G.S.R. 26.—In exercise of the powers con-ferred by the proviso to Article 309 of the Consti-tution, the President hereby makes the followingrules regulating the method of recruitment to thepost of Hindi Typist in the National Civil DefenceCollege, Nagpur, namely :—

]. Short title and commencement.—(1) Theserules may be called the National Civil DefenceCollege, Nagpur, Hindi Typist Recruitment Rules,1996.

(2) They shall come into force on the date oftheir publication in the Official Gazette.

2. Number of posts, classification and scale ofpay.—The number of the said post, its classifica-tion and the scale of pay attached thereto shall beas specified n columns 2 to 4 of the Scheduleannexed to these rules.

3. Method of recruitment, age limit, qualifica-tions etc.—The method of recruitment, age limit,qualifications and other matters relating theretoshall be as specified in columns 5 to 14 of the saidSchedule.

4.Disqualiftcations.—No person;

(a) who has entered into or contracted amarriage with a person having a spouseliving; or

(b) who having a spouse living has enteredinto of contracted a marriage with anyperson,

shall be eligible for appointment to the said post:

Provided that the Central Government may ifsatisfied that such marriage is permissible underthe personal law applicable to such person and theother party to the marriage and that there are

other grounds for so doing, exempt such personfrom operation of this rule.

5. Power to relax.—Where the Central Govern-ment is of the opinion that it is necessary or ex-pedient so to do, it may, by order, for reasons tobe recorded in writing, relax any of the provisionsof these, rules with respect to any class or categoryof persons.

6. Saving.—Nothing in these rules shall affectreservations relaxation of age-limit and other con-cessions required to be provided for the ScheduledCastes, the Scheduled Tribes, Ex Servicemen andother special categories of persons in accordancewith orders issued by the Central Governmentfrom time to time in this regard.

G.S.R. 31.—In exercise of the powers conferred by Section67, read with Section 8 of the Monopolies and RestrictiveTrade Practices Act, 1969 (54 of 1069), and in supersessionof the Monopolies and Restrictive Trade Practices Commission(Recruitment of Members of Staff) Rules, 1974, in No Taras they relate to the posts of Secretary, Deputy Secretary.Director (Research), Joint Director (Economics), Joint Direc-tor (Legal), Deputy Director (Economics), Deputy Director(Accounts), Deputy Director (Legal), Assistant Director (Eco-nomics), Assistant Directory (Statistics) Administrative Officer,Court Master and Librarian except as respects things doneor omitted to be done before such supersession, the CentralGovernment in consultation with the Commission herebymakes the following rules to regulate the method of recruit-ment to Group 'A' and Group 'B' posts in the Monopoliesand Restrictive Trad'e Practice Commission, namely:

J. Short title and commencement.—(1) These1 rules may becalled the Monopolies and Restrictive Trade Practices Com-mission (Group 'A1 and Group 'B' posts) Recruitment Rules,1997.

(2) They shall come into force on the d:ite of their pub-lication in the Official Gazette.

2. Application,—These rules shall apply to the costs speci-fied in column 1 of the Schedule annexed to these rules.

3. Number of posts, classification and scale of pay.—Thenumber of posts, their classification and the scale of payattached thereto shall be as specified in columns 2 to 4 ofthe said Schedule.

4. Method of recruitment,, age limit, qualification, ete.—The method of recruitment, age limit, qualifications and othermatters relating to the said posts shall be as specified Incolumns 5 to 14 of the Schedule aforesaid.

5. Disqualification.—No person,—

(a) Who has entered into or contracted a marriage witha person having a spouse living; or

(b) Who having a spouse living, has entered into orcontracted a .marriage with any person,

shall be eligible for appointment to any of the said posts :

Provided that the Central. Government may, if satisfied thatsuch marriage is permissible under the personal law appli-cable to such person and the other party to the marriage andthat there are other grounds for so doing, exempt any personfrom the operation of this rule,

6. Power to relax.—Wnerei the Central Government, is ofthe opinion that is necessary or expedient so to do, it mayby order, for reasons to be recorded in writing and in con-sultation with the Union Public Service Commission, relax-any of the provisions of these rules with respect to any classor category of persons.

