The 8 damaged mattresses are good enough to use however, due to the damage they are not suitable for using in the jail. Common Cup Ministries has a church youth minister who is able to use these new mattresses and some of the better older mattresses at a youth church camp.

A. Request authorization to proceed with advertising for bids for McLeod County Fiber Optic Network project with bid letting tentatively scheduled to start April 16th and continue for a three week period of time. Funding for the project will be coming from the Capital Fund.* IT is continuing to work with Consultant, Elert and Associates to finish the bid spec documents which are on track to be received on April 11th. IT would like to continue to move forward and establish a time table that will allow them to complete a portion or the entire project by the end of this year’s construction season. IT will continue to provide the necessary documents as they go through the steps of the bidding process.

The purpose is to raise funds to help support Holy Trinity Schools in Winsted, MN. Holy Trinity has an enrollment in grades Preschool through 12th grade. This is a major fundraiser in their annual budget. The assembly will being on the 13th day of June, 2014 between the hours of 5:00 P.M. and 11:59 P.M. and end on the 14th day of June, 2014. The maximum number of persons anticipated to attend is 20,000 each day. The maximum number of tickets to be issued, sold or distributed is 20,000. This property is located in the Northwest Quarter of the Northeast Quarter of Section (15) in the Township (117) North of Range (27) West. Approvals have been granted by the property owners, Township and City. All appropriate signatures have been obtained for the City of Winsted and the State of Minnesota for the application to conduct annual Off-site Gambling and Permit for 1 to 4 day temporary on-sales liquor license. Both the pull tab booth and beer tent are located on property within the City of Winsted. Because of their location it is not necessary to secure approval for these licenses from either the Township or County. McLeod County Sheriff granted written approval on March 6, 2014.

ANALYSIS
This application is for the continued mining as applied for in 2001, the existing survey is being used since there has not been enough excavation to exceed the area as pennitted since that time. The mining operation will be permitted for an additional 5 years. The reclamation of the pit area shall be fish stocking ponds for the existing aquaculture. The Rich Valley Town Board has made a recommendation of approval at their February 12t h meeting. The Co. Hwy. Eng. has requested that the landowner provide dust control as needed with a final road inspection being done after the closure of the pit. In the event that dust control is needed at the request of the McLeod Co. Hwy. Dept. that applicant shall follow instmctions and time frame as request by that department for CR 71. Juul Contracting has a $5,000 bond for road maintenance issues. The McLeod County Environmentalist has no additional concerns from the previous mining applications. The DNR area hydrologist has been notified. The existing reclamation bond expired in January 2014 and will need to be renewed.
RECOMMENDATIONS
Staff has no objections but the applicant must be familiar with and adhere to mining standards within a shoreland and floodplain area and road maintenance of CR #71.

Information: Applicant is applying for a renewal of a conditional use pennit to mine gravel.
There are some wetlands around the gravel pit and there is County Ditch 38 on the south side of the pit.
Recommendations: I would recommend the following if approved:
1) Meet all NPDES Permit requirements. 2) No direct or indirect impacts be allowed to any surrounding wetlands
from this operation. 3) Per M N Chapter 103E there is to be no negative impact to the County
Ditch from de-watering practices such as sediment deposition or bank erosion.

Zoning History: This area has been mined intermittently for the past 30 years under various permits.
ANALYSIS
The Hassan Valley Town Board has made a recommendation of approval at their February 18 meeting and has approved the proposed haul route of 160th St to CR #25 or St Hwy #22. The McLeod County Hwy. Dept. has no concerns other than informing the Mueller's that during the 2014 construction season CR #25 will be closed to traffic during re-construction. The McLeod County Environmental Office and DNR have been notified. When the operation is closed the end use is planned for a wildlife area. The mining will be done on the Katzenmeyer property and the stockpiling and processing will be done on the Baumetz property. This is a duel property permit to avoid the mining setbacks at the shared property line; this will result in all the material being able to be mined. Hours of operation will remain the same as the previous mining permit.
Staff has no concerns i f all conditions are met. Staff would recommend that restoration be completed on all previously mined areas before moving into new work areas. A reclamation bond or letter of credit shall be placed on the pit reclamation along with a road bond to Hassan Valley for haul route reclamation and dust control i f needed.

