DESCRIPTION

It refers to media-reports about Sanjiv Chaturvedi said to have been a whistle-blower being unceremoniously sacked by Union Government from post of Chief Vigilance Officer (CVO) of All India Institute of Medical Sciences (AIIMS) New Delhi.Central Vigilance Commission (CVC) and AIIMS following a verdict of Central Information Commission (CIC) have provided some important information relating to vigilance-enquiries at AIIMS for the period from 01.06.2012 to 27.05.2013 to Sri Subhash Chandra Agarwal. It should be ensured and analyzed if any of those, involved in such enquiries managed ouster of Sanjiv Chaturvedi from post of AIIMS CVO. Or it is part of strategy of Union government to send back the media-termed honest officer back to his state-cadre in Haryana to expose corruption in the state where polls to state-assembly are due in near future. This post is based on inputs obtained from Sri Subhash Chandra Agarwal.

    Detailed investigation report/comments sent to CVC vide letter dated 22.8.2012 and CVC vide letter No0121HFW/014-206332 dt 15.3.2013 has advised closure of the case.

    On receipt of complaint relating with allegations of having disproportionate assets by Shri Suresh Bhasker, Executive Engineer(Civil), the matter was examined after obtaining information from Sh. Bhasker and report has been sent to cve vide letter dat~d 15.4.2014 for opinion and further course of action. Disciplinary proceedings under Rule 14 of the CCS (CCA) Rules, 1965 were initiated against Dr. R.S. Tyagi, Ex. Dy. Director(Computer Facility),AIIMS and penalty of withholding 10% of his penSion and gratuity for a period of two years had been imposed vide order dated 20.6.2013 As per direction of the CVC, the matter has been examined in consultation with the procurement section of the Institute and report sent to CVC vide letter of even number dated 8.11.2013

The detailed investigation report along with the departmen's specific comments/recommendations on each of the allegations may be sub itted to the Commission within 12 weeks of receipt of this order.

    Hospital vide their tender number YlI0161I58/2010PC-ECC Due on 15. 7.2010 Schedule No 28 Washer Disinfector with Seven years warranty (two years warranty and additionaffive years free CMC) . This equipment price was Euro 132 0 CIF New Delhi with more than twice the accessories than asked in this tender.

    3. The same model is being procured by AlIMS with half the accessories at m re than DOUBLE the price (Euro 27800 in CNC AIIMS and Euro 28600 in JPNA C AIIMS and INR 18.85.275 in BRA IRCH AHMS with FIVE years warranty and he! fthe accessories.).

After examining the report ,furnished by AIIMS, it is ob)rVed that while the said report mentions that four firms had participated ib the said , tender and two firms had been technically shortlisted for openin$ of price bids, the enclosed note of Store Purchase Selection Committee Iindicates that six firms had submitted their offer against the AIIMS's aldvertised tender, of which five bidders had been rejected. Moreover, t e model numbers in the report of AIIMS for the purpose of price comp ison are different from the model mentioned in the complaint.

[email protected] . I ,[email protected]) and telephone (+91-9968120034; 011 - 23062434) but I not recdived any reply about that. (1 asked a.bout these facilities because overseas applicants were eligible to avail this facmf,'as per interview letter.) Finally, I visited India and meet to Director PMSSY (Dr. Rakesh Kumar) and Directo AIIMS (Bhopal) in the 'Nirman Bhawan" New Delhi, I faint, when I knew that interviews already done and facul es ~ere also appointed. I asked about my interview and application status, instead of providing any information a out th~t Director AIIMS (Bhopal) badly"insulted and humiliated me and gave useless excuses, I don't know why? Wh t was my mistake? After' . that I s~bmitted the RTI application to get the information about my interview as well as :tug of application. But I am sorry to inform that still after 43 day they not send any information regarding my RTI. e to this behavior, I face ecoriomicalloss and frustrations because I was already 10 days late to join my work in US . So, I applied for 'First Appellate' after that they uploaded some information on Patna AIlMS website and also ent some an~wel' .of rny questions not all (See Attachment). An answer ofmy question clearly indicates that there 9something going wrong during AIIMS. Faculty selection. I was also surprised when I saw the "Faculty advertise ent" with correct Bank' account No. on Patna Login site (http://aiimspatna.nic.inO (See Attachment). Previo I)', there was no such

I also feel that ;Seal'ch-cum-selectlOn committee has misused his discretion power to select their own candidates. i

    Now, I am frustrated and tired and have no hope to get my right f~om concern dept. So, hnally, I am writing to you for justice and to protect my right. My humble request you to please take the strong ne4essary action to protect our country from corruption and helps all other candidates like me.     The decision for full-time CVO for AIIMS was discussed during the meeting of the Commission with Secretary, Health held on 10.9.09 (the minutes may be seen at 'X' on P.IOS/C). Para 2 of the Mlo HFW's letter dt. 8.9.2010 (P .120/C) has also mentioned about the same. The issue was also followed up by the Commission vide letters dt. 2S.12.2010 (P.l22/C), OS.2.2011(P.125/C) and 26.4.2011 (P.127/C).

    Now, vide FR (P.132/C), it has been informed that Sh. Sanjeev Chaturvedi, IFS (HR):2002 has joined as Dy. Secretary at AIIMS and has also been given charge of CVO on a part-time basis. No prior concurrence of the Commission has been taken in this regard.

    2. FR-I (p.135/C) is a letter from Sh. Sanjiv Chaturvedi, AIIMS which had been addressed to Dr. R.S. Shukla, JS & cva, M/o Health & Family Welfare (HFW) and only a copy has been endorsed to the Commission. Since, the Commission has sought some clarifications from M/o HFW vide letter of even no. dated 03.09.12 (p.134/C), we may wait till a formal reply in this regard is received from the Ministry.

    3. FR-lII (p.161/C) is a letter from Sh. Sanjiv Chaturvedi to Dr. R.S. Shukla. In view of para I above, we may wait for formal reply from the Mlo HFW.

    4. FR-IV (p.162/C) is a communication from Sh. Sanjiv Chaturvedi to the Commission regarding correction of address of cva, AIIMS. As the issue of appointment of cva has not been finalized the matter regarding correction of address is a secondary issue to be dealt with at the moment.

    5. FR-II (p.159/C) is a letter from Sh. Vineet Choudhary, Dy. Dir. (Admn.), AIIMS n addressed to the Commission. He has informed that directions received from CVC were

    placed before Director, AIIMS and he has taken a view that since the communication of the CVC is addressed to M/o HFW, no action is required to be taken by AIIMS till any instructions are given by the Ministry. He has further mentioned that Government of Haryana is contemplating disciplinary proceedings against Sh. Chaturvedi and also a criminal case is being registered against him at Jhajjar Police Station. Accordingly, we may write to ~1.M!0 Environment anQ Forest for getting detailed information from the State government in this regard.

On the suggestion of the Commission to have an independent CVO it AllMS and to delink him from procurement and administration work, a proposal for cr ation of full-lime evo at the level of DS/Director was considered by AflMS, ith the upgradation of the post of DO (Admn) from DSlDirector level to .IS level andtcreation of an additional post of DS/Director, it \Va; felt to assign the work or 'VO to DS/Director and in this process. 8hri Sanjeev C'haturvedi was appointed a' evo, AIfM8. It has also been mentioned that AIIM8 is not in the list of institution' which require mandatory approval of evc prior to appointment of CVO.
