    CONSTITUTION AND BYLAWS

    PREAMBLE

    We, the students of La Salle College Antipolo, imploring the aid of the Almighty God and guidedby the prayers and the way of life lived by St. John Baptist e La Salle, affirm our inherent demo!rati!right to pursue an independent, "ust, and genuine student government that shall inspire us to be!ome trueLasallians for God and !ountry, strengthen our learning and formation as Lasallians who se!ure harmony,unity and !ooperation among ourselves and with those who, together with us, ma#e up the Lasallian!ommunity of persons, s!holars, learners and !iti$ens, !ommitted to the advan!ement and defense of our rights and welfare, safeguard the a!ademi! freedom and integrity of the !ollege, affirm human dignity andworth, promote the !ommon good, a!tuali$e our responsibilities as heralds and !atalysts for so!ial!hange and a!tion, instill a so!ial !ons!iousness that will stri#e a balan!e between self and servi!e toothers, healthy !ompetition and !ooperation, freedom and responsibility and embody our open%mindedideals, noble aspirations and genial vision of a humane and sovereign so!iety where truth, "usti!e,freedom, love, e&uality and pea!e reign, do solemnly ordain and promulgate this Constitution.

    ARTICLE I

    GENERAL PROVISIONS

    SECTION 1. 'his Constitution shall be #nown as LSCA '() Student Government Constitution, whi!hshall here in after be referred to as the '() SG Constitution.

    SECTION 2. 'his Constitution shall govern the LSCA Student Government also #nown as the StudentCoun!il together with the Coun!il of *residents +SCC*- in the !ollege.

    SECTION 3. 'he LSCA Student Coun!il and the Coun!il of *residents as mandated by theundergraduate students shall be the offi!ial representative of all bona fide students of LSCA.

    SECTION 4.  'he SCC* Logo shall be

    ARTICLE II

    DECLARATION OF OBJECTIVES

    SECTION 1. 6a!ilitate !ommuni!ation between students and the administration, fa!ulty,fellow students and the rest of the LASALL7A8 !ommunity.

    SECTION 2. 5e!ogni$e, prote!t and uphold the students9 benefits, privileges, rights andwelfare.

    SECTION 3. )nderta#e student a!tivities and pro"e!ts whi!h promote the reali$ation of the'()9s ob"e!tives.

    SECTION 6. 'he Student Coun!il together with the Coun!il of *residents shall promote theLasallian identity of spirit of faith, $eal for servi!e and !ommunion in mission.

    ARTICLE III

    STUDENTS’ RIGHTS AND OBLIGATION

    SECTION 1. (very student has the right to be properly informed of the programs, rules andregulations and poli!ies of the a!ademi! !ommunity.

    SECTION 2. (very student has the right to have a!!ess to his; her offi!ial re!ords and other pertinent do!uments and papers pertaining to offi!ial a!ts, transa!tions or de!isions.

    SECTION 3. (very student has the right to !ondu!t s!holarly resear!h freely and to publish,

    dis!uss and e:!hange findings and re!ommendation for the purpose of a!ademi!development.

    SECTION 4. (very student has the right to be a!ademi!ally evaluated based on ob"e!tive!riteria.

    SECTION 5. (very student has the right to vote for representative and offi!ers.

    SECTION 6. (very student has the right to proper representation in all poli!y%ma#ing bodiesinside the !ollege.

    SECTION . (very student has the right to assemble and to freely and responsibly e:presstheir views, opinions and grievan!es.

    SECTION !. (very student has the right to establish, organi$e, "oin and a!tively parti!ipate in!lubs, organi$ations, groups and other asso!iations for purposes not !ontrary to e:istingpoli!ies.

    SECTION ". (very student has the right ob"e!tive presentation and independent operation of the student% !ontrolled publi!ations, sub"e!t to the !annons of responsible "ournalism.

    SECTION 1#. (very student has the right to legitimate and responsible use of ade&uate, safe,!lean and effi!ient s!hool supplies.

