THIS TENDER FORM IS TO BE DULY SIGNED AND ENCLOSED ALONG WITH THE TENDER

1. Sealed Tenders are invited by the Director, Tata Memorial Centre, Dr. Ernest Borges Marg, Parel, Mumbai 400 012, for Outsourcing the services of Maintenance, Housekeeping & Catering Services for TMC PG Hostel & Guest House at Anushaktinagar &Paylipada on contract basis.

2. Tenderers are required to sign the Terms & Conditions of the tender and submit along with the tender.

3. Tenders for Outsourcing the services of Maintenance, Housekeeping & Catering Services for TMC PG Hostel & Guest House at Anushaktinagar &Paylipada on contract basis should be submitted in two parts, in two sealed envelopes duly super-scribed as “TENDER FOR OUTSOURCING THE SERVICES OF MAINTENANCE, HOUSEKEEPING & CATERING SERVICES FOR TMC PG HOSTEL & GUEST HOUSE AT ANUSHAKTINAGAR & PAYLIPADA ON RATE CONTRACT BASIS FOR ONE YEAR - 01/09/2016 to 31/08/2017”. Due Date and E.M.D. Receipt No. needs to be mentioned on both Part - I / Part - II. Part - I containing technical bids in complete details, requisite & other relevant documents and original

E.M.D Receipt. Part - II containing price bid.

Both Part – I and Part – II tenders addressed to the Director, Tata Memorial Centre, Dr. Earnest Borges Marg, Parel, Mumbai 400012 should reach Purchase Department on or before 22-08-2016 till 12.00noon. Please note that Tenders which are received late will not be considered.

4. The Part I Technical Bid will be opened on same day i.e. 22-08-2016 at 2.00pm onwards in front of those Tenderers who wish to be present.

5. Pre-bid meeting will be held on 25-07-2016 at 11.00am in the Purchase Department, TMH, interested bidders may present on the said date and time.

6. All Micro-Small & Medium Enterprises Units (MSME) including National Small Industries Corporation (NSIC) will be exempted from paying Tender Fee, Earnest Money Deposit (EMD) & Security Deposit as applicable, subject the above services should be specified in the NSIC Certificates. If wrong NSIC or invalid Certificate produced in avoidance of fees, tender will be treated as invalid.

7. It is not composite tender and will not be possible to split the Contract for above said scope of work for any reasons.

8. Time and date of opening of Part II- Price Bid will be intimated only to the tenderers who are qualified after evaluation of Part I- (Technical Bid) i.e Part II of the tenders will be opened on a date to be intimated later, only if Part I of the bid is technically accepted.

9. No tender will be accepted unless the full amount of tender document charges and Ernest Money deposit of Rs.3,00,000/- (Rs. Three Lakh Only) paid. The Earnest money deposit must be paid in cash or by Demand Draft drawn in favour of Tata Memorial Hospital, payable at Mumbai. Deposit cash or Demand Draft on cash counter, 1st floor, Homi Bhabha Block, TMH and obtain receipt from cash counter. Original receipt of the same receipt must be enclosed along with the tender document (Technical Bid Part-I). The EMD Receipt number and date should be mentioned on the envelopes (i.e. Technical Bid Part-I & Price Bid part –II). The copy of the money receipt must be kept with the vendor and to be shown at the time of tender submission.

10. It is responsibility of the Tenderers to see that the completed bidding documents are deposited in the Tender box kept inside the Purchase Department, 4 th Floor, Service Block, Tata Memorial Hospital, Parel, Mumbai 400 012 on or before the date and time mentioned above for submission of tender, failing which the bid would be considered late and rejected. Mere handing over of the bidding documents at reception or at any other counter or room or person cannot be considered as submission of bid.

11. Tenders submitted in other places in time but not reached purchase department before schedule time will not be accepted.

12. Vendors shall quote firm offers. Conditional offers shall not be considered.13. Tenderer must fulfill the vendor capability proforma giving all the requisite details, submit all required

documents mentioned and return back duly signed.14. If at any later date, it is found that the documents and certificates submitted by the Contractor are forged or

have been manipulated, the work order issued to the Contractor shall be cancelled and EMD/ Security Deposit issued to the TMH shall be forfeited without any claim whatsoever on TMH.

15. The tenderer should be able to cope up with total scope of work mentioned in the terms & condition and 1

DR.E.BORGES ROAD, PAREL, MUMBAI-400 012should also have at least three years experience of such scope of work in a reputed organization-preferably an academic or a medical institution (as specified in Technical Bid). Suitable documentary evidence in the form of a letter from the concerned organization should be submitted along with the tender documents. Bids not complying with this condition will be summarily rejected. Tenderer should not be blacklisted in any of the Organization in any of the previous years. No criminal cases filed on Tenderer regarding food poisoning, harassments, etc

16. The Director, (TMC) reserves right to: Reject any or all of the tenders without assigning any reason at any stage. At his sole discretion reject all or any of the tenders without assigning any reason for the same.

The contractors must fill in the tenders strictly in conformity with the instructions given with the schedule, failing which, their tenders are liable to be rejected.

