The Information and Library Network (INFLIBNET) Centre, is an autonomous Inter University Centre of the University Grants Commission, Ministry of HRD, Government of India. INFLIBNET having an Administration & Housing Building and Residential Block at GH-0 near Infocity, Gandhinagar with all modern facilities needs services for ANNUAL OPERATION & NON COMPREHENSIVE TYPE MAINTENANCE CONTRACT For FIRE SAFTEY SYSTEMS ( Fire Detection and Fire Protection Systems ) installed in the buildings.

The building is already occupied & operational. INFLIBNET is proposing to hire services of an agency for ANNUAL OPERATION & NON COMPREHENSIVE TYPE MAINTENANCE SERVICES from 1st February 2015. The installed utility systems are exposed to people from all walks of life, the equipment should be operated and maintained efficiently for complete personnel safety and should be very safe against any health hazard / accidents throughout the year. The installed utility systems are catering to a most modern Office cum Residential Buildings accordingly; the systems should be operated and maintained for continuous trouble free operation and adhere to uptime and response time requirements as stated in the document.

INFLIBNET invites sealed tenders in two bid system from interested contractors having

All the bidders should also submit a demand draft / Banker Cheque of Nationalized Bank of Rs. 20,000/- drawn in favor of “INFLIBNET CENTRE" payable at Gandhinagar, as the non-

interest bearing Earnest Money Deposit in separate sealed cover super scribed “EMD Cover.”

Documents Comprising the Bid

a. Two Bid System : The offer should be submitted as per two bid system.

b. One set of document should be put in a sealed cover marked as `Technical Bid’

containing Technical details, Literature, Catalogue etc., EMD, Tender fees and Tender commercial terms.

c. Other set should be put in a separate sealed envelope and should contain Bid Form -

Schedule of Rates only and marked on the cover as `Price-Bid’.

d. Each envelop securely closed and sealed should indicate boldly on it the Tender No.,

description and Due Date of opening of tender.

e. Both the envelopes of `Technical-Bid’ & `Price-bid’ should then be put in a single separate(big) sealed cover indicating thereon clearly the description of works, Tender No. &

Due Date.

After opening of Technical bid, the capability and suitability of the bidders shall be

evaluated as per the criteria mentioned below and Price bid of the qualified bidders only

shall be opened in the presence of the attending bidders, on the date & time to be communicated later to the qualified tenderer. 1. Following are the Tenderer Eligibility Criteria 1.1 The registered company, firm or an agency should have experience of similar works

in the Government or Semi Government or Corporate Organizations of repute at par with INFLIBNET.

1.2 The tenderer should have been registered with the competent authority and must have PAN / TAN number, VAT Registration, Service tax registration, Registration of the Agency under the Shops & Establishment Act, License under the Contract Labour Act, PF registration with the Regional PF Commissioner, ESI Registration, Workmen Compensation Policy as applicable, Electrical License etc..

1.3 The tenderer should have experience of minimum 3 Years in dealing with reputed Educational Institutes / Organization in the providing such services / contracts.

1.4 The tenderer should not be blacklisted by any organization.

1.5 In deciding upon the selection of bidders for the work, great emphasis will be put on the ability, reputation, experience for similar type of work done, financial standing, technical competency of bidders to do good quality work according to the time schedule.

1.6 The Bidder must be having annual turn over of Rs. 50,00,000/- for similar kind of operating & maintenance contractual services.

1.7 The Bidder must have completed at least One work of 80 % of similar work value or Two works of 50 % of similar work value or Three works of 40 % similar work value in last 3 years.

1.8 The company/firm must be profit making organization. Audited report of last 3 financial years should be attached with the bid document.

1.9 The company/firm should have office in Ahmedabad/Gandhinagar.

* The tenderers shall comply with the requirements under qualifying criteria.

Proofs shall be attached with abstract in separate sealed cover of Technical Bid, failing which will disqualify for opening of price bid cover.

2.0 NOTES TO TENDERER

2.1 The Tenderer is expected to must have visited, inspected & studied the site, scope

of work, local conditions, details of installed systems, operational environment,

materials & labour conditions as applicable to work and as required by various statutes in force for respective works.

2.2 Every tenderer must furnish along with the tender, detailed information in respect of

works that they have completed during the past three years, including the name of

work, name of the client, contact person with telephone nos. and total cost of work. Work experience, Clients Work Satisfaction / Completion Certificates etc. for such

type of Buildings is one of the main parameters for evaluation of Bid.

