COURT DECISION BLOW

TO FOES OF GRAFTERS

Former Dictator of San Fran-

cisco, Despite Plea of Guilty,

Discovers He is Innocent of

Wrongdoing.

(Hy Morning Jonrn.il Nurriul lanril Win..

San Francisco, Jan. la. Followingtlie derision of the district court of

appeals yesterday setting aside (lieconviction of former Mayor KiigonoK. Schniiu, which may have a se

rious effect on tlie pros, ration .if San

Francisco graft unit bribery cases In

which 111 Indictments were returned

perhaps necessitating many changesin tlie plans of the district altorneiand a complete realignment of e

much activi. prevailed today

among those associated in the pros-

ecution. One of tlie slgulticaiil features waf

a conference between Abraham fiuef.the former dictator in tlie politics of

San Francisco, Special Agent William

J. Hums and District Attorney Will-

iam II. Langdon, In the hitter's office,

and at the request of the district at-

torney. None of tlie parties to theconference would give Ihe slightestIndication as to the object and pur-

pose of the meeting but It limy besaid that the release of Ituef on ballIs one of the developments that Is

expected as a possible compromisebetween him and the prosecution as a

result of the reversal of the SchmllzJudgment w hich also nullifies the pleaof gnilly made by Ituef. Far moreserious lo the proseeulion It is gen-

erally believed was tlie appelatecourt' decision because of its uppll-abillt- y

to Ituef than the setting asideof the conviction of Schniilz, havingthe effect it is said of practically des-

troying the proiooucinn'H hold uponthe former political boss, who is re-

garded as Ihe one, and Ihe only con-

necting link between the accused bri-

bers and the board of supervisors."I am entirely innocent, as innocent

as any man that you might pick onthe street who knows nothing aboutthe mailer," said KuelT lo a repre-sentative of the Associated l'ress as hi'was on his way to the district at- -'

tornev's office."I repeat that I am Innocent of ex-

torting money from any one," he con-

tinued. "My Tee was legitimate. N

crime was committed. 1 did not soli-ci- l,

in fact, severa times refused totake their cases because of the se-

rious Illness of a member of my fam-

ily. I was Innocent of the chargealthough, paradoxical as it may seem,I pleaded guilty. When I shall makea statement In court, which I shalldo at Ihe proper time, the reasons formy nclion will hi' understood."

Instead of the Judgment ol ihe ap-

pelate court not going Into effect for

sixty days us was erroneously statedlast night, tt renilttlture will conicdown today or toinniorrow.

Kuer stated today that he could giveball within any amount wilhin reasonand tills led to the Inference Ihat hisennferrnee. wllh the district ullnrneyhad to do with agreeing upon a re-

duction from the total of $1,170,000llxed on the 100 odd Indiel merits

against him.It developed today that the appeal

of Schmltz In full was not submittedto the appellate court until Wednes-day, the day thai what was hit of theSclimitz administration went out or of-

fice and Ituef was sent to the couniyJail, and that Ihe following clay be-

fore noon Ihe voluminous decision, covering thirty-tw- o typewritten pagesand containing about 1 0,000 wordsw as handed .low n.

While tlie rever-a- l by the app.ialeoourl was on tlie appeal of formerMayor Schmltz, it has had the effectof again making Huef Ihe central It'i-ur- e,

one acqultial and one mistrial of

Tirey L. Ford having caused theprosecution to practically concede thatRuef's testimony is essential to n

In the bribery graft cases. I'was said tonight by one of the altoi-ney- s

for Schmltz that application .'orhis release on ball will be made to-

morrow morning. It developed during- the hill thai

counsel for Schiuiiz and Huef anilattorney's office had dis-

agreed on whether or not Ihe judg-ment of flic appelate court can be ef-

fective at once or not. until thirty daysafter the decision was handed down. The defense maintains Ihat under a

statute passed in 1005 u reniillituimust be sent down by the highercourt "forthwith." which as pointedby the proseeulion is In direct con-

flict with the constitutional provisionthat Judgment chiiii.iI go into effect o;--

remittitur be sent down until all--

thirty days, except with the c.uiseni ofthti people.

