You may be following the CIVIX lawsuit against technology companies that utilize location based search on the internet. After suing Microsoft, Lycos, Hotels.com, Expedia.com, and many others for patent infringement – most ending in settlement – CIVIX attorneys have set their sights on the heart of the real estate industry – MLS.

In 2005, CIVIX sued realtor.com which ended in settlement in 2009. Late last year suit was filed against two of the largest regional MLSs in the nation. The strategy is to sue the MLSs that use the technology covered in their patents rather than going after the MLS vendors, IDX providers, etc. At the NAR Mid-Year Meetings the CEO of MRIS, DC area announced that they had made a business decision to settle with CIVIX.

NAR was asked to negotiate a settlement with CIVIX on behalf of the entire industry. On May 17th NAR did license the search technology covered by the patents owned by CIVIX with the ability to sub-license to all MLSs nationwide. However, the agreement gave the industry only 3 months to raise $7.5 million with the first $2.5 million payment due on the 16th of June.

MLSs who enter into the sub-license agreement will cover the use of search technology (as defined by the specific patents owned by CIVIX) utilized by members of the MLS; basically every product and service used by the MLS and its members that has any kind of search on the internet.

The cost for an MLS to enter into the sub-license agreement is a one-time fee of $9.06 per member. Some MLS are exploring means to charge a one-time assessment to their members to cover the license fee. But NNRMLS, due to years of sound fiscal policy, is able to enter into this agreement without any additional individual expense on the part of our members. The Board of Trustees of the Northern Nevada Regional MLS has approved the un-budgeted expenditure up to $25,000 on behalf of our members. We will move forward with this settlement with alacrity to add our share to that first $2.5 million payment. If that initial $2.5 million is not raised, there will be no agreement, our payment will be returned, and CIVIX will be free to pursue other remedies toward what they feel is infringement of their patent.

You may be thinking, “NNRMLS is small, why would CIVIX come after us?” Friday, May 27, 2011 NNRMLS was contacted by the legal firm representing CIVIX and offered our own settlement or face litigation. Their offer was $6.00 per member per year for 4 years; substantially more expense than entering into the NAR license agreement. Therefore, should the settlement negotiated by NAR fail, we have been targeted. The cost to fight that kind of legal battle would far exceed either settlement offer.

We anticipate that our various vendors – who will share in the protection afforded by this settlement – will join in the payment of the license fee to help offset our cost. Although, our indemnification clauses cannot compel them, we fully expect they will willingly lend their assistance. LPS has committed to pay 2/3rds of the license fee on behalf of all members using Paragon and other products. They are negotiating certain protections to be added to the license agreement. If accepted by the June 16th deadline, NNRMLS’ portion will be dramatically reduced.

Here’s how to avoid late fees, suspension, and a $50 reinstatement fee:

• Before you leave this summer, call us to find out your current balance

• Pay any outstanding balance, and think ahead about your summer plans

• If you are going to be gone for an extended amount of time you can pre-pay for the length of time you will be gone. We can help you determine how

much you will owe.

And finally, go camping, sight-seeing, biking, etc, knowing your account is taken care of! Call us and we will help keep your account up-to-date!

Can the Fannie Mae Short Sale Assistance Desk Help You?Does your Fannie Mae backed short sale transaction fall under one of these guidelines?

• The servicer has not provided an initial response within 20 days• A final property valuation (BPO) has not been completed within 30 days from the

offer submission• A final decision or specific direction to facilitate a decision has not been made

within 60 days from the original offer submission date• Or, you have received an approval from the servicer for your transaction, but the

MI (or 2nd lien holder) has imposed a closing condition that is not possible for the borrower to meet

If your transaction falls under at least one of these guidelines then you are eligible to submit to the Fannie Mae Short Sale Assistance Desk and your case will be sent directly to Fannie Mae so that they can get your stalled transaction moving again.

When you submit your case through the Fannie Mae Short Sale Assistance Desk, please make sure that the listing information in Paragon is correct; in particular, that the Fannie Mae “Yes/No” field reads “Yes”. In order for the property to be eligible for the Assistance Desk it has to be Fannie Mae backed and the listing in Paragon must reflect this. To check to see if the property is Fannie Mae backed, you may use the Fannie Mae Loan Look-Up Tool that can be found on the Paragon homepage under Quick Links or by clicking here.

