Executive Summary

The objective of Dhaka Environmentally Sustainable Water Supply Project (DESWSP) is to

provide a reliable water supply for the Dhaka city by developing a surface water treatment plant

and distribution network to improve quality water supply, water pressure in the pipelines, cost

recovery, reduce water loss and gradual ground water depleting in Dhaka city.

The DESWSP is to be delivered through several contract packages by several consultants,

contractors and NGOs under DWASA’s Project Management Unit (PMU). Mott MacDonald is

responsible for the three main construction contracts through their Management, Design and

Supervision Consultancy (MDSC) contract. Under MDSC, Mott MacDonald is acting as the

Employer’s designer for Packages 2 and 3 and as the supervision consultant for Packages 1, 2

and 3. Package 1 is to be let as a Design, Build & Operate (DBO) contract. Package 2 (P2)

comprises of 14 km. Treated Water Pipeline from Water Treatment Plant to Madani Avenue.

Packages 3 (P3) includes Distribution Reinforce Pipeline in North Dhaka City.

The total length of the alignment is approximately 36 kilometres. This starts from the Meghna

River and passes through Ariahazar and Rupganj upazilaand reaches Madani Avenue in Dhaka

after crossing Sitalakhya and Balu rivers. This project will use 294 acres of land of which Dhaka

WASA owns 82 acres (in Gandhabpur) and Bangladesh Water Development Board (BWDB)

with Roads and Highways own another 24 acres. The rest of the land (188 acres) is privately

owned.

Issues of involuntary resettlement are addressed according to National (Government of

Bangladesh) Legislation [Acquisition and Requisition of immovable Property Ordinance

(ARIPO), 1982 and Acquisition and Requisition of immovable Property Act (ARIPA), 2017 and

ADB Safeguard Policy Statement (SPS), 2009, and DWASA Policy. A Resettlement Framework

(RF) was developed for DESWSP to provide the mechanism through which the Executing

Agency (EA) is updating Resettlement Plans (RP) for each of the sections of the project.

Scope of land acquisition and resettlement impacts has already been identified based on the

preliminary design. The project will impact private and government land of different

organizations also structures, assets, crops and trees. As per preliminary design, a total area of

188 acres of private land needs to be acquired for the construction of the water pump at the

intake and for the required pipelines.

DWASA is the EA, through the PMU will establish a monitoring system involving the Supervising

Officer (SO), Safeguard Implementation Unit (SIU) and NGO. Evaluation of the resettlement

activities will be undertaken during and after implementation of the RP. An independent monitor

(External Monitoring Agency) has been engaged as third-party monitor for RP implementation.

PMU of DESWS Project has established its own SIU on 10.10.2017 to assist the PMU for

managing social and resettlement issues.

In September 2017 DWASA with the support of MDSC National Resettlement Expert (NRE)

has organized a two days training program for SIU and other relevant staff of PMU on

Management of Land Acquisition and Resettlement.

To carry out the resettlement activities, PMU has contracted a local NGO called DORP that

mobilized in February 2015. From that date the DORP has started/completed surveys and

information campaign to update a resettlement plans for some sections.With the view of

convenient implementation project area has been divided into 6 sections for Resettlement Plan

(RP). Draft RP for Section 1, 2 and 4 have been prepared and submitted to ADB for their

approval. The RPs for other sections would be submitted to ADB by September 2018. The

alignment for RP Section 5 and 6 has been finalized by December 2017.

The socioeconomic survey (SES) has been completed in Section 3. It has also been completed

for Section 5 except three mouzas namely Naora, Harina and Rupganj because people of these

areas do not cooperate in giving data as no legal notice for land acquisition has been served

yet. This survey for Section 6 would be carried out on July 2018. It is worth mentioning that in

these no legal notice for land acquisition has been served for RP Section 3, Section 5 and

Section 6 areas. So, DORP is facing problem in collecting data.

Four committees namely Joint Verification Committee (JVC), Property Valuation Advisory

Committee (PVAC), Grievance Redress Committee (GRC) and Resettlement Advisory

Committee (RAC) have been formulated by the PMU for each section of RPs. The GRC is

responsible to assist the Affected Persons (APs) in case of complains at project level. GRC

committee has been revised and approved by the ministry on 27 November 2017.But yet to

declare its members’ names and contact number to the APs.

During this quarter DORP has submitted RP of Section 1four times, Section 2 once and Section

4twice to ADB through PMU. DORP has improved required RPsto comply with the ADB’s comments that they have given four times. Their last submission date of updated RPs for

Section 1, 2 and 4 was21st May 2018. DORP promised to submit Draft RPs for Section 3 and 5

by July 2018. It can be mentioned here that RP for Section 5 will be submitted as per ADB

safeguard official’s advice though SES of three mouzascould not be completed which is

mentioned above. SES for RP Section 6 area is being conducted.

Procedural delays with regard to Land Acquisition (LA) process have also hindered progress of

RP implementation. At present Cash Compensation under Law (CCL) is being paid by the DC

office in RP Section 1 and Section 2 area. Though updated RPs are yet to be approved by ADB

and ministry of LGRD&C.

Total nos. of CCL recipient APs are 183 and 315 in RP Section 1 and Section 2 respectively.

1 Background of the Monitoring Report

1.1 Project Description

This is a Semi-annual Resettlement Monitoring Report prepared for the PMU for onward

submission to ADB. The “Dhaka Environmentally Sustainable Water Supply Project” comprises of Water Intake, Gandharbpur Water Treatment Plant, and Raw & Treated Water Mains.

Dhaka Environmentally Sustainable Water Supply Project (DESWSP) is to provide a reliable

water supply for the Dhaka city by developing a surface water treatment and distribution

network. (See detailed map of the full project given above) The total length of the alignment is

approximately 36 kilometres. This starts from the Meghna River and passes through Ariahazar

and Rupganj upazilla and reaches Madani Avenue in Dhaka after crossing Sitalakhya and Balu

River. This part of the project is called P1 and P2. This project will require 294 acres of land of

which Dhaka WASA owns 82 acres in Gandharbpur and Bangladesh Water Development Board

(BWDB) and Roads and Highways Department (RHD) owns another 24 acres. The rest188

acres are privately owned that will need to be acquired.

A Resettlement Framework (RF) was developed for DESWSP to provide the mechanism

through which the DWASA will prepare Resettlement Plans (RP) for each section of the project.

Issues of involuntary resettlement will be addressed based on DWASA Policy (Resettlement

Policy Framework, 2013) following National Legislation (Government of Bangladesh Acquisition

of immovable Property Ordinance, 1982), and the ADB Safeguard Policy Statement (SPS),

2009. It is worth mentioning that meanwhile Bangladesh government has enacted new laws

from September 2017, namely Acquisition and requisition of Immovable Property Act (ARIPA),

2017. This will be applicable for updating RPs for Section 3, Section 5 and Section 6.

Necessary Inputs to prepare the report (Semi-annual Social Safeguard Monitoring Report) were

provided by the DORP, the NGO responsible for implementation of the Resettlement Plans. The

report covers the progress made during the 1st half of the year 2018 and is presented according

to the format provided in the resettlement framework.

