Injury and Illness Incident ReportOSHA’s Form 301, the “Injury and illness Incident Report”, is one of the first forms employers must fill out when a recordable work-related injury or illness occurs. This form, or its equivalent, must be filled in within 7 calendar days after receiving information that a recordable work-related inju-ry or illness has occurred. The form must be kept on file for 5 years following the year to which it pertains.

Capitol Connection Q & A for ContractorsBy Shauna Krause, President, Capitol Services, Inc.

We speak volumes of words to each other each day, but one word makes all the difference when written into contractor’s regulations. It’s been a whirlwind of change as contractors nail down the benefits of operating under the new LLC (Limited Liability Company) rules now available in California…

Q: I have a current General Building license and I am trying to find out if I can pay my RME as a 1099 Independent Contractor. The reason for this is that we don’t have work year-around and we just plan to pay him piece-meal when we have a project.

A: RME stands for Responsible Managing Em-ployee. 1099 forms are typically used when you are paying someone who is not your employee. An RME must be a bona fide employee of the firm and be regularly employed by the firm and actively involved in the operation of the business at least 32 hours per week or 80 percent of the total business operating hours per week, which-ever is less. That being said, there is no wage re-quirement for RME’s so technically you can pay him “piece-meal” as long as he is on payroll and receiving wages at least 80 percent of the time that you are actively engaged in projects.

Q: I am an attorney and my firm has used your company several times in the past to assist my clients with CSLB issues. I am in need of your as-sistance again. One of my clients, an engineer-ing firm with a General Engineering “A” license, is currently structured as a corporation in Califor-nia. They want to continue to operate as a cor-poration, but they plan to form a LLC to own the corporation, as opposed to the individuals have direct ownership. Is this possible?

A: The CSLB does not have any rules or regula-tions with regards to who can or cannot own a licensed corporation. When applying for a license, the CSLB does require you to disclose how much equity the qualifying individual has in the company (if any), however they do not look in to ownership beyond that. As long as your cli-ent intends to continue to do business as a cor-poration, and not as an LLC under the guise of a corporation, there is no need to inform the CSLB of the ownership transfer.

Q: Is there any way to change a sole proprietor-ship license to a different entity without re-ap-plying for a new license?

A: Any time you change or form a new entity you

are required to re-apply for a contractor’s license. In certain circumstances you can request that a sole proprietor license number be transferred to the new entity, but that still involves re-applying for the license. Please feel free to call our office if you’d like assistance in this process.

crease or eliminate unwanted and distracting noise. In other work environments, even not-so-loud sounds can be distracting. Constantly ringing phones, conversations, and loud faxes, copiers and printers can distract workers from their job tasks.

Portable electronic devices can be the source of distractions in some work environments. If these devices are approved in your workplace, make sure you keep them on a low volume or silent as a courtesy to your coworkers. To maxi-mize work safety and performance, turn email notifications off and disable instant messag-ing. If possible, avoid answering the phone or emails when you’re in the middle of a task.

Wearing headphones on a construction or in-dustrial site can be dangerous if it prevents workers from hearing warning signals such as mobile equipment backup alarms, and safety instructions. Headphone use also has the po-tential to interfere with communication, and worker focus. Talking on the phone while walk-ing around can also be a distraction and can result in injury.

In many work situations, distractions and inter-ruptions are unavoidable. Some distractions can even lead to workplace injuries. However, many of these incidences can be controlled or prevented. Regardless of the distraction, your first priority should be to keep your mind and your focus on your safety and the safety of oth-ers, and then focus on the task at hand.

Workplace distractions can result in work errors or accidents. Before addressing or responding to another person, workers should disengage or shutdown any work tool, equipment, or process that requires their attention. On-the-job training should include instructions to not interrupt others during a critical job phase or process. Instruction manuals and procedural guidebooks should be kept on site to answer frequently asked questions, or a supervisor should be consulted, and thereby eliminate the need to interrupt or distract other workers.

External noises from tools, mobile equipment, and processes can be distracting in industrial and construction work environments. In work situations where loud or constant noise is un-avoidable, hearing protection devices can de-

Resource Directories are also distributed to the AIA SB Chapter, Santa Barbara Board of Realtors, local retail home design showrooms, material suppliers, banks, building departments, public agencies, and organizations. The SBCA will also place an online version of the Resource Directory on the webpage to maximize your advertising dollars and reach a larger audience. Additional copies can be picked up at the SBCA o�ce during normal business hours and are available free of charge.