2.3 The tenderer must have Annual Turn Over of at least Rs 50,00,000=00 as per

latest Audited balance sheets in any one year out of last three year for such types of works. Also the tenderer must have on hand / completed the work of similar magnitude in last three years. In case of Joint Venture of more than one

firms/ companies, the net worth of firm/company, who is to operate on day to day

functions, will be considered. The tenderer must be registered with ESI & PF and

having valid registration as per Indian Work Man Compensation Act.

2.4 Tenderer shall not make alteration or amendments in the scope of work and in descriptions as incorporated in the tender documents, since in such cases the

tender is liable to be rejected and if at all any alterations are made, IT SHOULD BE MARKED WITH BOLD LETTERS AND FURNISHED UNDER SEPARATE LETTER

ALONGWITH THE TENDER.

2.5 No alteration shall be made in the form of tender or in scope of work schedule.

2.6 The tenderer before submitting tender, must visit the site and satisfy himself for

makes & capacities of the installed system and scope of work. The information

contained herein is only indicative and for reference purpose. Any Variation in

description shall in no way entitle the Bidder to claim additional money after the award of work.

2.7 The tenderer having office, maintenance centre in city or in the nearest city will be

preferred and tenderers must give the location of nearest office and maintenance

centre.

2.8 Tender scope of work is detailed scope of work. However, the Logbooks, Complaint

Registers, Formats & Records for day to day operation & maintenance are to be

prepared by the successful tenderer. The tenderer should bid for all the services

covered under the tender and should not leave any services out of scope. The

tenderer shall also furnish details about key people who are to look after the operations . Any deviation in this will render the bid liable for rejection.

2.9 Sealed Tenders in two separate envelopes in duplicate separately should be addressed to Information and Library Network Centre, Gh-0, near Infocity, Gandhinagar, and super-scribed “Tender for ANNUAL OPERATION & NON COMPREHENSIVE TYPE MAINTENANCE CONTRACT For FIRE SAFTEY SYSTEMS ” for the Administration & Housing Building and Residential Block Buildings and sent so as to reach them not later than 15-00 hours on 16th January, 2015.

2.10 No tender will be accepted after 15-00 hours on 16th January, 2015 under any

circumstances whatsoever. (a) The tenders – Techno Commercial Bids - will be opened at 16-00 hours on

16th January 2015 at the office of INFLIBNET, Gandhinagar. However,

INFLIBNET at its sole discretion and is entitled to extend date of opening of

tender.

(b) Rates and Terms of Tenders shall remain open for acceptance by the Client for a period of Three Months from the date of opening the tender, which

period may be extended by mutual agreement and the tenderer shall not

cancel or withdraw the tender during this period.

(c) The tenderer shall use tender issued by the client to fill in the rates and shall

return the tender duly signed on all pages as a token of having read and

accepted all the terms and complete in all respects along-with the Tender.

2.11 (a) The Tender form must be filled in English. If any of the documents is missing

or unsigned, the Client at its discretion may consider the tender invalid.

(b) Rates should be quoted both in figures and words in column specified.

All erasures and alterations made while filling the tender must be attested by initials of the tenderer. Overwriting of figures is not permitted. Failure to

comply with either of these conditions will render the tender void at client’s

option. No advice of any change in the rate or conditions after the opening of

the tender will be entertained.

2.12 Each of the tender documents shall be signed by the person or persons submitting

the tender in token of his / their having acquainted himself / themselves with the

general conditions of the contract, scope of work, special conditions etc. as laid

down. Any tender with any of the documents not signed is liable for rejection.

2.13 The tender submitted on behalf of the firm shall be signed by all the partners of the firm or by a partner who has the necessary authority on behalf of the firm to enter

into the proposed contract or by a person who is duly authorized official in case of a

Company. In case of Joint Venture of more than one company / firm , the Joint

Venture Agreement , authority letter to company / firm submitting tender must

accompany. Otherwise the tender is liable to be rejected by the Client.

2.14 The client does not bind himself to accept the lowest or any other tenders and

reserves to himself the right to accept or reject any or all the tenders either in whole

or in part without assigning any reasons for doing so.

2.15 On receipt of intimation of the acceptance of his / their tender by the Client, the

successful tenderer shall be bound to implement the contract and sign an agreement

in accordance with the draft agreement and the schedule of Conditions within 7 days thereof. Written acceptance by the INFLIBNET, Gandhinagar will however,

constitute a binding contract between the INFLIBNET, Gandhinagar & the person

so tendering, irrespective of whether such a formal agreement is or is not

subsequently executed.

