Plate senate, nccept a valid suchcertificate If presented with the gov-

might do so, but It Is doubtful. TheSemite that would puss upon the mat-

ter may be of a different politicalcomplexion. Exactly one-thir- d of thesenatorial term end March 4, 1!I13,

and it Is poHHlble that enoughlegislature may be elected to

change five of the stntes. Is It at alllikely that a democratic senate wouldseat a republican aenator Irregularlyelected?

We have quoted the statute spe-

cif ically prescribing how legislatures, shall proceed to elect a I'nit-'- Statesaenator. The net. was passed by con-gress lo prevent exactly such electionas la now proposed In New Mexico.

In construing the statute fixing thetime for Hie election of a t'nltedStates senator ihe supremo court ofNew Hampshire dSU N. II. ft S r. ) said:

"The evil (to be remedied) was theelection of senator lit too early a dayby a li glBlaluri' that was run. the lat-

est one lhat could elect for the fullterm of six years. The remedy wasthe fixing of such a lime that theduty of electing for Ihe full termshould fall upon Ihe latest legislaturethat could perform lhat duty."

The question was sillimllli d to thesupreme court of New Hampshire by

Ihe slate legislature Upon which de-

volved Ihe duty of electing a s niitorto succeed the one whose term ex-

pired Murch 4, 1 883. The next legis-

lature which succeeded th.'i one pro-

pounding the query would meet In

June, 1 883, nnd the court was of theopinion that the election should beheld by the In I eat legislature thatcould elect for the full term of sixyears, but emphasized the opinionquoted uliove (hut It must be the lat-

est legislature that could elect fur thefull term.

In the face of these facts It la futile, purlle, nonsensical to talk of electingKali at Ihi aeslon and It would belittle lea than a fraud upon the staleto tuk-- i Ihe lime of the legislaturefor that purpose when so much im-

portant legislation Is Imperatively de-

manded by the state. It might make il necessary for

(lovernor Mclionald to cull the legis-

Tim e. OcrrilloH Mining; ilMstrli't.Editor Mornin? Journal:

Will the mining activities in thisdistrict ever become again what theywere In days gone by?

For many yenra the little town ofCerrlllos was one of the most flour-ishing mining camps In the south-west. A few years ago the camp be-gan to recede nnd finally become dor-mant. When sifted to the bottom It

becomes evident that Ihe cause ofthe failure here was similar to thatIn many oilier camps, not on ac-

count of the ore not being there, noron account of the ore being hard totreat, but simply on account of thewrong kind of a plant being built totreat the ore.

The richest zinc mines In theworld would become an absolutefailure If you were to try to smeltthe ore in either a lead or coppersmelter. That Is what was tried atCerrlllos.

A new era has come In the campThe Sunset Mining & Snieliinif Co.,under the able management of Presi-dent William F. Sinley, has takenover u large acreage of valuablemining property In the district andconverted Ihe smelter into a con-

centrating mill In which they havedemonstrated that they can not onlyconcentrate tho metals Into a highgrade product, but at the same time;separate the zinc from the lead amsilver, thereby preparing them forsmelting' In their respective furnaces.

One of the strongest proofs of thecrowning Bticcess of this company Isthat they are progressing nnd thattheir assets are accumulatin"?. Whenthe Sunset Company took over thisproperty it was in oblivion with butfew to even apeak a good word fo.rIt. I'pon the Judgment of Mr.Staley the Sunset Company beganoperations on the lath day of lastAugust, ("in October 10th, Mr. TJ. A.Stall!, a prominent mining engineer, examined the property nnd foundover $1 14,000 worth of ore blockedout and a great amount In slRht. OnApril 1st, Mr. Statz made anotherexamination and found ore of a to-

tal value of over $.144,000 actuallyblocked out with about tho sameamount In sight, with over $2'oooat the mill Kite and on the dumpready for concentrating.

In addition lo Ihe blocking out ofore. Ihe Sunset Company has re-

modelled the smeller into a modelconcentrating null. Alt

of this has been done at a total expenditure of less than $20,000.

If the past means anything for thefuture, il would be hard to over-e- s

timate the future suece.-.- of the Sun- -

Set Company ami consequently inesuccess of tho entira district.

the only man who had enough votesto elect him had he seen fit lo cutloose and go it alone. This samelegislature elects his successor, andit is hardly possible that with hisposition as senator for the next tenmonths to draw upon that the menwho elected him will reverse them-selves nnd elect anyone else.

XiiW. therefore, can Albuquerque, confronted with u great situation af-fecting her interests, monkey with abuzz saw and flirt with would-b- e

The Itemed)--As the Federal building here is

practically filled there remains butone thing to do. and that Is fur theCommercial club to ask Senator Falland Congressman Fergnsson to pre-pare bills and Introduce ih bulbbouses nt once appropriating $100,-001- 1

for a hiiililine f,,. )(. forest ser-vice and engineer of reclamation.Such building to be erected on thevncaVit government lots fronting onGold nvenue, west of the drivewayto the post office. If this mutter isstarted at once it can be pushedthrough at the time the Catron billIs considered and we will get whatwe want und what wo need.

Xow is the time to get busy fclhat the two appropriations may gotogether.

In mentioning "engineer of recla-mation" the writer has in mind thepinna outlined by our senators andcongressman to dyke the Uio (ii.indeat government expense. This Is noIrridcsccnt dream; it is one of theearly possibilities, and there i;; everyreason to prepare viffices in Albu-querque for that great engineeringproblem, and now Is the time todo it.
