SRO 28 ,- Whereas, on 30.09.2010, a docket wasreceived at Police Post Ramsoo to the effect that on the samedate, during search operation in general area of Bari Dhok, oneperson namely Mohammad Amin S/o Sadiq Gujjar RIo Sumber,Tehsil & District Ramban, an OGW of HM outfit, who instigatedthe youth of the area to join the militancy besides being a closeassociate of Qari Zubir, District Commander of HM outfit andterrorist Naseer Ahmed, was apprehended; and

Whereas, in this connection, Case FIR No. 179/2010 undersections 13/18-B/40 of the Unlawful Activities(Prevention) Act,1967 was registered in Police Station Banihal and investigationinitiated; and

Whereas, during the course of investigation , on the basisof statement of witnesses and other evidence, the InvestigatingOfficer established a prima-facie case against the accusedperson under sections 13,18-B, and 40 of the Unlawful Activities(Prevention) Act, 1967; and

Whereas, the Authority appointed by the State Governmentunder sub-section (2) of section 45 of the Unlawful Activities(Prevention) Act, 1967 has independently scrutinized the CaseDiary file and all the other relevant documents relating to thecase and has come to a definite conclusion that this is a fit casefor accord of prosecution sanction against the accused person;and

Whereas, after perusing the Case Diary, the relevantdocuments and also taking into consideration theobservations/views of the Authority appointed under sub-section(2) of section 45 of the Unlawful Activities (prevention) Act, 1967,the State Government is of the view that there is sufficientmaterial and 'evidence available against the accused for hisprosecution under the aforesaid provisions of law; and

~. /.- Now, therefore, in exercise of powers conferred by sub-section (1) of section 45 of the Unlawful Activities (Prevention)Act, 1967 the State Government hereby accords sanction forlaunching prosecution against the accused person namelyMohammad Amin S/o Sadiq Gujjar RIo Sumber Tehsil & DistrictRamban for the offences punishable under sections 13, 18-8 and40 of the Unlawful Activities (Prevention) Act, 1967 arising out ofFIR No. 179/2000 of Police Station 8anihal.