    SECTION 15. Lasallian Students shall ta#e responsibility in the e:er!ises of their rights withdues regard to the rights of other.

    SECTION 16. Lasallian Students shall observe mutual respe!t and support.

    ARTICLE IV

    GOVERNMENT STRUCTURE AND OFFICERS

    SECTION 1. Statement of the Government Stru!ture'he 'ertiary (du!ation )nit Student Government +'()%SG- of La Salle College Antipolo,with its mitigating power to establish a government, shall be a demo!rati! union that shallempower the '() students9 rights and as well promote e&uality and prosperity amongstindividuality without undermining the institutional mission and vision.

    SECTION 2. 'he *ower of the Student Body'he '()%SG shall

    2. have the ability to establish its own government,=. ena!t laws amongst members of the !oun!il,>. mitigate the relation between students and the institutional leaders and

    sta#eholders?. support students9 endeavor with a!!ordan!e to the 1ission%@ision statement of the

    College.

    SECTION 3. Suffrage'he '()%SG shall re!ogni$e the students9 right to vote, with a!!ordan!e to the demo!rati!stru!ture of its established government. 'he '()%SG, in relation its governmental stru!ture,shall re!ogni$e the e:isten!e of the Commitee on (le!tions +C1(L(C- that shall embodythe students9 suffrage.

    SECTION 4. *oliti!al Body and (stablishment of 6a!tions'he '() students shall have the right to establish politi!al fa!tions to provide politi!aloptions to students that shall be at least two +=- parties.

    ARTICLE V

    STUDENT GOVERNMENT FUNDS

    SECTION 1. 'he '() Student Coun!il 6und shall !ome from a fi:ed !ontribution of every studentenrolled during !urrent s!hool year and other sour!es derived from approved fund raisingpro"e!ts.

    SECTION 2. 'he amount of !ontribution shall be determined by the (:e!utive Board and shall be!olle!ted upon enrollment for the first semester, se!ond semester, and summer term.

    SECTION 3. 'he !olle!tion of the fi:ed !ontribution shall be underta#en by the A!!ounting ffi!e andshall be put into a trust fund otherwise #nown as the LSCA Student Coun!il 6und andrespe!tive rgani$ation 6und.

    SECTION 4.  All e:penses of the !oun!il shall be paid out from this fund in a!!ordan!e with approvedguidelines on a!!ounting and auditing poli!ies and pro!edures.

    SECTION 5.  All other authori$ed !olle!tions by the '() Student Coun!il, through the A!!ounting ffi!efor a spe!ial purpose shall be used for su!h purposes only. Should there be a balan!e from

    su!h fund, it shall be automati!ally transferred to the general fund of the !oun!il +SC 6undor respe!tive rgani$ation 6und-.

    SECTION 6. 'he balan!e of the '() Student Coun!il and rgani$ation 6und is !umulative therefore thebalan!e for a spe!ifi! term shall be added to the fund for the ne:t term and su!!eedingyears.

    SECTION . Should therefore be any proposal or need for an in!rease of !olle!tions for the '() SC6und or respe!tive rgani$ation 6und, the (:e!utive Board shall !onvene and !ondu!t!onsultations through mass surveys and;or assemblies of their !onstituents. 7f the ma"ority+42- of the student population agrees, therefore, the proposal of the in!rease isapproved. Below is the s!ope of !onsultations

    SECTION !. 6or all purposes of this fund, the in!umbent offi!ers and their su!!essors must use this fundto benefit the students in general.

    ARTICLE VI

    COMELEC$ ELECTION CAMPAIGN AND ELECTION

    SECTION 1. 'he Committee on (le!tion +C1(L(C- shall a!t as &uasi%"udi!ial Committeethat will organi$e, !ondu!t and manage the ele!tion of the members of the Board.

    SECTION 2. 'he C1(L(C shall enfor!e and administer all rules and regulations relative tothe !ondu!t of the ele!tion.