7. Saving.—Nothing in these rules shall affect reservations,relaxation of age: limit and other concessions required to beprovided for the Scheduled Castes, Scheduled Tribes, Ex-servicemen and other categories of persons in accordance Withthe orders issued by the Central Government from time totime in this regard.

4. adequate number of explosives vans licensedTinder the Explosives Rules, 1983, shall beKept ready at the airport so that the ex-plosives con be removed expeditously fromthe aircraft after its landing.

5. the aircraft shall be parked at a remote placeat the airport and an area of atleast

500 metres around the aircraft and explo-sives van shall be cordoned off by providingadequate number of security guards inconsultation with the Director General orCivil Aviaion before the transfer of explo-sives from aircraft to van is started. Thearrangement shall continue till the transferis completed and the van duly locked leavesthe site;

No smoking or use of naked light shall bepermitted within the cordoned area, and;

6. the vans carrying above explosives shall pro-ceed to the storage magazines licensed underthe Explosives Rules, 1983, and no Unduedelay shall be made on the way and allrelevant rules and local regulations shall beobserved during the transport.

G.S.R. 34 .—In exercise of the powers conferredby the proviso to article 309 of the Constitution, thePresident hereby makes the following rules regulatingthe method of recruitment to Group 'D ' posts in theDirectorate of Wheat Development, Ghaziabad in theMinistry of Agriculture, namely : —

1. Short title and development .—(1) These rulesmay be called the Directorate of Wheat Development,Ghaziabad, Group 'D' Posts Recruitment Rules,1996.

(2) They shall come into force on the date oftheir publication in the official Gazette.

2. Applicaiton.—These rules shall apply to the postsspecified in column 1 of the Schedule annexed hereto.

3. Number, classification and scale of pay . - -Thenumber of posts, their classification and the scale ofpay attached thereto shall be as specified in columns2 to 4 of the said schedule.

4- Method of recruitment, age limit and qualifica-tions etc .—The method of recruitment to the saidposts, age limit, qualifications and other matters re-lating thereto shall be as specified in columns 5 to 14of the Schedule aforesaid.

Provided that the upper age limit prescribed fordirect recruitment may be relaxed in the case of

Scheduled Caste, Scheduled Tribes and other specialcategories of persons in accordance with the ordersissued by the Central Government from time to time.

5. Disqualification-—No person,—-

(a) who has entered into or contracted amarriage with a person having a spouseliving; or

(b) who, having a spouse living, has enteredinto or contracted a marriage with anyperson,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, ifsatisfied that such marriage is permissible under thepersonal law applicable to such person and the otherparty to the marriage and that there are other groundslor so doing. exempt any person from the operationof this rule.

6. Power to relax.—Where the Central Governmentis of opinion that it is necessary or expedient so to do,it may by order, for reasons to be recorded inwriting relax any provisions of these rules with respectto any class or category of persons.

7. Saving.-—Nothing in these rules shall effect re -servation, relaxation of age limit and other conces-sions required to be provided for the Scheduled Castes,the Scheduled Tribes, Ex-Serviceman and other specialcategories of persons, in accordance with the ordersissued by the Central Government from time to t imein this regard.

G.S.R. 37.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, thePresident hereby makes the following rules regulating the method of recruitment to the post of Senior PersonalAssistant in the Civil Wing of the Department of Telecommunications. 1. Short title and commencement—(I) These rules may be called the Department of Telecommunications.Civil Wing (Senior Personal Assistant) Recruitment Rules, 1996.

2. Definitions :—In these rules., unless the contextotherwise requires —

(a) "Act" means the National Commission forWomen Act, 1990 (20 of 1990) ;

(b) '"Commission" means the National Com-mission lor Women constituted under sub-section (1) of section 3 of the Act.