1.2 Purpose of the Report

Clause no. 18 (iii) of the Terms of Reference (ToR) of MDSC requires submission of Semi-

annual Social Safeguard Implementation Monitoring Report. Moreover, Appendix C of the

Resettlement Framework of the DESWSP mentioned, ‘Following requirements of the ADB Safeguard Policy Statement (2009) and the Operations Manual section on Safeguard Policy

(OM F1), borrowers/clients are required to establish and maintain procedures to monitor the

status of implementation of safeguard plans and ensure progress is made toward the desired

outcomes for projects categorized as A or B in Involuntary Resettlement and/or Indigenous

People. The borrowers/clients are required to submit semi-annual monitoring reports for ADB

review.’ To comply with the requirement on behalf of the borrower (the DWASA), the MDSC is hereby submitting the Semi-annual Social Safeguard Monitoring Report (SSSMR). This is

the6thSSSMRof the project RP implementation.

1.3 Category of RP

Considering the extent of significance of impacts, ADB has classified projects into four

categories; A, B, C and FI. The involuntary resettlement impacts of an ADB-supported project

are considered significant if 200 or more persons will be physically displaced from home or lose

10% or more of their productive or income-generating assets. The project, which has significant

involuntary resettlement impacts, falls under category A. Thus, the DESWSP is classified as

Category A. No indigenous household has been found during the surveys; therefore, the project

falls under category C as regard to indigenous people categorization.

1.4 RP Update and Public Consultation

The NGO contracted named DORP is assisting DWASA in updating the RPs and

implementation of the resettlement activities. The DORP has so far prepared four Draft RPs for

Section-1 and Section-2, Section-3 and Section-4. They prepared a zero draft for RP for

Section-5 and submitted to MDSC on April 2018 which has been sent back by the MDSC as it

was not acceptable for review due to lack of proper data. They have submitted their second

draft to MDSC on 25thJune 2018. DORP is now conducting field census /survey in section 6 to

assess and verify the impacts on APs for the RP updates as well as its implementation.

Regular consultations with the affected persons (APs) and other stakeholders are being

conducted by the DORP to ensure that they are fully aware of the project interventions and

about their entitlements in case of involuntary land acquisition and resettlement benefits for APs

(titled or non-titled holders). The format to report on the consultation carried out need to be

reviewed to emphasis more on the remarks made by the participants.

2 Scope of Impacts

The initial Resettlement Plan for the project was prepared in 2013 and it indicated major impacts

on private land, scope of land acquisition and resettlement impacts has already been identified

based on the preliminary design. The project will impact private and government land of

different organizations and also structures, assets, businesses and livelihood, crops and trees.

Based on given alignment, a total area of187.94acres of private land would have needed

acquisition for the construction of the intake area and the pipeline construction for package 1

and 2. However, section wise required quantity of land to be acquired is presentedin Table 1.

See map above.

The project area under Package 1 and 2 has been divided into six sections to update the RPs

conveniently. The sections are named as follows;

Section-1: Water Intake Area

Section-2: Water Intake to Baliapara (End of Araihazar)

Section-3: Darikhandi Chak (start of Rupganj) to Murapara via Gandharbpur WTP

Section-4: Water Treatment Plant Gandharbpur Area

Section-5: Rupganj (West bank of Sitalakhya River) to Balu River (East bank)

Section-6: Balu River (West bank) to Vatara along Madani Avenue up to Baridhara

RP Section 1 and 2 requires both private and government (govt.) land. No land acquisition is

required for the construction of the Water Treatment Plant as DWASA acquired a total of 82

acres of land in Gandharbpur area in 1982-83. Besides, Dhaka WASA has signed a

Memorandum of Understanding (MoU) to receive back 2.83 ha of land from the Bangladesh

Water Development Board (BWDB) by DWASA for excavation of a canal for irrigation purpose.

This arrangement has been done under a MoU signed between DWASA and BWDB mentioned

in the RP.

The Table 1 below presents the summary of the land requirements with areas and type of

impacts identified so far.

3 Status of RP Updating and

Implementation

3.1 Update of the RPs

DORP, as INGO has been appointed in February 2015. First Draft RP for WTP was submitted

to DWASA in January 2016. The draft has since been resubmitted several times; the version of

December 2017 awaiting ADB’s approval. Subsequently, after various rounds of discussions

with ADB and clarifications on interpretation of the entitlement matrix, the required revisions

were made. Each time MDSC provided necessary feedback and detailed comments and

advised them in providing full details of the impacts, improve the accuracy of the data

presentation, prepare budget based on approved entitlement matrix and do proper editing of the

document. In December 2016, the DORP conducted a resurvey in WTP area because MDSC

found out some discrepancies during field monitoring.

DORP has submitted updated RPs several times for section-1; first draft in November

2016, second version in May 2017, third version in August 2018, fourth version in

December 2017, 5th one in 1 January 2018, 6th one in19 January 2018, 7th version in

February 2018 and 8th and another version in May 2018 which has been submitted to ADB

for their approval. ADB provided their observations on the RPs for WTP and WIA. ADB

Safeguards Specialist advised that the entitlement matrix could not be downgraded and

that the original entitlement matrix should be followed.

The RP for Section 1 had to be revised several times due to various reasons, including

clarity on interpretation of the entitlement matrix, required document structure and quality to

reflect the ground reality while meeting ADB’s standards. Field visits during an ADB

Mission revealed that the need to address the issue of compensation to people affected by

river erosion, leading to the need for further consultations and revision of the RP.

DORP had submitted a preliminary draft RP for Section-2 in March to MDSC for review..

Accordingly they submitted 2nd draft on May 2017 and MDSC reviewed and sent it back for

updating. They submitted Draft RP to ADB through PMU three times; first one in October

2017, second one in December 2017 and then on 21stMay 2018. which is under ADB’s review. .

After review 1st Draft of RP for Section 3 [Darikhandi Chak (start of Rupganj) to Murapara via

Gandharbpur WTP] on April 2018by the MDSC, DORP has submitted 2nd Draft of RP to MDSC

on 25June2018. This is under review.

DORP had prepared a zero draft for RP Section 5 [Rupganj (West bank of Sitalakhya River) to

Balu River (East bank)] which needed to be revised as the data given in the report was not

sufficent. DORP could not collect data from the villages namely Harina, Naora and Rupganj as

the local people were unwilling and DC office was yet to serve land acquisition (LA) notice.

No progress has been made yet by DORP for updating the RP Section 6 [Balu River (West

bank) to Vatara along Madani Avenue up to Baridhara].

Land acquisition work is in progress for Section-1(Water Intake area) and Section-2 (Intake to

Baliapara). Notice under section 7 has been served from the DC office to all entitled persons of

total 87 households in Section-1 and of 1178 households in Section 2 area for paying

compensation money or CCL. Out of them 183 APs inSection 1 and 315APs in Section 2 area

received CCL. On land acquisition matters DWASA has been following up with the DC office

regularly with regard to expedite CCL payment in Araihazar Upazila of Narayanganj District.

DWASA has been keeping all communications with the Ministry of Land (MoL)regarding

progress on land acquisition. A small part of RP Section 5 lies under military lead housing

authority namely Jalshiri Abasan. Meetings were held with PMU, MDSC team and Jalshiri

Abasan Authority along with PD and DPD with regard to finalization of draft Land Acquisition

MOU between DWASA and Jalshiri Abasan Authority.

The Table 2 below provides in a nutshell the progress achieved about land acquisition and RP

preparation section wise. It shows updates on RP preparation stage, including progress on land

acquisition, data collection and planned date for submission of RPs.

Following LA law DC has served notice under Section 7 to all APs. Out of them 315 APs have received CCL. The rest will get soon.

