Dear Member (s), This is pursuant to notification of the Sharing of Inter-State Transmission Charges and Losses Regulations, 2020 vide notification No. L-1/250/2019/CERC dated 4 th May-2020 by the Hon’ble CERC. (3) Transmission charges for Short Term Open Access paid by an embedded intra-State entity during a month shall be reimbursed in the following billing month to the State in which such entity is located. (4) Transmission charges for Short Term Open Access, paid by a DIC with untied LTA shall be offset against the transmission charges payable by the said DIC for untied LTA in the following billing month. (5) No transmission charges for Short Term Open Access for inter-State transmission system, shall be payable by a distribution licensee which has Long Term Access or Medium Term Open Access or both, or by a trading licensee acting on behalf of such distribution licensee: Provided that other charges or fees as per Open Access Regulations, 2008 and the Transmission Deviation charges, if any, as per these regulations shall be payable. (6) Transmission charges for Short Term Open Access collected in a billing month, after adjustment as per Clauses (3) and (4) of this Regulation, shall be reimbursed to the DICs in proportion to their share in the first bill in the following billing month.” Towards implementation of the above Regulations, NLDC has communicated to the Exchanges vide letter dated 29 th November 2020 to make the STOA rates in the collective transactions (DAS and RTM) applicable in line with the Sharing Regulations 2020 w.e.f. delivery date 02 nd December 2020.

Dear Member (s),

This is pursuant to notification of the Sharing of Inter-State Transmission Charges and Losses Regulations, 2020 vide notification No. L-1/250/2019/CERC dated 4th May-2020 by the Hon’ble CERC. Further, vide notification dated 08th August-2020 it was communicated that the said Regulations shall come into force w.e.f 01st November 2020.

Clause 11 of the above Regulations, which has provided for the applicability of ISTS Transmission charges for Short Term Open Access transactions, are reproduced below -

“11. Transmission charges for Short Term Open Access (1) Short Term Open Access Rate (in paise/kWh) shall be published for each billing month by the Implementing Agency which shall be calculated State-wise as under: Transmission charges of the State for the billing month (in rupees) / (7200 X the quantum, in MW, of Long Term Access plus Medium Term Open Access of the State for the corresponding billing period) (2) Transmission charges for Short Term Open Access shall be payable by generating stations and embedded entities located in the State, as per the last published Short Term Open Access Rate for the State, along with other charges or fees as per Open Access Regulations, 2008 and the Transmission Deviation charges, if any, as per these regulations. Towards implementation of the above Regulations, NLDC has communicated to the Exchanges vide letter dated 29th November 2020 to make the STOA rates in the collective transactions (DAS and RTM) applicable in line with the Sharing Regulations 2020 w.e.f. delivery date 02nd December 2020.

On the basis of the above Member(s) and its Clients(s) are requested to take note of the following:

1. No transmission charges for STOA under collective transactions (DAS and RTM) shall be payable by

DISCOM with LTA/MTOA or the trading licensees applying on behalf of DISCOM with LTA/MTOA. However, other charges or fees as per Open Access Regulations 2008 shall be payable.

2. Computation of STOA rates of the States shall be done along with the computation of transmission

charges for LTA/MTOA in line with Sharing Regulations 2020 which shall be made effective from 01st January 2021.

3. Till 01st January 2021, last published STOA rates (as of 2nd Quarter of FY 2020-21) as approved by

CERC shall be applicable.

4. Any Member, who is either a Discom or has a Discom as a Client, is requested to furnish the following information from the respective SLDCs regarding the DISCOM’s LTA or MTOA to avail the exemption provided under the 11(5) of the above Regulations latest by 10:00 hours of 01st December 2020 as the same needs to be applied w.e.f delivery date 02nd December 2020 in Collective (DAS and RTM) transactions. (I) Name of the Discom (name as mentioned in Standing Clearance): (II) Is the DISCOM mentioned in point(I) having a LTA/MTOA (Yes/No): (III) Quantum of LTA/MTOA in MW (if any)(NA if not applicable): (IV) Start and expiry date of LTA/MTOA: DD/MM/YYYY to DD/MM/YYYY In absence of above required details from SLDCs, we will continue to levy ISTS transmission charges for the respective DISCOM.