3. Group A and Group B officers of the Com-mission :—The posts of the officers for the purposeof the Commission. Their name, number, classifica-tion and the scales of pay attached thereto shall beas specified in the Schedule appended to theserules.

4. Salary, Allowances and other Conditions ofservice : —The conditions of service of the Group. Aand Group B officers of the Commission in thematters of pay, Allowances, Leave, Provident Fund,age of superannuation, pension and retirementbenefits, medical futilities and other conditions ofservice, shall be regulated in accordance with suchrules and regulations as arc for the time being ap-plicable to officers of the Central Civil Services be-longing to Group A and Group B, as the case maybe. of the corresponding scales of pay.

5. Conditions of short terras contract appoint-ment :— (1) The persons appointed on short termcontract basis from the State Government, UnionTerritory Administrations, local bodies, Universities,recognised research institutions, semi-Government orautonomous bodies and such other organisationsshall be treated as on transfer on deputation onforeign service basis.

(2) The officers shall have the option either toget their pay fixed under the normal rules in force

in the Government of India [Without deputation(duty) allowance] or to draw pay which they were

. drawing in their parent organisation plus deputation(duly) allowance in accordance with the ordersissued by the Government of India, from time totime.

(3) The option for fixation of pay under sub-rule (2) shall be exercised within one month fromthe date of joining the appointment.

(4) The officers appointed on short term con-tract shall receive City Compensatory Allowance,House Rout Allowance, Travelling Allowance andLeave Travel Concession as admissible to such, offi-cers appointed on short term contract under theCentral Government.

(5,) The officers appointed on short term contractbasis shall continue to be governed by the leave,pension and provident fund rules as applicable tothem in their parent organisation and the employer'scontribution to the provident fund, if any, shall bepayable by the Commission during the period ofsuch contract.

(6) The officers appointed on short term contractbasis shall be entitled to medical facilities under theMedical Attendance rules of the Central Govern-ment.

(7) The officers appointed on short term contractbasis shall be eligible for Government residentialaccommodation us per rules of the Central Govern-ment in respect of allotment of residential accominoi-dation in Delhi.

(5) The terms and conditions of service of per-sonnel appointed on short term contract basis forwhich no express, provision has been made- in thisrule, shall be the same as are applicable to officersof equivalent rank under the Central Government.

6. Residuary provisions :—In respect of anymatter for which no specific provision has been madein these rules, the conditions of service of a personserving as a member in a Group A or Group B postin the Commission shall be governed by the rulesand orders for the time being application to corres-ponding Group of officers in the Central CivilServices.

7. Power to relax :---Where the Central Govern-ment is of the opinion that it is necessary or expe-dient so to do, it may for reasons to be recorded! in.writing relax. any of the provisions of. these ruleswith respect to any class or category of persons.

8. Interpretation .—All questions relating to theinterpretation of these rules shall be decided by theCentral Government,

Residuary Provisions :- In respect of anymatter for which no specific provision has been madein these rules, the conditions of service of a personserving as a Group "C" or Group "D" employee ofthe Commission shall be governed by the rules andorders for the time being applicable to correspond-ing Group if Government servant's in the CentralSecretariat.

3. Power to relax . -Where the Central Govern-ment is of the opinion that it is necessary or expodient: so to do. it may, for reasons to be recordedin writing, relax any of the provisions of these ruleswith respect to any class or category of persons.

9. Interpretation :—All questions relating to theinterpretation of these rules shall be decided by theCentral Government.

G.S.R, 43.—In exercise of the powers conferredby sub-section (.1) of section 17 of the Public RecordsAct, 1993 (69 of 1993), the Central Governmenthereby makes the following rules, namely :—

1. Short title and commencement.—(1) These rulesmay be called the Public Records Rules, 1997.

(2) They shall come into force on the date oftheir publication in the Official Gazette.

