    Short title and commencement : -

    (1) These Rules may be called the Unani, Ayurvedic and Homoeopathic System of MedicineRules, 1980.

    (2) They shall come into force at once.

    2. Definitions: - In these Rules, unless there is anything repugnant in the subject or context: -

    a) Act means the Unani Ayurvedic and Homoeopathic Practitioners Act, 1965 (II of 1965).

    b) Omitted

    c) Candidate means a registered or listed practitioner or, as the case may be, a registeredteacher of an approved or recognized institution, in respect of whom nomination paper hasbeen submitted under sub-rule (1) of Rule 21.

    d) Omitted.

    e) election means election to the Council, and includes election to fill a casual vacancy inthe membership of the Council

    f) Form means a form appended to these Rules.

    g) Ordinance means the Unani, Ayurvedic & Homoeopathic Practitioners (Amendment)Ordinance, 1978 (XXII of 1978).

    h) Polling Officer means an Officer of the Government appointed as such by the ReturningOfficer;;

    i) Register means a register of Practitioners of the Unani or Ayurvedic or HomoeopathicSystem of Medicine, or, as the case may be, the register of teachers of the approved orrecognized Institutions.

    j) Registrar means the Registrar of the Council.

    k) Returning Officer means a person appointed by the Federal Government who shallconduct the elections of the Council..

    l) Section means a Section of the Act, and

    m) Voter means a person whose name appears on the list of Voters published under Sub-Rule (5) of Rule 20.

    3. Forms of registers and list of Practitioners : -

    The registers and the list of Practitioners required to be kept and maintained by the Registrars ofthe Council shall be in the following forms, namely: -

    a) Register of qualified practitioners of the Unani System of Medicine, register of qualifiedPractitioners of the Ayurvedic System of Medicine and register of the qualifiedPractitioners of the Homoeopathic System of Medicine, in form I.

    b) Register of Practitioners of the Unani system of medicines, other than qualifiedpractitioners of that system registered as Tabibs in category B under section 25, registerof practitioners of the Ayurvedic system of medicines, other than qualified practitioners ofthat system, registered as Vaids in category B of that section, and the list ofHomoeopaths, other than qualified practitioners of the Homoeopathic system of medicine,prepared by the registrar of the National Council for Homoeopathy under section 27, as

    those sections were in force immediately before the commencement of the Ordinance xxiiof 1978 in form-II.

    4. Appl ication for Registrat ion of Pract it ioners: -

    (1) An application for Registration of Practitioners under Section 24 shall be made: -

    (a) In the case of the Unani and Ayurvedic System of Medicine, to the Registrar ofthe National Council for Tibb in Form III, and;

    (1-A) Persons who obtain degree or diploma in the Unani, Ayurvedic or Homoeopathic Systemof Medicines as a regular student from a recognized institution in the country or fromabroad, duly verified by the Embassy of Pakistan in that country may apply for registrationto the Registrar of the respective Council on prescribed from.

    (b) In case of Homoeopathic System of Medicine to the Registrar of the NationalCouncil for Homoeopathy in form-IV.

    (2) Each application shall be accompanied by a bank draft or postal order of five hundredrupees drawn in favour of the Council or, as the case may be, the Board as RegistrationFee.

    (3) The form of application shall be obtained from the office of the Council or, downloadedfrom the website of the Council.

    (4) Subject to the provisions of the Act, the registration of a practitioner under these rulesshall be valid for a period of four years from the date of issuance of registration and shallthereafter be renewable for every period of four years on the application of the practitioneraccompanied by a Bank draft or postal order of five hundred rupees drawn in favour of theCouncil or as may be notified by the Federal Ministry as renewal of registration fee inForm-IV-A. or Form IV-B.

    (5) In case of non-renewal of registration within sixty days of expiry of date of registration, theoriginal registration shall be deemed to have been cancelled and the practitioner shall beliable to action for practicing illegally.

    5. Forms of registers of Teachers.

    For the purposes of clause (c) of Section 4 and clause (c) of Section 5, the Registrar concerned shall keepand maintain the following registers in Form V, namely: -

    i) Register in respect of the teachers of all the recognized Institutions of the Unani System ofMedicine,

    ii) Register in respect of the teachers of all the recognized Institutions of Ayurvedic Systemof Medicine, and

    iii) Register in respect of the teachers of all the recognized Institutions of the HomoeopathicSystem of Medicine.

    6. Registers to be signed by Regist rar: -

    The name of all Practitioners and Teachers in a register or list shall be in serial order, and each page of theregister of list shall be signed, and each addition too or alteration or correction in, an entry therein shall beinitialed by the Registrar.