5. Transmission charges for STOA shall be payable by generating stations and embedded entities located

in the state as per the available published withdrawal rate of the state in which they are geographically located. In this regard, Annexure-III of the Hon’ble Commission’s order no. L-1/44/2010-CERC dated 01st August 2020 available at http://www.cercind.gov.in/2020/orders/L-1-44-2010-01-08.pdf may be referred.

It may be further noted that for transactions held in the Term Ahead Market (TAM) segment, The Exchange shall make an application to the nodal RLDC on behalf of the Sellers. The ISTS transmission charges, as may be applicable in line with the Sharing Regulations 2020 or the Detailed Procedures issued thereunder will have to be borne by the Seller.

The applicability of STOA rates shall be w.e.f. 01st November 2020. Retrospective revision with regard to transmission charges for the approved transactions for which application was made on or after 01st November 2020 shall be carried out and accordingly settlement will be done.

Subject: Applicability of STOA rates in collective transactions (Day Ahead Market and Real Time Market) in line with Sharing Regulations 2020.

Sir,

Detailed deliberations were held between NLDC and CERC officials regarding the

issues involved in application of Short Term Open Access (STOA) charges for implementation

of Sharing Regulations 2020, wherein it was decided to implement the applicability of STOA

rates w.e.f. 01st Nov 2020 as per clause 11(5) of the said Regulations.

Accordingly, a meeting was held on 28th November 2020 at 17:00 hrs on Webex

between National Load Despatch Centre and Power Exchanges to decide the implementation

modalities of applicability in collective transactions. Based on the above discussions following

points have been finalized:

1. Computation of STOA rates of the states shall be done along with the computation of transmission charges for LTA/MTOA in line with Sharing Regulations 2020 which shall be made effective from 01st January 2021.

2. Till 01st January 2021, last published STOA rates (2020-21 Q2) as approved by CERC shall be applicable.

3. No transmission charges for STOA under collective transactions (DAM and RTM) shall be payable by Distribution licensees with LTA/MTOA or the trading licensees applying on behalf of distribution licensees with LTA/MTOA. However, other charges or fees as per Open Access Regulations 2008 shall be payable.

4. NLDC shall share the available information in respect of LTA/MTOA with the Power Exchanges. The Power Exchanges shall also seek the details of LTA/MTOA from the individual market participants and also get confirmation from State Load Despatch Centres (SLDCs) so as to identify which DISCOMs are exempted from payment of

transmission charges. In this regard, the minimum information needed is as follows: (a) Whether DISCOM has LTA/MTOA (Yes/No) (b) Quantum of LTA/MTOA (MW) (c) Start date and expiry date of LTA/MTOA

5. No exemption is applicable to Power Exchanges applying on behalf of Distribution licensees with LTA/MTOA for Term Ahead Market (TAM) transactions and all charges shall be payable.

6. Transmission charges for STOA shall be payable by generating stations and embedded entities located in the state as per the available published withdrawal rate of the state in which they are geographically located. In this regard, Annexure-III of the Hon’ble Commission’s order no. L-1/44/2010-CERC dated 01.08.2020 available at http://www.cercind.gov.in/2020/orders/L-1-44-2010-01-08.pdf may be referred.

7. As already decided to implement the applicability of STOA rates w.e.f. 01st Nov 2020, retrospective revision with regard to transmission charges for the approved transactions for which application was made on or after 01st Nov 2020 shall be done and transmission charges are to be refunded.

Based on the various aspects mentioned above, Power Exchanges are requested to

implement the applicability of STOA rates in the collective transations (DAM and RTM) in line

with the Sharing Regulations 2020 w.e.f. trade date 01st December 2020 (delivery date 02nd

December 2020).

Regulations, 2020 in STOA Bilateral Transactions.