2.16 The Contractor shall not assign the Contract to any other agency. He shall not

sublet any portion of the Contract, except with the written consent of the Client. In

case of breach of these conditions the Client can take severe action including

termination of contract and without prejudice to his other remedies against the

Contractor.

2.17 The successful tenderer shall submit, in triplicate within a week of acceptance of

order, detailed schedule of operation & non comprehensive maintenance services along and work which is to be done at INFLIBNET, Gandhinagar.

2.18 The Contractor shall carry out all the work strictly in accordance with approved

schedule of work & recorded in format approved by client.

2.19 The tenderer must obtain for himself on his own responsibility and his own expenses

all the information which may be necessary for the purpose of making a tender and

for entering into a contract and must visit and inspect and totally famiriliaze himself with all the installed utility systems at the site of the work, and acquaint himself with

all local conditions, local rules and regulations, statutory requirements, means of

access to the work, nature of the work and all matters appertaining thereto and

provide for all tools/tackles equipments etc. as may be required for rendering the

services.

2.20 The rates quoted shall include all existing taxes, duties and levies and shall be

deemed to be for the complete duration of work. The rates shall also remain firm for

the entire period of contract. However, any subsequent changes in taxes and levies

shall be reimbursed to the contractor or passed on to the client as the case may be.

2.21 Each tenderer shall submit with his tender a list of large works of similar nature he

has executed giving details as to their magnitude and cost, the proportion of work

done by the contractor in it and the time for which the works were carried out.

2.22 The tenderer shall state clearly in his tender the Man power / Operators, standard

tools, spare parts, inventory for consumable items which he will keep at site of work for operation & non comprehensive maintenance services of utility installations.

2.23 The successful tenderer is bound to carry out any items of work necessary for

smooth operation of installed utility services.

2.24

2.25 The successful tenderer shall obtain and renew necessary registration / permission

from the Government & or any other local municipal authorities & obtain necessary permit / NOC as required & also conduct such tests as are called for by the

Consultant / Client or by regulation of the authorities. Necessary fees shall be paid

by INFLIBNET.

2.26 The Tenderer shall guarantee that the work shall confirm to the detailed scope of work to be carried out and as per good engineering practice.

2.27

2.28 Incomplete technical data will be treated as negative reply.

2.30 In case Techno-commercial part is without the EMD, the bid shall be rejected without

opening of the price bid part. 2.31 The contractor shall be reporting to authorized representative of client.

2.32 All the spare parts used shall be only standard make of original brand or of approved

make by Client.

2.33 All routine and preventive repairs and maintenance works shall be done preferably

on holidays or after office hours to avoid disturbance to the normal functioning of the

office.

2.34 The tenderer shall make out his offer in two parts as TECHNICAL PART and COMMERCIAL PART.

The Technical Part shall not carry any indications of the price, but the tenderer shall

give details in technical part any thing he would like to state/offer. In other words

technical parts of the offer will give details of his offer as called for in various

sections. EMD shall have to be kept in this Bid cover. The Technical part shall be

comprising of following documents :

The commercial part shall have nothing but the prices indicated. Any other

qualifying clauses etc. in this part will not be considered. In other words the commercial part will only carry a cross-reference to technical part and detail the

2.36 The Contractor shall submit his confirmation with offer as under on a Stamp Paper

valid until end of the contract period. a. Confirmation to Scope of Work

Prices shall be inclusive of all taxes and levies. Only statutory variation for finished part of work shall be payable as extra / reduction shall be passed on to the client.

2.37 The above instructions shall form part of the conditions of the contract.

2.38 The conditional Tender shall be liable for rejection without assigning any reason

whatsoever

b) The client invited Bids for ANNUAL OPERATION & NON COMPREHENSIVE

TYPE MAINTENANCE CONTRACT FOR FIRE SAFTEY SYSTEMS and the

contractor has submitted Bids for the said work. c) The Client desires to entrust the work of ANNUAL OPERATION & NON

COMPREHENSIVE TYPE MAINTENANCE CONTRACT FOR FIRE SAFTEY SYSTEMS of the said utility System to the Contractor;

d) The parties hereto are desirous of recording the terms and conditions of the

operation & non comprehensive maintenance and service of the said utility

systems as appearing hereafter.

NOW THIS AGREEMENT WITNESSETH AND IT IS HEREBY AGREED BY AND

BETWEEN THE PARITIES HERETO AS FOLLOWS:

The recitals contained above form integral and operative part of this agreement as if the

same were set out and incorporated herein verbatim.

