Marriott Hotel in Washington, D.C. Registration information is on page 14 of this newsletter. Commissioner Copps was nominated May 1, 2001, confirmed May 25, 2001, and sworn in May 31, 2001. Previously, Copps served until January 2001 as Assistant Secretary of Commerce for Trade Development at the U.S. Department of Commerce, where he was previously Deputy Assistant Secretary of Commerce for Basic Industries. Copps came to Washington in 1970, joining the staff of Senator Ernest Hollings (D-SC) and serving for over a dozen years as Chief of Staff. He has also held positions at Collins and Aikman Corporation and the American Meat Institute. Before coming to Washington, Copps was a professor of U.S. History at Loyola University of the South. Copps received a B.A. from Wofford College and earned a Ph.D. from the University of North Carolina at Chapel Hill. Registration information is on page 14 of this newsletter. Congressman Joe Barton was first elected to serve the Sixth District of Texas in 1984. In 2004, he was selected by his colleagues to be the Chairman of the House Committee on Energy & Commerce – the oldest standing legislative House committee. Barton follows in the footsteps of former House Speaker Sam Rayburn as only the second Texan elected to this position. The Energy & Commerce Committee has principal House responsibility over matters relating to commerce, public health and marketplace interests. Joe Barton was born on September 15, 1949 in Waco,Texas. An avid baseball player growing up, he earned a four- year Gifford-Hill Opportunity Award scholarship to Texas A&M University, where he was the outstanding industrial engineering student for the Class of 1972. After earning a Master’s of Science degree in Industrial Administration from Purdue University, he joined Ennis Business Forms, where he rose to the position of Assistant to the Vice President. In 1981, he was selected for the prestigious White House Fellows Program, and served as an aide to then-Energy Secretary James B. Edwards. Commissioner Michael Copps March 13 CTIA-FCBA Seminar On Sunday, March 13, CTIA and FCBA will co-host the first “Litigation, Transactional and Other Legal Issues for Wireless Practitioners” CLE conference in conjunction with CTIA’s Wireless 2005 convention and trade show in New Orleans. The program will be held from 1:00 to 5:00 p.m. in Room 232 of the New Orleans Convention Center, the CTIA convention site. Participants can earn 3.5 CLE credits. As outlined in the agenda below, the four-hour program will feature panels on litigation issues facing the wireless industry, transactional issues involving spectrum leases and MVNOs, government surveillance issues, and a review of CMRS regulatory compliance obligations. During the first panel, focusing on wireless litigation issues, three experts will discuss pending cases and review the legal landscape. March 13 CTIA-FCBA Seminar On Sunday, March 13, CTIA andFCBA will co-host the first “Litigation,Transactional and Other Legal Issuesfor Wireless Practitioners” CLEconference in conjunction with CTIA’sWireless 2005 convention and tradeshow in New Orleans. DEAR MEMBERS :

The FCBA’s expanded commitment to continuing legaleducation has resulted in the presentation of more and better-attended CLE sessions this year. Providing such educationalprograms is a core function of the FCBA. Our CLE seminarsnot only are vital in terms of keeping our member lawyerscurrent on current legal developments, they also provideopportunities to showcase our practice committees, not tomention the individual presenters. And, by providing avaluable service to our members, CLE programs promote theFCBA generally, thereby encouraging our members to participate in other baractivities.

No other organization has the resources and contacts to provide communicationslawyers with a significant number of educational programs targeting our diversepractice areas. This is because we have an abundance of committees and volunteerswilling to put together CLEs. Also, we are able to present more programs than in thepast due to the generosity of Dow Lohnes & Albertson; Sidley Austin Brown & Wood;Skadden Arps Slate Meagher & Flom and Wiley Rein & Fielding, each of which hasmade conference facilities available to the FCBA at no charge. Good organizationaltalent has helped as well. This year we have been fortunate to have as CLE Committeeco-chairs Bob Pettit, Lee Petro and Charla Rath. They, together with Stan Zenor andHeidi Kurtz at FCBA headquarters, have managed to skillfully coordinate the 11 CLEprograms the FCBA has presented since September.

In February alone we presented three CLEs that together attracted 278 attendees. Thefirst, on February 8, was our annual Comm Law 101 seminar. To attract busy younglawyers we changed the conference from a two-day gathering at Georgetown LawSchool to a four-hour CLE in a central downtown location. This experiment worked.Attendance by FCBA members was up,and feedback was generally positive.

On February 15, the Engineering and Technical Practice Committee presented"Engineering 101 for Communications Lawyers." This session, which was sold out,included three FCC engineers and covered topics such as frequently-used technicalterms, how multiplexing works, the table of frequency allocations, new technologies,Internet applications,and the lawyer’s role in technical proceedings.

Finally in February, the Wireless Practice Committee put on our first luncheon CLE.This session, which also was sold out, featured panels on new broadband deploymentand another on the FCC’s new rules and decisions governing EBS and BRS (formerlyITFS and MDS).