May terminate the contract without assigning any reason with one month’s notice to the caterer. Rejection of offer if found incomplete with regard to the required information regarding scope of work. Reviews of the services performed by the contractor and ask for any clarification and

changes/modifications to the services performed by the contractor. Such changes shall be mutually discussed and agreed upon between TMH and contractor and the same shall be incorporated by the contractor in the work without any dilution of the responsibility of the contractor.

The Contract shall be initially for one year. TMH reserves the right to extend the Contract subject to satisfactory performance of the Contractor as may be mutually agreed to.

To visit any of the places mentioned by the Contractor where he carries similar scope of services in the Tender for On-Site Technical Inspection to assess the workmanship, set up, etc before technically accepting tenderers technical quote.

TECHNICAL BID INSTRUCTIONS TO TENDERER DEFINITIONS:1. Invitation to Tender shall mean and include the document for the above job described in the Scope of work

and such other supplements and agenda which may be issued in connection with the present request for tender.

2. The term “TMC” shall mean Tata Memorial Centre having its Registered Office at E Borges Marg, Parel, Mumbai-400 012 and shall include Officers authorized to deal with all matters relating to contract.

3. Tenderer shall mean the person, firm or corporation submitting tender against the request for the tenders and shall include his legal representatives/heirs.

4. Contractor shall mean person, firm or company with whom a contract is placed and shall be deemed to include their representatives permitted assignees, legal heirs, executors, administrators and successors.

5. The Purchase Officer shall mean the officer so designated or duly authorized officer placing the Work Order with contractor.

6. Guest House shall mean the TMC Guest House & P.G.Hostel located at Anushakti Nagar, and Paylipada.

INSTRUCTIONS FOR SUBMISSION OF TENDER1. Tenderer shall offer their quotations in the prescribed tender forms, in figures as well as in words. Erasures or

corrections in figures without Tenderer’s initials will render the tender liable for rejection. Amount in tenders expressed in words will be treated as correct even if the figures are incorrect or overwritten. Financial bid submitted with the technical bid will be rejected.

2. On site visit will be carried out for on-site technical inspection to assess the workmanship, set up, etc before technically accepting Tenderers technical quote.

3. The Tenderer should visit the site at his own cost and expenses and get acquainted with the work load involved, facilities and other details. TMH will not be responsible for any misunderstanding developed later on.

4. Technical Parameter for technical selection:A. The tenderer should be able to cope up with total scope of work mentioned in the terms & condition and

should also have at least three years experience of such scope of work in a reputed organization-preferably an academic or a medical institution as follows:

a. Two works where he is currently carrying out the said scope of services should not be less than Rs. 80.00 lakh per annum per work.

Any tender received after closing date & time is liable to be rejected without assigning any reason. 10. Each Tenderer must himself make aware of the conditions under which the services are to be performed

before submitting a Tender. Tenderer should carefully examine all the information as may be furnished in writing and should fully be conversant with all existing conditions, limitations and Central Government/State Government, Local body Regulations.

11. Tenders should be submitted in Purchase Department or put in drop box available at Purchase Department. Tenders submitted in other places in time but not reached Purchase Department before schedule time will not be accepted.

12. If a firm quotes ‘NIL’ charges/consideration, the bid shall be treated as unresponsive and will not be considered. Compliance report on technical bids be clear. If tenderer not quoted or put dash (-) or ‘NA’ then it will be presumed that quoted price includes those item cost.

13. Vendors must fulfill the vendor capability proforma giving all the requisite details, submit all required documents mentioned and return back duly signed.

14. The Tenders must be accompanied by the following documents wherever necessary: Vendor capability Proforma form a duly filled, singed & stamped enclosed with these tender documents. Name and address with their residential addresses and telephone no., Mobile nos of Proprietor and all

Accountant for last three years Copy of Certificate of License contract issued Central Labor Commissioner Fire certificate from Appropriate Authority, if required as per rules.

15. It will be the sole responsibility of the Contractor to abide by the provisions of the following acts as to the workers engaged by him for performance of this contract: Employment of Children Act Workmen compensation Act Employment of Labor/ Contract Labor Act Industrial Employment Act Contract labor Abolition and Regulation Act 1970 Minimum Wages Act Employee Provident Fund Act Any other act or legislation which may govern the nature of the contract. Any other law or act or rule as may be forced and made applicable to the workmen/supervisor/other

persons as may be deployed by the contractor for carrying out the assigned jobs involving use of skilled, semi-skilled or unskilled workers.

16. The tenderer are requested to fill in the rates duly typewritten against each item of the schedule. Only one rate should be filled in against each item. The Rates should be legibly written. Erasures and correction in figures without the Bidder’s initials will tend the Tender, liable for rejection.

17. Only the items mentioned in Regular item list provided shall be considered for evaluation and award of Contract.

18. Every Tender must remain open for acceptance for 90 days from the date of opening of the Tender.13 The Tenderer/Contractor should furnish along with tender a Notary affidavit on Non judicial stamp paper

of Rs. 100/- stating their in as under:a. Tenderer should not be blacklisted in any of the Organization in any of the previous years. No

criminal cases filed on Tenderer regarding food poisoning, harassments, etcb. That no case pending against them in court of law, or that no time they were penalized by any court

of Law or Regulatory Authorityc. That the firm has been manufacturing and marketing the quoted products for more than three

consecutive financial years.d. That the firm is never being blacklisted/penalized/defaulted by any government institution/Hospitals

with in last 5 years.e. That the firm has deposited up to date Sales Tax and Income Tax (Attach copy of clearance/Return

certificate).f. That the rates quoted by the firm are the lowest and not higher than the wholesale market

rates/quoted in any other Institution or Hospitals. Rates have been checked by me/us and if approved shall supply that items in the specified period.

g. That the firm is having its manufacturing unit as per norms of revised schedule “M” of the Drugs Act & is having GMP/WHO-GMP/IPF/USFDA/CEE/ISO/DGQA certificate valid till date. (Mention whichever is applicable).