The Client entrusts the work of ANNUAL OPERATION & NON COMPREHENSIVE TYPE MAINTENANCE CONTRACT For FIRE SAFTEY SYSTEMS of the said utility

System to the contractor for the period of 1 (one) year from _________ day of

____________________ and the Contractor agrees to do so at Contractor’s own costs,

expenses, risk and responsibilities on the terms and conditions contained in this

agreement. The client shall pay to the contractor a total sum of Rs._________ /-

(Rupees ________________________________ only) for the duration of contract.

The above annual operating and maintenance charges for each year shall be paid monthly after completion of each month. The Contractor agrees and undertakes to carry out the operation and non comprehensive maintenance service of the said utility Systems by using all material required to keep the utility System in good working order as the same is on the date of execution of these presents, save and expect fair wear and tear. Such non comprehensive service shall include operation and non comprehensive maintenance of all utility equipments & plants installed at INFLIBNET, Gandhinagar enclosed herewith section – 6 of tender document.

B) Scope of work shall be generally as follows: This Annual Operation & non Comprehensive type Maintenance Contract will include the following but not limited to the following-

1) Daily Routine operation of Fire safety systems & its components :

a) Day-to-day routine checking of the fire pumps, pump glands, motors, hydrant

valves, smoke and heat detectors, fire panels, electrical connections etc. of

entire fire detection and fire protection systems.

b) Day-to-day cleaning of equipment / fire analogue panels / filters / strainers etc.

c) Day-to-day routine maintenance of logbook for all the equipments with daily

standing water pressure readings in the system.

d) Day to Day routine checking of fire tanks for adequate water levels and water

quality in tanks. Also checking of Diesel availability for Diesel pumps.

e) Checking & tightening of all electrical contacts of fire systems equipments

f) Checking of Pressure switches and operation of Jokey Pumps for pressure

building up. g) Checking of Sprinkler bulbs

h) Checking of any water leakages in the complete system and rectifying the

same if found any fall of water pressure due to any leakages in the system.

2) Routine cleaning & maintaining of all fire safety equipments necessary for trouble

free operation.

3) Routine checking condition and settings of fire panel controls, operating controls, safety controls to ensure optimum performance and reliability.

6) Routine checking of all electrical controls and components (switches, timer, relays, starters etc.) for all utility equipment electrical panel.

7) Regular checking & greasing of all fire pumps.

8) Routine checking & cleaning of bearings of all motors and pumps.

9) Checking alignment of all equipment, operation of control devices, water level

indicators, valve stem, etc. and cleaning and lubricating the same.

10) Routine checking, cleaning of sensors, controllers, DDC panel /controllers.

11) Routine checking of PC workstation, system controller and controller panels,

pointers.

12) Routine checking, rectification of communication cables, internal cabling,

terminations etc.

13) Attend any break down within 8 hours in any installed fire detection and protection systems equipment for trouble free and round the clock operation for any kind of emergency along with any required spares & consumable.

14) Yearly Renewal of Fire Systems NOC from local Fire Authorities with required operation tests up to the satisfaction of Fire Authorities. All the necessary arrangements, tests, trails, documents, legal liason charges, fees etc. required

to obtain the fire NOC from local fire authorities will be in contactors Scope till the contract in force.

In case any part is found beyond repairs, the same shall be reported to plant in-charge and replaced by the Contractor for trouble free operation of the system.

C) The contractor will maintain books of records in which the entry of having given such

service, the date and time thereof and replacement if any, etc. will be made and the

same will be got countersigned by the Client or his representative.

D) The Contractor agrees and undertakes that the Annual operation & non comprehensive maintenance contract cover all Maintenance and day-to-day

operation of utility System.

E) The Contractor agrees and undertakes that the non-comprehensive maintenance &

operation service shall be available to the Client even after the normal working hours

or on holiday at no extra charge.

F) It is agreed that the contract value is inclusive of all duties / levies prevailing, as on date, however any change in duties/levies structure or introduction of any new levies

shall be paid extra by the client after submitting documentary evidence by the

contractor.

G) Following minimum skilled & qualified man-power( with minimum Diploma Graduate )

will be deployed at site by Contractor : i) One skilled Fire System Operator for 24 hours ( in two shifts )

The above manpower requirement is indicative and minimum manpower requirement

at the premises. However depending upon the load of work and response time the

contractor must be able to mobilize required manpower to adhere to requirements of

this contract. Before employing the Manpower at site of work , the Bio-data / CV of

respective technical persons must be submitted to client and get it approved. In no circumstances unskilled & in competent man power at site will be accepted by client.