2. Definitions.-—In these rules, unless the contextotherwise requires,—-

(a) "Act" means (he Public Records Act, 1993(69 of 1993);

(b) "appraisal" means the evaluation of publicrecords in association with the NationalArchives of India or Archives of the UnionTerritory as the case may be ;

(C) "classified records" means the files relatingto the public records classified as top-secret, secret confidential and restricted inaccordance with the procedure laid down, inthe Manual of Departmental Security Ins-tructions circulated by the Ministry ofHome Affairs from time to time ;

(d) "custody" means the possession of pubicrecords;

(c) "defunct body" means a corporate or non-corporate body which has been wound upwith no successor to carry on its func-tions :

(g) "file" means a collection of papers relatingdowngrade the security classifications aftertheir evaluation;

(a) "file" means a collection of papers relatingto the public records on a specific subject-matter consisting of correspondence, notes

and appendix thereto and assigned with afile number.

(h) "form" means the form appended to theserules;

(i) "private records" means records lying in thepossession of a private individual or withany non-governmental organisation;

(j) "recording" means the process of closing afile after action on all issues consideredthereon has been completed;

(k) "records of permanent nature" means thepublic records being maintained after re-cording for a period specified, under sub-rule (1) of rule 5 by the records creatingagency in accordance with the procedurelaid in its Manual of Office Procedure orInstructions on the subject;

(1) "retention Schedule of records" means aSchedule which provides the period of re-tention;

(m) "review" means periodical evaluation ofrecorded files on the expiry of the period ofretention for determining their further re-tention or destruction, as the case may be;

(n) "Section" means the section of the Act;

(o) "Standing guard file" mean's a compilationof papers on a particular subject-matterconsisting of copies of policy decisions,orders, instructions or any another matterincidental thereto arranged in a chronolo-gical order ;

(p) Words and expressions used herein and notdefined but defined in the Act, shall havethe meanings respectively assigned to themin the Act.

3. Nomination of records officer.—The recordscreating agency shall by an office order issued in pur-

suance of the provisions of sub-section (1) of section5 of the Act nominate one of its officers, not belowthe rank or grade of a Section Officer, as the RecordsOfficer. A copy of such office order shall forwardedto the Director General or head of the Archives, asthe case may be.

4. Maintenance of standing guard file.—The re-records officer shall be responsible for maintainingand keeping a standing guard file and proper recordof the directions issued by the Director General orhead of the Archives, as the case may be, in pursu-ance of the provisions of sub-section (2) of section 6and shall produce the same for inspection as andwhen required by the Director General or head ofthe Archives, as the case may be.

5. Acceptance of public records of permanentnature.—(1) The Director General or head of theArchives, as the case may be, shall accept for depo-sit and preservation public records of permanentnature which have been retained after recording bythe records creating agency an Its records room forthe last twenty five years or more.

(2) Records officer shall intimate to the DirectorGeneral or head of the Archives, as the case may be,each year before 31st day of January, in Form-1 theparticulars of all public records of permanent naturewhich are due for appraisal during the year.

(3) On receipt of an intimation under sub-rule (2),the Director General or head of the Archives, as thecase may be, through his officers, shall assist the re-cords officer in conducting the appraisal of publicrecords. When the appraisal is over, the recordsOfficer shall prepare, in triplicate, a transfer list inForm-2 of all public records end deposit the samefor preservation with the Director General or headiof the Archives, as the case may be, who shall afterhis satisfaction, return one copy of the transfer listto the records officer as a receipt of the publicrecords.

(4) If the records officer after appraisal deams itnecessary to retain any record or file of permanentnature beyond the period of twenty five years, he maydo so for reasons to be recorded in writing and underintimation to the Director Genera] or head1 of theArchives, as the case may be.

6. Withdrawal of public records.—(1) If public re-cords deposited and preserved with the Director Ge-neral or head of the Archives, as the case may be, isrequired by the records creating agency for any offi-cial purpose, than the records officer shall send aduly signed and stamped requisition slip in Form-3to the Director General or head of the Archives, asthe case may be.

(2) The public records requisitioned under sub-rule(1) may be returned as soon as he purpose is achiev-ed but shall not be retained beyond the period of six!months by the records officer or the record creatingagency.