As per ADB SPS 2009, additional payment as resettlement assistance will be paid to the entitled APs after RP approval by ADB and concerned ministry.

Section-3 Darikhandi Chak (start of Rupganj) to Murapara via Gandharbpur WTP

LA plan has been submitted to the Ministry of Land (MoL). DC office hasconductedfeasibility Study (FS) for Rupganj in April 2018. DC has sent the reportto theCentral Land Acquisition Committee (CLAC) under MoL.Expected date of CLAC approval is July 2018 and DC office will serve the notice under section 4(according to newly enacted Acquisition and Requisition of Immovable Property Act 2017) by the end of August 2018.

Tentative date of first Draft RP submission is 20 July 2018.

Section -4 Water Treatment Plant DWASA owned land. Following ADB SPS 2009, resettlement assistance will be paid to the entitled APs after RP approval by ADB and concerned ministry.

MDSC resettlement consultants reviewed DORP’s work plan and provided feedback advising them to make it more realistic. For upgrading DORP’s capacity a 3-days training on

Resettlement Implementation Activities to DORP’s all field staffs have been imparted in May

2018. The progress achieved so far is presented in the Progress Reports prepared by the

DORP on monthly and quarterly basis. The Monthly Progress Report covered the progress of

the DORP activities for the respective month. Quarterly reports were a cumulative reporting on

three months progress. In this phase MDSC had reviewed six (6) Monthly Progress Reports and

two (2) Quarterly Progress Report is received in this period (January to June 2018) and MDSC

provided feedback with specific comments to DORP for improving their quality of documentation and

other works to focus on the critical issues. With reference to those reports, the progress made so far

by the DORP up to June2018 is presented in the Table 3 as follows:

It may be summarized here that LA process of Package 1 (RP Section 1, 2 and 4) is in progress

because RP Section 4 is under DWASA’s own land and CCL payment by the DC is going on for RP Section 1 and 2. However, no additional payment (top up and other resettlement benefits) could be

made since RPs are yet to be approved by the ADB and GoB. At present approval of the RP is

necessary for the project for handing over the stipulated acquired land to the DBO contractor for

construction commencement.There has been marginal progress with regard to LA process for RP

Section 3, 5 and 6. As mentioned earlier that land of these three areas will be acquired following

new law (ARIPA, 2017) enacted by the GoB has in September 2017. Rate of compensation has

been made double under this new act. It is already known that lands in RP section 1 & 2 area are

being acquired following ARIPO, 1982. The overall status of the land acquisition process of six

sections are presented in two separate tables below; Table 4for RP section 1, 2 and 4and Table 5for

RP section 3, 5 and 6. Following Figure 2 and Figure 3also follow the same sequence.

3.2 Disclosure and Public Consultation

DORP has conducted three hundred and ninety-five (395) consultation meetings including

community meetings with affected households and other stakeholders (351) and FGDs with the

eligible AHs (38) to develop livelihood plan up to June 2018 in the Section 1, 2, 3, 4, 5 and 6. Total

5053 participants (3788 male and 1265 female) were present at the meeting. A total of eleven (11)

DORP staffs were present at the meeting. The summary minutes of the meetings is provided in

Appendix B. Main discussion issues were: Objectives and activities of the project, opinion of the

participants about impact of the project and mitigation procedure, entitlements/compensation (CCL

and other resettlement benefits) payment procedure, livelihood activities in the locality, impact on

livelihood-based activities due to project intervention, livelihood and Income Restoration Program

(LIRP), numbers of cropping/yielding season in the RP area, Grievance Redress Mechanism (GRM),

relocation of APs, preparation of AP file, collection of relevant papers for resettlement

benefits/additional payment, rapid awareness building amongst the affected people on some basic

points, etc. andspecial agenda for river eroded affected HHs in section 1. Key findings are noted

below:

● APs were upset about losing their ancestral property; but they will have no grievance if they

receive adequate compensation to buy another land with the compensation money.

● APs expressed their urge to co-operate the JVC team in verifying the affected persons list and

their losses and PVAC team in determining of lost assets value.

● Agriculture-based employment will be affected due to implementation of the project. Three

season crops are grown in the area. Crops compensation should be paid.

● Fair compensation will be paid and the Project Authority will ensure all payments are made

directly to the affected persons (APs).from the project authority.

● River eroded land claimant APs are advised to submit their necessary legal papers in proving

their ownership. These claimant APs expected PMU’s interruption in resolving the issue with the DC.

● Suitable livelihood opportunities for the affected people should be offered and restoration of their

business should be ensured.

● DWASA committed to pay fair compensation and resettlements for lost assets and livelihood.

● APs have been informed that INGO will help them in opening bank accounts, collection of

citizenship certificates, tax certificates including submission of the required paper to the DWASA

to get resettlement benefits, etc.

● APs have been informed with regard to GRM process including GRC and its functionalities.

● APs are advised to take photographs and submit national ID card in the preparation of AP Identity (ID) card for getting resettlement benfits.

● APs are willing to be self-relocated subject to all types of payment receipt from the DC and

DWASA.

In addition to the consultation meeting that carried out during the preparation of the RPs, the

approved Entitlement Matrixwill be disclosed before the APs before implementation which will start

for WIA and WTP approximately by October 2018.

3.3 Payment of CCL and other Resettlement Benefits

Table 2, indicates CCL payment has been going on in the RP Section 1 and 2 areas. In total 498

APs received CCL in these areas. The rest of them have got notice under section 7 for CCL

payment. DORP is assisting affected persons in receiving CCL by preparing legal papers,

introducing them to the DC office, DORP has prepared 344 CCL statements (which defines AP’s cash payment) of RP Section 1 and 2 against 498 CCL recipients. They are collecting CCL papers

from the DC office with the help of PMU and directly from the recipient APs as well. In section 1 thise

who are yet to get the CCL have problems with legal papers. The others have delayed submission of

legal documents since some of them have river eroded land and conflict with the co-owners, etc.

Respective Union Parishad (UP) member will provide support to those APs who have conflict to

resolve. Three separate meetings have been held in three consecutive months during January,

February and March 2018with claimant APs, who have lost land due to river erosionand with DC

office following suggestion given by the ADB Safeguard Officer. The meetings were conducted by

the PMU in presence with MDSC National Resettlement Expert headed by the PD. Most of them

produce porcha and tax payment receipt. DC office asked them to submit their legal papers. DC

instructed ADC (Revenue) to arrange a hearing for both parties. DC has promised to repay the

compensation to the respective entitled persons if claimants’ submitted papers are proven as legal.

DORP has prepared a list of claimant APs and called them with their supporting paper on behalf of

their claims as well as to submit those to the DC office. List is provided with the meeting minutes.

Though last meeting held at DC office on 8th April 2018 and DORP disseminated the information to

the APs on the very next day but the APs have not submitted their papers to the DC office yet.

DWASA has added a different section with regard to river-eroded land issue and keep sufficient

budget for them in the entitlement matrix. DWASA is ready to pay them if they are proven as entitled.

In RP Section 2 area DC office is paying CCL gradually.

Property Valuation Advisory Committee (PVAC) has decided for additional compensation for

ensuring current market value of lost assets under RP Section 1, 2 and 4 areas. This top up payment

and other resettlement benefits will be paid upon approval of RPs by the ADB and the concerned

Ministry of Bangladesh government. It needs mentioning that no RP has been approved yet by the

ADB.