Have You Heard of HUD Short Sales?

In the meantime, here is the updated summary of requirements forHUD Short Sales, also called "Pre-Foreclosure" Sales:

1. Seller must be delinquent 31 days or more at the time of sale.

2. Seller must list the property with an un-related Licensed Real Estate Broker.

3. Listing agent must actively market the property for four months (up to six). After the 6th month, HUD will begin foreclosure proceedings or accept a Deed-in-Lieu of foreclosure and the REO property will be assigned to an asset manager per the normal HUD channels.

For the first 30 days of marketing, the short sale lender (mortgagee) may only approve offers that will result in a minimum net sale proceeds of 88% of the "as-is" appraised Fair Market Value (FMV). During the next 30 days of marketing, the lender may only approve offers that will result in minimum net sale proceeds of 86% of the "as-is" appraised FMV. For the rest of the marketing time (60 days), the lender may only approve offers that will result in minimum net sale proceeds of 84% of the "as-is" appraised FMV.

4. The property must be owner-occupied, except for cases of job transfer, death, divorce, job loss

5. There should be written proof of sellers decrease in income showing inability to pay the mortgage, job loss, etc.

6. Must be an arm’s length transaction – buyer cannot be a relative etc.

7. HUD will pay up to 1% of buyer's mortgage as part of closing costs if the new mortgage is also FHA, plus reasonable "seller" costs.

8. HUD allows 6% REALTOR® commission.

9. HUD will not pay for Home Warranties, points or lender's title insurance.

10. A Seller incentive up to a maximum of $1,000 may be paid by HUD at close of escrow. Seller may elect to receive cash or apply some or all of the compensation to sales costs not paid by HUD or toward junior liens.

11. Seller must get approval to participate in the HUD Pre-Foreclosure Sale Program in advance.

12. Upon acceptance into the program, seller will be given Approval To Participate Form which will outline program restrictions

13. Neither the listing broker nor the buyer’s broker needs the HUD “NAID” number as these listings are not (yet) a part of the HUD HomeStore.com website.

Details can be found at HUD Short Sale (Pre-Foreclosure) Program. Remember, these guidelines apply to FHA-insured loans only, and there may be some latitude in those requirements. These guidelines are subject to change.

Recently NNRMLS became aware of the “Pre-foreclosure Sales Program” also called “HUD Short Sales.” As we are in the process of overhauling our “Special Conditions of Sale” section in Paragon to change “Bank Owned” to “REO” and move HUD listings out of “Other,” we became aware of potential confusion between traditional HUD listings (technically foreclosed properties) and FHA insured short sales or “HUD Short Sales.”

We are holding off on our revamp of Special Conditions in order to find the best way to identify listings to simplify our members’ search.

Log Off: In order to fully terminate your session with Paragon, please be sure to log off when you finish. If you simply exit your Browser window without properly logging off, this can cause Paragon to give you a SafeMLS error Page. Paragon does not fully release your session unless you click on the “Log Off” button in the top right-hand corner of your screen.

Back Button: Do not use the web browsers’ back button when in Paragon. Paragon provides all the navigation tools needed. Please use Tabs and Sub Tabs to change and modify your search. Paragon provides its own back button in views and reports. Navigating through Paragon is done through the website itself and not whatever Browser that you might be using.

Scout: Scout for SafeMLS is the security platform that we use to protect our members proprietary data. Scout determines your keystroke when you log onto Paragon. The purpose of Scout is to protect your account from being compromised and also to ensure that the password is not being shared. If Scout detects a potential problem with your login, it will first send you an email. Please contact NNMRLS as soon as possible so we can determine the cause and avoid escalation.

Tax Autofill: Tax Autofill is a feature that will start a new listing directly from the assessor’s tax records. The Tax Autofill command is located on the light blue action toolbar at thetop of the listing input form of Paragon. The amount of data that is populatedwill vary by county, but it is a start.

The new www.NNRMLS.com will be launched later this month! This customized website helps our MLS leverage our unique ability to provide comprehensive, up-to-date local listings on behalf of our Members, and provide leads back to the agents. All of the twitter and facebook followers of the recently retired Real Estate Directory are being routed to the consumer portal and back to our Members.