Another question over which thereIs a difference of opinion between tin-

la w yers for- the two sides Is:

Whether or not Schmilz's bond of$H."iO,000 wus accounted when con-

victed. If held by the court thai ilwas not I lie former mayor will onlyhave to put up an additional borefor the ball upon which the nine pr.z- -

meetings are not unusual. The meeting was productive of very

positive and encouraging results inthe broad plans for the Irrigation con-

gress sessions here next fall. The first and most important ac-

tion of the meeting was the unanimous determination approved by ev-

ery one of the forty or fifty businessmen present, to proceed at once withthe construction of the conventionhall so that It will be ready and wait-ing before the session of the congress. An additional lot is to be bought amidecdod to the territory and the com-mittee of nine, appointed some timeago to have charge of Ihe financingand construction of the conventionhall, was Instructed to proceed with-fun- d

out delay to raise a sufl'leien, 'ocomplete the. bulldiniJ- on thescale whlell has bepn determined on,and at an expense not to exceed $17.-00- 0,

Including the J7.500 appropria-tion from the territory and exclusiveof the price of the additional lot.

This action was taken after consl-- fruble discussion in which every phase

of the financial side of the congrenwas fully discussed. Half a dozenmen spoke on the subject, every oneagreeing that it would be essentialthat Albuquerque should begin t'.ieconstruction of the convention hall atonce and tiiat the best time to boniiiraising the funds was right now. Themethod of procedure, which was dis-

cussed at length last night, has beenleft to the committee which will meetthis afternoon lo take up its work.

The second action of first impor-tance was ihe determination of theJoint meeting to drop the regulartures of the annual territorial fair ina sporting way and to a large extentto turn the energies of the immure-ment to the creation of an inters! loindustrial exposition to lie held in

with the congress and to n

real showing of I lie resources of NewMexico, at the same time invk;:igother .states and territories to join In

the exposition, which will be on a

broad scale. The title to be used forthe Joint evenls will be "The Six-

teenth National Irrigation Congressand Interstate Industrial Kxposltion,"the title of the New Mexico annualfair being; retained since It Is one ofthe cheif objects of the expositionplan to make a real New Mexico fairan annual feature of the future. Thisquestion was also discussed .at greatlength and while many members ofthe Joint board were in favor of con-

tinuing the sporting features of thefit U- - to a certain extent, the matterended with unanimous agreement usto the scope of the exposition and thenecessity for It.

Various other matters of detail worediscussed and action was taken onseveral matters of important routine.

When Chairman Hopewell calledthe meeting to order, the followingwer, present: Secretary Twltchell.Solomon Luna. P. F. McCanna, A.

Stern, G. L. Brooks, li. L. Washburn.Hoy A. Stamm, J. L. I.adrlore. Jos-

eph Burnett. The first action wus on the report

of M. L. Stern from the committee onthe convention hall. Mr. Stern pre-sented plans by Architects K. B.

Cristy F. W. Spencer and J. L. LaDrlere. all of whom were present, Mr.La Drlere also presenting a roughsketch of the exposition grounds asplanned by Secretary Twltchell. These plans were inspected and dis-

cussed and varied in estimates of costfrom H6.000 to $25,000, depending onmaterial used to a large extent. Itis probable that following the actionof the meeting as to the conventionhall fund, new plans on a definite ba-

sis of cost will be called for in the'immediate future. All of the plans

THE PRESIDENT AND SOME

POPULAR IMPRESSIONS

Washington, a City of Great

Churches; Some Impres-

sions of Cardinal Gibbons, the First American Cardinal,

(By Will C. Barnes.)Washington, Jan. 6. Couricss

today ami from now on the

political pot promises to boll ami boll

pretty hard at that. Every vote eastwill bo a wtraw, every speech made a

token of submission to some one of(lie numerous claimants for the favorof the coming convention.

II Is interesting to note that thedemocrats in making lit, their repre-sentation for their convention at Den-

ver gave the territories file usual sixvotns regardless of whether it was oneof the two at home or some one ofthose in the outer regions of our coun-

try, und heedless of the action of th1republican committee.

Hut the democrats, unlike our re-

publican party, ate much in the sameshape us we have been in the past,(here is but one man named or

thought of when the. democratic, nom-

ination is' mentioned und that is

Bryan. .So it matters but little howmany come, the more the merrier forthe opponents of the. gentleman fromLincoln are far In the minority andnothing short of death cun keep himfrom nomination or, as I overheardone man say the other night in one of

the hotels, "nothing short of deathwill stop him trying, either."

There, is a very curious phase of

this Bryan business, too; und that'sthe fact that a large majority of the

e southern democrats, es-

pecially among the congressmen undsome of the. senators, are very out-

spoken in their opposition to his nom-

ination.Old-tim- e democrats like Senator

Daniels, of Virginia, scout his preten-tions and roast him on every possihleoccasion. And yet they are not ableto mention a single man in the partywho could get twenty-liv- e votes intheir convention against Bryan.

When Bryan was "here recently heand Senator Daniels met in the cor-

ridor of the Wlllard hotel accidentallyand In such a way that they simply, for common decency, couldn't refuseto speak.