Photograph taking is going on in RP Section 1 & 2 areas for the preparation of AP Identity (ID) Card

for payment of resettlement benefits. It has been finished in WTP area. It is to be mentioned here

that 24 APs declined to take photograph as they are not interested to get compensation. Prior notice

(copy of notice is appended as Appendix C had been given to each APs describing dates and

venue of the photograph taking. However, three APs declined to take the photograph. AP ID card

preparation is going on for RP Section 1, 2 and 4.PMU has approved formula of creating AP ID

Number, attached as Appendix D Copy of AP ID Card is presented as Appendix E.

It is worth mentioning that eleven (11) old aged APs have died in this section; list is provided in

Appendix F Their legal successors will be eligible for compensation payment.

According to project requirement, the DBO contractor has to be handed the DWASA has to

handover them free acquired land with full compensation paid to all APs. DBO contract has been

signedon 16 May 2018 and they need land soon to start their construction in Package 1 area where

RP Section 1, 2, part of Section 3 and 4 are situated. Therefore, these RPs need to be approved by

the ADB and the Ministry on urgent basis.

3.4 Grievance Redress Mechanism (GRM)

Grievance Redress Committees (GRCs) are not declared yet. The PD has been reminded to declare

it in the project level. The PMU should name GRC members along with their contact numbers and

declare at each union. This is urgent and important because APs need GRC who can assist them in

notifying the project authority if they have any grievances. The GRC will exclusively work for

redressing grievance of the APs. The GRC will receive, evaluate, and facilitates the resolution of

APs concerns, complaints and grievances about the social safeguard issues linked to payment of fair

compensation as per the Entitlement Matrix.

The ministry of LGDR&C has approved the proposal for the formation of four committees for smooth

implementation of RPs; these are Joint Verification Committee (JVC), Property Valuation Advisory

Committee (PVAC), Grievance Redress Committee (GRC) and Resettlement Advisory Committee

(RAC). These committees have been formed for each sections of RPs. Considering present situation

PMU has revised these committees (except GRC) and their Terms of References (ToR) and got

them approved by the ministry in June 2017. However, GRC has been reviewed by the PMU and got

approval by the ministry in November 2017.

List of Committees and their respective Terms of References (ToR) had been attached in the 3rd

SSSMR.

4 Institutional Arrangement

DWASA is the Implementation Agency (IA) of the project. A PMU has been established with a SIU

with a staff of Resettlement, Safeguard Officer (Social and Gender) and Safeguard Officer

(Environment). DWASA has established its own SIU to assist PMU for managing social and

resettlement issues. Safeguard Officer (Social and Gender) of the SIU assisted by the Resettlement

Expert and Social Development and Gender Specialist of MDSC will oversee the implementation of

involuntary resettlement safeguard work under the project with support of the resettlement

implementingNGO DORP. The other staffs responsible for looking the safeguard issue of the

project include: one Executive Engineer, two Assistant Engineers. The Project Director and two

Deputy Project Directors and one Senior Water Supply Engineer administer the overall activities.

DESWSP is to be delivered through several contract packages by several consultants, contractors

and NGOs under DWASA’s PMU. Mott MacDonald is responsible for the three main construction contracts, through their Management, Design and Supervision Consultancy (MDSC) contract. Under

MDSC, Mott MacDonald is acting as the Employer’s designer for Packages 2 and 3 andwill act as the supervision consultant for Packages 1, 2 and 3.

MDSC is being led by the Mott MacDonald Limited (UK) in association with Fichtner GmbH & Co.

KG (GER), Euroconsult Mott MacDonald (Netherland) & Yooshin Engineering Corporation (KOR),

BCL Associates Limited (Bangladesh), SARM Associates Limited (Bangladesh), Associates for

Development Services Limited (Bangladesh). The goal of MDSC is to provide all necessary

consulting services requirements to implement the DESWSP.MDSC resettlement consultants is

specifically monitoring the RP implementation program. International and National Resettlement

Experts have been assigned to review and assist RP implementation process.

DWASA and the INGO namely DORP signed an agreement on February 2015 to update and

implement RPs with the support of DWASA. DORP is working in close coordination with DWASA

PMU. The major tasks of DORP are: updating RP, Institutional development, skill training,

consultation and distribute ID cards to each AP DORP is responsible to assess impacts, market

price of the loss of the property and all field activities such as 100% census and survey, public

consultation and FGD with the APs and communities.

5 Summary Monitoring Results and Key

Findings

As like as previous SSSMR, three RPs for Section 1, 2 and 4 have been resubmitted to ADB for their

approval within June 2018. As per these RPsin total 1497 AHs will have impacts on their livelihood,

agricultural production, small businesses, and structures (both dwellings and businesses). Summary

of project’s impacts on APs in RP Section 1 (WIA), 2 (Intake to Baliapara) and 4 (WTP) is given in Table 6 below:

MDSC is monitoring the activities of the INGO, DORP. In this regard carried out field visits and

regular meetings between PMU and DORP to share the progress. Minutes of the meeting and field

visit report are attached herewith under AppendixGandAppendixHrespectively. Objectives of those

were i) to oversee the DORP’s activities in the field and their interactions with the affected persons’, ii) to ensure that the APs are informed and aware of their entitlement and compensation rights, iii)to

know the status of CCL payments and finding out the reasonsfor not getting CCL yet, iv) to know the

status of having legal papers of ownership by the APs who claimed the river-eroded lands under

Meghna.

Discussions were conducted with field staff and APs to get their feedback and suggestions on RP

implementation and bottlenecks if any. Key findings are as follow:

● CCL payment is going on in RP Section 1 and 2. MDSC monitored DORP’s activities and reviewed the status of CCLpayment receipt to find out reasons why some APs are yet to receive.

Reasons revealed that APs have problems in legal papers, conflict with co-owners, made delay in

the submission of legal documents to DC office, etc. In Section 1, it was seen that some APs

have conflict with the DC in determining ownership of the river eroded land. In RP Section 2 area

DC office is paying CCL gradually.

● In presence of MDSC consultant PMU held meeting with claimants APs who have lost land due to

river erosion which suggested by ADB Safeguard Officer. DORP has prepared a list of claimant

land owners and called themwith their supporting paper on behalf of their claims. Most of them

produce porcha and tax payment receipt. River eroded land owner have been suggested by the

PMU to file mis-case against government to regain the ownership from the government.

● MDSC consultant were present in the meeting whichPMU held with the DC to resolve the river-

eroded land issue. DC suggested claimant APs to submit legal papers to the DC. ADC

(Revenue) will check those through a hearing process with the APs. If they are proven as legal,

DC will repay his compensation to the legal owners. DORP was instructed to disseminate

information and help them to submit papers. They conducted meeting in this regard and regularly

following up the issue.

● ADB Safeguards Specialist suggested that the owners of the river eroded land be paid

compensation prescribed by the Property Valuation Advisory Committee to expedite the process.

(Ref. Skype meeting held on February 25, 2018)

● DORP has finalized leaflet with the review of MDSC for RP section 3, 5 and 6. Two separate kind

of leaflet has been published; one for RP section 3 & 5 and another for section 6 since this

section is different than other sections. Copiesare attached herewith as Appendix I.1 and I.2.

● GRC application form has been translated in Bangla following resettlement framework, which is

given as Appendix J

● Titled and non-titled AP’s application forms for claiming additional compensation and declaration form of compensation receipt have been developed are attached as Appendix K, Appendix

Land Appendix M respectively.