N.B. The affidavit must be as per the details mentioned above. Any changes in the text matter are not accepted & TMH reserves the right to reject such offers.

Tenderers must distinctly understand:- That they will be strictly required to conform to the conditions of the Contract as contained in each of its

clauses and that the plea of "CUSTOM PREVAILING" will not on any account be admitted as an excuse on their infringement of any of the conditions.

That the full Contract Deposit must be paid within the time specified and the Contract must be signed on or before the date fixed and intimated in writing to the successful Bidder.

That a postponement of the payment of the full Security Deposit for the execution of the Contract will not be permitted, by reason of the Director having in his possession other Deposits, on account of other Tenders or Contracts, which deposits may be or become returnable to the Bidder and which they may wish to transfer as Deposit under this Contract. Such transfers will not under any circumstances be permitted.

DR.E.BORGES ROAD, PAREL, MUMBAI-400 012COMPENSATION FOR SUBMISSION OF TENDER 1. The Tenderer shall not be entitled to claim any costs, charges, expenses for the incidental to or in connection

with the preparation and submission of his tender under any circumstances, including if the invitation to tender is cancelled by TMC.

2. The successful Tenderer shall submit before entering into the contract the name, permanent and present address, age, qualification, experience and two passport size photographs of all employees proposed to be placed at Guest House to Administration Department. No changes or reduction to the strength of employees shall be made without the permission of Officer in Charge of the Guest House.

EMD, SECURITY DEPOSIT, ETC. EARNEST MONEY DEPOSIT:

All Tenders must be accompanied by Earnest Money Deposit of specified amount in the form of Demand Draft drawn on nationalized bank. EMD will be refunded to unsuccessful Tenderer within 30 days from the date the original receipt is submitted by the Tenderer, after award of the contract without any interest. The quotation should remain valid for 120 days from the date of opening of price quotations.

FORFEITURE OF THE E. M. D. If for any reason whatsoever any bidder withdraws his bid at any time prior to expiry of the validity period or after issue of the Letter of Intent/Work Order or refuses to execute the Work Order or furnish the Security Deposit and Performance Guarantee for faithful performance of the contract within the stipulated time, the amount of E.M.D. shall be forfeited by TMC.

SECURITY DEPOSIT: The Contractor shall be required to deposit an amount equal to 5% of the contract value as Performance Security within 15 days from the date of award of contract. The remaining 5% of the security deposit will be collected by TMC by deductions from the monthly bills of the contractor at the rate of 10% of the monthly bill till the sum amounts to 5% of the contract value. The Performance Security is accepted in the form of Cash/ Demand Draft / Unconditional Bank guarantee issued by any Nationalized Bank situated at Mumbai. The Security Deposit shall be released only after one month from the date of expiry of the contract after deducting outstanding dues, if any subject to satisfactory of work. TMC reserves the right to recover any statutory dues or other dues such as EMD, Security Deposit of the Contractor

SCOPE OF WORK OF THE CONTRACTOR Kindly refer to the Scope of the work attached here with. The Contractor is required to maintain Front Office Services, Housekeeping Services, Food Production Services and F & B Services along with day to day soft Maintenance of Civil, Plumbing, Electrical Maintenance & Carpentry jobs. The Contractor may also require to employ Office Staff and Storekeeper.

CONTRACTOR’S RESPONSIBILITIES:The contractor shall be responsible and liable for the following activities:1. The contractor will have to arrange for recovery of occupancy charges of Guest House on daily basis as per

the tariff decided by TMC and will have to give daily Statement of account to Accounts Officer (Cash) through the Guesthouse In-charge and deposit the same in TMC Account

2. The contractor will have to maintain register with details of occupants. This should be in conformity with Laws of States and Central Government in general and relating to Foreign Nationals in particular.

3. The contractor will be responsible for shortages like loss of furniture, electrical fittings, sanitary and any other items used/fitted in the Guest House. He will be liable to pay for the loss and damage of any item handed over to him by TMC, which are lost and damaged during the period of contract.

4. The contractor shall be liable to TMC for any act of commission or omission on his part or on the part of his employees thereby causing any loss, damages or inconvenience to Guests or TMC.

5. The contractor will have his employees who should be thoroughly trained in the respective jobs and be able to understand and speak English, Hindi or Marathi.

6. The contractor should provide for washing of occupant’s clothes and laundering on chargeable basis.7. The contractor will have to arrange and maintain First Aid Box with valid medical kit for the occupants/his

employees and shall replenish items as may be required, in the said First Aid Box. 8. It will be Contractor sole responsibility to pay monthly wages to his employees which shall not be less than

the wages prescribed under the Minimum wages act.9. Contractor will have to obtain Registration Certificate from the Food Safety and Security Authority of India.