    SECTION 3. 'he C1(L(C shall be !omposed of nine +E- students, and three +>- fa!ultymembers.

    SECTION 4. 'he C1(L(C shall perform the following fun!tions?.2 (nsure that the guidelines and pro!edures for the !ampaign and ele!tions

    are properly observed and implemented.?.= Condu!t ele!tions.?.> Canvass ele!tion results.?.? Announ!e results and pro!laim winners

    SECTION 5. 'he term of the C1(L(C shall begin on the first day of =nd semester until thelast day of 2st semester of the su!!eeding s!hool year 

    SECTION 6. 'he C1(L(C members shall ele!t among themselves a Chairman, who shalldire!t C1(L(C operations and preside over meetings.

    SECTION . 'he C1(L(C shall draw up and administer pro!edures for student !oun!ilele!tions, pursuant to the provisions of the Constitution.

    SECTION !. C1(L(C de!isions shall be made through a simple ma"ority vote.

    SECTION ". 8o C1(L(C member shall be eligible to run for any offi!e in the student!oun!il in the semester immediately following his term in the C1(L(C.

    SECTION 1#. (le!toral !ases, protests, and petitions shall be forwarded to the C1(L(C.

    SECTION 11. ne C1(L(C member shall preside over the ele!tions for professional andspe!ial interest organi$ations.

    22.2 'he C1(L(C shall ma#e sure that there is no va!an!y in the #ey fieldpositions. 'his in!ludes the announ!ement of filing of !andida!y, the ele!tionproper, and the de!laration of winners.

    22.= 7n the event of a va!an!y, re%ele!tion would be held for that spe!ifi!position

    22.> 7n the event that no one applies for the said position, the C1(L(Ctogether with the Coun!il of *residents and the supervision of the adviser will!onvene on the appointment of the va!ant position

    22.? Student A!tivities Coordinator shall be informed of all the de!isions madeby the C1(L(C

    SECTION 12. (le!toral Campaign2=.2 'he !ampaign must be !ondu!ted that befits the dignity of the

    rgani$ation.2=.= *arty names, !ampaign gimmi!#s and materials must uphold the dignity

    and integrity of the LSCA Student Coun!il and fellow !andidates.2=.> Campaign posters ; materials should be approved by the Student

     A!tivities Coordinator and the 8L offi!ial ballots will be used for the ele!tions.2?.? 'he C1(L(C will tally the number of the ballots with the number of 

    voters.2?. After voting, the ballots will be put in a sealed envelope and will be

    submitted to the ffi!e of Student Affairs.

    2?.F @oters must observe given guidelines for ballots to be !onsidered valid.2?.3 Canvassing of ballots by the C1(L(C will ta#e pla!e immediately after ele!tions.

    2?.0 (a!h party;!andidate is allowed one +2- poll wat!her per !anvassingroom.

    DUTIES AND RESPONSIBILITIES OF STUDENT COUNCIL

    AND COUNCIL OF PRESIDENTS

    SECTION 1. General 6un!tions of the Student Coun!il Coun!il of *residents2.2 'o plan, !oordinate, and implement a formation; development program for student leaders,

    together with the College administration, as well as !o%!urri!ular and e:tra%!urri!ular a!tivities

    whi!h will enri!h the students9 so!ial awareness, interpersonal s#ills and the Lasallian !ore

    values of 6aith, Servi!e and Communion,2.= (stablish a lin# between the administration, fa!ulty, parents and students by representing the

    student body in the de!ision%ma#ing of the s!hool through the College ean9s Coun!il and by

    disseminating vital information on matters whi!h affe!t the s!hool !ommunity, espe!ially the