In case the behavior / attitude / services of any manpower of contractor found in

satisfactory, client will issue a written notice for necessary corrective actions. The

contractor shall change such persons, if the complaint still persist then after.

H) The contractor will be liable or responsible for all its persons / its contractors / sub-late manpower for matters including any injury / (death) due to any defective service

and Client shall not be responsible for the same. Any damage to the property by

Force Majeure situations shall be covered by the insurance policy of the Client.

I) This Agreement is binding on both parties and is not-terminable for the entire period

of the contract. However, the client and the contractor will have the right to terminate

the agreement resulting from this contract by giving one month notice to the other

upon situation arising due to non-compliance of the conditions of contract. The

termination notice shall be valid only if it is preceded by a corresponding non-

compliance notice issued at least ten days prior to the date of termination notice and

if the non-compliance has continued to the date of the termination notice.

J) The agreement is subject to force majeure caused by Earthquake, floods, riots lock-

outs strikes or any Industrial Disputes under the Industrial Disputes Act. Both parties

shall ensure fulfillment of their own obligations under this contract irrespective of the

above although reasonable circumstantial consideration shall be made by both

parties concerned as per prevailing situation in such circumstances.

K) The conditions of this Agreement shall be, inter alia, applicable for the warranty

period of 1 (One) years.

Disputes Resolution and Arbitration-

(a) If any dispute or difference of any kind whatsoever arises between the parties in connection with or arising out of this Agreement including any question

regarding its existence, validity or termination, the Parties shall seek to

resolve any such dispute or difference by mutual consultation.

(b) If the Parties fail to resolve such dispute or difference by mutual consultation,

then either party may give to the other Party formal notice in writing that the

dispute or difference exists, specifying its nature, the point(s) in issue and its intention to refer the dispute to arbitration.

(c) If the Parties fail to resolve such dispute or difference by further consultation

within a period of seven (7) days from the date upon which such notice of

dispute has been given, the dispute or difference shall be referred to and

finally settled by arbitration.

(d) It is agreed between the Parties that in such event the arbitration be conducted in accordance with the provisions of Arbitration and Conciliation Act (Amended) 1996. The venue of the arbitration shall be Gandhinagar and

the language of the Arbitration proceeding shall be English.

3.0 CONDITIONS OF CONTRACT 3.1. DEFINITION OF TERMS

“Client” Shall Mean Information and Library Network Centre, Gh-0, Near Infocity, Gandhinagar. “Contractor” shall mean the tenderer whose tender has been accepted and shall include his heirs and successors. “Scope of Work” shall mean the Scope of work attached along with the conditions of the Contract. “Contract” shall mean the agreement between the Contractor and Client for Annual Operation & Non Comprehensive type Maintenance of Fire Safety systems for Administration & Housing Building and Residential Block Buildings “Tests” shall mean the tests as described in the specifications for checking the performance of the Utility system, as per BIS standard and as may be required statutorily.

3.2 EXECUTION

This specification provides for the complete operation & maintenance works for installed. If something is not specifically mentioned here but related to execution, shall be included in the scope. The client shall provide lockable space of around 100 sq. ft. for the storage of materials however, the sole responsibility of the safety of the stored material shall be of contractor. The Contractor shall make his own arrangements for providing accommodation for his workmen. The Contractor shall make good all damages to the building, property, equipments and articles, how so ever arising from the execution of the said scope of work. The Contractor shall indemnify and hold harmless the client, its directors / officials etc. against all claims in respect of injury to any person how so ever arising out of the repair maintenance of the equipment in the course of such activity. The Contractor shall discharge all his obligations under the Indian Workman’s Compensation Act & E.S.I., PF and other labour / manpower related laws / rules / guidelines in so far as it affects workmen in his employment. The contractor shall also be responsible for obtaining all necessary statutory licences/ permissions , if any , required for the work / manpower. The Contractor shall make his own arrangements for procuring the necessary labour, skilled and unskilled. He should conform to all local government laws and regulations concerning labour and their employment.

3.3 GENERAL

In order to avoid correspondence and clarification at a later date, tenderers are requested to indicate clearly all technical details and information asked for in the tender document. Absence of any information on item will be assumed to be negative reply.

3.4 COMPLETENESS OF CONTRACT

All services whether specifically mentioned or not but which are usually required to operate & maintain utility systems and to ensure safe and satisfactory operation are to be provided by the Contractor without any extra charge. All tools & labour which may complete the work shall be considered to be in the scope of work of the Contractor and shall be furnished without extra charge.

