Weatherization and Auditing Classes at Santa Barbara City CollegeBy Patrick Foster, SBCC Construction Academy

agnostic and remediation phases of using less energy and water. It covers blower-door testing, infra-red scanning, and duct-blasting and teaches about sealing the building shell, installing insula-tion and flashing properly, sealing HVAC ductwork, etc.

The Sustainability Audit class (CT 127) covers the basic audit pro-cess (energy consumption, water issues, indoor air quality), audit tools (visual inspection, diagnostic tools, computer programs), creat-ing audit forms (surveys, inspector checklists, summaries, and recom-mendations), audit business issues, performing an on-site inspection, combustion gas inspections, etc. This is good pre-BPI training for those who need extra exposure to these topics and skills.

As many of you know, the Con-struction Technology program at SBCC got its AS/Certificate status last summer. Now students, car-penters, contractors, realtors, and architects can continue to take “drop-in” classes in a variety of building topics, but can also now earn a City College Certificate (8 construction tech classes only) and an Associate of Science de-gree in Construction Technology (with some additional general ed. classes).

This Spring semester (beginning in late January), the Construction Academy is offering 7 16-week classes in the construction field. Rodney Utt is teaching his yearly cabinet making course (CT 115), and Jim Cunningham is teaching Intro to Construction Trades (CT 111) and Contractors License Prep (CT 130). Patrick Foster is offering Roof Framing (CT 113), Measur-ing and Calculating (CT 118, trade math), and 2 new “green-collar” classes (Weatherization and Sus-tainability Audit).

Let me put in a word about the weatherization and auditing class-es. It is becoming obvious that the first step toward energy and water efficiency is weatherization rather than alternative energy. We will need non-fossil-fuel energy in or-der to stop contributing to global warming and negative climate change, but the easiest and cheap-est way to conserve energy (and water) is to tighten up our homes and businesses. The Weatheriza-tion class (CT 124) covers both di-

Whether in Nevada or California a solar contrac-tor can’t light up your life without the proper license, but which one is right for the job? We offer clarification on the rules for selling home improvements in California. Another contrac-tor gives us the ‘key’ to a slim chance on ‘locking down’ an exam waiver…

Q: We’re solar contractors in NV and have a ques-tion on the best classification to apply for in CA. We called the Contractors Board in Sacramento and they told us your state has a “C-46” (Solar) license. We called back a second time and the new person who answered said we could get the “C-46” or an electrical license “C-10.” We found you on the Internet and you look to have a lot of experience in these issues. In your opinion, which license would be best?

A: In order to shed some ‘light’ on this topic, I am sending you an “Industry Bulletin” from 2010. The CSLB published this a few years ago to re-spond to questions regarding which classifica-tions are authorized to perform solar projects. This “Fact Sheet” lists 7 different classifications that can properly perform some or all aspects of solar energy projects.

The “C-46” is a broad classification, which allows contractors to “install, modify, maintain, and re-pair thermal and photovoltaic solar systems”. “C-10” contractors are “authorized to perform any solar projects which generate, transmit, transform or utilize electrical energy in any form for any purpose”. “A” (General Engineering) and

“B” (General Building) contractors are also autho-rized to install solar energy systems.

The real question is what classification you can qualify for. In addition, depending on the license classification you hold in NV, you may be eligible to secure a waiver of the trade test. I hope this information helps. Call us if you have any further questions.

Q: I have a question and my business partner re-ferred me to your company. What is California’s rule for home improvement salesman? Some places I’ve worked treat them as independent contractors and others treat them as employ-ees.

A: In CA, a Home Improvement Salesperson (HIS) is a person employed by a licensed contractor to solicit, sell, negotiate, or execute home improve-ment contracts. A Home Improvement Salesper-son can work for a number of contractors and sell a variety of goods and services, but must be registered with the CSLB separately for each con-tractor for which he/she is employed.

Q: I got a solicitation in the mail (not from your company) stating that the CSLB allows individu-als to request a waiver of the exams if they have been an Officer of the corporation or a “key em-ployee” for at least five years. Do you know if this is true and what is a “key” employee?

A: That is true under certain circumstances. The CSLB only allows this waiver request for individ-

uals seeking to replace the Qualifying individual on an existing license, not for the purposes of obtaining a new license. According to B&P code 7065.1(c), in order to qualify for this waiver the following conditions must exist:

For five of the seven years immediately 1. preceding the application for replacing the Qualifier, the corporation or LLC must have continually employed the new Qualifying individual in a supervisory capacity in the same classification(s) being applied for.For five of seven years immediately preced-2. ing the application, the corporation or LLC has held an active license in good standing in the same classification(s) being applied for.The corporation or LLC has not requested 3. a waiver under this subdivision within the past five years.

As far as what it meant by “key employee”, I be-lieve the company that you received the solicita-tion from is referring to item 1.

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.