    0. Colle!t and summari$e needed data in the preparation of finan!ialreports dealing with all phases of the finan!ial, a!!ounting and operating

    a!tivities of the SC.E. *repare semestral finan!ial reports dealing with all phases of the

    finan!ial a!tivities of the offi!es under the SC stru!ture and present su!h

    reports to all offi!es !on!erned.24. 1onitor fundraising a!tivities initiated by the offi!es under the SC.22. 1a#e periodi! reviews of the in!ome and e:penditure status of ea!h

    budgetary unit for any needed remedial a!tion.2=. 5eview and monitor all re!eipts and disbursements of funds within the

    SECTION 3. *rofessional;A!ademi! and Spe!ial rgani$ations>.2 (a!h offi!ial organi$ation in La Salle College, Antipolo City shall have their own set of offi!ers

    and their powers, fun!tions, duties and responsibilities as stipulated or defined by the

    organi$ation9s respe!tive !onstitution and bylaws re!ogni$ed by the SCC* and the ffi!e for 

    Student Affairs.>.= 'he offi!ers of the a!ademi! and spe!ial organi$ations are to be ele!ted ea!h year by the

    members of the organi$ation a!!ording to the rules and regulations set up by the organi$ation9s

    !onstitution and bylaw.>.> 'he head for Student Affairs through the re!ommendation of the SC and College Administration

    may appoint organi$ation heads spe!ifi!ally for Spe!ial 7nterest rgani$ations and Lasallian

    istri!t organi$ations.>.? 'he organi$ation offi!ers are ele!ted annually through a general assembly set by the in!umbent

    offi!ers at a date and venue approved by the Student A!tivities Coordinator.>. 'he organi$ation 6a!ulty 1oderators should be present during this a!tivity.

    ARTICLE '

    ACCOUNTABILITY OF SCCOP OFFFICERS

     All SCC* offi!ers shall at all times be a!!ountable to the studentry who they must servewith utmost responsibility, integrity, loyalty, effi!ien!y and professionalism.

    ARTICLE 'I

    THE E'ECUTIVE BOARD

    SECTION 1.  'he (:e!utive Board, whi!h shall hereinafter be

    referred to as (B, shall be the highest governing body and

    representative authority of the '()%SG.

    SECTION 2.  'he (B shall be !omposed of the Student Coun!il and

    the Coun!il of *residents

    SECTION 3.  'he (B shall have the following powers, duties and

    responsibilities

    >.2 'o uphold and enfor!e the provisions stipulated in this Constitution and its bylaws.

    >.= 'o outline and enfor!e basi! poli!ies that shall fa!ilitate the performan!e of itsduties and responsibilities.>.> 'o dis!uss national, se!toral and !ollege%wide issues and a!ademi!%related

    matters, pro"e!ts, programs and !ampaigns to be presented to the Coun!il of *residents.

    >.? 'o ensure fair, effi!ient and effe!tive representation in all College !ommitteeswhose servi!es and de!isions affe!t the welfare of the students.

    >. 'o !reate departments and ad ho! as may be ne!essary to dis!harge its fun!tions.

    SECTION 1. 'he members of the (B shall determine the fre&uen!y

    SECTION 2. Any member of the (B may !all spe!ial meetings if

    MEETINGS

    ARTICLE 'IV

    ARTICLES OF IMPEACHMENT

    SECTION 1.  All SCC* ele!ted offi!ers may be removed from offi!e, on impea!hment for, and!onvi!tion of, !ulpable violations of this Constitution and betrayal of publi! trust.

    SECTION 2. 'he following may be grounds for impea!hment=.2. Any willful violation of this Constitution and its bylaws.=.=. Gross negligen!e of duty.=.>. 7llegal disbursement of funds.=.?. Any behavior whi!h undermines the integrity of the '()%SG.=.. Any other forms of gross mis!ondu!t as provided by the '()%SG poli!ies.

    SECTION 3. Any student or offi!er of the SCC* may file a resolution of impea!hment against anySCC* offi!er. 'he resolution must be addressed to the Student A!tivities Coordinator.