3.5 SCOPE OF WORK

The Contractor shall be deemed to have satisfied himself before tendering as to the correctness of the installed utility services. The scope of work and other parts of this contract are to be considered as explanatory to each other or should any thing appear in the one that is not described in the other or should any discrepancy or any misunderstanding arise on account of such discrepancy, or inconsistency, the site instruction given by the client shall prevail. The contractor shall execute the work according to such instructions / explanations given by the different parts of this contract, even though such works are not specifically shown and described therein. The contractor shall record all the works done on daily basis in approved format.

3.6 INSURANCE OF WORK

The Contractor will insure entire tools for transit / storage during execution of work against losses, damages due to fire, earth-quake, war, floods, insurrections etc. No claims will admissible on this account. The tenderer shall also insure all the manpower employed for the execution of above scope of work.

3.7 CO-ORDINATION a. Work shall be carried out in conformation with the scope of work and with the

general requirements of the Client. b. The Contractor shall also co-operate with other Contractors employed by the client /

Clients Engineers, compare plans, scope of work and shall forward to the Client copies of all correspondence.

3.8 DOCUMENTATION AS PER ANNEXURE ATTACHED a. Before proceeding with the work, the Contractor shall submit the following

documents in duplicate-

i. Descriptive formats / Logbook for all the equipments viz. Fire Pumps, Smoke and Heat Detectors, Sprinklers, Fire Panels, Electrical Components, Controls, Electrical panels etc. for recording details of Capacity, Power Consumption, Efficiency, Performance Curves, power factor, electrical details, mechanical details etc. shall be maintained by the contractor.

He shall also maintain and keep updated Operation Manual and Disaster

Management Plan for related services. The persons operating shall have knowledge of these manuals and shall be kept conspicuously.

3.9 VARIATION OF WORK

The Client shall have the power from time to time during the course of the work, by notice in writing to instruct the Contractor to make any alteration, omission, addition or variation in the work (herein after referred to as variation). The difference in the cost of such variation shall be added to or deducted from the contract price as the case may be in accordance with the clause3.12, and if in the opinion of the contractor the variation would prevent him from meeting any of his obligations or guarantees in the contract, he shall give the same in writing failing which he shall not be entitled to any modifications in his obligations. The variation required should never the less be carried out. The matter in difference shall be settled by arbitration. The Client shall give a reasonable notice to the Contractor to enable him to make arrangements for variation in work required by him.

3.10 NEGLIGENCE

If the Contractor shall neglect to execute the work with the due diligence or shall contravene the provisions of the contract or Normal working practice , the Client or its representative may give notice in writing to the Contractor, calling upon him to make good the neglect or contravention complained of. If the Contractor fails to comply with such notice within a reasonable period, the Client shall have the option and be at liberty to determine the contract and to take the work wholly or in part out of the Contractor’s hands and complete it either by himself or his agents at the risk and cost of contractor. The Client shall then be entitled to retain any balance payment which may other wise be then due on the contract. The cost of execution of such work as aforesaid will be adjusted against the payment due to the Contractor. If the cost of execution shall exceed the balance due to the Contractor, the Client shall be at liberty to dispose off any of the Contractor’s material that may be at site and apply the proceeds for payment of the difference of

such cost and recover the balance by process of law, or from any moneys due to the contractor.

3.11 PROGRAM OF WORK & PROGRESS SCHEDULES

The Contractor shall submit along with the offer detailed schedules showing the program and the sequence in which the Contractor proposes to carry out the work.

Such schedules shall be approved by the Client before starting the work and shall be binding on the Contractor. If so required by the Client, the Contractor shall furnish weekly progress reports.

3.12 EXTRA ITEM

Any kind of extra job not specifically mentioned in the scope of work and also other than the variable items, shall be approved based on Rate Analysis basis as approved by client.

3.13 INSPECTION DURING EXECUTION The Client is at liberty to inspect the any system during execution and the Contractor shall remedy any defects found free of cost. The Contractor shall furnish all instruments and services needed for the tests. Any defects and deficiencies that are noticed during this inspection will have to be attended by the Contractor from time to time.

