Whereas, the Hon’ble High Court at Jammu in the Clubbed WritPetitions No. 44/2009, titled Chiranjeev Razdan and Others Vs. State andothers, vide its order dated 8.04.2010, and in another Clubbed Writ PetitionsSWP No. 1350/2006 titled Parvez Ahmad Kirmani and Ors. Vs. State andOthers at Srinagar, vide judgment dated 29.04.2011, has directed the staterespondents to place the matter before the DPC/PSC for regularization ofofficers in accordance with the rules ; and

Whereas, in pursuance of the above directions of the Hon’ble HighCourt, an exercise has already been undertaken by placing the matter ofregularization of Non-Gazetted officials for their regularization in Class VII(First Gazetted Entry Level Post), consequent upon which GovernmentOrder No. 113-Agri of 2013 dated 19.03.2013 has been issued. Pursuant tothe said Government Order, the officers have been regularized in Class VIIin accordance with SRO-179 of 1988 dated 02.06.1988 which, for the firsttime provided that 50% posts in Class-VII shall be filled by promotion fromthe subordinate services ; and

Whereas, as a further sequel to the implementation of the aboveclubbed judgments and other related judgments on the subject and with aview to updating the seniority of the Gazetted members of AgricultureExtension Officers of J&K Agriculture (Gazetted) Service, appointedw. e. f. 16.12.1972 to 21.04.1984, a tentative seniority list of AgricultureExtension Officers (AEOs) and Equi.valent in the Agriculture ProductionDepartment, was published vide circular issued under endorsementNo. Agri/E-08(i) 2010-V dated 25.04.2013 ; and

Whereas, 420 officers, notified vide the aforesaid circular dated25.04.2013, have been appointed prior to the commencement and as perRecruitment Rules of 1978 notified vide SRO-134 dated 02.03.1978. Videthis SRO, 100% posts, at the first entry Gazetted level, were to be filledthrough direct recruitment on the recommendations of the PSC only.The provision of appointment by promotion at the entry Gazetted level(Class VII), to the extent of 50% was, however, introduced vide SRO-179of 1988 dated 02.06.1988 and, therefore, any question of fixation of inter-se-seniority between the direct recruits and the promotees would arise onlyafter the commencement of the Recruitment Rules of 1988. The tentativeseniority list, as notified was, therefore, up to 21.04.1984, issued in respectof direct recruits appointed on the recommendations of the Public ServiceCommission, made from time to time/those appointed prior to thecommencement of 1978 Rules and is to be read with Government OrderNo. 12-Agri of 2003 dated 17.01.2003 vide which the seniority of suchofficers already stood notified ; and

Whereas , objection(s), if any, on the said seniority list were invited,to be submitted in writing within a period of four weeks from the date ofissuance of this circular before the respective Directors or AdministrativeDepartment ; and

Whereas, a Committee of Officers was constituted vide GovernmentOrder No. 144-Agri of 2013 dated 05.04.2013 read with Government OrderNo. 248-Agri of 2015 dated 26.08.2015 to examine the representationsreceived and make recommendations ; and

Whereas, the representations so received, were examined by theCommittee of Officers on the basis of inputs received from the Directors/SKUAST, Jammu/Kashmir/relevant available records, the material, if any,provided by the representing officers in support of their claims and response,if any, received to the Public Notice dated 10.08.2015 issued by thedepartment seeking details etc. about a group of officers and the followingissues came up for consideration :––

(i) Following four officers claimed that they were appointed asinitial constituents vide Government Order No. 12-Agri of 2003dated 17.01.2003 read with Government Order No. 285-Agriof 2003 dated 14.10.2003 in Class-VI, based on which theywere subsequently promoted to Class-V vide GovernmentOrder No. 359-Agri of 2005 dated 07.12.2005 on therecommendations of the DPC/PSC and as such, their namesneed to be deleted from the tentative seniority list of 2013 :––

(ii) Some representations were received from the officers forinclusion of their names in the seniority list, being the membersof the service at the relevant point of time ;