● JVC meeting has been held and decided to conduct Joint Verification Survey for RP Section 4 for

3 business affected APs whose income needs to be verified for ensuring proper compensation

payment.

● PMU has arranged collection of copies of CCL payment documents from the DC office. APs are

also advised to cooperate the INGO.

● Participation of female APs in the consultation process is not yet up to the expected level of ADB.

However, it has been increasing day by day. DORP field staff had arranged meeting exclusively

with the female folks. It is 25% for overall progress while this quarter made it 34%. MDSC

SD&GS is regularly following up this issue and will be guiding DORP to increase female

participation.

● Some of the APs faces problem in determining ownership right in case of joint ownership. MDSC

consultants provided them with advice and suggested DORP personnel to maintain regular

contact with them with adequate assistance.

● Rupganj INGO staffs are busy with conducting socio-economic survey in RP Section-3 and 5.

● MDSC NRE is supervising DORPs activities and will continue guiding them to improve the quality

of survey, reporting and monitoring.

● It was found that daily activities reports are prepared by the Area Managers and submitted

regularly to the DORP head office copied to MDSC NRE. MDSC NRE suggested to add daily

achievement of communication with APs such as personal contacts, FGDS, consultation

meetings. Also instructed to attach photographs of meetings, etc. In most cases, Rupganj

complied but Araihazar is expected to be improved. Even, daily progress report was not received

regularly from Araihazar Area Manager. Team Leader, DORP has been notified by the MDSC

time and again to ensure daily reporting.

● Regular assistance has been provided by the MDSC to develop the MIS database and a draft

database has been prepared. Final database presentation will be held on September 2018.

● One meeting was held with ADB Safeguard Specialist with regard to vulnerability criteria. ADB

Safeguard Specialist instructed to follow vulnerability criteria in all RPs as given in Safeguard

Policy Statement (SPS) 2009 and Resettlement Framework of this project. MDSC NRE shared

that some of the women and elderly headed households have substantial incomes much above

the poverty line income who would not be considered as vulnerable households.In the given

socio-cultural context of Bangladesh, they may feel embarrassed if offered a grant for the

vulnerable. However, in order to avoid subjectivity/judgemental errors in identification of the

vulnerable found in a few other projects in the past, ADB Safeguards Specialist opined that APs

meeting any of the vulnerability criteria must be made aware of the vulnerability benefits. Should

they choose to decline the vulnerability benefits, it needs to be documented as per due

procedure..

6 Compliance Status

The loan covenants related to land acquisition and resettlement activities are being complied. The

status of progress and compliance including all covenants are provided in the Monitoring and

Evaluation section of the Project’s Quarterly Progress Report and will not be repeated here.

ADB has given comments on various resettlement plans and also the 6th SSSMR and MDSC

complied with those. A comments-responses matrix has been given as Appendix N.

7 Follow up Actions and Recommendation

DC office has been paying CCL in Section 1 and 2 areas. Three RPs (Section 1, 2 and 4) have been

updated so far and two are being updated. SES has been completed for RP Section 3 and 5 (except

three mouzas). Information campaign, consultation meetings, community meetings, etc. have been

conducted as well side by side.

During the Feasibility Study conducted by the DC it was observed that APs of the RP Section 3

areas are confused about the project alignment route and activities of the project. PD has notified

MDSC that local people should be provided with the correct information in this regard so as to they

could know who will actually be affected in terms of losing their livelihood and assets (land, structure,

trees, etc.) and to what extent. So, DORP should be briefed from the PMU with actual map of project

alignment and activities to be done in this area. DORP has been instructed to disseminate accurate

information to those APs with regard to land acquisition and resettlement so that the affected

persons do not get confused what is going to happen.

Alignment video filming has been done and social cut-off-date has been declared in RP Section 3, 5

and 6 on 10th ,16th and 11th April 2018 respectively.

MDSC has arranged 3-days training on Resettlement Implementation Activities including Gender

Action Plan (GAP) for INGO field officials in May 2018. In addition, 2-days refresher’s training on Resettlement Implementation Activities for PMU officials also imparted on April 2018.

The Resettlement Experts of MDSC held several meetings with DORP to expedite their progress

and finalization of RPs.

Progress of work carried out by the DORP so far is improving with regard toquality and progress.

Several meetings were held with DORP and PMU from time to time where this was discussed.

Considering their progress following actions are recommended:

● DORP should disseminate accurate information to the APs with regard to LA including Right of

Way (RoW).

● DORP needs to assist APs more in processing legal papers for getting CCL. In addition, with the

assistance of Respective Union Parishad (UP) representative they will provide support to those

APs who have conflicts to resolve.

● No mentionable progress was found in LA/resettlement due to delays in Resettlement Plan (RP)

approval as well as some pending bureaucratic process of the government. PMU must instruct

DORP to update quality RPs. The PMU should also request ADB for quicker review of RPs and

approval. They need to look after the LA issue with the DC office to make it quicker. They may

push the DC office to make progress in land acquisition for RP Section 3, 5 and 6.

● River eroded land ownership issue and APs’ entitlement in RP Section 1 is yet to be decided.

DORP and the PMU should address these issues as early as possible since ADB is highly

concerned about them.

● DORP should be more proactive in RP preparation and incorporation of all comments made by

the ADB.

● DORP field officials should ensure more participation of the female in the consultation meeting

with proper documentation.

● DORP management should visit the field more often to ensure regular monitoring of the field

activities during implementation of land acquisition and resettlement.

Below is the monitoring format for activities to be done during implementation of the land acquisition

and resettlement as provided in the resettlement framework.

Consultation meetings were held in a cordial atmosphere and each participant took part in discussion spontaneously. Through the consultation process, it was transpired that most of the affected persons were found worried about losing of their land and agriculture-based livelihoods. Affected persons said that they have no sufficiently other land except this one. They said that they would not be able to purchase or replace lost land and properties They also said that the land they lost for the project intervention, they are using it from generation to generation as their only livelihood base. They said, compensation for lost properties must be made to the genuine owners. The Project authority should ensure compensation is paid directly to the affected persons. They informed that current market price of land (per decimal) is very high. Regarding income and livelihood activities affected persons said that agriculture, cattle rearing, poultry rearing fishing, handloom, vocational, day labor and small business are the livelihood activities and opportunities in their locality. Greenery crops are in an abound, the vegetables gardening and cultivation in the homestead and field, the mighty river Meghna and the sight of fishermen fishing and the incessant blowing gentle breeze at the river bank are the main visible and feeling object/things in the WIA. They said, agriculture-based employment will seriously be affected due to implementation of the project. They also said that they cultivate crops three times in a year. The main crops are: Paddy, Jute, Potato, Vegetables, Green-Chili and Tomato etc are grown in their land. However, they have shown positive attitudes

towards project.

Recently during January to June 2018 the following issues were discussedthrough public and consultation meetings:-

• In connection to the entitlement for the river eroded affected HHs several number of meetings were arranged with the affected HHs by PD of the project and by the DORP. In this regard they were advised to submit their papers to DC office for compensation.

• PreparationofAPIDcard: It is to be prepared as soon as possible. In this regard APs are advised to take photographs and submit national ID

The project (Section-01) will take

necessary mitigation measures to

compensate their lost assets in accordance

with ADB’s social safeguard policy. All

kind of technical and administrative support

will be provided to get compensation from

DC office as well as to get resettlement

benefits from DWASA.