3.14 REJECTION OF DEFECTIVE WORK a. If the completed system or any portion thereof before it is taken over is found

defective or fails to fulfill the intent of the scope of work, the Contractor shall on receipt of notice from the Client forthwith make defective work good. Should he fail to do so within a time considered reasonable by the Client, the Client may reject and replace at risk, and expense to the Contractor, the whole or any portion of the system, which is defective or fails to fulfill the requirement of the contract.

b. The Client shall have the right to operate all equipment, if in operating condition, whether or not such equipment have been accepted as complete and satisfactory.

3.15 TAKING OVER

After completion of the contract, the same shall be taken over by the Client in good working condition.

3.16 CLEAN-UP OF THE WORK SITE

During execution the Contractor shall at all times keep the working and storage areas free from waste or rubbish. On time-to-time, as directed by Client in charge, he shall maintain the premises neat and clean in a satisfactory condition.

3.17 WORK AT SITE

Access to the work shall be allowed only to the Contractor and his duly appointed representatives. The Contractor shall not object to the execution of work by other Contractors or tradesman and shall afford them every facility for execution of their works simultaneously with his own.

3.19 CONTRACTOR’S CONDITIONS OF CONTRACT

Conditions of contract in Contractor’s offer will be treated as null and void unless specifically agreed by the Client in writing.

3.20 SAFETY

All the contractors personnel working shall be complete with approved safety devices wherever a potential hazard to personnel exists and with provision for safe access of personnel to and around equipment for operational and maintenance functions.

It shall be the responsibility of the contractor that all necessary safety measures and precautions are invariably ensured while performance of the contract work and CLIENT shall not be responsible for any injuries / accidents suffered by contract labour. The workers are required to follow the safety rules while working. The sufficient no. of safety gadgets such as, safety shoes, gumboots, earplugs, helmets, safety belts & HT/LT hand gloves etc. are to be made available to them. The agency is required to provide First Aid Box with all accessories at suitable location during contract period

3.21 Penalty Clause:

No total Breakdown is acceptable:- In case of total Breakdown, suitable recovery shall be made based on losses incurred to CLIENT. The decision of Director, INFLIBNET Centre will be final and binding on contractor. The contractor shall carry out preventive maintenance, operation & maintenance/ upkeep as per schedule and ensure the serviceability of system as per specifications and as directed by In-Charge of the system, failing which he shall be liable for penalty as specified below. Non Performance of Periodical Preventive operation & maintenance/ upkeep/ breakdown works:- a) The contractor is required to carry out the work as per the schedule /specifications issued by CLIENT and as per the instruction of Admn. Officer or his authorized representatives from time to time, failing which he shall be liable for a penalty of Rs. 1000/- per incident. b) All minor break downs are required to be attended / rectified with in 24 hrs, failing which agency is liable for a penalty of Rs. 1000/- such incident/day. c) For unforeseen / major repair such as rewinding etc., is to be done, the defect need to be rectified within 3 days or minimum lead time required for the procurement of spares etc with the prior approval of In-charge of the system. Failing

which agency is liable for a penalty of Rs. 5000/- such incident/Equipment / Week. d) If agency fails to disburse the uniform within 1 month time of award of letter, the penalty @ Rs. 1000/- per week shall be imposed for the delayed period. e) Recovery of Rs 50/- per man per shift for non wearing of uniform on duty will be made (This shall be applicable after disbursement of uniform). g) The contractor has to deposit PF & ESI as applicable to their staff

3.22. Uniform:-

The contractor shall provide uniform with firm’s name of approved quality and color to his staff deployed . No extra payments shall be made in this regard. The workmen will attend duty only in the neat and clean approved uniform. It is the responsibility of the contractor to issue the required number of uniform sets to the worker(s) during the execution of the contract. The disbursement of stitched uniform including shoes has to be ensured by the agency within one month time from date of issue of award letter. Failing which, the recovery shall be made against non wearing of the uniform as per relevant penalty clause.

4.0 SPECIAL CONDITIONS OF CONTRACT 4.1 DURATION OF CONTRACT

The duration of contract shall be of one (1) year by the client from the date of Letter of Intent. However, the contract can be extended twice for the duration of one year each at rate quoted in the price bid. Such extension shall be done after review of the contractors' performance during the duration of contract and shall be at sole discretion of the client.

4.2 TERMS OF PAYMENT a) Contractor shall be paid his charges for his work monthly after completion of every month after submission of monthly bill. The bills and registers shall be sent for verification and payment to the Admn. Division of our Centre. b) However, the final value of the entire work shall be worked out and paid to you to the extent the work actually carried out by you as assigned and verified jointly. c) Deductions, if any, shall be made as recommended by Admn. Officer(PA&F) for non – compliance of work.