DR.E.BORGES ROAD, PAREL, MUMBAI-400 01210. It will be sole responsibility to insure his staff to be deployed for the above scope of services. The centre shall

not pay any compensation in respect of any injury or death caused to the workers of the Contractor. It will be the sole responsibility of the Contractor under the applicable law/ rules.

11. The centre shall not responsible for any loss, breakages or theft of Contractor material for which he has to make his own arrangement for storage.

12. The Contractor shall be liable to pay compensation for any loss and damage caused to the property of the TMH or its patients by the Contractor or by his workers as property belongs to TMC either on lease hold or freehold.

13. The event of the Contractor failing to execute the work under contract in whole or in part an alternative arrangement will be made by the TMH totally at the cost and risk of Contractor besides any suitable fine /penalty.

14. All branded items mentioned in the annexure should have batch number, manufacturing and expiry date thereon on each packet.

15. The Contractor should have Registration No. under the EPF Act 1952 and Registration No. under the ESI Act and must hold a labour license from the competent authority and Maharashtra Professional Tax.

16. The Contractor shall not have any claim for compensation by reason of any alteration having been made in the original scope of work which shall involve any curtailment of the work as originally contemplated.

17. No person engaged or involved in this contract should disclose any matter pertaining to the Department to any third party in particular any information identified as proprietary in name that be kept strictly confidential and shall not be disclosed to any third party without written consent the original disclosing party.

18. The Institution Campus is a “NO SMOKING ZONE”, hence sale and use of tobacco is prohibited. 19. The sale and use of Liquor (alcohol) is also strictly prohibited in all the PG Hostel area and premises. 20. The Contractor should use AGMARK/F.P.O. or such standard quality food articles approved by relevant

regulatory authorities. Certificate in this regard should be displayed prominently in the premises. 21. The Contractor will secure and submit to TMH all applicable Licenses for running the PG Hostels within 21

days of award of work or commencement of work, whichever is earlier. 22. No child labour shall be deployed. The Caterer shall employ only those persons in all the PG Hostels who are

found medically fit. Vendors should submit fitness of food handlers in the Performa attached (Annexure A) and a general fitness from Medical Practioner for the staff employed other than cafeteria. Tata Memorial Hospital reserves its rights to examine any of the employees for medical fitness. Expenses, if any incurred by the TMC on medical examination of such employees, shall be borne and paid by the Caterer.

23. The Contractor shall not bring or cook or permit drinking or cooking in the hostel of beef or bacon, or permit the skinning of animal. Under any circumstances, the Contractor shall not bring and serve outside cooked food like Chapatis, Puris.

24. The Contractor shall abide also by the rules and regulations of rationing authorities, municipal Bye-laws, rules and regulations and also by the laws of the state in force from time to time relating to sale of articles of food.

25. The dealings of the Contractor and his employees with the customers shall be polite. The Contractor shall while the agreement is in force, keep a complaint book in a conspicuous place in the respective PG Hostel’s in which the complaints may be recorded and which shall be opened for inspection by the TMC management, for the purpose.

26. The Contractor shall not permit or exhibit in the said building, printed or written Notices or Advertisements of any kind whatsoever without the previous written permission of TMC management.

27. The Contractor shall comply with any other instructions which may be issued from time to time by the TMC management.

28. All disputes relating to this tender can be legally resolved through courts in Mumbai only.

FACILITIES PROVIDED BY TMCTMC will provide all capital items and the Contractor will provide all consumable. For Guest House, all linen etc. will be provided by TMC. For Kitchen all the Capital items will be provided by TMH. The Contractor is required to provide all groceries, Cutlery, Crockery, Chafing Dishes. The Contractor will charge the Guests for the Catering Services directly as per the rate list.

RATES 1. The Tenderer should submit his quotation for all items as mentioned in Annexure- I & II. The rates quoted

should include the cost of food (breakfast, lunch and dinner on all working days as well as on Sundays & Holidays) for 400 persons- inclusive of transportation, loading, checking, taxes and octroi duties by any State/Central Government/Local body.

2. The Contract will be a fixed contract and the rates shall remain firm on any account, without any escalation during the tenure of the said Contract

THE TERMS OF PAYMENT1. 100% by progressive monthly bills on completed work certified by Officer-in-charge with in fifteen days after

the submission of the monthly bills. It is the responsibility of the contractor to ensure compliance of all the law relating to the contract both with regard to its execution and hiring of man power, Certification that the Minimum Wages Act, PF, ESIC etc are compiled with should be submitted. PF & ESI Challan of previous month and wage sheet of the current month. First monthly bill may be accepted without any PF & ESI Challan. The Bills may be submitted after the payment of wages to the staff every month. Since this is a lump sum work, the rates shall be firm during the currency of the contract.

2. Wages should be paid through Cheque/NEFT to employees and Contractor must submit proof of payment of wages along with bills. Wages in cash will not be accepted.

3. Income tax will be recovered at prevailing rate from the payment as per Income Tax Act and certificate for the deduction of tax will be issued by TMC.