All training on the programs written by SafeAssure Consultants, Inc. will meet or exceed State and/or Federal OSHA requirements. These programs/policies and procedures listed on the addendum do not include the cost of hardware such as labels, signs, etc. and will be the responsibility of McLeod County Highway Dept. to obtain as required to comply with OSHA standards. Our contract year will begin on the signing of this proposal/contract. Classroom training will be accomplished at a time convenient to most employees/management and so selected as to disrupt the workday as little as possible. All documents and classroom training produced by SafeAssure Consultants for McLeod County Highway Dept. are for the sole and express use by McLeod County Highway Dept. and its employees and not to be shared, copied, recorded, filmed or used by any division, department, subsidiary, or parent organization or any entity whatsoever, without prior written approval of SafeAssure Consultants. It is always the practice of SafeAssure Consultants to make modifications and/or additions to your program when necessary to comply with changing OSHA standards/statutes. These changes or additions, when made during a contract year, will be made at no additional cost to McLeod County Highway Dept.. Contract/ Agreement THIS AGREEMENT is made this first day of May, 2014 between McLeod County Highway Dept., Hutchinson, Minnesota, herein referred to as McLeod County Highway Dept. and SafeAssure Consultants, Inc. 200 S.W. Fourth Street, Willmar, Minnesota, herein referred to as SafeAssure. SafeAssure agrees to abide by all applicable federal and state laws including, but not limited to, OSHA regulations and local/state/national building codes. SafeAssure expressly forever releases and discharges McLeod County Highway Dept., its agents, members, officers, employees, heirs and assigns from any such claims, injuries, or damages. SafeAssure will also agree to defend, indemnify and hold harmless McLeod County Highway Dept., its agents, members and heirs from any and all claims, injuries, or damages of whatever nature pursuant to the provisions of this agreement. April 1, 2014 McLeod County Board of Commissioners Re: Request to donate jail mattresses Dear Commissioners: I would like to explain a bit more in detail my request that is going to the board on April 8th regarding mattresses. Right now I am in a transition of rotating out our older mattresses for new. We typically do this as needed every few years. I have found a vender that has a very good product that has extended the useful life of our mattresses from 2-3 years to 6-7 years. In the past we have thrown away the worst of the old mattresses and kept the better ones for spares. We will continue to do this. In this year’s rotation I have a lot of mattresses that are in good shape but are losing their form through age. They are good enough for spares and for children, but are losing the support that an adult needs when sleeping on a hard surface. As I elude to in the board request, we ordered 12 mattresses that arrived in January during the sub-zero weather. During transport the edges of the outer mattresses basically shattered from the temperatures. We worked with the supplier to see if doing a replacement cover would work. It did not. The supplier replaced the 8 new damaged ones at no cost. These arrived in perfect condition. This brings me to my request. I have these new damaged mattresses and a dozen or so decent mattresses that have no value to the jail and would be thrown in the garbage which is to me a waste. They are still usable, just not in a corrections environment. My staff did some brainstorming and we called a few agencies that we thought may be interested in using them. Bev from Common cup ministries has a church that is interested in looking at and hopefully taking several of them off our hands to use for a church youth camp. I feel this would be beneficial both for the county and the church as well as a good public relations move. M . and end on the 14t h day of June 2014 at 11:59 P . M . The maximum number of persons anticipated attending is 20,000 each day. JUSTIFICATION FOR MOTION:
Approvals have been granted by the property owners, Township and City.
A l l appropriate signatures have been obtained for the City of Winsted and the State of Minnesota for the application to conduct annual Off-site Gambling and Permit for 1 to 4 day temporary on-sales liquor license. Both the pull tab booth and beer tent are located on property within the City of Winsted. Because of their location it is not necessary to secure approval for these licenses from either the Township or County.

Enclosed is the "Application for Licenses to Permit Large Assemblies in McLeod County". With regard to this document I have obtained all pertinent signatures as well as supplied the information requested. What is required now is the review and approval from your office, the McLeod County Sheriff and the McLeod County Board of Commissioners.
As in years past the "Application to Conduct Annual Off-Site Gambling" and the "Application and Permit for the 1 to 4 Day Temporary on-Site Liquor License" are obtained from the City of Winsted and the State of Minnesota.