4.3. UP TIME CLAUSE-

The uptime of all the equipment operated & maintained shall be more than 95% calculated on a monthly basis. The penalties for deviation on the above point will be as under-

1) Slab A – between 95% - 90% : 5% of monthly AMC charges. 2) Slab B – between 90% - 80% : 10% of monthly AMC charges. 3) Slab C– below 80% : 25% of monthly AMC charges.

The response time for the contractor to provide alternative / satisfactory solution 8 hours. 4.4. LETTERS FROM EQUIPMENT MANUFACTURER / AGENCY -

The tenderer before submitting the tender shall visit the site & study the makes of all installed equipment and shall submit from all the manufacturers / agency guarantee letter for providing necessary spares & technical back-up required for maintaining the equipment.

4.5. MEMORANDUM OF UNDERSTANDING WITH EQUIPMENT MANUFACTURER / AGENCY - The tenderer shall submit MOU with all the manufacturers/agency clearly stating that the contractor is capable of maintaining the equipments supplied by them & installed at said site of work and shall provide the bidder all required back-up in terms of spare, specialized tools & tackles required & any other technical service necessary to operate & maintain the equipment.

4.6 PERFORMANCE BANK GUARANTEE(SECURITY DEPOSIT)

The successful bidder shall submit a Performance Bank Guarantee of 10% (approx.) of Annual Contract Value from an approved nationalized bank valid for 60 days beyond the duration of the contract. The performance bank guarantee shall be submitted within 15 Days of issuance of letter of intent.

7.0 SCOPE OF WORK

The scope of work for various equipment is as follows and as recommended by the manufacturer of the respective equipment. This scope of work is indicative only and for the reference of Tenderer but this will not be limited to perform & maintain the entire utility services. The contractor is responsible & liable for complete and efficient operation & maintenance contract. 7.1 PUMPS A) DAILY 1. Checking and necessary action for rectification for gland leakages. 2. Checking and necessary action for rectification for abnormal noise. 3. Check the position of inlet and outlet valves for normal operation 4. Check inlet and outlet pressure of the pump.

B) MONTHLY 5. Checking of current and logging the same. 6. Cleaning of strainers, repair/replace if required. 7. Check and necessary action on condition of love joy coupling. C) HALF YEARLY 8. Dusting of the externals of the pump/motor. 9. Checking of the terminal connections of pump/motor. 10. Checking the pump foundation and advice customer for repairs as and when

required. 11. Checking of lubricants, topping up if required. 12. Check earthing connection of the pump/motor. D) YEARLY 13. Inspection of impeller, shaft, sleeve and bearing during overhauling. Replace/repair if

required, customer to supply for necessary material. BREAK DOWN MAINTENANCE

Any type of break down maintenance exclusive of all required material spares & consumables.

7.2 VALVES AND PIPING MAINTENANCE VALVES 1. Quarterly opening and closing. 2. Periodical check for by passing, replace the liner and rectify. 3. Repair of insulation on the valve.

SCHEDULE OF MAINTENANCE & CHECK LIST FOR FIRE FIGHTING SYSTEM Daily Check for Glands of pump for any water leakage. Check general cleanliness of the installations and its surroundings. Check the system pressure Monthly Check the operation of jockey pump by releasing some pressure from the line Check automatic stoppage of Jockey pump after building up of the pressure. Check auto and manual operation of main pump and diesel engine operated pump. Check abnormal noise or vibration and conditioning of coupling in all the motor pump set. Inspect Shaft, shaft sleeves/bearings, bearing housing fabrication/greasing by grease gun. Check abnormal heating of motor & pump/shaft/bearing during test runs. Tighten all the cables and terminations at motor i/c proper positioning of the cable gland cover/ box Tighten all the earth connections and terminations. Check all the hydrants are equipped with hose real, hose pipe & locked (Key available with Engg. & Fire department) Check the battery of DG set regularly for termination and Tightness, application of petroleum jelly and battery charging arrangement i/c water pouring etc. Quarterly Carry out Dummy test run of the system to check the operation of the system as whole. Cary out periodical maintenance of Diesel Engine as per engine manufacturer’s manual Half Yearly Carry out Periodically maintenance of Diesel Engine as per engine manufacturers manual. Yearly Carry out Periodically maintenance of Diesel Engine as per engine manufacturers manual. Measure and record IR value of Incoming cables and outgoing cables of Elect. Panel Check for Painting requirements. Note:- These activities and periodicity are minimum. Any missing activities can be incorporated and implemented.