4. The Contractor should have the FSSAI Registration and should follow the FSSAI Guidelines once the work is awarded.

TENURE OF CONTRACT 1. The contractor must start the work immediately after award of the contract or from such date as mentioned in

the Work Order. 2. Initially the Work Order will be issue for 1 year and the same can be extended for further period of one year

on same terms & conditions subject to the satisfactory performance and at sole discretion of Management.

THOSE CONTRACTORS WHO ARE AWARDED THE ABOVE SAID CONTRACT:a. Will be kept on probation for a period of six months from the date of commencement of contract.b. Will be required to maintain highest level of cleanliness and standard of hygiene with regard to the persons

under his employment and utensils for serving the food. c. The Contractor need to pay attention to foods not to be waste.d. The personnel appointed by the Contractor must have proper and clean uniform for their identification. The

personnel appointed should have the basic knowledge of personal hygiene and safe and clean method of food handling; they should be of good character and decent behavior. They should be provided with appropriate ID Cards by the contractor.

e. The quality of the raw materials to be used for preparation of food in the Hostel Kitchen should be of highest standard and fresh.

f. The Contractor will be responsible for maintaining adequate number of persons engaged in cooking, distribution of food and disposal of garbage and left over food.

g. The Contractor should keep the complex clean and free of any insects, cockroaches, etc., at any given time. If, at any point the premise is found to be unclean, the Contractor shall be held responsible and action deemed fit shall be taken by the Director, TMC including levies of appropriate penalties.

h. Will be required to deploy the manpower and start the work within seven days from the date of award / date of communication of acceptance of the tender. In case it is found that the work has not been taken up within seven days from the date of acceptance of the tender or issue of the work order, the TMH at its sole discretion may cancel the work order and forfeit the earnest money deposit, deposited along with tender without any reference to the Contractor.

i. Should all the time be available at work site during the course of his work.j. Shall personally be responsible for the conduct of his staff and in case of any complaint against any staff;

Contractor will be under obligation to change the workers when instructed by authority. The contractor shall observe all the laws and will be responsible for any prosecution or liability arising from breach of any of those laws. The TMH will not hold any responsibility with regard to staff on the role of the contractor whatsoever.

k. Will be subject to "Force Majeure" clause as per section 56 of the Indian Contract Act.l. Shall be incumbent on the successful vendor to pay stamp duty on the contract.m. Will be required to post skilled manpower as may be needed to supervise and guide the workers-skilled,

semi-skilled as well as unskilled/ trained for proper completion of the work as per directions of the Officer

n. The employee engaged by the contractor shall not use TMH’s name for any publicity purpose through any public media like Press, Radio, Television or Internet, without the prior approval of Director, TMC.

o. Shall take an insurance policy for an appropriate value for insurance against damage/loss due to fire accident in the Hostel Premise and copy of premium paid shall be submitted to TMC within 1 week from the date of payment.

p. The contractor shall be responsible for removal/disposal of garbage generated in the Hostel Premise. q. Contractor shall carry out the work in close co-ordination with the department. If any dispute arises in this

regard the decision of the In-charge of work shall be final and binding on you.r. The Contractor will vacate and hand over the possession of the premises on the expiry of the term of the

contract or on termination of the contract. If the Contractor fails to vacate the premises on stipulated date or on direction then damage charges for the overstay at the rate of Rs. 10000/- (Rupees Ten thousand) per day will be recovered from the Contractor out of the

COMPLIANCE OF STATUTORY NORMS:a. The Institute is registered in terms of the Contract Labour (Regulation and Abolition) Act, 1970 with the

Registering Officer under the Regional Labour Commissioner (state). As such, the service provider shall be required to obtain requisite license from the office of the Regional Labour Commissioner (state) under the aforementioned Act.

b. The contractor shall have his own set-up including registration under the relevant laws governing the type of work he is to perform.

c. The contractor shall abide by all the rules and regulations of the labour laws and rules framed there under and maintain all the registers required under the above mentioned Act, Rules and regulations, including the Contract Labour (Regulation and Abolition) Act, 1970.

d. The contractor shall be wholly responsible for the payment of minimum wages to his workers. As and when the minimum wage rate is changed by the Central Government, the contractor shall have to pay the revised rate to his workers as on that date.

e. The contractor shall be liable to comply with the Employees’ State Insurance (ESI) Act, 1948 and Employees’ Provident Fund (EPF) and Miscellaneous Act, 1952 and Maharashtra Professional Tax.

f. The contractor shall be liable to deduct the employees’ contribution of EPF and ESI and deposit the same along with the his part of the contribution of EPF and ESI to the respective authorities within the statutory periods and shall provide a signed copy of the deposit challan to the institute within one week of depositing the same to the respective authorities. The service provider shall regularly maintain proper record in this regard, which can be inspected by the appropriate authority of the institute at any time.

g. If Contractor obtain declaration from employee regarding non-deduction of Provident Fund as per CPF rules, contractor need to submit copy of declaration to TMC at the time of awarding Contract

h. The contractor shall pay wages directly to the workmen without any intervention of any labour contractor. The contractor shall also ensure that no amount by way of commission or otherwise is deducted from the wages of the workmen.

i. The contractor shall be solely responsible with regard to the supervision, salary/wages, and service conditions in respect of his employees/workmen, which shall be fair and in no case be less than the wages prescribed by the Central Labour Commissioner under the Minimum Wages act as in force from time to time.

j. The contractor shall, within 14 days from the date of issue of work order will apply to the Assistant Labor Commissioner for Labor License for the maximum number of workers he intent to engage on work. A copy of the application has to be furnished to the Engineer in Charge of the work.

k. All the liabilities arising out of any provision of Labour Acts in force and enacted/ amendment from time to time during the execution of contract shall be contractor’s responsibility. Any expenditure incurred by TMC to face the situation arising out of the negligence on the part of the contractors or on the part of their laborers shall be to the contractor’s accounts and recovered from the contractor’s dues.