As per guidelines of ADB, the DWASA

prepared resettlement plan to restore

livelihood and income of affected persons. All AHs will be compensated for their lost

properties at current market value. The

project will bring more income and

employment opportunity. Affected Persons

will get priority to get employment in project

construction works based on experience

and skill.

DORP will assist APs in lodging complaints

to GRC.

It was clearly discussed with the affected

persons that the project has no provision

for land for land, so, they have to be self-

relocated, and the EA will arrange full

compensation at the current market value

for their lost assets.

For receiving additional payment DWASA

will provide full support with a condition to

submit required documents to DORP

(INGO).

River eroded 19 HHs were advised to submit necessary papers in support of their ownership to DC office for receiving CCL In this regard several public meetings and meetings with DC Narayanganj were arranged by PD of the project. DORP is following up of the matters regularly.

Although PD has advised to keep budget for them in the RP of WIA. Accordingly, budget provision has been kept in the RP section-1 (WIA).

• TakingphotographsforIDcard:APswereadvised/informedtocometotheselectiveplacefortakingphotographandDORPwilltakephotographattheirowninitiativeandcost.

• CollectionofcitizenshipcertificatefromUnion/Pouroshavachairman:Itwasdiscussedinthemeetingthatcollectionofcitizenshipcertificateisinevitablleforreceivingadditionalpayment.

• Taxcertificate: Those have taxable income they must collect tax certificate from local tax office. This is also necessary for receiving additional payment.

• Submissionofnecessarypapers: This is strict instruction of PMU that those are eligible for additional payment must produce and submission to DORP (INGO) for additional payment

• GRM:The participants were informed in the meeting about GRM that if they have any complaints regarding compensation, delayed payment and ownership claim they can lodge their complaints to the members of the GRC or to the INGO..

• Self-relocation: The participants opined and expressed their interest that they will be self-relocated with the payment they received..

Participants expressed their views regarding

project, land acquisition and compensation

etc. They expressed that those, who is going

to lose their lands due to project intervention

would never be able to buy again this kind of

land because the land price is becoming

higher day by day. They are very willing to

give their land subject to proper and fairly

payment of compensation as it is the priority of

the government. Compensation rate is very

much lower than actual market price as they

claim. With this compensation they won’t be able to repurchase their land. They expressed

that they are very worried about their

next/future generations who are losing their

culture & community. They were also, worried

about dropping out their land which is their

livelihood production base. They sought

DORP’s assistance in getting necessary

documents ready for CCL from DC office.

They also drew authority’s attention in preventing broker and middlemen’s intrusion

The affected persons were informed that

the project has already undertaken

necessary mitigating measure to

with ARIPO 1982 and in compliance with

ADB’s Social Safeguard Policy Statement

2009. The project has designed a livelihood

restoration program to resettle and re-

establish the lives of the affected persons

at least at the pre-project level All kinds of

In the meeting different group/strata of people in the community were present.

The resources and speakers of the meetings expressed detail on project description and its objectives in the way that in mega city of Dhaka, here lives an uncounted number of populations, in order to meet up with the present insufficient water supply and increasing demand for it, the DWASA through the DESWSP has been taken to provide treated water to Dhaka city dwellers through DWASA distribution system.

It was discussed about negative and positive side of the implementation of the project. Ensuring pure drinking water for the city dwellers will ensure in protecting water borne diseases.

Those who are residing in Dhaka, in some way they are the relatives of ours. So, it is our moral obligation to support them in ensuring pure drinking water for them.

The project will extract surface water from the River Meghna at Shomvupura Mouza of Arihazar Upazila where a reservoir will be constructed. This surface water will be delivered through 22 km pipeline to the Water Treatment Plant at Gandharbpur in Rupganj Upazila. The treated water will then be delivered through 13 km pipeline to the distribution network of Dhaka city near US Embassy in Baridhara. This project aims to reduce abstraction of ground water by 150 million liter per day (MLD).

It was added in the meeting that due to implementation of the project the affected persons will be entitled to receive compensation for their losses. In addition, the affected persons will be provided income generating training and will be involved with the income generating activities, so the standard of their lives does not deteriorate from the pre project level.

In 1980, population of Dhaka city was quite a few in numbers, and now the numbers increased incredibly at an enormous size. With the increase of number of population in Dhaka city the demand of pure drinking water has been increased accordingly. He added that ensuring pure drinking water for the city dwellers will ensure in protecting water borne

or non-titled) will receive resettlement

benefits for loss assets such as: land,

trees, residential structures, business

structures etc. MDSC will guide and DORP

will assist them in all respects for easy and

tranquil payment for the APs. It was also

assured the PAPs in most of the meetings

that they will get fair resettlement benefits.

The business man, employees of the

business will receive benefit of income loss

from business and employees/workers will

receive grant for wage loss. Tenant, will

receive their due resettlement benefits. In

addition of the above benefits vulnerable

HHs and HHs those fully loss of

agriculture-based livelihoods will be entitled

to receive some other grants like for

vulnerable HHs they will receive

subsistence allowance and one-time

training grant. The vulnerable HHs and

HHs fully loss of their agriculture-based

livelihoods will be resettled by involving

them in income generating activities.

In this regard DORP and MDSC will assist

them. These are the project’s commitment to the PAPs. It was also discussed in the

meeting that by no means the life standard

of the affected persons, especially of the

poor (as they maintained before the pre-

project time) would not be aggravated,

rather it will be tried to enhance their socio-

diseases.

The following issues were elaborately discussed in the meeting 1) objective of the project, 2) Resettlement Activities 3) Implementation of Resettlement Activities. It is our moral obligation to support them in ensuring pure drinking water for them. In the meeting it was mentioned that the affected persons will be compensated fairly whatever they lost according to ADB Safeguard Policy Statement (SPS) 2009 All types of affected persons (irrespective of titled or non-titled) will receive resettlement benefits for lost assets such as: land, trees, residential structures, business structures etc. DORP and MDSC will assist/guide them in all respect for easy and tranquil payment for the APs. The participants were assured that the affected persons will get fair resettlement benefits, the business man, employees of the business will receive benefit of income loss from business and employees/workers will receive grant for wage loss. Tenant, will receive their due resettlement benefits. In addition to the above benefits vulnerable HHs and HHs with full loss of agriculture based livelihoods will be entitled to receive some other grants like for vulnerable HHs they will receive subsistence allowance and one time training grant. They also will be resettled through involving them in income generating activities. She added that in this regard DORP and MDSC will assist them by linking with DC office and DWASA for ensuring their rights in receiving all sorts of eligible benefits. The participants were urged to co-operate the JVC team in verifying the affected persons list and their losses and PVAC team in determining of lost assets value. It was mentioned in the meeting that by no means, the life standard of the affected persons, especially for the poor (as they maintained before the pre project time) would not be aggravated, rather it will be tried to enhance their socio economic condition at a better of condition. It was also discussed about GRM in the meeting that if they have any complaints regarding compensation, delay payment and ownership claim, construction work, Job placement especially for the vulnerable they can lodge their complaints to the members of the GRC or to the INGO. The participants opined and expressed their firm confident that they will be self-relocated with cash compensation they received.