Paragon 5 keeps moving towards the Gold status. NNRMLS currently rates Paragon 5 as being Silver. If you have not tried Paragon 5, give it a try because Paragon 4 will not last forever. If you found problems with Paragon 5, a lot has been fixed and we recommend seeing what has been fixed and updated.

Based on direct member feedback by NNRMLS members much has been updated since the initial debut of Paragon 5. Here is a list of just a few of the recent repairs and updates to Pragon 5 to make your job easier:

• The Primary Area Filter has been added back to the Area Search window in the Property Search.

• Users may now designate whether they would like to print a Spreadsheet or CMA Summary view in Portrait or Landscape orientation via Print+.

• A font size selector has been added to the Spreadsheet Print enabling a larger or smaller font.

• The Photo Slideshow has been redesigned to fit smaller screens eliminating the need to scroll.

• The Photo Slideshow has been updated to provide a faster load time.• A minimize button has been added to the Map and Compose E-mail windows

allowing users to view what is behind the map or e-mail window.

Only a few obstacles remain before we can call Paragon 5 Gold. NNRMLS continues to work with the developers to resolve these issues:

• Printing a spreadsheet view may result in a blank first page.• Saving a search may return an error under certain circumstances.• CMA Summary’s Summary Stats for Sold listings are not calculating correctly.• Agent roster may not be showing all members.• Changes to Adobe Reader X can cause Print+ to fail. LPS is working with Adobe

Directly to fix this problem.• Print +Load Times are longer than what we like to see.

The timetable to turn off Paragon 4 relies on Paragon’s developers. Once the main problems have been resolved, NNRMLS will provide a two week notice before access to Paragon 4 is disabled. Please remember that NNRMLS is on your side. We want to provide the best product available to our membership. Are You Using Paragon 5 the Hard Way?

We launched Paragon 5 at the end of January 2011 and followed with an extensive highly recommended Paragon 5 Overview class that highlighted new features in the system. This class was a huge success in attendance!

But, now it is time to maximize the time-saving features offered in the new system! While the overview class stressed the similarities between P4 and P5, we now need to focus on the differences. For example, you can input a listing by using familiar P4 steps, but if you learn the new processes utilizing P5 enhanced features, you will experience greater speed. Sign up for one of our hands-on or online classes to learn the time-saving features that set P5 apart from P4.

In addition to our hands-on and online classes, we would like to offer you another training option. If you cannot attend one of our scheduled classes, as your P5 trainer, Josh will schedule personal training in order to help you become more efficient and productive in Paragon 5. We will schedule an appointment at your office or in our lab, for you and several co-workers. Please contact [email protected] to set up a training time.

Area-Wide Open House Wrap-Up

On May 15th NNRMLS held our first Area-Wide Open House event of 2011 throughout Northern Nevada. The event, which took place on a Sunday, had 185 properties searchable on the consumer site nnrmls.com – 120 members participated.

As with previous Open House Events, we had print advertising in the Reno-Gazette Journal (RGJ), Nevada Appeal, Record Courier, Bonanza and the Sierra Sun. We ran a TV commercial on Channels 2 and 4 and HGTV on Charter Cable. The commercial was also translated into Spanish to run on KREN 24 (Univision). One of our Trustees, NNRMLS Vice President, Pat Schweigert appeared on The House Detective.

Members were able to add and remove their listings via Paragon. Identifying an open house via Paragon on nnrmls.com will be a permanent part of the Paragon system. Based on the responses from our members, the event was a success! Almost 90% of members who answered our follow-up survey said they would participate again. Over 85% of respondents also said they felt the event was a valuable service of NNRMLS.

We are planning to hold a 2nd open house event later this year, so keep an eye out for an upcoming date. We will announce details of the next event in our Members Monthly newsletter as well as our Facebook and Twitter pages.

Recently many areas of the United States have been devastated by natural disasters. We are all deeply saddened by the losses members of our REALTOR® family have suffered by these events. In a letter from Joyce Thomas, President of the Missouri Association of REALTORS®, she shared these alarming statistics regarding REALTOR® Members directly affected by the tornadoes that touched down near Joplin, MO.