    7. Fee for change of entries in a register of list: -

    Any registered or listed Practitioner who desires to have an addition made to an entry relating to him in aregister or list of Practitioners, or to have any change or correction made in such entry, shall pay a fee of100 rupees. Provided that no fee shall be charged for correcting typographical error.

    8. Certificate of Registration: -

    (1) Every Practitioner whose name is entered in a register of list shall be entitled to receive acertificate of registration from the Registrar, and such certificate of registration shall setforth the name qualifications, of the registered practitioner in full, his fathers name,number of the registration, address, date of registration and the provisions of the Actunder which he is registered.

    (2) Where a registered or listed practitioner has lost the original certificate of registration, hemay obtain a duplicate certificate of registration from the Registrar on payment of twohundred rupees.

    (3) The Registrar shall issue the registration, renewal or duplicate of registration to theapplicant within 30 days of receipt of application through registered post.

    9. Fee for recognition of Teaching Institutions:-(1) An application for the recognition of an institution imparting or desiring to impart

    instructions in the Unani, Ayurvedic or Homoeopathic System of Medicine shall beaccompanied by a non-refundable initial fee of twenty five thousand rupees.

    (2) On receipt of an application under sub-rule (1) the Council, shall, within three months,inspect or cause to be inspected the building of the institution to verify that it meets the

    laid down requirements and submit a report with its recommendations to the FederalGovernment for further action.

    (3) If the Federal Government deems it fit to grant recognition to an institution under section17 of the Act or this rule, it shall direct the applicant to further deposit a fee of rupees onelac within such period as may be prescribed.

    9-A. Registration of teaching institutions for Bachelor of Eastern Medicines and Bachelor ofHomoeopathic System.

    (1) An application for registration of teaching institution for Bachelor of Eastern Medicines andBachelor of Homoeopathic System Medicine shall be accompanied by a non-refundableinitial fee of fifty thousand rupees.

    (2) On receipt of an application under sub-rule (1) the Council, shall, within three months,

    inspect or cause to be inspected the building of the institution to verify that it meets thelaid down requirements and submit a report with its recommendations to the FederalGovernment.

    (3) If the Federal Government deems it fit to grant recognition to an institution, it shall directthe applicant to further deposit a fee of two lac rupees within such period as may beprescribed.

    10. Students to be enrolled with the Council

    The principal of every recognized institution shall send to the Council, within a period of ninety days from thedate of the beginning of the academic session of his institution along with a fee of fifty rupees in form of payorder or bank draft payable to Registrar of the respective Council for each student for enrolment with thatCouncil, and where the name of a student is sent within thirty days after the expiry of that period along withadditional fee of fifty rupees as late fee charges: Provided that the maximum age-limit for a student seekingadmission in the first year class of Fazil-Tibb-Wal-Jarhat and Diploma in Homoeopathic System of Medicineshall be forty five years.

    11. Term of office of member of Examining Body: - A member appointed to an Examining Body

    under sub-section (3) of Section 22 shall hold office for a period of five years.

    12. Examination Fees, etc: -The fees for annual/ Supplementary examination to be held under the provisions of the Act, and other

    charges relating there to, shall be as follows, namely :-

    (i) Fee for 1st

    & 2nd

    years examination : Rs.300(ii) Fee for the 3

    rd& 4

    thyears examination : Rs.350

    (iii) Fee for practical examination : Rs.100per student, per practical examination.

    (iv) Late fee:-(a) if the fee for an examination is not paid before the date fixed but paid within ten days

    after the date: Rs.200.

    (b) if the fee for an examination is not paid within ten days after the date fixed but paidafter ten days and up to fifteen days before the commencement of the examination,the rates of fees including late fees shall be as under:-

    (a) fee for the 1st

    & 2nd

    year : Rs.450/- (b) fee for the 3

    (v) Fee for supplementary examination(two subjects) : Rs.300/-

    (vi) Fee for diploma examination : Rs.500/-(vii) fee for mark sheet or duplicate mark sheet : Rs.50/-(viii) Fee for scrutiny or re-totalingof answer script : Rs.100/-(ix) Charges for examination andregistration forms : Rs.10/-

    (x) Fee for change of examination centre : Rs.500/-

    (xi) Migration fee : : Rs.300/-(xii) Charges for examination gazette : Rs.2500/-(xiii) Fee for urgent mark sheet

    (within seven days) : Rs.100/-

    12- A. Tution Fees etc: -

    The tuition fees in recognized Tibbia / Homoeopathic /Ayurvedic colleges shall be as follows, namely:-(i) Fee for the 1

    st& 2

    ndyear student : Rs.300 per month

    (ii) Fee for 3rd

    and 4th

    year student : Rs.400 per month

    12-B. Rates of Daily Allowances and Hotel charges :-

    The examination staff shall be entitled to daily allowance and hotel charges at the following rates, namely:-(a) Superintendent of Examination Centers:

    (i) Daily allowance at fixed rate of Rs.300 per day.