LIQUIDATED DAMAGES/PENALTIES . If the Contractor fails in the due performance of his contract within the time fixed by the TMC, the Contractor will be levied liquidated damages/penalties at the rates given below this will be deducted from the monthly bills: Unclean and unhygienic condition of kitchen and dining hall at the rate of Rs. 1,000/- at a time. Not wearing of proper uniform by the Contractor’s staff Rs. 500/- per instance per person.

DR.E.BORGES ROAD, PAREL, MUMBAI-400 012 Bad quality and insufficient quantity of food, snacks, tea etc. or not providing of requisitioned items, Rs.

500/- per instance. If any guest room is not provided with soap, toilet paper and for poor up-keep, a fine of Rs. 500/- will be

charged per room per instance. At the time of Breakfast, lunch/dinner; presence of supervisor to be ensured by the contractor, failing which a

fine of Rs. 500/- per day per shift will be charged. Not providing quality items or absence of Supervisory staff during VIP visits, Rs. 1,500/-per incidence will be

charged. To stop the sale of expiry date food articles in the Hostel Cafeteria. If found at any time the same will be

destroyed by the TMH Management at our own discretion. To stop the service rendered by the Contractor in the Hostel Cafeteria which is not of the requisite standard

or found to be unsatisfactory on the grounds of providing poor quality food, unhygienic atmosphere management can terminate the contract by giving one month’s notice.

TMC management shall demand and be supplied with a sample of any article of food or drinks sold or intended for sale free of cost for inspection and analysis.

If any inspection or in the analysis, it is proved to the satisfaction of TMC management, whose decision shall be final, the articles of service rendered by the Caterer is not of the requisite standard, the caterer shall be liable to pay to the TMC a sum not exceeding Rs.1000/- as may be determined by TMC management, as liquidated damages each time.

If any document or evidence of statutory dues as mentioned in the tender document not submitted to TMC, Contractor will be liable to pay penalty as per management decision.

TMC has right to recover any dues or excess payment from bills of the Contractor.

CANCELLATION OF CONTRACT Director, TMC reserves the right to cancel the contract or any part thereof by giving one month’s notice and shall be entitled to rescind the contract wholly or in part by a written letter to the Contractor if :1. The Contractor does not adhere to any terms and conditions of the contract including general and special

terms and conditions and the conditions imposed from time to time.2. The quality of service and the supply/part supply of food is poor or not in conformity with the requirement.3. The contractor or his employees indulges in any corrupt practices and the Guest House premises are

misused.4. Notwithstanding anything contained above, TMC reserves the right to cancel the contract and forthwith

forfeit EMD and/or Security Deposit and get the job done by a third party in part or in full at the risk and cost of the contractor. TMC also retains the option of debarring the contractor from participating in future tenders for a specific period. Payment for the work completed at the time of termination of the contract shall be made as per the terms of the contract.

5. Upon receipt of said cancellation notice, the Contractor shall discontinue all work on the contract and matters concerned with it.

TERMINATION OF CONTRACT FOR CONVENIENCE:Director, TMC may also by a written notice sent to the Contractor, terminate the contract, in whole or in part, at any time for their convenience. The notice of termination shall specify that termination is for TMC’s convenience, the extent to which performance of work under the contract is terminated and date upon which such termination becomes effective. The works that are complete, at the time of receipt of notice of termination shall be taken over by TMC or its authorized agency at the contract terms and prices. For the balance work TMC may opt: To have any portion completed at the contract terms and conditions. To cancel the remaining work and pay to the contractor an agreed amount for material brought to work site

for execution of work.

FORCE MAJEUREThe force majeure conditions are as under:“Neither the Contractor nor TMH shall be considered in default in performance of their contract, as long as such performance is prevented or delayed because of legal strikes, war, hostilities revolution, civil commotion, epidemics, accidents, fire, cyclone, flood, or because of any Law & Order proclamation, regulation or ordinance of Government or sub-division thereof or because of any Act of God, provided it shall promptly in any case not later than 14 days of happening of the event, notify the other, the details of the Force Majeure and

TMC’s LIEN ON ALL MONEY DUE TMC shall have a lien on and over all or any money that may become due and payable to the contractor under these present, and/or also on and over the deposit Security Deposit amount or amount made under the contract and which may become repayable to the contractor under the conditions in that behalf herein contained for or in respect of any debt or sum that may become due and payable to TMC by the contractor either this or under any other contract or transaction of any nature whatsoever between TMC and the contractor. And further that TMC shall at all times be entitled to deduct that paid debt or amount due from the contractor from Security Deposit or bill, which may become payable to the contractor under these conditions.