1 Member has died; 7 Members are missing; 20 Members have lost their homes; 2 Association staff members have lost their homes; 2 REALTOR® offices have been condemned, and emergency officials will not let

anyone into those offices to collect or salvage their belongings

We know the Members of NNRMLS will want to support our fellow REALTORS® who have faced tragedy in Alabama, Missouri, North Carolina, Tennessee and so many other states. If you are moved to make a contribution, we have provided a link to to the REALTORS® Relief Foundation.

NAR first launched the REALTORS® Relief Foundation (RRF) as the REALTORS® Relief Fund in 2001, within hours of the devastating Sept. 11 terrorist attacks. Since then, more than $20 million has been raised for victims of disasters including wildfires, tornadoes, floods, and hurricanes. Today, the REALTORS® Relief Foundation (RRF) exists as a 501(c)(3) organization established to provide housing-related assistance to victims of disasters and for other charitable purposes permitted under Section 501(c)(3) of the Internal Revenue Code.

The RRF welcomes contributions, not only in times of disaster, but at any time throughout the year. The foundation distributes 100 percent of all funds collected to disaster relief causes, and it guarantees all donors that 100 percent of donations will be used for an appropriate disaster relief effort. As many of you know, NNRMLS offers two syndication products to assist with the distribution of your listings across various channels. The goal of syndication is to allow you, the broker, to individually decide where your office listings will appear on the internet. In an effort to make the process easy, we often forget that the syndication dashboard may be on auto pilot. So, here is a friendly reminder about and how to check out our two syndication services.

List HubThe ListHub syndication service has been a service of NNRMLS since 2007. ListHub powers over 50 search sites and can provide metrics on what sites generate the most clicks from your listings. If you are an agent, ListHub can generate reports just for your inventory. ListHub recently upgraded their metrics to include Realtor.com and the Yahoo!/Zillow metrics.

Point2 SyndicationA recent addition to the NNRMLS product suite. Point2 syndication is similar to the ListHub syndication product. The Point2 syndication network also features over 50 syndication channels. Some of these channels are the same as ListHub, but some are different.

Point2 provides metrics to brokers and agents on which listings receive clicks from websites. Point 2 also has an additional product suite available to agents and brokers including websites and marketing tools.

Annual Renewal RemindersCertain segments of our membership have an annual renewal – approved MLS Exemptions, MLS-Only Members, and Licensed Assistants Staff ID. A very small portion of our agents have these specialized membership classes, but since brokers may have agents falling into different categories, we are streamlining the renewal process so that these housekeeping issues may be taken care of more efficiently.

You may have received notification of one of these renewals. If so, you can expect your 2011 renewal fee to appear on your July billing statement which will be sent on June 28th.

MLS Exemption – Annual renewal notices have been sent to brokers on behalf of members who have previously been granted an MLS Exemption. Renewal letters must be signed and returned to NNRMLS no later than June 17, 2011. A $35 renewal fee will be applied to the brokers account for all renewing exemptions.

If NNRMLS does not receive the renewal notice with the broker’s signature by June 17th, the agent will no longer be eligible for the exemption and the member status will be changed to Active – with reinstatement of monthly fees. To be returned to exempt status, the agent would then be required to reapply.

MLS-Only Members – Brokers and Agents who belong to an Association other than RSAR or SNAR who have joined as MLS-Only members of NNRMLS must pay an annual renewal fee of $35. As part of the 2011 renewal process, NNRMLS will confirm that MLS-Only members are “members-in-good-standing” at their primary Association of REALTORS®. As part of our streamlining process, NNRMLS will attempt to obtain this confirmation on the Member’s behalf and only request the Member to provide a letter of good standing if we are unable to confirm via the National Association of REALTORS®.

Licensed Assistant’s Staff ID – Notification of the Licensed Assistant annual renewal has been sent to employing members. This annual fee applies to licensed REALTOR® Members working as the personal assistant to another REALTOR® Member. Employing Members can expect the $20 fee on the July billing statement. If you no longer employ an assistant, please contact NNRMLS by June 17th. A new Limited Subscriber Staff ID form must be completed and returned to NNRMLS if you have made a staffing change. If it is an update, there will be no set-up fees.