7. Down-grading of classified records-- Therecords creating agency shall by an office order autho-rise an officer not below the rank of the Under Sec-retary to the Government of India to evaluate anddowngrade the classified records being maintained by23 GI/97—14.

it. A copy of .such office order shall be forward tothe Director General or head of the Archives, as thecase may be.

(2) The officer so authorised under sub-rule (1)shall evaluate the classified records every fifth yearfor the purpose of down-grading.

(3) After down-grading if the officer declares anyrecord as of permanent nature, the same shall be de-posited and preserved with the Director General orhead of the Archives, as the case may be, after itsappraisal,

(4) The records deposited under this rule can berequisitioned for any official purpose and returned tothe Director General or head of the Archives, asthe case may be, in the manner provided underrule 6.

(5) Every year in the last week of June and Decem-ber, a half-yearly statement in Form-4 shall be fur-nished by the officer authorised under sub-rule (1) tothe Director General or head of the Archives, as thecase may be, on the action taken for evaluation anddowngrading the classified records.

8. Submission of Annual Report.—(1) The recordsofficer nominated under rule 3 shall furnish to theDirector General or head of the Archives, as the casemay be, an Annual Report in Form-5 every year inthe month of March of the following year.

(2) The Director General or head of the Archives,as the case may be, shall, thereafter, submit a reportto the Government in the Ministry of Human Re-source Development every year on the action takenby the Records Officer in pursuance to the provisionsof cltuses (a) to (1) of sub-section-1 of section 8of the Act.

9. Destruction of Public Records.—(1) No publicrecord shall be destroyed without being recorded andreviewed. In. the month of January every year, eachrecords creating agency shall record after consultingthe records retention Schedule all those files on whichaction has b?en completed. This work shall beaccomplished in consultation with the records officer.

(2) No public record which is more than twenty fiveyears old shall be destroyed by any records creatingagency unless it is appraised.

(3) A list of all such public records which are pro-posed to be destroyed shall be prepared by the recordcreating agency in Form-6 and retained permanentlyfor future reference.

(4) The records officer shall furnish a half yearlyreport in Form-7 on recording, indexing, reviewingand weediing of records to the Director General orhead of the Archives, as the case may be.

(5) Records shall be destroyed either by burningor shredding in the presence of records officer.

10. Access to private reocrds.—(l) Recordsacquired from private sources by way of gift or-purchase or otherwise shall be made available for

bonafide reasearh subject to the conditions laid downby the donor.

(2) Research scholarshall submit an applicationin Form-8 to the Director General or head of theArchives, as the case may be for permission toconsult records. The Director General or head ofthe Archives, as the case may be, may refuse suchpermisisi6n in public interest and for reasons to berecorded on the said application.

(3) Whether microfilm rolls may be available,the original records shall not be supplied for con-Sultation to reasearch scholars.No copy of anyrecord Shall be made by any one without the prioifpermission of the Director General or head of theArchives, as the case may be.

11. Access to public. records.—(1) The publicrecords accepted for deposit and preservation underSub-rule (r)of rule 5 shall be made available forbonafide consultation and research purposes subjectto the 'provisions of' sub-section-(1) of section 12and the following conditions namely :—

(i) a person who intends to consult the publicrecords shall apply to the Director Generalor head of the Archives, as the case maybe, in Form-8. The Director General orhead of the Archives, as the case may be,may refuse .such permission in public inte-rest and for reasons to be recorded on thesaid application;

(ii) , foreign national intending to .consult thepublic records may be permitted only onthe production of letters of introductionfrom their sponsoring institution and diplo-matic Mission;

(iii) records, maps and cartography records re-lating to the Ministry of External Affairsand Ministry of Defence, in respect ofArunachal Pradesh (including Eastern Sec-tion of the Sino-Indianborder) Sikkim;Bhutan, Nepal, Tibet, China and Myanmarand areas comprising Pakistan andBangla-desh may be made available for consulta-tion keeping in view the security and thedefence of India or of any part of theterritory thereof. Records relating to theMinistry of External Affairs, Home Affairsand Human Resource development in res-pect of Jammu and Kashmir (includingGilgit and Chitral) pay also be made avail-able for consultation keeping in view thesecurity and defence of India or of anypart of the territory thereof;