    (ii) Hotel charges (without food and other charges) actual charges subject to amaximum of Rs.900/- per day for big cities and Rs.450 for other cities.

    (b) Deputy Superintendents of Examination Centers:

    (i) Daily allowance at fixed rate of Rs.200 per day.

    (ii) Hotel charges (without food and other charges) actual charges subject to amaximum of Rs.600 per day for big cities and Rs.300 for otherstation/cities.

    (c) Invigilator of Examination Centers:

    (i) Daily allowance at fixed rate of Rs.150 per day.

    (ii) Hotel charges (without food and other charges) Rs.450 per day for big citiesand Rs.225 for other cities per day in case the Invigilator is appointed fromother city; and

    (d) Other staff (water carriers, sweepers and Naib Qasids):

    Daily allowance at the rate of Rs.125 per day.

    13. The funds of the Council shall consist of: -

    (i) Grants by the Federal Government;(ii) Examination and other fees;(iii) Proceeds from sale of list and forms;(iv) Registration fees;(v) Donations;(vi) Registration card; and(vii) Sale of publications (book & Journals);

    (viii) Proceeds from any other project initiated by the Council after approvalby the Federal Government;

    14. Expenditure by the Counci l/Board : -

    (1) All moneys in the funds shall be used for the following purposes, namely: -

    (i) Pay and allowance of officers and servants of the Council;

    (ii) Traveling allowances and daily allowances of the President, VicePresident and members of the Council;

    (iii) Hiring, purchasing and construction of office and residential buildings; (iv) Expenditure on holding meetings, examinations and tests; (v) Contingent expenditure; (v-a) Expenditure on holding of election of the respective Councils; (vi) Expenditure connected with research, including Laboratories, Libraries

    and Museums, and(vii) Such other expenditure as the Council may, with the approval of the

    Federal Government determine.

    (2) In incurring expenditure, the Council shall abide by all financial Rules and instructions of theFederal Government in so far as they are not inconsistent with the Act or these Rules.

    15. Term of office of members: -

    The term of office of the members of the Council shall be five years, and the term of office of a memberelected or nominated to a casual vacancy caused by the resignation, death or otherwise of a member shallbe the remaining period of the term of the member in whose vacancy he was elected or nominated.

    16. Mode of election: -

    Elections to the Council shall be held: -

    a) In the case of clause (b) of section 4 and clause (b) of section 5 by direct ballot and onprovincial basis;

    b) In the case of clause (c) of section 4 and clause (c) of section 5, by ballot and on allPakistan basis; and

    c) In the case of clause (d) of section 4 by ballot and on all Pakistan basis.

    17. Electoral Colleges: -For the purpose of elections to the Council the electoral Colleges shall be: -

    a) In the case of clause (b) of Section 4, all registered Practitioners of the Unani System ofMedicine of each Province,

    b) In the case of election under clause (c) of Section 4, Teachers of all recognizedInstitutions of the Unani or Ayurvedic System of Medicine of all the Provinces providedtheir names appear on the register of teachers maintained by the Council.

    c) In the case of clause (d) of Section 4, all registered Practitioners of the Ayurvedic Systemof Medicine of all the Provinces;

    d) In the case of clause (b) of Section 5, all registered and listed Practitioners of theHomoeopathic System of Medicine of each Province; and

    e) In the case of clause (c) of section 5, teachers of all recognized institutions ofHomoeopathic system of medicines of all the Provinces provided their names appear onthe register maintained by the National Council for Homoeopathy, maximum 15 teachersshall be entitled per sixty seats of the College.

    18. Federal Government to notify dates of election : -

    Whenever an election to the Council is to be held under section 4 or section 5, the Federal Governmentshall, by notification in the official Gazette, specify a date, which shall not be less than three monthspreceding the date on which the term of the members of the Council is due to expire, on which such electionshall be held and may appoint a Returning Officer for holding such election.

    19. Returning Officer to notif y dates for submission, scrutiny etc of nomination papers: -

    (1) As soon as may be after the date of election has been notified under Rule 18, theReturning Officer shall, by public notice, appoint in respect of the Province or theProvinces, as the case may be: -

    a) The last date (which shall be a date not earlier than fifteen days after the publication of thedate of election) for submission of nomination papers.

    b) The date (which shall be a date not later than the third day after the date for submission ofnomination papers) on which the nomination papers shall be scrutinized;

    c) The last date by which a nomination may be withdrawn; and

    d) In the case of election by postal ballot, the last date by which ballot papers shall reach theReturning Officer.

    (2) The public notices shall state the time and place for receiving nomination papers and for holdingscrutiny of such papers.