SUBLETTING OF CONTRACT The contractor shall not sublet /subcontract the job or part of it to any other agency without the written permission of Director, TMC. In case Director, TMC permits to employ sub contractor, if found competent and in the interest of the work, it shall not imply any limitation of contractor’s liability to fulfill the work order.

ArbitrationIf any dispute arises out of the transaction in any manner that shall be resolved by the sole arbitrator, to be appointed by the Director, TMC and the contractor/vendor undertakes that he shall accept such appointment even if the sole arbitrator shall be an employee of TMC. In case such person is not acceptable to the Contractor/Vendor, Director, TMC shall be the final and sole arbitrator and award given by him shall be final and binding on the parties.

Governing Law: The Law in force in India, from time to time shall only have application, and the courts in Mumbai shall have exclusive Jurisdiction to adjudicate the disputes/differences arising out of this contract.

JURISDICTION OF COURTNo compensation will be entertained for the liabilities arising out of any provisions of any Act, Laws, Rules and Legislation, in force from time to time. In case TMC has to pay any charges for non-compliance of any Act, Enactment, Laws, Rules and Legislation enforcement from time to time, by the contractor, the same shall be recovered from the contractor.

OTHER TERMS AND CONDITIONS: 1. UNIFORM : - Contractor’s staff will be in neat & clean uniform while on duty which is appropriate for

catering/hotel industry and will be arranged and maintained by the contractor at his cost. 2. No person other than the contractor’s workmen and their authorized agents shall be allowed to work at the

Guest House in connection with work, except with special permission in writing from the Officer- in-charge. 3. The TMH assumes no responsibility for death, disablement, injury or accident to persons employed by the

contractor which may arise out of and in course of their duties with company due to lack of safety related issues. TMH shall not be liable to pay any damage or compensation to contractor’s employees.

4. Security Deposit will be released only after one month from the date of expiry of contract.5. The contractor has to pay all legal dues before making application for release of security deposit. Any short

fall noted on this account will be recovered from the Security Deposit of the contractor. 6. In case of acceptance of the offer, the contractor will have to abide by the contract Labour(Regulation and

Abolition) act 1970 and the Contract Labour (Regulation and Abolition) Central Rules 1971. On award of the contract, Contractor has to obtain Labour License from the Office of the Dy. 7. Quotation should be submitted in the specified manner only.8. Canvassing in connection with tenders is strictly prohibited. Tenders submitted by the contractors who resort

to canvassing will be rejected outright. 9. The Contractor shall ensure that at all times the persons appointed by him to serve in the company’s

premises are physically fit and are free from any disease, injury or illness or otherwise in order to ensure that healthy hygienic and clean services are maintained.

10. The service conditions of workmen/labour/ staff employed at Guest House by Contractor will be governed by applicable labour laws and other prevailing legislations and enactments and Central and State Acts & Rules.

authorised working hours. 12. All staff employed by the Contractor shall be the contractor’s employees for all intent and purposes.

SAFETY MEASURES:1. Contractor shall have to observe all the safety practices as required and shall provide safety wear for his

workmen at his cost. Contractor and his employees should observe all safety arrangements of guest house as informed from time to time. The Contractor has to ensure safety of his materials, equipments, tools & tackles, etc.

2. In case of any accident requiring medical attendance, first-aid, the same shall be reported immediately to the Officer In charge for necessary medical attention and other statutory formalities.

3. The Contractor shall abide by all the directives of and statutory bodies regarding safety of his workers and materials.

4. The Contractor shall be solely responsible for any damages to the machinery, equipments and property of TMH due to negligence of his staff. Suitable amount will be deducted from the monthly bill of the contractor.

5. The successful Tenderer will be required to enter into an Agreement on non judicial stamp paper of Rs.100/- (at his own cost) immediately after the acceptance of the work.

6. Contractor’s services shall be available throughout as per requirement specified by Officer- in-charge including holidays. The contractor shall keep adequate number of well experienced and trained staff. The services are to be provided only to the Company’s employees, the authorised Consultants, Contractors, Auditors, Govt. officials. No outsider will be served food without prior permission of the Officer in charge.

7. Allotment of rooms, catering services inside or outside of the Guest House to TMH employees, consultants, contractors or outsider as the case may be, will be arranged by the Contractor only on written permission from the Chief Administrative Officer, TMC / Administrative Officer, TMH.

8. The Contractor must give staff allocation for front office, cafeteria, kitchen, washing, upkeep, security, maintenance staff etc.

MATERIALS:The Contractor shall use for the preparation of food only such raw materials which are first Class quality as indicated in Annexure-VI.

INSPECTION: The Contractor shall make available for inspection his store room and kitchen etc. at any time, as per requirement of Officer- in-charge.

COMPLAINTS:The Contractor shall take all possible steps to ensure that no complaints are coming from employees, guests of company or others in respect of quantity, quality of services / food item served. Complaint book should be maintained by Contractor and should be always ready for inspection as and when required

Sweeping & mopping of all occupied rooms & dining halls daily and vacant rooms weekly once. Sweeping & mopping of passages, stair cases in hostel & dining hall areas once in a day. Cleaning of toilets, bathrooms, urinals twice in a day including cleaning of all such facilities

Repairing of faulty fittings & fixtures related to electrical, plumbing, aluminum, carpentry, air-conditioning, water coolers, water filters, deep freezers, televisions, computers, telephones, etc.