The stakeholders told in the meeting that they are concerned about their business. Beside the agricultural work, most of the people of the area are businessmen, and they are afraid of losing their income from business due to WTP. So, they requested the project authority to provide sufficient compensation to mainstream their livelihood and skill development training, so that they could start alternative livelihood activities. The participants wanted to know about the compensation procedure clearly from the respective authority. They demanded that the concerned authority should provide suitable livelihood opportunities for the affected people and ensure the restoration of their business. They also expected adequate compensation for loss of income and business prior to construction work. It was observed in our consultation that there are two groups of affected people. One group is the businessmen and the other group is cultivating crops in the WTP land without any valid documents. It is revealed that both groups

DWASA made provision for Livelihood and Income Restoration Program in Resettlement Plan to rehabilitate their business. Due compensation will be paid to the temporary job losers.

1. The meeting had been scheduled at 3 o’clock but due to DC’s another engagement meeting started late.

The PD gave a brief description of the project to the DC and ADC (Revenue) alongwithshowingalignmentmapforRPSection1.Hestatedsameasbefore that some affected persons (APs) claimed that they have ownership against fewriver-erodedlandswhichhasbeenrecordedafterDC’snameduringJoint Verification Survey (JVS). As a result, these APs became non-titled for the CCL(CashCompensationunderLaw).According to JVS,alistofriver-eroded claimant land owners has been presented before the DC and ADC as well which had been updated from a consultation meeting that held on 24th March, 2018inWaterIntakeArea.Resolutionofthatmeetingthatpreparedbythe DORP is attached herewith.

3. The DC and ADC (Revenue) reviewed the list. They went through that many of claimant affected persons (APs) have porchas and tax payment receipts. Considering all, he suggested DWASA to inform these claimant APs for applying to the DC along with all legal papers they have in favour of their claims. The ADC revenue will conduct a hearing upon their claims. The ADC (revenue) stated that DWASA may represent in the hearing process. If their submitted papers proven as legal, then the DC will repay the CCL to the legal APswhichhehadreceivedasperlandacquisitionnoticeunder7onbehalfof the government owned land.

1. The meeting was held on 9 April 2018 (Monday) at about 11.00 am.The community meeting was held in Shomvupura

Intake Area organized by Araihajar DORP Area Office.The meeting was chaired by Abdul Baten, the most honorable

person by the community.With the consent of the Chairperson, Area Manager Ms. Nurunnahar Begum gave thanks to

all of the participants in the meeting.The Area Manager said that those who have not yet received the compensation

due to river erosion and due to record their land in the name of Peoples Republic of Bangladesh,they have to submit

all of the papers they belonged in support of their ownership to the DC office (land acquisition section) within three

days. Zoynal Member said that they have been asked to submit the papers within three days but in previous meeting PD

sir mentioned that they have to be submitted miscellaneous case. In reply Ms.Nurunnahar informed that the decision has

been changed.DCoffice wants to verify the papers through arranging hearing,after verifying the papers they will suggest

what do by the river eroded APs. For this reason they have to submit the papers in support of their land ownership

claim to the land acquisition section. DeputyTeam Leader of DESWSP project Jesmin Shahana informed that at present

there is no need to file any miscellaneous case. A hearing will be held to determine the actual owner of the land.After

scrutiny if their ownership is determined they will get the compensation for land.Zoynal member said that if they do not

receive the proper market price of the land,they will not give their land for the project.Abdur Rahman member said that

the market price of the nalll and of Tetia Mouza is assessed asTk.1,07,635 per decimal.But if you giveTk.26,000 per

decimal it will not be acceptable.To acquire the land,actual market price must be paid.Shahin member also mentioned

that,the market price of the nall land of Somvupura Mouzais Tk.5,21,268 per decimal.If any it is paid less amount

than the current market price,then the rate will be not fair and it wil limpact on them negatively.

3. Nurunnahar Begum said that whoever received CCL,they must submit the photocopy of CCLand others paper to

Araihazar DORP Area office.Sothat DORP can process their case for Additional payment.Area manager also

declared in the meeting that tomorrow their photograph will be taken for preparing AP ID card in Shahin member’s

residence.She requests everyone to attend tomorrow at the stipulated venue for photograph taking.

5. The chair listened to all the discussions of the meeting very carefully and expressed his satisfaction for sharing their

opinions to DORP personnel.As there were no other discussions the chair closed the meeting with thanks to everybody

Meeting was chaired by the Project Director of DESWSP. In the beginning of the meeting PD thanks to the members of the meeting and begged pardon for being late for an unavoidable issue that had to deal with High Court of Bangladesh. After coming back from the court, he commenced the meeting, he created a nice environment by telling some humorous joke to the audience what he naturally practiced almost in all of the meetings so far held with us. He was actually indicating and remindingtheDORPsomeurgentactivitieswhichtobedoneinanurgent basis.Firstofall,heaskedDORPtofinalizetheRPofsection1,2and 4 as early as possible. For this reason, necessary amendment and incorporation in the RP to be made.

Regarding preparation of RP of section 6,in this regard PD advised DORP to construct a frame for section 6 and he gave his commitment to DORP to provide necessary documents (BS AlignmentMap,PlotScheduleetc.)relatedtosection6,possiblythevery meeting date.

The Construction work is supposed to be started by October- November 2018, so, before starting construction work in the project area by the contractors, it needs to clear up all types of payment to the APs at least onemonthbeforeconstruction.Inthisregard.PDemphasizedongetting the RP concurrent from ADB, at least of 3 RPs by May 2018. For accelerating the payment. DORP will ensure that necessary papers have been submitted to DC office by the APs. PMU will keepclose connection with LA section of DC office for expedite the payment. DORP staff will make a list of APs received CCL, and HHs, yet to submit papers to DC officeandthenumberoftheaffectedHHsareinpipelinetoreceiveCCL, their status should be updated at daily basis and report to Team Leader DORP. In addition, DORP will complete all process to open Affected Persons (AP) filesand Entitlement Card (EC) for Additional payment by DWASA.

The PD cited an exciting example of a meeting in the Ministry, he said that irrespective of all of the present members including senior most officers of the ministry applauded highly of the DESWSP Project unanimously, every one of the members irrespective positions narrated the high necessity of the project and already they all are well acquainted with the project, so everybody will provide necessary support for the project.

PMU will make the opportunity in real effect.

5 PD reminded DORP to incorporate budget for the river eroded affected people as usual.

A JVC meeting is needed to organize immediately for approval of the list of affected persons and loss of assets of section-4 (WTA). PDInstructed DORP to request PD to arrange a meeting on next Wednesday (18-04- 2018) at WASABhaban.

PD expressed his dissatisfaction regarding market survey of Araihazar area, He suggested to complete the market survey form in regards to putting signature of the concerned respondent and revised the current market rate of losses in line with the rate determined by PVAC.

PD advised DORP in regards to preserving CCL related papers for easy identification. He pointed out that papers to be preserved mentioningthe Mouza, LA case and DESWSP top of each and every bundle ofpapers.