    SECTION 4. 'he poli!ies on impea!hment shall be as follows?.2. 'he Student A!tivities Coordinator shall order investigations of !ases of 

    impea!hment and re!all at its own dis!retion or on the basis of written !omplaintsfrom any student or offi!er of the SCC* within seven regular s!hool days +notin!luding Sundays and holidays-. 'he Student A!tivities Coordinator shall thende!ide whether to initiate impea!hment or re!all pro!eedings or not. Should theStudent A!tivities Coordinator fail to meet this deadline, !omplaints shallautomati!ally be dismissed.

    SECTION 2. 7n !ase of in!apa!ity in the dis!harge of duties, removal from offi!e or resignationof the *resident, the @i!e *resident for 7nternal Affairs shall ta#e the position of the*resident while maintaining his;her fun!tions and powers as @i!e *resident for 7nternal

     Affairs until the ne!essary appointment is made.

    SECTION 3. 7n !ase of in!apa!ity in the dis!harge of duties, removal from offi!e or resignationof any (B member e:!luding the *resident, the *resident shall endorse a Student Coun!iloffi!er.

    SECTION 4. 5esignation shall only be valid if it !on!erns health, a!ademi!s, among others,sub"e!t to the approval of the (B. 'here shall be no leave of absen!e from the SCC*duties, e:!ept for the !ase of in!umbent SCC* offi!ers see#ing to run for offi!e in thene:t general ele!tions. Su!h offi!ers are, however, re&uired to resume their original postsand !omplete the term of their original offi!e after ele!tion.

    ARTICLE 'VI

    AMENDMENTS

    SECTION 1.  Any attempt to amend or revise this Constitution shall have to !omply with the

    following pro!edures in se&uen!e

    2.2. Any SCC* offi!er may propose to amend or revise this Constitution in writing. Su!hproposal should be addressed and submitted to the *resident.

    2.=. 'he *resident shall !all for an assembly of all ele!ted offi!ers of the SCC*. 'heassembly shall allow the proponents to dis!uss his;her points and reasons for theamendment or revision.

    2.>. (a!h offi!er in the assembly shall vote whether in favor or not in favor of theamendment or revision. A ma"ority vote of all the ele!ted offi!ers in favor of the

    amendment or revision shall be needed to !ontinue with the ratifi!ation pro!ess.2.?. Any amendment or revision of this Constitution shall be valid only when ratified by

    ma"ority votes !ast by the members of the '()%SG at a plebis!ite !alled for by thispurpose.

    2.?.2. 'he membership of the '()%SG shall !omprise of all the bona fide studentsof the College as stated in the Arti!le 77 of this Constitution. 

    SECTION 2. 'here shall be no amendment or revision of this Constitution within three years

    following its ratifi!ation.

    SECTION 3.  Any amendment or revision to this Constitution shall be transmitted and

    !ommuni!ated to the students within ten s!hool days after its ratifi!ation.

    ARTICLE 'VII

    TRANSITORY PROVISIONS ( REPEALING CLAUSE

     All e:isting resolutions, !odes, 5ules of 7nternal Governan!e and poli!ies !onsistent with this Constitutionshall remain operative until amended, repealed or revo#ed.

    SEPARABILITY CLAUSE

    7f any provision of this Constitution is de!lared invalid, the remainder thereof not affe!ted thereby shall!ontinue in full for!e and effe!t.

    ARTICLE 'I'

    EFFECTIVITY CLAUSE

    SECTION 1. 'his Constitution shall ta#e effe!t following the ratifi!ation by a ma"ority of fiftyper!ent plus one votes !ast by enrolled students at a plebis!ite !alled for by this purpose.

    SECTION 2. 'his !onstitution shall be applied on the ne:t General (le!tions for the A!ademi!

    ear upon the approval of the administrators and its publi!ation.

    SECTION 3. )pon ratifi!ation, this !onstitution shall supersede all previous !onstitutions of the

    Student Coun!ils, and all pro!edures and poli!ies not !onsistent with this !onstitution shall

    thereby be amended.