Some officers had expired/left the department etc. during thesaid period and, therefore, their names/cases need to beretained in the seniority list up to the date they were membersof the service/need to be deleted ;

(iii) Some representations were received from some Non-GazettedOfficers for inclusion of their names in the seniority list on thebasis of release of grade in their favour earlier in Class-VII,without being confirmed by the DPC/PSC ;

(iv) Some errors with regard to inter-se-seniority of the officerswere noted from the records ;

(v) Some representations were received with regard to thecorrection in date of birth/name/passing of the PG Degreeetc. ;

(vi) Some representations were received regarding making entriesof the category certificates against their names.

Whereas, after examination of these issues on the basis of therecommendations made by the aforesaid Committee and after dueconsideration, it has been decided as under :––

i. The four officers mentioned in sub-para (a) were actuallyappointed as direct recruits prior to the commencement of theRecruitment Rules, 1988 and under the repealed rules of 1978.They were declared initial members of the service inpursuance of Rule 3(2) of 1988 Rules vide Government OrderNo. 12-Agri of 2003 dated 17.01.2003 read with GovernmentOrder No. 285-Agri of 2003 dated 14.10.2003. Subsequently,they along with others, were promoted to Class-V, videGovernment Order No. 359 of 2005 dated 07.12.2005 on the


recommendations of the DPC/PSC. The names of these fourofficers alone had figured, inadvertently, in the tentativeseniority list notified under endorsement No. Agri/E-08(i)2010-V dated 25.04.2013 and, therefore, need to be deletedfrom the list so notified ;

ii. In respect of the cases of such officers who figured in theseniority list of 2002/2003 in the relevant Class notified videGovernment Order No. 10-Agri of 2002 dated 25.10.2002 readwith the Government Order No. 12-Agri of 2003 dated17.02.2003 but were not figuring in the tentative seniority listmentioned hereinabove, it has been observed that some officershad expired during the intervening period and some had leftthe department and joined other services/departments. In somecases, the details could not be ascertained and, therefore, aview in such cases could not be formulated. However, suchofficers who were members of the service at the relevantpoint of time and is borne out from the records also, are to beincluded in the seniority list at appropriate places ;

It has also been observed that a final decision with regard tothe deletion of the names from the seniority list of such officerswho have left the service/whose whereabouts are not knownbe taken separately after further ascertaining the factualposition. However, necessary entries as such be recordedagainst their names for better appreciation ;

iii. The issue with regard to inclusion of a person, not a memberof the Gazette service at any point of time, in the seniority listhas been considered in accordance with Rule 24 of the Jammuand Kashmir (Classification, Control and Appeal) Rules, 1956and also in light of various judgments of the Hon’ble Courtson the subject, which provide that only substantive membersof the service i. e. those who have been appointed on therecommendations of the Public Service Commission or clearedby the DPC/PSC in accordance with the rules, as the case


may be, are to be included in the seniority list, and no other

person can be considered as a member of the service. This

has also been settled by the Hon’ble High Court in many cases

including those filed by various officers of the Agriculture

Production Department from time to time. The claim of any

Non-Gazetted Officer for inclusion of his name in the seniority

list can only be considered from the date of his substantive

appointment in Class-VII on the recommendations of the PSC/

DPC. Therefore, the claim of any Non-Gazetted Officer for

inclusion of his name in the seniority list of Gazetted Officers,

being void of any merit, has to be rejected, moreso when the

list only includes those who were appointed prior to 02.06.1988

whereas the promotion quota was introduced for the first time

vide SRO-179 of 1988 dated 02.06.1988 ;

iv. Wherever, the typographical errors have been noticed in the

inter-se-seniority, those need to be corrected in accordance

with the rules/the records ;

v. The date of birth recorded in the seniority list is not considered

for purposes of retirement etc. which is subject to such entries

recorded in the service book as per the rules. Further, the

claim regarding corrections in the date of acquiring higher

qualification, if any, be made in accordance with the records

available. Further corrections in the names, if any, be also

made ;

vi. A note should be taken of the candidates belonging to Reserved

Categories which shall be considered only from the dates these

certificates were issued in favour of such candidates or from

the date, reservation was provided to such categories in

accordance with the Reservation Rules whichever be later.