During the contract, as and when required the contractor shall replace fused bulbs, tube light, water filter candles, ceiling fans, exhaust fans, telephone instruments, remote controls, gas and faulty spare parts in the air conditioners etc items inside as well as outside the building.

The replacement of the item, spare part should be of same brand. The replaced spare parts shall be the property of the contractor, except the compressors (air-conditioners, deep freezers, water coolers, etc which shall be return to TMC.

M/s. Voltas or its authorized contractors shall be employed for repairs of air-conditioners, deep freezers water coolers, etc. Minimum three preventive services shall be done for all the air- conditioners, deep freezers, water coolers, water filters, etc all. Whenever asked, the record of such periodical services shall be submitted to TMC.

All the preventive & breakdown maintenance, repairs and replacement of the equipments, appliances etc shall be with the prior intimation to TMC.

Landscaping including tube well within the campus. Shall do overhead and underground water tank cleaning (at least 3 times in a year) from the

reputed agencies and produce the water test certificate from the BMC approved labs. The complaint register shall be maintained and shall be produced as when ask by the TMC.

Efforts shall be made to attend the complaints on the same day. The contractor shall employ qualified/license holder technicians/contractors for attending the complaints/maintenance works.

The contractor shall take over the facility with the inventory. At the end of contract period, the contractor shall handover the facility with all inventory in place i.e. all the fitting and fixtures, equipment, appliances shall be in working condition.

Only female attendant will be deployed for carrying out housekeeping job in the rooms of female Occupants at both the places i.e Anushakti Nagar & Paylipada.

FOOD PRODUCTION & FOOD SERVICES

Food Production and food service - with all consumables, perishable, raw material etc for cooking Contract must ensure installation of Biometric Attendance System to ensure count of actual services availed

for breakfast, lunch & dinner. The contract will be paid for the Minimum Assured Business or at actual whichever is higher, subject to the Contractor providing the attendance marked on Biometric System as mentioned in Annexure I & II

Standard Breakfast, Lunch, dinner etc should be provided to the guests and charged as per the rates mentioned in the Rate list.

Standard Breakfast and dinner for the hostel occupants is included in the scope of the contractor for food services.

Contractor must ensure Installation of Biometric Attendant System in order to ensure count on actual services availed for Standard Breakfast, Lunch & Dinner. The payment will be done on Minimum Assured Business and anything above the Minimum Assured Business shall be paid on actual basis subject to the contract provides the attendance marked on Biometric Attendant System

All the items should be freshly prepared in the kitchen by using good quality ingredients. The contractor shall provide all groceries, vegetables, oil, masala etc. required for preparation of food. The contractor shall get the samples approved by officer-in-charge before procurement.

The contractor will also provide the cutlery & crockery. TMH will approve the samples of the same and the required cutlery & crockery, Glassware may be procured.

Special lunches Hi-tea also should be arranged as per the requirements in line with the rate list. The contractor will also maintain a complaint register. The vegetables should be soaked in salted water to ensure that the traces of pesticides are removed and

then it should be washed thoroughly. Cooking should be done with hygiene in reputed brand of refined healthy oil as approved by officer-in-

charge. It should bear the ‘Agmark’ wherever available and with the approval of officer-in-charge. The food should not have excessive oil, spices, chilies and salt.

The sweet etc. being provided should not be artificially coloured and should be free of silver foil etc. The dining tables, chairs and floor etc. should always be kept cleaned and arranged properly.

time of service. The kitchen including the tiles, drainages and flooring should be cleaned thoroughly including the tiles,

drainages and flooring on daily basis. The chopping boards, knives should be cleaned properly on daily basis. The cleaning of SS plates and the kitchen utensils should be done properly and the utensils etc. should be kept sparkling clean.

Special cleaning of the kitchen equipment and utensils etc. including the kitchen may be done every week or as and when needed or as directed by officer-in-charge.

All the cooks, kitchen staff should wash their hands while entering the kitchen area. The storage of the raw food should be done properly and at the correct temperature. The cleaning of the stores should be done every week and also as and when directed by officer-in-charge to ensure that the area is free from pests and rodents.

The food items like pickles, jams, sauces etc. should not be stored beyond the expiry dates. The staff may undergo annual medical tests as prescribed by Municipal Corporation.

FACILITIES SERVICES It includes the plumbing services, carpenter services & electrical maintenance services pn day to day basis. It includes the soft maintenance on day to day basis It does not include the major repairs. The staff should follow safety norms & guidelines.

UNIFORMS All the staff should be in uniform and remain neat and clean e.g. hair properly cut, nails properly trimmed etc. The cooks and other kitchen staff should wear proper uniforms and the protective gears to ensure that no

accident takes place. The entire uniform set including the shoes must be provided by the contractor. Each staff is to be provided with two sets of uniform. Different type of uniform should be issued to the following category of staffs :

a. Reception staffb. Food Production Staffc. Utility staff in the kitchend. Stewardse. Housekeeping stafff. Facility staff like plumber, electricians etc.
