovery phases of the disaster.

• National Capacity Building Forum

Facilitate and coordinate capacity building initiatives amongst the state, the private sector, training institutions, academia, other stakeholders etc.

• National Early Warning Task Team

Facilitate and coordinate the development and dissemination of early warnings relating to disasters to stakeholders and civil society

• National Joint Operations and Intelligence Structure: Major country events overseeing and managing security and non security incidents/ events.

• Various departmental structures dealing with disaster management

• Multisectoral national outbreak response team(MNORT);Electricity Committees , Nuclear – Emergency Preparedness and Response Evaluation, Operation Phakisa etc.

National Joint Operations and Intelligence Structure

The NATJOINTS is a security structure set up to coordinate organs of state in responding to security incidents but the structure also plays a key role in coordinating operational matters safety relating to large scale political, sporting events and where applicable disaster response with the NDMC as co-chair.

Various disaster management coordination structures exist internally with in sector departments (eg. MNORT - DoH, Water management – DHWS, Climate change - DEFF, Nuclear – DME, etc.)

Departments use own budgeted funds and following reprioritisation mayaccess disaster grant funding listed below

Grants for Emergency Response –

• The Municipal Disaster Grant (MDG) - The grant is meant to provide for theimmediate release of funds for disaster response within municipalities. The grantcovers amongst other items: emergency repairs to essential infrastructure toaddress the disruptions caused by disasters within communities in case theresponsible municipality is unable to cope. The grants are conditional.

• The Provincial Disaster Grant (PDG) - The grant is meant to provide for theimmediate release of funds to sector departments for disaster response. It coversemergency repairs to essential infrastructure to address the disruptions caused bydisasters in case responsible sector department is unable to cope.

• Disaster damages that require emergency response will be dealt with, throughimmediate relief grants and should be implemented within three (3) months.

FUNDING ARRANGEMENTS AVAILABLE WITHIN SOUTH AFRICA

Grants for Emergency Response –Adherence to the following Conditions of both the Provincial and Municipal Disaster Grantas stipulated in the Division of Revenue Act are a further requirement:

• Funds from this grant can only be used to purchase the items described in NDMCProvincial and Municipal Disaster Grant Frameworks and will only be released on requestof a provincial department or municipality and verification of a declared disaster as per theDisaster Management Act.

• Funds can only be released after a disaster has been declared in termsof the Disaster Management Act 57 of 2002 (as amended).

• Other legislation are considered when funds are to be released to the municipalities orprovinces.

• It is also safe to mention that proof must be submitted that the sector cannot fund theoccurrence based on reason stated before application can be finalized to avoid duplicationof efforts.

FUNDING ARRANGEMENTS AVAILABLE WITHIN SOUTH AFRICA

Grants for Reconstruction and Rehabilitation

The Municipal Disaster Recovery Grant (MDRG) and theProvincial Disaster Recovery Fund – Are meant or thereconstruction and rehabilitation of disaster damagedinfrastructure within municipalities and affected organsof state.

The grants are conditional and unallocated. The fundsare accessed through the budget adjustment process andmeant to address damages to be reconstructed orrehabilitated over the medium to long term period.

ASSISTANCE FROM SADC

▪ Assist with facilitation and coordination of the development of bilateral agreements and memorandum of assistance agreements; exchange programmes on good lessons to be learnt.

▪ Provide support to build capacity to establish a gender platform for DRR in RSA.

▪ Peer review by SADC

Challenges

• Due to SA having three spheres (National - Provincial - Local levels),coordination and reporting can be challenging

• Differentiated capacities in each province and locals

• The main development plans (IDP) at local level may have riskconsiderations but implementation lags

• Varying, and sometimes inadequate, response capacities andcapabilities in various municipalities

• Management of in-migration and rapid unplanned informalsettlements 17