1.1 It has been decided in the meeting held on 24th January, 2018 that vulnerability criteria will be fixed following Safeguard Policy Statement (SPS) 2009 which has been followed by the Resettlement Framework of this project as well. According to that vulnerable groups include those households are: (i) headed by single man or woman with dependents with low incomes; (ii) headed by old/disabled people without means of livelihood support; (iii) households that fall on or below the poverty line; (iv) households of indigenous population or ethnic minority;(v)persons without title to land with low income; and (v) households of socially marginalized group or caste. However, it was found and shared with her before that some of the women and elderly headed households have substantial incomes much above thepoverty line income who would not be considered as vulnerable households. In the given socio-cultural context of Bangladesh, they may feel embarrassed if offered a grant for the vulnerable. However, in order to avoid subjectivity/judgemental errors in identification of the vulnerable found in a few other projects in the past, ADB Safeguards Specialist opined that APs meeting any of the vulnerability criteria must be made aware of the vulnerability benefits. Should they choose to decline the vulnerability benefits, it needs to be documented as per due procedure..

But according to national law river eroded lands belong to the DC and individual ownership becomesineffective. InthatcasenoonebutDCcouldbeconsideredasAPdespitepreviousAPs’claims. SheaddedthatiftheclaimantAPscouldproducetaxpaymentreceipt(khajna)then she/he will be eligible for gettingCCL.

7 TL DORP asked ADB Safeguards Specialist regarding use of the word ‘AP’. It was explained that the RP should not use this term in short form, it should be in full form like affected persons.

9 The Mission leader wanted to know about the status of Draft RP submission for Section 3, 5 and 6 because it is necessary to provide the bidders with the draft RP during bidding documents circulation. ADB Safeguards Specialist stated that if socioeconomic survey (SES) is not completed yet, DORP may submit draft RP with 20% SES completed. She also suggested that the area which are yet to be surveyed, estimate of the number of vulnerable will be prepared by projection on the basis of existing data. SMAH informed ADB Safeguards Specialist that DORP completed 100% SES for section 3 and 95% for the rest sections. 1 The PD welcomed the meeting participants. -

2 At the inception the PD, DPD, and XEN wanted to know about the current progress DORP will submit 4 RPs as of DORP and how many months they have remaining. TL DORP stated that they follows: have already submitted two Resettlement Plans (Section 1 and 4) to ADB through Section 2&3 by 15 March PMU. RP Section 2 is ready, only location map with structures’ photos will be added 2018 and will be submitted to PMU by next week. Preliminary draft for RP Section 3 is Section 5 by 31 March 2018 being written. He promised to submit that by 15th March 2018. About 95% socio- Section 6 by 15 April 2018 economic survey has been completed for RP section 5. PD stated that alignment of

RP section 5 and 6 will be changed slightly. However, DORP will submit RP section

5 by the end of March 2018.

Mr. Alamgir stated that as decided before two types of leaflets will be prepared; one for section 1 to 5 and another for section 6. Photograph taking has been started in WTP and Intake area. It will be finished in WTP area by 14th March 2018. But in Intake area it will be dependent on disbursing CCL cheques to the APs. With regard to CCL statement he added that up to February 2018 in RP section 1 and 2 areas 86 and 229 APs has received CCL respectively. But NGO could only collect required papers from 13 APs (7 in section 1 and 6 in section 2). So, they are very much lacking behind in making CCL statement. Ms. Nurunnahar told that they are facing problem to collect CCL papers because she heard that Mr. Badiul Alam told the APs that the INGO (DORP) has limited role in implementing RP including additional payment. That’s why APs are seemed to be very much non-cooperative withDORP.InthatcaseDr.RafezasuggestedthatMs.Nurunnaharshouldconduct communitymeetingineachmouzasaccompaniedbyMr.BodiulAlam toclarifytheir role in assisting PMU in RP implementation. The PD agreed with theadvice. Mr. Alamgir told that he will submit application form for GRC in English and Bangla by next week. Photographs taking of structures of RP section 2 have been completed on5th March 2018. DORP will present MIS database before PMU with original data on 27th March 2018.

4 The PD asked Mr. Nouman that why he replaced their experienced team staffs of DESWSPforanotherproject.MD DORP Mr Nouman did not agree with tha tstatement.Hetold that he did not take anyone from this project unless PD instructs. PD told him not replace any staff from now on for the months how much remains. Mr. Nouman agreed with him. Dr. Rafeza told Mr. Nouman that if he could promise that in future he would not replace staffs then MDSC could give training to the field staff. Mr. Nouman assured that he would not replacefurther.

MDSC will impart training to DORP field staff on Resettlement by April 2018.

requested to provide specific information including the details of resolution either through DC or the Property Valuation Advisory Committee (PVAC) should be added to the RP.To ensure their suggestions it is decided to have a consultation meeting with those APs to find out a solution to their problems.

4 To verify the ownership, the Area Manager has been requested by the PD over phone to inform the APs to bring their legal papers with one set of photocopies as evidence of ownership.

2 Then we went for meeting Land Acquisition Officer(LAO) to update her regarding river-eroded land issue as she stated during last meeting on 26th February 2018 that if the APs of Water IntakeArea(whoclaimedthattheyarethelegalownersoftheland)havetaxpaymentreceipt againstsuchlandsDCofficewillconsiderCCLpaymenttothem.Withregardtothisameeting had been arranged with those APs and found that most of those APs have such receipts as well as porcha but according to Joint Verification Survey (JVS) those lands belong to the government of Bangladesh through Deputy Commissioner (DC). As a result, those APs did not receive DC’s land acquisition notice under section 7 for compensation. Under this circumstance the project executing authority gets stuck to further progress of acquisition processbecauseADBisverymuchconcernedregardingsolutiontothoseclaimants.Butshe (LAO) was absent due to attending mobilecourt.

3 In absence of LAO, we met Deputy Commissioner (DC) though it was unscheduled he gave us time and listen to our issues regarding ownership dispute between government and the APs. The DC stated that he needed to discuss his officers before making any decision and needed to review existing law as well. He suggested us to make an appointment and sit with them in view of sorting out the problems.

● Objectives of the visit were to know the reason from the APs for not getting CCLpayments.

● It came to light from the discussion that about 65% APs of the RP Section 1 have already received

● We attended meeting in the courtyard of Ms.Sufiyan of Shamvupura village,Shamvupura

mouza,Bishnondiunion,Araihazar upazila under RP section-1.This meeting has been conducted exclusively

with the affected persons(APs) who claimed that they have the legal ownership of the river-eroded lands under

Meghna River.Numbers of the AP participants in the meeting were30.

● Objectives of the visit were to know the status of having legal papers of ownership of the river- eroded lands

under Meghna.It was found out during field visit in January that few of the entitled persons (EPs) in Water

Intake Area claimed that they have lands under river which have been eroded a long before. They have

legal ownership documents. But according to national law river eroded lands belong to the DC and

individual ownership becomes ineffective. In that case no one but DC could be considered as AP despite

previous APs’claims.She added that if the claimant APs could produce tax payment receipt (khajna) then

she/ he will be eligible for getting CCL. With regard to this a meeting had been arranged to verify the reality

of ownership.

PD,the chair of the meeting listened to all the discussions related to river eroded affected people very carefully and expressed his satisfaction for sharing their opinions and expectations to WASA and DORP.He requested them to cooperate DORP in all respects, because as they knew that DORP has been assigned to assist them in regardsto implementation of resettlement plan smoothly.If theydo not cooperate DORP, it will be difficult for DWASAto make arrangements in receiving additional grant by DWASAtothem.He strongly urged them to provide the necessary documents of those already CCL has been given with a view to open AP files. Unless they provide the documents immediately their next step i.e. payment will be delayed. On this point he is hopeful and positive that the affected people will cooperate spontaneously. As there were no other discussions, the chair closed the meeting with thanks to everybody who attended in themeeting.