Daniels took a shot at Bryan andbefore they had spoken three minute';he had challenged the Nebrashhn s

democracy and Bryan with consider-

able and very commendable self re-

train t, simply said, "Oh, well, Mr.

Daniels, if the ,uality of my dem-

ocracy is to be 'discussed, I may aswell not slop to hear It." and passedin to the elevator he was about to en-

ter when they met.

But, nevertheless, Bryan is the onlychoice they have and Willi all the feel-

ing against him In such sources he hi

certainly popular with a great manypeople, just how many the comin;?election will doubtless determine.

Not long ago a knot of men were

talking politics in the Wlllard loh1i.y

and some one said to a democrat In

the crowd who was not at all In love

with Bryan, "Well, there's one thingsure, he's certainly tremendously pop-

ular nil over the country." "Yes,"snarled the member of the great un-

washed, "he's popular all right, everyday ill the, year but election day."

a case of the "king can do anythingwith the masses.

In Washington I'liurclie.Washington is a city of fine

churches and lots of them. The ne-

groes have a splendid cathedral, with

colored bishops, priests and other at-

tendants ut the altar, it's one of thefinest church buildings in the city ami

they have the best music by far of

any of the churches, l'rotestant or

Catholic. Great crowds attend theservices, so much so that they chargea small admission fee to the wlil:

visitors simply to give the colored peo-

ple a chance to get a seat. There are splendid choirs ami

in many other churches, notablythe First Congregational, where

the blind, organist, plays and di-

rects the music. It Is simply wonderful to see him

handle the organ, playing accompani-ments to solos, concerted pieces and

hymns entirely without music, ol

course, and as far as we can see, w ith

no one to prompt him.He always plays for half an hour

In lore the services begin and lifteen

minutes after the services close anilihe church is always filled when hebegins to play and few leave at theclose of the service until he Is donrand has closed his key board andstarts down the steps of the choir loft.

At the New York Avenue 1'resby.(erian church they have a line choir,11 splendid organ and organist, anlalso one of the best solo violinists In

the citv who plays during servicesand always a solo after the serviceswhich everyone slays to hear.

Bast Sunday he played tl vertun to "William Tell," with organ ac-

companiment, and 1 am wondering it

my old grandfather didn't turn overIn his grave if he. heard .lt, and in a

Presbyterian church of all things. And

an overture at that; and an operaoverture, too.

Shades of the old Scotch eovciiaiu-ers- ,

what a desecration of the church:from his point of view.

But it was good to listen to. even

if it might some day have, been calledungodly.

The First American Ciirilliml.A few Sundays ago Cardinal Gib-

bons came over from Baltimore to ad-

minister continuation to a large classat the Church of the Bleeding Heurt.Never having seen a cardinal and

such a renowned one as Car-

dinal Gibbons', we went to hear him.Of course the church was crowded

and It was not only a very deeply In-

teresting affair from a religious stand-

point, but a magnilicent spcctulur pic-

ture.Tin' entrance of tin- cardinal J'

preceded by a long iroi os.-i,.-n of hoy-I-

scarlet skirts carrying burningcensers, a long line of acolytes, priest--

and higher church ollkials and Una II;

at the end came the cardinal, his longand gorgeous scarlet tram earn. 11 orheld mi hy two hoy pages. On his hear'.

tht. insignia of bis great rank, thescarlet hat; on his linger the hugeapostolic signet ring. I was greatlyInterested in seeing this man, the first

American cardinal, and not only a

priest but a statesman anil scholar. In build he is u slender wiry liguiT

with a well shaped head with close

cropped grey hair, keen kindly greyeyes which seemed to sec everythingthat was to be seen. His Uw.f. cleanshaven and florid, was an Irish face

every line, and kindliness, gooil na-

ture and love for his fellows shone allover It. Why, he looked just like aman who could tell you a

Irish story and ship you 011 thebacli and enjoy it with you to the ut-

most.As he stood at the altar in Ills bril-

liant scarlet robes., surrounded by allthe white rolid figures of the lesserpriesthood. It was a picture not soouto Ire forgotten.

His sermon surprised no lor it was

just such a simple plain Christian talkto the people as one could lime heardIn any Brotestant church In the world.A talk that went to tile heurt andumbevta niling or every hearer. 110

matter who they were or to whatcreed they belonged.

think everybody loll as I did andwanted to clap their hands In ap-

Take the row in the navy which lia, followed Admiral Brovvnson's resigna-tion. At first every one here took theAdmiral's side of it, and said. "Howridiculous, of course, a navy of fleerought to command a hospital ship:who ever heurd of such folly''