Provided that the Director General orhead of the Archives, as the case may be,refuse such consultation;

be suppied for consultation to resarchscholar ;

(v) reprogtaphic and transription facilitiesmay be made available on submission ofan application in Formr9 and for such ser-vices the applicant- shall have to make thepayment of such service charge as maybe fixed the director General or headof the Archives, as the ca$e may be, fromtime to time;

(vi) a person consulting public, records for, thepurpose of research and publishes the workwhich is based upon the material takenfrom the said records may acknowthe sarnie.

(2) A person intending to consult the public re-cords shall not,—

(a) write and put any marks or indicationsor on public records;

(b) fold; tear, Cut, crease, or otherdamage or mutilate public records;

(c) remove any public records without obtaining the permission from the Director Gene-ral or head of the Archives, as the casemay be;

(d) be allowed to take any eatable or drink.ing products or smoking while consultingpublic records;

(e) place any thing or object on any publicrecords with a view to make out any copyof the said records;

(f) disturb or interrupt any other person whileconsulting the public records; and

(g) behave in a manner which, in the opinionof the Director General or head .of ' theArchives, as the case may be, is detri-mental to the maintenance and preserva-tion of public records.

12 Allowances to the members of the ArchivalAdvisory Board The members of the ArchivalAdvisory Board nominated by the Central Govern-ment under clause (d) of sub-section 2 of Section13 shall draw travelling allowance and daily allow-ance for attending the rat ings of the ArchivalAdvisory Board at the rates admissible to Group•A' officers of the Central Government.

1. Short title and commencement.— (1) These rules maybo called the Forward Markets Commission (Assistant) Re-cruitment Rules, 1996 .

(2) They shall come into force on the date of their publi-cation in the Official Gazette.

2. Number, Ciassification and Scale of Pay.----The numberof the said posts, its classification and the scale of pay attach-ed thereto shall be as specified in columns 2 to 4 of theSchedule annexed to these rules.

4. Disqualifications.—No person,—

(b) Government of India Presses Manager (Photolitho)/Works Manager (Photolitho), Technologist (Process) andTechnologist (Printing and Banding) Recruitment Rules, 1983, so far as they relate to the post of Manager(Photolitho )/Works Manager (Photolitho);

(c) Directorate of Printing, Government of India Presses (Deputy Manager and Technical Officer) Recruitment Rules,1988;

except as respects things done or omitted to be done before such supersession, the President hereby make the following rulesregulating the method of Recruitment to certain Group 'A' and 'B ' posts, in Ministry of Urban Affairs and Employment,Directorate of Printing namely :—

1. Short title and commencement.—(1) These rules may be called The Ministry of Urban Affairs and Employment,Directorate of Printing, Group 'A' and Group 'B ' Posts Recruitment Rules, 1996.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.—These rules shall apply to the posts as specified in column 1 of the Schedule annexed to theserules.

3. Number of posts, classification and scales of pay.— The number of the said posts, its classification and scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules,

4. Method of recruitment, age limit, qualification, etc.—The method of recruitment, age-limit, qualifications andother matters relating to the said post shall be as specified in columns 5 to 14 of the aforesaid Schedule.

5. Disqualifications.—No person—

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any other person,

shall be eligible for appointment to any of the said post:

Provided that the Central Government may, if satisfied, that such marriage is permissible under the personallaw applicable to such person and the other party to the marriage and that there are other grounds for sodoing, exempt any person from the operation of this rule.

6. Power to relax.—Where the Central Government is of opinion that it is necessary or expedient so to do, it may,by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission,relax any of the provisions of these rules with respect to any class or category of persons,

Themaximum age limit for appointment by trans-fer on deputation shall be not exceeding 56years as on the closing date of receipt ofapplications).