Revalidation of the certificates wherever, rEqui.red would also

be necessary at the relevant time of consideration.


Now, therefore, having considered the matter in accordance withthe above decisions and after updating the records accordingly :––

(a) The final and updated seniority list of the AEOs and Equi.valent,appointed between 16.12.1972 to 21.04.1984 (as it stoodon 21.04.1984), on the recommendations of the PSC as directrecruits in accordance with SRO-134 of 1978 dated 02.03.1978/the other earlier rules on the subject is hereby notified asAnnexure to this Government Order for information of themembers of the service ;

(b) The date(s) of birth recorded in the seniority list shall not beconsidered for purposes of retirement of officers etc. but shallbe based on the actual records/entries made in the servicerecords in accordance with the rules.

The above final seniority shall be subject to the outcome of the writpetitions, relating to the subject, pending, if any, before any CompetentCourt of Law.

Whereas, the Hon’ble High Court at Jammu in the Clubbed WritPetitions No. 44/2009, titled Chiranjeev Razdan and Others Vs. State and

Others, vide its order dated 8.04.2010, and in another Clubbed Writ

Petitions SWP No. 1350/2006 titled Parvez Ahmad Kirmani and Ors. Vs

State and Others at Srinagar, vide judgment dated 29.04.2011, has directed

the state respondents to place the matter before the DPC/PSC for

regularization of officers in accordance with the rules ; and

Whereas, the updated seniority of the Agriculture Extension Officers

(AEOs) and equivalent, appointed, prior to the commencement of the Rules

of 1988 (SRO-179 of 1988 dated 02.06.1988), as direct recruits through the

PSC, in accordance with the rules governing the field, at the relevant point

of time, has been notified vide Government Order No. 277-Agri. of 2015

dated 11.09.2015 ; and

Whereas, in pursuance of the above directions of the Hon’ble High

Court, an exercise has already been undertaken by placing the proposal

of Non-Gazetted Officials for their regularization in Class-VII

(First Gazetted Entry Level Post) before the DPC/PSC, consequent upon

whose recommendations, Government Order No. 113-Agri. of 2013

dated 19.03.2013 has been issued, vide which 67 officers have been

regularized in Class-VII in accordance with SRO-179 of 1988

dated 02.06.1988 which, for the first time, provided that 50% posts in

Class-VII shall be filled by promotion from the subordinate services. Cases

of some officers were deferred by the DPC/PSC for want of requisite

documents ; and

Whereas, a tentative seniority list of the members appointed, directly

or by promotion, after the commencement of the Recruitment Rules

of 1988 (those appointed w. e. f. 13.06.1988 up to 18.10.1988) was notified

vide Circular No. Agri/E-03(1)/2010-V dated 21.06.2013 ; and

Whereas, objections, if any, on the said seniority list were invited, to

be submitted in writing within a period of four weeks from the date of

issuance of this circular before the respective Directors or Administrative

Department along with the material/documentary evidence in support of

their claim, if any ; and


Whereas, a Committee of officers was constituted vide Government

Order No. 144-Agri. of 2013 dated 05.04.2013 read with Government Order

No. 248-Agri. of 2015 dated 26.08.2015 to examine the representations

received and make recommendations ; and

Whereas, the seniority could not be finalized in view of certain

directions dated 29.06.2013 from the Hon’ble High Court in a case titled

P. S. Mastana Vs. State and Ors. (SWP No. 1359/2013) ; and

Whereas, in consultation with the Law Department, it was observed

that the above matter had come up before the Hon’ble High Court

on various occasions but no extension in the interim directions

dated 29.06.2013 were granted and also that the seniority can be finalized

subject to the outcome of the writ petitions pending, if any ; and

Whereas, with a view to finalizing the seniority of the members

appointed to the service in Class-VII w. e. f. 13.06.1988 to 18.10.1988, the

representations received in response to the tentative seniority list notified

dated 21.06.2013 were examined by the committee so constituted and

following points emerged for determination :––

(i) The manner in which the inter-se-seniority between the direct

recruits and the promotees has to be determined ;