    20. List of Voters: -

    (1) As soon as may be after the publication of the Notification under Rule 18, the Returning

    Officer shall cause a preliminary list of voters to be prepared in accordance with therelevant registers or as the case may be, the list maintained by the respective Council .

    (2) District wise list of voters, shall be available on the website of the Council, and shall bedisplayed at the office of the Council and at conspicuous places in all ProvincialHeadquarters of the Health Departments, together with a notice specifying the date forinviting claims and objections with respect to that list.

    (3) Any person claiming to have his name entered in the list of voters or objecting to any entrytherein may prefer before the Returning Officer at his office on or before the time and datespecified therefor written claim or objection duly signed by him.

    (4) The Returning Officer shall decide the claim or objection and if he is satisfied of thecorrectness of the claim or objection, shall amend or correct the list of voters accordingly,and the decision of the Returning Officer shall be final.

    (5) The final list of voters shall be published and displayed in the same manner as is providedin sub-rule (2).

    (6) The final list of voters may be inspected by any person at such time and place as theReturning Officer may specify.

    (7) Copies of the list of voters may be obtained from the Returning Officer: -

    a) In the case of practitioners of the Unani or Homoeopathic System of Medicine, onpayment of fifteen hundred rupees per copy, and

    b) In the case of practitioners of the Ayurvedic System of Medicine, or registeredteachers, on payment of hundred rupees per copy.

    21. Submission and scrutiny of nomination papers: -

    (1) A voter who desires to contest election shall deliver to the Returning Officer on or beforethe date appointed under clause (a) of Rule 19 a nomination paper in form VI signed byhim and by two other voters as proposer and seconder, and shall also deposit with theReturning Officer a sum of ten thousand rupees non-refundable as security money, but

    security money shall be refundable if the candidate with-draws his candidature asprovided in Rule 23.

    (2) The Returning Officer shall scrutinize all nomination papers along-with any objectionsreceived by him on the date appointed for scrutiny, and shall, if found correct, declare thenomination valid, and where the Returning Officer thinks that a nomination paper suffersfrom any defect, he may, after such summary enquiry as he thinks fit, reject thenomination paper recording his reasons thereof:-

    Provided that no nomination paper shall be rejected only on the ground of technical defector error not of substantial character which may be allowed to be corrected.

    (3) It shall be open to a candidate to inspect the nomination papers of other candidates.

    (4) A candidate whose nomination paper is rejected may appeal to the Federal Government

    against such rejection, and the Federal Government shall decide the appeal within sevendays from the date the appeal is made.

    22. Display of list of valid nomination:-

    The Returning Officer shall cause a copy of the list of all candidates whose nominations have beendeclared valid to be displayed at the office of the Council and on the website of the Council.

    23. Withdrawal by candidate: -

    Any validly nominated candidate may withdraw his candidature by a written and signed noticedelivered to the Returning Officer before 3 p.m. on the date appointed for withdrawal.

    24. Declaration of unopposed candidates as elected :-

    Where, after scrutiny under Rule 21, the number of validly nominated candidates does not exceedthe number of seats for which election is being held the Returning Officer shall be public noticedeclare such candidates to be elected and inform the Federal Government of the names of suchmembers.

    25. Omitted.26. Voting by ballot: -

    (1) Election shall be held by ballot and the Returning Officer shall appoint Polling Officer inthe Districts from amongst the Government Officers not below BS-17. Poling shall startat 8.00AM and finish at 5.00PM.

    (2) A voter shall cast vote in the District mentioned as address in his / her registration/renewal certificate.

    (3) A voter shall bring the original computerized National Identity Card and original certificateof valid registration/renewal with him and may record and cast his vote in the mannerspecified in sub rule (1) of rule 27.

    (4) Any ballot-paper received by the Returning Officer after the time fixed for the receipt ofballot-paper shall be rejected.

    26-A Procedure for Government servant interested to cast vote through postal ballot.

    Postal ballot shall be allowed to a Government servant who is on duty away from the District in which he isregistered or enlisted as voter. Voter shall send an application to Returning Officer before thirty days ofelection along with attested copy of computerized National Identity Card and valid registration/ renewalintimate his District and serial number at the voter list.

    32-A Criteria for nomination of the Member by theFederal Government :-

    A person shall be eligible for nomination of member if he is registered under the Unani, Ayurvedicand Homoeopathic Practitioners Act, 1965.

    33. Election of President and Vice President: -

    As soon as may be after the Federal Government has notified the names of the elected and nominatedmembers, the Registrar shall summon a meeting of the Council to elect a President and Vice President fromamongst themselves and shall communicate the names of the President and the Vice President so electedto the Federal Government.

    34. Repeal: - The Unani, Ayurvedic and Homoeopathic System of Medicine Rules, 1965, are herebyrepealed.