We will have presented 16 CLEs by the end of June. Two other programs are in theplanning stages,which may bring the total to 18. Attendance has been good,averaging82 and peaking at 124 for Engineering 101. Our chapters have organized yet otherCLE programs. The FCBA also offers partial CLE credit for the Annual Seminar inWilliamsburg on April 29-May 1 and for Seminar West, scheduled for August 5-7 at theClaremont Resort in Berkeley, California. I would welcome any comments you mayhave on this year’s CLE efforts, as well as suggestions on how we can better serve ourmembers’needs in this area.

What’s In TheCards???The 2005 FCBA Annual Seminar willbe held April 29th – May 1st, at theKingsmill Resort in Williamsburg,VA. With the pending departure ofChairman Powell, changes in leadershipat the FCC are certain and the potentialfor shifts in policy and program emphasislooms on the horizon. The seminartheme, What’s In The Cards?, willfocus on what changes may be comingto the FCC. Panels will feature FCCCommissioners, NTIA leaders,Bureau Chiefs, Legal Advisors, andfinancial analysts looking to the futureand how changes in FCC leadership willaffect the telecom industry. Confirmedspeakers -- so far -- include FCCCommissioners Abernathy, Coppsand Adelstein, Mike Gallagher,Assistant Secretary for Communicationsand Information, U.S. Department ofCommerce,Eugene Huang, Secretary ofTechnology for the State of Virginia,Robert Gensler, T. Rowe Price, Anna-Maria Kovacs, Regulatory Associates,and Victor Miller, Bear, Stearns & Co.The first seminar panel presentation willbegin at 3:30 p.m. on Friday afternoonand will be followed by the seminarkeynote speaker. Seminar presentationswill resume at 8:30 a.m. Saturdaymorning and will conclude at 12:00noon on Saturday.

Everyone will enjoy the traditional familyBBQ dinner and activities on Fridayevening, including the always-popularbingo bonanza. Saturday afternoon willsee the golfers take to the course for atournament and the tennis players headto the courts for their tournament. Otherplanned activities on Saturday afternoonwill include a kayak excursion lead byFCBA President Harry Martin and anorganized trip to historicJamestown/Yorktown. ColonialWilliamsburg, Busch Gardens, and plentyof outlet mall shopping are also close tothe resort. On Saturday evening, theadults will enjoy a special banquet andthe younger seminar participants will

have a special Kids’ Night Out activity.Following the banquet, members willstep into the “Casino” for some FCBA-style Texas Hold-‘em Poker,Blackjack, andother games of chance for young andold, all for the benefit of the FCBAFoundation. A $25.00 tax deductibledonation to the Foundation buys yourgambling stake for the evening. At theend of the night, the top three moneywinners will walk away with a prize afterall players have cashed out. The casinowill offer instruction to those who needto learn or brush up their card skills aswell as tables for the more experiencedcard sharks at the seminar.

The first panelevent, likely titled "VOIP: FromEmergence to Abundance," will be heldin the Boston area in April, with anoutstanding panel or panels of speakersfrom major VoIP and telecom industryplayers, and state and federal regulators(similar to those in attendance in theNew England Chapter’s "Emergence of

VOIP" panel held in June 2003). Issues tobe addressed will be different marketimplementation plans, state, federal, andinternational regulatory issues, and otherrelevant topics for this paradigm shiftingtechnology. In keeping with the NewEngland Chapter’s attention to cuttingedge technologies, a panel onWiFi/WiMax/Ultra-Wideband will beheld, likely in May. Chairman Robert E.Lee Scholarship andInternship Fund forLaw StudentsIn 1993 the Foundation established aScholarship and Internship Fund inmemory of former FederalCommunications Commission (FCC)Chairman Robert E. Lee, who passedaway in April 1993 after serving on theFCC for almost thirty years. ChairmanLee served as a Commissioner of the FCCfor 28 years and was instrumental in theearly development of color television,among other contributions to federalcommunications policy.

For the twelfth consecutive year, theFederal Communications Bar AssociationFoundation will award stipends to lawstudents from its Chairman Robert E. LeeScholarship and Internship Fund. In2005, the Foundation will award at leastfour $3,000 stipends to law studentsemployed as unpaid summer interns inpositions with the FCC and othergovernment Agencies or entities withjurisdiction over the communicationsindustry (i.e., broadcasting, cabletelevision, telephony, satellites andinformation technology).

Applicants will be selected on the basisof: (1) having secured or having pending,an unpaid summer position (internship)in communications with governmentoffices, (2) a demonstrated interest in thecommunications field, (3) dependenceon financial assistance in order to acceptan unpaid internship in a governmentagency involved in communications, and(4) involvement in community activities.An Application for the Lee Fundscholarship is posted on the frontpage of the FCBA Website -www.fcba.org.

March 27. Volunteers will meet onSunday afternoon at Martha’s Tablebefore they depart with the van of foodto selected locations. Children andfriends are also welcome. We will beginat 10:00 am and work until 1:00 pm.Martha’s Table is located in a yellowbuilding at 2114 Fourteenth Street, NW,in the District, near the intersection of14th and U Streets. On-street parking isavailable. Volunteers are asked to bringsandwich fixings (bread and sandwichmeat) with them, as the center oftenruns out of donated food.