(ii) Whether the ReZ service rendered by the officers can be

claimed for purposes of seniority ;

(iii) Some representations were received from officers appointed

as direct recruits after 1988 for inclusion of their names as

direct recruits in the seniority list ;

(iv) Claim of some officers for being reflected in the seniority list

on the basis of position acquired by them under Government

Order No. 279-Agri. of 2008 and also determining the position

on the basis of present position held by them ;


(v) Corrections in the names/date of birth/date of qualification/

typographical errors in inter-se-seniority, if any ;

(vi) making entries of the category certificates against the names.

Whereas, these issues were examined in detail and on the basis of

the recommendations made by the aforesaid committee and after due

consideration, it has been decided as under :––

(i) The inter-se-seniority of the direct recruits, the promotees and

as between the direct recruits and the promotees, has to be

fixed strictly in accordance with Rule 24 of the Jammu and

Kashmir Civil Services (Classification, Control and Appeal)

Rules, 1956 alone ;

(ii) The issue regarding counting of the service of the ReZs,

appointed, on consolidated basis has been settled by the

Hon’ble Supreme Court in the case titled Ravinder Kumar

Kapoor Vs. State of J&K in the SLP No. 9702/2012 vide

its order dated 02.04.2012 in which it has been held as

under :––

“In our view the reasons assigned by the Ld. Judge and Division

Bench of the High Court for taking the view that the petitioners

are not entitled to have their seniority fixed in the cadre of

Village Extension Workers from the date of their initial

engagement as Rehar-e-Zirat on fixed emoluments of

Rs. 400/- per month do not suffer from any legal infirmity and

the judgment under challenge does not call for interference

under Article 136 of the Constitution.

The Special Leave Petition is accordingly dismissed.”

The claim of such persons as members of service at the timeof initial constitution w. e. f. 02.06.1988 has thus been settled


once for all by the Apex Court by dismissingthe SLP ;

(iii) Since the seniority list is being issued only after 18.10.1988,therefore, the claim of the direct recruits appointed after18.10.1988 can be considered only at appropriate time, asit does not include name of any officer appointed after18.10.1988. The seniority of those appointed in the subsequent,years either by direct recruitment or by promotion, within theavailable quota and in accordance with the rule on the subject,be notified separately ;

(iv) Government Order No. 279-Agri. of 2008 has been keptsubject to the outcome of DPC/PSC by the Hon’ble High Courtin various writ petitions. Further the Hon’ble High Court inthe case titled “Qasim Ganai Vs. State and Ors.” in SWPNo. 184/2005, vide its judgment dated 19.02.2007 had quashedtwo impugned Government Order Nos. 31-Agri. of 2005 and38-Agri. of 2005 as these were not in accordance with ruleand has directed to reconsider the matter and re-fix theseniority of petitioner and private respondents in accordancewith rules and observations made by Hon’ble High Court. Thetentative seniority list, notified in 2008 vide endorsementNo. Agr/E-8/2008 dated 19.08.2008 read with Notice dated21.08.2008, which formed the basis for issuance ofGovernment Order No. 279 of 2008, was not based on rules.The Hon’ble High Court, subsequently, in various writ petitionshad directed to place the matter before the DPC/PSC forregularization of officers in accordance with rules and all thesepetitions were found by Hon’ble High Court to be coveredunder Mohd Qasim Ganai’s case supra ; and

67 VEWs, for the first time, were regularized w. e. f.18.10.1988 by the DPC/PSC, consequent upon whichGovernment Order No. 113-Agri. of 2013 dated 19.03.2013was issued and subsequently a tentative seniority list of those


appointed directly and by promotion, after the commencementof Recruitment Rules of 1988 was notified in accordance withRule 24 of the J&K Civil Services (Classification, Controland Appeal) Rules, 1956.