Dear Sir,

As you may be aware, the Hon’ble CERC, vide notification No. No.L-1/250/2019/CERC dated 4th

May 2020 notified the Sharing of Inter-State Transmission Charges and Losses) Regulations, 2020.

As per clause 11 (5) of the above said Regulation, the applicability of ISTS Transmission charges

for STOA bilateral transactions is reproduced as below -

or both, or by a trading licensee acting on behalf of such distribution licensee:

Deviation charges, if any, as per these regulations shall be payable.”

In line with the Sharing Regulations 2020, a procedure was prepared by the implementing agency

(NLDC) which is available at

Your attention is drawn to the clause no. 9.2 & 9.5 of the above Procedure for Computation and

sharing of Inter-State Transmission System Charges and subsequent addendum to it.

Quote

“9.2 Transmission Charges for STOA transactions shall be payable by generating stations and

embedded entities located in the State, as per the last published STOA Rate for the State. In case

of drawee entities that are users of RLDC which have no Long Term Access or Medium Term

Open Access, STOA Rate of the state in which they are located shall be applicable.

9.5 STOA bilateral transactions where buyer and seller both are distribution licensees or traders

applying on behalf of such distribution licensees, one having Long Term Access or Medium Term

Open Access or both and the other licensee having no Long Term Access or Medium Term Open

Access, then the following shall apply:

(a) If distribution licensee with Long Term Access or Medium Term Open Access or both has

applied for STOA, then no transmission charges for STOA transactions shall be applicable

(b) If distribution licensee without any Long Term Access or Medium Term Open Access or both

has applied for STOA, then transmission charges for STOA transactions shall be applicable”

The above clauses are mapped in a tabular form by the Implementing Agency for ease of

understanding. The same is enclosed at Annexur-1 for reference.

It may be noted that all other applicable charges viz. state transmission charges, operating charges

and application fee etc. will continue as per the CERC(Open access in interstate transmission)

Regulations-2008 (as amended).

Further, vide notification no. L-1/250/2019/CERC dated 8.8.20 the effective date of implementation

for regulation was notified to be 01st Nov 2020. Accordingly, the philosophy of applicability of new

STOA bilateral rates in line with latest Sharing Regulation 2020 shall be effective for the

applications received on and after date of 01st Nov 2020.

The process of punching and processing of STOA applications in line with the latest Sharing

Regulation 2020 on the STOA software portals of RLDCs is under development and will be made

live at the earliest. Till the S/W is upgraded with all the above requirements, following methodology

will be adopted by RLDCs:

1. Till Jan’2021, only existing withdrawal charges of the respective states as per the order by

Hon’ble CERC shall be considered as the STOA rate for each transactions in line with latest

Sharing Regulation 2020. If any STOA application is punched by any utility or trader except

Regional entity distribution licensee with LTA/MTOA or on its behalf then the withdrawal

rate of the state where the generator is located shall be applicable.

2. The payments received against applications applied on and after 01/11/2020 shall be revised

in line with the latest Sharing Regulation 2020 and necessary refund shall be done by 15th

of

Dec’2020.

3. To assess the applicability of ISTS transmission charges for already approved STOA

Bilateral transactions (during the aforementioned period), the applicant, Trader/PX, shall

declare whether the application is made on behalf of seller/buyer. Approval wise declaration

shall be sent on < [email protected] > by 24 Hrs of 30th Nov 2020.

4. The above refund of STOA charges, on this account, if any, shall be made only after the

receipt of declaration.

5. Advance and FCFS applications received till deployment of upgraded STOA software, will

be approved manually in line with latest Sharing Regulation 2020. Accordingly, the

applicant, trader/PX, shall declare whether the application is made on behalf of buyer/Seller.

6. Day ahead and contingency approvals received till deployment of upgraded STOA software,

shall be done by applying the old rates (both injection and withdrawal), and necessary refund

in line with the latest Sharing Regulation 2020 shall be done by RLDC to the applicant. At

the end of the day Traders/PX shall submit the list of their respective approved approvals

with a declaration mentioning on who’s behalf they have submitted the application, Seller/

buyer.