A final seniority list of the members appointed as directrecruits, prior to the commencement of Rules of 1988, hasalready been notified vide Government Order No. 277-Agri.of 2015 dated 11.09.2015. Therefore, any further promotionof the officers from Class-VII to Class-VI and beyond, willexclusively, depend upon the overall position assigned to themin seniority in Class-VII and also such other conditions asprovided in the recruitment rules. Since the representingofficers were placed in Class-VII and subsequently inClass-VI and even in Class-V earlier, without clearance fromDPC/PSC, therefore, any officer who has not been clearedby the DPC/PSC in Class-VII so far cannot claim seniorityin Class-VII, Class-VI or Class-V to which he has not beenappointed in accordance with rules and as such is not a memberof the Gazetted service.

The claim of such officers shall, however, depend onlyupon their date of regularization first in Class-VII on therecommendations of the DPC/PSC and thereafter on theirinter-se-seniority position as may be assigned and notifiedsubject to their eligibility and availability of posts in higherclasses at relevant point of time. Further, once seniority inClass-VII, as notified vide Government Order No. 31 readwith Government Order No. 38 of 2005, was quashed byHon’ble High Court in “Qasim Ganai’s case”, all consequentialbenefits arising out of the position assigned on the basis ofsuch a seniority in higher classes automatically gets reversedand the future course of action has to be determined inaccordance with the directions of Hon’ble High Court asreferred to above. Besides, none of the Juniors of the


representing officers has been regularized by the DPC/PSCso far in Class-VII and, therefore, any position held by therepresenting officers on the basis of earlier arrangements hasalso to be viewed vis-à-vis the position assigned to their juniorswhich shall be in true spirit of the directions of the Hon’bleHigh Court.

Viewed as above, such representations do not have anymerit and are to be disposed off accordingly. However, theDPC/PSC has withheld the regularization of some officersfor want of certain documents and their position in the seniorityshall depend upon the decision taken by the DPC/PSC andshall be determined accordingly ;

(v) The date of birth recorded in the seniority list is not consideredfor purpose of retirement etc. and is subject to such entriesrecorded in the service book as per the rules. Further, theclaim regarding corrections in the date of acquiring higherqualification, if any, be made in accordance with the recordsavailable. Wherever the typographical errors have been noticedin the inter-se-seniority, those need to be corrected inaccordance with the rules/the records ;

(vi) A note should be taken of the candidates belonging to ReservedCategories which shall be considered only from the dates thesecertificates were issued in favour of such candidates or fromthe date, reservation was provided to such categories inaccordance with the Reservation Rules whichever be later.Revalidation of the certificates wherever required would alsobe necessary at the time of consideration.

Now, therefore, having examined the matter in totality and afterdue consideration and taking note of the above, the final seniority list of themembers of Jammu and Kashmir Agriculture (Gazetted) Service appointedin Class-VII w. e. f. 13.06.1988 to 18.10.1988, is hereby notified asAnnexure to this Government Order. Any officer aggrieved with his position


in this Government order, may file a review petition against theseniority, so assigned to him, if he so chooses, within a period of 15 daysfrom the date of issuance of this order, before the competent authority,which shall be disposed of in accordance with the rules.

The position in the seniority of such officers whose cases have beendeferred by the DPC/PSC, shall be determined after a final decision in thisregard is taken by the DPC/PSC and shall be based on the inter-se-positionassigned to them in the select list which shall be notified accordingly.

The instant seniority list notified shall be in continuation of GovernmentOrder No. 277-Agri. of 2015 dated 11.09.2015 vide which seniority of theJammu and Kashmir Agriculture (Gazetted) Service appointed prior to thecommencement of 1988 rules, has been notified.

The date of birth recorded in the seniority list shall not be consideredfor purposes of retirement of officers etc. but shall be based on the actualrecords/entries made in the service records in accordance with the rules.

This also issues without prejudice to the outcome of the writ petition(s)pending, if any, before any competent court(s) of law and shall be subjectto the outcome of such petition(s).
